The “real” killer, the man who stabbed to death a 54-year-old woman at a home in El Dorado Hills on a summer night in 1985, has been arrested — and it’s not Ricky Leo Davis. The new, suspected murderer was arrested Feb. 11 in Placer County on a warrant out of El Dorado County, said to be one of three young men who were with the victim’s young-teenaged daughter at a nearby park on the night her mother’s nightmare unfolded, July 7, 1985. That man has been named as 51-year-old Michael Green — but Ricky Davis is the guy who has served more than 15 years in prison, who has always protested his innocence in the brutal slaying of Jane Anker Hylton. He is the defendant whose anger erupted in court more than once during the years of prosecution, prompting sanctions against

him for his behavior. He is the man who in 2005 was bodily picked up by court bailiffs, chair and all, and deposited in a room separate from where his sentencing occurred, after he refused to let a family member of the victim state her feelings prior to the judge pronouncing sentence; Davis talked loudly over her comments until the magistrate ordered him subdued and separated from the proceeding. Davis sat guarded in a jury room as his fate was gaveled home, a sentence that would find him serving out the years at state facilities including Pelican Bay and at Solano. ORHS gives us a reason to ‘cheer’ Jana Rossi Staff writer
T
he Oak Ridge High School Varsity Cheer team had a lot to celebrate this past week. After traveling to the ESPN Wide World of Sports in Orlando, Fla., to compete with 950 D-1 Super Varsity Cheer teams, the Trojans took the Super Varsity Tumbling Division 1 national title at the High School Cheerleading Championship. While this is the sixth time Oak Ridge cheerleaders have received a bid to nationals in Florida, this is their first time taking home the title. Varsity captain and flyer Ashlyn Keledjian said the biggest challenge came during the semi-finals while competing against other phenomenal teams. “It’s intense, but at the end of the day everyone is super nice and they want to meet each other. It’s a cool experience,” she said of the competition. n

Spark your musical legacy with the symphony
O
ne chilly, foggy afternoon in the spring of 1950 a fourth-grade lad got to go on a field trip to the War Memorial Opera House in San Francisco. While in the warm comfort of that impressive concert hall, Maestro Pierre Montoux and the members of the San Francisco Symphony sparked his imagination with music he knew from his favorite radio The Arts shows. “They played the music to ‘The Lone Ranger.’ That surprised me. I thought symphonies were boring. But here was my favorite show. I learned the music was actually called ‘The William Tell Overture.’ And that’s when I fell in love with music and started my record collection,� he told me decades later. That kid was my father. A native San Franciscan, Dad loved the city’s symphony and the theater district. I credit him with my love of performing arts. Dad never wasted an opportunity to share his favorite musical selections (and why he liked them), whether they were classical works or ’50s rock-androll. Usually, they were associated with pop culture — radio shows, theater or movies. In fact, he was always scouting out record stores for the latest albums. He and I would go through his recordings and pick what we wanted to listen to that evening, together. The man just loved music and loved to share it — at concert volume! I thought it highly amusing that I was the only kid on the block who had to tell her father to turn the stereo down.

Instrumental encounter Opportunities to fall in love with music on a large scale like that don’t come along every day. Fortunately for us in Northern California, the Folsom Lake Symphony and Maestro Peter Jaffe are dedicated to sharing the joy of music with every generation — including our youngsters. On Saturday morning, March 14, the FLS hosts its annual family concert. The theme this year is Musical Engine. Jaffe will explore how catchy rhythms propel music forward — prepare to be entertained. Toetapping syncopated rhythms and familiar musical themes kids (and parents) recognize make for special memories. In addition to the engaging program, this event includes a musical “petting zoo.� This is a memorable, hands-on experience for youngsters. One so rare they will remember it. When I was a third-grader I got to experience a musical petting zoo with the San Francisco Symphony’s percussionist, Anthony Cirone Sr. Who knew that there was more to that section of

He brought instruments that included a variety of drums, cymbals, triangles, church bells and others. My favorite instrument that day was an unusual one: the “donkey’s teeth.� It was a small box-like instrument with a distinctive buzzing rattle. I thought it was very cool. The young person in your life may discover they really like the bass. Or the flute. Or the kettle drums. Or any one of myriad of instruments members of the symphony will share, along with what makes that instrument so fun.
Magical moments As a kid I didn’t realize what a gift Dad was giving me. We celebrate the greatest moments of our lives with music, whether they be birthdays, rock concerts or weddings. We console ourselves with music when the sad times come to life, too. It marks the time in its own eternal way. My dad passed away many years ago but I find we still connect whenever music is present. Funny how that happens. Whether it be Mozart or McCartney, Dad’s heart is as vibrant to me as ever in that moment. I close my eyes and we share the love of music yet again. Especially when I turn up the volume. And to think, it all began with a “little� children’s concert.

