Overview: Health care providers are now subject to random audits for their compliance with HIPAA - especially those relating to electronic security under the Security Rule - and with the requirements of the Medicare Electronic Health Records Incentive program (better known as "Meaningful Use"). Many providers are unprepared to respond to such audits. Those who fail to adequetely prepare may face a range of possible penalties and difficulties. This webinar explores the background of, and recent developments in, the HIPAA audits being conducted by the Department of Health and Human Services’ Office of Civil Rights, and the Meaningful Use audits being conducted by CMS and its contractor, Figliozzi & Co. The webinar examines the type of information reviewed in each audit, and discusses common problem areas, including areas of overlap between audit types, such as the security risk assessment. Lastly, the webinar discusses the legal implications of such audits, and what practical steps health care providers can take to prepare for such audits. This session explores the history of both the HIPAA and Meaningful Use audits, including the process for each type of audit, and the kind of information requested. This session also discusses common problem areas, and the kinds of penalties that health care providers face under each type of audit. It also discusses how these audits can overlap with the federal False Claims Act, including a discussion of recently published regulations regarding the retention of overpayments.
