Keeping Gilroy Gardens growing

LOCAL SCENE This play’s the thing

By the numbers Mathnasium of Gilroy, was honored in July for its outstanding performance at the 13th annual Mathnasium International Franchise Convention. The local outpost of this tutoring program specializing in math won the Rising Stars Award selected from a pool of more than 800 Mathnasium franchise locations around the world. “This award speaks to the great success we’ve had with the students who study at our centers,” said Seth Bullwinkle, owner of Mathnasium of Gilroy. “We are deeply dedicated to making math fun and engaging for all our students. My staff and I are so grateful to all the families who have trusted us with their children’s math education, our students for all their hard work and positive attitudes, and the Gilroy community for embracing Mathnasium in the way that they have.”

SINKING FEELING Pedro Virgen’s Union Taxi Company has sunk from 13 cabs to three as a result

of competition from largely unregulated ride share companies that charge half as much as him.

Local biz not Lyfted RIDE SHARE COMPETITION KILLS CABS By Bryce Stoepfel Reporter

The owner of Union Taxi Company of Gilroy says ride-sharing companies like Lyft and Uber have been killing his business. Pedro Virgen, 50, who has owned the company since 2006, has seen his business shrink from eight taxis and a dozen employees to three cabs and two drivers. He’s lost his home, and his family of four now shares a two-bedroom apartment with his sister and her husband. “I’m sad,” said Virgen. “I don’t know why the city lets them operate here, They don’t have to have permits, like we do. They don’t

have their cars inspected or give their employees drug tests. They don’t have the insurance we have.” Virgen works 12 hours a day to keep afloat and pay $4,100 a month for insurance, fuel, licensing fees, his office and advertising. Virgen has laid off his dispatchers and his secretary as business has dwindled. Customers “all go to Uber because it’s a lot cheaper,” Virgen said. “I don’t know if I'm going to be in business much longer. It’s just too much. They can charge half as much as I can. To go to San Jose, I charge $90, and they only charge $45.” Virgen, an immigrant from the Oaxaca region of Mexico, worked as a cab driver for Union Taxi and saved enough money to buy the company for $70,000 in 2006. He made a good living until about

three years ago, when Uber and Lyft made inroads here. Now, to help make ends meet and support his wife and 7- and 9-year-old children, he’s selling prepared food and Oaxacan crafts from his office at 7263 Monterey St. As part of the city’s regulation of cab companies, he’s required to pay rent on an office in town. The ride sharing companies aren’t. He is not alone. Taxi cab companies around the country have closed, including Gilroy’s Golden Taxi Cab. One of the things Virgen is most sad about is that he and his drivers made a decent living. In his opinion, rideshare drivers don’t make a fair wage, and says his drivers could make as much as $400 a day.

True or false: The City of Gilroy owns a tourist attraction business called Gilroy Gardens Family Theme Park. That’s false. True or False: Gilroy taxpayers paid $12.5 million for the park more than a dozen years ago when it was called Bonfante Gardens. That’s true. True or False: The Gilroy City Council controls park operations, hiring and six-figure management salaries and is required to make sure meetings of the park’s board of directors are open to the public, just like city council meetings. That’s all false. It’s true. In fact, park employees don’t work for the city; the park’s board of directors hiked the General Manager’s total compensation to more than $202,000 a year without public or city input and the board’s meetings are not open to the public. That’s because the company that runs the park, Gilroy Gardens Family Theme Park, Inc., is a private, nonprofit corporation, not a public agency. As such, it’s only required to file one public document each year, a financial summary called a 990 form that lists revenues, expenditures, assets, contributions and compensation paid to top management and directors. The eight directors of Gilroy Gardens, seven atlarge community members and one city council member, serve without pay. They include city retiree Jay Baksa, who was city administrator when Gilroy bought the park, Jane Howard, who heads the Gilroy Welcome Center, which for years has been partially funded by the city and tourism-related tax revenues and City Councilman Dan Harney, appointed in January by the council. The park’s 2015 financial form suggests the city plays a key role at the park and that its role is growing and will include the city Parks and Recreation Department. ➝ Gilroy Gardens, 2

CAMPING AWAY Parking lot living at the OSH isn’t pretty,

but the city says there’s not much they are doing about it.

Call (408) 842-9070 or email redphone@ gilroydispatch.com. What about the travel trailer that has been illegally parked forever in the Orchard Supply parking lot. I thought that the city had a 72 hour limit on vehicles parked on the street. Is private property different? It looks unsightly and harbors others to park there too.

