Chambless expects the city council to have an initial meeting on the McCarthy Street Park revitalization in two to three months. The city received the $667,370 grant from the California Department of Housing and Community Development through the state’s HousingRelated Parks program, which aims to increase the overall supply of affordable housing to lower-income households by offering financial incentives for the creation, expansion or renovation of community park and recreation amenities.

Outdoor gym equipment and handball courts may be in the pipeline for McCarthy Street Park thanks to a nearly $700,000 grant the City of Hollister was recently awarded by the state. While the process is expected to take up to three years to complete, the monies will go towards renovating the mostly turf-covered 1.5 acre park located next to San Andreas High School. Facilities being considered for the park include a refurbished basketball court, new bathrooms with

showers, a splash pad water feature similar to the blue whale at Valley View Park, and a raised stage for community concerts and events. A conceptual design of the improved park has been drafted by city staff. “I based the features on community feedback from several sources,” said Mike Chambless, the city’s management services director. The city received community suggestions on social media, at various public meetings and through direct interaction with citizens. The revitalization could take between two to three years, Chambless explained. “This is just the beginning of a long process I am afraid,” he said, as he outlined a series of tasks,

State opinion on 400 block delayed AG INPUT COULD TAKE WEEKS Nicholas Preciado Reporter

An opinion from the state’s top attorney on the validity of the 400 block petition spearheaded by Hollister Mayor Ignacio Velazquez has been delayed, according to city officials. City Clerk Tom Graves asked the state Attorney General for an opinion on whether the petition could justifiably impact the city council’s previous decision to sell the vacant 400 block property on San Benito Street for development. “There are three kinds of acts that a city council performs: executive, administrative and legislative,” Graves explained. “If an act is administrative or executive it can’t be undone by a

referendum petition. If the act is legislative it can. Having said that, there is a difference of opinion on whether or not Resolution No. 2017-139 was legislative or administrative. Hence the letter asking for an opinion.” An answer was expected Tuesday, but Graves received an email from the state to say it would be weeks before a response was issued. “I’m not happy and this comes as an unwelcome surprise,” said Graves. Velazquez said the 400 block is a city issue, not a state issue. “The people are speaking out and want to be heard,” Velazquez said by phone Tuesday. “It is time to start listening to the public. The public wants that as an open space. It is time to listen and not look for another way out.” In June, the city council

approved selling the city-owned 400 block property to the Community Foundation for San Benito County for a new philanthropy center and the Del Curto Brothers Group for mixed housing and commercial development. Total project development costs are estimated at $4.5 million. The vacant property is worth $390,000, according to an appraisal conducted in 2015. Construction is expected to begin sometime next year pending site and design review. Velazquez recused himself from the June 5 vote to sell the property due to a financial conflict of interest as owner of the Vault building adjacent to the 400 block lot. But that did not stop Velazquez from speaking out against the sale on social media nor did it keep him from

collecting signatures for a petition that would require city policymakers to revisit its decision to sell the grassy parcel. On July 11, Velazquez delivered to city hall an estimated 2,465 signatures, more than the 1,600 required for a referendum. Graves is currently reviewing the petition. He has until September 20 to either decline it or declare it sufficient. If the petition is declared sufficient, it will move to the San Benito County Registrar of Voters for further review. The city clerk needs to notify the city council by October 2 if the petition is sufficient. “I’m really hoping I won’t have to wait that long,” Graves said. The council has various ways to proceed if the petition is declared sufficient: amend the resolution approving the 400 block sale,

withdraw it or do nothing. If the council does nothing, the item will go to the ballot. Placing the item on the ballot during a regular election could cost Hollister upwards of $50,000 whereas a special election could cost about $150,000. The city owns the 400 block lot because of the dissolution of the former Hollister Redevelopment Agency, which purchased the property following the 1989 Loma Prieta earthquake. If the petition results in a withdrawal of the development proposal, the city still needs to sell the property because of a requirement by the California Department of Finance. Due to a tax sharing agreement with various entities, the City of Hollister is expected to receive $43,000 once the sale is finalized.

