California Attorney General Xavier Becerra has rejected a personal appeal from Santa Clara County officials to keep two hospitals open, after they had attempted to head off a Jan. 30 court showdown. The county had proposed a memorandum of understanding that would commit the county to the highest levels of medical care at the two hospitals it seeks to buy from Verity Health System, according to Santa Clara County Executive Jeff Smith. The city of Gilroy sent out email alerts early last week warning residents to get prepared for the storm that was about to hit Northern California. According to the National Weather Service, Gilroy saw 2.21 inches of rain from Tuesday, Jan.
15 and Thursday, Jan. 17. The city opened up to designated stations for residents to pick up sandbags to protect their homes from flooding. The city sent a list of tips to prepare recommending flashlights in case of power outages, not driving through standing water, taking extra precautions while driving and developing a family emergency preparedness plan. Rachelle Bledell, Gilroy’s
community engagement coordinator, told the Dispatch a major point of flooding in the city is Uvas creek, but that the city is typically protected from flooding by the creek’s levee. However, Bledell said there are still points in Gilroy that are at higher risk of localized floods. Last week’s storm closed down Silva’s crossing, at the intersection of Miller Avenue and Uvas Parkway, to resident’s for less than a day. The area is
seen by the city as a point in the city that frequently floods due to increased rain. The Santa Clara Valley Water District monitors rising water levels in the district’s creeks during heavy rainfall. Uesugi Farms has harvested its last crops and sold its last pumpkin. The large, well-known, family-owned vegetable producer with operations in California—Santa Clara,
Contra Costa, San Benito and other counties—and Mexico, is selling off all of its equipment and “winding down” its operations. There will be no spring planting of its Napa cabbage, pepper, corn, squash and pumpkin crops. “Due to market conditions and factors outside of its control, Uesugi Farms has made the difficult decision to wind down its operations at the conclusion of the 2018 fall harvest season,” the family said in a web posting this winter.

not affect plans already approved or in late stages of development-; at the Jan. 7 meeting when the ordinance was approved, the council also voted to approve a multi-family housing project on Monterey Road. However, the ordinance will allow staff to analyze city services needed for the projects, the effects of multifamily projects on portions of city infrastructure and where new projects of the type would fit best within the city. A project is considered multi-family if it is three units or more. Ketchum told the Dispatch that the moratorium is not intended to last any longer than 45 days and that the state mandates a report be presented to the council within the first 30 days or the urgency ordinance. He expected the presentation to occur at
the Feb. 4 meeting of the council. Within the presentation, housing trends will be addressed to best identify potential building sites for projects. Ketchum said an economic report commissioned by the council identified a trend of building multi-family residences near places of employment, which may influence the findings of the report and how the council proceeds when approving projects. “We believe there is a potential impact on the city’s residents long term if we don’t have all the information we can on how multifamily residential and affordable housing, which is a subset of multi-family, comes before the city,” Ketchum told the council. The findings from the study will become part of the city’s emergency and general plans.

The Gilroy City Council and Planning Commission will not be hearing or approving any multi-family housing projects until Feb. 21, after an interim urgency ordinance was adopted by the council in a 6-1 vote. Council member Dion Bracco voted against the ordinance, which will halt any new projects from coming before the council and commission for 45 days to give staff time to create a report of current housing and zoning needs within the city. All other council members voted to approve the ordinance, which needed six votes to pass.
According to the staff report presented to the council, California cities can only pass a moratorium of this nature if “there is a current and immediate threat to the public health, safety or welfare, and the approval of additional multi-family development entitlements would result in that threat to public health, safety or welfare.” City staff concluded such threats were present. The initial report came in November after the council directed city staff to research whether an ordinance was necessary or possible. Senior planner for the city, Stan Ketchum, told the council, “We think it’s prudent and important that we have a little bit of a time out…to give us a chance to look at these issues going forward.” The ordinance will

