A drive by any major parking lot in Gilroy may reveal a familiar site: large recreational vehicles out of shape and parked in one shaded corner, sometimes for several days. The phenomenon has become a growing nuisance for merchants and a health and enforcement headache for the city. It’s a new cat-andmouse routine for police and the itinerant homeless. In August, Police Chief Scot Smithee gave a “Quality of Life” report to the council, in which he mapped out a plan to decrease homelessness in the city. Smithee told the council that the police department was dealing with an increase in recreational vehicles that violated city codes and needed to be towed. At the Oct. 15 City Council meeting, the council approved an increase in fees from $500 to $1,000

In case you missed it, there is a new mural in town, and this week Gilroy’s downtown business community celebrated it with a ribbon cutting.

The sprawling colorful mural celebrates the wineries of Santa Clara Valley, and is located on the north side of the CMAP TV building at 7500 Monterey St. Commissioned by the Gilroy Chamber of Commerce, the mural was painted by the same Italian artist who created the now-iconic “Garlic City” mural across the parking lot in the heart of downtown. The Chamber hosted a ribbon-cutting at the mural on Oct. 23. Mark Turner, president and

CEO of the Chamber, was enthusiastic about the work of Gianni Martino, who paid his own way from Torino, Italy, to complete the month-long project just in time for this week’s celebration. He painted the other mural in 1993, and the styles of the two are very similar. Turner said he chose Martino because his was the low bid for the project, and also so the parking lot offers passersby a visually matched pair of wall-size postcards. The new mural features names

of the more than 20 wineries in the Santa Clara Valley, surrounding Gilroy and Morgan Hill, plus other sponsors, which include downtown businesses, wineries and Realtors. Martino also has painted the signage for the Fifth Street Coffee Roasting Company across the street, whose inside wall includes a giant portrait of owner Yolanda Castaneda, also painted by Martino. ➝ Mural, 19

Schoolchildren pictured here on the playground at Glenview Elementary School in Gilroy—and at schools and offices in California and worldwide—“dropped, covered and held on” for at least 60 seconds last week as if there were a real earthquake. The drill occurred at 10:18am Oct. 18, about 17 hours after the anniversary of the 1989 Loma Prieta quake, and involved 10.4 million registrants in California and over 61.7 million worldwide. “The main goal of the ShakeOut is to get Californians prepared for major earthquakes before, during and after an earthquake,” said organizers. This year marked the 10th anniversary of ShakeOut, which began in Southern California in 2008. All Gilroy and Morgan Hill schools participated, as did the Hollister Unified School District’s preK-8 classes. San Benito High School practiced its earthquake emergency procedures earlier this year. BMX legends Joey and Jimmy Garcia. Joey is a three-time gold medalist in the X-Games. The track still needs to pass environmental review for air quality, natural habitat, flooding and noise concerns. The track must also be set 100 feet back from Uvas Creek. According to the City Council agenda prepared by city staff, two site options are located near the Miller Red Barn on the west side of Christmas Hill Park. Pump it up, Gilroy. BMX bike riders should be pumped, because the Gilroy City Council voted unanimously Oct. 15 to go ahead with plans to build a one-acre BMX pump track in Christmas Hill Park. The track, which will feature a jump track and a track for toddlers, will come at no cost to the city aside from inkind donations.

“We’ve been working on this a long time, but it never reached this point,” said Bike and Pedestrian Committee Chairman Zach Hilton. The council agreed to a memorandum of understanding to contract with BMX pump track designer Alex Fowler, lead builder and founder of Action Sports Construction, to build a track that will require almost 10,000 cubic feet of dirt. The track will cost between $29,500 and $40,000 to build. Jim and Mary Garcia, founders of Garlic City BMX, and parents will seek corporate and grassroots funding, said Hilton. The Garcias are the parents of Gilroy

With less than three weeks until Election Day Nov. 6, the Santa Clara County Registrar of Voters Office is facing a critical shortage of volunteers to serve at the 849 polling places throughout the county, according to an Oct. 15 announcement. More than 1,000 election officers are still needed, including more than 100 bilingual

volunteers. Englishonly volunteers are also needed. “This is a remarkable opportunity for Santa Clara County residents to observe, promote and facilitate one of our most important civil liberties: our democratic rights as voters,” said Registrar of Voters Shannon Bushey, adding that election officers are paid up to $200 for volunteering at the polls. Bilingual election officers must be fluent in English and one of the following languages: Mandarin, Cantonese, Taiwanese, Spanish, Tagalog, Vietnamese, Hindi, Gujarati, Nepali,

Punjabi, Japanese, Khmer, Korean, Farsi, Syriac, Russian, Portuguese, Tamil or Telugu. Farsi, Russian and Syriac speakers are especially needed. Eligible residents who would like to participate in the democratic process are encouraged to contact the Registrar of Voters Office immediately. Election officers must be citizens who are registered to vote, legal permanent residents, or high school students age 16 or older with a minimum GPA of 2.5 and both parental and principal permission. Experience is not necessary; all training is provided.

