A San Benito County Superior Court judge on Monday, Nov. 13, ruled that Mitchell Dabo, president of the county Board of Education, illegally emptied nearly $644,000 in a private charitable trust for his own personal use. Superior Court Judge Marjorie L. County inspection teams discovered a 104-foot long breach in the Pacheco Creek levee on Dara Farms’ property on Jan.12. Another significant, 80-foot breach occurred elsewhere in the levee system during a subsequent storm. Those breaches remain unrepaired. “We knew what we were getting into when we made the commitment to go ahead and fund these projects,” Supervisor Robert Rivas said. “Certainly the dollar amount is concerning, but at the same time we made the commitment to see this project through. We have to honor those commitments.” Supervisor Mark Medina asked for a definite start date, which Guertin was unable to provide. “We probably don’t want to put a definite date to it,” Guertin said. “We’re looking at about 10

The San Benito County Board of Supervisors this week approved $275,000 in additional funding for repairs to the Pacheco Creek levee system, damaged during last winter’s storms. The allocation at a special Tuesday meeting followed previous board action in October that dedicated $350,000 of general fund money toward the repairs. Tuesday’s allocation puts the total money allocated to the project at $625,000. Resource Management Agency Director John Guertin informed supervisors on Tuesday that county staff received three
bids ranging from $511,000 to $650,000 to conduct the work. Don Chapin Company, a Salinasbased general engineering construction company, was selected as the lowest bidder at $511,214. “We’d also need extra funding for contingencies and a geotech survey to go out there before they do the work to make sure the soil is stable,” Guertin said. Board Chairman Jaime De La Cruz asked Guertin if he felt a total of $625,000 would mitigate the problems out at the levee. “Based on what I know today, yes,” Guertin said. “In the construction world things change. This is an active streambed and we’re expecting rain tomorrow. The environment can change before we can get out there and do additional work. There are things beyond our control, but we’ll try to mitigate those as much as possible.” Storms last January and February damaged the Pacheco Creek levee system, which runs

Workers fired after cannery strike are appealing FOUR MEN FIRED IN JULY FOR STRIKE ACTIONS Nicholas Preciado Reporter
Four tomato cannery workers who participated in the June 2017 strike at San Benito Foods and then were fired in July are taking their cases to arbitration next month. “The company never gave us a chance to explain why we got fired,” said Raymundo Fregoso, one of the terminated employees, who worked at the cannery for 17 years. “I still don’t know the reason why they fired us.” Fregoso, Esteban Guillen,
Daniel Miranda and Arturo Macias Jr., said they were suspended when the eight-day strike ended July 1. The cannery employs 100 fulltime workers year-round and 450 seasonal workers during the busy processing season that runs from July through September. Jose Perez, a representative for Teamsters Local 890 which represents San Benito Foods employees, said he was made aware of the suspensions immediately after the strike ended. “I got a call from the guys telling me they were put on suspension pending investigation,” Perez said by phone Monday. “A couple days later they were terminated for striker misconduct.”
The terminations aren’t going unchallenged, with the union and former cannery employees set to go into arbitration with San Benito Foods on Dec. 6. “We’re fighting it, we’re definitely against it,” Perez said. “We wouldn’t be going to arbitration if we didn’t think we had a strong case. We’re 100 percent behind our members and it’s unfortunate that the company decided to take this route. We don’t believe they have sufficient evidence to support their allegations.” The cannery strike started on June 23 after contract negotiations that began in January collapsed between Teamsters Local 890 and the San Benito Foods
tomato cannery, owned by the Neil Jones Food Company. The strike ended eight days later on July 1. Five days later, on July 6, Fregoso and the other three terminated employees received notices from the cannery that they would not be reinstated due to striker misconduct. “They retaliated against us for asking for what the United States stands for: better quality and better treatment for better pay,” Fregoso said. “We have a right to say, ‘You’re doing us wrong and this has to stop.’ That’s why we all walked out. We were out there 12 to 13mi hours a day for a week. We didn’t do it for fun, we did it for a purpose.”

It is unclear how San Benito Foods, and to a larger extent the Neil Jones Food Company, define striker misconduct. Plant Manager Sam Humphrey wouldn’t respond to questions, but provided a company statement to the Free Lance on Wednesday morning. “San Benito Foods is working collaboratively with the union to find a resolution,” Humphrey said. “For privacy reasons, we won’t be discussing employee matters.” After the strike ended in July, Humphrey said that no workers were terminated. At the time, he was responding to rumors that workers had been fired for their roles in the strike.

