A federal judge has dismissed more than half of the 15 “causes for action” cited by a former Gilroy public safety dispatch employee in a lawsuit that alleges pervasive sexual misconduct within the city’s police department. Some of Harrell’s allegations against the city and police department by Patricia Harrell, a public safety communicator for the city for 26 years, still stand, including age discrimination, gender discrimination, failure to investigate or take corrective action, retaliation and violation of federal civil rights. None of Harrell’s defendants has made a motion to strike these causes for action, according to the ruling.

Dave Peoples is a “glass half full” kind of person, and if you’re going to say his retirement from Garlic City Mercantile is another sign of a dying downtown Gilroy, you better watch your tongue. He and his wife Marianne are retiring at the end of September because

they want to, and he sees promise in a renewed retail center in downtown Gilroy. “I feel that the downtown reflects the community; it’s the pulse,” Peoples said. “The community is you, me and everyone. It’s a melting pot, and for years there was no place like the downtown. If you needed shoes, you had two or three places. If you needed prescriptions, you had four drugstores downtown.” Peoples bristles at the idea of a dying downtown Gilroy. His retirement, he insists, is not a

precursor of another boardedup shop. Garlic City Embroidery Studio, run by Carol and Al Guitierrez, will remain open for business at 7550 Monterey St., and another retailer may take up the space vacated by Garlic City Mercantile. “It used to be that retail would drive activities,” Peoples said. “People would shop, and then explore what else the downtown had. Now, people go out to eat, and then maybe they go to a retail store. Young people want new things, and I think that’s what

you see downtown. It’s becoming more activity-oriented.” Nearby, customers are on the way. California voters may have approved the legalization of cannabis, but the Board of Supervisors in Santa Clara County, the state’s sixth-most populous county, has dropped plans to extend a moratorium on growing or selling cannabis, and instead is set to vote to ban pot growth altogether.

A temporary moratorium on the cultivation and sale of cannabis in unincorporated areas of the county imposed in 2017 ends Sept.12. Janice Rombeck, communication officer for Supervisor Dave Cortese, said supervisors will vote on the permanent ban Aug. 28, with a second reading on Sept. 11. It would take 30 days for the ordinance to go into effect, meaning there would be a brief period between the moratorium expiration and the permanent ban. “No one expects that gap to have

an impact on illegal cultivation,” said Rombeck. Four of five supervisors would need to agree to extend the moratorium, but approval of a ban on cannabis sale and cultivation would require just three votes. After Supervisors Cortese and Ken Yeager voted on Aug. 14 against extending the moratorium, the other supervisors decided to move forward with the ban. In response to questions about the upcoming vote, Supervisor Mike Wasserman, whose District

1 includes Gilroy and Morgan Hill, wrote in an email, “This all comes down to the health, safety and environmental concerns surrounding cannabis cultivation in unincorporated county areas. Like Cortese, Chavez is worried about the regulation of cannabis, saying not enough is being done to ensure it was being properly cultivated and sold. “We have to make sure that any step we take is really protective of young people in our community,” said Chavez. She wants to continue to explore ways cannabis can be regulated within the county. Chavez said, “my feeling is there is no risk to getting more information and see how other communities are

addressing the concerns raised.” Chavez said she couldn’t say that cannabis would never be allowed in unincorporated Santa Clara County and made it clear a ban could be overturned. Supervisors cited a report that the Santa Clara County Sheriff ’s Marijuana Eradication Team had seized 5,793 illegally grown marijuana plants in the first five months of this year. Cortese said the best way to deal with cannabis in the county would not be an allout ban, but with regulations to prevent black market sale and cultivation of the crop.

But on Aug. 13, U.S. District Court Judge Lucy Koh of the Northern District of California issued a ruling that dismissed nine of Harrell’s 15 bullet points identifying the specific laws and procedures that she accuses the defendants named in her lawsuit of violating. Koh’s ruling dismissed Harrell’s claims of sexual harassment, failure to take steps to prevent discrimination and harassment, retaliatory termination (previously stricken from

the 2017 complaint) negligent supervision, negligence, assault, negligent and intentional infliction of emotional distress, supervisory liability, and negligent and intentional misrepresentation. Koh’s ruling dismisses these allegations as they relate to former Gilroy Police Chief Denise Turner, Officer Royce Heath, Captain Joseph Deras, Captain Kurt Svardal, Dispatcher Steve Ynzunza and Gilroy Human Resources Director and Risk Manager LeeAnn McPhillips—all of whom are named as defendants in Harrell’s lawsuit. The ruling also dismisses allegations against the American Federation of State, County and Municipal Employees

