iscal year (Fy) 2014 was an extraordinary year for the Ohio Department of Commerce Division of liquor Control (Division). We experienced many significant and positive changes in the industry. Our accomplishments reflect the Division’s renewed mission to move at the speed of business by modernizing operations for improved efficiency, providing exemplary service to Ohio customers and stakeholders and taking a common sense approach to regulations helping Ohio businesses grow and create jobs. here are some of the Division’s highlights and accomplishments for Fy 2014. liQUOr PermiTS: The Division’s licensing Section was responsible for licensing the operations of more than 24,000 privately owned and operated manufacturers, distributors and retailers of alcoholic beverages. This includes the issuance of new permits, permit renewals and transfers, as well as the investigative and hearing requirements associated with permit issuance.

PermiT Fee DiSTriBUTiOn: The Division collected more than $39.7 million in permit fees. Of that amount, $38.8 million was distributed to various entities: $13.3 million was returned to the local taxing districts for liquor law enforcement, $17.1 million was deposited in the state’s liquor regulatory Fund and $7.6 million was allocated to the Ohio Department of mental health and Addiction Services to fund treatment and education efforts. Another $10 million was transferred to the Ohio General revenue Fund. PrODUCT reGiSTrATiOn: The Division’s Beer & Wine section registers beer, wine and low-proof products to be sold in Ohio. The number of product registrations continues to grow each year as manufacturers, including Ohio’s rapidly growing craft brewing industry and wineries, offer new and innovative items. in Fy 2014, the Division registered 1,733 new beer products, 6,975 new wine products and 136 new low-proof products for a total of 8,844 new products. This was 1,640 more new products registered than last year. SPiriTS innOvATiOn PrOGrAm: The Spirits innovation Program (SiP) was initiated to enhance the overall shopping experience and modernize the look and feel of

contract liquor agencies that sell spirituous liquor. in Fy 2014, the Division and its industry partners Diageo and republic national Distributing Company reset 134 Contract liquor Agencies (Agencies) to optimize product selection, maximize consumer value and increase shopper satisfaction by providing an improved and consistent store experience. This exceeded the SiP goal of resetting 125 Agencies in the first year of the program. The 134 reset Agencies represent 48% of the spirits business in Ohio and those stores experienced an 8.2% increase in sales as opposed to 4.7% growth in Agencies that have not been reset. With the support of the Contract liquor Agents and all the Division’s industry partners, SiP will continue to drive business growth in a responsible manner, while also giving the citizens of Ohio a better and more fulfilling shopping experience. By taking a fresh look at regulations and our operations, Ohio is a leader and example of what government can do to affect positive change and help improve the economic future for its stakeholders. recent report from nPr suggests that some Whiskeys using the words “hand crafted” or “small batch” really aren’t either. it’s reported that a factory in indiana has been producing massive quantities of beverage-grade alcohol, and some distilleries are just buying it and putting it in their bottles. Steve Ury, an attorney by day and blogger by night, has been tracking where the good stuff comes from. Ury told All Things Considered’s Audie Cornish that over 50 different brands from different companies appear to be bottling whiskey from this big indiana factory, which goes by the name of mGP - midwest Grain Products. Ury reported that one tell-tale sign on the bottles containing the indiana whiskey is the wording. Does it say “distilled” by the company, or does it say “bottled by” or “produced by” that company? Promotions must Adhere To Provisions By DAve rABer

t is common for manufacturers and suppliers of alcoholic beverages to use contests, prizes, sales incentive programs, rebates, and other promotions to market their products to consumers. When doing so, a manufacturer or supplier must adhere to the provisions of rule 4301:1-1-45, Ohio Admin. Code (“rule 45”). Pursuant to rule 45, “no merchandise or thing of value shall be given away in connection with the purchase of an alcoholic beverage” unless authorized

under r.C. Chapter 4301 or 4303, or the rules adopted and promulgated under these chapters. rule 45 provides further that a manufacturer or supplier of alcoholic beverages, or a registered solicitor or third party acting on behalf of a manufacturer or supplier may offer contests, prizes, sales incentive programs, rebates, and other promotions in conjunction with the sale of alcoholic beverages. Wholesale distributors and retail permit holders, however, may not use such promotions to reduce the price of alcoholic beverages at the point of sale. The authority granted by rule 45 to manufacturers and suppliers of alcoholic beverages, and their registered solicitors and third parties acting on their behalf includes the authority to offer a mail in rebate to consumers when they purchase a particular alcoholic beverage, provided the cost of the alcoholic beverage is not reduced at the point of sale. To notify consumers of a mail in rebate offer, a manufacturer or supplier of alcoholic beverages, or a registered solicitor or third party acting on behalf of the manufacturer or supplier, a wholesale distributor, or a retail permit holder may use printed or other media. in addition, mail in rebates may be distributed by the manufacturer or supplier of alcoholic beverages, their registered solicitor, a third party acting on behalf of the manufacturer or supplier, or a wholesale distributor for display and dissemination at the premises of a wholesale distributor or retail permit holder. A mail in rebate form may also be attached by the manufacturer or supplier to any