Police seeking leads to find hit-run car VICTIM IS IDENTIFIED AS KATHY H. HARO, 56 Staff Report
The Hollister Police Department identified a hit-and-run victim from a Nov.9 accident. On Thursday, Nov.9 around 9:30 p.m., Hollister police
officers responded to a report that a pedestrian had been struck by a vehicle at Pinnacles National Park Highway and Meridian Street. The Hollister Fire Department and AMR also responded. Officers located Hollister resident Kathy Haro, 56, in the roadway just north of Meridian Street. The victim was pronounced
deceased shortly thereafter. The investigation revealed that at least one vehicle hit Haro and fled. As many as two or more vehicles may also have struck the victim in the roadway after the initial collision. At this time, the Hollister Police Department does not
have a description of the suspect vehicle. Other motorists stopped and attempted to render aid to the victim. The Hollister Police Department offered its sincere condolences to Haro’s family and friends. Investigators are asking for public help in identifying the vehicle that struck Haro.

Citizens turn in 275 pounds of prescription drugs TAKE-BACK EVENT IS CALLED A BIG SUCCESS Staff Report
Locals handed in 275.6 pounds of prescription pills and liquids during a take-back drug event last month, according to city police. The Hollister Police
Department and Drug Enforcement Agency held a take back prescription drug event on Saturday, Oct.28 at Target at 1790 Airline Highway. The event allowed the public an opportunity to rid their homes of potentially dangerous, expired, unused and unwanted prescription drugs.
As the event was designed to be anonymous, the department did not have data on what kinds of drugs were taken in. “Overall the event was very successful,” said Hollister Police Department Public Information Officer Sergeant Don Pershall. “We have offered the service several times in the last few years
and the response is always good. Over 275 pounds of prescription drugs were received out of homes where they are more accessible to children and disposed of properly.” The event was the 14th public opportunity in seven years to rid homes of prescription drugs.
Last April, Americans turned in 900,000 pounds of prescription drugs at almost 5,550 sites operated by the DEA and more than 4,200 of its state and local law enforcement partners. Overall in the previous 13 take back events, the DEA and its partners have taken in over 8.1 million pounds of pills.

Native Americans give Thanksgiving Address
I
n 1620, a ship carrying European settlers landed off the coast of Massachusetts and started a settlement at an abandoned Native American village of the Wampanoag tribe. Some native people helped them through their first difficult year, teaching them how to grow and gather native food. When the settlers harvested their first crop, they shared some food with Wampanoags. This was the first Thanksgiving. Here are excerpts from the Thanksgiving Address, the central prayer and invocation for the Haudenosaunee (also known as the Iroquois Confederacy) which is a daily sunrise prayer, and an ancient message of peace. The Thanksgiving Address teaches mutual respect, conservation, love, generosity, and the responsibility to understand that what is done to one part of the Web of Life, we do to ourselves. Today we have gathered and we see that the cycles of life continue. We have been given the duty and responsibility to live in balance and harmony with each other and all living things. So now, we bring our minds together as one as we give our greetings and our thanks to one another as people We are all thankful to our Mother, the Earth, for she gives us all that we need for life. She supports our feet as we walk about upon her. It gives us joy that she continues to care for us as she has from the beginning of time. We give thanks to all the waters of the world for quenching our thirst and providing us with strength. Water is life. We know its power in many forms — waterfalls and rain, mists and streams, rivers and oceans. The fish were instructed to cleanse and purify the water.They also give themselves to us as food. We are grateful that we can still find pure water. As far as the eye can see, plants grow, working many wonders.They sustain many life forms. Since the beginning of time, grains, vegetables, beans and berries have helped the people survive. From the beginning, medicine plants were instructed to take away sickness.They are always waiting and ready to heal us. We are happy there are still among us those special few who remember how to use these plants for healing.

