BOMA Members Seeing DBI Improvements In 2009, the San Francisco Grand Jury criticized the city’s Department of Building Inspection’s efficiency and suggested various reforms, such as a one-stop permit center and urged expediting permits by having various departments at City Hall simultaneously review building applications, reducing permitting delays. Several BOMA members who regularly work with DBI see some results and hope for even more improvements. “While the process at DBI is not perfect, it is greatly improved over what it was just a few years ago. Old ways die hard, and with the turnover of staff due to retirements, the new staff will more easily embrace change because they have not been exposed to the old ways. As for the statement that it would be nice to have one point of contact to find out permit status, no one would disagree with that,” says architect Skip Soskin. Henry Karnilowicz, vice chair of BOMA’s Codes & Regulations Committee, adds, “The process of permit issuance at DBI is relatively seamless with the staff at the information counter providing information on permits and routing of applications. The fifth floor houses all the stations necessary for most permits, including those for tenant improvements, which are usually approved the same day. Unfortunately, projects that require

neighborhood notifications can take many months to gain Planning Department approvals as they may involve several hearings and/or appeals.” Explains Ken Cochrane, BCCI Construction Company’s director of permit services, “As daily customers of SF DBI, we have seen a marked improvement in the TI process. The process has continued to improve over the last three years or so. The new space set up for over-the-counter permits on the fifth floor is great. San Francisco’s over-the-counter permit center should be a model for all Bay Area jurisdictions.” Cochran adds, “Projects that must be submitted into the system still suffer from long backlogs. As staff is increased, this should ease up. A lot of the long wait times are caused by the City Planning Department. Over the short term, I do not see any way to speed up this process.” Ken Cleaveland, BOMA San Francisco, who routinely monitors actions taken by the city building department, said, “The best thing about San Francisco’s building department is their willingness to listen to their customers, the real estate and construction industry, and to hold regular Public Advisory Committee meetings that are open to the public to take input from the private sector on ways to improve their services. That openness to constructive suggestions is very much appreciated.”

Q&A with Our New BOMA SF President What do you hope to accomplish during your year as BOMA San Francisco president, from the perspective of being a broker?

I am a big fan of the “triple bottom line” with focuses on People, Planet and Profits. I think BOMA has done a great job educating its membership and service providers, and using BOMA 360 and the EARTH awards to push the agenda of sustainability. I would like to see us continue to promote the triple bottom line approach. I believe the next opportunity is to net-meter tenants for their electrical usage in both lights and plug loads. We need to address the other 40% of power usage by commercial buildings that are really under tenant control. Let’s give tenants the incentive to conserve — allowing tenants to monitor their power usage and benefit directly from energy cost savings is a great motivation. In your view, what makes BOMA unique as a business organization?

Its advocacy work is unmatched here in San Francisco. The organization is very focused on keeping San Francisco a businessfriendly place, and that is not an easy job in this city. BOMA knows it needs to listen to both sides and has proven open to working with other agendas that are shaping the city. Working with new bicycle legislation is just the latest example. We heard both sides of the issue and worked to come up with compromises that our members and bike riders (such as myself) can work with. What advice would you have for a newcomer to BOMA San Francisco?

That’s easy—if you’re not volunteering for a committee, you’re not using your dues money effectively. This organization is about relationships. Rolling up your sleeves and getting involved is the only way to maximize the opportunity. Tell us a bit about yourself?

I moved to San Francisco in 1983 after graduating from Oregon State. After 70 days of rain and overcast skies in Oregon, I packed up my things, drove all night and arrived in San Francisco to sunny, 70degree weather — and I haven’t moved back since. I’ve been married for over 18 years to Terri, and we have three kids. When not working on leasing and sales transactions, I can be found coaching, gardening, fishing and growing wine grapes. I have also served on several boards, including the local chapters of The Leukemia & Lymphoma Society, the U.S. Green Building Council and NAIOP.

Status Report A summary of San Francisco government actions affecting the operations of the commercial buildings and The City’s economic well being.

