Former Gilroy Police Chief Denise Sellers said allegations of scandalous sex charges against officers in her department are false, the result of “a disgruntled employee making accusations that aren’t true.” In an interview this week, she said the charges made by fired dispatcher Patricia Harrell were thoroughly investigated by Gilroy Police and an outside investigator and had no validity. In a 60-page lawsuit filed Aug. 7 (available here: bit.ly/gpdsuit), Harrell alleged that Gilroy officers had inappropriate sexual relations with members of the Police Explorers, a young volunteer group with members aged 14-21, exposed themselves at drunken parties in the presence of minors and hosted sex parties that included wife swapping. After first discussing Harrell’s lawsuit last week, her attorney, Andrea Josta, Tuesday clarified one of her client’s allegations, that officers were sexually intimate with youth in the Gilroy Explorers Post. Josta said that in interviewing witnesses, “Our understanding is that there were a couple of minors involved” and that the alleged activity took place several years ago. More information might be developed as a result of the discovery process, she said, referring to the legal term for both sides in a suit gathering additional information. According to the lawsuit, one officer left the department as a result and the other was demoted but later reinstated to his previous rank. Josta also said Harrell is “devastated that this all has to come out, but she has received some words of support, so that is good.” She added that while the public might get caught up in the sexual allegations, which she said are “very much an important piece” of the case, it is

Gilroy’s new school year got off to a record-breaking start, with more students, teachers and expenses than ever before. “It was our best opening day of school with very few problems,” Gilroy Unified School District Superintendent Debbie Flores said Tuesday. Classroom instruction for the 2017-18 year kicked off on Aug. 17. “Within an hour of the opening, teachers were teaching and students were learning about all the great things that will be happening this school year,” Flores said, adding, “There was such a positive feel to this year’s start with lots of excitement and enthusiasm.” In all, 11,485 students took to their desks at the district’s 15 school sites. They include eight grammar schools, three middle schools, two comprehensive high schools, a continuation high school and an early-college academy located at Gavilan Community College. If past years are any indication, the student population by October could be up another 2 percent, according the GUSD’s Public Information Officer, Laura Correa-Hernandez. The number of teachers also grew, from 542 last year to 558 this year, as did the number of GUSD employees, from 1,050 at

There’s a new buzz and excitement going around downtown Gilroy these days. Several new businesses have either recently opened or will open in the very near future alongside businesses who are expanding their offerings. New this past spring, Greenhouse Coworking opened on 7500 Monterey St. providing office space, desks, video equipment and meeting rooms for freelancers, individual contractors, students or start-ups looking for a work space with strong Wi-Fi access. Raul Ceja, community coordinator for

the company, stated, “Business has been good. Walk-ins are welcome Monday through Friday from 9 a.m.- 5 p.m. and members can access their reserved spaces on a 24/7 basis.” Bartenders Union, offering a full-bar, 20 beers and four wines on draft, is the latest project of Dustin Evanger, who formerly owned The Hill Bar & Grill in Morgan Hill. Evanger runs the business with four silent partners explained. “As former bartenders, we wanted to create a place that we would like to go to and hang out,” Evanger said. It’s a place

for everybody; older, younger and everything in between.” The new bar has pool tables, dart boards and a juke box. Although food is not available for sale, patrons can bring in their own food or have it delivered. Not to miss is the wall filled with “Union Rules,” a humorous list of do’s and don’ts for guests. Entrees include everything from omelettes, combination plates of traditional fare to oysters, shrimp, and steaks. Art-lovers will be glad to know that Moya Art Gallery and Studio has opened – located on 7516 Eigleberry. Owned by Ignacio (Nacho) Moya, the art gallery has a collection of Moya’s work including portraits, abstracts and murals in pen, pencil and oil. Moya has done the mural work at newly remodeled Station 55 restaurant. “We offer paint parties for private parties of up to 15 people,” said Moya. “We’re open Tuesday through Saturday, from 10 a.m. to 5:30 p.m.” Lynn Mosley, owner of the newly opened Itty Bitty

How can we fairly police the police?