Wisdom keepers have come to help the people throughout the ages. When we forget how to live in harmony, they remind us of the way we were instructed to live. M
asaru “Moose” Kunimura passed away peacefully on November 11, 2017, at the age of 91. He is survived by his wife of 69 years, Doris Aiko (Kuwada), daughters Karen, Donna, Kathy and Diane, Grand-daughter Allison Aiko Bartelstone (David), Great-Grandson Luke Masaru Bartelstone and Great-Grandaughters Katherine Mason Bartelstone and Charlotte Murray Bartelstone. He was preceded in death by his son, Mason. He is also survived by his brother Hiroshi (Dorothy) and his sisters Shigeko Nishiguchi (Mike), Hiroko Kunimura, and Sachi Beaver. He leaves behind many nieces, nephews and extended family members.
Moose was born on April 6, 1926 in Gilroy where he graduated from Gilroy High School in 1944. He was briefly interned in the Poston 1 Arizona Internment camp before being drafted into the US Army. He served as an Army cook until 1946. He owned and operated Kunimura Market for many years before joining the Maintenance Staff at Mt. Madonna County Park. He would retire from the park in 1983. He was an avid sports fan participating in basketball leagues through his early married years and many years with the local bowling leagues. After retirement, his passion turned to golf and bicycle riding. Moose was devoted to his family. He always provided his unconditional support to all. He spent a lifetime contributing to the Gilroy community that he loved. He was a member of the Gilroy JACL and had previously served on the board of Gilroy Parks and Recreation. He was also a member of the San Jose Buddhist Church Betsuin. Family and friends are invited to a Memorial Service conducted by the San Jose Buddhist Church Betsuin on Friday, November 24, 2017, at 11:00am at Habing Funeral Home, 129 Fourth Street, Gilroy. ichard Duane Van Pelt, 67 of Paso Robles lost his short battle with cancer on Saturday, November 4, 2017. Born in Delano and raised in Fresno, he joined the Navy which lead him to meet his wife Frances at Moffett Field. At the age of 23, he married Frances then 20 and they started their life together in San Jose. Eventually, they moved to Gilroy, where they raised their three children. In Gilroy, he worked at Nob Hill as a controller and then left to start his own accounting business. Richard spent the last ten years of his life in Paso Robles where he moved to be near his son’s and grandchildren. He loved his grandchildren dearly and wanted to live close to see them grow and have a strong bond with them. That he did. He loved working in his garden, building things in the garage, fixing the house up and going to the movies. He was an honest man, who treated others equally and always wanted to do what was right. He leaves behind, his wife of 44 years, Frances Van Pelt of Paso Robles, children, Jon and Robert Van Pelt of Paso Robles and Jennifer Ellis of San Rafael. Daughter in-law, Kelly Van Pelt and Son in-law, Braeden Ellis. Grandchildren: Maddie, Chloe, Abigail, Logan, Bryson, Jordyn Van Pelt and Hudson Ellis. His celebration of life will be held on Thursday, November 16, 2017 1pm at Saint Rose Catholic Church in Paso Robles. A viewing will be held the same day from 9am - 11am at Kuehl-Nicolay Funeral Home. A wake will be held following the mass at CaliPaso Winery in Paso Robles.

He made his home variously in California and Hawaii. He was employed by General Electric in San Jose. While in Hawaii, he was a marathoner and triathlete. His greatest joy was playing his piano. He was an accomplished musician and pianist. He was active in both the United Methodist and Episcopal churches in Morgan Hill. He is survived by his mother, Annie Ruth Rhoads, of Charlotte, North Carolina; his sister and brother-in-law, Cheryl and Joe de Gier, of Marina, California; and his sister and brother-inlaw, Annette and David Vander Ploeg, of Glenview, Illinois. He was a loving uncle and is survived by five nephews, Peter and Martin de Gier, of Monterey, California, and David, Charlie, and Gerrit Vander Ploeg of Chicago, Illinois, as well as nine great nieces and nephews in Illinois. For many years, Margo volunteered as a tutor at Boccardo Family Living Center in San Martin, helping children with their homework. Margo also loved the outdoors, and enjoyed camping, and volunteering as a Docent at Gilroy Gardens. Rest in Peace, Margo.

