Online education leader Study.com launched its Working Scholars program in Gilroy this month offering anyone living or working in the city the chance to earn a free bachelor’s degree. All costs are community funded: covered by the local business community, philanthropic organizations, grants, individual donations and more. The Gilroy Chamber of Commerce partnered with Study.com to bring Working Scholars to the city. Fresh off the heels of the success of a similar program in Mountain View, the initiative was kicked off with an info session held at Gilroy High School theatre. Attendees were introduced to success coaches, including Mark Turner, CEO and President of the Gilroy Chamber of Commerce and Dr. Michelle Bresso, Vice President of Academic Affairs at Gavilan College. According to the U.S. Census Bureau, only 25% of Gilroy residents over the age of 25 have a bachelor’s degree. Study.com said that 27 potential scholars activated accounts within just one day of the invitation email being sent, and 17 applicants had already completed the required college success course. Applicants are accepted on a rolling basis as further community funding is secured to finance the cost. More information about the Working Scholars program is available at www. workingscholars.org

a large reservoir we could depend on for a long period of time,” said Melih Ozbilgin, the project’s manager who is working to meet an Aug. 14 deadline to apply for funding from the California Water Commission. “It has the potential for reducing floods downstream when the rains come from the hills and it will relieve us from having to use
ground water in times of drought.” One of the problems during the drought was that water started tasting and smelling bad because of algae blooms at the San Luis Reservoir, which would be helped by having more available fresh water. The reservoir now holds 6,000 acre feet of ➝ Pacheco Dam, 12
For perhaps the first time in its history, a veteran Gilroy police captain has been demoted from the department’s second highest rank to its lowest, according to city officials. “I have been here a long time and this has never happened (before) to my knowledge, at least not in the 33 years I’ve been here, Police Chief Scot Smithee said this week. Citing confidentiality laws surrounding personnel matters, he and other city officials, including City Administrator Gabe Gonzalez, would not say why former Capt. Royce Heath was stripped of his management rank and demoted to police officer. The demotion stems from an alleged violation of departmental policy or city rules that happened long before Heath was promoted in the spring of 2016 to be one of four captains, the rank right under police chief, according to Health’s San Luis Obispo attorney, Dennis Belsamo. “There are no criminal allegations, it’s strictly internal allegations of a violation of police department rules, city rules,” he said. LeeAnn McPhillips, Gilroy’s Human Resources Director declined to discuss specifics of the case. “We are not able to confirm date of a peace officer rank change or if a peace officer employee was on administrative leave as that would require accessing a Peace Officer personnel file,” she said in an email Wednesday. Without referencing the Heath matter, she said appeals are in process and that the city takes such matters seriously. Police and fire personnel are held “to an even higher standard,” she said. “When something serious happens and the facts support that, you will see the city take serious action in what we believe is the best interest of the organization and the city we are,” McPhillips said. ➝ Demoted, 2