(AFSCME) and AFSCME Business Agent John Tucker. McPhillips said the Aug. 13 ruling is “a favorable decision” for the city and police department. “I think the documents speak for themselves,” McPhillips said, referring to the 30-page Aug. 13 ruling and the city’s Feb. 27 motion to dismiss the causes for action that accuse specific city employees of wrongdoing. The judge’s ruling notes that for some of the dismissed allegations, Harrell can submit an amended complaint providing more specific details. Harrell’s attorney, Andrea Justo of the San Jose based Costanzo Law Firm, said Harrell “plans to amend her first amended complaint (filed December 2017)

pursuant to the judge’s order and plans to proceed accordingly with her claims.” That means some of Harrell’s accusations against the officers and union reps could survive if she amends her complaint accordingly. Specifically, Koh dismissed the sexual harassment allegation against Heath, Deras and Ynzunza with “leave to amend.” Plus, the accusation of negligent supervision against Tucker and AFSCME was dismissed “without prejudice,” meaning Harrell could file it again in the future. Also, the allegation of supervisory liability against Turner, Heath, Deras, Svardal, Ynzunza and McPhillips was dismissed with leave to amend. And the accusation of negligent and intentional misrepresentation against AFSCME

and Tucker was dismissed without prejudice.

Sexual harassment

One of Harrell’s more salacious complaints is that she was fired March 21, 2016 for refusing to engage in sexual misconduct within the police department. This misconduct included police officers having sex with members of the Gilroy Explorers youth organization; sexually explicit conversations among employees at work; supervisors watching pornography in front of their employees; co-workers participating in sex parties at private homes; and other nudity and sexual acts at work-related parties and social events. Harrell’s lawsuit specifically accuses Heath, Deras and Ynzunza, as

well as the city and Gilroy PD as a whole, of sexual harassment. However, Koh’s ruling dismissing the allegation agrees with the defendants’ motion to dismiss because the alleged misconduct does not meet the legal standard for sexual harassment. The defendants’ “alleged actions were not severe or pervasive enough to constitute a hostile work environment as a matter of law,” Koh’s ruling states. Furthermore, Harrell’s complaint does not demonstrate how the alleged misconduct was directed to her purely on the basis of her gender—a requirement for a valid sexual harassment claim— according to Koh’s ruling. Council denies injury claims RESIDENTS BLAME CITY FOR INJURIES AND LOSSES Michael Moore Reporter

Fernando Zepeda’s claim states he suffered extensive injuries to his arm when a police dog bit him during an incident on the 7200 block of Dowdy Street about a year ago. Zepeda, who now lives in San Jose, said on his

claim for damages form that he was hospitalized and lost his job because of the dog bite injuries. The Gilroy Police report of the incident, which occurred Aug. 24, 2017, describes Officer Robert Zuniga’s response to a 911 call reporting a family altercation at the Dowdy Street address, where Zepeda lived at the time. Zuniga’s report says when he arrived to the scene, he saw Zepeda and female family members outside arguing verbally. Zuniga saw Zepeda remove what appeared to be a handgun from his waistband, then run inside the apartment, according to the police report. Zepeda returned outside, then began to approach the officer in a threatening manner. He also allegedly verbally threatened Zuniga. The officer told Zepeda to stop and lie down multiple times, but Zepeda continued to approach and “took a fighting stance,” according to Zuniga’s report. At one point, Zuniga called his K9 dog Scotty to subdue Zepeda. The dog bit Zepeda’s upper right arm, and the officer detained him as the suspect’s female family members tried to stop the officer. The August 2017 police report adds Zepeda has an “extensive criminal history with multiple dangerous weapon violations and assaults.” After he was detained, Zepeda told the officer he

The Gilroy City Council earlier this month rejected claims submitted by three people who said they were injured due to negligence or faulty construction or maintenance of public facilities. At the Aug. 6 meeting, the seven-member council unanimously agreed to deny the claims of Alfredo Zepeda, who said a street sign in the downtown area fell on his head; Fernando Zepeda, whose claim says he suffered injuries from a Gilroy police K9 bite that resulted in loss of work; and Maria Elena Alvarez, who tripped and fell on a Welburn Avenue sidewalk that had buckled upward due to vegetation growth. LeeAnn McPhillips, Gilroy’s human resources director and risk manager, declined to comment on why the city isn’t taking responsibility for any of the damages or injuries cited in the three separate claims. “I am not able to discuss the confidential recommendation on each claim as it is possible that lawsuits may be filed following the council’s rejection of the claims,” McPhillips said in an email. The filing of a claim for damages at City Hall is often a plaintiff ’s first legal effort to seek recourse for