judgment—and the revelations of documents showing how Dabo drained more than $640,000 from a charitable trust to his personal accounts—would have any impact on his duties as president of the county school board, or as a 23-year trustee for the county Office of Education. Dabo was elected to the county school board in 1994 and was elected board president in 2016. He is up for reelection in 2018. Carter’s ruling that Dabo’s actions with the Matulich trust violated state probate laws represented a legal victory for the Community Foundation, which filed the lawsuit against Dabo in December 2015, after three frustrating years struggling to obtain some financial accounting of the Matulich trust. Byrne said he doesn’t expect Dabo to be able to pay Monday’s judgment. Carter also ruled Monday in a separate but related lawsuit that the Community Foundation be paid an additional $35,500 by Dabo. Claims against two codefendants, Jim Morris and David Vavoulis, former Dabo business partners, were rejected by the judge, who ruled that a $40,000 loan from the trust between Dabo and Tyler was an individual loan, and did not involve the other two partners. The judge said the loan amount was part of her probate ruling, but added $35,500 in interest to the promissory note. Dabo, a licensed financial representative from 1983-1999, had been a longtime friend of Barbara and Tony Matulich when they named him the trustee of the Matulich trust. Appointed in 2008, Dabo had sole authority to manage the trust, which was established in 2001 with $750,000 and had $643,599 in 2008, according to court documents. “Clearly, he used the money personally for his own interests,” Clark told the judge on Monday. Clark walked the judge through the bank statements and canceled checks, showing a pattern of borrowing money from the trust, which “continued through his tenure until there was no money left to borrow.”

School board prez loses big court case judge at Monday’s trial with a thick evidence binder that included more than 230 pages of copies of bank statements, canceled checks and emails, which showed a multi-year pattern of electronic transfers of funds from the Matulich charitable trust to Dabo’s personal accounts. Dabo was named sole trustee of the Matulich trust in 2008, and bank statements and canceled checks showed the trust was quickly drained, except for regular deposits by Dabo to provide for $3,000 monthly payments to Barbara Matulich until her death. Bank records show Dabo even wrote several checks to the widow after her death. Dabo owns a Hollister liquor store, and the website for Dabo Financial Group continues to offer estate and financial planning services, despite the fact that Dabo has no licenses or authorized credentials for such activities. He was censured or fined on four separate occasions in 1998, 1999 and 2001 for selling securities or acting as a securities broker by the Financial Industry Regulatory Authority. Dabo listed his business address in court papers as 801 San Benito St, which is in the same building as Dabo Liquor Store. His LinkedIn profile says he is President of Dabo Financial Group, LLC and a financial planner. He advertises his business as Dabo Financial Group LLC, but the California Secretary of State has no record of an LLC or corporation with that name or for the name of Mitch Dabo Associates, a name used on some bank accounts. A limited liability corporation, Dabo Holdings LLC was formed in 2007, and has an active registration with the Secretary of State, listing Catherine M. Dabo as the sole principal and as manager. Clark told the judge Monday that Dabo had refused to produce detailed financial documents for the Matulich trust. Dabo did not appear at the 90-minute trial in Hollister. He had said in court papers he should not be held accountable for the missing funds because a former business partner had defaulted on most of a $490,000 unsecured personal loan. Bank statements presented in court Monday showed that Dabo’s loan to the late Jack Tyler and other deposits into Dabo’s personal accounts came from a charitable trust that Dabo had managed for Barbara and Tony Matulich of Hollister. Tony Matulich died in 2003; Barbara Matulich died in 2012. All remaining funds in the Matulich Charitable Trust were designated for the Community Foundation in the event of their deaths.. The judge doubled the actual damages in her ruling, because state law allows for the doubling of damages in cases where a defendant’s action are “selfdealing, serious, willful and in bad faith.” Dabo did not respond to an emailed request for comment on Carter’s ruling. Immediately after her 11am ruling, the judge asked: “Has this been referred to the D.A.?” John Clark, the Morgan Hill attorney representing the Community Foundation, said its complaints about Dabo had been passed on to local police and prosecutors for possible criminal violations. San Benito County District Attorney Candice Hooper said late last month that she would not make a decision on whether to begin a criminal investigation of Dabo’s actions until after the civil lawsuit had been resolved. New Hollister hotel holds grand opening NEW HOTEL ROOMS WILL MEAN MORE TOURISM BUCKS FOR THE CITY Nicholas Preciado Reporter