T

hank you, good caller, for bringing this situation to our attention. The old Orchard Supply Hardware on 10th Street has been closed for several years and even though located on a busy street, the view of the parking lot is obscured behind tall shrubbery. Red Phone drove into the parking lot on several different occasions and observed not one, but several travel trailers parked there. In addition, we

noticed other commercial vehicles being stored there along with a few other cars – some vacant and some with people sitting inside. Checking with Scott Barron of Code Enforcement, at the City of Gilroy, we learned that it is not a violation of city regulations for people to park their vehicles in a public parking lot on a temporary basis. “I’m not aware of any laws that are being broken by people parking for short periods of time on a privately owned parking lot that’s open and accessible to the public so long as they’re not living on the site.” On the day that code officers drove by to check on the parking lot, there weren’t any RV’s or trailers on the property. However, after following up with a phone call to the property owner, Barron said, “One of the travel trailers has the express permission from the owner to park there during the day.” Although Barron acknowledged that city code prohibits people from living in a travel trailer or other such vehicles outside of a RV or other designated trailer park, as far as he is aware, the travel trailers are parked there temporarily. As a result of Red Phone’s inquiry, the city found that the commercial vehicles from The Parks at Monterey Bay were not licensed to be there and have since been removed. “We’ll continue to monitor the site however, as mentioned, if the property owner has an issue with anyone parking there then that would be a civil issue,” said Barron.

New indoor water park on the council’s table Gilroy Gardens, 1 In fact, agreed General Manager Barbara-Lea Granter, Baksa, Harney and councilman Dion Bracco—all interviewed for this article—the City of Gilroy has no say in anything related to the running of Gilroy Gardens Family Theme Park. That is, with the exception of its very existence; in that case, the city has the power of life and death over the nonprofit and could close the park today. That is because the nonprofit operates on city-owned land and uses city equipment and other assets under a year-to-year lease with City Hall. Confused? You might not be the only one. And that’s because

when Gilroy about 15 years ago came to the rescue of the financially hemorrhaging, privately-owned park built by former Nob Hill Foods owner Michael Bonfante, the deal that resulted created a situation that is about as uniquely odd in the world of theme parks as are Gilroy Garden’s beautifully grafted but grotesquely unnatural so-called Circus Trees, a tourist favorite. In the case of the California’s Great America amusement park, for example, the city of Santa Clara owns it hook, line and Demon Roller coaster. Ditto for San Jose’s Happy Hollow Park and Zoo, owned by that city and staffed by municipal employees.

But in Gilroy, while what the city bought still is seen as about as good a deal as the purchase of Manhattan by the Dutch in 1626, for what history suggests was about $24 worth of trade goods, it was not the whole park operation. For $12.5 million, the city council bought 536 acres of mostly unusable hillside land and an eclectic collection of buildings, a private gymnasium, a swimming pool, children’s amusement park rides, exotically grafted trees, ponds and giant fiberglass swans—in other words, every stick of wood and slab of concrete, every rock, pipe, sprinkler, restroom, lunch counter, ➝ Gilroy Gardens, 10

Ride shares cut salaries for cab companies Cabs, 1 Gilroy Lyft driver Nikole Harlan, 36, makes considerably less, but is happy. She started driving with Lyft over a month ago after being unemployed for six months, and she’s enjoying the work. “I posted on Facebook and I asked if people knew that Uber and Lyft were in the area and most people didn’t,” said Harlan, who also works at a Gilroy flower shop. “I like it. You get to meet new people; you learn the roads better and it’s a learning experience every time,” Harlan said. Harlan never interacts with other Lyft drivers and dealings with the company are over the web. In fact, nearly all business is conducted through the Lyft app, including getting paid. “You pick up somebody, tap on the app and let them know that you picked somebody up,” she said. “It automatically tells you where to go and it gives you step by

step directions. After the drop off, the app automatically tells you how much is charged and the money goes into your piggy bank. Every week you get paid in the middle of Tuesday.” Harlan has made up to $600 in a week and was especially busy during the Garlic Festival, picking up and dropping off festival goers throughout the weekend. “I think I picked up about 10 people in only a couple of hours,” Harlan said. So far Harlan has not had any trouble passengers. Nobody has been rude, and she hasn’t encountered obnoxious drunks, late night couples getting intimate in her backseat or anybody who has made her feel unsafe. “Some people are just too quiet for me, I like someone who can interact with me a little bit. I prefer if they sit in the back, it makes me feel that I’m providing a service for somebody.” Fares begin to be calculated one minute after

a driver has confirmed on the Lyft app that they arrived at the pickup spot. The fare includes a pick up fee, cost per mile and cost per minute. Rates are also calculated based on area. In Gilroy, the minimum fee is $5, $1.22 per mile and $.22 per minute. There have been rideshare horror stories. Jason Brian Dalton, a former Uber driver in Kalamazoo Michigan, engaged in a killing spree in 2016 when he murdered six people between stops. Police said that Dalton would pick up and drop off passengers for Uber between shootings. Uber itself has been rocked by a recent sex scandal that led to the dismissal of 20 employees and CEO Travis Kalanick in late June. Lyft has taken advantage of its rival’s vulnerability and has seen its market share increase from 21 to 25 percent since February, according to Forbes Tech. GUEST VIEW CHRIS RETTIG, BAND PARENT