Demoted officer may contest chief ’s decision Demoted, 1 There was no estimate from the city or Heath’s attorney on when the matter might be fully resolved, let alone how it will end. Then Sgt. Heath was elevated to the department’s second highest rank as a probationary captain by former Police Chief Denise Turner, who retired soon after in December of last year. Apparently, no indication of possible wrongdoing was ever forthcoming from or alleged by the Turner administration, at least not publically. Heath was the public face of the department as its public information officer dealing with the press and overseeing the department’s social media pages. Probations can last a year or more and can confirm or derail a promotion. After Heath ran into trouble, the city conducted a preliminary investigation earlier this year and reached its “initial” conclusion, but its probe was flawed, according to Belsamo, suggesting the investigation was reopened by city officials after he challenged its conclusions. “I pointed out problems with the investigation,” and so the city now has an “ongoing” investigation, he said. One problem is how long it took the city to act, Belsamo said. “They forgot to consider the statute of limitations, which I reminded them of (and) which is why the investigation is continuing,” Belsamo said. “They did the right thing, the city has been cooperating,” he said. Under state law, including the Police Officers’ Bill of Rights, the city has one year to act when wrongdoing is suspected or alleged but did nothing for three years, so it has no case, according to Belsamo, who added he would advise his client not talk
to the media and hopes the matter is not “tried” in the press. Except to confirm the basics and outline personnel procedures and appeal policies, city officials had little comment, again citing confidentiality laws. Based on Belsamo’s comments, the alleged violation appears to have taken place in 2013 or 2014, when Health was a sergeant and Denise Turner was chief. After Turner’s retirement, 30-plus-year GPD veteran Scot Smithee took over as interim chief and later accepted the permanent position. Smithee this week said he moved quickly when he learned of the matter in January after coming out of retirement to accept the interim post. “I react to stuff like this when I become aware of it,” he said. The highly respected professional rose through the ranks in Gilroy over three decades. His ascension to the chief ’s post was widely welcomed by a department whose former chief was not without critics among the rank and file, albeit silent ones, for her style of leadership. “I came back on December 30th and I became aware of this (Heath matter) the third week of January. I put him on administrative leave on January 24,” Smithee said. Health, who Belsamo described as a “great guy” and a “stellar” professional, spent more than three months on leave at full pay before he returned to work, with restrictions, according to a city official who declined to elaborate. “I brought him back on Monday, May 15, and that was in the position of police officer,” Smithee said. Both sides in any personnel matter can agree to waive timelines that typically dictate how the process moves forward,

She declined to discuss timelines in the Heath matter. She confirmed that former Capt. Heath is now a police officer. In cases of a demotion or other disciplinary action, the employee has the right to appeal to the Gilroy Personnel Commission, the city administrator and, ultimately, to the city council, according to McPhillips. If still unsatisfied, the employee could take the city to court, she said. An appeal to the commission can be for a confidential hearing or a public hearing, at the applicant’s choice, she said. The employee can also opt to skip the personnel commission and take the appeal directly to the city administrator, she said. Belsamo said he is going on vacation soon and hopes the city holds off on any action until he returns.
In 2015, while still a sergeant, Heath was the city’s fifth highest compensated employee in terms of base salary, overtime, special pay and benefits, which combined totalled nearly $245,000. That was just under the police chief ’s total compensation at the time. His overtime pay alone that year exceeded $38,000. The salary range as of July 1 for a sworn department employee at the rank of Police Officer is $86,539 to $105,192. At that rank since May, Heath as of June was earning a base salary of $10,019 per month in regular pay, according to the city’s Human Resources Department. That’s just below the highest pay for a sergeant, $124,821 per year or $10,400 per month. Captains as of July 1 earn from $130,536 to $174,036 per year. As a probationary Captain in October 2016, Heath earned
$12,243 per month in regular pay, or nearly $147,000 on an annual basis. In April of this year, while still on administrative leave, his salary remained at that level, according to the city’s human relations department. A month after his return, his monthly regular pay as a police officer as of June was $10,019, or $120,228 per year, an apparent pay cut of $27,000 per year. Heath was a sergeant part of 2016 and a captain for the rest. He earned nearly $131,000 in regular pay that year and about $17,627 in overtime pay. McPhillips said, “All of the parties involved in these matters take them very seriously. Anytime you are going to take a significant disciplinary action against an employee, that is a very serious thing; it changes people’s lives and careers and reputations in a department.”

Gilroy company builds big all over the Bay BUT NOAH CONCRETE HAS ONLY DONE ONE PROJECT IN ITS HOMETOWN By Bryce Stoepfel Reporter