The new Fairfield Inn & Suites by Marriott held a grand opening and ribbon cutting ceremony last with week the San Benito County Chamber of Commerce and Hollister Downtown Association. “I understand that their capacity has been full and we look forward to it being full going forward,” Chamber of Commerce President Juli Vieira said at the ceremony. “We’re thankful that they’re here. We’ve already had two chamber events here since they’ve been open.” The grand opening event featured hotel tours, prize drawings and refreshments provided by Fisher’s Catering, Lighthouse 55 Bakery and Duckhorn Wine Company. The new hotel, located at 390 Gateway Drive, features 38 guestrooms, 39 suites, an indoor pool, fitness center, breakfast room, and meeting room with space for 50 guests. Each hotel room provides amenities like television and wireless, highspeed Internet. “The newly built hotel is creating a high level of enthusiasm with our team and the Marriott International brand further advances our goal of being the premier lodging facility in San Benito County,” General Manager Justin Nicholls said. “The
Marriott brand favorably positions this hotel for generating new business opportunities. We strive to be the hotel where Hollister hospitality shines the brightest.” The hotel is operated by Lotus Management Inc., a San Josebased hotel ownership, management and development company. The company represents large hotel brands like Marriott International, Choice Hotels and Wyndham Hotel Group. “We are delighted that the Marriott brand now includes Hollister, CA, which has the distinction of hosting many of the city’s top events,” said Sita Patel, regional director of operations with Lotus Management Inc. “We’re confident that the new hotel will provide both guests and the community with a vibrant hospitality experience that they’ll value.” The management company employs just under 25 people at the Fairfield Inn & Suites. Although they aren’t hiring at the moment, Nicholls said they typically accept housekeeping applications anytime. The City of Hollister first issued a building permit for the Fairfield Inn & Suites in December 2014. Then in June 2017, the Hollister City Council approved an agreement to defer the hotel’s payment of impact fees until December 22, 2018 in order for their inclusion in a Transient Occupancy Tax (TOT) incentive program. The deferment of

The city council approved the TOT program in September, with a goal for the program to provide incentives to develop quality hotels and the rehabilitation of existing hotels in the city to enhance regional tourism, provide visitorserving facilities, and assist
the city in reaching its tourism goals. Fairfield Inn & Suites by Marriott would qualify for a 50 percent transient occupancy tax rebate for ten years with a cap of $2 million, according to city staff. There’s also the possibility to extend the incentive an additional five years with a 33 percent rebate to the transient occupancy
tax, should a future city council choose to do so. Both the City of Hollister and San Benito County have positioned the region as a refreshing getaway to the hectic day-to-day life up in Silicon Valley and the Bay Area, with the Chamber of Commerce marketing the county up and down California. Hollister would gain
plenty if the TOT program is successful in bringing high-quality hotels like Fairfield Inn & Suites to the region, as well as rehabilitating existing hotels, which would further circulate tourism dollars. The program is expected to be evaluated annually and will sunset in three years, unless continued by future city council action.

San Juan Bautista mayor tries to oust top planner COUNCILMAN WARNS OF POSSIBLE BROWN ACT VIOLATIONS Nicholas Preciado Reporter
San Juan Bautista Mayor Chris Martorana this week tried and failed to remove city Planning Commission Chairman John Hopper from the planning body without cause. In its public discussion of the mayor’s proposal at a special meeting of the San Juan Bautista City Council, council members revealed what one member called a possible violation of the Ralph Brown Act, which prevents secret or informal meetings of members of elected bodies. Near the end of the Nov. 8 meeting, Martorana made a motion to remove Hopper without
cause—allowable under city code—near the end of the meeting. The item originally had been earlier on the agenda, but Martorana moved it to the end of the meeting, anticipating a lengthy debate. “Why are you doing it?” asked Councilman John Freeman. “Specifically to you, mayor. I’m really curious: Why?” City Attorney Deborah Mall interceded to advise that the night’s action was without cause. She added the council could vote to remove Hopper, because planning commission members serve at the pleasure of the council. Freeman wasn’t having it, and spoke of a meeting he had with Vice Mayor Jim West a couple weeks before Wednesday night’s special meeting. “I went over to a certain councilman’s house, Councilman West,”
Freeman said. “We talked for a while and he stated he had talked to another city council member. He didn’t say who, but it doesn’t matter. Brown Act violation right there.” The violation Freeman referred to is what is known as a serialized meeting, in which a string of meetings, emails or phone calls constitutes a group meeting. The Brown Act, which promotes government transparency in California, prohibits members of public bodies from engaging in communication among themselves outside of a public meeting that leads to a concurrence for an action to be taken. West responded to Freeman by saying there was no conversation, but later changed his answer and said he didn’t remember a discussion taking place. Residents spoke in support of Hopper and chastised the
council during public comment. “Not giving us a reason why is an easy way out for you all,” resident Elia Salinas said. “Your constituents deserve to know why you’re doing this.” Hopper spoke during public comment as well and explained his side of things. “I had a meeting with one of our city council members and he said to me that because I am anti-growth and because of the position and stances that I take, this was an issue and they were going to try to get other people on the planning commission that were more favorable towards growth,” Hopper said. “One of those was appointed tonight.” Earlier in the evening, the San Juan Bautista City Council accepted the resignation of Andy Moore from the planning commission. Councilman Tony Boch appointed David
Medeiros to fill the vacancy. Hopper has lived in San Juan Bautista for just over 25 years and moved to the city after a career in law enforcement. He also served on the planning commission for six years in a separate term before going to serve on the city council for eight years. He addressed why he thought council members attempted to remove him. “They believe that my leadership style conflicts with the matter in which they believe I should conduct myself,” Hopper said. “A city council member said to me he felt that I was acting like it was my planning commission, that my anti-growth position shouldn’t be influencing the entire planning commission and driving decisions. That’s the rootcause of why this is happening.”