National Night Out, 1 evening hours, National Night Out featured jump houses, emergency response vehicles on display, exhibits and information from agencies such as First 5 San Benito County and Hollister Police Animal Care and Services. The event also gave emergency responders the opportunity to give Hollister families important public safety information. “We are here to spread the word to kids and adults alike about fire safety,” said Mel Nielsen, Hollister Fire Department engineer. Nielsen said there are simple things families can do to prevent fire at home. “They can change the batteries in their smoke detectors, clean the vents at the back of dryers and we see a lot of older barbecues catch on fire, which can easily spread. Usually there are safety mechanisms on newer models, but not on the older ones.” At the California Highway Patrol booth, officers passed out stickers and

spread the word about driver safety. “Seat belts are a big one. We still see people without seat belts,” said officer Will Meyers. “Also stay off the cell phone when you are driving.” The California Highway Patrol area office in Gilroy offers car seat inspections. “As a rule, if you don’t know where the car seat came from - like you bought it at a garage sale - get rid of it, or get it inspected,” said Manny Salinas, commercial vehicle inspector specialist. Over at the silly photo booth, sisters Deysi and Itzel Santiago were having a great time. “I like it because we get to have fun together,” said ten-year-old Deysi. Assemblywoman Anna Caballero was also spotted strolling San Benito Street. “National Night Out is a very important event for me,” said Caballero. “I did violence prevention programs and anything you can do to make the community aware of community services and opportunities

So I’m here and trying to make as many of these events throughout the district.” After stopping in Hollister Caballero was off to Morgan Hill and Gilroy. “Hollister and San Juan Bautista are really strong communities with a lot of community spirit. They have a lot of volunteers, people who care. I am proud to represent this area but I also want to participate as much as possible. The more we get involved, the better the community is.” Overall, the event was a success. “Highlights for us are interacting with the community, especially the kids,” said Hollister Police Department Sergeant Don Pershall. “We also want to get the message across that we want to be partners with the community in servicing their needs. We run into a lot of community members that are helpful and take an active role in helping us solve and prevent crime and that is what this event is all about.”

Racetrack proposal is vehemently discussed

Bill Lipo, a Monterey resident who said he had a business in San Juan Bautista for several years, encouraged others to see the project as an opportunity. “Formula One racing is a world-renowned sport,” Lipo said. “This is an opportunity to address your water system and sewer system. I hope the city would ask the developer to include a substantial percentage of affordable housing. This is an opportunity where you can leverage these things.” Maria Madrigal, a San Juan Bautista resident, shared her experience growing up by the Mazda Raceway Laguna Seca in Salinas. “Spreckels is more than five to six miles away from Laguna Seca,” Madrigal said. “You could hear the echo bouncing from the hills.” She said she could

hear the racetrack every weekend. “If I was that many miles away from the racetrack, this is just across the street. We’re going to hear it. They’re going to hear it in Hollister, they’re going to hear it in Prunedale, they’re going to hear it in Aromas and possibly Gilroy and Morgan Hill.” San Benito County Supervisor Anthony Botelho voiced his opposition to the project. “We just got done with the county general plan revision a couple years ago,” Botelho said. “One of our great concerns was maintaining the rural character of the entrance to the town’s historic cultural center. This is contrary to the general plan.” Botelho said the project was too big and he couldn’t see how the city would service it. “I certainly hope the applicants take a hard

look at the testimony tonight and make the best decision. For the record, I’m absolutely against this project in this location.” After public comment and discussion amongst the commission members, Hopper directed staff to send the applicants a response letter outlining the concerns raised at the meeting. “Should the applicant want to come forward with an application, then we’ll weigh it on its merits,” Hopper said. “In my opinion, I don’t think we should spend any more of our time or the public’s time hearing about this project. I think we’ve heard the concerns. So let them bring forward a proposal, should they elect to do that.” Commissioners Darlene Boyd and Andy Moore voted with Hopper to send a response letter. Commissioners Scott Freels and Ernest Franco were absent.

How do you feel about the Formula One racetrack proposed for San Juan Bautista? What other exciting developments would you like to see in San Benito County?