On another hot Thursday morning, Don Alvarez, Sr., the owner of Noah Concrete, could have been sitting cool in his office on Rossi Lane. Instead, he was out overseeing the concrete pouring work on a large scale Costco project in South San Francisco. The concrete business is hard work. Alvarez Sr, 62, founded Noah Concrete in 1996 in San Jose, then in 2000 moved the company to Gilroy. With more than 77 employees, Noah Concrete expects to buy $7 million in concrete from its suppliers this upcoming year. The company focuses only on large scale projects such as the Alexander Station Apartments with a fleet of truck tractors, cement dumpers, rollers, and cement pumps. It does commercial, residential and government projects. However, other than the new Alexander complex, work in Gilroy has been rare. “In seven years of bidding for jobs in Gilroy, I never got a single job in Gilroy except for that job,” said Eugene Pacchetti, Senior Estimator at Noah Concrete. “We laugh about it. We get jobs in Walnut Creek, Lafayette and Daly City, but nothing
here. We’ve doing some pretty big stuff — just not in Gilroy.” Pacchetti said he doesn’t know why they can’t crack the market in their hometown. Competing to offer the best bid on a job, where the consumers must weigh costs as well of the quality of work means tight competition within the industry. Despite the permanent nature of concrete, business must move fast. “We say, ‘When we move onto a job, we know we got it,’” Pacchetti, 76, said. “When you bid private work, someone can offer a better price months after we've successfully bid on a job.” It’s a tough industry, but Noah Concrete’s gross sales are expected to be higher than $19 million this year. “We bid jobs the way we’re going to build it,” Pacchetti said, who bids project to include all phases of the job, when determining unit cost. Given the distance between jobs, Noah Concrete incurs significant fuel costs. When gas prices hovered over $3.50 a gallon, they spent $22,000 a week. With jobs as far as South San Francisco, Daly City, Coloma, Salinas, Hayward, and Danville, they keep their equipment fueled with a swarm of refueling trucks delivering diesel fuel. “With traffic the way it is, it takes too long for our guys to get where they need to go,” Pacchetti said. “For the job, we did in

Lafayette, our guys would come in by 5 a.m. to be on the job by 7 a.m.” Alvarez, Sr. and Pacchetti, who have nearly 100 years of combined experience, have worked together with another concrete company nearly three decades ago.
With deep industrial roots, word travels fast. “It's a very well connected business and I tell contractors; ‘if you don't think we talk, you’re mistaken,’” Pacchetti said. “Sometimes a company will call and say that someone else is way
cheaper than us. We chat with each other and often find out that they’re playing us against each other.” Noah Concrete is not insured to pour concrete for single family homes, but rather concentrates on large-scale projects.
“When you have a single family residence there’s an issue of longevity of claims,” Pacchetti said. “Basically, it never ends. The statute of limitations on a house does not start until someone finds an issue.”

OPINION LETTERS Smoking pot is still smoking and illegal Residents in Luxury Apartments in downtown Gilroy who rented for a smoke free environment are being ignored as their apartments and sometimes halls are filling up daily with people smoking pot. The apartment manager has ignored the illegal smoking problem which is under the new prop 64 and building's no smoking lease. LEGAL POT CAN NOT BE SMOKED IN SMOKE FREE BUILDINGS EVER. Pot can cause heart attacks in healthy people, Mayo Clinic shares. One luxury apartment renter has already had to go to the emergency room as a result of the illegal pot smoke in what was leased as a smoke-free building. KRON news is even following the story as this is such new territory in dealing with the legalized pot difficulties.. Under the new laws — Prop 64 says pot may not be smoked in non-smoking buildings such as those downtown. Also, pot may not even be smoked in nonsmoking buildings if used for medicinal purposes such as cancer or seizures. So those medicinal pot users need to stick to Prop 64 guidelines in the environments forbidding smoking. A simple solution to keep their neighbors who are heart patients out of the danger of wrongful death by AFIB. That would send the pot user to court for murder.