Empty Bowls to fill plates for the hungry News release Oak Ridge High School students are raising funds to alleviate hunger in local communities by putting on an Empty Bowls Dinner and Silent Auction on Feb. 21. The event, running from 4-8 p.m., will include live music and entertainment by ORHS students. Local restaurants provide the soup that will be served in beautiful, hand-painted bowls decorated by local students and adult artists. The bowls are a keepsake with any ticket purchase. The event will benefit the Twin Lakes Food Bank in Folsom and the Upper Room Dining Hall in Placerville. Oak Ridge service learning teacher Steve Seely is coordinating the student’s efforts and said he’s excited by what he sees. “I wish everyone could see how hard students all across our campus are working to help the needy,� Seely shared. “It’s a joy to witness.� TLFB Executive Director Lisa Tuter and URDH Executive Director Charles McDonald are also very excited. Tuter acknowledged that hunger is hard to see in the three communities her food bank serves: Folsom, El Dorado Hills and Granite Bay. “In our area hunger is hidden. It may be hard to see,� she said, “but, believe me, it is all around us. So, we really appreciate all that Oak Ridge students and the entire foothills community is doing to help feed the hungry.� The TLFB provided 300,000 meals to the needy last year. McDonald shared, “Last year, we served 5,478 meals and this year we expect that number to rise as our goal is to reach more people in need. The Upper
Room not only provides meals 365 days a year, served with compassion to a diverse community, we also offer a warm, friendly and safe refuge free of judgement to the marginalized members of our community. This is Keledjian’s 10th year in cheer and her fourth year on varsity. Her advice for anyone looking to try cheer: “It doesn’t hurt to come out. If you love it, stick with it. If you put in the work, it will pay off.” Oak Ridge High School Cheer fundraising manager and parent volunteer Angela Nicholson, who has had years of cheer experience with Oak Ridge having had three daughters participate in the program, said the entire experience has been gratifying, especially to see how far cheer has come. “Cheer has finally been legitimized as a sport,” said Nicholson. “Cheer teams are always out there cheering for other sports and it is now being recognized as a winter and spring sport.” The ORHS Varsity Cheer team has been led by coach James Blunk and assistant coach Kat Martin since 2015. Team manager Elaina Padilla released this statement: “As part of the coaching staff it has been an extreme pleasure to watch our varsity team win the title of national champions of the D1 Super Varsity Tumbling Division. They worked so hard for this win, with some of them on the team for four years, making the dream a reality.

Thurman said in that spirit, last year the Military Order of the Purple Heart designated El Dorado County as a “Purple Heart Community.” He emphasized that events such as El Dorado Hills’ dedicating this bridge in memory of its veterans is another example of why El Dorado County received this honor. Pointing to the medals on his jacket, Thurman continued, “These medals and awards represent physical bravery and can be worn and shown physically. But there are other types of courage that are just as important and for which there are few physical medals to display,” citing intellectual courage, moral bravery and the emotional courage needed to prevent wars, not just win them, among them. As a shroud was withdrawn unveiling a plaque dedicating the footbridge to the memory of El Dorado Hills’ veterans, Oak Ridge High School bugler Noah Olmstead played taps and veterans who’d fought in all wars since World War II saluted. Soon after the last of its 24 notes echoed off the surrounding hills, attendees gathered for refreshments or visited the VA’s mobile vet center while cyclists and walkers resumed recreating along the trail, though now stopping to consider the meaning of the newly dedicated bridge.