Gilroy school bands deserve your support

B

and kids are great! I say that again, they really are great. After spending a few seasons with this group of students and other band parents I have really developed a true appreciation of the band culture. The only way one would know this is to get involved and help out. Having two of my kids in the Gilroy High School marching band my wife and I volunteered with others to this group. On a local level this includes fixing instruments, getting the kids to practice, bringing them cold waters, sizing uniforms, fundraising, and hosting barbecues. During band season the kids devote over nine hours a week to practice their music, learn their routine or “dots” as my son calls it, and learn how to work as a unit. The practice can be grueling as they march on hot sunny days, cool nights, rainy days, and early weekend mornings. My son dislikes getting out of bed early Saturdays but his love of the band culture pulls him through. Unlike a team sport they are all starters. With a different dynamic to the academic studies and no shortcut to success – they are all in! They may bobble and fall during a competition, have sore feet from marching, but they all have each other’s backs. It’s a team effort and it’s a great site to witness. Last season we welcomed our new GHS band director, Mitch Goldsmith, who is an alumnus of Gilroy High School. He quickly found his footing and put forth a new system that the kids were at first skeptical to accept. Some said they were going to quit but in the end, they all realized it was a good move and quickly took to the new form. You see you have to have dedication to this program. Some folks do not like change but these kids let themselves to be moldable and did not give up.

Each season has the highlight of performing as the “pep band” at the GHS home football games, on Veterans Day, and at the Gilroy holiday parade downtown, and other events. At the Friday home games the “pep band” even allows alumni or middle school band members to come and join in. Also during this time, we enter into band competition events. Within the Western Band Association regional competitions, we are graded on our music, visuals, percussion, and artistry. The band won second place at the Gilroy Garlic Classic Band Tournament and first place at the Dublin High School Irish Guard Band Tournament. We are not a large band with lots of monetary support or big entourages of equipment, but we are a band family with a lot of heart. As parents, we worked to support this group by hauling equipment to the competition sites, setting up staging areas, fixing uniform tears, building and staging the props, feeding the group, and lugging all the equipment home. The sacrifice is well worth the outcome. This will be the 25th year that Gilroy High School will host the band competition “Gilroy Garlic City Classic” on Oct. 14. This year we will have 18 bands competing for regional band trophies. Gilroy High School band will be performing its “Pathways” program and it promises to be a good one. Come and check it and see.

As a pediatrician at Valley Health Center, Gilroy, I have the privilege of ensuring that the children in our community are healthy. Over the years, I have treated an increasing number of patients who at very young ages have chronic diseases including diabetes and obesity. Parks and places that promote exercise and movement are key to children and families’ health. According to the Centers for Disease Control and Prevention, creating, improving and promoting places where the community can be physically active can improve both physical health and mental health. Many people in our community have a chronic disease and could greatly benefit from walking on local trails and spending time at our parks. Being outdoors has been associated with decreased blood sugar levels for diabetes, and improved mental health including reduced feelings of depression. Parks and trails can function as a hub for community members to meet for social events and recreational activities resulting in increased social cohesion strengthening our community. The City of Gilroy, in partnership with the Santa Clara County Public Health Department, the City of Morgan Hill, Santa Clara County Parks, the South County Collaborative and the South County United for Health Leadership Team have coordinated a “Let’s All Go to the Park” Initiative. This initiative was designed to promote parks and trails as a destination for physical activity and for members of the community to meet. Our last free event in the series will be held in Gilroy on September 9 at 10 a.m. All fitness levels are welcome. Participants can choose how far they would like to walk or bike. The event starting point is the Gilroy Sports Center, located at 5925 Monterey Frontage Road in Gilroy. Please join City of Gilroy Mayor Roland Velasco, Gilroy City Council Member Fred Tovar, Gilroy Bike Pedestrian Commissioners Leo Gonzalez, Tony Marandos, Chad Reeder and Zackary Hilton; Herman Garcia, Founder and President of CHEER; BMX racer Joey Garcia and other local celebrities on September 9 for a walk or bike ride on the Gilroy Levee. Taking steps toward better health as a community is important. More details are available on the City of Gilroy website. Dr. Elizabeth Mendoza-Levy Valley Health Center Gilroy