How bad can housing get and what can we do about it?
Q
uestion: I recently had a terrible experience with my landlord and want to know how to exercise my rights and make sure he never treats any other tenant the way he treated me. As soon as my ex and I moved in, my landlord started hitting on me. For example, he used to call my cell phone, lavish unwelcome compliments on me, and ask me out on dates. I didn’t want any problems, so I would usually just laugh it off and say, “You know I’ve got a boyfriend!” Recently, my boyfriend and I broke up. As soon as my landlord found out my ex moved, my landlord kicked things into overdrive. He started showing up at my door without notice, and even let himself in to my house when I was at work for no apparent reason. One night, I even caught him peeking through my living room window. I didn’t feel safe in my own home anymore. Luckily, I found a new place to move. However, as soon as I gave notice, my landlord told me he wouldn’t give back my security deposit unless I met him in a hotel room! What are my rights? How can I prevent this sort of thing from happening to other tenants? Answer: Federal and state fair housing laws make it illegal to discriminate against person because of gender or sex. Sexual harassment in housing is a form of sex discrimination. Courts recognize two types of sexual harassment: (1) quid pro quo (i.e., when a housing provider expects or grants a favor in return for something); and (2) hostile environment (i.e., when a housing provider creates an environment that is intimidating, hostile, offensive, or otherwise significantly less desirable for a resident). Sexual harassment may be either severe or pervasive — just one incident may be enough to make a claim that a landlord has violated the law. You’ve described a troubling pattern of behavior that appears to have been based on

A grassroots group of more than 50 Gilroyans was told that the city police department hasn’t and will not enforce federal immigration law Tuesday night at
a meeting at South Valley Middle School. Councilmembers Peter Leroe-Muñoz, Fred Tovar, Cat Tucker and Chief of Police Scot Smithee heard an impassioned plea from members of PACT, People Acting in Community Together, asking that they take action to protect undocumented workers. PACT is a multicultural,
multifaith organization that focuses on social justice and represents more than 50,000 people in Santa Clara County. “The Chief really spoke to the issue in no uncertain terms that the police department doesn’t do immigration enforcement,” said Leroe-Muñoz afterwards. “That is not something they have done or will do.”
Leroe-Muñoz said the issue wasn’t so much about making Gilroy a “sanctuary city,” as it was about ensuring that all residents, documented or undocumented, are protected by police and the police are not enforcing federal laws. Many said they feared living here under the threat of deportation. “While hundreds of
local governments across the country are establishing protection for undocumented immigrants in the face of increased ICE operations, Gilroy residents seek a city policy that clearly states such protection,” its agenda explained. “The opening of the ICE office in Morgan Hill has raised immigrant concerns in South County.”
In Gilroy, Latinos comprise nearly percent of the population and it is estimated that more than 10% of the total population is undocumented, the organization told representatives. The organization asked for assurance from the Gilroy Police Department and the city council to protect undocumented workers from being deported.

Carol graduated Gilroy High School, attended Monterey Peninsula College, she was a bookkeeper/ accountant for many firms during her career, she was also affiliated with the Ojai Gun Club. Carol was a lot of things to many people. She faced a lot of challenges and never gave up. She is and was a Beautiful Soul and will be missed by many.