Chamber Hall of Fame to induct four LAWSON SAKAI, SUSAN VALENTA, AL GAGLIARDI, JACK STURLA ARE HONOREES Staff Report

The Gilroy Chamber of Commerce will honor four distinguished Gilroyans on Oct. 27 in ceremonies and a luncheon at Old City Hall restaurant. The 11:30am-1:30pm event will recognize extraordinary contributions of veteran lawman Al Gagliardi, water district manager and local historian Jack Sturla, decorated veteran Lawson Sakai and influential business woman Susan Valenta. [subhed] Al Gagliardi AI Gagliardi grew up on a 10-acre farm located on the southwest corner of Monterey Road and Farrell Avenue with his brothers Sal and Mike and his sister, Eleanor learning the prune business first-hand. As it did with so many, World War II disrupted life for Al’s family. He and his brothers went off to serve. Tragically, Sal was killed in Germany and Mike died in a postwar auto accident. When his military duty was completed in 1946, Al returned to the farm in Gilroy. Prune orchards were on their way out and Al began growing grain and cucumbers. Later, Al became a deputy sheriff and the family leased the farmland to a strawberry farmer, eventually selling the land in 1960s.

At one point Al began collecting prune box ends which grew into quite a collection. Al has been collecting prune box ends for 60 years. In addition to serving his community through law enforcement, Al was involved with the Gilroy Historical Society. One of his projects was the recovering of Gilroy’s now-restored 1923 Seagrave Fire Engine. Al has advanced the work of the Historical Society as a member and the go-to source of information about the past. Al graduated Gilroy High School in 1942, and entered World War II in February of 1943 where he served at Iwo Jima and Okinawa. AI won a medal for good conduct and a bronze star. He served to protect Gilroy through his work as a deputy sheriff from 1948 to 1977. “Al has a rich history of selfless service and commitment to the Gilroy community,” read his Chamber tribute. [subhed] Richard “Jack” Sturla Up until the time Jack Sturla joined the Air Force just after the attack on Pearl Harbor, he was following in his family’s footsteps as a farmer. In 1943, after graduating from flight school in Santa Ana, Jack was assigned to Will Rogers Field in Oklahoma City, flying an A-20, an attack, light bomber, intruder and reconnaissance aircraft. One of Jack’s proudest moments was being chosen as leader of one of two 12-plane

squadrons to raid a Japanese radio station 60 miles south of Jack’s base in New Guinea. Jack flew 52 combat missions during the war. After his military service, he returned home where he met the woman of his dreams, Dorothy Nagle of Gilroy. They were married for 63 years, until her death in 2011. Jack passed away in 2014 at the age of 95. In the 1960s, Jack became a board member of the South Santa Clara County Water District, which later became the Gavilan Water District. Over the years, Jack was a farmer, worked in the employment office, worked at the John Sherrer’s “Pieter-Wheeler” Seed Company, and then became manager of the

Gavilan Water District before retiring. Jack also advanced the work of the Gilroy Historical Society as a board member and was a wealth of information regarding Gilroy past. He shared his knowledge of generations of his family's farming, allowing photos of his artifacts of Gilroy's past including the fence he rescued from Don Pacheco's Rancho Ausaymas y San Felipe. Just one example of his stories from the past was telling how he saw the smoke rising from Henry Miller's burning mansion, and heard that drunken cowboys accidentally started the fire. In many more cases, Jack could always be counted on to illuminate Gilroy's past.

[subhed]Lawson Sakai Lawson Sakai was born in Los Angeles in 1923. He graduated from Montebello High School, attended Compton College in Los Angeles, and Mesa College in Colorado. On December 8, 1941 (the day after Pearl Harbor), he tried to enlist in the military service and was rejected based on a government classification that he was an enemy alien because of Japanese ancestry.. His family was evacuated to an internment camp in Colorado in 1942. In March 1943, enlistment opportunities opened up for Japanese Americans to serve in a segregated unit. Lawson immediately volunteered for 442nd Regimental Combat Team. He was overseas in May 1944 until November 1945. While overseas, he served in all of the 442nd campaigns in Italy and France, including the liberation of Bruyeres, France, and the rescue of the Lost Battalion where he was seriously injured. During the war he was wounded four times, and received a Bronze Star, a Purple Heart and a Combat Infantryman Badge. In December 1945, he was discharged from the army. After leaving the service, he attended Pepperdine College and operated a travel agency in San Jose, California. Lawson has been very active in the 442nd reunions. He recently led a group of 53 to Bruyeres, France for the 60th anniversary of the town’s

liberation. He lives in Morgan Hill. [subhed]Susan Valenta Susan Valenta has made a lasting impact on the community of Gilroy. Her most significant contribution was as CEO of the Gilroy Chamber of Commerce for over 20 years. She brought professional leadership to the organization that resulted in good business opportunities for the community. Her work led directly to the creation of the Gilroy Economic Development Center, Gilroy Welcome Center, Leadership Gilroy and the Gilroy Downtown Business Association. In addition to her leadership at the Chamber of Commerce, she has worked tirelessly with the Gilroy Rotary Club. Susan served as the District Governor allowing her to visit many of Rotary clubs in the region taking the best of Gilroy to others and bringing back the best of other clubs to Gilroy. Many leaders in the community serving today were influenced by Susan’s service whether through her efforts at the Chamber or through the Leadership Gilroy program established under her watch. Prior to retiring from the Chamber of Commerce in late 2013, Susan was recognized by the Silicon Valley Business Journal as one of the most influential women in Silicon Valley. Gilroy needs open spaces, farmland

