Welcome According to the Transportation Research Board, the Taft Tunnel, built in 1837 is the oldest railway tunnel still in use in the United States. This tunnel is part of the Metro North Railroad as it winds through Connecticut and back into New York. Beyond the knowledge that this tunnel has been resilient enough to still be in use is amazing but what is even more amazing is that this Region has not seen fit to replace this tunnel before it reaches its 200th year anniversary. Moving south towards the Hudson River, another marvel of engineering the Hudson River Tunnel used every year by millions as a daily commute between New York City and destinations throughout New Jersey is over 110 years old and still remains in use as the only regional transit tube for AMTRAK and New Jersey Transit along this southern route. It has been calculated that unexpected disruptions or complete closing of the Hudson River Tunnel for the NY/NJ Region could spell disaster for over 25% of the Nation GDP. The devastation caused by Sandy, climate change, other weather and continual wear and tear on this Tunnel is a daily reminder that our Nation faces grave and unforeseeable consequences from an aging and crumbling infrastructure. Although not limited to transportation, these concerns of degradation are also found in our water systems, both storm ad drinking water, within our energy grids, fossil oil and gas, our communication systems, cyber security and food sourcing. On the positive side, these challenges have solutions and building innovations and technologies ready to be utilized to affect positive and sustainable results. The creative minds in the US and throughout the world understand this is a collective mission to use these skills to build safer infrastructure that improves quality of life, to further train and upgrade the abilities of individuals seeking work in existing and new construction trades, project, safety management, software applications, quantitative and qualitative controls and administration. Where Business Comes to Grow The Manhattan Minority Business Development Agency (MBDA) Business Center is one of 33 MBDA business centers located across the country. Operated by the Business Outreach Center (BOC) Network, the Manhattan MBDA Business Center provides technical assistance and strategic business consulting for growing Minority Business Enterprises (MBEs). Its mission is to help clients achieve higher levels of growth and competitiveness both domestically and internationally. What are the MBDA and the BOC Network? The Minority Business Development Agency is a federal agency within the US Department of Commerce. As demographic trends continue, the ability for minorities to establish and grow businesses will be fundamental for the health of the US economy. The MBDA seeks to facilitate this growth as part of the Department of Commerce’s general mission of supporting overall US economic growth. The Business Outreach Center Network is a nonprofit organization that seeks to improve the economic prospects of underserved populations by supporting entrepreneurship among women, minorities, and immigrant communities. BOC Network’s affiliate, BOC Capital, provides credit-related products in support of this mission. What businesses are eligible to be clients? The business must be owned or controlled by the following persons or groups of persons: African Americans, Hispanic Americans, Asian and Pacific Islander Americans, Native Americans (including Alaska Natives, Alaska Native Corporation and Tribal entities), Asian Indian Americans, and Hasidic Jewish American. How does the Manhattan MBDA Business Center support its members? MBDA Business Centers support businesses with: 1) Access to Capital Identifying financing and bonding opportunities and connecting businesses with alternative lenders for the financing of purchase orders for rapid scalability. He has over 20 years of experience in R&D for embedded systems and wireless technology industry, where he has successfully managed joint R&D programs with Asian, European, and U.S. companies. Babak received his Ph.D. in Electrical Engineering at the University of Massachusetts, Dartmouth, master’s degree in Electrical Engineering at the State University of New York at Stony Brook, and bachelor’s degree in Electrical Engineering at the State University of New York at Stony Brook.

Dr. Robert Passwell Ph.D., Dist. M. ASCE - Distinguished Professor of Civil Engineering at the City College of

New York, the flagship institution of The City University of New York (CUNY). He served as its Interim President from 20092010. He’s the emeritus Director of the College’s University Transportation Research Center, Region II and the founding Director (2001-present) of the CUNY Institute for Urban Systems (CIUS). A civil engineer and former CEO of the Chicago Transit Authority, Dr. Paaswell is an internationally recognized expert in public transportation issues and consulting.

Keith D. Wright - Senior Program Manager of Capacity Building for the Port Authority of NY/NJ. -

Now in his second tour with the PANYNJ, Wright’s assignment is to identify and expand prime and subcontracting opportunities for the MWBE community to fully participate in the agency’s Ten Year $32.2 Billion Dollar Capital Plan. Wright received a Master of General Administration from the University of Maryland, a Bachelor of Arts degree from Rutgers University, and completed the program for management development at Harvard University’s Business School and served on the board of the Hurston\Wright Foundation.