He said Gen. George Washington, who established the Purple Heart in 1782, did so to recognize the common citizen soldier’s valor in combat. Until Gen. Washington created the Purple Heart, Thurman continued, recognizing common soldiers was the exception. Awards were then given to noblemen who financed wars but rarely fought in them. Davis Melikian listened, declaring the man scheduled for a third murder trial in March “factually innocent” and vacating Davis’ conviction. The judge’s order, which was met with enthusiastic applause and tears from the gallery packed inside the courtroom in downtown Placerville, was in response to a motion by the El Dorado County District Attorney’s Office to dismiss all charges against Davis. In fact, the El Dorado County district attorney himself appeared before the judge, explaining that the motion to dismiss had been filed that same morning, based on DNA recovered at the crime scene and relatively recently processed for analysis at the urging of members of the Northern California Innocence Project out of Santa Clara College, who were recognized for their work by DA Vern Pierson. “I would like to thank the Innocence Project for bringing (the DNA connection) to our office’s attention,” began Pierson, as more than a dozen of the college’s team was in the court to hear the praise. The project’s Melissa O’Connell, the attorney who worked the lion’s share of the case and successfully argued in 2018 to vacate the verdict, sat with her former client who also was flanked by his current defense attorney, Melissa van der Vijver. On Thursday DA Pierson added that his office, upon taking on the task of trying Davis once again, treated the case “as an unsolved murder” and as a result of that fresh look, including the crucial DNA testing, determined that “Mr. Davis was wrongfully accused and convicted of this crime.” The Sacramento County District Attorney’s crime lab analyzed Hylton’s nightgown and identified a different suspect, according to Sacramento DA Anne Marie Schubert. She said it is the first case of its kind in California history and second in the nation to both exonerate a wrongfully convicted individual and name a new suspect. Following his arrest in the early 2000s, based on evidence given to “cold case” investigators from the El Dorado County Sheriff’s Office by a former girlfriend as she sat in an Oregon jail on drug charges, the case was taken to trial. An initial jury declared impasse saying its members were hopelessly hung; the panel was dismissed and the case against Davis refiled by the DA’s Office. A second jury declared impasse at one point but was convinced to keep deliberating and ultimately convicted him in 2005, after which he was sentenced to 15 years to life in prison. DA Pierson on Thursday characterized the cold case investigators’ tactics as having been highly questionable in exacting a confession
Continued from A1 from Davis’ ex-girlfriend Connie Dahl, a matter he listed as part of the reason for seeking dismissal of the charges and vacating of the upcoming trial. Pierson said the detectives sent to interview Dahl, who eventually testified against Davis, essentially browbeat her into confessing to helping her thenboyfriend to murder Jane Anker Hylton and into implicating Davis as the instigator of the violence at the home on Stanford Lane in El Dorado Hills. “After being repeatedly interviewed between 1999 and 2002 in an aggressive, accusatory manner, Ms. Dahl told the cold case detectives that Ricky Davis committed the crime,” states the motion presented to Judge Melikian Thursday. “Ms. Dahl claimed she witnessed the murder and was the person responsible for inflicting the bite mark on Ms. Hylton’s shoulder. In addition, Ms. Dahl said that the murder was witnessed by the victim’s 13-year-old daughter.” Those statements made by Dahl, who reportedly died in 2014 of a drug overdose, have been shown to be false, the DA’s Office maintains today, and in fact DNA collected from the victim’s nightgown near the “bite mark” was part of what has set Davis free. That DNA was from a male and could not have come from Davis, testing has determined, nor could it have come from Jane Hylton’s estranged husband Archie, from whom she had fled and was staying at the Stanford Lane home with daughter Autumn in a respite offered by her friend. Ricky Davis’ mother owned the home where Ricky and thengirlfriend Connie Dahl also were staying. Not only did Dahl lie about having inflicted the bite mark on Jane, but more biological matter found under the victim’s fingernail was found to potentially have come from the same male DNA depositor who bit the woman’s shoulder during an attack that left the room soaked in blood; that man could not have been Davis nor Archie Hylton, DNA testing revealed. DA Pierson notes in the motion that his office “entered into an agreement” with the Northern California Innocence Project regarding submitting evidence for DNA analysis and genetic genealogy, leading in 2014 to the discovery of the as-of then unknown male. Based on that DNA finding, Judge Melikian in 2018 vacated the 2005 conviction and ordered a new trial proceed; it was set to begin in just a few weeks. Instead of facing yet another ordeal where a jury would decide whether he still belongs behind bars — and where the late Connie Dahl’s previous testimony was to have been read to the court —

