Permanent Guidelines For Medical Cannabis in Orange County Released

Most of California’s cannabis industry had been busy on July 13th, 2018 with the deciphering of the 315 pages of the draft regulations. These proposed guidelines were issued by the Bureau of Cannabis Control, the Department of Food and Agriculture and the Department of Public Health that oversees the state’s marijuana market. One of the prominent people of the California Cannabis Industry Association stated that “It will probably be a couple of days before we have our heads wrapped fully around the changes” The California cannabis industry was operating under the emergency regulations since they were first implemented, but state law had mandated that the permanent guidelines have to be finalized by the end of 2018, and are now in effect since January 2019. It will be effective for medical cannabis in Orange County as well. Hence, the proposed guidelines are laid on improving the earlier set of emergency rules that involved delivery, packaging, edibles and concentrates. This is considered a step forward as they provide clarity towards many queries that were posed by many organizations. Here is the summary of the guidelines laid down by the three state agencies:


 Deliveries Delivery can only be done by state-licensed commercial marijuana licensed holders. The amount which is allowed to be delivered in a single delivery will be around $5000-$10,000.

 Products Potency The changes have been made on the potency caps for the manufactured products from the Department of Public Health, which allows some medical cannabis products to have up to 500 mg/ package ( an increase from the earlier limit of 100 mg/ package). However, this rule applies only to orally dissolving products such as sublingual strips. For edibles, the doses still must be 10 mg.

 Packaging According to the new rule, the product carry bags must be child-resistant, resealable, and opaque.


 Distributors It clarifies that distributors will be allowed to manufacture pre-rolled joints. It also clarifies that distributors are allowed to transport lab-tested product not only to retailers but also other distributors.

 Advertising New rules are thought to expand the restrictions on marijuana advertising that might appeal to minors such as toys and cartoon characters. Also, for outdoor advertising, it should be fixed to a permanent structure instead of bar roving billboards attached to trucks or trailers. The proposal also offers guidance for advertisers on how they can show that 71.6% of their audience remains 21 years or older.

 Events The changes will require marijuana event-holders to provide more details about where the licensed retailers will be set up and where the users will consume marijuana. These points were mainly focussed on the first draft of the guidelines. However, the agency left a loophole allowing no limits on small cultivation licensed for any given business. These guidelines will pave the way as the booster of the marijuana market. Products that will emerge in the market will be more authentic.