injuries or property damage they think occurred on city property or due to the city’s actions. If a claim is denied, the victim or plaintiff can then go to the Superior Court to file a lawsuit. Alfredo Zepeda’s claim for damages states that he was walking in the area of Eigleberry and Fifth streets May 5, 2017, when a street sign on the southeast corner of the intersection “spontaneously fell off of its post and onto the claimant’s head.” As a result, Zepeda, a San Martin resident, suffered injuries to his head, neck, shoulders and back, reads the claim filed by his attorney Juan M. Simon. He was treated at Saint Louise Regional Hospital. He sought more than $25,000 in damages from the city, for medical expenses, loss of income, pain and suffering. Zepeda and his attorney claim the city is responsible for creating “a dangerous condition” with the “inadequate” installation of the street sign and signpost. Zepeda’s attorney did not return a phone call requesting comment.

Officers who briefly searched the home after his arrest did not find a firearm. Zepeda was charged with multiple offenses in Santa Clara County Superior Court in relation to the incident. He said when contacted briefly on the phone that he pleaded no contest to disturbing the peace. The Dispatch was unable

to determine if the two recent claimants Alfredo Zepeda and Fernando Zepeda are related.

Sidewalk accident

Alvarez, a 63-year-old Gilroy resident, tripped while walking on the sidewalk on the 500 block of Welburn Avenue, according to her claim. She tripped on a portion of the sidewalk that had been pushed upward by a tree root growing underneath.

The accident happened April 4, according to Alvarez’ claim. She was treated at Saint Louise Regional Hospital for injuries that include scrapes on her hands, knees and elbows, and soreness in her ribs. The Dispatch was unable to contact Alvarez for comment. The claims of Fernando Zepeda and Alvarez did not specify how much in damages they are seeking from the city.

Homelessness in Gilroy

Is Gilroy the county homeless capital? When I moved to Gilroy it was known as the Garlic Capital of the World. What I didn’t know is that it would become the per capita Homeless Capital of Santa Clara County. It appears we are starting the buildup of demand that requires more infrastructure and services for homeless. A reasonable response is that we should build support systems for that demand and then the system grows on its own, and it never goes away. Please know that a homeless infrastructure is already being built with low-income housing that can become section 8 housing, free transportation and more. Another factor is that our police chief has requested funds for an officer and/ or a social worker that deals only with homeless issues, but there is no funding for such an officer. This means that Gilroy is growing a homeless population and has no officers to deal with the issues created by this population. One possibility is for Gilroy to pay more taxes to accommodate more police to deal with homeless issues. Another possibility is for Gilroy to adopt the same aggressive policies and practices used by more affluent cities to reduce the likelihood a homeless person will reside here, and having a target number of homeless in mind. So what is a reasonable homeless population target? There are 7,394 homeless in Santa Clara County, 1,918,000 people in Santa Clara County and 48,821 people in Gilroy, so our fair share should be 188 homeless, instead of the 722 we currently have. This means we should limit services to accommodate to only 188 homeless using business licenses, permits and such. With

only 188, Gilroy can provide a higher quality of care for those who are here rather than overburden our services. Our police department is overworked as it is. Police officers are working overtime and that is not enough to handle our crime and they are under-appreciated for that effort. Adding a burden to their work load only endangers our community. According to the homeless survey, 1 in 4 homeless people will spend a night in jail next year. If the homeless population is reduced by 500, that will remove 125 arrests needed to be made by our GPD and Gilroy will be a better community for it. I don’t have all of the answers, but clearly something can be done, to be more proactive with our city-wide policies. Elected officials who support expanding services should be removed from office. Some churches offer free meals and they should be responsible for the human waste created by those free meals, if it is deposited around the community. Events to feed the homeless should require a permit and that permit should require facilities. Think about it. Would you go to a Gilroy Garlic Festival if it didn’t have any toilets available? This is a health and safety issue. Like you I have supported some homeless support organizations that include the Second Harvest Food Bank. That organization supports several others that have direct contact with the elderly, disabled, meals on wheels and the homeless. I don’t like seeing anyone go hungry, but that is not the point. The point is right-sizing our efforts to match our community’s size and capacity. Gilroy should not be a dumping ground for other city's homeless. Cheri Sarkur

Housing anywhere in the county will help solve the problem. Only Sunnyvale and Gilroy have armories that serve as emergency overnight housing in the winter. That is part of the reason that other areas send their homeless here. I am proud of the fact that Gilroy is compassionate and trying to help feed these people and provide services. I am sorry that it is more than our proportionate share, but how can you actually limit the number? If you have a solution to that, many people would like to know. There are many more mentally ill on the streets and not taking their meds since Ronald Reagan let them out of halfway homes in the ‘80s.