Nants Foley: I can already hear the roar of the engines and see the checkered flag! I am not a fan of auto racing, but would welcome any activities bringing outside dollars to our economy. It's a good life. Bill Mifsud: I am excited to hear about a world renowned sport, which may be coming to our neck of the woods. F-1 racing in Europe is huge and if developed San Benito County will definitely be elevated to world renowned status. We also need better infrastructure when it comes to our roads leading in and out of San Benito County. Keith Snow: That's good. It will create revenue and that is good for them and the community. I have lots of great ideas to create revenue and bring family fun functions to San Benito County, such as a skating rink, bowling alley, miniature golf, indoor swimming and wet park with lifeguards and security guards. There's lots of possibilities for San Benito County. Ruth Erickson: Great idea though it may be a better fit for land closer to Hollister than San Juan Bautista. A similar idea for a racetrack was proposed for Hollister some years ago but it did not come to fruition. What a boon it would be for San Benito County with tourists spending their dollars and generating much needed income for our county. We need to have tourist attractions like Monterey County where millions of dollars are generated from all their events and attractions. Raul Castaneda: It would be awesome. It would bring in a lot of money

to the county. They can also have track days like they do at Laguna Seca, which might get some illegal street racing off public streets. Taylor DeLeon: People keep talking about how San Juan doesn't have the infrastructure or the roads aren't good enough. Well guess what people, you let stuff like this in and the county can afford to fix stuff like that. No racetrack, no money. This would bring so much money into the area including Hollister, Salinas and Gilroy. Having a track used for Moto GP and F-1 would be awesome. This is the biggest of the big leagues when it comes to races. People would come from all over the world. Jeff Domingues: A town that stonewalls housing and commercial development is going to sign off on a racetrack? Not holding my breath.

Last Friday while deciding on this issue’s Question of the Week, I ran into a bit of difficulty. I wanted to ask our readers how cancer impacted them to coincide with reporter Nick Preciado’s coverage of the Relay for Life fundraiser held last weekend at San Benito High School. But as our faithful reader and regular commentator, Ruth Erickson noted, if you have not experienced cancer firsthand or been touched by the suffering of a loved one with the disease, it may be challenging to give a robust response. So, after discussing it for a while, I went with Formula One, instead. I suppose I wanted to get our readers’ opinion on cancer, a disease that comes in many forms, and according to the American Cancer Society, which spearheads the Relay for Life initiative nationwide, will impact one in three women and one in two men in the U.S. during their lifetime, because, I have seen what it does to people I love firsthand. I lost my grandfather in April to lung cancer and while he died, thousands of miles away, across the pond, in a town called, London, I watched my brave motherin-law do daily battle with the disease. As this paper’s coverage of the Relay for Life event showed, the will to live and hope are intrinsically combined when facing a cancer diagnosis. I give my heartiest of thanks to the hundreds of participants in San Benito County who raised more than $107,000 for a cure and cancer patient care. Cancer does not care if one is young or old, and neither should we in our joined pursuit to find healing, offer support and give hope to impacted members of our community. As for the Formula One proposal floated for a 550-acre rural parcel just outside San Juan Bautista, the Los Gatos company behind it failed to show up to a packed planning commission meeting where the proposal was vehemently discussed on Tuesday. While an informal tally of comments on the Hollister Free Lance Facebook page and from our own Question of the Week panel showed most in support of the ambitious project, the majority of San Juan Bautista residents who spoke up at Tuesday’s meeting were against it. Common concerns were related to the lack of infrastructure that currently exists for such a large project. As many have noted, in this country, most development is undertaken in partnership between private developers and investors and public agencies. While the idea of a worldclass event such as Formula One being located in our neck of the woods seemed almost too outrageous to fathom, it’s worth remembering that to get what we need, we sometimes have to give something in return.