container of an alcoholic beverage, or to any carrier or packaging containing alcoholic beverages, without making other methods of acquiring the mailin- rebate form available, if a purchase of the alcoholic beverage is required to receive the mail in rebate. A manufacturer or supplier of alcoholic beverages may not (1) require a wholesale distributor or retail permit holder to participate in a mailin- rebate promotion or be subject to any quota or other arrangement that requires the wholesale distributor or retail permit holder to purchase products of the manufacturer or supplier in order to distribute the mail in rebates or (2) establish a quota or numerical amount of mail-in- rebate forms or mail in rebate materials that must be distributed by a wholesale distributor to any specific class or type of retail permit holder. moreover, no manufacturer, supplier, or wholesale distributor may discriminate between permit holders within the same permit class, based upon size or purchases of a particular brand, when distributing mail in rebate forms nor in any way restrict or limit participation in the promotion to one or more specific retail permit holders. except as provided in rule 45, no mail in rebate shall be made by or awarded through any retail or wholesale permit holder. manufacturers, suppliers, their registered solicitors, and third parties acting on behalf of a manufacturer or supplier may provide a mail in rebate only on the alcoholic beverages that they manufacture or represent. An alcoholic beverage may not be given to a consumer as part of a mail in rebate promotion. A consumer may or may not need to purchase an alcoholic beverage to participate in a mail-in- rebate promotion or may need to purchase a specific non-alcoholic item in addition to the purchase of an alcoholic beverage. Proof that the non-alcoholic item was purchased from a retail permit holder may be required to participate in a mail in rebate promotion. Any rebate amount given to a consumer may not meet or exceed the retail price of the alcoholic beverage purchased by the consumer to participate in the mail-in- rebatepromotion. nor may a mail in rebate be awarded to a person under the age of 21 or used to reduce the cost of an alcoholic beverage at the point of sale. While there are questions regarding what types of mail in rebates are permissible under rule 45, it is nevertheless important for all members of the industry to work together to make certain their conduct is in compliance with the regulatory framework established in that rule.

e are all aware that each State has its own, unique liquor laws. however, it is still interesting to see what other States are doing in regard to the regulation and responsible sale of beer, wine and spirits. Below is just a brief recap of some policy decisions in other States, including a recent bill introduction in Ohio. Ohio: legislators are taking proactive steps to ban the sale of powdered or crystallized alcohol, which they say could present serious risks if approved by a federal agency. At issue is a new product that allows powdered alcohol to be added to water to make certain spirituous liquors. The sponsors have taken issue with the products main selling point, which is that it’s easy to conceal in public places where alcohol is prohibited. Additional concerns revolve around the issue of mixing the alcohol with less water than suggested, resulting in a much higher content drink. Palcohol, which has an alcohol content equivalent to one shot in each package, received federal approval in April but the decision was rescinded in response to public outcry in opposition to the products labeling. South Carolina recently passed a similar ban. Tennessee: in 2007, Tennessee became the first state to require store clerks card everyone who bought carryout beer. The carding requirement was

expanded on July 1 to include liquor and wine as part of a new wine-ingrocery-stores bill. This effort was actually sought by the convenience store industry to simplify thing for clerks and store owners. Beer purchases by minors dropped by a third. This has of course had mixed reactions from patrons. Arizona: liquor servers were taught ways to spot fake iDs. educating employees about laws regarding beverage service and sales was the goal of a free class presented in one Arizona city. This was not the result of a state law, but merely an effort by permit holders and the State to promote responsible practices. The class was presented by the state’s Alcoholic Beverage laws enforcement Commission and muskogee’s neighbors Building neighborhoods. The purpose of the class was to make sure that businesses understand what their responsibilities are when it comes to selling alcohol, especially as it relates to selling to minors or selling to people who are intoxicated. Washington: while not new, there is still a great deal of attention on the State of Washington as it continues to go through issues brought on through the privatization of spirituous liquor sales, including an increased rate of theft of alcohol that researchers connect to the dismantling of the state’s monopolistic system. The number of stores at which Washingtonians can buy their booze has skyrocketed, from