Navigator Schools, which has campuses in Gilroy and Hollister, was recently granted a third charter petition to open a school in Watsonville by the state Board of Education. Navigator plans to open Watsonville Prep School in
August 2019, according to Navigator staff. The state board’s decision comes almost a year after Navigator was rejected by the Pajaro Valley Unified School District. Along with its petition, Navigator submitted a list of more than 200 meaningfully interested families who signed forms signaling their intent to enroll if the school was authorized. “Navigator determined the community, PVUSD
and Navigator could benefit from a local Navigator campus” in Watsonville, according to Navigator officials. “With several members of the leadership team having strong ties to the Watsonville community, the combination of need and organizational dedication only emphasized the commitment to making a difference in the Watsonville community.” The state Department of Education staff recommended Navigator’s
approval to its board, which voted unanimously Jan. 9. More than 100 Watsonville families, community members and supporters attended the meeting in Sacramento to support Navigator’s petition, according to Navigator staff. Navigator also got support from Gilroy Unified and Hollister school districts, both authorizers of Navigator schools in their respective areas.
After listening to 90 minutes of public testimony, including strong words of support from Gilroy Unified, Hollister School and Healdsburg Unified districts, and asking questions of both the Pajaro Valley Unified School District superintendent and Navigator staff, the state board members voted unanimously to approve the charter petition. “From day one, Navigator’s mission has to been to be a positive
influence on public education throughout the state of California, not just on the students who attend Navigator schools,” said Kirsten Carr, Navigator’s director of engagement and partnerships. “We look forward to establishing this same type of strong relationship with our fellow educators in Watsonville.” Navigator has failed in past attempts to open its charter schools in Morgan Hill and Salinas.

Decisions set stage for 2019
H
ere are a few highlights in Santa Clara County government in 2018. New Animal Services Center Coming. Construction of the new center is scheduled to break ground in Spring 2019, with a movein date of mid-2021. The new 37,000-squarefoot building on 4.5 acres will replace the current facility in San Martin. The no-kill center will serve dogs, cats, horses, sheep and much more. It will also be an inviting destination for visitors focused on animal welfare, care, and education and will include a community multi-use room. Making Magic at Our Playgrounds. Children of all abilities deserve a safe and fun place to play, which is why the county approved $10 million in matching funds for many new all-inclusive playgrounds. Magical Bridge Playgrounds provide fun for people with autism, sensory challenges, cognitive developmental, physical disabilities, as well as those without special needs. In addition, the county supervisors just approved several more playgrounds including one at Lake Almaden. Exchanging Food for Library Fines. As chair of the Santa Clara County Library District (SCCLD), I am proud of the 7,936 patrons who took part in our “Food for Fines” program designed to clear library fines in exchange for food donations to Second Harvest Food Bank. A total of 18 tons of food (30,000 meals) was collected. The popular amnesty program offered SCCLD library cardholders the chance to quickly return to good standing while helping someone in need, making this truly a win-win program. Preserving Hospital Services. I have been concerned about access to health care in South County since the Daughters of Charity announced plans to sell St. Louise Regional Hospital (and other facilities) in 2014. The new owners filed bankruptcy in 2018, and
despite the County being the only bidder to purchase and run the hospitals, the state Attorney General is attempting to block the sale, a move that would effectively close the hospitals. My colleagues and I are fighting to keep the hospitals open. Preserving Agriculture. The Santa Clara Valley Agricultural Plan recently received the distinguished Governor’s Environmental and Economic Leadership Award for Ecosystem and Land Use Stewardship. In addition, we just received a Sustainable Agricultural Land Conservation Grant of $100,000 to initiate a regional Agricultural Conservation Easement purchasing program and several million dollars of funding for specific easements. Building Schools and Preserving Farmland. LAFCO (Local Agency Formation Commission) works to protect farmland, but rarely are choices ever black and white. I was disappointed when a majority of LAFCO commissioners voted against Morgan Hill’s recent application.The proposed one-for-one acre exchange of conservation easements to protect agricultural land and build a muchneeded high school in the area could have been a win-win for those of us who care deeply about both agricultural preservation and education. Building Affordable Housing. In November 2016, Santa Clara County voters approved a $950 million Affordable Housing Bond to produce new affordable housing units and to assist first-time homebuyers. It is projected that the housing bond will fund 120 new affordable housing developments over 10 years. Just 18 months into the County’s 10year plan, over $234 million in funding has been approved for 19 multi-family housing developments across six cities in Santa Clara County for a total of 1,437 new affordable apartments and 484 renovated apartments.

