Almost one year after Steven Juarez died in Gilroy police custody, the district attorney’s office has concluded that officers acted lawfully in detaining and using force on the 42-year-old local man, while acknowledging that force contributed to his death. The county medical examiner’s office found that Juarez died from “severe drug intoxication complicated by his exertion to escape arrest and the police officers’ less lethal efforts to detain him,” reads a Feb. 22 report compiled by Santa Clara County Assistant District Attorney Brian Welch. A U.S. District Court judge in Los Angeles rejected a bid by California Attorney General Xavier Becerra to block the purchase of two failing Verity Health System hospitals by Santa Clara County. The Feb. 22 ruling cleared the way for the county to close its $235 million purchase of Saint Louise Regional Hospital in Gilroy and O’Connor Hospital in San Jose, plus the DePaul Urgent Care Center in Morgan Hill this week. County officials said they expected to close the deal Feb. 28, when a court-approved purchase agreement expired, and take ownership on March 1. “We are pleased that the district court denied the stay, which

will allow the county to complete its purchase of the hospitals,” said County Counsel James Williams. “We will now be able to keep these hospitals open to ensure access to healthcare for the residents of Santa Clara County.” The federal court decision ended nearly two months of anxiety for patients, staff and community leaders, especially in southern Santa Clara County, where for more than 100,000 people Saint Louise is the only local option for many healthcare services. Becerra had appealed a bankruptcy court’s December approval of the sale to U.S. District Court, and sought a stay of the sale, pending resolution of the appeal. If successful, Becerra’s effort would have voided the county’s

purchase agreement and forced the two hospitals to close. There were no other purchase offers. “The public interest factors weigh against the stay,” U.S. District Court Judge R. Gary Klausner wrote in his six-page

The announcement by President Donald Trump that he is delaying his plan to raise tariffs on $200 billion worth of Chinese goods March 1 was bad news for Gilroy garlic giant Christopher Ranch. The 10 percent tariff imposed on some foreign agricultural imports, including garlic, had brought the company out of a ninemonth sales slump caused by China’s “dumping” of cheap garlic on U.S. and world markets, said Ken Christopher, executive vice president of the family business.

If tariff talks had not been successful by March 1, those tariffs were to increase to 25 percent. The president pushed that deadline back indefinitely in two Feb. 24 tweets. “As this is the second time that the administration has delayed the implementation of 25 percent tariffs, we’re disappointed that the president is not willing to enact legal action that has been scheduled for some time now,” Christopher told this newspaper. A 25 percent tariff “would be incredible for our business,” according to Christopher. “In not enacting the 25 percent tariffs, the administration is letting down American garlic farmers.” He said China illegally dumped garlic into the U.S. until September, when the tariffs went into effect. Christopher sales were

Performance Food Group is putting the finishing touches on its new food distribution plant on South Monterey Road in

Gilroy and is hiring workers for the new facility. Performance, one of the nation’s largest prepared food distribution companies, is holding a hiring fair on Thursday, March 7, at the Hilton Garden Inn, 6070 Monterey Road, just north of the new plant. A flier distributed through the Gilroy Chamber of Commerce said Performance is hiring for area managers, customer service representatives, a

facilities manager, warehouse staff and drivers. The hiring center will be open from 10am to 7pm. The massive 195,000-square-foot food processing plant could mean nearly 60 new jobs in Gilroy, as the company expects to retain 70 percent of the current 190-person workforce in Santa Cruz. Performance is closing down the Santa Cruz plant to open the new operation in Gilroy. A company spokesman

declined to say when the new facility would open for business. The new site sits on 30 acres of land at 5480 Monterey Road, south of the Garlic Farm Travel Center. With 30 acres to work with, Performance Food Group will have the option to add 151,000 square feet to the 195,000 square feet facility. When the company bought the site, it was listed for $5.5 million. Performance Food

Group specializes in supplying restaurants and distributes a broad array of food and food-related products such as baked goods, meats, poultry, condiments and even cleaning supplies. The Richmond, Va.-based firm delivers fresh, frozen and dry food as well as food-related products such as cleaning supplies and packaging materials. It also offers equipment, supplies and serving ware.

Performance Food Group’s Central Coast business has been in its current Santa Cruz location since 1957 when Harry Ledyard founded a local food distribution company. The Ledyard company was sold in 2011 by former owner Richard Fontana of Scotts Valley to Performance Food Group for $100 million. For the first time in a decade, Gilroy school leaders will be searching for a new principal at Gilroy High School after veteran administrator Marco Sanchez announced he is resigning at the end of the school year in June. “After 10 wonderful and amazing years at Gilroy High School, I have accepted a position with the Central Coast Section,” said Sanchez in a message to “Mustang Nation.” Sanchez—a decorated collegiate and Olympic wrestler in his day—is not going too far, as he was selected as the new assistant commissioner for the Central Coast Section, which governs high school athletics throughout the area. “The CCS Selection Committee diligently reviewed each candidate’s strengths and potential contributions to the CCS office and all member

The Independence High School alumnus, who holds a doctoral degree in organizational leadership, has led Gilroy High School for the past 10 years. “We have accomplished much over the years,” Sanchez said. “The students, staff, parents and the incredible support from the district office/school board have made my experience as a school leader the best I have experienced in my 26 years in education.”