As election season is in full swing, please ensure that you are educated about the candidates and issues that you are considering. Please read through the rhetoric with a critical eye and react with factual evidence and not emotion. As I ponder who to support in Gilroy’s City Council election, Carol Marques and Tom Fischer stand out in my mind. Carol has been an advocate for downtown Gilroy for a number of years. She has spent many hours meeting with council members and city staff to streamline the process for businesses to move into our vacant downtown buildings. Tom is an advocate for Gilroy while serving on the Planning Commission and is very knowledgeable about issues that concern our city as well as how our city government operates. Engage in a conversation with Tom and you will find this to be true. Both Carol and Tom support utilizing buildings and land within the city limits before expanding. Whether you are a longtime Gilroy resident like me or new to Gilroy, we all can agree that we need Gilroy’s open spaces and productive farmland. While growth is inevitable, our city can grow responsibly, developing within our boundaries. Carol Marques and Tom Fischer have proven their advocacy for our city and will continue to move Gilroy forward in a balanced manner.

City offers safe routes

S

afe Routes to School had another successful year in Gilroy. The Gilroy Bicycle Pedestrian Commission, along with Santa Clara County Public Health, took a leadership position in getting all the stakeholders in the city to come together to form a Safe Routes to School Task Force. The county secured funding for our action plan, which will guide and sustain the program for the long term. Safe Routes to School is the commission’s top priority. One reason why is the economic benefits that spill over into the city when we stay local and play local. When you engage the youth to walk and ride to school, they become more comfortable with their streets, neighbors and surroundings. Suddenly walking and riding to downtown, Gilroy Gardens, the sports park, Nob Hill, The Patio and the newest Hecker Pass AgTourist project along the bike/ped path seems a lot quicker and easier than driving in your car. Shifty Cycles has free bike valet for Downtown Live, Tamal Festival and Bonanza Day Parade. Look for more bike/ped-oriented open streets events. The bicycle commission plans to ask the City Council to recognize “Walk & Roll” each Wednesday. Rucker Elementary will have its first Walk & Roll Wednesday this month. We reached out to each high school last year to participate in the Silicon Valley Clean Energy Bike to the Future Event at Gilroy Gardens, and several students who have been leaders in their middle school SRTS programs are moving onto high school. The Specialized Foundation Riding for Focus program began this year at Ascencion Solorsano Middle School. We helped teacher Anthony Fucella apply for the grant. The creation of a bike park in Gilroy is closer than ever, thanks to the City Council’s unanimous request for a draft memorandum of understanding between the City of Gilroy

and Garlic City BMX so that the latter can proceed with site evaluation, project development and fundraising activities for the construction of a proposed dirt pump track at Christmas Hill Park. Having places like this that are open to public year-round in our parks supports our efforts for biking to school and playing local. When completed, enthusiasts will be able to access the pump track from the current bike/ped trails. We encourage the public to nominate someone for a monthly award within Gilroy who strives to make Gilroy a better place in regard to biking and pedestrian activities.

When youth walk and ride to school they become more comfortable with their streets, neighbors and surroundings. The commission also invites the public to attend one of our meetings on the fourth Tuesday of each month at 6pm in the City Council Chambers, or email any of us. The commission is the city’s advocate for Complete Streets, Safe Routes to School and bicycle/pedestrian-friendly infrastructure. The youth in our community will shape the future, but it's up to us to show them the way. As Mark Fenton has famously said, “Let’s create a community full of freerange children!” If you are looking for ways to get involved then look to the schools that need parent volunteers and join a City of Gilroy commission. The Bicycle Pedestrian Commission will have one open seat this December.

Council listens to the people

I was born in Gilroy 70 years ago and raised my family here, so I’ve seen lots of changes to our small town. I’ve always cared about what happens in Gilroy and dedicated many years of service to the community. I served on the Chamber of Commerce board for nine years and as president in 2000. I was a member of the South Valley Hospital board, Gilroy Downtown Development Corp. and the Chamber Governmental Review Board and served eight years on the Planning Commission. I owned a downtown business and worked at Costco for many years. In 2001, I was honored to be named Woman of the Year. I still attend many City Council meetings and am impressed with Mayor Roland Velasco and several council members, especially Dan Harney. This is a transparent council that listens to the people. Watching Councilmember Harney and listening to the pertinent questions he asks of staff, engineers and representatives from various organization and committees, it is apparent he is well-versed with the packet that details agendized items. I competed with Dan Harney for that council seat in 2016 and I am pleased he was selected by his peers. I am supporting him in his quest for the the twoyear City Council term because I’m confident he will make informed decisions that will keep Gilroy a safe, thriving community for new families and those of us who have been here a long time. Drop GilroyHollister rail idea

While everyone agrees that restoration of passenger service from Gilroy to Hollister would benefit San Benito County residents, I believe it is error to plan to fund it in the same manner as our sister counties do. It would be cheaper for local government and taxpayers to buy Mercedes sedans for each Caltrain rider on the route. In fact, it would be cheaper to buy each one a median-priced home in Gilroy than to pay the taxes to extend Caltrain to Hollister. San Benito County lacks the population and tax base to support public sector passenger rail transportation, which would have a bigger annual deficit than VTA bus service. Caltrain and VTA are so bankrupt that they are proposing to repeal Prop. 13's super-majority vote requirement to add new taxes to run their Sovietstyle transit systems. Why would local government in a small, rural county want to duplicate their wasteful mistakes? Instead, why not have restoration of rail passenger service in the same manner that it was brought here originally in the 1870s? Combining freight revenue with unremunerative passenger fares is how to do it. Following the Caltrain funding model is a recipe for disaster. Plan for private-sector solutions, and not damn future generations to suffer under public sector, Soviet-style transit in any mode. Following the bankrupt ideas of VTA will earn the condemnation of future generations. Joseph P. Thompson