He always had the itch for motorcycles as he loved riding dirt bikes. So he went on to work for Custom Chrome and later became self employed selling motorcycle parts. He grew to have many friends through his work and will be truly missed and loved by many. John was a board member with the Gilroy Little League Baseball, where his son Paul played baseball for many years. John was always willing no matter what time of day to help with equipment, keeping score, and being an umpire. He was well known with the baseball community and will be truly missed and loved by many. John enjoyed the simple things life had to offer. He enjoyed spending time with family and friends, fishing, baseball, going to the races, and the beach. He had the biggest heart, he was a Gentle Giant who had love for All he knew and met along the way. He will be dearly missed by All who knew and loved him. John is survived by his Beloved Wife Julie D. John was born to John and Albina Grimsich in Zuzemberk, a small Slovenian village. They immigrated to Chicago when John was 14 months old. He and his parents enjoyed being part of an active Slovenian community in south Chicago. After serving two years in the Army, John attended the University of Illinois and received a BA in Advertising Design. He moved to California in 1955 and began a long career in technical publications at Lockheed. John married Virginia Yeggy in 1957 and they began their family in San Jose and were members of St. Francis Cabrini parish. In 1969 the family moved to Morgan Hill where they enjoyed many years in a rural setting with numerous animals. John served on the City’s Parks and Recreation and Planning Commission. John leaves behind Virginia Grimsich, his wife of 60 years and their five children Lynnette Kaashoek (Garth), Darcy Bennett (Gene), Connie Grimsich (Greg Katz), John Grimsich (Karen) and Greg Grimsich (Claudia) and ten grand children: Owen, Alex, Cy, Jon, Sam, Amelia, Anica, Will, Maya, and Ludo. John will also be missed by his brother Daniel Grimsich (Sylvia), and many nieces and nephews and their children. Gilroy High School seniors who decorate their parking stalls with elaborately cool art work will soon have a new canvas for their teenage self-expression. The school’s sprawling parking lot off Princevalle Street and adjoining the football stadium is right now undergoing a complete facelift that school officials say is worth about $1 million but will end up costing the district not a dime. That’s because the parking lot— and its counterpart at Christopher High School across town in north Gilroy — will be resurrected next month as state of the art, solar power generating plants. Work at GHS is quite a sight for anyone familiar with the old parking lot—it’s gone, replaced for the time being by heaps of rubble and a bustle of equipment and construction workers. It’s the district’s inaugural foray into solar power generating and it’s estimated the installation of the solar arrays at the schools will save millions of dollars in electric bills in the decades to come. The parking lot at the Gilroy Unified School District’s Christopher High School, which is less than 10 years old, is not being repaved, only the GHS lot will is being torn up and replaced as part of the project. James Bombaci, GUSD’s facilities manager is overseeing the project. He said this week that everything is on schedule
for completion by the time the 2017-18 school year starts on Aug. 17, and that the scheduled might even be “tightened a bit.” That the GHS re-paving project was necessary is no secret. Originally scheduled to be done last summer, the bankruptcy of one of the solar power companies involved in the project delayed its start by a year. “The parking lot was in 100 percent failure,” Bombaci said. The pavement of the pothole flecked lot was also experiencing extreme “alligatoring,” according to Bombaci, a situation where the asphalt develops a deeply rippled surface. Granite Construction Company is the contractor for the paving work at GHS and Borrego Solar will erect and install the solar arrays that will splay out over the two high school lots. The adjoining tennis and basketball courts at GHS will not be impacted by the project and the parking lot will be the same size when the work is completed. However, because space is taken up by the solar installation, the lot will lose several parking stalls, according to Bombaci. One of the improvements that will come with the project involves the single entrance and exit on Princevalle Street. The new lot will boast two exit lanes, one that will be left-hand only and the other righthand-only, and two entrance lanes, Bombaci said. The paving at GHS and the two high school solar installations will be done at no cost to GUSD, under
a solar power-funding plan called a PPA, or Power Purchase Agreement, Assistant Superintendent Alvaro Meza said this week. According to the Solar Energy Industries Association, or SEIA, a PPA “is a financial agreement where a developer arranges for the design, permitting, financing and installation of a solar energy system on a customer’s property at little to no cost.” It works like this, according to SEIA: “The developer sells the power generated to the host customer at a fixed rate that is typically lower than the local utility’s retail rate. This lower electricity price serves to offset the customer’s purchase of electricity from the grid while the developer receives the income from these sales of electricity as well as any tax credits and other incentives generated from the system.” As is true with most PPAs, Gilroy’s will go on for decades, during which time the developer, Borrego Solar, is responsible for running and maintaining the system, according to district officials. “At the end of the PPA contract term, a customer may be able to extend the PPA, have the developer remove the system or choose to buy the solar energy system from the developer,” according to SEIA. The installation of solar arrays over the parking lots will result in a lot more than just savings on energy bills, according to school officials. The installations will provide more shelter, lighting and security for students, staff and anyone visiting the schools, they say.