LB Electric provides electrical systems, testing, solar (photovoltaic), designs and installation for major organizations, including, but not limited to: commercial, industrial, schools, hospitals and government agencies. In 2006, Leon purchased a 20,000 sq. ft. building, in Cedar Grove, NJ that serves as LB Electric’s corporate headquarters. Leon also serves as President and CEO of LB Training Center and LB Glass Enterprise. LB Training Center was developed to offer solar/photovoltaic design and installation training.

Overall Supervision of General Construction Activities and Coordination and Supervision of General Construction Projects and Estimating. Prior to launching his company he was the senior project manager for MB Builders, Inc. based in Brooklyn, NY where he had complete supervision of all General Construction Projects. Prior to that he was the project manager at Hirani Contracting Corp. in Floral Park, NY where he provided estimating and Coordination and Supervision of all Projects. He’s a graduate of Pratt Institute in Brooklyn, NY where he received his Bachelor of Architecture degree.

Shamsell Abdill, Associate Vice President at Armand Corporation (for Barbara Kushner)

Shamsell Abdill couples her certification in construction management with more than 16 years of professional experience to provide executive project oversight and management for Armand Corporation’s construction management division. Her diverse experience spans industry sectors and offers a valuable and distinct skillset. Shamsell has led Armand projects since 2013, guiding work that includes a $34 million public housing project involving 25 buildings across three developments in addition to multiple economic development and public agency projects throughout the city. Her prior experience includes public schools, correctional facilities, and landmark building restoration. Drawing on this broad exposure, Shamsell works to continuously expand Armand’s extensive portfolio both geographically and within market sectors.”

Julie uses the skills learned from being an Olympian, a world ranked champion athlete and award-winning coach to execute and implement large-scale complex projects and to motivate teams for winning outcomes. She is a noted subject matter expert and is a frequent panelist and guest lecturer on M/WBE inclusion policy, regulatory and statutory compliance, workforce diversity and inclusion, and in the delivery of innovative and results driven M/WBE, DBE and LBE programs. She provided executive leadership on iconic infrastructure projects such as the LaGuardia Airport Redevelopment, the Recovery and Resiliency efforts at the Port Authority, and the Coney Island Hospital Redevelopment.

Roxanne Neilson - Managing Director of the MBDA Manhattan Center

Roxanne Neilson serves as the Managing Director of the Minority Business Development Agency Manhattan Center located at 48 Wall Street. Ms. Neilson began her career in construction over 25 years ago as a member of Union Local 745 Hawaii working through apprenticeship and later as a journeyman formwork carpenter-welder in heavy construction. Through apprenticeship, Ms. Neilson earned a degree in applied engineering where she learned to read as well as interpret all MEP and Architectural plans/specifications. Ms Neilson earned a degree in Political Science and Public Policy from Swarthmore College.

almost two decades in the public sector. While at the public sector she held the positions of Executive Director for Design/ Build and Emergency contracts and Capital and In-House Painting for NYCDOT; and Group Vice President for MTACC’s East Side Access. Chris’ over 25 years of experience includes conceptual, preliminary and final design, program management and construction management for both highway and transit projects with various degrees of complexity, political visibility and with values up to $ 8 Billion.

Chris Ward, Executive Vice President - Velocity Holdings - Chris Ward has accomplished a life long mission to effectively assist and advocate for small and minority businesses success. After running the Port Authority for eight years, becoming a major VP for the international builder DRAGADOS and recently heading up AECOM, the world’s largest A/E firm, Chris has selected a position with BRAVO that empowers him to find MBE mergers, acquisitions and joint ventures. Interested in Removing Hurdles to Minority Participation on Public Works Projects; Wrap Up Insurance By Roxanne Neilson

The total premium to cover the owner and contractors under a wrap‐up tends to be significantly less than the total premium charged if each contractor buys its own insurance and includes that cost – plus any mark‐up – in its bid to the owner. The program facilitates the inclusion of small and minority businesses by eliminating insurance barriers. The wrap‐up provides a single point of focus for safety and claims management offering a coordinated approach specifically tailored to the project. This eliminates disputes among contractors and their insurers, reduces the disruption at the worksite, and can minimize potential delays attributed to accident investigation. Major infrastructure projects in our region will involve work over navigable waters. The failure of state workers compensation statutes to address longshore exposures coupled with court rulings denying state workers compensation benefits to maritime employees injured upon United States navigable waters (considered federal jurisdiction) prompted the U.S. Congress in 1927 to pass the Longshore and Harbor Workers Compensation Act (LHWCA). The 1927 LHWCA provided both compensation and medical benefits to any employee engaged in maritime employment (except the master or members of the crew of a vessel) who suffered a work‐related injury, disability, or death while upon the navigable waters of the United States.

