STRIKE! Nurses stage one-day walkout ST. LOUISE AND O’CONNOR ARE TARGETS OF COMPLAINTS OF UNFAIR ACTIONS BY THE COUNTY Barry Holtzclaw Managing Editor
➝ Nurses strike, 8
Barry Holtzclaw
Tensions between Santa Clara County and a local nurses union hit a flash point this week, when the union led some nurses in a one-day strike at two county hospitals, in San Jose and Gilroy, beginning Tuesday morning, March 12. Picket lines were set up at 7am at O’Connor Hospital in San Jose and St. Louise Regional Hospital in Gilroy, and continued until 7pm. The nurses, who work around the clock, were to return to work at 7am on Wednesday, March 13, the California Nurses Association (CNA) said in a statement.
JOB INTERVIEW Ray Avila of Gilroy speaks with a Performance Food Group representative in Gilroy earlier this month.
Job seekers line up NEW PLANT IS HIRING WORKERS, AND MOVING SOME FROM SANTA CRUZ Barry Holtzclaw Managing Editor
Performance Food Group’s new food processing plant and distribution center in Gilroy may not be in operation yet, but that hasn’t stopped the company from reaching out to Gilroy, Morgan Hill and Hollister and beyond to find new workers for its expanded Central Coast operation. Performance, one of the nation’s largest prepared food distribution companies, hosted a daylong hiring fair on March
7, 10am to 7pm at the Hilton Garden Inn on Monterey Road, just north of the new plant. Performance said it would be hiring managers, customer service representatives, warehouse staff and drivers. When the doors opened at the hiring event, nearly 50 prospects were already in line. The interviews would continue all day. “I said, I think I’ll give a whirl,” said Ray Avila, 67 of Gilroy. “I’ve been in the distribution business for 22 years. Hopefully, they can find me something within this company.” Michael Sanchez grew up in Gilroy, where he worked as a stock boy before moving to Morgan Hill as a young man. “I just retired four years ago, and
want to get back to work. ‘My wife worked in food distribution in both Morgan Hill and Gilroy,” he said. Laura Blacklock lives in Hollister and works in Gilroy. “It’s very exciting,” she said of Performance Food Group’s relocation to Gilroy. “I have been watching the building go up every day when I drive by.” She said she was hopeful there might part-time office positions available. Completion of the new plant could mean nearly 60 new jobs in Gilroy, as the company expects to retain 70 percent of the current 190-person workforce in Santa Cruz. Performance Food Group is closing down the Santa Cruz plant
to open the new operation in Gilroy. A company spokesman declined to say when the new facility would open for business. The new site sits on 30 acres of land at 5480 Monterey Road, south of the Garlic Farm Travel Center. The company has the option to add 151,000 square feet to the 195,000-square-foot facility. Richmond, Va.-based Performance Food Group specializes in supplying restaurants and distributes a broad array of food and foodrelated products such as baked goods, meats, poultry, condiments and even cleaning supplies. Revitalizing downtown Gilroy along Monterey Street was a plank in every council candidate’s platform in 2018.
While progress in attracting new businesses to vacant buildings that line Monterey Street has been slow, the council this month took another step it believes will make downtown a more business-friendly and vibrant economic center. Over the last few years new businesses have begun to pop up between Fourth and Eighth streets. Mayor Roland Velasco heralded the progress of the downtown during his State of the
City address. He said new businesses allowed to use groundfloor offices on Monterey Street, along with mixed-use apartment projects like the Cannery, are turning the downtown into the city’s epicenter. New businesses and new construction can bring potential problems. With mixed-use buildings in the works in the area around Monterey Street, council members say they hope to quell any discord between developers

and nearby residents before it gets out of hand. The council unanimously approved an ordinance March 4 that sets new guidelines for downtown businesses and gives mandatory deed notices to those buying property in the area. Evelia Rosso is Woman of the Year FURNITURE STORE OWNER OFFERS COMMITMENT TO FAMILY AND COMMUNITY Jaqueline McCool Reporter
Jaqueline McCool
Sitting in the office of Rosso’s Furniture, Evelia Morales Rosso is surrounded by photos of her family and friends, a poster from her famous ad campaign wear she dons boxing gloves promising to “beat out” competitors and a campaign sign for newly elected Assemblymember, Robert Rivas. Rivas recently named Rosso the 30th district’s 2019 “Woman of the Year,” stating in a press release, “Evelia’s dedication to improving the lives of others is an inspiration to me and many other local leaders. Her commitment to putting our community first should serve as an example to us all.” On March 4, Rosso, her husband Jaime, her sister and their 94-year-old mother traveled to the state capital to watch Rosso receive the award. Talking about the honor in her Gilroy office full of memorabilia, Rosso’s eyes well up with tears. Her 30 years as an educator in South County and her work as a businesswoman and philanthropist may have been what got Rosso recognized, but her charitable passions date back decades. The Rossos own two furniture
stores—one in Gilroy on Monterey Street and one in Morgan Hill on Tennant Avenue. The daughter of immigrants from Miltepec, Oaxaca, Mexico, Rosso came to the United States at seven years old. She says charity and giving back to her community were traits both her parents instilled in her. Despite her family’s financial status, Rosso says her parents and siblings always found a way to give “whatever amount we had.” Jaime Rosso, who recently retired as a longtime member of the Gilroy Unified School DIstrict Board of Trustees, agrees that his wife’s charitable nature comes from her upbringing. He says, “In her family, they really do have a tradition of giving back to the community.” After graduating from San Jose State in 1975, Rosso began her life in South County as a teacher at PA Walsh Elementary in the Morgan Hill Unified School District, at the same time she began work with the American Association of University Women. As Rosso started to think she wanted to slow down and spend more time with her family, she and her husband opened their first Rosso’s store on First Street in Gilroy. They later moved to their current, larger location on Monterey, opening just days after the 1989 earthquake. Rosso’s story has always been one about fighting: for her family, her community and her students.