DBA invites costumed characters for a pint Ghouls, goblins and hippies crowded taverns and stores in downtown Gilroy for the annual Halloween Beer Crawl on Saturday, Oct. 20. The event, presented by the Downtown Business Association, saw hundreds of over-21 patrons who donned costumes and enjoyed craft beers while shopping at participating businesses. Association president Gary Walton said between 500 and 600 people attended—many in costume. “This year we had 25 breweries located in 25 different businesses in downtown, who each paid a fee to participate,” said Walton. He estimated the event was a financial as well as marketing success. “This year at all of our events, we heard from a lot of new residents who discovered stores and restaurants that they didn’t even know existed,” he said. “It is because of events like this that we expose all the great merchants and business owners to the greater community and keep downtown a viable destination.”

Dion Bracco recused himself from the vote because his company, Bracco’s Towing, is one of those used in the police department’s rotation. Fred Tovar was absent. Daniel Harney moved for the vote, and Cat Tucker seconded the motion. Bracco’s recusal didn’t prevent him from speaking up about the council’s action, claiming that if he spoke as a private business owner, he could avoid any conflict of interest. Bracco said he was speaking on behalf of his company as a private citizen in favor of the fee increase. He said he spoke to the city attorney prior to the meeting to see if he would be able to speak, and got the green light. Bracco said he felt it was necessary to speak publicly at the meeting because he considers himself an expert in his field. However, he recognized it was necessary that he recuse himself from the vote. “I’m the only one on rotation now that tows the motorhomes, so the city will be paying me to tow them,” Bracco told the Dispatch. State conflict-of-interest laws require that elected officials shall not vote or participate in any way

in decisions that benefit them financially. Bracco’s towing company is part of the rotational tow list used by the police department and is not contracted by the department. When the police need towing services, they go down the list to ensure one company is not called more than others. Smithee said during his report, “We’ll just absorb that cost in that salary savings for as long as we can. At some point, when that salary savings goes away, then we would have to budget this into our operational budget.” The staff report said the fee increase will be enough to cover the cost of dissembling 25 vehicles, making the budget $25,000 that will initially come from the police department. According to the city code, “an oversized vehicle may only be parked in the public right of way for 48 hours during any 14-day time interval.” Jan Bernstein Chargin, board chair for the Gilroy Compassion Center, also spoke at the council meeting, urging the council members to consider the humanity of the people living in the vehicles being towed and destroyed. “What I’d like to propose right now is if we’re going to find $25,000 for the enforcement side, we find an equivalent amount for the services side,” Chargin said at the meeting. “When somebody’s home is towed,

that leaves that human being with no place to sleep.” Shawn Weymouth, secretary at the Compassion Center, said she had witnessed Bracco’s tow company along with the police department removing a woman from her vehicle. This was in contrast to Bracco’s statement to the council. “I have never towed a motorhome that has a family in it. It’s usually meth addicts. And our police department is really good,” Bracco said in his public comments. “They warn them, and they warn them, and they warn them.” Weymouth was upset by what she said she witnessed and hoped the council would consider alternatives. “I get it. I love Gilroy too, Rolan. We’ve both been in Gilroy our whole lives, but we have to temper that with the humanity of it,” said Weymouth. Mayor Roland Velasco asked the City Manager Gabriel Gonzalez if the council could get an update in four to six months on the progress of the fee increase. He said he wanted an update in mid-spring, in time for the budget update, on how many vehicles had been towed and what the cost were. Tucker wanted to clarify what the motion was accomplishing. “What’s before us now is just to increase this fee; the other things can be talked about at budget time,” said Tucker.

Property Tax Increase for California Businesses?

The measure is sure to face intense opposition from business groups worried about the hit to their bottom lines. Secretary of State Alex Padilla announced in a news release late Monday that the initiative had earned more than the 585,407 valid petition signatures it needed to make the ballot. Monday’s news does not mean the initiative will definitely go before voters — its backers can pull it back for any reason. But the initiative’s qualification is likely to shape tax conversations at the Capitol over the next two years. Democratic gubernatorial candidate Gavin Newsom recently told The Times he would consider charging businesses higher property taxes than homes.

that went out to supporters in the beginning of his campaign and PayPal contributions that can be made through his campaign website. He told the Dispatch that more than 80 percent of his campaign funds have come through local donations from “people who appreciate the work and improvements I have made to our community since being on council.” Among the contributions made to Harney’s campaign were some from developer groups or individuals who contributed large sums. Harney told the Dispatch the developers he has accepted contributions from are local, and that this was a conscious decision and reflects his commitment to supporting the local economy. “Friends of mine who have land in Gilroy, such as Gary Gilmore a local landowner, and Dany Fiero, a local farmer, have contributed and did so in my past elections,” said Harney. “Realtors who have made contributions include longtime family friends and local Realtors from Intero and Coldwell. I have had many offers for donations from large developers, and I refused their donations just as I did in the last election.” He said the loan he chose to give his campaign was to cover initial costs for campaign purposes such as website and filing fees. Harney told the Dispatch that overall he considers his campaign a grassroots effort. “Equally important to contributions are the costs associated with the campaign,” said Harney. “I chose to do a grassroots campaign and

only used local community volunteers and vendors to help run my campaign.”