Owner‐Controlled Insurance Program (OCIP) is an asset protection option designed for major construction projects that allows coverages for multiple insured entities to be “wrapped up” into a single consolidated insurance program. Increasing regulation in the insurance marketplace, coupled with the high rates of construction in NYS and the nature of small and disadvantaged minority and business enterprises, create structural inequalities for DBE/MWBE/and SBE’s who seek to compete for contracts on equal footing with more established firms. While OCIPs have been used for more than 30 years on private and public projects that include every type of constructionmunicipal projects, airports, highways, tunnels, and bridges -where there is no such program in place there are barriers to participation. OCIP’s can mitigate the impact of the structural inequality that minority and small local businesses face in the insurance marketplace. While many municipalities have no such policy in place for the work in their communities, steps can be taken to help municipal planners understand the impact, effect

savings, and assist local and small businesses better navigate the insurance marketplace- especially on public contracts where goals for participation have been placed. One of the first types of wrap‐up programs was the Defense Rating Plan (DRP). The DRP was developed for use at Department of Defense DOD projects, and later adopted by the Department of Energy DOE, where the work presented hazards that contractors’ insurance companies were unable to respond to. The DRP used insurance carriers to issue workers’ compensation and general liability policies, with one significant difference ‐ no insurance (or risk transfer was provided). The “project” concept was adapted by the private sector in the 1970’s in an effort to control the insurance costs associated with major projects which were ranging from 5 percent to 10 percent of total project cost. (1) Under an OCIP or “wrap‐up” program, a single insurance program provides insurance for the owner and all eligible (on‐site) project contractors and subcontractors. Wrap‐ups can be owner sponsored (OCIP), or sponsored by the prime or general contractor (Contractor Controlled Insurance Program – CCIP).

Longshore and Harbor Workers’ Compensation LHWCA covers employees in traditional maritime occupations such as longshore workers, ship‐repairers, shipbuilders or shipbreakers, and harbor construction workers, but only if they are employed to work on the navigable waters of the United States or in the adjoining areas, including piers, docks, terminals, wharves, and those areas used in loading and unloading vessels. Non‐maritime employees may also need to be covered if they perform their work on or over navigable water and their injuries occur there. Watercraft liability insurance covers losses arising out of the use or operation of watercraft. Projects over or adjacent to water that utilize barges or transport vessels need to address the watercraft liability exposure. This can be done by contractually requiring the specific contractor to provide coverage, but where operations affect multiple contractors, this coverage can and should be written on a project wide basis. The cost of these policies make small and minority contractors unable to be competitive when included in the bid package submission.

• Increasing regulation in the insurance marketplace combined with the nature of small and disadvantaged minority and business enterprises createstructural inequalities for DBE’s who seek to compete for contracts on equal footing with more established firms. • Projects over navigable water present unique challenges. Longshoreman’s Insurance and the regulations requiring coverages, are even more complex, the risks are multiplied and the risk pool ‐especially for local and minority contractors ‐is extremely small. The high premiums for these combined coverages present an obvious barrier to participation for DBE’s. • Benefits of OCIP insurance to MW/DBE/LBE/SBEs; A wrap‐up is both a raceneutral and race‐conscious program and can increase minority participation on projects. Wrap‐ ups help to level the playing field by eliminating or reducing conventional insurance expenses that for MW/DBE/LBE/ SBEs tend to be higher than those expenses for large contractors. In addition to the opportunity to work on construction projects, wrap‐ups also provide these firms with work experience references, recordkeeping experience and project safety training. • Feasibility studies should be conducted by State agencies to determine the viability of wrap‐up programs for mega projects well before the projects are bid. Insurers can utilize the results of such studies to provide more competitive products for the project; feasibility study information and additional information (e.g., hard and soft costs, projected payroll by trade, term of‐project, relevant experience of prime contractor, type of construction) to determine coverage specifics, including premiums, minimum deductibles, safety program requirements and maximum payouts for claims (i.e., annual aggregates). • If a project is going to be built under a wrap‐up plan, the decision should be made before the owner selects prime contractors by including wrap‐up enabling language in the bid proposal documents for design‐bid‐build projects or in the Request for Proposal document for design build projects. • In the absence of wrap up programs, workshops should be convened for minority firms as part of on‐ going good faith efforts (GFE) providing assistance and instruction so that these firms can have a greater understanding of what can be done to mitigate risk, how to purchase coverage at the most competitive rates, and what options are currently available to them in the market place.