IN THE FAMILY Evelia Morales Rosso, matriarch of the Rosso family
in the Gilroy store with her ‘Woman of the Year’ plaque.
She advocated for Spanishspeaking students in the classroom during her time as a teacher and currently supports children struggling with learning disabilities through her work with Parents Helping Parents—a passion spurred by her own grandchildren. And then there’s the Rosso’s furniture television commercial, where Evelia Rosso appeared in boxing gloves promising her family’s furniture store was “knocking out the competition.” The commercial, now recreated multiple times since she passed
on the boxing gloves to her daughter, Sarah Rosso Bent, gained Evelia Rosso some local fame. The idea was inspired by Telenovela and also is a symbol of the business she and her husband had built. “This thing about keep going and getting up there,” says Rosso. “It just went with the ongoing theme of the business.” With that, Jaime Rosso says, “She was the face of our business.” His wife says the commercial gave her a connection with South County—she still sees customers on a daily basis
when she’s out and about. Rosso says she has loved getting to know the South County community through the business, her philanthropic work and her teaching, and despite the changes and growth over the years, she believes the region has maintained its integrity. In 2017, Rosso was named “Philanthropist of the Year,” by the Gilroy Latino Family Fund. Jaime Rosso says it was his wife’s work in the community and with the schools that got him to run for Gilroy school board. “My involvement came as a
result of her engagement,” says Rosso. “She helped engage me in what I did... we thrive on each other.” After nearly 44 years of marriage and one successful family business, Evelia Rosso is now taking time to focus on her various philanthropic involvements, her aging in-laws, her mother, her nine grandchildren, and for the first time, herself. Her advice for women: “All of us have the opportunity to give back to our community in any capacity,” says Rosso. “It’s all for our community.”

many members of the community during his speech, including army private Gaven Doyle and Captain Kiser, commander of the Monterey Bay Recruiting Company. The crowd cheered as Velasco announced plans for a yearlong celebration in 2020 for Gilroy’s 150th birthday. Velasco spoke about challenges the city faces, such as lack of downtown parking, public safety funding and state-mandated housing requirements. He promised to address the future problems with new plans and the help of the council. “As long as I am mayor, I am going to continue to do all I can to provide the leadership that this community needs to be successful,” said Velasco. “Our city deserves nothing less.”

Velasco began his speech by talking about the success Gilroy has seen during his tenure. “Our median income is up to nearly $87,000,” said Velasco. “Our unemployment rate is 3 percent as of December. Most economists will tell you this is considered full employment.” He focused on improvements within the last few year to infrastructure, economic development and city transparency. Velasco cited the First Street sewer and repaving project, the reduction in unreinforced masonry building downtown from 40 in 2012 to five as of last month, and the city’s use of online community engagement as points of success during his last two years as mayor. “Ladies and gentlemen, we are moving up and to the right!,” Velasco said to the crowd. The mayor called out

to create the new rules. The ordinance amended the city’s zoning ordinance to add sections specifically related to Gilroy residents and downtown businesses. Tenants and property owners will be notified that they are within the Downtown Specific Plan and in the vicinity of late-night restaurants and entertainment venues and so may have to deal with issues such as lights, music and special events. The ordinance also attempts to foster a “good neighbor policy” and “dispute resolutions” to problems downtown residents may have with the neighboring businesses. Rachelle Bedell, the city’s community engagement officer, told the Dispatch, “The plan is fairly simple: ask operators to pass along a notification that downtown might be loud.” She said
the new ordinance made minor changes to the existing code, but that it would promote transparency between the city, businesses and residents. “The Community Development Department will require new residential developers in the downtown to provide future residential tenants with the same notice that is written within the ordinance,” Bedell said in an email. “Notices will also be recorded along with each new property deed so every resident going forward will be made aware.” Gary Walton, president of the Gilroy Downtown Business Association and local business and property owner, said the ordinance doesn’t go far enough in setting specific guidelines for how to deal with potential conflicts faced by property owners. Walton, who owns several downtown properties, also told the council at the meeting that he would have liked to see
a specific plan for dealing with renters and conflicts in the downtown area. “I think we’re gonna save ourselves a lot of headaches by trying to do this right,” Walton said. Ultimately, council members did not feel they would be able to impose a specific conflict resolution plan, with Mayor Roland Velasco saying the ordinance may be “as good as it gets.” Trevin Barber, senior management analyst for the city, told the council that when surveying the community for input, the residents near the downtown were overwhelmingly supportive of something being done to set expectations and manage relations between the business and residential sectors. “They’re way more interested in the practical,” Barber told the council, “but they were supportive in general.”