Repeal Ranked-Choice Voting Before memories of San Francisco’s 2011 election fade, some housekeeping is needed before the next major local election. We were pleased with some of the election results, but the ranked-choice voting process fundamentally undermined Americans’ hallowed and very practical “majority rule” principle and ended up giving us some leaders that most people did not vote for and may not support. There are efforts in the works to repeal ranked-choice voting in 2012, and they will be supported by BOMA San Francisco.

...and also Repeal Public Financing of Elections The second major flaw in San Francisco’s 2011 election was the waste of $4,636,144 in tax dollars given to mayoral candidates, many of whom never had a chance

of winning and polled insignificant results in the election. We need to overhaul or repeal public financing.

The Food Trucks Keep Rolling The proliferation of mobile food facilities (or MFFs) continues to vex downtown restaurants, cafes, sandwich shops and other take-out food establishments. This phenomenon has also become a major concern and objection for commercial landlords. The ordinance allowing for the permitting of MFFs went through a major overhaul in late 2010, and the responsibility for issuing those permits was moved from the Police Department to the Department of Public Works. The cost of such permits was also reduced from approximately $10,000 to $1,000. The intent of the ordinance was to help create more food opportunities in underserved parts of The City. Unfortunately, the new MFF applications have overwhelmingly been for downtown locations, not so-called “Underserved Areas” of San Francisco. As a consequence, BOMA is seeking revisions to the MFF ordinance that will include the requirement that MFFs notify and indemnify commercial property owners who will be impacted by their presence, and that some type of limit (density) on the number of permits in any one area be imposed to reduce its current unfair competition aspects. BOMA, the Union Square Business Improvement District, and the Golden Gate Restaurant Association are working together with the mobile food truck representatives and SF Supervisor Scott Wiener to craft an acceptable compromise to this problem.

SF Police Chief Praises BOMA uring his luncheon address last fall, San Francisco Police Chief Greg Suhr thanked BOMA members for being vigilant in assisting his department in controlling downtown crime and making the Financial District a safe and desirable place to do business. He also explained that his department takes special care in dealing with challenging situations like Occupy San Francisco, since he wants to help maintain The City’s reputation for fairness, tolerance and First Amendment rights. BOMA’s Ken Cleaveland, Police Chief Greg Suhr asked BOMA members to support his efforts to keep the Suhr and BOMA EVP Marc Intermaggio. force vibrant, as budget challenges and the retirement of many senior officers will require extensive recruitment efforts. He also observed that SFPD lacks many up-to-date technological advantages, noting the department only recently began extensively using email. Commenting on the new chief, BOMA Director of Government and Public Affairs Ken Cleaveland said, “Greg is a local San Franciscan who really cares about his hometown and making sure The City is safe for every resident and visitor. He knows The City well, having worked in every part of it in his long career with SFPD. He’s the real deal and a very fine public servant. We’re lucky to have him as our police chief.”

J. Timothy Falvey realized early in his career that if you’re going to be in business, you have to work for government policies that support a healthy economy. So he rolled up his sleeves and plunged into the political process. Since then he’s chaired BOMA’s Government and Public Affairs Committee and its Political Action Committee. He has also served as a director of both the San Francisco and California Association of Realtors® and president of the Union Square Business Association Improvement District. Over the past quarter-century, the 2003 San Francisco Realtor® of the Year and 2004 Small Business Owner of the Year has lived up to his commitment to use the political process to improve conditions for commercial and residential owners and tenants in San Francisco. Associate Member Profile Self-described “bon vivant” Rennie Ediger uses her well-honed social skills and zest for volunteering on BOMA’s Associate Member Committee to market the services of Perfection Sweeping Co., over which she presides. In almost three decades, she and her sales staff have used their BOMA membership to become one of the most respected firms in their field in Northern California. Doing good has also helped Ediger do well. The Associate Member Committee is “responsible for 90% of BOMA’s social events. So we are able to meet and talk with vendors as well as property managers. This has opened up new doors for us to do business with other vendors that are related to our services,” she says. Perfection maintains the exterior of buildings as well as underground garages. “We try to be property managers’ eyes and ears at night when the buildings are not occupied. 8 Skyline Construction Installs New Ventilation System in Transamerica Pyramid New fan system is quieter, easily maintained, uses less energy and is much less disruptive to implement than traditional air-handling equipment.