The Gateway Project Doesn’t Need Trump’s Approval By Alon Levy

Jersey, and one two-track tunnel for commuter rail and Amtrak, called the North River Tunnels. The North River Tunnels are at capacity: At rush hour there are 24 to 25 trains entering Manhattan, the maximum number that can be accommodated on a mixed commuter and intercity rail tunnel. According to Gateway’s backers, the North River Tunnels are facing imminent collapse. The Gateway website claims that such closure would reduce capacity by 75 percent, allowing just six trains per hour in each direction if new Gateway tunnel were not complete. What is Gateway’s political situation? The projected cost of Gateway has been climbing for years, but the project has remained a top priority for both New York and New Jersey, earning the support of Schumer, both governors, and New Jersey Senator Cory Booker. During the Obama administration, the states reached an agreement with the federal government in which the federal government would put up half the budget and the two states would together put up half. Because of the program’s high cost, the states only put up $5.55 billion in matching funds, enough for $11.1 billion for the rail tunnel with matching funds (the $12.7 billion figure includes rehabilitation of the North River Tunnels, which suffered extensive damage in Superstorm Sandy).

The $30 billion rail tunnel project may be a victim of President Trump’s feud with Democrats. But New York and New Jersey could still save it. Holding up the spending bill in Congress this week: a fight over a tunnel beneath the Hudson River. President Donald Trump has said that he will veto the omnibus spending bill that lawmakers in Congress are now finalizing if it includes funding for the Gateway project, a massive replacement rail tunnel system connecting connecting Manhattan with New Jersey. According to Bloomberg, the compromise bill sets aside up to $541 million in a year’s worth of appropriations for rail tunnel and bridge projects, less than two-thirds of the $900 million Gateway backers were seeking this year. The president’s objection can be chalked up to his feud with Congressional Democrats in general and Senate Minority Leader Charles Schumer in particular, for whom the project is an enormous priority. There’s a reason why Gateway gets billed as “the most urgent infrastructure project in America.” “The Gateway Tunnel is vital to our New York economy, [and] is vital to the whole Northeast,’’ Schumer said in July. “The tunnels that now go under the Hudson are old … and Sandy was the final blow. If they collapse, if they are not used, if they fail, we will go into a recession immediately. No one will get across the Hudson.’’ As it stands, the millions of passengers who cross the existing North River tunnels face frequent delays due to mechanical failures in the infrastructure, which were worsened by Hurri-

cane Sandy’s flooding. On both sides of the river, Republican and Democratic lawmakers have insisted that without a major overhaul, one of the deteriorating tunnels could face long-term closure, which would “essentially shut down the Northeast Corridor.” That overhaul—the core of which would be adding an tunnel for redundancy and capacity—would be extraordinarily costly, with the total cost now pegged at nearly $30 billion. It would also have extraordinary local impacts. Gateway is the kind of project a national infrastructure investment program should indeed fund. But Gateway’s struggle for federal dollars may not necessarily be the existential threat to the regional and national economy that leaders claim. At $30 billion, the tunneling costs of this project are inexplicably high, even by the standards of recent astronomical subway expansion projects by the MTA. Gateway’s bare tunnel without stations shouldn’t be so expensive. There might be a better way to create the benefits Gateway promises, with or without money from Trump. Why is Gateway so important? At the center of the $30 billion Gateway project is a $12.7 billion Manhattan-New Jersey rail tunnel. This is indeed a critical connection: While there are many tunnels connecting Manhattan with Brooklyn, Queens, and Long Island, there are only two two-track subway tunnels between Manhattan and New