The ordinance also attempts to foster a ‘good neighbor Policy’ and ‘dispute resolutions’ to business and neighborhood disputes.

OPINION GUEST VIEW SEN. BILL MONNING
Music in schools The great American composer Leonard Bernstein once said, “Music can name the unnameable, and communicate the unknowable.” This concept, that exposure to music provides intrinsic value outside of just entertainment, is why schools have long made music education a central part of educating the whole child. While language arts, civics and STEM education are critical in successfully preparing students for a college or career pathway, music education stands as an equally important and influential component of modern pedagogy. Visual and performing arts provide students with opportunities to explore their creativity, improvisation and self-expression—all significant lessons that cannot be extracted from a textbook. Research on the impacts of a music-rich education have continually shown positive developmental benefits for students, such as improved test scores, emotional growth, increased coordination, memorization, pattern recognition, discipline and neurological development.
GUEST OPINION DAVID SNYDER
The AG’s double standard
C
alifornia Attorney General Xavier Becerra appears to believe there are two sets of rules about government transparency—one for his office and another for everyone else. Back in 2017, when the Environmental Protection Agency (EPA) refused to disclose public records about EPA Administrator Scott Pruitt’s potential ethical conflicts, Becerra promptly sued under the federal Freedom of Information Act, coming down hard on Pruitt. “The EPA is legally required to respond to our FOIA request,” Becerra said in a statement released by his press office. “Administrator Pruitt and the Trump Administration are not above the law.” But when his own state’s legislature passed a bill requiring police misconduct records to be released to the public under the California Public Records Act (CPRA), Becerra refused to comply. In response to the First Amendment Coalition’s CPRA request for records under the new, landmark Senate Bill 1421, Becerra’s office refused to release anything. Instead, the attorney general claimed that because a few trial courts around the state are in the midst of deciding whether certain records must be disclosed under SB 1421, “the public interest” requires his office to refuse to disclose the records until the legal question is resolved. This is nonsense. Under SB 1421, which went into effect on Jan. 1, all state and local agencies are required to disclose files that have been confidential for decades, including those involving police shootings and accusations of serious police misconduct. While a handful of police unions across the state have rushed to court claiming SB 1421 should only apply to files created after Jan 1— none before that date—this argument lacks any serious legal merit. Despite what the unions claim, it’s clear that when the Legislature passed this bill, it never envisioned it being limited only to documents created in the future. The attorney general, of all people, has an obligation to comply with the law—or at least
to say why he believes the law doesn’t require that he disclose the records the coalition requested. Becerra has done neither. A government agency, in particular the attorney general’s office, doesn’t get to evade the law simply because compliance raises thorny legal or political questions. When fighting for truth, justice and government transparency serve Becerra’s political interests, Becerra is at the vanguard. But when these lofty principles require the attorney general to do more than lob legal bombs at Trump, things get complicated. If any doubt remained about Becerra’s allegiances, he threatened legal action against journalists for the unquestionably lawful act of simply receiving government records obtained under the CPRA. Reporters from UC Berkeley’s Investigative Reporting Program used the CPRA to obtain a list of police officers who were convicted of crimes. The reporters received that list from the Commission on Peace Officer Standards and Training. Then those reporters got a letter from Becerra that threatened: “You are hereby on notice that the unauthorized receipt or possession of [the list of convicted officers] is a misdemeanor.” While Penal Code section 11143 does make it a crime for many people to possess the list at issue, it specifically exempts journalists. There was no reason for the AG to cite that law except to strike unjustified fear into the hearts of law-abiding journalists. As in the case of SB 1421, the AG’s office disregarded clear law in order to protect police officers at the expense of government transparency and accountability. It’s an old story for anyone who follows politics. Virtually all politicians favor transparency when their opponents are in the glare of public scrutiny, but when sunlight turns to them, they scurry into the shadows. One might have thought, given his work on the national stage, that Becerra would be different. His actions over the past month strongly suggest that’s not the case. David Snyder is executive director of the First Amendment Coalition.