f there’s one thing the salacious and damaging sex scandal lawsuit filed against the Gilroy police this month proves, it’s that we need more transparency in policing the police. The suit, filed by 25-year veteran dispatcher Patricia Harrell, who was fired two years ago, alleges that members of the Gilroy police department sexually harassed her and that she was punished for reporting it. She says the department was rife with scandalous sex activities, including wife-swapping parties, drunken pool soirees in which women exposed themselves in proximity to minors, and that officers had inappropriate sexual relations with members of the youth volunteer Police Explorers. The department has gone silent on the charges—claiming they can’t talk about a pending lawsuit or of personnel matters—at precisely the moment when they need to be openly and transparently engaging in public discussion. The public that pays police salaries and has a very direct and immediate interest in public safety has been frustratingly left in the dark. We know some things, but the dots are harder to connect. Royce Heath was promoted to captain and then unceremoniously demoted to patrol officer. The department will not reveal why he was downgraded. The lawsuit suggests he was involved in wife swapping with other officers and got into a fight over it. We won’t know the truth unless the case comes to trial, but the public deserves to know why an officer was demoted, particularly one in command who, with overtime, was the department’s highest-paid officer. Another officer named in the suit resigned from the department. The suit alleges he had relations with an Explorer. Without good information, people outside the inner circle can only guess at the answers. Should the public should be notified about police misconduct and resulting staffing changes? Former Police Chief Denise Sellers says the suit is a pack of lies. And maybe that’s true. However, the way pertinent facts are hidden

from view by the department casts suspicion. Departments elsewhere were decimated when internal crimes were brushed under the rug. About a third of the officers of the King City Police Department were convicted of stealing cars from indigent immigrants. That case was broken after the Monterey County District Attorney investigated comments made on the KSBW-TV website about police stealing cars. (The officers, by the way, got slaps on the wrist, with the toughest sentence being 30 days in jail that didn’t have to be served and unsupervised probation.) Then there’s Oakland, where two dozen police officers had sex with an underage prostitute. That case came to light when an officer mentioned it in a suicide note and a federal judge monitoring the department took action. Neither of these cases was brought out by internal investigations. When other officers found out about the crimes, they didn’t turn in their fellow officers, they joined them. In an interview, former Police Chief Denise Sellers said the Gilroy case isn’t like those and that there’s no scandal. As much as we’d like to believe her, there’s no narrative to counter what’s been presented in the lawsuit. Until the Dispatch published that suit, Gilroyans thought of GPD as one of the squeakiest, cleanest and open departments around. Hopefully, that’s still true. But we think the case needs to be looked at by outside officials, in part because there are allegations of sex with minors and lewd and lascivious behavior around minors. In an email, the Santa Clara District Attorney’s office had this to say about the case: “There are some circumstances where the District Attorney’s Office initiates a criminal investigation. In circumstances like these, we encourage victims of crime to file a report with the police. We regularly review reports to determine if a crime has been committed and if so, if we can prove it beyond a reasonable doubt.” That’s not enough.

The council is also looking at increasing fines. Gilroy charges $250 for a fireworks violation. Morgan Hill boosted its fine to $750. Other cities have raised them to $1,000 for one violation, and $1,000 added for each one after. Dennis Revell, whose Sacramento public relations firm Revell Communications, represents TNT Fireworks, the state’s biggest seller of legal fireworks, has been helping cities fight

The Gilroy City Council is considering some serious penalties to cut the booms next Fourth of July, including increasing fines from $250 per violation, charging violators for disposal of fireworks and having an app that lets neighbors report illegal fireworks via cell phones. After hundreds of complaints of illegal fireworks exploding around neighborhoods this year, council members say that what they have been doing so far isn’t working and they are studying severe enforcement and penalties, including putting police in

undercover cars and even having police rent cars to catch violators. “I have received so, so many complaints about fireworks,” said Mayor Roland Velasco, who still supports selling legal “safe and sane” fireworks for the holiday. “Unfortunately we have a lot of yahoos out there who think bigger is better and want to get the biggest bang.” Velasco said he saw illegal fireworks all over his neighborhood. He made a motion that was approved unanimously for city staff to come back with recommendations to improve the problem for next year. This year, Gilroy’s citations were below neighbors in Morgan Hill and Hollister, although residents said the noise was worse than ever. Gilroy Police issued only 16 fireworks citations this year, down from 34 in 2013 and less than the 20 issued in Morgan Hill and 29 in Hollister this year. Police Chief Scot Smithee said his department was

Administrative fines have less of a standard for proof. A photo of fireworks in a yard is enough to fine a homeowner. For a criminal case, police

have to see who lit off the firework and prove it. In many cases, said Smithee, there can be a crowd of people around illegal fireworks, but police can’t prove who set them off. That makes for a higher burden of proof than the administrative fine, the chief said. Mayor Velasco asked the staff to prepare a report well in advance of next July 4.