Carol Marques

Marques has raised $8,324 in monetary contributions, with a $3,000 loan from herself and $533 in nonmonetary contributions for a total of $11,857 for her campaign. Some notable contributions to Marques’ campaign are $600 from Carolyn Tognetti, a founder of Gilroy Growing Smarter who is also Marques’ treasurer listed on her filings. Marques said her decision to give her campaign a loan was to cover initial costs. “I loaned my campaign money because I needed start-up funds since I started campaigning after Aug. 10,” said Marques. She told the Dispatch she has reached out to supporters for contributions through a fundraising dinner and personalized letters. Marques said, “Other than a donation from the South Bay Democratic Club, I am totally citizen funded.” In the race for the fouryear seat, Bracco has outraised all other candidates and incumbents.

Peter Leroe-Muñoz

Leroe-Muñoz loaned his campaign $21,012.80 over several filing periods in smaller increments. While he said he has not actively been seeking contributions, Leroe-Muñoz said he has received donations from individuals and local organizations. Dependent on the amount, Lero-Muñoz may have to file again before the election.

“Fundraising has taken a back seat to constituent outreach,” said Leroe-Muõz. “Thus far, I've personally met with nearly 1,000 voters during my meetings and door-to-door canvassing.”

Tim Renggli

Renggli has not filed any contributions and told the Dispatch he is not actively fundraising and is not accepting contributions. “I have actually turned down a couple of donations because I do not want to feel that I should be obligated to vote a certain way just because I received a donation from an individual or organization,” said Renggli. He does not believe this has affected his ability to campaign. “I am not accepting donations because my vote is not for sale,” said Renggli. “I am an advocate the entire city of Gilroy and its residents, not any individual or organization.”

Reid Lerner

Lerner received $1,100 in monetary contributions and $6,000 in loans for a total of $7100. He began his campaign with a cash balance of $2,506 that was left over from a loan he had given his 2017 campaign. The original loan was $15,000. Lerner did not respond to the Dispatch’s request for comment on his filings.

Tom Fischer

Fischer recently filed an updated list of contributions ahead of the Oct. 26 filing deadline. His campaign has now raised $19,834 in monetary contributions and $119.76

in non-monetary contributions for a total of $19,953.76. Some of his notable filings are $1,000 from the James Group, $750 from UA Local 38 COPE Fund, $750 from UA Local 230 PAC, $750 from UA Local 447 Political Fund, $750 from UA Local 246 COPE Committee, $750 from Sprinkler Fitters Local 483 PAC Kauffman, & Gable Assoc. Inc. and $750 from Carolyn Tognetti of Gilroy Growing Smarter. Fischer told the Dispatch that he has taken an active approach to fundraising, reaching out to supporters and beyond. “This year I decided to reach out to my local union and labor organizations as well,” said Fischer. In explaining the political action committee contributions to his campaign, Fischer said he had many personal connections to the groups. “I am a member of Plumbers UA Local 393. I requested help and support from them,” said Fischer. “I also applied for and received an endorsement from South Bay Labor. They have affiliates that you can also solicit if you receive their endorsement.” Fischer said a lot of the committees listed on his filings are associated with Plumbing UA. “The UA is United Association, which is the national affiliation that all plumbing unions in the US belong to. C.O.P.E. represents Committee on Political Education.” During a previous campaign, Fischer had loaned his campaign $7,500. He said this was mostly paid off and used to cover campaign

expenses that exceeded contributions. With a remaining $1,000 on the loan, Fischer said he will pay the balance at the end of his campaign if he is able. “Contributions to my campaign come from a wide range of sources; friends, family, businesses, developers, individual supporters and unions. I have made no promises or commitments to any of these sources,” said Fischer. “They support my campaign because we share ideals, values and perspective on issues that are important to them.”

Bracco has outraised all other incumbents and candidates and recently updated his filings with $8,929 in monetary contributions and $22,500 in loans for a total of $31,429. Some of his notable contributions include $500 from TUT Brothers Estates, $750 from Gilpac, $250 from Curries Associates, $250 from Hewell & Sheedy and $400 from Carolyn Tognetti of Gilroy Growing Smarter. Bracco said he loaned his campaign the $22,500 because he did not want to feel beholden to anyone. “I’m a firm believer that when someone’s giving you a lot of money, they’re expecting something in return,” said Bracco. He said he would rather give his own money to his campaign “than take a lot of money from developers.” However, Bracco said he has been fundraising and wrote letters to supporters who had

contributed in the past. Bracco said developers he has listed on his filings were personal friends.