A spokesperson for the attorney general still had conceded defeat early this week. On Feb. 25, Becerra’s press office issued a terse statement: “We are exploring our options.” The attorney general had only one option after Klausner’s ruling—to ask the 9th CIrcuit Court of Appeals to intervene before Feb. 28, a move observers considered futile and unlikely. "These two hospitals are essential to the continued health and well-being of folks in our region,” said Santa Clara County Supervisor Joe Simitian, president of the county Board of Supervisors. “Continued litigation by the attorney general is a distraction from the important work we have to do. It's time to stop arguing about who's right and start focusing on what's right, and that's taking care of the folks here in the county who need our help." Becerra had argued it was necessary to block the sale—even it if meant closing the hospitals— to ensure that his office could enforce guarantees of healthcare services. “Two federal judges have now rejected the attorney general’s arguments against the county as meritless attempts to exert authority he does not have over local governments,” said County Executive Jeffrey V. Smith. “The county will ensure that O’Connor and Saint Louise hospitals continue serving our communities with

the enhanced services we will offer through the hospitals as part of the county’s integrated health system.” Klausner affirmed in today’s ruling an earlier decision in Bankruptcy Court that the sale of the hospitals “is not reviewable by the attorney general.” “Losing Saint Louise Hospital simply was not an option for me and for the 100,000 Gilroy and Morgan Hill residents who would have lost their local hospital,” said Supervisor Mike Wasserman, whose district includes Gilroy and Morgan Hill. “I am grateful to the many people who joined our fight.” “This is all about the thousands of patients who need our services, 451 hospital beds and 1,700 highly trained and dedicated nurses, doctors and other healthcare industry workers who provide those services,” said Supervisor Cindy Chavez in a statement. “We are very pleased that the district court denied the stay, allowing the county’s purchase of the hospitals to go forward,” said Williams. “The county has and will continue to serve as a model for local governments nationwide in protecting the health and well-being of our residents.” Smith predicted that after the county takes legal possession of the two hospitals on March 1, the transition process will be “seamless” as far as patients are concerned, wth most of the doctors and staff at the two hospitals staying at their current jobs. There is one more bump in the road for the county—a possible strike by Saint Louise and O’Connor nurses. The California Nurses Association, which represented nurses at

O’Connor and Saint Louise under contracts voided by the Bankruptcy Court, has asked the state Public Employment Relations Board to intervene on the nurses’ behalf. The nurses union is a rival of the Registered Nurses Professional Association, which represents nurses at the flagship of the expanded county healthcare system, Santa Clara Valley Medical Center. The new county-employee nurses will be covered by the RNPA contract beginning March 1. CNA members told the county Board of Supervisors last week they would strike at O’Connor and Saint Louise if the county didn’t recognize their union and begin negotiations on a new nurses contract for the two hospitals. The CNA has asked the state Public Employee Relations Board to seek an injunction in state court next week to force the county to the bargaining table. The county said to do so would violate state law, the RNPA contract and the county’s own personnel rules. “We asked the PERB to seek an injunction to ensure the county bargains in good faith with the Saint Louise and O’Connor nurses through their chosen union, CNA,” said Andrew Prediletto, the regional CNA director. “We want to ensure nurses stay at the hospitals and to preserve the patient care protections that nurses have won over the past two decades.” Felix de la Torre, general counsel for PERB, said he will make his recommendation on the CNA request to the board by March 1, but said he could not say when or if the quasi-judicial board would make a decision.

They're telling him to take his hand out from underneath him, but then the other officer is hitting him with his baton. I don't know but if you ask me, if someone's hitting me, I'm going to crunch up to protect myself. Where's everybody else's body cams? Why did they only use one officer’s? Because that officer’s body cam probably would help them better to get out of this to make them look good. And then you have more than one officer putting weight on him as they're telling him to take his hand out from underneath him. This is just so sad. Stevie was a good guy and he did not deserve this. Should Atty. General police the police?