Charles known by most as Chuck enjoyed traveling, fishing, politics, cooking, and spending time with his loved ones. Chuck was most known for his wit and humor. Chuck was a great man, father, and friend. He was a proud grandfather who doted on his grandkids. Charles was preceded in death by his loving parents Rudy and Carmela Bava. Police take kids to Kohl’s Shop with Cop, 1

“Every time I’ve come shopping, I’ve met a fantastic kid and a fantastic family,” said Parra. “To this day when I see them around town, they’ll come up and say “Hi” and smile. It’s a good feeling plus I’m passing it on to my girls.” The Gilroy Exchange Club raised the money through its annual November Harvest Dinner. The families are also treated to breakfast. Exchange Club member and community activist Carlos Pineda said this year Steve and Jan Pete, who own the local McDonald’s franchises, provided the meals. Police found one family not in school, but in a tent. Officers were conducting a cleanup of a local homeless encampment earlier in the week when they came across them. “There were four kids living in a tent (ages 3, 6, 14, 17) with mom and grandmother,” said GPD Sgt. Jason Smith. “At that time the mother mentioned that she didn’t have any clothes for her kids to wear to school,” said Smith. “Their shoes were extremely worn down and dirty and they only had one pair each.” He took action. “Having daughters that are that age myself, I called my wife

a shopper from one of the agencies. The kids are recommended by school nurses. The Gilroy Exchange Club started the program two decades ago, but police got involved six years ago. Former Gilroy Police Chief Denise Turner (now Denise Sellers) came out of retirement to help. In order to serve all the families, the event is spread out over two Saturdays and the Shop with a Cop falls on the second day. “They love this,” Sellers said of the police officers. “Last weekend they were here shopping with us too and they didn’t even have to be.” The children are given about $150 with all the discounts. The CHP raises money by selling legal fireworks with the El Camino Club. “This year we donated $2,000 to sponsor roughly 20 kids,” said Sgt. Chris Miceli. “And Kohl’s gives us another 30 percent off.” Many of the officers use this as a chance to teach their own children about community service. CHP Officer Steve Parra, who has been volunteering for this event for the last five years, brought his twin daughters, Melissa and Morgan, 12, to help out.

Lawsuit alleges major misdoings at GPD Former Chief, 1 for her office “an employment case.” The Boy Scouts of America, parent organization of the Explorers, reacted swiftly to the lawsuit’s allegations. On Tuesday BSA headquarters issued a statement related to the officers named in the suit and that reads, in part, as follows: “The behavior included in these allegations is abhorrent and runs counter to everything for which Exploring and the Boy Scouts of America stand. While these individuals were not registered in our programs, including Exploring, upon learning of these reports we took immediate action to prohibit them from any future participation in Exploring and all Scouting programs.” The statement continues, “The safety and well-being of our youth members is of paramount importance to the BSA, and integral to everything we do. We seek to prevent child abuse through comprehensive policies and procedures to serve as barriers to abuse. These include a

thorough screening process for adult leaders and staff, requiring youth protection training of all adult leaders and volunteers, and the prompt mandatory reporting of any allegation or suspicion of abuse.” Harrell alleged she was fired for warning other dispatchers about the behavior. She said she was threatened, investigated, harassed, called names and subjected to unwanted sexual advances as a result of speaking out against the alleged sexually charged work environment and off-duty parties. Hired in 1990, the city took action against her in 2015 and she was fired in March of 2016, three years before she would have received her full pension. “This person was trying not to accept responsibility and was trying to ruin other people’s lives and careers, which solidified my recommendation to recommend her termination,” said Sellers, who said she looks forward to testifying in the future civil trial. Sellers, who was chief for nine years, said she had heard