Utility box art focuses on youth PUBLIC ART PROGRAM BEAUTIFIES AND INSPIRES By Roseann Hernandez Cattani Editor

Paint brush in hand, David Gutierrez makes the final touches to his latest artwork, a utility box on Tres Pinos Road in Hollister. “This one has taken me quite a while because of the amount of subject matter,” said Gutierrez, as he reviews the utility box now covered with vibrant scenes of youth engaged in positive activities such as graduating from high school and walking a ropes course. “The scenes revolve around a program I am a part of called Youth Alliance,” he said. “We run a group, GUIAS (Guiding and Understanding Individuals and Achieving Success) at San Benito High School. We are mentors and advisors to the students in addition to what the school provides.” The seven panels depict various scenes of the students in action. “This is a field trip we took to a ropes course. At the front, is graduation. On the left side is mentorship and a scene of our weekly support group,” explained Gutierrez, who uses water-based acrylic paint to create his streetside masterpieces. Gutierrez and some of his students worked on the motorcycle rally inspired utility box in front of the Vault in the city’s downtown. “I used that project as a catalyst to get kids and the community to work

on mural projects,” said Gutierrez, who is from Hollister and got a degree in studio art at San Diego State University. But for this artist, being creative is a lifelong passion. “I’ve been doing art my whole life,” he said. “When I was little I was always drawing. Then I went to Gavilan College and was inspired by my teacher and muralist, Arturo Rosette. He worked on murals at local schools and I helped out on a few in Gilroy while I was there.” Spearheaded by the San Benito County Arts Council, the utility box project is currently in its second phase. “In this phase we are doing five boxes,” said executive director Jennifer Laine. “The first phase was in 2015 and we did five murals.” The project is funded through various sponsorships. “In this round the arts council sponsored two utility boxes,” explained Laine. “We got a $2600 grant from the Community Foundation for San Benito County for two boxes and the San Benito County Chamber of Commerce sponsored one box.” Artists and their proposals were decided by the city’s public art review committee, which is made up of artists, an architect and a youth commissioner. Transforming the utility boxes into works of art is challenging. “Boxes aren’t just solid sides, there are vents and keyholes,” said Laine. “You really have to make sure it comes out

as part of an initiative by the San Benito County Arts Council to increase public art in the city. seamless looking while making accommodations for all the different parts of the box.”

The council hopes to do a phase three for three more city-owned utility boxes.

“We want to increase the visibility of art, beautify the city, and highlight local artists,” said

Laine. “That really creates a sense of pride in the community.”

Community comes out strong to show support Relay for Life, 1

The American Cancer Society estimates one in three women and one in two men in the U.S will be diagnosed with cancer in their lifetime. “Over the years more of my family and friends have gotten cancer so it’s become important,” said Szyndrowski. “I’ve had two back surgeries and three spinal blocks so I have a hard time walking. But as long as I can get to the meetings and organize the team, I’m going to do this until we find a cure.” Diana Muñoz, Fight4Life team captain and event co-chairwoman, has been participating at the Hollister event for five years. “It takes a lot of volunteers to pull off a great Relay,” said Muñoz. “This year we had an outpouring of response from San Benito Boy Scouts, members of the Key Club, Clampers and LULAC (The League of United Latin American Citizens). We could not have done it without their support.” Muñoz, a single mother of

two children, was diagnosed with triple negative breast cancer in December 2014. When she was 17 years old, she lost her mother to breast cancer. Others in her family have also been diagnosed with cancer. “Over the last 15 months I’ve endured a bilateral mastectomy and my lung collapsed twice requiring two chest tubes,” she explained. “I’ve had three blood transfusions, a blood clot that required daily self injections and 16 rounds of chemotherapy, reconstructive surgery and 28 days of radiation.” Muñoz, 36, is in surgical menopause after she had her ovaries and Fallopian tubes removed last year to lower her risk of other cancers. She said as long as she is alive it is all worth it. “My children Caden and Madison are my reason to breathe,” she said. “I will fight with every ounce of my being to be here with them.” The Howling Huskies team

chose a fishing game for their booth, which featured nautical decorations. Jean Murray, team captain, said she joined the event to support the search for a cure. Murray lost her best friend and colleague to kidney cancer. “I think it brings a better understanding of all the aspects of what the American Cancer Society can do for you,” said Murray. “It can educate you on

how to prevent cancer and the treatment that is available.” Ruiz said Relay for Life is more than raising money. “We want to have a safe place where we can celebrate our cancer survivors and celebrate those we lost,” she said. “When you come to the event it’s a time for you to share your story, support others going through the same process and to spread hope.”