Operators of San Francisco’s iconic Transamerica Pyramid recently avoided the costly disruption of replacing an aging ventilation system by installing a new-tech Huntair® modular FANWALL® system, thanks to the efforts of general contractor Skyline Construction. The retrofit process, says Skyline Construction Senior Vice President Randy Scott, avoided weeks of tenant disruption, noise and unnecessary expense and resulted in a new system that requires much less energy than the older technology. He adds that the FANWALL TECHNOLOGY produces minimal noise and vibration, alleviating irritation for tenants above and below the ventilation equipment. Confronted with the major disruption associated with replacing the old air-handling fans, Transamerica Pyramid construction and engineering personnel and Skyline’s construction and subcontractor team came up with a logistical solution that will be an attractive alternative for other buildings that need to replace their antiquated ventilation systems. The FANWALL system had the added benefit of operational redundancy. Should a fan failure occur, the multiple fans of the FANWALL system would ensure operational continuity until the fan could be changed out through a simple maintenance effort. By implementing the FANWALL system, the owner avoided having to incur the cost and disruption of demolishing walls and a costly rigging operation that would have been incurred with a conventional like-for-like fan replacement.

State Issues It’s almost certain there will be a split-roll property tax initiative on the ballot in California in Nov. 2012. Key provisions of proponents: • Exempts all residential property – including rentals and apartments • Requires commercial reassessment at least every three years • Increases homeowner exemption to $14,000 • Provides a $1,000,000 personal property tax exemption • Puts money into general fund to increase Prop 98 funding “This could be the most challenging attempt ever to carve up Prop 13 and target commercial property owners with higher taxes since the state’s voters passed the landmark measure over 30 years ago,” said Ken Cleaveland, director of government and public affairs for BOMA SF.

Legislation to curb costly opportunistic American with Disabilities Act (ADA) lawsuits against business owners is being pushed by California Congressman Dan Lungren (R-Gold River). “Too often these lawsuits are filed and the accuser takes the settlement money and moves on down the road. Access for the disabled does not get fixed because the business owner has spent his money on the lawsuit. The business owner loses out, disabled Americans still can’t patronize the place – only the pockets of the ones bringing the lawsuits are enriched,” said Lungren, who launched H.R. 3356, otherwise known as the ACCESS Act (ADA Compliance for Customer Entry to Stores and Services). Lungren’s legislation is “very laudable,” says Ken Cleaveland, director of government and public affairs, BOMA SF. “Such ADA scams are closing down small businesses and ultimately denying their services to everyone, including disabled people,” Cleaveland adds.

The Last Word: Marc Intermaggio Action Request: Help Promote Real Estate Career Opportunities he dearth of people entering the commercial real estate workforce hampers our industry in numerous ways. Chief among them: real estate operating companies are forced to poach talent from one another, compensation packages can be unnecessarily inflated, and employees are stretched so thin as to prompt inadequate job performance and even burnout. BOMA San Francisco is diligently addressing workforce development and training needs. Our Careers Committee is building relationships with local colleges and universities, educating students about industry career opportunities. Our new Foundation is gearing up to provide financial assistance to students who wish to take advantage of the many training programs BOMA offers. And BOMA’s Young Professionals Committee plays a supportive role in helping newbies plug into a collaborative network of learners and “doers.”

Your help is needed: Here’s how One of the best ways to give students a glimpse of the day-to-day goings-on in an office building is to allow them to shadow employees in key positions such as engineering, construction management, tenant administration, and property management. We’d like you and your staff in the above disciplines to consider volunteering to be shadowed – for two hours, four hours, or a full day.

From recent participation in local university career fairs, we have collected contact information from sixty students who’ve expressed interest in learning more about commercial real estate career opportunities. We’ll soon send an email request for “job shadow” volunteers. Opening the eyes of young people to our industry is the first step toward opening doors to a fulfilling career. And a more fully developed talent pool will benefit our entire industry. In addition to recruiting recent graduates to our field, it’s important to spread the word to seasoned professionals who are considering a career change. Many employees who have been downsized during the recent economic downturn have skill sets that would be a good match for commercial real estate positions.