I

n his two years on the job, California Attorney General Xavier Becerra has crafted an image as a progressive warrior, suing the Trump Administration dozens of times and delivering the Democrats’ Spanish-language rebuttal to the President’s State of the Union speech. But there’s one major area where the Democrat isn’t allied with progressives: accountability for law enforcement. There, Becerra is at odds with the push by many in his own party to better police the police. The attorney general is refusing to provide records on police misconduct that media outlets requested under a new law signed last year by Democratic former Gov. Jerry Brown. The legislator who wrote the law, also a Democrat, says the documents must be disclosed. But Becerra has sided with police who want the courts to weigh in before releasing records about officers who were involved in shootings, sexual assault or lying on the job. The union representing statewide law enforcement officers spent $226,000 to help Becerra win election last year. The prison guards union put $320,000 into a campaign that supported a bipartisan mix of politicians, including Becerra. And Becerra’s own campaign received more than $75,000 from law enforcement unions up and down the state. Numerous police unions have filed lawsuits in recent weeks to try to block their departments from releasing misconduct records under the new law, Senate Bill 1421, which took effect on Jan. 1. The officers argue that the law only applies to records created on or after Jan. 1, while the legislator who wrote the law says it applies to any records in the police departments’ possession, including those from past years. Courts have offered differing opinions, with judges in Contra Costa and Los Angeles saying the prior records must be disclosed and a Ventura County judge blocking their release. A broad coalition of media outlets have

been requesting misconduct records from law enforcement agencies big and small since the new law took effect at the start of the year. Becerra refused to disclose any misconduct records regarding officers employed by the state Department of Justice. Then the free-speech non-profit, the First Amendment Coalition, sued him, arguing that his refusal has had a ripple effect, giving “a green light to other departments to disregard the new law.” Becerra said he’s waiting until courts clarify what now stand as conflicting opinions. “I’d rather make sure I do this right because there are lots of people whose privacy is at stake.” Five days later, he submitted a legal brief in an unrelated lawsuit saying he thinks the disclosure law does apply to records created before Jan. 1, but that he’s withholding them until courts resolve the question. Becerra is not the first California Attorney General to side with police on accountability issues—or to take heat for it from the left. Democratic presidential candidate and U.S. Sen. Kamala Harris, for instance, refused as attorney general to support statewide standards for police body cameras, endorsing instead the law enforcement argument that such rules should be determined at the local level, even if the result was a patchwork. She also opposed a bill to put the state Department of Justice in charge of investigating police shootings. Becerra has held a similar position on more recent versions of the bill, marking another instance in which he sided with law enforcement against efforts toward greater transparency. Progressive advocates for criminal justice reform argue that the state Department of Justice could be more objective than local prosecutors in determining if shootings are justified, because local prosecutors work so closely with police.

When you hear someone begging for a “peace officer,” you would think he or she is trained correctly to identify different things, such as if drugs or alcohol are involved; how to deal with someone, like when Stevie says, "You've hit me real hard, please stop." Family continues to mourn CITY COUNCIL ADDRESSES JUAREZ FAMILY FOR FIRST TIME IN A YEAR Michael Moore Reporter

From there, the group traveled up Sixth Street to City Hall to address city council members at their scheduled meeting. Some of the demonstrators held handmade signs protesting the Gilroy Police Department, and police misconduct in general. Monica Juarez was among those who spoke to the council at the meeting. For the first time in a year, council members addressed Juarez’s death and offered their condolences to his family and friends. “He did not deserve to die the way he did, by what

Steven Juarez’s family and friends gathered at the scene of his death Feb. 25 to remember the Gilroy native who died one year ago while in police custody. The attendees reiterated their intent to hold Gilroy police accountable for Juarez’s death, just a couple days after the Santa Clara County district attorney announced his office had completed an investigation that exonerated the officers involved in Juarez’s arrest. About 20 people gathered at a makeshift memorial for Juarez in front of a home at 7461 Chestnut St. The front yard of the home is seen in a police body camera video released Feb. 22 by the DA. The

video shows Juarez pinned to the ground with several officers on top of him as they try to gain control of his arms so they can handcuff him. The footage is from the night of Juarez’s death, Feb. 25, 2018. At the memorial event, friends and family members said prayers and spoke about the need to continue their activism in order to hold police accountable. Stephanie Sambrano, Juarez’s cousin, said they need to keep pressure on public officials and police agencies in order to prevent future officerinvolved deaths. “It could happen to anybody,” Sambrano said. “It’s happening all over the world.” Sally Armendariz, a local activist and relative of Juarez’s, condemned the DA’s office for failing to notify Juarez’s family before releasing the report of their investigation and body camera footage. She said Juarez’s mother found

that the DA’s investigation is complete, the police department and city staff will review previous requests for public records related to the arrest and inquiry. Until now, the police department has said it cannot release the records because the investigation was still underway. Mayor Roland Velasco