A medical cannabis recommendation clinic with several licensed physicians will not be allowed to operate at a former bank in the historic center of San Juan Bautista, according to a decision by the city’s planning commission during its Tuesday meeting. “I’ve provided a wealth of information in the last three months to the point where I’m going to lose this building because of the delays of this body and also the city council,” said applicant, Mandisa Snodey. “I tried to simplify it because there was confusion over the business plan.” Snodey, who owns Closet Under

the Stairs Apothecarium in the city, presented the proposed business for 301 Third Street to the commissioners at their regular meeting on July 10, but the item was continued to August 1 because of new information presented by Snodey the day of the meeting. Snodey told the commission she took responsibility for trying to put all the business components in one place. “It led to the perception that I was trying to hide or be sneaky,” she said. “But I was really trying to do everything at once. My vision grew as time went on. I don’t have any more time to deliberate on this issue, which is why I simplified it down to a medical clinic.” Commission chairman John Hopper asked what kind of signage Snodey envisioned outside the proposed medical cannabis clinic.

“Potentially a cross or green cross,” said Snodey. “Of course I’d want to keep the signage very discreet.” Residents were quick to share their concerns about the consistency of the proposal, children walking by the clinic and the type of clientele the clinic would attract. “First it was a medical clinic, then a healing center and now a medical clinic with multiple physicians,” resident Rachel Ponce said. “This medical clinic is not conducive to the historic district. We must preserve the historical, peaceful and quiet atmosphere that tourists come to experience here.” Resident Jackie Morris, sporting medical scrubs, said she got the impression that people were uninformed, both in the audience and on the dais. “You all need to go home and do

While he thought the clinic proposal had the potential to be a strong business opportunity for the city, the issue was its location within the historic resources district. He also took issue with signage. “I’m not going to allow a green cross, 420 or anything like that,” Hopper said. “Thousands of fourth graders unfortunately walk by all the bars in this town and they would be walking by this newly permitted use in town. So I’m not in favor of this medical clinic usage. Running For State BALERS ARE LOADED YET AGAIN FOR A STRONG YEAR emanuel lee Sports Editor

In terms of being consistently excellent, the San Benito High cross country teams are among the gold standard in the Central Coast Section. The boys and girls squads routinely finish first or second in league, and in most years, place in the top 10 in the CCS Championships. This season should be no different. The Haybalers kick off the 2017 campaign on Sept. 2 at home with the Dry River Run,

an event that gets the entire community involved. The Dry River Run has races for all age levels, including an open division, middle school and high school category. “The girls team is looking great as normal and our boys team really started off on the right foot with our two time trials,” said Ryan Shorey, who along with Leanna Morgan are entering their fourth season as the co-coaches. “We have some pretty good young runners coming in, and at one point had 60 total runners during summer conditioning.” The girls team took a distant third in the CCS Division I race last year to miss a state berth by one position. Although disappointed, San Benito should be just as strong—if not

stronger—to make another run for state this year. The Balers return several key standouts from last year’s team, including No. 1 runner Elli Kliewer, an incoming senior who finished 11th in last year’s section championships. San Benito also returns Samantha Cortez, who finished 12th in last year’s section race, fellow seniors Hailey Cross and Makenna Parks along with junior Mariah Changco. In addition, the Balers have a talented freshmen class coming in, led by Lauren Okamoto, who Shorey describes as a superior talent along the lines of past Balers standouts Amy Quinones, Vanessa Estrada and Courtney Allen. “Every once in while we get that runner that has the

potential to take the program to the next level,” Shorey said. “And Lauren in the future could certainly be that runner.” Okamoto ran the second fastest time in the 2-mile time trails, with a best of 13 minutes, 27 seconds. If Okamoto ends up producing fast times alongside Kliewer, then the Balers are primed for a state run. That’s because Shorey also expects big things from incoming junior Emily Quinby, who has run track the last two years but will be in her first season running cross country (she did volleyball in the fall the previous two years). Although the boys team didn’t have its typical upper-tier finish in 2016—they took 13th in the CCS Championships—they’re ➝ Balers, page 16