If the Anzar High football team wins an 8-man Mission Trail League championship in the future, it will look back to the 2017 season as the beginning of that title journey. When Chace Miguel graduated from San Benito High in June 2015, she had already made up her mind that she wasn’t going to continue her soccer career— much to the dismay of Hartell College women’s soccer coach Ivan Guerrero. “When I first recruited her, she told me she was done with soccer,” Guerrero said. Later that fall, when Guerrero was watching San Benito High to start recruiting another freshmen class, Miguel, who was the assistant coach of the Balers’ junior varsity team, approached Guerrero with a different tone. “She told me she wanted to
play again,” he said. “I was pretty happy with her decision.” And with good reason. Miguel, who on Monday was named the Coast Conference Player of the Year along with earning All-NorCal First Team honors, finished the regular season with 23 goals and seven assists. Her goal output was good for fourth in the state and established a new single-season Hartnell record. The Panthers earned the No. 16 seed in the NorCal playoffs and hosts No. 17 Foothill on Thursday at 2 p.m. It’s been a spectacular season for Miguel, the former Balers standout who made the switch to playing forward at Hartnell after spending her entire career as a midfielder. The transition wasn’t easy; however, in time Miguel developed into a potent scoring threat. For Miguel, the adjustment was tougher in terms of the mental aspect. “I’ve always had a pass-first
mentality, so it was a big change to go from that to a score-first mentality,” she said. “And because the team needed me to score, it was tough at first having all the pressure on you to make sure the team scores goals.” As Miguel started to take charge as the season went along, Guerrero knew Miguel would have a special season. “Chace had a hard time being a bit selfish,” he said. “I told her if she has a goal-scoring opportunity, she needs to look to score instead of making the pass because she is the better option. We needed her to have that killer mentality inside the box and not be afraid to miss.” Miguel didn’t miss often— at least not when you judge it by soccer shooting percentage standards. “If you’re scoring on 33 percent of your shots, any coach will take that,” Guerrero said. “And
that’s what Chace was doing.” Athletic, agile and fast, Miguel had to get used to the rigors of the college game after being a year away from the sport. Once Miguel overcame an injury her freshman season—which caused her to miss five games—Guerrero started to really coach up Miguel on the finer points of the game. “It wasn’t so much about playing at Hartnell, but setting her up to play at the four-year level,” he said. “We’ve been demanding and strict to get her out of her comfort zone. Her skills alone will not get her playing time at the next level, but doing the little things will.” With that, Miguel started to work on timing her runs, where to make her runs and defending as a forward. Off the field, Miguel continued to be diligent in the weight room and doing extra drills on her own. “It’s been a good journey for ➝ Miguel, page 21