Arrest followed neighborhood chase ➝ Juarez, 1

a man fitting Juarez’s description was lurking on her property, the DA’s report says. Gilroy police officers arrived, and Juarez fled as soon as he saw them, according to authorities. Juarez leapt over fences and hid on the roof of a shed and

a nearby house in his efforts to evade police on foot. When Gilroy Police Officer Jason Greathead confronted Juarez, he refused commands to stop running, at which point Greathead used a Taser on him “to little effect.” Other officers tried to handcuff Juarez, who continued to fight with police,

by using a Taser again and other restraint techniques, reads the DA’s report. Finally, Greathead used a carotid artery hold on Juarez, rendering him unconscious. Juarez was pronounced dead on the way to the hospital. A total of seven Gilroy police officers ultimately participated in Juarez’s arrest: Ellsworth,

Greathead, Michael McMahon, Chris Silva, Martin Beltran, Diana Barrett and David Ludden. Two of the officers— Greathead and Ludden— did not turn on their body cameras in time to capture footage of the incident and their response, according to the DA’s Feb. 22 report. Gilroy Police Chief Scot

Smithee this week broke his yearlong silence on the Juarez investigation. “This report concludes a difficult time for all concerned. Any time there is a loss of life, it’s always a tragedy, regardless of circumstances,” Smithee said in a press release. Welch’s report notes that Juarez had a history of confrontation with

Gilroy police, and had a felony warrant out for his arrest at the time of his death. He had “violently resisted arrest numerous times” before the night he died. In one past incident, Juarez dragged a police K9 who was biting him, breaking the dog’s tooth. ➝ Juarez, 10

Council moves to line up with new law JUAREZ FAMILY PLEADS FOR TRANSPARENCY Jaqueline McCool Reporter

A vote by the city council on the deletion of a few lines of city code this week became a new aspect of the Steven Juarez case. The vote had no direct connection to the case, but the council action had the effect of blocking release of all past internal police records, at least temporarily, while a new state law is argued in the courts. Exactly one year after Juarez died while in police custody, his family, friends and community members gathered at City Council chambers for the council

meeting on Feb. 25. The council voted 6-1 to delete a portion of the Gilroy City Code in order to comply with the new Senate Bill 1421, which went into effect Jan. 1. The action was tagged on the meeting agenda as an “emergency ordinance.” SB 1421 requires police agencies in California to release internal police investigation records related to shootings or use-of-force incidents involving an officer, or an accusation of misconduct or certain types of crimes against an officer. The records newly opened by the law, which amends the state’s Public Records Act, include certain personnel documents and complaints against officers. The application of the law

to older records is currently on hold as it has been challenged by police organizations that are awaiting clarification on the law’s intent from a higher court. Gilroy’s city code, like that of many California cities, previously prohibited the release of local agency peace officer personnel files and records of citizen complaints. The new state law would allow those records to be public, but there are several disputes in court over whether or not that decision applies to records in existence before Jan. 1. California Attorney General Xavier Becerra has argued that the law only applies to cases created after Jan. 1, 2019. Locally, the dispute over whether

or not to adopt the attorney general’s recommendation brought a renewed fight over public transparency, particularly when it came to the Juarez case. City Attorney Andy Faber told the council that with preliminary rulings going in both directions, allowing the records to be accessed retroactively— before a definitive court ruling—could open the city to litigation. The council’s Feb. 25 action prohibits the city from releasing police personnel records in existence before Jan. 1, at least until the courts clarify the meaning of SB 1421. First Amendment and civil liberties advocates have argued that the state law does apply retroactively,

The DA’s office also noted that on the night of Feb. 25, 2018, Greathead recognized Juarez from previous police contact and feared he was trying to pull a hidden weapon from his clothing. Police later found a knife in his back pocket and possible burglary tools in his jacket, according to the DA’s office. Gilroy police previously reported that Juarez also had methamphetamine on him at the time of his death. Juarez is survived by five sons. His family in August 2018 filed a claim for damages with the City of Gilroy in relation to Juarez’s death. The claim, which the city denied, alleged that officers unlawfully detained Juarez and used excessive force during his arrest. Family members have said that Juarez was wellknown and generally liked in the Chestnut Street neighborhood, and have questioned whether he was really causing a disturbance before police were called the night he died. The DA’s office investigates all fatal law enforcement encounters in Santa Clara County to determine if the force was legal. Officers are legally allowed to use a variety of “reasonable” use of force techniques when arresting a suspect who is resisting, the DA’s report noted. Greathead, the officer who applied the carotid hold on Juarez, had been previously trained to use the technique, according to the DA’s office. A three-minute clip from Ellsworth’s body camera video released with the DA’s report was the clearest of all the responding officers’ footage, Welch said. He reviewed all