The Compassion Center is not a shelter. It does not serve the same function as the Armory. People who live in low-income housing or have Section 8 housing are not homeless-they have housing! Last month the Compassion Center had 17 people entering or beginning the formal process for housing. Most will be housed outside of Gilroy because that is where they will find apartments. Once they have housing they are no longer homeless. We know how to reduce and end homelessness-- with housing. The Compassion Center has a very small camping program that provides transportation to and from a legal campground to the Compassion Center. In order to qualify, participants contribute work at the center. They also participate in case management and have regular jobs (that don't pay enough for housing) or participate in job training or school. This effort is funded entirely by donations from private individuals who want to help people get back on their feet. Many of our former campers now have permanent housing! They include families with children, veterans, people with disabilities and low-income workers who are looking for a place they can afford. Jan Bernstein Chargin

The solution to homelessness has to make sense for all of us, and we have to be brave and pragmatic while we are compassionate. Gilroy taxpayers should not be inequitably burdened. The expense for homeless services should be normalized across all cities in the county, then distributed back to the cities, as burdened, to care for the homeless living in that cities community. The homeless need to be reciprocal. “It is better to give than it is to receive”, however, that’s not how the world works. There are many people on the streets that are very capable. If the city is providing services to people who are capable, they can work for the city. There are many walls that need painted, parks to clean and maintain, streets that need to be cleaned. If you want to bash me for the suggestion that we give these folks maintenance work, I won’t hear it. It is very important for people to contribute to a cause. This will give folks purpose. We need true leaders that will stand up to the other cities in the county and negotiate a deal that is fair, as mentioned above. What I suggest above very well may not be the right idea, but someone (leaders) come up with one that is. We need our leaders to be strong and protect the citizens of this city, Gilroy. Figure it out folks. That’s what we are paying you to do. If you can’t figure it out, give the job to someone who can. Don’t just tell taxpayers there is not enough money but we have to do it anyway. We know the problem very well. It’s time our leaders implement a solution that is fair to all of us!

Harrell’s lawsuit does not specify the amount of damages she is seeking from the city and other defendants. Her complaint notes she was fired three years before her full retirement age. One of the officers named in Harrell’s amended complaint, Royce Heath, was disciplined by his superiors, though the reason was never revealed. The City of Gilroy and the police department have not revealed any details about why Harrell was fired. Harrell’s complaint says she was disciplined in 2005 for leaving work 14

minutes early to check on her friend and Gilroy Police Officer Ray Hernandez, who had suffered a medical emergency and subsequently died. She also claims the police department conducted an internal affairs investigation of her in 2008, in response to allegations she verbally attacked two officers. In September 2015, Harrell was notified by her superiors that the city was investigating her again, this time for a complaint that she made racially insensitive remarks to a colleague. Harrell claims the context of her remarks was misunderstood. Harrell was placed on administrative leave in January 2016 and terminated about two months later, according to her lawsuit.

You can get some things in these stores, but if you need a nice steak sauce or a bottle of wine, you can’t find that right now.” Peoples, however, recognizes a nationwide transformation of downtown USA. Retail has often been replaced with activities, like, restaurants, bars, and clubs, whereas before, downtowns used to be the place to find everything a household would need. “It’s an American thing, not just a Gilroy thing,” Peoples said. “I think that started to happen when we became a bedroom community for Silicon Valley.”

Hot rods brighten Monterey Street Hot weather had people searching for shade at this year’s Garlic City Car Show on Saturday, Aug. 18. The event, hosted by the Gilroy Chamber of Commerce, went on for several days and included a midweek “Show & Shine,” a parade of cars, and finally culminated in the Garlic City Car Show along Monterey Street in the downtown area. Event-goers enjoyed music on three stages, festival food, more than 40 booths and a family fun zone. The show attracted hundreds of vehicles including classic cars, muscle cars, hot rods and custom rides.

The California Highway Patrol is investigating reports that at least one male suspect threw rocks at passing motorists on Pacheco Pass Highway earlier this month. On Sunday evening, Aug. 12, the drivers of five vehicles were struck by rocks thrown by a male pedestrian, according to CHP Officer Chris Miceli. The location of the vandalism was on Highway 152 East, just east of Casa de Fruta. The vehicles suffered varying degrees of damage, including broken windows, Miceli said. No suspect or suspect has been arrested or identified. The Angeles family, of Gustine, was among those whose vehicles were

struck by rocks. Nicole Angeles said she and her husband and their five children were traveling east on Highway 152 when their Econoline van was struck. The family’s first reaction was to slow down and pull to the side of the road, but Angeles said there were so many other vehicles pulled over that it took several moments to find a spot. Soon after pulling over, the family quickly learned these other cars had been struck by rocks as well, likely by the same suspect. There are likely more victims than CHP is investigating, as Angeles said at least nine vehicles had pulled over on the shoulder of Highway 152 just before or after their van was hit by a rock. Angeles posted details of her incident on Facebook and subsequently heard from three other victims