Harrell’s complaints and hired an outside investigator found by the city’s Human Relations department and paid for by the city to check them out. “We investigated every single rabbit trail to see if there was some truth,” said the chief, whose maiden name was Turner. “We were able to close each of those. I investigated, responsibly and exhaustively. We took a long time to investigate those, each and every one of her claims. The whole thing was to tarnish the reputation we have in this community.” One of the police officers mentioned prominently in the lawsuit is Royce Heath, a former Salinas policeman who rose rapidly in the ranks when he joined the Gilroy department. In 2016, shortly before her retirement, Sellers promoted Health to provisional captain, the second highest rank in the department. However, in January, less than a month after he took over for Sellers, Police Chief Scot Smithee suspended Heath and in May brought him back as a police officer, the department’s lowest rank. This Evidentiary Hearing (EH) has been scheduled by the CPUC to review PG&E’s application. BACKGROUND The ERRA is used to record fuel and purchased power costs which can be recovered in rates. While this may result in an increase in rates, PG&E recovers these costs with no markup for return or profit. The purpose of this Application is to forecast costs of obtaining energy for customers and also to approve the amount to be returned to customers from the sale of GHG emission allowances for the calendar year of 2018. If the CPUC approves this Application, PG&E will begin to recover its costs in electric rates effective January 1, 2018. At the end of 2018, PG&E will compare actual costs to the amounts forecasted in this Application and will incorporate any differences in next year’s Application. HOW WILL PG&E’S APPLICATION AFFECT ME? Based on rates currently in effect, the bill for a typical residential Non-CARE customer using 500 kWh per month would decrease 4.1 percent. Actual impacts will vary depending on energy usage. Twice a year, in April and October, eligible residential customers will also receive a California Climate Credit in the amount of approximately $39.68. The impact of PG&E’s Application on Direct Access (DA) and Community Choice Aggregation (CCA) customers is an average increase of 0.3 percent. In addition, eligible non-residential DA and CCA customers receive the benefit of the GHG allowance returns. The impact of PG&E’s Application on departing load customers is a total decrease 0.4 percent. EVIDENTIARY HEARING At this EH the assigned Administrative Law Judge (Judge) will receive the testimony of PG&E, consumer advocacy groups, and other parties to this proceeding. Christopher High School has a new, but familiar starting quarterback for the 2017 season in Ben Sanford. Sanford spent his sophomore year watching from the sidelines backing senior Ryan Adamkiewicz trying to absorb as much information as he could to get him ready for the 20172018 season.

will vary this year because Christopher will join cross town rivals Gilroy in the Pacific Division of the Monterey League, a step-down from last year’s Gabilan Division. “We’ll be more confident with ourselves rather than last year we were going into every game like ‘oh man, we’re going to probably take a beating this game,’ but this year we’ll be at the same level and it will definitely be interesting,” Sanford said. Last year’s lone win came against Gilroy on the season opener. Despite being part of a lower division league, Sanford doesn’t feel it takes

the pressure off him to help his team get wins. “I definitely need to prove myself coming up,” Sanford said. “With good guys in the past (as QBs) it’s a big tittle for the school,” Sanford said. Sanford has not been left by himself to learn everything. He said he has great communication with his offensive players, specially the veteran players and that has helped him transition better into the starting role. Among those are tight ends Jason Scirigione and Payton Mitchell and the Davis twins, Christian and Tyler, at receiver and running back. Sanford said one of his

biggest takes from last year is the importance to not get flustered or let his emotions get the best of him when things don’t go his way. “I have a tendency to get nervous and that’s always been one of my biggest weakness, but this year I’ll just start to be more confident and making decisions on the field,” Sanford said. Sanford said he expects a winning season this season despite being his first year as a starter because he has good connections with all of his weapons on offence, which was one of Christopher’s struggles last season.

Running back Joseph Barnes was left with a bitter taste after losing to Soledad in last year’s CCS semis game by a single point. “I have high expectations from my team, especially the outcome last year,” Barnes said. “I just want to grow on from last year and do better than last year.”

Barnes rushed for 1,633 yards last season averaging over 130 per game and scored 26 touchdowns, according to his Maxpreps stats. Barnes, a multi-sport athlete, hopes the skills obtained last year on the Mustangs’ CCS football run and as a wrestler, where he reached the state finals, can help him lead the team on another CCS run. Barnes believes wrestling helped him become a better leader and gave him more body control and balance, which will make it harder for the opponents to bring him down on the field.

“It would probably take a couple of guys to take me down because of wrestling, because my good balance and awareness of my feet and body weight,” Barnes said. In addition to physical skills, Barnes said that the most important thing that helps him be successful in both sports is his poise under pressure. He tries to stay calm if things don’t go his way and have a shortterm memory in order to move on to what’s next. Barnes has also been able to take advantage of the skills he displays on the football field and transfer them to the mat. ➝ Barnes, 18

Dub Fall Ball tryouts being held in August Dub will be holding tryouts for its 12U Cooperstown team on Aug. 26 at 10 a.m. Anyone interested can register for tryouts. Dub is one of the only travel ball programs in the Bay Area to regularly send teams to Cooperstown for the 12U age. Dub has been to Cooperstown for three straight years and has finished with a Top10 finish every year, including this year’s third place finish. The 12U Cooperstown tournament is the largest youth tournament in the county and a once-ina-lifetime experience for the participants. The team stays in dorms for the entire week with the coaches and lives a baseball players dream week! Cooperstown is the birthplace of baseball and the Baseball Hall of Fame is also located in the quaint baseball city.