Marie Blankley

Blankley raised slightly less Bracco; with no loans yet to her campaign, she has $28,739 in total. County settles jail lawsuit AUTHORITIES MUST BEGIN SCREENING, AND MPROVE SERVICES FOR INMATES Staff report

After three years of negotiations, the Prison Law Office, Cooley LLP, and Santa Clara County have reached a settlement in a class action lawsuit alleging that some conditions in the county jails are unconstitutional, county staff reported Oct. 23. The current settlement in the case Chavez v. County of Santa Clara, which is subject to court approval, binds the county to significant existing and future commitments to improve living conditions for inmates confined in the jail. County staff said the county and sheriff ’s office began addressing these conditions more than three years ago. The settlement results from several years of negotiations between the Prison Law Office, Cooley LLP, and the county regarding the alleged unconstitutional conditions in the jails, county staff said in a press release. “Although the negotiations were long and difficult, the outcome will result in dramatic improvements to the jails that will help reduce recidivism,” said Donald Spector, executive director of the Prison Law Office. “During this process, Sheriff Laurie Smith and

the county demonstrated leadership and complete transparency and dedication to finding solutions that addressed the deficiencies (including the use of force and solitary confinement) and negotiated this deal in good faith.” The composition of the county’s inmate population, due in large part to the recent realignment that placed more state prisoners in county facilities, has placed additional pressures on the county jails, the county’s press release continues. “For the last three years, the county has tackled necessary jail reforms in a collaborative, deliberative and transparent fashion resulting in improved conditions for inmates and their families, the staff and our community,” County Counsel James Williams said. “With this settlement complete, the county can now finalize its work on (its) larger efforts on jail reforms.” Smith added that she has “appreciated the professionalism of the Prison Law Office and Cooley LLP and the opportunity to work cooperatively to find common ground in the parties’ shared goal of providing appropriate conditions for inmates in the county’s custody.” The Prison Law Office and experts will monitor the county’s implementation efforts to ensure compliance. Key points of the settlement agreement include: • For all inmates, the county will make several modifications to the intake

unique to these inmates. • For inmates at risk of suicide, the county will make additional efforts at suicide prevention through revised triage and screening processes for evaluating inmates with suicidal behaviors, installation of suicide-resistant cells and changes to the way the jail supervises inmates at risk of suicide. • For inmates with dental needs, the county will improve wait times and expand services to inmates incarcerated for longer periods. • For inmates with vision, hearing and speech disabilities, the county will improve its identification and verification processes as well as its issuance,

retention and provision of assistive devices; accommodate these inmates in improved housing; provide for effective communication and programmatic access; and track accommodations provided to these inmates. • For inmates who engage in violence and, therefore, whose contact with inmates and staff must be reduced for the safety and security of the institution, the county will use a new, innovative phased approach, developed in consultation with experts, to house these inmates in what will be known as administrative management. This new approach will include specific admittance criteria and a high-level review for inmates who are retained

for longer periods of time; notice to inmates regarding their placement; improved conditions on these units in the form of greater out-ofcell time and more meaningful out-of-cell opportunities; and an opportunity for inmates to demonstrate good behavior and return to a lesser restrictive setting. • The sheriff ’s office has developed a new use of force policy and implemented extensive training to correctional staff on the policy as well as de-escalation and conflict resolution training. The federal court is scheduled to decide whether to grant preliminary approval to the settlement before the end of this year.

Property taxes are due November 1 MULTIPLE METHODS OF PAYMENT Staff report

Santa Clara County’s Department of Tax and Collections Department has mailed out the 201819 property tax bills to all property owners and tax payments are due Nov. 1, according to an Oct. 16 press release. The California Revenue and Taxation Code Section 2610.5 does not relieve property owners of the responsibility of making timely payments because they did not receive a tax bill. Property owners whose taxes are paid by their lending agency receive a tax bill marked “copy,” indicating that the original statement was sent to the lending agency. Property owners who have not received a bill by Nov. 1 should call the tax Information line at (408) 808-7900 and request a copy of their tax bill. Property tax bills are also available online at sccdtac.org.

Unpaid property taxes will become delinquent if not paid by 5pm Dec. 10. At that time, a 10 percent penalty and a $20 cost will be added to the unpaid balance. Taxpayers should mail tax installment payments, along with the first installment stub, to the Department of Tax and Collections, PO Box 60534, City of Industry, CA, 91716-0534. All payments must be postmarked Dec. 10 or earlier to avoid penalties. The Department of Tax and Collections recommends mailing payments early or obtaining a proof of mailing receipt from the post office. Checks are accepted by mail, but cash is not. Cash payments must be made in person at the Department of Tax and Collections, East Wing, sixth floor, 70 West Hedding St. San Jose. To pay taxes with a credit card, debit card or eCheck, visit the Department of Tax and Collections’ website at sccdtac.org. eCheck payments are free. A convenience fee is associated with credit or debit card

payments and must be paid by the taxpayer.

The Department of Tax and Collections has acquired a cashiering system to assist in the timely processing of payments received in the department. Payments made in person at the office will be processed within 48 hours. Also new this year, property owners will be able to view the allocation of the 1 percent county levy collected by their tax rate area online at wheredotaxesgo.org. Property owners also can take advantage of the partial payment program launched last year, and make multiple partial payments on each installment, with penalties placed on the unpaid portion only, after the payment deadline. The event continued with Broadway highlights performed by more than 40 students from Westmont High School Musical Theatre. The evening’s emcees included County

Superintendent Mary Ann Dewan, and Ron Gonzales, president and CEO of the Hispanic Foundation of Silicon Valley and former Mayor of San Jose. Chappell, who teaches at Barrett Elementary School, was recognized as Morgan Hill’s 2018 Teacher of the Year in May. Chappell was joined by all the teachers of the year for each MHUSD school site at the May 15 school board meeting. Cornaggia is a math teacher at Gilroy’s South Valley Middle School.