When Emily Tonascia played at San Benito High School, she was known for her enthusiasm and positivity. The former Haybalers’ standout looks to bring that same mojo as the new coach of the girls volleyball team. Tonascia takes over for Ruth Testman, who stepped down in April so she could pursue her Master’s degree. “I think most things can be said in a positive way,” Tonascia said. “I like the girls to have fun and enjoy the game, because no one has to be out there. We’re about enjoying the game, but at the same time getting better and stronger and beating teams.”

Tonascia, a 2010 San Benito High graduate, went on to play at Gavilan College and Menlo College. A Hollister native, Tonascia’s previous coaching experience includes a one-year stint coaching the San Benito boys team in 2012 and three years of club coaching, mostly with Rush Volleyball Club out of Gilroy. Tonascia actually got hired on first as a special education teacher at San Benito, not knowing initially the volleyball coach’s position was vacant. “I actually found the teaching and coaching position at the same time, so it seemed meant to be,” she said. “It’s really exciting because in the summer

I’ve gotten to learn about the girls and their past success. They’ve been super awesome, but we can’t live off of that success. It’s a new year, we’re starting from square one and teams will be coming after us.” Indeed, the twotime defending Monterey Bay League Gabilan Division champion Balers know it’ll require an intense focus and discipline to three-peat, but they’re up for the challenge. San Benito graduated standouts Marisa Villegas and Camille Finley, but they return a plethora of talent, including Lauren Sabbatini, Nicole Andrade, Annie Breger, Kieley Hoskins, Alyssa Ito

and Elizabeth Fleming. Tonascia tested the mettle and discipline of her players early on, as she held 6 a.m. summer practices— just like the football team. “I thought for sure some of the girls would stop showing up,” Tonascia said. “We were doing a lot of conditioning and running—not super fun stuff. But we consistently had 40 to 50 girls everyday, which was kind of crazy and cool.” Said Breger: “I was also pleasantly surprised that day in, day out, everyone showed up. It was really great; it shows the girls’ commitment to the sport and the program.” Breger likes how ➝ Tonascia, page 16

to a good start,” Shorey said, noting Loredo ran 2 miles in 11 minutes, 8 seconds and Ruiz in 11:09. “I’m definitely happy with those times knowing they will get faster.” Loredo said he’s a much improved runner from a year ago, both mentally and physically. Loredo has been running 60 to 70 miles a week for the last three or four weeks, which has given him confidence. The number might seem staggering given the fact that Loredo was regularly logging 40-plus mile weeks last season. However, Loredo is comfortable with the amount of

mileage he’s putting in. Loredo tries to get in 10 miles a day, which is usually split up with a morning and evening session. In between, he does a lot of stretching to keep his legs supple. “I feel a lot better this season compared to last year,” he said. “I feel good about the team as well. I feel we all came back a little faster, and that’s exciting to see.” Loredo plans on breaking 16 minutes this season over a typical 3-mile course; his personal-record is 16 minutes, 40 seconds. The San Benito boys finished out of the top 10 in

the Division I CCS Championships , and they’re intent on making sure that doesn’t happen again. “We’re all training harder than we were last year, and that will make a difference,” Loredo said. Shorey was also high on Rabago, who ran a 12:10 in one of the time trials and as of last week ranked eighth on the team’s depth chart. “Isaiah is very serious about the sport, which is sweet,” Shorey said. “To have someone as determined as he is at this point is pretty exciting. When the motivation is there, the possibilities are endless.”