Visual and performing arts provide students with opportunities to explore their creativity, improvisation and selfexpression—all significant lessons that cannot be extracted from a textbook. The month of March offers us the opportunity to acknowledge the unique benefits of music education through the celebration of “Music in our Schools Month.” This important acknowledgement of music education is celebrated each year with the help of the National Association for Music Education, and provides our schools with the opportunity to highlight the need for expanding these vital programs. Gov. Gavin Newsom’s 2019-20 state budget proposes the largest-ever funding increase for K-14 education in our state’s history. California’s students will receive a record $80.7 billion in funding, dwarfing the recessionary low of $47.3 billion during the 2011-12 fiscal year. This proposed reinvestment in our schools, teachers and students will allow for the expansion of music education opportunities for students across the state. Additionally, California recently overhauled its education finance system through the implementation of the Local Control Funding Formula and the Local Control Accountability Plans, which require school districts to involve parents and community members in the decisions they make about how education funds are spent. I encourage those community members who feel strongly about arts and music education in our schools to reach out to your local education leaders with the message that arts funding should continue to be a priority in all our schools. For information on participating in the Music in Our School’s Month, visit https://nafme.org. Sen. Bill Monning represents the 17th State Senate District, which includes all of San Luis Obispo and Santa Cruz counties, and portions of Monterey and Santa Clara counties.

Nurses stage 1-day strike at St. Louise ➝ Nurses strike, 1
County says strike illegal
County officials said that the CNA’s action constitutes a “wildcat strike” that was illegal and unjustified. The CNA contract with the previous owner of the two smaller hospitals, Verity Health System, was voided by a bankruptcy court judge in late December, and all nurses at the hospitals early this year were offered the chance to keep their jobs in the new county hospital system, under the existing RNPA contract. County Executive Jeff Smith told this newspaper on March 11 that the county would take no disciplinary action against the nurses who didn’t show up for
work Tuesday, “unless they specifically interfere with patient care, commit crimes or threaten employees.” On March 4, the same day the CNA had cheered its success in convincing the state Public Employee Relations Board to file an unfair-labor-practices complaint on their behalf against Santa Clara County, the unions were incensed by a March 7 memo to nurses from Smith warning them a strike could result in disciplinary actions against participating nurses. Smith said the memo merely restated existing county employment policies. The implied threat, according to the CNA, prompted it to file a new complaint with the board on March 8, when the strike action also was announced. “Santa Clara County violated state law when it threatened to retaliate against registered nurses at O’Connor Hospital in San Jose and St. Louise Regional Hospital in Gilroy for exercising their fundamental labor rights,” the union said in a statement March 11. “The new charges were filed after the county illegally threatened hundreds of nurses with termination in a memo from County Executive Jeff Smith intended to intimidate and coerce nurses, in violation of state labor law,” the CNA charged.
Smith warned employees
In a May 7 memo, Smith warned nurses of “serious possible consequences
Robert Eliason
Nurses at the two hospitals had voted in early February to authorize a strike, and union leaders told county supervisors Feb. 12 to expect a nurses strike if the county didn’t immediately begin negotiations on a labor contract with CNA. The union said at the time that 90 percent voted in favor of a strike, but declined to say how many nurses voted. The union did not say how many nurses participated in the March 12 job action. The Registered Nurses Professional Association, which represents more than 2,800 county nurses, said CNA has no legal standing. “Every employee has the right to strike,” the RNPA said in a statement released March 12. “This strike has not been authorized by the bargaining representative for the registered nurses employed by Santa Clara County, RNPA. “In a last-ditch effort to maintain a hold on the registered nurses at the former Verity facilities, CNA is calling for a strike,” the RNPA statement read. RNPA has a labor contract with the county until October 2019. Noon rallies were scheduled Tuesday at each hospital, to be followed by a 1pm rally at the Santa Clara County Government Center—the same location where union leaders had joined with county government leaders in a Jan. 29 rally demanding that Attorney General Xavier Becerra drop his bid to block sale of the two
hospitals to the county. The CNA is demanding that the county designate it and not the RNPA as the sole collective bargaining agent for the 482 nurses at O’Connor Hospital in San Jose and the 200 nurses at St. Louise Regional Hospital in Gilroy. The RNPA represents 2,150 nurses at the Santa Clara Valley Medical Center and its clinics. “RNPA has been fighting for the nurses at the former Verity facilities,” the RNPA said in a March 12 statement. “We have secured strong agreements protecting their pay, vacation requests and shift assignments. The details of these agreements have been sent to members.” The county’s acquisition of the two hospitals from bankruptcy court was finalized just 10 days ago.