329 state-owned and operated stores to more than 1,400. Additionally, the state liquor board was recently briefed on a study showing an increasing number of high school students found it “very easy” to get alcohol, and fewer believed drinking at their age is wrong. now Washington residents pay more for a liter of alcohol than residents in any other state. The higher prices come from taxes levied through the 2012 ballot initiative itself, including a 10 percent license fee paid by the distributors and a 17 percent license fee paid by retailers. The OlBA continues to look at other State’s experiences on many of these issues. We also appreciate the input of you, the permit holder, on many of these changes. What would the impact be if every person who purchased alcohol had to be carded, for example? your input on the actual implementation of such policy is critical to not only the OlBA, but also policy makers as they

s college students prepare to head back to school, you may be preparing to hire a number of new employees. having them TAm trained is a great way to protect them and protect your establishment. TAm, or Techniques of Alcohol management, is a comprehensive server training program that helps the permit holder maintain a responsible staff. TAm can help keep you aware of the legalities within the industry. The TAm program is a comprehensive program designed to give servers the know-how to be alcohol servers. One of the most valuable aspects of the program sessions provide detailed information about state laws, as they relate to the alcohol beverage industry, along with information about the scientific effects of alcohol, how to recognize when a person is impaired and tips on dealing with the intoxicated. • A place to hold the class. your establishment can work fine, but it needs to be in a quiet area away from the day-to-day operations of your business. it also needs to be large enough to set up classroom style for at least fifteen people. if you don’t

have fifteen people don’t worry, there is also an online version of the class. • Three dates that can work for you. The classes are 3 ½ hours long so please be prepared to block out that much time on your chosen date. We can schedule the class at any time of day, depending on what works best for you. When you have decided upon these two things, call our office at 800-678-5995 and we’ll get to work scheduling the class for you. We assign a certified TAm instructor to your class and that’s it. The only thing left for you to do is to inform your employees and encourage them to attend. Some employers even make it mandatory. These classes are very beneficial to tavern owners. Sometimes, insurance agents even provide lower rates to tavern owners who have all their servers trained. ever have more wines been so eco-friendly. So proudly, consciously, strategically eco-friendly. But before we all hop on this presumably-biodiesel-fueled bandwagon, it is important to ask: What is organic wine, and who cares? Does green-ness even factor in to people’s drinking thinking? The topic is at once quite simple, and surprisingly complicated. Who doesn’t want to live greener, cleaner and more naturally? At the same time, the devilish details—of certification, and even definitions— make the entire concept slippery. And on top of the real deal, so to speak, the greenwashing in wine can get laid on pretty thick. Hoping to bring some order to this dynamic yet difficult category, here are angles to consider when buying, stocking and selling the modern wave of green wine.


THE FOOD GAP

KEEP AN EYE ON EUROPE

Society has embraced “green” just about everywhere. Food especially. From Brazilian açai to Greek yogurt, whole-grain to gluten-free, healthy eating is mainstream. People care about what they eat—the nutrition, the calories, the ingredients, the provenance and the processing. Wine, on the other hand, has reached nowhere near the same level of awareness. Perhaps the wine industry has done such a marvelous job of portraying its product as crafted rather than manufactured, people already consider it essentially natural.

While interest in the U.S. edges up, sales of certified, organically grown wines are positively booming across the Atlantic. France, Italy and Spain each produce 10 times more organically grown wine than the U.S., accounting for 73% of organic vineyards worldwide. In France 8% of vineyards are certified organic— acreage more than doubled from 20072012. In the U.S., approximately 2% of vineyards are certified organic (mostly in Mendocino and Napa counties), accounting for 2% of the global total. The boom is in consumption as well. According to a study released at Millésime Bio in 2014, one in three French wine drinkers regularly drinks organic wines. The study described organic wine consumers in very broad terms: younger people (under 24), women, men 45 years and older, middle class, and people who appreciate terroir (i.e., a sense of place). Sounds like a lot of American wine enthusiasts....

TRADE AHEAD OF THE CURVE Distributors large and small are flagging green wines in their price listings—often in a separate section. Forrest Harper, Director of Education for Southern Wine & Spirits of Upstate New York, recalls creating internal lists back in 2007. Word spread and before long he was fielding requests from the sales teams in Metro NY, so Southern decided to dedicate extra space in their price book to green wines and spirits (42 organically grown wine SKUs; 35 organic spirits). Like Southern, Opici Family Distributing in New Jersey double-lists green wines. Winery Brand Manager Phil Ward sees increasing demand from restaurateurs; somewhat paradoxically, he notes, organically grown wine resonates with the locavore, farm-to-table movement. Off-premise, he sees more interest from smaller stores, especially ones accustomed to hand-selling. Opici’s organic labels include De Martino (Chile), Fattoria di Magliano (Italy) and Albet I Noya and Mas Igneus of Spain.