It's not the best hospital, but we need emergency care! I almost died there due to a doctor's poor decision. However, when I returned, a great doctor and the awesome nurses saved my life. Most of our experiences there have been positive. I have only had two bad experiences in my 12 years of living in Gilroy. Driving to San Jose or Hollister for emergency care would be terrible! Saint Louise Hospital I am deeply disappointed that the California Department of Justice is trying to block the sale of O’Connor and St. Louise hospitals to Santa Clara County . As county supervisor, I will do everything I can to keep the hospitals open so as to ensure continued healthcare access for all residents. Since the County was the only party to bid on Verity’s hospitals, the Attorney General’s actions jeopardize the deal and could cause the closure of both hospitals, threatening the health of our community, especially in South County. Thank you for your tremendous desire to help us “Save St. Louise hospital in South County!” The issue is simple: The County is the only one offering to buy it, and the the judge approved the sale to us. Unfortunately, the Attorney General’s office is contesting the sale. If we don’t buy it, it will close and 100,000 County residents will lose local access to hospital services. The easiest way to help is for each of you to call the AG’s office and the Governor and the applicable Senator and Assembly members. The Superior Court of California, County of Santa Clara is recruiting volunteers for the 20192020 Civil Grand Jury. The Civil Grand Jury, an arm of the Superior Court, is a part of the judicial branch of government. It serves as the county’s civil watchdog agency and may examine all aspects of county and city government, special districts and school districts. It is authorized to inspect and audit books, records and financial expenditures to ensure accountability of public
funds. The grand jury may also inspect jails and juvenile detention facilities. Grand Jury service gives citizens an opportunity to contribute to the efficiency of local government and play an integral part in ensuring that government officials are accountable to residents. “Grand jurors are civic-minded individuals who are agents of change in their communities,” reads a recruiting email from the court. “Grand jurors come from all walks of life with varying interests and life experiences; however, they share a common thread: dedication to democratic ideals.” Applicants must be at least 18 years old, United States citizen, and residents of Santa Clara County for at least a
year prior to selection. Service on the grand jury requires an average time commitment of 25 hours per week, or as determined by the grand jury. Candidates must be willing to dedicate this year of service to keep careful watch over various aspects of county government, and the oneyear term of the 20192020 panel will begin on June 20. Grand Jurors are paid per diem for all official grand jury business and reimbursed for their mileage. The application deadline is Friday, March 29. Hospitals face Jan. 30 ➝ County, 1 drove to Sacramento in a driving rainstorm the afternoon of Jan. 16 to hand-deliver the proposal and meet with Becerra, who earlier this month stunned the county by asking the U.S. Bankruptcy Court to block the sale of O’Connor and St. Louise hospitals to Santa Clara County. If the attorney general is successful in convincing the judge to “stay” or block the sale of the two hospitals until a U.S. District court rules on Becerra’s appeal of the judge’s Dec. 27 sale order, the $235 million hospital deal is dead and the two hospitals will close, said Smith. Smith remained hopeful. “We are pretty confident that our legal case is strong, and that the stay will not be granted,” he said. Lawyers familiar with the case also said it would be unlikely that a judge would stay his own order. Because of a death in the family, Becerra was not able to attend the Sacramento meeting, at which Smith had hoped to ease Becerra’s stated concern that the county’s failure to commit to quality medical care was the primary reason the deal should be scrapped. Santa Clara County supervisors last week instigated a social media, telephone and email campaign—including appeals to Gov. Gavin Newsom— in hopes of convincing Becerra he should put the healthcare needs of Santa Clara County first, and that his concerns about the county’s commitment to quality health care were unfounded. Smith had told supervisors the morning before his trip that “time is running out.” Smith said Becerra’s aides were in no mood to discuss the issue. “Their response was, ‘We are not interested in a contract with the county; we are intent on enforcing our regulations,’ ” Smith said after the meeting. “It is largely an issue of control and power and has nothing to do with the hospitals.” The attorney general, he said, made “a

political decision, not a legal decision.” The attorney general’s office continued this week to decline to comment. A hearing at Becerra’s request to block the sale has been set for Jan. 30 in U.S. District Court in Los Angeles, with a decision expected by Feb. 2. Also on Jan. 30, the same federal bankruptcy judge will hear multiple motions by Verity dealing with the collective bargaining agreements with unions at the O’Connor and St. Louise hospitals. After returning from Sacramento, Smith remained incredulous at the attitude of the attorney general, whose staff rejected any effort to compromise or modify a set of conditions imposed on Verity in 2015 in connection with its purchase of six troubled hospitals in Northern and Southern California that Becerra said dictates conditions of the current purchase agreement. Becerra contends in court documents that any sale of hospitals owned by Verity Health must adhere to all of the strict conditions set down in December 2015 by his predecessor Kamala Harris, even if it meant the hospitals will close. Smith has called the attorney general’s obstinacy “absurd.” Smith said that he made it clear in his personal appeal to Becerra’s staff that blocking the sale to the county will mean that O’Connor and St. Louise hospitals will close, but that this information didn’t sway the state’s lawyers. The attorney general has no legal role in overseeing the state’s hospitals, but got involved in 2015 because a private entity was purchasing hospitals from a nonprofit. In this case, the
sale would involve a purchase of private hospitals by a government entity, an actual arm of state government. Smith and his legal team contend that the attorney general doesn’t understand California law, and that the issue amounts to a power play. The county executive said he no longer thinks that healthcare workers’ unions’ concerns about losses of pensions and contracts are the issue. “It’s all about control and power,” he said. Blocking the county purchase will mean “the hospitals will close, and nobody is going to buy them,” Smith said earlier this month. He said the county’s asset purchase agreement expires March 1, and that a deal must be closed by then. Mike Wasserman, the Santa Clara County supervisor whose district includes St. Louise Regional Hospital, wrote on Facebook, “I am deeply disappointed that the California Department of Justice is trying to block the sale of O’Connor and St. Louise hospitals to Santa Clara County. As county supervisor, I will do everything I can to keep the hospitals open so as to ensure continued healthcare access for all residents.” He urged his constituents to contact Becerra and published his contact information. “The attorney general’s actions to block the sale of Verity’s hospitals to the county is a real threat to the health of our community, our residents and the vulnerable populations the hospitals serve,” Smith had said in a Jan.10 statement.