Since the rodeo made most of its ticket sales at the gate, Martin is looking forward to having a whole year to sell tickets for its second go-’round.. “The event was a success, and if we could advertise all year, we could sell out.” Given the limitations, ticket sales were still robust. Buyers hoping to get tickets online on Saturday got a message saying the event was sold out. “I got ten calls that day with people asking me if the rodeo was sold out,” Martin said. “We fixed it in the end, but by that time it was Sunday.”

It's been more than a week since the renewed Gilroy Rodeo weekend ended, and rodeo organizer Erik Martin said this week he is examining what went right, what went wrong and what he and his volunteers can do better next year. Planning for next year may be just around the corner, but this year's bills are coming due. “I haven’t shaken out all the numbers yet, but my gut feeling is that we won’t be in the black,” Martin said. “We’ll lose maybe $20,000, which is not

terrible, but it could have been better. I think we did really well in our first year.” First years can be rough, but the rodeo in the arena ran smoothly. The events were fast-paced and varied, and with little lag time between activities, the rodeo ran about three hours each day. “The business part never ends,” said Martin. “We were like, wow, you have a successful event where everybody was happy and we had no issues, and we get all kinds of scrutiny and we get hammered by a bill from the sheriff ’s.” The Santa Clara County Sheriff 's Department handled parking and security at the rodeo. OBITUARIES IRENE MOUSLEY November 15, 1923 - August 9, 2018

M

yrtle Irene Tenney Mousley of North Bend, Oregon, passed away peacefully in her home on Thursday, August 9, 2018 at the age of ninety-four. Irene was born November 15, 1923 in Virden, New Mexico to Nathan Cram Tenney and Myrtle Payne Tenney. She grew up in Virden, the eleventh of eleven children in the family.

Irene graduated from Virden High School. She attended New Mexico State Teachers College in Silver City, New Mexico. She was also a student at Los Angeles City College and LDS Business College in Salt Lake City, Utah. After serving a proselyting mission for The Church of Jesus Christ of Latter-day Saints. Irene married Woodrow Vernon Mousley in the Salt Lake Temple on April 7, 1952. Irene and Woody moved to Morgan Hill, California where they raised their six children: David, LeeAnn (Lani), Michelle (Shellie), Lori, Chris, and April. Irene worked as a very busy homemaker and mother. Woody taught school, ultimately becoming a professor at San Jose State University. After thirty-five years in Morgan Hill, Irene and Woody moved to Kansas City, Kansas and then to North Bend, Oregon. Irene’s husband, Woodrow, passed away on August 14, 2002. Since that time, Irene has lived in a home next door to her daughters, Lori and April. Irene was an avid reader and a gifted writer. With her husband, she wrote and published three biographies. Irene also edited and published another biography, a selection of poems written by her son, David, and following Woody’s death, wrote a descriptive history of Woody’s violin making, with pictures, entitled For Remembering. Irene was a journal keeper, with over twenty-five handwritten diaries and numerous typed entries. Until recent months she continued to write, organize, and compile her journal entries. She loved to correspond with family and friends through telephone calls, letters, and emails. She went to great efforts to locate and communicate with friends from her past. Irene loved classical music and opera. She attended opera performances over the years in many cities, including Los Angeles, New York City, London, and Milan, Italy. Irene was an active member of The Church of Jesus Christ of Latter-day Saints. In her twenties, she served as a full-time missionary in the Central States Mission. She served in leadership and as a teacher in the Primary, Young Women, and Relief Society organizations. At the age of eighty she was called to serve as the Relief Society President. Irene was preceded in death by her husband, Woodrow, her parents, David Woodrow Mousley (son), Shellie Weed (daughter), brothers: Walter Tenney, Nathan Tenney, Carl Tenney, Lynn Tenney, Clifton Tenney, Samuel Tenny, and sisters: Louise Robinson, Anna Turley, Pearl Archuletta, and Helen Webb. Irene was the last living of her siblings. She is survived by four children: Lani (Richard) Moore, Lori K (Steven) Tersigni, Chris (Holly) Mousley, and April Mousley. She is also survived by seventeen grandchildren and twenty-one great-grandchildren. Irene will be buried alongside her husband in the Salt Lake City Cemetery.