TO SECTION OR SCATTER? The stereotypical 20th century “Organic” section—small, remote, dusty—is disappearing, not unlike the snooty, tuxedoed sommelier. Faced with so many green wines from all over the world, merchants are now being compelled to rethink their shelving strategy. Stores with the floor space are often double-shelving certified, organically grown wines. Smaller shops may still have a green section—but it gets more prominence. Bottlerocket, a Manhattan store that prides itself on organizing wine in consumer-friendly categories, devotes a kiosk

to 20 green wines, each with a brief description. “People have changed the way they shop,” General Manager Gary Itkin says. “They’re more aware of what they’re purchasing. They are also interested in a more honest product.” Most stores keep certified green wines mingled with their non-certified peers, using shelf talkers or the like (e.g., a green leaf or ladybug) to identify them. And, of course, with the scattered approach, it’s still important for staff to know how green terms apply to specific wines. Creating an info-rich environment plays a critical part in growing customer engagement, says Itkin: “The more educated the customer, the better the customer they become, capable of making intuitive leaps.”

CERTIFICATION SITUATION Most consumers tend to say “organic wine” when referring to all types, but certification standards have narrower definitions. There are actually three certifiable types of organically grown wines in the U.S.: “Organic Wine,” “Ingredients: Organic Grapes” and “Made with Organically Grown Grapes.” Organic Wine is the rarest—because the U.S. is, uniquely, the only country in the world to combine an organic ingredients requirement with a no-added-sulfite

SUSTAINABILITY VS. ‘SUSTAINABABBLE’ Sustainability is a catchall concept, not a category. It applies to dozens of regional programs in the U.S. and elsewhere and it has been used to canonize a wide variety of eco-friendly practices under a green umbrella. Some have been started by local grape growers; others are the offspring of Big Wine. The sustainable tent is large (and flexible) enough to include many aspects of the wine business that have no direct connection to organic grapes: water conservation, energy efficiency, carbon reduction, solar power, reusing/recycling and packaging (lighter weight, soy ink, etc.)—not to mention support of environmental projects. Sustainability is best thought of as a helpful step forward—encouraging growers and vintners to reduce their energy and water use (and more), but its achievements are often overstated. It’s a process rather

than an outcome. Contrary to what most consumers believe, sustainability does not involve legal certification or require reduction of pesticides. Most consumers believe it does much more than it actually does. Merchants (and their customers) may have noticed more official emblems of sustainability programs appearing on back labels recently; New Zealand and South Africa have optional official seals, for instance. In California, the Wine Institute’s statewide program has a large outreach budget to promote its mission to consumers, with marketing videos, TV news appearances and a coffeetable book; yet, according to its own reports, fewer than 13% of state vineyards are certified sustainable under its guidelines. Moving forward, one question is whether operating under the big umbrella of sustainability will be accepted as an end, or as means to continue with real progress. One encouraging sign is how subregions in California—notably Napa Valley, Mendocino, Central Coast and Lodi—have established their own programs to cross-pollinate best practices. Meanwhile, however, wineries can and

often do overstate organic or Biodynamic certification as part of an overarching brand story, when, in reality, their case production of organic or Biodynamically grown wines is less than 5% of their total output. Certification is on a wine by wine basis; it is not bestowed upon brand names. Some wineries certify only their estate vineyards and buy tons (literally) of grapes from uncertified growers.

THE REAL DEAL Ironically, the green wine category is also home to understating. Sometimes organic grapes are blended with conventional grapes, so the wines can not be labeled as organic in any way. Also, some vineyards are “practicing organic” but not certified; this situation is common among wineries that have long-term contracts for grapes. And, sometimes producers leave any mention or emblem of certification off their labels—an extension of the attitude that their wines are excellent examples of their grapes/place first, and happen to be organic. So, when even green practicioners are hesitant to toot their own horns, it’s easy to see how “sustianababble” can grab hold of consumer consciousness. How to tell the Real Deals from the Hot Air? One easy way is to start with the Biodynamic producers. These eight each

requirement. (Most organic growers consider this requirement unfair, and many winemakers using organic grapes still use small amounts of S02 for stability). By far the most common certification is Made with Organically Grown Grapes. Biodynamic farming—administered by Demeter USA—was the first organic certification (1924). In addition to meeting organic farming standards, Biodynamic certification requires: use of on-farm materials for fertilization (farm compost, for example); 10% of land set aside for biodiversity; and use of herbal and mineral sprays. Biodynamic farming also involves consulting phases of the moon for the timing of farm and winery tasks; and bringing domesticated animals (cows, pigs, chickens, horses) onto the farm (for compost and more). Biodynamic wine holds great appeal for consumers who want to know that nothing has been added to wine; it is the only standard that specifies the use of native yeast and no additives (other than sulfur to stabilize during fermentation).

that in mind, here are some fundamental talking points: } There is no one-size-fits-all definition of green wine; there are degress, or shades, of green, and the wines span a huge range. } The foundation of organic wine is organic grapes, which are grown using natural processes (compost, cover crops, et al) and organic products (mineral oils, biopesticides, etc.), enabling these growers to avoid synthetic fungicides, herbicides or pesticides. } Green wine does not inherently taste different from conventional wine; however, organic and Biodynamic wines—being made with no synthetic treatments—have a unique and powerful selling point.