“It was definitely a rough experience, but it was good to learn and see what the varsity level would be like and it gave me a taste of what I would have to deal with this year and the upcoming year,” Sanford said. Sanford comes into the season with a few series under his belt. He played last year an average of five series per game, mostly in the second half. “It was good just getting my feet wet and see what the pressure would be like and how throwing a ball is different. Christopher sweeps but GHS goes down fighting Cheeto Barrera Sports Editor

The volleyball season is officially underway with the sportsmanship game Monday where Christopher and Gilroy squared off in a final tuneup before games start for real. On Thursday, Christopher kicks off at Saint Francis-Watsonville and Gilroy opens at San Benito, but Monday gave both teams a live look at rotations, at bench players and at some of the starters. The Cougars pulled away with a three-set win, 25-16, 25-15, 25-18, but the match was closer than the scores show. “It was a little rougher than I thought,” said Christopher coach Brian Calimpong. “I thought Saturday we played at a higher clip.” Calimpong said he had just gotten one of his players cleared to compete and was trying her out as a setter, which isn’t her natural position. Calimpong added there were times when the team looked sharp, making good passes into

quality sets for powerful attacks, especially from the back row. Maya Tabrone had several of her 12 kills from a back row look. But Calimpong said there was still some need for improvement to keep things sharp. Gilroy coach Bailie Carpenter said the team lost one of its main players due to an injury at the jamboree on Saturday and had a second key player on vacation. That forced the Mustangs into a new rotation that they really only had one day to practice. “All in all, I would say my girls did really awesome today,” Carpenter said. “I have no complaints with how they did.” She said there were some communication errors on the floor which allowed Christopher to go on several long runs, but there were adjustments made that kept her positive. In Games 1 and 2, Christopher jumped out to a big lead early. Kennedy Bretz went on a run of seven-straight

service points, including an ace to push Christopher’s lead to 10-2. In the second game, Amanda Catanzaro went on an eight-point run as the server in an 18-3 run that put Gm. 2 out of reach. But both times, Gilroy did not go down quietly. After falling behind by eight in Game 1, the Mustangs went on a 13-8 run to pull within four points at the end. In the second game, Gilroy went on a 6-0 run, led by some strong serving and several Christopher errors. Ultimately, despite outscoring the Cougars 13-5 down the stretch, the Mustangs weren’t able to stave off defeat. In the third game, themomentum seemed to carry over. Despite going down 9-2, Gilroy rallied to pull within one at 10-9. Both teams will play 6:30 p.m. Thursday. Christopher will then head to Spikefest on Saturday while Gilroy will host Mt. Madona on Aug. 28.

Report to the Public 2000 Measure A Sales Tax Activities Fiscal Year 2016 (7/1/15 – 6/30/16)

VTA delivers transportation solutions critical to the vitality, prosperity and quality of life for all who live, work or play in Santa Clara County. In November 2000, Santa Clara County voters approved Measure A, a 30-year half-cent sales tax devoted to specific public transit capital improvement projects and operations. Most of the ballot-defined projects are massive and complex, requiring years to plan, design and construct. Although in just the 10th year of a 30 year program (tax collection started mid-2006), VTA has achieved significant results toward meeting Measure A goals. A few key Fiscal Year 2016 accomplishments are: • Extending BART to the Silicon Valley cities of Milpitas, San Jose and Santa Clara, which will provide increased transportation options and reduce congestion. Phase I extension to the Berryessa area of San Jose is ahead of schedule and under budget. Construction is mostly complete (over 90%), system testing is underway, and passenger service is currently projected to start the first half of 2018. • Extending and improving light rail service with projects such as the Mountain View Double-Track project completed in December 2015 that allows enhanced service to Mountain View, Sunnyvale and Santa Clara. This project, combined with other improvements, allows VTA to establish a new light rail corridor from Mountain View to Alum Rock to accommodate the projected dramatic increase in public transit ridership into our County when BART service begins.