that employees may face if they fail to report to work.” He also told employees in the memo that “there may be consequences for individuals who decline to report to work as scheduled on March 12 or March 13, which could include possible termination of employment or release of employment from their provisional position depending on the circumstances.” “We will not be bullied into standing down and letting the county violate our legal right to stand up for ourselves and our patients,” said Lianne Pounders, an intensive care unit registered nurse at O’Connor Hospital. “We are determined to exercise our legal right to strike, as the county refuses to recognize our democratically elected union.” “We will not be monitoring participation in the action, only filling vacancies,” Smith said
in a statement March 11 after the union’s strike announcement. He added: “We have contracts with temporary agencies who will provide nurses to cover any vacancies.” Smith disputed the union’s contention that the county’s memo to nurses constituted any kind of a threat. “The county has provided updates over the past few days to employees to address their questions about the work action,” he said. “We are encouraging employees to contact their union representatives if they are seeking additional guidance on union representation.” PERB said the key questions in the dispute are: Do the county’s local employer-employee rule apply? If so, how? On what legal basis should PERB decide whether county can lawfully add O’Connor and St. Louise Hospital employees
to pre-existing bargaining units? If so, how? The union’s request for an injunction “remains pending before the board, without prejudice to any party’s ability to provide the board with further information.” Smith also released a statement to all media in which he said: “Our primary focus since the acquisition closed on March 1 has been integrating O'Connor Hospital, St. Louise Regional Hospital and the De Paul Health Center into the county's health system, with the highest priority being patient care, increasing healthcare access, and delivering highquality medical services to all members of our community. Charter schools are wary of new laws LEGISLATURE FAVORS STRONGER OVERSIGHT Scott Forstner Reporter
charter schools abide by the same Brown Act openingmeeting law as traditional public school districts, and require public elections of its school board members, who are now appointed. The Senate bill also requires conflict-of-interest disclosures by charter school board members. The charter school in Gilroy, Gilroy Prep, has 540 students enrolled in grades K-5. “As an integral part of the local public school community, Navigator believes in and practices transparency at our board meetings,” Carr said. “Our meetings have always followed the Brown Act, are open to the public, have our agendas posted online, and all of our board members adhere to our conflict-ofinterest code.”
Barry Holtzclaw
Gov. Gavin Newsom late on Tuesday, March 5 signed into law Senate Bill 126, which ensures that all corporate charter schools are held to the same transparency and accountability standards as neighborhood public schools. During the debate on the Senate bill and several stillpending Assembly measures, charter school advocates were concerned about the impact of the legislative initiatives aimed at their growing industry, which includes non-profit and forprofit schools. Traditional public school
officials and teacher union representatives said they believe that new oversight of charter schools is long overdue and will establish an equal playing field for their districts. “The charter schools industry is concerned with the package of bills that was introduced as they could have a devastating impact on the ability to provide equitable choices and education for all students,” said Kirsten Carr of the nonprofit Navigator Schools, which operates charters in both Gilroy and Hollister. Senate Bill 126, along with Assembly Bills 15051508, could change the landscape of how charter schools have been allowed to operate under the existing charter school law established in 1992 and amended in 1998. The new law will make
Mustard beckons spring As sure as Acacia blooms in the forests and crapapple trees flower in suburban backyards, the explosion of yellow mustard on California farms, shown here off Highway 25, is a sure sign of the coming spring equinox. Traditionally, the first day of spring
is on March 21, but astronomers say this year’s spring season starts one day earlier, March 20, at 2:58pm in Pacific Daily TIme. Next year, the sun sits above the equator and the day and nighttime hours will be nearly equal even earlier in the year, on March 19.

qualify for the nationals. “It’s a lot of fun. It’s great to get them inspired early,” said judge Gene Sakahara, a retired GUSD educator and half of the famed cooking duo known as “Sakabozzo.” “It’s fabulous. The kids are great,” added Sakahara’s partner Sam Bozzo of the young aspiring chefs. “Look at that creativity on the plates.” The same went for the competition’s third judge, Carlos Pineda, chef at Rebekah Children’s Services Culinary Academy and manager of Kneaded Bakery. “The dishes created were outstanding,” said Pineda, who was especially impressed with the amount of fresh, local fruits and vegetables used by the young chefs. Rod Kelley Elementary School fifth-grader Rayen
Garcia and his Quinoa Enchiladas took home second-place honors. He also earned the crown as organic food waste champion for having the least amount of food waste while preparing his dish. Each chef put their food waste in a container that was weighed at the end of the competition. Eliot Elementary School fourth-grader Kevin Carrillo placed third with his “Sincronizada” dish. Other competing student chefs were Glen View Elementary School fifthgrader Sandra Martinez Aguila, who prepared fish tacos; El Roble Elementary School fourth-grader Myra Moniz, who cooked up Myra’s Tasty Cheese Tostadas; Luigi Aprea Elementary School fifth-grader Michael

El Roble Elementary School fourth-grader Julia Finucane’s mother was skeptical of the ingredients her daughter planned to fuse together for her entry in the fifth annual Gilroy Unified School District Future Chefs competition. “She chose her recipe based on the ingredients they were looking for,” said parent Kirsten Finucane. “She does like to cook and experiment in the kitchen.” The student chef trusted her palate and it paid dividends, as her Black Bean
and Sweet Potato Taquitos with avocado won over the three-judge tasting panel March 6 and she was crowned the district’s Future Chefs champion. “I just love being creative (with my cooking),” said Julia, who took home a first-place medal and a prize package from event organizer Sodexo, a food and facilities management company contracted by the district. “I didn’t think I was going to win.” Julia was one of eight finalists—each assisted by a district food service worker—in the Future Chefs competition held at Gilroy High School. Christopher Ranch donates to Gilroy schools PAYMENTS COVER ALL STUDENT LUNCH DEBTS AT LOCAL HIGH SCHOOLS
Staff Report
Ken Christopher, executive vice president of Christopher Ranch, last month presented Gilroy High School principal March Sanchz with a $15,000 check to cover
student account balances for food services. This followed a similar gift, for $5,000 that the local garlic producer gave to Christopher High School. “Regardless of ability to pay, all children deserve good food to nourish their
bodies, hearts and minds as part of our school community,” the district said in a statement. “Thank you, Christopher Ranch, for your unending care of our schools and students. Gilroy is better because of you.” “This one thing that you
can do that has an immediate impact—to clear student lunch debt,” said Christopher in an interview. “In a world where there is even a chance of children going hungry, if there is a chance of that, if we can do a gesture like this, we want to do it.”