the involved officers’ body cameras of the incident as part of his investigation. Due to the nighttime darkness, other footage was not clear enough to provide a distinct picture of what happened, Welch said. The graphic, profanityladen video shows numerous officers surrounding and on top of Juarez—a 160-pound man—in front of a home on Chestnut Street at the end of the foot pursuit. The officers were unable to pull Juarez’s arm out from under his body, and repeatedly tell him to stop resisting and reveal his hands. The DA’s report described Juarez as exhibiting extraordinary strength and seemingly “oblivious to any kind of pain” due to his level of meth intoxication. The clicking sound of a Taser can be heard several times during the video. An officer can be seen hitting Juarez with the butt end of a baton more than a halfdozen times. “I’m going to hit you again if you don’t stop (expletive) moving,” yells one officer. “You’re going to get Tased again,” exclaims another. Juarez can be heard screaming profanities at the officers while they attempt to handcuff him. At one point Juarez yelled, “Please help me!” Toward the end of the video, an officer announced he was going to apply a carotid hold. About the same moment, Juarez went silent. Officers then applied handcuffs to him. Juarez had been tased six times by multiple officers before Greathead applied the carotid hold, according to the DA’s report. The end of the footage shows

Juarez unconscious and handcuffed as the officers propped him up into a “recovery position.” One of the officers said Juarez was still breathing as they propped him up. Seen briefly in the video is a puddle of blood where Juarez had been prone on the ground. Welch wrote in his report, “Juarez’s behavior demonstrated a determination to resist and flee the police at any cost. There is no evidence that any officer intended to cause Juarez’s death, and there is no evidence that any officer acted with ‘conscious disregard for human life.’…The officers’ actions as captured on their body cameras and described for investigators were entirely focused on securing control of Juarez, whom the officers feared was holding a weapon under his body.” Juarez’s cousin, Gilroy resident and activist Rebeca Armendariz, said of the Feb. 22 report, “Of course it’s not shocking. I’m not surprised the district attorney wouldn’t find anything; they never do. Their own brethren are never guilty of anything.” The DA’s report includes a detailed legal analysis of the officers’ actions, reasoning that none would likely be found guilty of a crime under the circumstances. Internally, none of the officers involved in the Juarez incident have yet been disciplined by Gilroy Police leadership. “W e are still conducting an administrative investigation of the incident,” Gilroy Police Sgt. Jason Smith said. “These types of investigations can take an extended amount of time to complete.”

Many speakers said the council’s decision was evidence the city was hiding aspects of Juarez’s death. Juarez’s sister Monica Juarez addressed the council about her hope that police documents surrounding the case would offer answers to her brother’s death. She said there are “so many pieces to the puzzle missing.” Council members offered some of their first comments in the year since Juarez’s death. Mayor Roland

Velasco said it was “unfortunate” SB-1421 was passed with as much ambiguity as it was. “All the City of Gilroy is doing right now is following what the California attorney general is recommending.” The council passed the resolution in a 6-1 vote, with council member Fred Tovar voting against the ordinance. City Manager Gabe Gonzalez said that public record requests regarding the Juarez case would be answered now that a decision had been made by the council about SB-1421. The Dispatch has filed numerous public records requests in relation to the Juarez case, which have thus far been delayed by the ongoing nature of the DA’s and police department’s investigation.

MEDICAL EXAMINER’S REPORT Steven Juarez’s body was covered with injuries following the Feb. 25, 2018 struggle with Gilroy police officers that ended in his death at the age of 42, according to the Santa Clara County District Attorney’s Office report on its yearlong investigation into the incident. Two pages of the 43-page report are titled “Medical Examiner’s Report,” and list Juarez’s injuries, vital statistics and other results of his autopsy and toxicology tests. Michelle Jorden, a forensic pathologist at the Santa Clara County Medical Examiner’s Office, conducted the autopsy. Jorden also reviewed portions of the involved officers’ body camera recordings of the Juarez incident. Here are highlights of her report: Juarez’s body showed numerous signs of “external evidence of injury/ electroshock weapon deployment.” These injuries include a white metallic barb in his neck area, several oval pink burns and bruises on his abdomen, both knees, left thigh and upper back, the medical examiner’s report says. Juarez was 5 feet, 7 inches tall and weighed 160 pounds at the time of his death, according to the medical examiner. The report also listed more than two dozen cuts, bruises and abrasions indicating “external evidence of blunt force injury” on Juarez’s body. These injuries appeared on Juarez’s face, head, arms, knees, legs, hands, shoulders, elbows and other areas. Jorden also noted “superficial and deep muscular hemorrhage” injuries on Juarez’s left shoulder, left elbow, upper back, rib cage and right thigh. Juarez’s body also exhibited “additional pathological diagnoses,” including a thickened left ventricle of the heart and focal coronary atherosclerosis or hardening of the arteries. Medical records from Jan. 25, 2017 showed a prior application of a Taser and an attack by a police dog during a previous altercation with Gilroy officers. Jorden’s toxicology report also found Juarez’s blood results showed methamphetamine in his system at a concentration of 960 nanograms per milliliter (ng/mL). “The forensic toxicologist indicated that blood levels of 200-600 ng/mL have been reported in methamphetamine abusers who exhibited violent and irrational behaviors,” the DA’s report says. His blood also tested positive for THC, the main psychoactive chemical found in marijuana. Jorden cited Juarez’s cause of death as “methamphetamine intoxication complicating profound physical exertion and police restraint to include carotid sleeper hold,” reads the DA’s report. “Hypertensive and artherosclerotic cardiovascular disease are considered significant conditions contributing to death.” The manner of death—such as homicide or natural causes—is undetermined in the medical examiner’s report. The DA’s report also includes details of Juarez’s criminal history. The report lists more than a dozen cases since 1994 in which Juarez was convicted of about 20 misdemeanor and felony offenses. His latest case was in Gilroy in 2017, when he was convicted of vehicle code violations, evading a peace officer and hit and run, the DA’s report says.