FROM THE WEB Sex allegations rock GPD Was anyone else disturbed by Mayor Velasco’s comment "at the end of the day the City of Gilroy is going to prevail.” Does the Mayor have a crystal ball? Guess since the city will not spare any of our tax dollars defending the Gilroy P.D. that we should assume Gilroy P.D. will prevail? I personally find it extremely disturbing that the mayor isn’t on the side of the people (remember, those who put him in office?) or more importantly, justice. One would hope that an elected official would have ethical moral values leading them to seek the truth and then to punish the perpetrator, even if it turns out to be the city P.D. I’m sorry to say that the behavior of some of our city officials leaves much to be desired and speaks volumes about who’s most likely guilty and who’s not. It certainly tells you who plays by the rules and who doesn’t have to. Apigca Via GIlroyDispatch.com

Former police chief denies sex harassment allegations If this is an employment case as her attorney states, then why name all those other people? Doesn't the saying, "people who live in glass houses shouldn't throw stones" come to mind? If this is a fight between Patty and the city, then fight the city and leave other people and their lives out of it. This is truly an “if I'm going down I'll take as many people with me as I can” case. In that kind of fight no one wins but everyone loses. Because things will come to light that neither side will be proud of. Hope everyone's closet door is locked so those skeletons don't get out. Because believe me we all have some. Peaceful peace walk attracts many of South Valley residents

OBITUARIES Mark William Bridwell

By Debra Eskinazi South Valley Magazine

More than 200 members of the South Valley community, including many from Gilroy peacefully demonstrated in a walk at the Morgan Hill Community and Cultural Center Aug. 19. Members of the clergy joined the walk in traditional garments— robes, stoles, prayer shawls and head coverings—all respective of their faith traditions. “I think it’s important to make our case for how we want to express our free speech—which is, we’re against hate, we’re against exclusion and we’re for peaceful engagement and acceptance,” said Phil Cooke, priest at St. John the Divine Episcopal Church in Morgan Hill. Father Jose Rubio of St. Mary Catholic Church in Gilroy felt with the vocal demonstrations around the country that it was necessary that people in South County be united in their stance against hate. "I am very surprised at this antiSemitic feeling, anti-immigrant feeling, anti-Muslim feeling,” said Rubio. “I think it’s important—as little as South County is—for people to say something.” In his participation, Imam Ilyas Anwar of the South Valley Islamic Community in San Martin wanted to make clear that there are many people who don’t want to tolerate actions and language that perpetuates hate. “There’s no place for hate in our country,” said Anwar. “Not in our community, not in our country.” Anwar noted that it was critical for all people to speak out and speak up. “We have to be part of this community,” he said “You can’t live in isolation—regardless of race, color, gender—whatever it may be—that’s all secondary. The first thing is: This is our home and we have to make it. We have to make sure that the peace and safety stays here.” The event was planned in response to the recent white nationalist rally in Virginia, where people from several hate groups including the KKK, neo-Nazis and white supremacists clashed with antihate protesters in Charlottesville. Events further escalated when a car crashed into demonstrators, killing one and injuring 19 more. The Clergy Alliance from the Interfaith Community of South County (ICSC) held a meeting on Wednesday, Aug. 16 in the interest of showing how the world could be different than the events that occurred in Charlottesville.

NO TIME FOR HATE Residents from throughout South County

marched on downtown Morgan Hill Aug. 19 for a peace walk.

Politicians also joined in the march, including Morgan Hill Mayor Steve Tate. Morgan Hill councilmember Rene Spring, wearing a black shirt with several lines declaring “love is love” written in a rainbow of colors, said he was there to show his solidarity. “There is so much hatred,” Spring said. “I’m not a believer in hate. I don't care if you’re left or right. I think we just need to love each other more, respect each other more and I wanted to show that.” Councilmember Caitlin Jachimowicz said she participated in the peace walk because she wanted to show there are more people who are full of love than hate. “But, I think they are louder— and so I think it’s important for us to band together and work on amplifying our voices in support for one another, in unity and in love,” Jachimowicz said. The walk, less than a mile down around Monterey Road and back, ending at the United Methodist Church, concluded with messages from many of the clergy. Reverend Ron Koch with the Good Shepherd Lutheran Church wanted to demonstrate that people can get along. “We make every effort to get along and share what is in common among us and among all of the great faith traditions—and that is justice for the oppressed, compassion for those who are overwhelmed and who need our support,” he said.