Early on in the Trump administration, it seemed that Gateway would be a point of cooperation between Congressional Democrats, especially Schumer, and the president. However, relations cooled through 2017, and by the end of the year, the administration was trying to kill the project. Trump’s final decision to cancel the federal matching funds was announced at the beginning of this month, leaving the project’s future uncertain. Transportation Secretary Elaine Chao admitted that the decision to cancel the project came from the president himself, apparently because of his clashes with Schumer. The loss of federal funding does not mean that the project is doomed, though. Potentially, the states could find more money themselves, or wait for a different presidential administration. But if the president vetoes the omnibus spending bill, a delay is all but certain. Can Gateway’s costs be justified? Although the current situation might make it seem that way, the politics of the Gateway program is not strictly partisan. The current administrations in New York and New Jersey are Democratic, but GOP Governor Christie was also a supporter of Gateway and helped find state funding for it. The centrist think tank Common Good claims a 3.5-year delay to the project would cost $10 billion. But that there is consensus in favor of Gateway does not mean the project is so good that only a partisan administration would cancel it. There are big question marks concerning the costs and benefits of the tunnel.

One benefit of the tunnel is straightforward: It would create capacity for far more commuter travel between New Jersey and New York. New Jersey Transit’s commuter trains are standing-room only dozens of miles outside Manhattan, and the state would like to double its rail capacity into Midtown Manhattan. For a rough order of magnitude estimate, the state has 93,000 rail passengers traveling to New York in each direction every weekday, most of them at rush hour. Doubling capacity could come close to doubling ridership—perhaps 170,000 passengers per day, a hefty number justifying a few billion dollars of investment. But it’s harder to justify a $30 billion project with such numbers. At $150,000 per weekday trip, that would be three or four times as costly as many recent American light rail projects, and more than ten times as costly as most French urban rail extensions. Amtrak could carry some extra ridership if it could run more trains, but Amtrak doesn’t urgently need the tunnels, as it runs eight-car trains serving stations most of which are long enough for 12 to 16 cars, so could create more capacity just by running longer trains. Furthermore, the assertions by Gateway’s backers that closure is imminent or that capacity would fall by a factor of four do not seem supportable. A study from 2014 recommending longterm closure of the North River Tunnels one track at a time once Gateway is complete notably refrains from saying that such closure is necessary. Right now, track workers are repairing the Sandy damage by shutting down one track at a time on nights and weekends, when there is no need for as much capacity. Moreover, scheduling trains at peak times on a single track is difficult, but not so difficult that there is only enough capacity for six trains per hour. A bidirectional schedule allowing 10 trains per hour in each direction appears possible given the tunnel’s short length, with only about four minutes of travel time between the portal and the station throat. Long Island-based rail activist Patrick O’Hara suggests that it would be possible to provide for 18 peak trains per hour into Manhattan in the morning and four reverse-peak trains. Moreover, New Jersey Transit’s commuter trains have good connections to the subway system connecting Newark, Jersey City, and Manhattan, so passengers could transfer. Long-term shutdowns, if they are even necessary, would be painful—but not as catastrophic as Gateway’s pushers would have us believe. Can we do Gateway cheaper? The main benefit of Gateway is clear: It would permit a doubling of peak rail capacity into Manhattan. There is no other way to move so many people from the North Jersey suburbs into the city; the roads are gridlocked, and the buses, which have a dedicated tunnel lane into Manhattan, have capacity problems of their own. This benefit justifies a budget in the single-digit billions of dollars, based on national and international costs for urban rail.

The Construction Program The 2019 Construction Program is published in a continuing effort to encourage participation in the Port Authority’s procurement of construction services. Issued annually, this document provides a forecast of construction contracts to be bid through a competitive design-bid-build model during the year. The forecast identifies contracts that the Port Authority will publicly advertise, provides a brief description, projects an estimated range of the construction cost, along with a brief description of each project. The section titled “Bidding and Understanding Port Authority Construction Contracts” is a guide to understanding the Port Authority’s contracting procedures for those projects procured under a design-bid-build project delivery model. This section also includes specific information for contractors interested in viewing or obtaining bid documents, completing a vendor registration profile to get on bid lists, and submitting bids, as well as information regarding the M/W/SDBE Program. The section entitled “Design-Build” provides a general overview of the Port Authority’s design-build program. The Port Authority anticipates that certain future Port Authority projects will be delivered using this alternative project delivery model.