He encouraged other business owners and individuals in the community to consider similar donations to other local schools. “There was no red tape; the school district was very helpful,” said Christopher.

NOTICE OF PACIFIC GAS AND ELECTRIC COMPANY’S REQUEST TO INCREASE RATES FOR THE ENERGY RESOURCE RECOVERY ACCOUNT COMPLIANCE APPLICATION (A.19-02-018)
NOTICE OF EVIDENTIARY HEARING FOR PACIFIC GAS AND ELECTRIC COMPANY’S APPLICATION TO FURTHER REDUCE RATES FOR AGRICULTURAL CUSTOMERS (A.18-11-013)
SUMMARY On February 28, 2019, Pacific Gas and Electric Company (PG&E) filed its 2018 Energy Resource Recovery Account (ERRA) Compliance application with the California Public Utilities Commission (CPUC). The purpose of this application is to review costs recorded to the ERRA balancing account from the prior year. The application also includes a request to increase rates to recover $4.69 million in costs related to the seismic (earthquake) studies performed at Diablo Canyon Power Plant. BACKGROUND The ERRA balancing account is used to record fuel and purchased power costs which can be recovered in rates. PG&E recovers these costs with no mark up for return or profit. The purpose of this ERRA Compliance proceeding is to review PG&E’s costs associated with obtaining energy for customers and approve rate increases for other program costs noted above. The CPUC will review PG&E’s costs to ensure compliance with the previously approved forecast and energy purchasing plans. HOW WILL PG&E’S APPLICATION AFFECT ME? Many customers receive bundled electric service from PG&E, meaning they receive electric generation, transmission and distribution services. Based on rates currently in effect, the bill for a typical residential NonCARE customer using 500 kWh per month would increase from $112.08 to $112.13 or 0.04 percent. Actual bill impacts will vary depending on electricity usage. HOW WILL PG&E’S APPLICATION AFFECT CUSTOMERS WHO BUY ELECTRICITY FROM A THIRD PARTY? Direct Access (DA) and Community Choice Aggregation (CCA) customers only receive electric transmission and distribution services from PG&E. These customers will not be impacted by this application. Departing Load customers do not receive electric generation, transmission or distribution services from PG&E. However, they are required to pay certain charges by law or CPUC decision. These customers will not be impacted by this application. HOW DO I FIND OUT MORE ABOUT PG&E’S PROPOSALS? If you have questions about PG&E’s filing, please contact PG&E at 1-800-743-5000. For TTY, call 1-800-652-4712. If you would like a copy of PG&E’s filing and exhibits, please write to PG&E at the address below: Pacific Gas and Electric Company 2018 ERRA Compliance Application (A.19-02-018) P.O. Box 7442 San Francisco, CA 94120 A copy of PG&E’s filing and exhibits is also available for review at the CPUC’s Central Files office by appointment only. For more information, contact aljcentralfilesid@cpuc.ca.gov or 1-415-703-2045. PG&E’s application (without exhibits) is available on the CPUC’s website at www.cpuc.ca.gov. CPUC PROCESS This application will be assigned to an Administrative Law Judge (Judge) who will determine how to receive evidence and other related documents necessary for the CPUC to establish a record upon which to base its decision. SUMMARY This Evidentiary Hearing has been scheduled by the California Public Utilities Commission (CPUC) to review PG&E’s Rate Design Window (RDW) application. The application was originally filed with the CPUC on November 20, 2018, and is focused on agricultural customers. The application’s goal is to reduce the number of customers highly impacted by previously approved rate increases by offering new and modified agricultural rate plan options. This hearing has been scheduled for issues that parties to the proceeding and the Administrative Law Judge (Judge) wish to cover. BACKGROUND In PG&E’s 2017 General Rate Case (GRC) Phase II application, the CPUC approved simplified default and voluntary rate plans for agricultural customers. These rate plans from the 2017 GRC Phase II case are scheduled for implementation by March 2020. If approved, this application would modify rate plans even further to reduce certain bill impacts. The changes included in this application will replace previously approved rate plan changes and customers will be able to choose from modified rate plan options. PG&E will provide online tools to help customers decide which rate plan is best for them. HOW WILL PG&E’S APPLICATION AFFECT ME? This application does not include a request to increase rates overall for the agricultural customer class, however, if approved, the new rate plans will impact bills for agricultural customers as rate design changes are implemented and customers make decisions about their rate plans. The new rate plans will also allow agricultural customers to select a rate plan that works best for them. Bill impacts will vary based on how much energy customers use, when they use it, and which rate plan they select. The new rate plans will reduce the number of highly impacted customers estimated to receive bill increases.1 EVIDENTIARY HEARING At this hearing, the assigned Judge will receive testimonies from PG&E, consumer advocacy groups and other parties to this