“In my tradition, a call to action is a prayer, speaking truth to power is a prayer,” said Rabbi Debbie Israel of Congregation Emeth in Morgan Hill. .Israel noted that there were not always two sides to a story, making reference to commentary on last week’s events in Charlottesville that suggested if only the anti-hate people let the neo-Nazis have their rally, the violence would not have happened. She insinuated, “Their presence provoked this response, and so they are to blame too.” Israel went on to draw a comparison to several times in history where the Jews of Europe cowered in their homes fearful of Nazis marching through the streets or similarly, in the early days of the Ku Klux Klan, when African Americans hid behind closed doors when klansmen put on their robes. Israel noted their silence didn’t halt atrocities. “But in 2017, we will not cower behind closed doors and we will not cower,” said Israel. “We will not be treated as ‘other.’ We do not accept that our black brothers and sisters and our Jewish brothers and sisters need to stay home because neo-Nazis are coming to town. We all stand together, stand proud together.” Of the clergy and the people present many reaffirmed the sentiment shared by Pastor Anita Warner of Advent Lutheran Church in Morgan Hill, “If you come for any of us, you come for all of us.”

City owns the land, but not most profits Gilroy Gardens, 2

flower, shrub, kiosk and merry-go-round built or placed on the site by Bonfante over the course of 20-odd years of fits-andstarts construction that culminated in near financial ruin. It made the city the proud but somewhat ill-prepared new owners of the park’s lands and assets—and party to a legal arrangement that Granter called “a very complicated, odd relationship.” A 35year veteran of the theme park business, she reports to the board. But when Bonfante let go of his dream, the theme park itself was not purchased by the city, and that business is the legal entity that plans and markets the attraction, runs daily operations, earns the revenues and makes hiring and firing decisions. It’s run not like an arm of the city but more like the private business of the nonprofit’s community board—with hired, professional management help from the Cedar Fair company, a huge amusement park firm that also runs California’s Great America in Santa Clara. Instead of buying a business it had no experience running, the city decided to lease all of the now public land and assets to the nonprofit corporation that would be held responsible for keeping it open and well maintained. In return, the city would get 10 percent of the take, calculated using a widely but not universally approved formula in the business world called EBITDA, which stands

for earnings before interest, taxes, depreciation and amortization. In the five years ending in 2015, the combined total city take was $561,363, or an average of about $112,272 per year. That is about $90,000 less than Granter’s 2015 total compensation of $202,451, the most recent year for which figures were available. Of those years, 2012 saw the lowest payment to the city, about $59,500; the peak year was 2015, when the city’s take took a roller coaster ride to $186,680. That pales to the amount paid to Cedar Fair, via Great America, which received $510,699 in 2015. The park’s well-connected marketing company, which also does work for the Gilroy Garlic Festival Association, also was paid a lot more than the return on investment to city taxpayers. In 2015, Articulate Solutions of Gilroy’s was paid $253,532 to promote the theme park, according to the park’s 990 form. Two other major contractors, both Canadian firms that did program design work that year, were paid a total of $324,000. Given some of those figures, and in particular the salary figures for park officials, at least one city councilman thinks Gilroy needs to renegotiate for a better deal as officials weigh giving a new lease to the nonprofit. “If they are paying out a lot in salaries, they can afford to pay the city fair rent,” Dion Bracco said. Harney believes the

nonprofit has been “a great steward” of the city’s asset. “If the (nonprofit) were to walk away from the deal, the city would be left with a theme park,” said Harney. “What do you do with a theme park? We’d have to find another operator.” Even with his criticism of the current lease, Bracco agreed with Harney, Baksa and Granter that the park is making good progress towards the board’s goal of sustainability through new and innovative programming. Attendance was up when the economy was down, Bracco said, because when times are tough families stay close to home—they “staycation” instead of vacation. So far this year, with a better economy, families are again traveling and attendance has dipped 12 percent, according to Granter. The drop led to the recent layoffs of the park’s long-time security chief, a merchandising manger and an IT specialist whose combined salaries were $150,000. To try and reach a goal of 100,000 more guests, the park for the first time will this year host new fall and winter programs designed to stretch its season and provide more nighttime fare designed to attract ticket buyers way beyond Bonfante’s vision, and the park’s stated mission, of a botanical educational experience for children that would draw mostly well-behaved ➝ Gilroy Gardens, 12

500 full time hotel jobs for a complex that would include up to 700 family suites, with shops, restaurants, conference facilities and an indoor water park. The city has a 60-day exclusive negotiations period with the company. To build its customer base, Gilroy Gardens is extending hours in October, November and December and will include Halloween Nights, beer-andwine themed Harvest Nights and the long popular but recently skipped Holiday Nights during the Christmas season. The latter was not hosted last year when the park presented the much-promoted Lumination event, a nighttime celebration of Chinese culture through huge, intricate and well-lighted sculptures.