Uesugi sells equipment, vehicles said the web post. The sales effort began with letters that went out to select creditors, followed by advertisements in trade journals and local newspapers, including this newspaper. The sales flier distributed in the new year read was headlined, “Farm equipment for sale by bank, 1020 State Highway 25 Gilroy, CA.” The flier included a link to a web listing for millions of dollars in farm equipment for sale, a total of 271 items. An advertisement published this week in this newspaper listed more than 150 pieces of farm equipment still for sale: trucks, tractors, backhoes, harvesters, trailers, trucks, cultivators, ATVs, plows, sprayers, pick belt trailers, bin trailers, water trucks, pressure coolers, conveyers, stackers and more. San Jose-based Heritage Bank of Commerce, with offices in Morgan Hill, is conducting

the massive equipment sale with the Aiellos. “The company is in the process of reaching out to its customers and vendors to help them understand what this will mean for them and the proposed next steps,” Uesugi said in its web post. Since 1985, the Aiellos have hosted a huge Pumpkin Park every October on Monterey Road in San Martin, featuring an internationally sanctioned pumpkin weigh-off. The park draws about 100,000 visitors each year. The fate of the 2019 San Martin Pumpkin Park is unclear. Uesugi Farms is reported to have employed about 250 seasonal workers and a year-round staff of 50. It also had partnerships with dozens of producers. Shutdown impacts local agriculture HOUSE MOVES TO EASE THE STRAIN ON FARMERS AND RANCHERS Staff Report
The House of Representatives passed a bill, 243-183, to reopen the Department of Agriculture—which runs the Supplemental Nutrition Assistance Program, commonly known as SNAP or food stamps—as well as the Food and Drug Administration. .Meanwhile, the Department of Agriculture will continue providing food stamps to millions of Americans through February, Agriculture Secretary Sonny Perdue announced. House Democrats, including Reps. Zoe Lofgren and Jimmy
Panetta, are taking action to reopen all government agencies by passing individual, bipartisan appropriations bills. The partial government shutdown is putting at risk federal food assistance programs, including WIC, school breakfast and lunch programs, The Emergency Food Assistance Program (which funds food banks and food pantries), and SNAP, which ensures that millions of low-income Americans, including pregnant women, children, seniors, people with disabilities, college students and veterans, don’t go hungry. In addition, just as the CDC and FDA announced the end of the E. coli outbreak associated with romaine lettuce, and continued searching local farms to pinpoint a cause, furloughed FDA employees were unable to properly inspect food

the United States. The Agricultural Worker Program Act would grant legal “blue card” status to immigrants who have worked in agriculture for at least 100 days during the previous two years. The agriculture bill approved by the House this month would provide both discretionary and mandatory funding for food and nutrition programs within the USDA. including SNAP, WIC, and Child Nutrition Programs.
SNAP: This bill provides $73.219 billion in mandatory spending for SNAP, which fully funds the program for FY 2019. WIC: Allocated $6.15 billion in discretionary funding for the Special Supplemental Nutrition Program for Women, Infants and Children. This is $400 million above President Donald Trump’s request. Child Nutrition Programs: Provides $23.184 billion for Child Nutrition Programs, including $30 million for school equipment grants and $28 million for Summer Electronic Benefit Transfer initiatives. It also provides $2.97 billion in discretionary funding for the FDA, $159 million above the FY 2018 level and $213 million below the President’s request.