Mustangs coach Jake Newman expressed pride when talking about Locsin, pointing to the linebacker’s leadership skills. “He’s able to gather players together or pull them aside and make sure they understand their role,” Newman said. “His impact as a linebacker is he plays downhill, is aggressive and vocal. What’s really nice is he fights through every play, and that is what makes him special. He’s a good kid who has worked hard and overcome a lot of negative things in his life.” Off the field, Locsin is also grinding to get things done, expressing pride in getting his grades up. That was one of Locsin’s main goals entering his senior year. Locsin also knew he was hanging with the wrong crowd last year. “You have to be careful who your friends are and how the environment around you really affects you,” he said. “I had to change that and my study habits. Education is really key and I’m glad I realized the importance of that. I’m headed in the right

After a tumultuous junior year, Cisco Locsin’s comeback came full circle at two points this season: In the season-opener against Liberty Union of Brentwood and in last week’s game against Salinas. The Gilroy High senior linebacker missed the 2017 season after being ruled academically ineligible. Locsin didn’t make any excuses; rather, he told a reporter the facts of his home life and how he was hanging out with the wrong crowd as factors that contributed to his 1.8 GPA as a junior. Locsin’s senior year has been a 180-degree turnaround. With a 2.83 GPA and positive mindset, Locsin plans on working hard and creating a fruitful life for himself and his family. Locsin has had to overcome difficult circumstances—on and off the field—making last week’s return a triumphant one. Even though the Mustangs lost, Locsin’s return from injury was a positive note. Gilroy plays at Seaside on Friday before closing the season against rival Christopher High. For the longest time, it looked as if Locsin’s season was done after he suffered a knee injury in practice leading up to the second game of the season. “Unfortunately, I was not able to afford the insurance needed to get an MRI, so we really kind of winged it,” Locsin said. “I iced it, stretched it, did a little physical therapy until I was able to feel no pain. Not being able to play almost my entire senior season

really sucks, but I’m going to make the best of a tough situation. I’m just excited to play the game I love again.” At 5-foot-8 and 185 pounds, Locsin packs a burly frame ideal for football. When Locsin steps onto the field, his approach is simple. “My mindset is to play like there’s no tomorrow,” he said. “You never know when your season can get cut short. I’m lucky to be back on the field, so I’m going to take advantage of every moment I have on the field and go all out. I just have to grind on every play.” Locsin, who only started playing the sport in the eighth grade, loves the physical aspect of the game, especially playing on the defensive side of the ball. “You’re not being hit; you’re the one who is going to make the hit,” he said.

Locsin’s family suffered heartbreak when Locsin’s dad, Frank, suffered a heart attack two to three years ago, Locsin said. “His heart was only working

at 24 percent and he needed open heart surgery immediately,” Locsin said. With Frank being unable to work, Locsin’s mom, Josephine Duenas, has had to work two full-time jobs to help support the family. Locsin’s parents are staying at his aunt’s one bedroom apartment, with Locsin living at one of his teammates’ parents house. “Financially, we’re not all there,” he said. “But I have to realize a lot of people have it worse. I love my parents to death.

We have a really good relationship, and they apologized to me, but we all go through struggles. What matters now is how we get out of these situations and how we respond to them. My parents are doing the best they can to get us back on our feet, and for that I’m much appreciative.” Locsin expressed pride in his parents, who come to the games to cheer him on. Whenever his football playing days are done, Locsin plans on getting into coaching, as he wants to make a difference in others.

Even though he hasn’t received interest from fouryear schools yet, Fleming said he would love to play in college. Pierleoni said college options would be available for Fleming as long as he continues to develop. “He’s an extremely good athlete, is very athletic and extremely fast for his size,” Pierleoni said. “He has all the tools.” Fleming continues to refine the technical aspects of his game and overall awareness. Defensively, one of Fleming’s goals is to make sure to keep the quarterback contained and in the pocket. Fleming has two different personas on and off the field. Off the field, Fleming is a gentle giant. On the field, he has to have a mean streak. “No one is my friend on the field,” he said. “I’m doing my best to help the team and trying to earn a scholarship, so I can’t be friends with anyone on the field. After the game, it’s OK. But when we’re on the field, we can’t be friends.” Case in point: Fleming had a solid game against

When Joe Fleming was in the eighth grade and preparing to play for the Gilroy Browns Pop Warner football team, he needed to drop 35 pounds in a two-month period to make the weight limit to play. Somehow, he got it done. With the help of his dad, Peter, Fleming ate healthier and ran whenever he could, resulting in a huge drop in weight in a short period of time. “I was super proud of myself for doing that,” the Christopher High junior said. “My whole family was pretty proud.” They’re still proud. Fleming has become an impact player for the Cougars, who enter Friday’s game against Alvarez at 3-5 overall and 1-4 in the Pacific Coast League’s Gabilan Division. Fleming plays tackle and end on the defensive line and tackle on the offensive line. At 6-foot-3 and 270 pounds, Fleming said he’s still growing. In the off-season, Fleming trained at Fact Fitness to improve his footwork and overall strength. Even though Fleming said he improved his footwork, he still wants to get stronger, which would be downright scary for any opposing lineman who matches up with him. Cougars coach Tim Pierleoni said Fleming has been a key differencemaker for the program.