Lumination was a break-even event, Granter said, because gate receipts had to be split with the Chinese producers. More importantly, said Baksa, Lumination showed the park could attract a largely adult audience at night with innovative programming that stretches the venue’s appeal beyond families with young children. As for a drop in attendance, yes, that happened, according to Granter. In her 12 years at the gardens, yearly attendance has gone from a low of 360,000 to a high of 460,000. Last year’s 12 percent drop was from the previous year, she said, which broke the 460,000 mark and saw record attendance nearing 500,000 visitors, including an injection of 80,000 for Lumination, she said.

family crowds, including grandparents. Plans are underway for more water-related attractions like the Oasis play area for kids. Ideas have been floated to use more of the hillside land for nature trails, according to Baksa. And then there is the proposal for Great Wolf Lodges, a fast-growing national chain looking to expand its presence in California, to use about 30 acres of unused parkland to build a huge hotel and conference center with its signature indoor water park, historically open only to hotel guests. Great Wolf is planning community meetings and Wednesday said Gilroy is its first choice for a location that promises 1,500 construction jobs and

Lyft does not require a drug test to drive for the company. “I had to take the car to a service center and they tested the brakes, the lights and made sure everything was in working order,” Harlan said. “The car can not have any mechanical problems at all. You have to send all of that into Lyft before they give you the final ok.” As taxis are replaced by ride sharing, so is the custom of tipping. “I have been given a cash tip one time,” Harlan said. “I don’t expect tips. It’s their right, but if they don’t want to, that’s ok. If they don’t tip me, I don’t wonder what I did wrong.” So far, Harlan’s longest trip was when she

Techcrunch reports a $50 billion valuation of Uber while Lyft lags behind at $7.5 billion. According to hits website, a Lyft driver must be at least 21, pass a driving record check and a background check, possess a current driver’s license and registration and have a smartphone. NOTICE OF EVIDENTIARY HEARING REGARDING PACIFIC GAS AND ELECTRIC COMPANY’S REQUEST TO INCREASE RATES FOR THE TRANSPORTATION ELECTRIFICATION APPLICATION (A.17-01-022) Scheduled September 25–29; October 2–4 and 6; and October 9–13, 2017, at 10 a.m. at the address below: California Public Utilities Commission Courtroom State Office Building 505 Van Ness Avenue San Francisco, CA 94102 SUMMARY On January 20, 2017, Pacific Gas and Electric Company (PG&E) filed a request with the California Public Utilities Commission (CPUC) for approval to expand the Transportation Electrification (TE) initiatives currently offered by PG&E. The proposed programs aim to address barriers to widespread TE and help determine how utilities can reduce these barriers through future projects and investments. This Evidentiary Hearing (EH) has been scheduled by the CPUC to review PG&E’s application. BACKGROUND This Application was submitted after the CPUC issued a ruling directing PG&E to file a TE application as mandated by Senate Bill 350: Clean Energy & Pollution Reduction Act (SB 350), which established California’s new clean energy, clean air and greenhouse gas reduction goals for 2030 and beyond. SB 350 orders the CPUC, in collaboration with the California Air Resources Board and the California Energy Commission, to direct utilities to file applications for programs and investments to accelerate widespread transportation electrification. If approved, these TE projects and programs will help achieve the goals outlined in SB 350 as well as Charge Ahead California to reduce dependence on petroleum, meet air quality standards, and reduce emissions of greenhouse gases. The proposals in this application will also encourage customers in all transportation sectors to choose electricity as a viable fuel source. HOW WILL PG&E’S APPLICATION AFFECT ME? If approved, this application would result in a $253 million increase in rates. The increase would also support California’s global leadership efforts related to air quality and climate change. The cost to ratepayers over the first five years will be $15.1 million in 2018, $17.6 million in 2019, $18.5 million in 2020, $25.3 million in 2021, and $33.7 million in 2022. While the costs of the infrastructure to support TE expansion will continue to impact rates beyond 2022, PG&E expects this to gradually decline over time. In 2022, the year of the largest annual increase, the bill for typical residential customers as well as Direct Access and Community Choice Aggregation customers would increase by 0.3% on average. Departing Load customers will see an increase of approximately 0.1%. EVIDENTIARY HEARING At this EH the assigned Administrative Law Judge (Judge) will receive the testimony of PG&E, consumer advocacy groups, and other parties to this proceeding. These hearings are open to the public, but only those who are parties to the proceeding may present evidence or testimony and be subject to cross-examination. The hearings and documents submitted during this proceeding will become part of the formal record that the Judge will rely upon in writing a proposed decision to present to the Commissioners for their consideration. After considering all proposals and evidence presented during the formal hearing process, the assigned Judge will issue a proposed decision which may adopt PG&E’s proposal, modify it or deny it. Any of the five CPUC Commissioners may sponsor an alternate decision. The proposed decision, and any alternate decisions, will be discussed and voted upon at a scheduled CPUC Voting Meeting. Please note: The CPUC’s Courtroom is wheelchair accessible. If you wish to attend and need specialized accommodations, please contact the Public Advisor’s Office (PAO) at least five business days prior to the hearing date. Any changes to the dates, times and locations of the hearings will be posted to the CPUC’s Daily Calendar. TO OBTAIN COPIES If you would like a copy of PG&E’s application filing and exhibits, please write to: PG&E, Transportation Electrification Application (A.17-01-022), P.O. Box 7442, San Francisco, CA 94120. A copy of PG&E’s filing and exhibits is also available for review at the CPUC’s Central Files Office located in San Francisco, CA, by appointment. For more information, please contact them at aljcentralfilesid@cpuc.ca.gov or 1-415-703-2045. PG&E’s filing (without exhibits) is available on the CPUC’s website at www.cpuc.ca.gov/puc. CPUC PROCESS The Office of Ratepayer Advocates (ORA) has reviewed this application. ORA is the independent consumer advocate within the CPUC with a legislative mandate to represent investor-owned utility customers to obtain the lowest possible rate for service consistent with reliable and safe service levels. ORA has a multi-disciplinary staff with expertise in economics, finance, accounting and engineering. For more information about ORA, please call 1-415-703-1584, email ora@cpuc.ca.gov or visit ORA’s website at www.ora.ca.gov/. DEFENSE HOLDS BULLDOGS TO 3 FIRST DOWNS IN 38-0 WIN Cheeto Barrera Sports Editor