BONTERRA: CALIFORNIA'S ORGANIC LEADER GOES BIODYNAMIC Bob Blue, as winemaker at Fetzer, started farming organically in the late ’80s— decades before “sustainability” was a buzz word. Bonterra emerged in 1990 as a division of Fetzer. As of last year, it was the number one brand of certified, organically grown wine in the U.S. “My winemaking approach is simple—organic somewhat forces that, because all the work is in the vineyard,” Blue explains. Whereas many conventional vineyards control the vines with herbicides and pesticides and can always turn to a fast chemical solution, “there are no quick fixes in an organic vineyard, so it’s all about prevention. And self-reliance.” When vines are healthy, they naturally resist disease; and pest populations can be kept in check by “predator pests,” which are attracted by planting the cover crops and flowers they like to eat. The right variety of cover crops also adds vital nitrogen which keeps the soil loose and moist, reducing the need for irrigation, explains Bonterra Vineyard Director David Koball. Field sprays he uses include “cow manure tea,” ground quartz and fermented herbs. Of Bonterra’s 970 acres, an impressive 284 acres are now certified Biodynamic by Demeter USA. This represents even more of a commitment to the earth: Farming Biodynamically means relying exclusively on natural materials and methods, not just using them. “Biody-

namics does much of what Bonterra already does for pest and disease management and cover crops, but extends it to the development and management of our vineyards as a whole,” describes Blue. Bonterra’s first Biodynamic releases—two high-end blends, The McNab (Rhône-style) and The Butler (Bordeaux-style), named after their vineyard sites—are stunning examples that prove drinking sustainably doesn’t require sacrificing taste or quality.

Green wine is still taking shape as a category—all the more reason for merchants to embrace it on their own terms. Across the country, managers of chains and independents alike are adjusting in-store signage and online databases to account for green wines. They are figuring out what suppliers are really doing (not just what they are saying); and how much their customers, know (and want to know). And amid all the talk of details and definitions, wine quality remains the ultimate collective goal of wine sellers and buyers. From an environmental view, organically grown wines do less harm to the environment than their chemically raised counterparts. In artisanal, fine wine circles, however, they represent the most sought-after grapes. T WHISKEY NAME?

here is no whiskey named Chutzpah yet, but who’s willing to bet against that happening? With new brown goods popping up almost weekly, the latest kid on the shelf is apt to be sporting a purposeful moniker. The classical-sounding “Glens,” “Macs” and “Olds” have worn thin, prompting marketers to seek fresh angles to grab attention, provide hooks to remember and, ideally, characterize the liquid at hand. Catchy is key, what with Peat Monsters and Supernovas and Alibis and Ron Burgundy beckoning whiskey lovers. Some brands have stories behind the name; others are pure fancy (with fancy packaging to boot). The trend is unfolding at all price points, in every crevice of the category, from classic malts, bourbons and crafty small batches to flavored “party whiskies” and even product from Japan, Taiwan and India. Perhaps most important, new-name whiskies are part of a broader movement, echoing the quirky labels of the craft beer boom as well as blend-driven cheeky names in wine. The collective effect is to make the whole category more modern. And with Americans well-attuned to expressive brand names in all sorts of consumer goods, this trend is likely to continue if not accelerate.


and emblazoned with an animorphic demon to promote its rebellious appeal. Now Fireball’s following is the envy of the brown goods world, and it has plenty of fiery company. To wit: Red Shot, Fire Eater (from Early Times), Cinerator (Heaven Hill), as well as the new Jack Daniels Tennessee Fire and Jim Beam Kentucky Fire. Similarly, the recent spate of honey-flavored whiskey labels imply that bees were involved in enabling that next round of shots at the bar. Not every label is so self-expressive, but in some cases that doesn’t much matter. What is a Red Stag anyway? Of course, one might ask the same of Old Crow and Wild Turkey. Nonetheless, Jim Beam Red Stag came with a bit of mental superglue that helped the brand ramp up the flavored whiskey genre. By contrast, another recent Beam innovation, Devil’s Cut, has a solid pitch—highlighting a process that extracts whiskey trapped in the bourbon barrels’ wood after aging and then reintroduces it to the blend for extra oomph. Sometimes the connection between a whiskey’s name and its provenance is very direct. Jefferson’s “Ocean” Bourbon declares its raison d’être—having been “Aged at Sea”—on the front of the bottle. Several entries in the Isle of Jura portfolio (Superstition, Origin, Prophecy) reference the folklore of the tiny Scottish island where the single malts are made. But it’s not always obvious. Monkey Shoulder Scotch is named after a repetitive stress injury the malt men used to get when floor malting was all the rage in Scotland; dragging a malt rake around in circles all day resulted in one arm hanging lower than the other (hence monkey shoulder). Chicken Cock, a flavored whiskey line from Island Club Brands out of Charleston, SC, may sound like something a sly 12-year-old came up with, but in fact was the name of a product launched in 1856 and supposedly popularly served in a can during Prohibition.