Ricky Davis couldn’t stop smiling Thursday as NCIP attorney Melissa O’Connell and his local counsel Melissa van der Vijver shared his joy, the trio seated at a table as the judge ordered the record of his arrest, conviction and incarceration be destroyed. Van der Vijver told the court she wanted to speak on behalf of her client, saying Davis was grateful for the chance to have the DNA testing done, accomplishing proof of his innocence, “what we have known all along.” As she patted Davis repeatedly on his back, attorney O’Connell said she wished to thank the DA’s Office for delivering justice and to thank the court for “finding the significance of the DNA evidence” that prompted Melikian’s overturning the conviction. “I send my condolences to (Jane Anker Hylton’s) family for thinking they had justice all this time,” added O’Connell, saying she and her team wish for an ultimate outcome that will give them some peace. O’Connell then looked at Davis and told the court she wished to remark on his “tremendous strength and resilience, never giving up hope, believing the (criminal justice) system would work.” Judge Melikian, who has had to admonish Davis during past proceedings, telling him at one point that he is his “own worst enemy” for his outbursts, told the formerly convicted man Thursday that he thanked him for his “graciousness.” One of Davis’ family members, a second-cousin who sat outside the courtroom prior to the Thursday morning proceedings, said she heard that DA Pierson made a trip to the jail earlier this week to “apologize to Ricky.” Judge Melikian, after declaring Ricky Leo Davis factually innocent and waiting for the applause to let up, cited pertinent sections of the California Penal Code that address potential recompense for more than 15 years of false incarceration. “(The code sections cited) are there if you wish to pursue compensation for wrongful conviction,” the judge explained. “Incarceration for way too long a time.” Paperwork needed to be done before Davis could walk free Thursday but he managed to share several hugs as he was escorted from the courtroom for what very well could be his last trip back to jail. DA Pierson explained the delay to the judge, outlining some of the finer points of freedom. Bowing to the DA’s expertise, Judge Melikian indicated Pierson’s office should do whatever is needed, with the court’s blessing. “We don’t do this very often,” smiled the judge.

WASHINGTON D.C. – A new definition for “hot property” has emerged within the real estate market. The recent string of state-level marijuana legalization continues to impact commercial property demand and residential housing decisions throughout the United States. These findings are according to the latest study from the National Association of Realtors, Marijuana and Real Estate: A Budding Issue, which found that in states where prescription and recreational marijuana use is legal, more than a third of those polled said they saw an increase in requests for warehouses or properties used for storage. In those same states, up to onequarter of members said the demand for storefronts grew, while one-fifth said there was a greater demand for land. The NAR report examines how marijuana is grown, harvested, stored, sold and consumed within states where the product is legal. Because each law and the duration of time in which the product has been legal varies by state, the study is summarized by legal for medical use, legal for both medical and recreational use after 2016 and legal for medical and recreational use before 2016. States where marijuana has been legal for the most amount of time have
seen the largest impact on both commercial and residential real estate. “As more states legalize marijuana, the real estate market will progressively have to adjust,” said Dr. Jessica Lautz, vice president of demographics and behavioral insights for NAR. “From property owners, to manufacturers, to those who simply want to engage for leisure — it all touches real estate in some form.”
Commercial real estate NAR surveyed its membership regarding their interactions with marijuana and the real estate sector in states where the product is permissible. The study finds that commercial practitioners are facing an increased demand for land, warehouses and storefronts that are intended for marijuana. “When the business of marijuana is discussed, some have a tendency to focus on only the buyers and sellers of the product,” said Lautz. “However, these numbers show that marijuana has been a boon to commercial real estate.” Marijuana as a business has prospered for more than a decade and that growth continues to evolve. California’s housing affordability holding steady California Association of Realtors News release LOS ANGELES — Slightly higher mortgage interest rates offset steady home prices and held California housing affordability constant during the fourth quarter of 2019. However, more Californians could afford a home purchase compared to a year ago, the California Association of Realtors recently reported. The percentage of home buyers who could afford to purchase a median-priced, existing single-family home in California in fourth-quarter 2019 was unchanged from the third quarter of 2019 at 31 percent but was up from 28 percent in the fourth quarter a year ago, according to CAR’s Traditional Housing Affordability Index. California’s housing affordability index hit a peak of 56 percent in the fourth quarter of 2012. CAR’s HAI measures the percentage of all households that can afford to purchase a median-priced, single-family home in California. CAR also reports affordability indices for regions and select counties within the state. The index is considered the most fundamental measure of housing well-being for home buyers in the state. A minimum annual income of $119,600 was needed to qualify for the purchase of a $607,040 statewide median-priced, existing single-family home in the fourth quarter of 2019. The monthly payment, including taxes and insurance on a 30-year, fixed-rate loan, would be $2,990, assuming a 20 percent down payment and an effective composite interest rate of 3.89 percent. The effective composite interest rate was 3.85
percent in third-quarter 2019 and 4.95 percent a year ago. Housing affordability for condominiums and townhomes also improved from a year ago but decreased compared to the third quarter of 2019 because of higher median condominium prices. Forty-one percent of California households earned the minimum income to qualify for the purchase of a $480,000 median-priced condominium/townhome, down from 43 percent in the previous quarter. An annual income of $94,400 was required to make monthly payments of $2,360. Thirty-seven percent of households could afford to buy a condominium/townhome a year ago. Compared with California, more than half of the nation’s households (57 percent) could afford to purchase a $274,900 median-priced home, which required a minimum annual income of $54,000 to make monthly payments of $1,350. Key points from the report include: • When compared to a year ago, housing affordability improved in 44 tracked counties and declined in four counties. Affordability remained flat in one county. • In the San Francisco Bay Area, affordability improved from fourth-quarter 2018 in every county. San Francisco County was the least affordable, with just 18 percent of households able to purchase the $1,600,000 median-priced home. Forty-seven percent of Solano County households could afford the $460,000 median-priced home, making it the most affordable Bay Area county. • Affordability also improved in all Southern
California regions, with Orange County being the least affordable (26 percent) and San Bernardino County being the most affordable (51 percent). • All counties in the Central Valley region experienced an increase in affordability from a year ago. San Benito County (34 percent) was the least affordable and Kings County (55 percent) was the most affordable. • Housing affordability improved in three of four counties in the Central Coast region with Santa Cruz experiencing the biggest improvement in affordability — jumping to 21 percent in fourth-quarter 2019 from 12 percent a year ago. Santa Barbara County was the only county in the region with a year-over-year decline in affordability, with the index dipping to 23 percent in fourth-quarter 2019 from 26 percent a year ago. • During the fourth quarter of 2019 the most affordable counties in California were Lassen (63 percent), Kings (55 percent) and Tulare and Plumas (52 percent). The minimum annual income needed to qualify for a home in these counties was less than $54,000. • San Francisco (18 percent), San Mateo (20 percent) and Santa Cruz (21 percent) counties were the least affordable areas in the state. San Francisco County required the highest minimum qualifying income in the entire state. An annual income of $314,800 was needed to purchase a home in San Francisco County. • San Mateo County also required an annual income exceeding $300,000 to purchase a medianpriced home.