This is the golden era for the Christopher High girls soccer team. Two years ago, the Cougars showed plenty of promise and finished with a winning record. Last season, Christopher set program records by winning an A-league championship and advancing to the quarterfinals of the Central Coast Section playoffs. So what could the Cougars do for an encore? How about making further history by reaching a section final? That’s exactly what No. 3 seed Christopher did after knocking off No. 7 seed Aptos in a penalty kick shootout on Feb. 21— the Cougars dropped a 1-0 game to Menlo School in the title contest—in a home match that had all the drama and back-andforth action would one expect from a postseason semifinal

For as long as she can remember, Alessandra Echauri has had a goal to play college soccer. The Christopher High senior realized a dream when she recently signed her letter of intent to play at University of the Redlands. “Whether it was D-1, D-2, or D-3, I knew I wanted to follow through and play soccer beyond high school,” Echauri said. “I’ve always had the dream to continue my soccer career at the collegiate level.” Echauri, who had a signing ceremony at Christopher High two weeks ago, expressed tremendous anticipation in the day leading up to the event. “I can’t believe it’s happening,” she said. “It’s crazy and unbelievable. Ultimately, I’m happy all my hard work over the past years have paid off. It’s kind of exciting to look back where I was and what I wanted and now to see it’s accomplished. It was a very long, stressful process, and right now my shoulders are totally relieved.” A center midfielder in high school but someone who has played every position in her career except goalkeeper, Echauri possesses speed and sees the field well. Echauri has a strong motor and work ethic, winning 50-50 balls and communicating with her teammates, whether it’s playing for Christopher or her club team. Redlands coach Suzette Soboti first noticed Echauri at a club tournament in Las Vegas two years ago. Even though Redlands showed interest, it took Echauri a while longer to reciprocate. The summer before her junior

year, Echauri knew she had to be proactive in the recruiting process, and from there reached out to the Redlands before attending one of their soccer camps. The Redlands offered a package last August, and after several exchanges Echauri decided to play for the Division III program located 65 miles east of Los Angeles. High school athletes who have a goal to play in college can learn lessons from Echauri, who contacted several college coaches first to get the recruiting process started. Like any prospective college freshmen, Echauri will enter school with a bit of trepidation. “I’m scared just for college in general,” she said. “Scared to move on and be independent, but at the same time I have an independent soul and seek change.” Although Echauri was proactive in the recruiting process, she credited her previous time playing for Santa Clara Sporting as key in getting her exposure to play in front of college coaches. “They got to see me and it allowed them to see my ability to play on the field and how I worked with others,” she said.

After the teams played 100 minutes of scoreless soccer—80 minutes of regulation and 20 minutes of overtime— Christopher prevailed in PKs, 3-2, to clinch a spot in the championship game against Menlo School of Atherton. “It’s unbelievable. Since my time here this is the most complete team we’ve had,” Cougars coach Matt Oetinger said. “It sounds pretty simplistic, but that’s the trick. It’s not a superstar with a supporting cast; it’s everyone pulling the rope.” The Christopher players and coaches had a delayed celebration as the referee took a while to make sure the Cougars had indeed clinched things after goalkeeper Jordan Anaya stuffed an Aptos’ fifth PK attempt. Aptos was already trailing 3-2 at that point and went first, so it needed to make it, which would’ve forced Christopher to connect on its fifth PK attempt to win it outright. However, the shootout session