In the midst of a 5-0 loss to San Benito High in a Jan. 10 Pacific Coast League Gabilan Division match, Gilroy High sophomore Sarah Fox kept on competing for 50-50 balls, playing as feisty as ever. It’s going to take that type of effort in every match for the Mustangs to post some quality results for the rest of the season. “We’re a young team and rebuilding,” Mustangs coach Roney Cardoza said. “We’re not as strong as the top teams in the league, but we have some good players and we’re setting up well for next year.” With a roster blending players from each grade level— including seven juniors, five freshmen, four seniors and two sophomores—the Mustangs hope they’ll coalesce and become stronger as the season goes along. Kelly Nebesnick, a junior captain, plays strong on the ball and possesses solid footwork. Cardoza hopes Nebesnick can stay healthy, as she has battled some injuries early in the season. “Kelly in the midfield is good at attacking and defending,” Cardoza said. “Most kids do one or the other, but Kelly does both.” The team’s other captain, sophomore Maddie Eastus,
plays striker and has the ability to create scoring opportunities for the team. Eastus is also strong on the ball and has excellent vision, allowing her to make solid passes and get to certain spots on the field that increases her chances of making an impact play. Eastus changes the field well, sees the passing lanes and competes hard for 50-50 balls. “Maddie is always out there looking for ways to create opportunities for the team to score,” Cardoza said. “She has a calmness on the field and the ability to read the game and slow it down, which allows her to score. No matter what speed the game is going at, she’s great at slowing the game down.” Tatianna Cardoza, a junior midfielder, scored nine goals last season and entered the first week of league play with two scores, both on free kicks. Roney said Tatianna’s free kicks are so lethal that the team wisely has an offensive strategy on set plays utilizing her leg. “She’s a lefty that bends the ball correctly, so on any dead ball she gives us a scoring opportunity (from 40 yards and in),” Roney Cardoza said. “Sometimes we’ll look to Maddie for a header or just pop the ball straight in off the kick.” Olivia Bozzo, a junior fullback, possesses speed, solid footwork and makes sound decisions. “Olivia is an amazing, great kid,” Cardoza said. “She’s always giving positive feedback to the girls and I have her at center back even though it’s not her normal position. But I have her there because she has more experience than the rest and is pretty fast.”

Cardoza said junior fullback Aphrodite Ayala plays with a level of intensity every team needs to be successful. Ayala sacrifices her body on defense and takes control of the back line as one of the main communicators. Junior Amaya Raoof and senior Korynn Yslava have split time at goalkeeper, and Raoof had a solid game against San Benito. Even though the Haybalers scored five goals, Raoof didn’t have a chance at most of them since they were high percentage
shots from close range. Both Raoof and Yslava are first-year goalkeepers, putting the onus on the rest of the team to play highlevel defense. Cardoza feels optimistic about the future because of players like freshman wing Lexi Wilson, who has provided a boost with her energetic play. “Lexi works harder than the average player,” Cardoza said. “She plays taller than she is and is stronger than what she looks like. It’s a great positive to have her here and I think she has a bright future.”
Isabella Domingues, a junior wing, entered the program having never played soccer. However, Domingues has caught on fast to make an impact. “Isabella is working her butt off and gives an all-out effort,” Cardoza said. “She and Lexi never miss practice, and that is really important.” With a small roster that has been hit hard by injuries, it’s going to take the team’s most experienced players—Eastus, as an example—to elevate the play of the squad.

926 GIL - Public Notice City of Gilroy Community Development Block Grant & Housing Trust Fund Request for Proposals for Fiscal Years 2019-2020 and 2020-2021 The City of Gilroy is scheduled to release a Request for Proposals (RFP) for the use of Community Development Block Grant (CDBG) and Housing Trust Fund (HTF) funding for Fiscal Years (FY) 20192020 and 2020-2021. The City of Gilroy utilizes a twoyear budgeting process. In FY 2019-2020, the City expects to receive an estimated $500,000 in CDBG funds from the U.S. Department of Housing and Urban Development (HUD). The City expects a similar amount in FY 20202021. Information is not yet available on the exact amount of this federal grant. The primary objectives of the CDBG Program include activities that benefit lowincome households, aid in the prevention of slums or blight, or meet an urgent community need. The City's HTF program provides additional funding of $168,000 for the services related to housing and homelessness. The City Council will determine the final funding priorities at its January 28, 2019 meeting scheduled for 6:00 p.m. in the City Council Chamber, 7351 Rosanna St., Gilroy CA. The priorities may include the following general categories: basic needs, supportive services, youth services, economic development, and housing services. The City will award grants for a two-year period with estimates included in this notice representative of the first year of funding. A similar amount is expected in year two and is contingent on the availability of funds and successful completion of the contract in year one. If approved by the City Council, the CDBG program will award approximately $75,000 in CDBG funds for public service activities, and $150,000 for a Housing Rehabilitation program.