proceeding. These hearings are open to the public, but only those who are parties to the proceeding may present evidence or testimony and be subject to cross-examination. The hearings and documents submitted during this proceeding will become part of the formal record the Judge will rely upon in writing a proposed decision to present to the Commissioners for their consideration. After considering all proposals and evidence presented during the formal hearing process, the assigned Judge will issue a proposed decision which may adopt, modify or deny PG&E’s proposal. Any of the five CPUC Commissioners may also sponsor an alternate decision. The proposed decision and any alternate decisions, will be discussed and voted upon by the Commissioners at a scheduled CPUC Voting Meeting. Please note: The CPUC’s Courtroom is wheelchair accessible. If you wish to attend and need specialized accommodations, please contact the Public Advisor’s Office (PAO) at least five business days prior to the hearing date. Any changes to the dates, times and locations of the hearings will be posted to the CPUC’s Daily Calendar. TO OBTAIN COPIES If you would like a copy of PG&E’s application filing and exhibits, please write to: PG&E, 2019 RDW Application (A.18-11-013), P.O. Box 7442, San Francisco, CA 94120. MUSTANGS OUT FOR A CCS TITLE REPEAT emanuel lee Sports Editor

Even though the Gilroy High softball team won last year’s Central Coast Section Division I playoff championship, it is acting as if it didn’t. In other words, the Mustangs are bringing the same intensity and work ethic to practice everyday, knowing they won’t be surprising anyone this season. “It’s a thrill teams are shooting for us and out to get us,” said Christina Chavez, Gilroy’s outstanding first baseman and Fresno State University-signee. “We love it. It’s an honor to say we’re CCS Division I champs. We know there is a lot of controversy on who should’ve won that game and we have the attitude that it should’ve been us since we did win it and it’s going to be us that wins it again, hopefully.” Gilroy edged San Benito 4-3 for the championship, the first time the Mustangs had even reached the playoffs in six years. However, it’s more difficult for a high school team to repeat as a section champion, for the simple fact that seniors usually play a heavy role and then are lost to graduation. However, the Mustangs lost only one senior starter—and it was their best player in Makenna Weiler—but everyone else returned, a fortuitous situation that has Gilroy primed to go the distance again. “Makenna was a huge asset to the team, a great captain, leader and leadoff hitter,” Chavez said. “She was all of those things and more. It was a big loss, but we do have people stepping up to the plate to help fill her spot and aura that was there. It’s basically the same team from last year, but we’re only getting stronger and working harder and the coaches are constantly pushing us to be the best. We already have the team chemistry, so we’re focusing on ourselves to grow as individuals for the betterment for the team and to produce for the team.”
When it comes to production, Chavez was big-time in that department last season. Along with Weiler, Chavez led the team in nearly every major offensive statistical category, but it was her walk to strikeout ratio that stood out. Hitting in the cleanup spot, Chavez drew 13 walks while striking out only eight times all season, a remarkable achievement, especially for a power hitter like Chavez. “I’m expected to have productive at-bats and hit with power,” said Chavez, who hit .420 and had three home runs last season while averaging an RBI per game. Chavez also finished with a .500 on-base percentage, and had a remarkable 1.159 OPS. “The focus is to be productive in the box, and I take extreme pride in doing that.” As do her teammates. As strong as Gilroy was last season, it could be playing at a higher level come April and May. That’s because everyone has another year of experience under their belt, especially the sophomores who came in as freshmen last season and made a huge impact as then 14-year-olds. One of those sophomores, Alysa Gutierrez, will play a key role in the circle. Along with workhorse senior Gianna Vanni, the two will eat up a lot of innings this season. However, Gilroy has strength in numbers in the pitching staff, which includes sophomores Savannah Wilson, Kaitlyn Martinez and Sabrina Lopez. “The sophomores have a year under their belt and are a lot more mature and confident this year,” Mustangs coach Bria DeLorenzo said. “They know what it takes to pitch at the varsity level. We’re lucky in that we’re one of the few high schools that are really deep in pitching. We have five pitchers on the roster, and they’ll all see time in the circle at some point this year.” Wilson pitched well in the team’s loss to perennial power Mitty on March 5, and Gutierrez moves the ball well and hits her target. “All of them have different strengths and my job as a coach is to put them in the right situation against the right team,” DeLorenzo said. “They all have movement
STRONG IN THE CIRCLE Mustangs senior Gianna Vanni returns to help lead a Gilroy High squad that
plans on repeating as CCS champions. The Mustangs return all but one starter off of last year’s team.