NOVEL TWISTS There can be serious piggybacking at play in modern whiskey packaging. Witness

Highland Park’s Valhalla Collection recruiting famous Norse gods (Thor, Loki). With Larceny, Heaven Hill taps into the legend of Treasury agent John E. Fitzgerald, who allegedly stole whiskey from the warehouses he patrolled. Monument Valley Distillers (including John Wayne’s son Ethan) has launched Duke Bourbon, based on the style of whiskey the iconic actor enjoyed. Tincup, part of Proximo’s portfolio, honors the legacy of Colorado miners who drank their whiskey from metal cups—like the one now crowning their bottle. And sometimes, a name is just a name. Entries in Diageo’s limited edition Orphan Barrel series—Barterhouse, Old Blowhard and now Rhetoric—have no real story behind them other than being bottled from re-discovered old barrels, but the packaging is rich with retro graphics and text. In 2012, Allison Patel and her husband Nital (a branding expert who has worked with Samsung, Hershey’s, Pizza Hut and Walmart) launched Brenne, a French barley-based single malt finished in Cognac barrels and aged around eight years. The emphasis is on floral and fruit notes, with no smoke and light wood, and the name (pronounced “Brenn” not “Bren-neh”) derives from a French word brien, which refers to a single blade of grass. Allison Patel does acknowledge some confusion (“People

have definitely called me Brenne, thinking it’s my name”), but the name and non-Scottish packaging (sky blue, with a script font) are working, as Brenne is now in 20 states. “This isn’t a Scotch whisky impersonator,” she says. “It’s an elegant whisky, and I wanted the name to be just as elegant.”

NAME, RANK AND AGE STATEMENT Single malt Scotch traditionally has been paced by age-focused releases; think The Macallan 12 Year Old, Laphroaig 10 Year Old, The Glenlivet 18 and so on. While age statements might not precisely indicate quality, they certainly convey a sense of the cost and perceived status. The expansion of so-called No Age Statement (NAS) whiskies in the past

few years has created a whole new marketing challenge. Scottish law requires producers to use the youngest whisky in the mix as the basis for its age statement. What if a bit of three-year aged spirit will perk up a fading 25-year spirit? You have to call it a three-year-old whisky or not state an age at all. With the genre’s cognoscenti raised on such statements, suppliers were challenged to find concepts— and names—that would prompt buyers accept high-end peers not defined by age. When it comes to something like Glenmorangie Signet—a $200 expression featuring a blend of whiskies ranging from 12 to 21 years and aged in a combination of ex-sherry and new oak— Brand Ambassador David Blackmore says he relishes the hard[er] sell: “It’s so much more interesting to talk about the creative process, both the whisky making and naming, than just an age statement—which is, after all, just a marketing construct from another era.” He has a point; there’s nothing magical about the 10, 12, 15, 18, 25 pattern. “The idea is to create names that explain some of the personality of the whisky in question,” Blackmore adds. Signet is inspired by a tribal standing stone, among the most important archaeological finds in Scotland. How much that influences a whisky purchase, we may never know.

The Widow Jane made from red Indian corn is fantastic stuff.” Christine Kennedy, a spirits specialist at the store, notes that while doubts can still arise, particularly with sourced American whiskies whose origins might be fuzzy, she notes: “For the Wine has Marilyn Merlot. THE BEVERAGE NETWORK: What

aspects of Beam’s sales and marketing approach will change now that the company is part of the Suntory group? KEVIN GEORGE: The merging of our companies is a really interesting combination. Suntory has a tremendous track record of success, yet the majority of the company’s business is currently in Japan. Suntory is looking to make a major international play and with the $16 billion purchase of Beam, they are gaining access to our route to market. The biggest change retailers will see is much greater access to Suntory legacy brands like their Japanese whiskies. Suntory sees tremendous opportunity in the U.S. which is the largest spirits market in the world, and they operate in a long-term thinking mode just like we do, which is fantastic. TBN: Japanese whisky has certainly made a lot of headlines of late, but do you think the category will be difficult to market because it is relatively new in the U.S.? KG: It’s not a hurdle anymore. I’m amazed to see that even many casual whisky consumers are familiar with Japanese whisky, and its reputation for