never went the distance because of Anaya’s brilliant play between the pipes. After the Mariners opened the shootout with a miss, Christopher went ahead when Aurea Martin drilled a shot to the back of the net. Aptos converted its second PK, and the Aptos goalkeeper blocked Christopher’s next attempt. Anaya answered with a resounding stuff save of her own, and Hanna Crawford converted her PK to give the Cougars a 2-1 lead in the shootout. Aptos made its forth attempt, but Christopher’s Jenna Urrabazo made her shot to put the pressure squarely on Aptos, which needed to make its fifth attempt to stay alive. It wasn’t meant to be. Anaya moved to her left, went to the ground and easily corralled the ball to seal the outcome. “(My mindset going into PKs) was mostly about anticipating,” said Anaya, the seasoned sophomore goalkeeper. “You have to mostly guess where they’re going to go and be ready to move to either side. It’s super exciting

and I’m proud of this team for getting this far. It’s taken hours and hours of practice and team bonding bringing us all together. All of the pasta dinners and watching game film help us play well together.” Save for the first three minutes of the contest, when Martin had two near-misses, Christopher was playing catch-up with Aptos, which dominated the possession in the opening half. However, the Cougars found their rhythm in the second half and into the overtime periods. “We just talked to the girls (at halftime) and said this was it,” Oetinger said. “That regardless of what happened, for the seniors it was their last half on this field ever, and everybody on the team had to sell out and give everything they had. As all teams are at this time of the year, we’ve got girls dinged up, nicked and hurt and strained. And yet they’re sacrificing for the team—I couldn’t ask for anything more.”

Never giving up

Despite the loss, it was these two young players—along with the entire roster—who never let up while on the court. Jordan, who is relatively new to the team, was thrust into the captain’s role because of his age and ability on the court, and is still trying to come to grips with his leadership on the court. “Being a leader is definitely not natural for me,” he said. “I’ve had to work on that a lot, just getting able to coach from the game. I notice things on the court and I try to call them out to my peers.” Martin, who scored a team-high 22 points, believes that coming from a small school has actually helped his game improve over the last year. “We absolutely have a lot more confidence because we’re coming from a much smaller school than any of our opponents,” he said. Lampkin understands that the size of his school limits the players on his team, but he makes sure that what the team may lack in depth, it makes up for in hard work. When asked about what the secret was to getting the most out of his players, he said, “Leaving it all out on the court and treating every game like it’s

For the Pacific Point boys basketball team, its Central Coast Section playoff matchup with Oakwood on Feb. 15 was more than just another game—it was about the players competing for something greater than the names on the back of their jerseys. They were playing for a friend who never got the chance to represent his school’s colors on the court, but had an unrivaled effect on the team this season. In July 2017, Josiah Duayo, one of the team’s top prospects and the son of the team’s strength and conditioning coach, was killed in a car accident just before the school year. His memory and legacy would end up inspiring a team, his friends and his school all season long, For someone like Artavious Martin, getting to play in the CCS tournament was all the more meaningful because of what could’ve been. “He would have been here playing for us, so that’s why we wanted to come out and give it everything we’ve got,” Martin said after the team’s 67-41 loss to Oakwood in a Division V playoff opener. “That’s why we’re thankful we were even able to make it to the playoffs and play this game against Oakwood, and we’ll just learn from this.”

The game was an emotional one, with Pacific Point fighting hard for four quarters, but ultimately losing out to a much more experienced Oakwood squad. For Pacific Point coach Joseph Lampkin, the loss to Oakwood was just a minor dent in an otherwise successful season. Pacific Point accomplished this in just its second season as a varsity program, with most of the players who came into the program having never played organized basketball before. “I’m really impressed,” he said. “We started the season off with kind of a silly loss and we just got better and better every game. We fought really hard every time we went out there. We have no seniors on our team, our young guys really had to become men throughout the year, and that was impressive. I’m just super proud of them.” Assuming the entire starting lineup returns next season, Pacific Point could make a major move up the league standings. Lampkin said the team made huge improvement off the court as well. “We had a lot more help (from the parents), hosted a lot of home games and had a Homecoming game,” Lampkin said. “It was a really, really, really good year.”20-7, Lampkin is particularly proud of his team captains—young in age but mature in experience—leading by example on the court. “We have two team captains, Deandre Jordan,

We play a lot of schools that are four times as big as us. The way we go out there and fight like there’s no tomorrow is impressive and essential for us to keep it up.” Perhaps the person in that gym who could best understand what Lampkin was feeling was Oakwood coach Kort Jensen, who helped start the basketball program at Oakwood and was all too familiar with the challenges that coming from a small school pose. “Ten years ago when I got here, we had four kids on the basketball team, we

had to beg a fifth one (to come out and play) and we lost every game that season,” Jensen said. “I had come from coaching high school and college and my wife asked me, ‘Why are you doing this?’” However, things turned around for the Oakwood program through the persistent work of Jensen, resulting in the Hawks becoming a perennial force in the CCS Division V playoffs. When asked about what advice Jensen had for Lampkin, he said, “Be patient. Every year you try to win a few more games,