Less than 48 hours after suffering his first knockout loss of his career, Robert “The Ghost” Guerrero announced he is hanging up his boxing gloves for good. “I want to thank everyone, the fans included. I hope you guys appreciated the guts and glory I left in the ring. God bless you all,” Guerrero said in a statement. Guerrero officially brings to an end a career that spanned 16 years and featured world titles in four divisions, including the World IBF Featherweight Title twice. He finished with a record of 33
from boxing. Guerrero had suffered his first knock-out loss of his career on Saturday at the hands of Omar Figueroa. wins, 6 losses and one draw. The Gilroy native and current resident got his start at Bantamweight and made his way up the ranks to welterweight here he ends his career. Guerrero reflected on his time in the ring fondly, acknowledging that the road over the years wasn’t always the easiest, but he made sure to always keep fighting. “A boxer’s career is a long and tough road. Many tears were shed, lots of blood, and tons of sweat. Many miles were traveled, thousands of rounds sparred, none were easy and nothing was ever given to me,” Guerrero said. “I earned everything I got the old fashion way. I never ducked anyone and fought the best fighters in the world. I fought my way through every obstacle to make sure my fans enjoyed every second, of every round, of my fights.” And through it all, Guerrero said he never forgot where he

Gilroy sweeps to state title The Little League Minor softball team won the state championship in Madera, going 8-0 through out the All Star tournament. Gilroy was 2-0 against San Jose in the district tournament and went 3-0 in Martinez at the Section tourney. In sections, Gilroy beat American Canyon 12-1, East County from Brentwood 6-5, and beat East County 13-0 for the title. From there Gilroy moved on to Madera for State championships defeating Consumnes River from Sacramento 7-2, Sutter Butte from Chico area 10-9 and again 15-8 to win State. This was the first time ever the girls Minors went undefeated on a run all the way through state.

This season, Hill helped lead Gavilan College to their firstever appearance in the California Community College Athletic Association (CCCAA) state tournament. “Hazel brings added depth to the post position,” Mouat said. “She is strong and is a good presence on the boards. What is most exciting for us is the fact that Hazel still has a ton of room for growth and improvement. I think she will make an impact for us in many areas.”

ruled Guerrero was let out of his contract by the CSAC because of “corruption, fraud, or other undue means,” The Ghost still split with Goosen and opted to fight under Golden Boy Promotions because the original contract had expired. It was under Golden Boy Promotions that Guerrero got his shot at Floyd Mayweather, Jr. in 2013, suffering just his second defeat of his professional career. Guerrero quickly rebounded with a unanimous decision win over Yoshihiro Kamegai, but Guerrero wasn’t the same fighter after that. After his win over Kamegai, Guerrero won just one more time in four matches and had lost his last three bouts. His final coming by way of technical knockout after the referee stopped the fight with Omar Figueroa in the third round. Guerrero had been knocked down five times between the second
and third rounds leading to the stoppage. Guerrero thanked everyone who had helped him on his journey, including his wife Casey and his father Ruben Guerrero who also acted as his trainer. He also had a special thank-you to his advisor Al Haymon. “Not only is Al Haymon a spectacular advisor, he is a wonderful human being as well, a great man, and someone who cares,” Guerrero said. “In a sport where most managers, promoters, and trainers turn their back on a fighter, when they no longer can perform, or are no longer beneficial to their interest, Haymon stands tall. Love and loyalty is tough to find in the boxing game, but for any boxer looking for it, you don’t have to look far, reach out to Al Haymon.” Guerrero also repeatedly thanked God in keeping with his deepseeded faith that kept him going through his career.

including a 2013 arrest for reportedly attempting to bring an unloaded gun onto a flight out of New York City. The gun was licensed in California authorities said at the time it still violated the city’s strict gun laws. Guerrero, who acknowledged he made a mistake by not being aware of New York’s gun laws, eventually pled guilty to disorderly conduct and had all gun charges dismissed. Back in 2008, Guerrero got into a legal dispute with his then promoter Goosen Tutor Promotions. Guerrero attempted to get out of his contract with Goosen Tutor in 2008 claiming he had not received some big money fights. The California State Athletic Commission ruled in Guerrero’s favor at the end of 2008, but that was overturned by a Los Angeles Superior Court judge. Although the judge