“He’s obviously one of our best defensive players for sure,” Pierleoni said. “At the end of last year as a sophomore he was probably our best defensive linemen and continued to stay that way as a junior. He’s definitely a force on our defensive front without a doubt, and he’s getting better and better every year. He’s more mature, working harder and knows what he’s doing. He has a motor on him, and that is half the battle for bigger guys playing this game.”

at San Benito in volleyball and swimming, and Caroline is a freshman on the Haybalers’ girls water polo team. Fleming said his individual highlight of the season came against Hollister, a 34-28 loss on Sept. 28. In a seasonopening 17-14 win over Monte Vista Christian,

Fleming had four tackles and 2.5 sacks. A week later in a 33-31 loss to Live Oak High, Fleming finished with five tackles for losses and two sacks. Still growing into his body, Fleming has tremendous potential and a huge ceiling, which should get college coaches showing interest

in him soon. Even though Fleming will be the first to tell you he has plenty to improve on, he said he’s willing to put in the work, noting his commitment to consistently work out in the off-season. The Cougars hope to rebound strong after suffering three straight blowout losses.

OBITUARIES RUTH EMMA NELSON SACCO

R

uth Emma Nelson Sacco, the matriarch of the Sacco family, born on February 11, 1920 in Missouri, died peacefully at home on Friday, October 19, 2018. Strong-willed to the end as she had “places to go and people to meet”, she transitioned in the company of family. Arriving in Gilroy in 1945 with her husband Jim Sacco, they raised four children, James Nelson Sacco, Gary Patrick Sacco, Mack Louis Sacco and Molly Sacco Hale, while running their downtown business, Kirby Appliance, together. Preceded in death by her husband, Jim, and son, Gary, she leaves behind her sister, Reba Mae Cassin, ten Grandchildren and sixteen Great Grandchildren who all have the benefit of her love, her thinking, her compassion and her way in the world. She adored her family, spending quality time whenever possible and would have loved having them all living on the same block. Ruth was involved with many social groups in Gilroy: a life-long member of the Presbyterian Church, of Eastern Star, of PEO, a philanthropic organization celebrating the advancement of women, her book club, FRFG and was an active participant with the Gilroy Garlic Festival. The family invites donations in Ruth’s name to Ability Production.org, a Spinal Cord Injury Support site managed by her daughter and husband and PEO International. A memorial service and celebration of life will be held on Saturday, December 8, 2018 at 1:00pm at the Presbyterian Church, 6000 Miller Avenue, Gilroy. nthony “Tony” Vigna died peacefully on October 8, 2018 in Goleta, California at the age of 82. Tony is survived by his wife Dolores, children Eric Vigna, Katherine Archibald, and Greg Vigna, siblings Deanna Goodrich and Marilyn Rocca, and his ten grandchildren. He is preceded in death by his parents Frank and Ida Vigna, daughter Elizabeth Vigna, and granddaughter Camille Vigna. Tony was born on September 17, 1936 in Gilroy, California. He graduated from Gilroy High School in 1954 where he was a Hall of Fame athlete in basketball. He was selected All Central Coast Athletic League, USA team, and the Northern California team during his high school years. He attended Stanford University on an athletic scholarship where he earned a bachelor’s and master’s degree in History and was a member of the Sigma Chi fraternity. He began his teaching and coaching career in San Jose. After moving to Santa Barbara, Tony taught high school history at San Marcos High School for 43 years and coached boys and girls basketball and tennis at both San Marcos High School and Bishop Diego High School. He was also a long-time Santa Barbara Little League and Boy’s Club coach. Tony was a self-taught tennis player and enjoyed competing at the club level and playing with his daughter Katherine. Together they won the 1980 Equitable National Father-Daughter tennis title in New York. A memorial mass was held on Friday, October 26 in Santa Barbara.

GINGER CLIFTON October 15, 1956 - October 13, 2018

inger Clifton passed away in Morgan Hill California on Saturday October 13, 2018, surrounded by her loving family after a battle with cancer.

She is survived by her two children JR Clifton and Austin Clifton as well as two grandchildren. She was preceded in death by her parents Pete and Anne Peretto and husband Hank Clifton. A private celebration of life will be held to honor her.

ulia M. Viarengo passed away in the comfort of her home on October 5, 2018. Born in Gilroy to Carmen and Teresa Filice, she was 102 years old.

Julia was preceded in death by her husband Frank Viarengo, sister Marietta Filice, brothers Michael A. Filice and Carmen E. Filice and nephew Steven Filice. She leaves behind her nephews Jeffrey Filice (Aptos) and Alan Viarengo (Gilroy), niece Deborah Filice Anderson (Santa Cruz) and sister-in-law Aurora Viarengo. She is also survived by numerous great-nieces, greatnephews and Godchildren. Julia worked for many years as a bookkeeper for the Filice & Perrelli Canning Company and Sunsweet Growers in Gilroy. She and Frank moved to Watsonville and eventually settled in Salinas in the early 1960’s. The family would like to express their gratitude to Dr. Leslie Foote, the VNA/ Hospice and Central Coast Senior Services. It was through their skilled and compassionate care that Julia remained comfortably at home. A Mass of Christian Burial will be held on Friday, November 9, 2018 beginning at 11:00am at St. Joseph’s Catholic Church, 1 Railroad Avenue, Spreckels, CA 93962.