quality precedes it, so it’s extremely easy to get people to try them. Yamazaki and Hakushu are some of the fastest growing single malts in the world right now, and the Hibiki blended malt is on fire. These are extremely premium—the Yamazaki 18 Year Old is on the shelf for around $170, but this isn’t slowing demand. The art of Japanese whisky production is world-class. The quality standards at the Suntory distilleries are unmatched; this is a best practice that we can definitely learn from, as well as their ability to market high-end luxury products. TBN: With such a large whiskey portfolio, do you worry at all about various brands cannibalizing one another? KG: People may have their go-to brand, but there is so much experimenting going on with whiskey. Consumers don’t just stay with one brand all the time, and we see our larger portfolio as a greater opportunity to keep them in the family. This is the reason we are introducing new flavors and additional premium expressions. Between our massive bourbon portfolio, Japanese whiskies, Irish whiskies [2 Gingers and Kilbeggan], Si ngl e M al t Sco tch e s [Laphr o ai g, Bowmore, Ardmore, etc.] and blended

Scotch like Teacher’s, (the #1 whisky in India), we really have whiskies for every occasion and consumer. TBN: How is your bourbon portfolio performing? KG: Bourbon is still on fire. Not just in the U.S. market, but around the world, so it’s a nice category in which to be the leader. The category grew 7% last year and even more in value, and our bourbons outgrew even that. Jim Beam—a 219-year-old brand—is growing at a double-digit rate, which is phenomenal. One key to the category’s growth is through premiumization, and we’ve seen tremendous interest in recent releases like Devil’s Cut, single barrel expressions and Knob Creek Smoked Maple. We see people trading up to different expressions or coming in through flavors like Red Stag or Jim Beam Honey. There are bourbons for purists and bourbons to attract new consumers and grow the category, and flavors have been really successful at that, particularly with younger legal-purchaseage consumers and women. Bourbon is a drink, not an ingredient. TBN: Beam isn’t all about whiskey— you have huge share in the tequila category.


A CONVERSATION WITH INDUSTRY PROFESSIONALS

KG: We are the number two tequila player in the world and our portfolio is well-rounded from top to bottom. Sauza is doing extremely well, and we recently partnered with Justin Timberlake with Sauza 901. Hornitos, in the premium space, was up 25% last year. We attribute this to significant investment in a television campaign, and a package upgrade that helps the bottle stand out on the shelf. Also, our distributors really got behind it, and although Hornitos is traditionally a reposado brand, we are seeing huge growth with Plata [Silver]—the fastestgrowing segment of the category. Our Hornitos Black Barrel, which we age in whiskey barrels to impart flavor, recently won double gold at the Denver International Spirits Awards. There is enormous opportunity globally for tequila as well, which we have yet to realize. TBN: I was interested to learn that while people tend to think of Pinnacle Vodka as a flavor-driven brand, the unflavored base vodka actually dominates. KG: Yes, while Pinnacle is obviously a leader in flavor, our unflavored vodka is 60% of the business and growing at a double-digit rate. This is largely because the quality is excellent—it was recently placed as the highest-rated vodka at the IWSC [International Wine & Spirits

Competition]. At 3.5 million cases, it is the third largest imported vodka in the country and growing at 20% right now. The vodka market as a whole has slowed down, but Pinnacle continues to outperform it. Vodka is a mature category, but we still see a lot of room for growth, so we have a new Tiki campaign and a new digital promotion. We’ve been doing our consumer research: People used to drink ‘beer, wine or spirits’. Now, they say they drink ‘beer, wine or vodka’. It’s pretty significant. TBN: The Skinnygirl brand is finding strong growth in the wine and vodka categories. What new opportunities has this afforded the brand? KG: While the RTS category is struggling a bit, the idea of low-calorie still resonates. This is also why we expanded into vodka

and wine with Skinnygirl, and we are seeing significant growth. Very few brands are capable of crossing categories like this. The premise is quite simple: It’s about permission not restriction—having everything you want without the guilt. When we acquired Skinnygirl in 2011, it was a one-product brand and we have grown it into an empire of low-calorie delicious cocktails. It went from 100,000 cases to 700,000 within a year. The advantage to having a vodka in the line-up is that we now have the ability to get on-premise. We offer the option of taking any cocktail on the menu and making it “skinny” and 8 times out of 10 people choose our vodka. Creator Bethenny Frankel continues to be very involved and we see a lot of untapped opportunity, and we will move Skinnygirl into new spaces where it is relevant. TBN: What will be your greatest challenge in marketing the larger, combined Beam Suntory portfolio? KG: It is actually a marketer’s dream to work with these brands; the quality is so high and the branding so strong, it makes my job easy in many ways. We are lucky in that the cultures of Beam and Suntory are quite similar, in that we are both very entrepreneurial. The combination of these two organizations is extremely powerful and, we believe, a real recipe for success. ■

olumbia Crest’s Grand Estate line of wines is a best-seller at Kreston Wine & Spirits, but owner Bob Kreston did a double take when a shipment arrived not that long ago. “I thought it was a mis-shipment,” recalls Kreston, who owns two full-service stores in Dover, Delaware. “I was ready to send it back, tell them I hadn’t ordered that. And if I was confused… I had customers coming up to me to ask why we had stopped carrying Columbia Crest.”