In any one game, Eugene McBride could play any one of three positions—nose guard, tackle or end—on the defensive line. The responsibilities are different for every position, but what it takes to play them remain the same: determination, intensity and hard work. McBride, a San Benito High senior, possesses those attributes in abundance. He has to. Haybalers coach Bryan Smith said McBride plays twice his size—at 5-foot-11 and 215 pounds, McBride routinely goes up against bigger offensive linemen—and has the “heart
of a champion.” It’s no wonder the Balers (6-4) have had another solid season, earning the No. 4 seed entering Friday’s Central Coast Section Open Division I home playoff game against No. 5 Menlo-Atherton (6-4). “We’re fortunate to have another home game because we weren’t expecting that,” McBride said. “We know that we’re a little outsized, but that won’t stop us. We have to be more physical, outplay them and not be lazy.” McBride will never be mistaken for being lazy on the field, as he literally takes on a different persona on game day, playing with a controlled fury. Coming off solid season, Hawks eye future goals and Paul Martinez, along with Chris Winterbottom, also made contributions in their first year of playing organized football. “The core seniors set a great example all year with their effort in practices and games, and showed the young guys what it means to truly commit yourself to a team,” Kosmicki said. “It’ll be hard to replace their attitude and commitment levels, but I’m confident we can do so because they set that foundation. Without those core guys, we couldn’t have turned some of the corners we turned as a program in 2017 as we move toward building something special at Anzar and establishing a new culture here. “We couldn’t have had the kind of buy-in from the underclassmen that will really benefit the program going forward, so I want to give special thanks to those senior guys. I’ll miss each of them greatly, but they’re always welcome around the team and will always be part of the Anzar football tradition.” Despite losing several starters, the Hawks will return their entire offensive line in Rafael Magana, Jose Pineda and Ben Minard. Linebacker/defensive ends Antonio Aguilar and Brian Munoz also will be seniors next season and provide speed and toughness. Junior cornerback/
receiver Logan Le Don also made plays on both sides of the ball. Isaiah Garcia was also another player who played inspiring ball. Of course, Greg Arispe was the biggest playmaker on the team, and Kosmicki said he can’t wait to see what the junior does next season as a running back, quarterback and cornerback. “Outside of his tremendous speed and sheer football instincts, what initially jumped out for me was his toughness,” Kosmicki said. “Early on in camp, I gave him the nickname “All Day” because he brought a certain level of consistent grit and effort to every practice, particularly hitting drills. Nobody brings Greg’s consistent level of intensity.” Kosmicki is particularly encouraged with the freshmen who made contributions, including Alan Cruz, Raul Pantoja and Brent Stofer. The trio is the next generation of Anzar players who will be looked upon to further fortify Anzar’s march toward the upper tier of the MTL. Kosmicki said he’s also excited about the return of sophomores Jorge Chavarria and Nick Nickerson. Chavarria has plenty of athleticism and potential, and jumps out on film, Kosmicki said. Coach Kollin Kosmicki said his No. 1 off-season priority is to implement a regimented strength-training program—an absolute must in the world of high school football. That’s something Anzar hasn’t traditionally taken part of in the past. “We don’t necessarily tend to have the natural physical stature of some other teams, so we’ll need to make up for it with a yearlong commitment to physical fitness,” Kosmicki said in an email to the Free Lance. “I said from day one to these guys that Anzar football will be tough, and we certainly were in 2017. Having consistent toughness, commitment and discipline were my mantras all season. We were successful on all fronts, and I only expect improvement in 2018.” Kosmicki credited assistant coaches Matt Lindholm, Felipe Davila and Felipe Davila Jr. for being instrumental in different facets of the program, including summer workouts, organizational skills and game planning. In terms of the players, Kosmicki said the team’s graduating seniors will all be missed, most notably Hector Jimenez, Kevin Jimenez, Jake Lindholm, Addam Banuelos, Jonathan Rocha, Marco Galvez and Jesus Estrada. Off record year, Chace Miguel earns Coast Conference Player of the Year possession before unleashing a shot to the upper right corner of the goal, a laser of a shot that impressed Miguel herself. “Right when I hit it, I knew it was going in,” she said. “I thought to myself, ‘Oh my gosh, that was an amazing goal.’ That goal was probably the best I’ve scored in my whole life.” Miguel credited Guerrero, assistant coach Ivan Campos and conditioning coach Hugo Gonzalez for helping her become one of the premier players in Northern California. Guerrero and Campos helped her with the mental and technical aspects of the game, while Gonzalez made sure Miguel
would stay focused from a physical standpoint. “Hugo made sure we were on our stuff all the time,” she said. “Whenever we had a bye week, he would really lay into us to make us stronger. I could feel the difference.” Guerrero feels confident that Miguel will be playing at a four-year school next year. Miguel said she’s going to stay in California, as she’s not interested in heading out of state. Whatever happens, Miguel has already achieved her potential at the competitive community college level, having made an impressive transformation from a midfielder to a goalscoring forward.