It was the Cougars’ first win since the opener of the 2016 season against Gilroy, snapping a ninegame losing streak with a 38-0 win on Friday. The night was dominated by the Christopher front line on both sides of the ball. The Cougars amassed 209 yards and two touchdowns rushing, led by Tyler Davis who had 96 yards on 13 carries and a touchdown. Joey Bassian followed with 61 yards on 10 carries and a score. The Christopher runners ran with purpose the whole night, trying to set a good tone for the season and avoid an early let down. “I was angry, so I was just moving my legs.

I was just trying to be productive and it worked,” Bassian said. Christopher is now gearing up to face Live Oak 7 p.m. Friday. The Acorns is coming off a 34-13 win over Alisal last week. The Cougars will have to find a way to slow down quarterback Jonathan Singleton, who accounted for all five of Live Oak’s touchdowns. The Acorns also come into the game with a diverse running game that Christopher’s linebackers will need to slow down if it hopes to win. But on Friday, things could not have gone better for the Cougars. Christopher’s passing game came through just enough to provide a balance for the run game. Ben Sanford threw for 87 yards and three touchdowns in his debut as the Cougars’ starter. “I’m sure he had a little bit of nerves, but he didn’t really show it. He did an

excellent job: He made the passes that we needed; he controlled the offense and the tempo. That’s what you want in a first time,” said coach Tim Pierleoni. “As time goes on we’re going to unleash him a little bit more and let him do a few more things, but I think

it was a perfect opening night for him in that way.” Tight end Cooper Ahola caught three passes, two going for touchdowns. Pierleoni said the focus was on taking what the defense was giving them and he said the run was there and it took

pressure off of his junior quarterback. Meanwhile, the Bulldog run game—which coach Tony Holmes was hoping to use to beat up the Cougar players who were going both ways— was completely held in ➝ Cougars, 19

Mustangs roll; look to Carmel Cheeto Barrera Sports Editor

Gilroy runningback Joe Barnes went nuts against Overfelt, rushing for 284 yards and three touchdowns and added a receiving touchdown in the Mustangs’ 34-14 win on Friday. Coach Jubenal Rodriguez said he was overall happy with the way the team opened up the season, but like any coach, saw room for improvement. Rodriguez said Overfelt scored on the second half

kickoff which allowed the Royals to briefly get back into the game. But thanks to the effort from Barnes—who also scored on a 10-yard pass from quarterback Jon Jon Castro—the Mustangs didn’t allow Overfelt to come back. “We had some little mistakes that are totally fixable,” Rodriguez said. “We’re going to be spending a little more time on special teams this week.” Gilroy will need to clean a few things up