The new Grand Estate label, with its shield shape, clean lines and dominant “C,” was night-to-day from the old one. “Sometimes I wonder,” says Kreston, “why they need to fix something that isn’t broken.” That’s a question that more and more retailers are asking—more and more often. It may be that a brand that has fallen

out of favor, or they may be aiming at a different demographic target. Some suppliers make small changes to their labels regularly, as part of an overall marketing plan. While the motivations may be diverse, the packaging adjustments can add up—and it’s retailers who wind up having to deal with it. In fact, say a number of branding and marketing experts, this re-jiggering is likely to continue apace. Producers (and not just the multinationals) are bigger, have deeper pockets, and are better able to revise their brands when they see a need. Also, as the number of wine SKUs, which may be high as 15,000, continues to grow, producers large and small will keep striving to stand out from the pack.

THREE-TIER EFFECT Label tweaks are generally more common than wholesale changes, notes Courtney Holmes of Talk is Sheep Marketing in Sacramento: “The goal is to shake the brands up, and sometimes they achieve the objective, but some don’t. But when they confuse the buyers, they’re not helping themselves.” A wine’s label is its identity, and in a category where consumers are often faced with a literal wall of wine, many shoppers are more likely to remember the label rather than the name of the prod-

uct (or recognize). Says Chris Battista, who Old is new again for Bolla, whose owns the 7,500-squarelatest evolution foot Ledgebrook Spirit resembles the wine’s look in the 1960s. Shop in Winsted, CT, “A decent amount of consumers, they don’t know a lot about wine, but the label will catch them up to what they’ve bought in the past.” Scott Stern, of the CBX marketing consultancy in New York City, who has worked with drinks companies Allied Domecq, Miller Brands, LVMH and Gallo, points out that wine makeovers are a special case. Retailers, to their credit, say they understand much of what is going on and why it is happening. But they still have concerns—not only for themselves, but for their customers. “Some brands may need a boost,” says Megan Shervin, a partner in the 5,400-square-foot The Liquor Store in Jackson Hole, Wyoming. “Normally, when someone changes a label, they're changing the face of their brand. So they wouldn’t go to all that trouble unless they really needed to. But it’s scary when they do it. We changed the store’s logo after 29 years, and I know how much trouble that was.” CMX’s Stern cautions that brands who leave retailers out of the makeover process risk having their wine suffer as a result. Understandably, Kreston wonders why brands publicize their changes to the media and distributors, so why not at the retail front line, with straightforward POS material? “I’ve always thought a case card with the two labels—what it was and

says “distributor fatigue” is an ongoing concern for suppliers. “And it’s a vicious circle,” he adds. “They have so many SKUs that they’re cutting them, so when someone says, ‘Sell our wine,’ they need a good, compelling reason to do so.” Hence, the pressure to re-jigger a product to earn the attention of the distributor, who then, at least in theory, transfers enthusiasm for the new look to the retailer. Unfortunately, word of Columbia Crest’s new label never made it to Bob Kreston before the first case of “C” wine arrived.

Chris Battista, in Connecticut, shares Kreston’s frustration: “I’m seeing new products almost weekly,” says Battista. “The distributors are choked up. Is this a new wine, or the same juice with a new label?” It’s surprising that suppliers don’t consistently make a more concerted effort to pre-publicize a label change. Because the whole idea of a re-jiggered label is to sell more wine. And retailers, distributors and suppliers all like the idea of that. ■

packaging makeover can serve as the centerpiece for a multi-faceted promotion. Last October, Gloria Ferrer introduced a new look for its core sparkling wines, marked by richer colors, a more contemporary shape, additional embossing and a harmonious color palette across four cuvées: Sonoma Brut, Blanc de Noirs, VA DE VI and the brand-new Blanc de Blancs. The makeover also coincided with a major website update and blog launch, and was preceded by a summer tour of major markets to share the new packaging with trade partners. Finally, retail POS and print and digital advertis-

ing helped support the new look through the holiday season. “We did not take the decision to change our label lightly,” says Eva Bertran, VP of Marketing for Gloria Ferrer. “When you make a fairly significant label change there is always some fear that customers will get confused, but the reaction from both consumers and trade has been very good.” Also in 2013, Gloria Ferrer’s parent company, Freixenet, tweaked its Cordon Negro brand. Now all products feature the classic black and gold label with each expression denoted by a colored strip along the bottom of the label and medallion at the neck.