on their pitches and can hit their spots, something we stress.” Annabelle Gutierrez, a senior shortstop and Weber Statesignee, usually hits leadoff for a good reason: she sees a lot of pitches, gets on base and is a threat to steal and move up in scoring position. Abby Clark, a junior catcher/center fielder, provides productive atbats, and Malia Mah, a sophomore catcher/third baseman, possesses a potent bat as well. Vanessa Zozaya, a senior second baseman, and Savanah Castro, a senior designated player, are expected to produce clutch hits, just like they did a season ago. Sophomore Lauryn Yslava is projected to split the all-important catching duties with Clark and Mah. “You’ll see our defense move
a lot and the lineup could get shaken on a daily basis,” DeLorenzo said “It’s all about who’s hitting (well and being productive). We’re extremely fortunate in that we have a lot of depth on this team.” Chavez plays her travel ball with the California Suncats, and throughout the off-season she worked with coach David Gutierrez to take her game to a higher level and improve in all aspects of the sport. “I worked a lot with coach Dave to make sure I’m swinging at the pitch I want,” she said. “Being a four hitter you go into it knowing there are a lot of expectations to be a smart batter, wait for my pitch and make the pitcher work to your strength. As a four batter they’re not going to try to throw you anything
good, so you have to be patient and keep to the plan.” Chavez plays softball yearround—literally. Save for a couple of weeks in December, Chavez never goes more than a couple of days without a game, practice or workout. She’s always honing her skills, striving to maximize her potential. Her plan—and the team’s approach—revolves around hard work, preparation and steely-eye focus. “The girls are confident and they know what it takes to win,” DeLorenzo said. “A championship doesn’t happen by mistake, it doesn’t happen by luck, it happens by a lot of hard work. When we began the season it was back to the grind and getting prepared to defend the championship. We should be as strong as last year if not stronger.”

Gavilan’s terrific season comes to end
RAMS FALL A WIN SHORT OF STATE CHAMPIONSHIPS AFTER LOSING TO SANTA ROSA emanuel lee Sports Editor
The faraway looks and soggy eyes said it all—this one hurt the deepest. On the cusp of advancing to the State Final Eight for the first time in program history, the Gavilan College men’s basketball team lost to Santa
Rosa 68-66 in a California Community College NorCal Regional Final Saturday. The No. 3 seed Rams (27-3) lost in the same round a year ago, but this one had to be more painful because of the circumstances. Gavilan was at home, having clinched a top 3 seed by virtue of its superior regular-season. Everything was set up for the Rams to advance to Ventura, the site of this year’s State Championships.
“It stings and they were obviously disappointed,” Rams coach Dallas Jensen said. “There were a lot of tears in that locker room.” Gavilan’s terrific season looked as if it was going to continue after it came all the way back from 17 points down and had the ball in its hands with 7.6 seconds left and trailing by one point, 67-66. The Rams got one of the matchups they wanted— 6-foot-7 forward Xander
Bowers on a much smaller defender in an 1-on-1 isolated play situation near the right elbow area— only to see the Santa Rosa player draw a charge with 1.1 seconds left. Gavilan was forced to foul, Santa Rosa made one of two free throws and Patrick Fisher’s desperation heave from 67 feet clanged off the backboard at the buzzer. “It was the right call by the refs, but that was tough,” Jensen said.
“Knowing you fight back like that all the way to the end, you can’t help but be proud of your players. We just came up short.” Ibn Zaid led Gavilan with 24 points, D.J. Burgess finished with 14 points and Bowers had 11 for the Rams, who simply had no answer for Santa Rosa’s Skylar Chavez in the first half. Chavez scored 18 of his game-high 27 points in the first half, which wasn’t a surprise
considering Chavez is arguably the best player in Northern California. Rather, it was Santa Rosa’s ability to shrink the court that made life tough on Gavilan for most of the contest and ultimately proved to be the difference in the outcome. The Bear Cubs were intent on packing the lane to neutralize Gavilan’s superior inside play, particularly Deion Ellis and Bowers.

If you are the highest bidder at the auction, you are or may be responsible for paying off all liens senior to the lien being auctioned off, before you can receive clear title to the property. You are encouraged to investigate the existence, priority, and size of outstanding liens that may exist on this property by contacting the county recorder's office or a title insurance company, either of which may charge you a fee for this information. If you consult either of these resources, you should be aware that the same lender may hold more than one mortgage or deed of trust on the property. NOTICE TO PROPERTY OWNER: The sale date shown on this notice of sale may be postponed one or more times by the mortgagee, beneficiary, trustee, or a court, pursuant to Section 2924g of the California Civil Code. The law requires that information about trustee sale postponements be made available to you and to the public, as a courtesy to those not present at the sale. If you wish to learn whether your sale date has been postponed, and if applicable, the rescheduled time and date for the sale of this property, you may call 800-280-2832 or visit this Internet Web www.Auction. com, using the file number assigned to this case CA1700278748 Information about postponements that are very short in duration or that occur close in time to the scheduled sale may not immediately be reflected in the telephone information or on the Internet Web site.