(but) it just takes a while to change the kids, the culture and the parents.” Indeed, if Pacific Point continues on the trajectory they are on now, with no players graduating and returning standouts in Jordan and Martin, next season could be an opportunity to build on the successes they enjoyed this year. Though they may be small, Pacific Point will always step on the court with just a little more to play for, because for them, playing to win means playing for Josiah — a legacy that will live well beyond this season.

eleste Pierce (Crnkovich), age 62, passed away on February 18, 2019 in Reno, NV after a long battle with metastatic breast cancer.

aurel Ruth (McDill) Gephart entered the Kingdom of Heaven on December 06, 2018 after a courageous battle with colon cancer. Born in Chicago IL on January 24,1945, to Lois (Tatter) and Samuel Rutherford McDill, a Baptist minister. Laurel spent her childhood in the Chicago area. The family moved to Watsonville, California in 1961 where Laurel graduated from Watsonville High School in 1963. In April 1964, Laurel married Bruce D. Gephart of Dolton, IL. They settled in Illinois and raised two children. In 1975 the family moved to Morgan Hill, California. Laurel received a Bachelor’s degree from San Jose State University and later a Masters in Education from Santa Clara University.

Celeste graduated from Bellevue High School (East), in Bellevue, NE in 1975 and attended Regis College (now Regis University) in Denver, CO receiving a B.A. in Political Science in 1979. Although Colorado has its beautiful mountains, it was a warmer climate and the ocean that called to Celeste. She moved to Cupertino, CA in 1980 where she met her future husband and obtained a certificate as a para-legal from Santa Clara University. She began her career as a litigation assistant with several law firms in Silicon Valley. Celeste enjoyed hiking, camping, and boating in California, plus visits to the beach. She also had a warm spot in her heart for stray animals and rescued several dogs and cats that became beloved pets. She was generous with friends and family, alike. And, she made a great sandwich! Celeste and Dennis moved to Morgan Hill, CA in 1999 where Celeste continued her career as an independent legal assistant. In 2016 they moved to Dayton, NV when Celeste joined the State of Nevada, Attorney General’s Office, as a Legal Researcher assigned to the Nevada Department of Transportation. She was preceded in death by her father, George A. Crnkovich, also of Bellevue, NE. Celeste is survived by her husband of 29 years Dennis Pierce of Dayton, NV and mother Dolores Crnkovich of Bellevue, NE, brothers Greg Crnkovich of Jacksonville, FL, Dr. Tim Crnkovich (Sue Ward) of Omaha, NE, Chris Crnkovich (Hilary) of Chicago, IL, and Dr. Frank Crnkovich (Patricia) of Littleton, CO. She will be interred in Bellevue, NE on March 2, 2019 in a private ceremony. Memorials may be sent to your local chapter of the American Society for the Prevention of Cruelty to Animals (ASPCA).

Laurel worked in elementary education in the Morgan Hill, CA school district. She loved shaping young minds and being in the classroom. Laurel taught at El Toro Elementary until she retired in 2013 after almost 30 years in the classroom. Laurel attended Morgan Hill Presbyterian Church for four decades. Laurel was fortunate to have had many opportunities to travel the world on church-related mission and family vacations. Laurel lived in Morgan Hill CA from 1975 to 2017. In 2017, she moved to Williamsport, TN to be closer to her son Stephen and his family. A celebration of her life will be held at Morgan Hill Presbyterian Church 16970 de Witt Ave., Morgan Hill, CA 95037 on Sunday, March 17th, 2019 at 12:00 PM. A reception will be held in the church fellowship hall following the celebration. Laurel is survived by her son Stephen (Nola) Gephart of Franklin, TN and their four children, Garrett, Brett, Trent, and Nola K. Her daughter Laura (Daniel) Libby of Orcutt, CA and their four children, Wesley, Arielle, Destiny, and Michael. Her sister Carol (Robert) Misson and brother Brik (Lynn) McDill. rs. Yukie (Hayashi) Dwan, born on May 14, 1931 in Fukushima, Japan, passed away at age 87 on December 13, 2018 at her home in Gilroy. Yukie was the loving wife of Francis Dwan. Yukie is survived by her husband; daughters, Nancy Dwan and Susan Payne; brother, Yukiharu Hayashi; and sister, Takako Hara. Yukie was a loving, devoted wife and mother whose warm heart, cheerful smile and positive spirit filled her home and charmed those who knew her. Yukie enjoyed sewing, sumi-e, and singing, and took pride in caring for her husband and children. A memorial service will take place at 1:00pm on Saturday, March 2, at the Morgan Hill Buddhist Community Center.