going against Carmel on Saturday on the road. “I’m expecting a disciplined football team offensively and defensively,” Rodriguez said. “We’re going to be two good teams going at it. It will be a fun game to watch.” Carmel opened with a 40-28 win over Willow Glen last week in a game where the Padres had to use a second-half push to put the game away. The Rams forced a 20-20 tie at the half before Carmel scored two

touchdowns in the third quarter and put things away with a TD in the fourth. “Their defense is real disciplined. I’m definitely a big fan of their front four guys,” Rodriguez said. “Our backers are going to have to run the ball real well. It’s going to be a chess match between two coaches. I just hope our kids execute.” Quarterback Kai Lee lit up the Rams last week with three touchdowns, going 15 of 18 passing for

228 yards, according to stats on Mbaypreps.com. The Padres will have a solid run game with Luke Melcher amassing 134 yards and two touchdowns against Willow Glen. Rodriguez said it will ultimately come down to which side makes the fewest mistakes. Kickoff for Saturday is scheduled for 2 p.m. in Carmel. Gilroy will make its home debut next week against Live Oak.

check. Christopher came into the game well prepared for what the Bulldogs were going to throw at them, Pierleoni said. And he gave all the credit to his defensive coordinator for getting the team ready. “When you have time to prepare like that and we fell like we prepared pretty good, especially for a nonleague, first game I feel like we were a little bit advanced in that situation,” Pierleoni said. “I expected us to do well defensively because we have so many defensive returners. I’m very happy with our coaching staff. I feel they did an excellent job. I can’t say more than that. They did a very good job.” The result was the defensive line and the linebackers could read the plays before they

developed and come blitzing in to shut down the play before it started. “They stepped it up. I was impressed. They really showed how hard they’ve worked this summer,” Bassian said. Sobrato had 37 total yards on the ground and 72 total yards of offense, including converting three first downs for the entire game. The Bulldogs didn’t move the chains for the first time until John Bell ran for 10 yards on second and 4 to his own 40. Sobrato’s best drive came on its next series when the Bulldogs converted two first downs, including a third and 7 that crossed midfield and Bell hit Jarod Jones for a 12-yard pass play. But it ended on the next play when Ethan Crawford snagged an interception on the CHS 35. It was the only turnover of the game. Christopher’s defense made up for the lack of take aways by holding on fourth down five times including holding on fourth and 1 three times. Holmes said his team had chances to move the

ball against Christopher, but didn’t take advantage of them and it hurt the offensive momentum. The defense getting off the field quickly allowed Christopher time to keep its offense rolling. The Cougars struck quickly, driving 58 yards on 11 plays capped with Sanford hitting Ahola for a two-yard strike on the goal line for a quick 7-0 lead at the 8:55 mark. After forcing Sobrato into a three-and-out, Christopher marched 52 yards on nine plays set up by the one-two punch of Davis and Jon Scarcella on the ground. That set up Sanford to complete the drive with a 17-yard strike to Jason Scirigioni who went diving into the endzone for a 14-0 lead. Just after the start of the second quarter, Christopher led 21-0 when Bassian punched the ball in from two yards out. He said he was running with anger to start the game, but that anger went away when he found the endzone. “My confidence just grew,” Bassian said. “It skyrocketed.”

Come together ... Saturday was the second annual Christopher High/Gilroy High Teams, Alumni, and Family Run. There was a wonderful turnout for our day of sportsmanship and camaraderie among the two high schools’ cross country teams. Whether walking, jogging, or running, people enjoyed the cool morning while they traversed the course at Christmas Hill Park. The run was followed by a BBQ and games. Both schools’ coaches believe the event was a huge success and the perfect way to kickoff the season.

Cougars go 1-4 at Spikefest Christopher is blitzing through the early part of the season, taking on Spikefest with a fivegame marathon and took a few lumps. After breezing by St. Francis-Watsonville in their season opener, the Cougars went 1-4 at Spikefest. They fell 2-0 to Clovis West 2-0 before

defeating Notre DameSan Jose 2-0. Christopher then dropped three in a row, first 2-0 to Los Gatos then 2-1 to Cupertino and Milpitas. Against Clovis West, Christopher fell 25-19, 25-11. Then Christopher battled Notre DameSJ tough, with a 25-23, 25-16 win.

The next three matches could have gone either way by falling to Los Gatos 25-21, 25-21, then getting edged out to Cupertino 25-23, 19-25, 15-12 and finally 11-25, 25-18, 15-10 to Milpitas. The Cougars got back on track on Tuesday, playing Mt. Madonna, but results were not available.