The team had a cleanup day in which they picked up trash on San Benito Street, and also met at Dunne Park for an outdoor event. On the court, Tonascia has reinforced the fundamentals, which the best high school teams possess in abundance. “It’s been back to the

basics with drills that reinforce what has gotten us to this level,” Breger said. “Things like how to use your platform when passing, or remembering certain serving techniques. In the long run, it will make all of our skills better. … It’s nice to see the amount of team-building and unity that she’s building within the program.” Breger said even though she wasn’t there for the trash cleanup day, having a

non-related volleyball team activity helps the players bond perhaps in a way that not even a sports-related event could accomplish. “It’s an opportunity to grow closer together,” she said. “I would rather spend time cleaning up garbage with the people I love rather than being in the best place in the world with people who genuinely don’t care about me. Doing things to help build off each other will help us

in the long run.” The incoming seniors are now on their third coach in four years, as Testman had coached the previous two years after succeeding Dean Askanas. However, Breger and her teammates are confident the squad will coalesce yet again to have another banner season. Breger said Tonascia brings something unique to the team, just like her predecessors did.

“As a player it’s awesome to see the different coaching styles and all the different methods they use,” Breger said. “Coach Tonascia’s style is really nice in that her whole philosophy is building an organization from all aspects. All of my experiences with the volleyball coaches here have been extremely different, but in really good ways.” Tonascia was a standout middle blocker at San Benito High, and she feels

one of her strengths is being able to relate to the players and know exactly what they’re going through. “I think I can relate to the girls a lot,” she said. “I was in their exact shoes, and went above and beyond in terms of giving a great effort and focusing to be the best. We all started with the same roots here in Hollister, and I think that is something powerful because they can relate to that.”

In recent years, the Department has undertaken to develop a comprehensive plan for the effective delivery of Project water across the SacramentoSan Joaquin Delta in conjunction with the conservation and rehabilitation of the environment and species in and around the Delta. Currently, Project water is conveyed across the Delta through the channels of the river delta formed by the confluence of the Sacramento and San Joaquin Rivers, as those channels have been modified over 150 years by the construction of levees, ship and other canals, flood protection channels, salinity gates and other facilities. The Department has approved the financing of the planning and design and, if and when appropriate, the acquisition and construction of conveyance facilities known as the “California WaterFix.” Broadly described, the California WaterFix would transport water from new intake points on the Sacramento River across the Delta by two underground tunnels running below the natural waterways of the Delta to export facilities at the southern edge of the Delta. The Department is authorized to carry out its various duties and functions in relation to the Project by the Central Valley Project Act (Cal. Water Code §§ 11100 et seq.) (the “CVP Act”) and the Burns-Porter Act (Cal. Water Code §§ 12930 et seq.), among other authorities. The Department is authorized to construct units of the “project” as that term is defined by the CVP Act, and to issue revenue bonds to pay the capital costs of those units. Among its authorities, Section 11260 of the CVP Act authorizes the Department to include the California WaterFix as one or more of the units “provided for in this chapter[;]” Section 11454 of the CVP Act authorizes the Department to “do any and all things which in its judgment are necessary, convenient, or expedient for the accomplishment of the purposes and objects of this part[;]” and Section 11700 of the CVP Act authorizes the Department to issue revenue bonds “[f]or the purpose of providing money and funds to pay the cost and expense of carrying out any of the objects and purposes of this part.” /// On July 21, 2017, the Department adopted resolutions authorizing, among other matters, the issuance of revenue bonds, in multiple series, the proceeds of which would be used to pay the costs of the planning, design, acquisition, and construction of the California WaterFix. On the same date, the Department filed its validation complaint pursuant to Code of Civil Procedure section 860 et seq. In its complaint, the Department alleges, among other things, that it is statutorily authorized to issue revenue bonds to finance the acquisition and construction of the California WaterFix and to pledge California WaterFix revenues to secure the payment of

debt service on these bonds in the manner provided by the Department’s resolutions. In the authorizing resolutions, the Department found and determined that: (1) the preliminary cost estimate for California WaterFix, not including bondrelated costs such as capitalized interest, costs of issuance and bond reserves, is $16 billion; (2) the estimated amount of such costs to be raised by the issuance of California WaterFix revenue bonds is $8.8 billion; (3) the probable amount of money, property, materials or labor, if any, to be contributed from other sources in aid of the California WaterFix is $7.2 billion; and (4) the principal amount of bonds estimated to be required to be issued by the Department for the California WaterFix is $11 billion.