commercial properties. Moreover, some commercial properties near marijuana dispensaries experienced rises in property values. In states where marijuana is legal for both recreational and medical use, more than one in five saw an increase in property values near dispensaries — a smaller share saw a decline in values. Although real estate has seen gains by its connection with marijuana, property owners and the commercial real estate industry have had to make accommodations to fine-tune the partnership. For example, half of those in states that legalized medical and recreational marijuana before 2016 said they saw addendums added to leases that restrict growing on properties. Additionally, in situations where a tenant was permitted to grow marijuana in their rental property, it was most common for the renter to pay utility costs. In fact, when a tenant regularly smokes marijuana in their rental property, nearly nine out of 10 tenants take on the costs of utilities.
Residential real estate Marijuana also has a rapidly growing presence within residential real estate, with no signs of decelerating. The demand for housing and residential properties has also intensified as more states relax marijuana laws. Of the states where marijuana is legal in some form, between 9 percent and 23 percent of members who were polled there said they believe inventory is scarce for multiple reasons, including all-cash purchases from the marijuana industry. In addition, while the majority of NAR members said they have not seen any changes in residential property values near dispensaries, between 7 percent and 12 percent answered that they have indeed seen an increase in values. Conversely, 8 percent to 27 percent said they have observed a decrease in residential property values near dispensaries. “Residential practitioners are getting used to the new normal of having marijuana legally used within rental properties, while homeowner associations are tasked with setting new rules to address consumption and growth,” said Lautz. The majority of respondents reported that homeowner associations have rules that place certain restrictions on smoking and growing marijuana in homes or common areas. Only around 3 percent answered that specific homeowner associations do allow growing or smoking in homes or common areas. In states with legal medical marijuana or recently legalized recreational marijuana, three-quarters of members had never tried selling a grow house. Among residential members who have sold a grow house, 29 percent said they had a difficult time doing so. Twenty-seven percent of members in recently legalized states had difficulty selling a grow house, compared to 25 percent in states that legalized before 2016. Because marijuana is often an all-cash business, earnings from those who profit are frequently cash proceeds. About one-fifth to a quarter of landlords said they were unwilling to accept cash for rent in any instance, while about 10 percent said they will not take cash from an illegal federal activity for rent. Still, 42 percent of those in states where medical marijuana is legal answered that they would accept cash payments for rent. Among those renting where marijuana is legal for both prescription and recreational use, twofifths said they would accept cash for rent. Finally, about half of NAR members in states where
medical marijuana is legal said they had no issues leasing a property after it was previously occupied by a tenant who legally grew marijuana. Thirty-five percent to 49 percent of those in states where both medical and recreational marijuana are legal said they had no difficulty leasing the property to a new occu-
pant. That said, the most common problem among these properties were lingering odors, followed by moisture issues. Both matters were more common in areas where recreational marijuana has been legal for a longer period of time.