ORDINANCE NO. 1142 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HOLLISTER ADDING CHAPTER 9.30 REGULATING SHOPPING CARTS WHEREAS, the Council finds that the accumulation of wrecked, dismantled and abandoned shopping carts, or parts thereof, on public or private property, create conditions that impede emergency services, reduce property values, promote blight and deterioration, comprise an attractive nuisance, create potential hazards to the health and safety of the community, and interfere with pedestrian and vehicular traffic within the City; and WHEREAS, the Council further finds that wrecked, dismantled and abandoned carts are injurious to the health, safety and general welfare of the public and are aesthetically detrimental to the community and are therefore a public nuisance; and WHEREAS, businesses have the option of whether or not to provide shopping carts to their shopping customers, and by providing such an option to their patrons, should accept the responsibility for the availability, control, condition and disposition of the carts; and WHEREAS, California Business & Professions Code (“B&P Code”) section 22435.7(a) provides that shopping cart retrieval has been declared by the Legislature to be a matter of statewide concern and the comments, complaints and actions of Hollister residents have demonstrated their concern with the regular appearance of shopping carts off-premises of local stores and abandoned in public rights-of-way to the detriment of public health, safety and quality of life; and WHEREAS, B&P Code section 22435.8 further provides that “[t]his article shall not invalidate an ordinance of, or be construed to prohibit the adoption of an ordinance by a city, county, or city and county, which ordinance regulates or prohibits the removal of shopping carts or laundry carts from the premises or parking area of a retail establishment except to the extent any provision of such an ordinance expressly conflicts with any provision of this article”; and WHEREAS, under B&P Code section 22435.8 cities have been given authority to adopt ordinances which require businesses to maintain a mandatory containment system whereby one or more physical measures will be taken by the business to prevent the removal of carts from their premises; and WHEREAS, the provisions set forth below will relieve the City from the detrimental effect of this public nuisance and are not in conflict with California Business & Professions Code Section 22435 et. seq. THE CITY COUNCIL OF THE CITY OF HOLLISTER DOES ORDAIN AS FOLLOWS: SECTION 1. Chapter 9.30 ADDED. Chapter 9.30 is hereby added to Title 9 of the Hollister Municipal Code as follows: Chapter 9.30 SHOPPING CART CONTAINMENT 9.30.010. Definitions. 9.30.020. Findings and purpose. 9.30.030. Applicability. 9.30.040. Unauthorized removal prohibited. 9.30.050. Cart identification and warning signs. 9.30.060. Measures to prevent the removal of carts from business premises. 9.30.070. Mandatory cart containment plan. 9.30.080. Fees. 9.30.090. Plan approval or denial and penalties. 9.30.100. Plan modification.9.30.110. Enforcement. 9.30.120. Retrieval notification. 9.30.130. Administrative costs and fines. 9.30.010 Definitions. The definitions set forth in this part shall govern the application and interpretation of this chapter.(1) “Abandoned cart” means any cart that has been removed, without written consent of the owner, from the owner’s business premises and is located on either public or private property, including but not limited to public parks, streets, sidewalks and alleys.(2) “Agent” means the person or persons designated in the cart containment plan who the owner of the cart authorizes as the person(s) to perform or provide retrieval services on behalf of the owner.(3) “Business establishment” means any business located in the city, regardless of whether the business is advertised or operated as a retail or wholesale business, and regardless of whether the business is open to the general public, a private club or a membership store.(4) “Cart” or “shopping cart” means a basket which is mounted on wheels or a similar device generally used in a business establishment by a customer for the purpose of transporting goods of any kind. The term “cart” or “shopping cart” includes a laundry cart.(5) “Cart containment plan” means a document submitted by the owner of the cart pursuant to Section 9.30.070 of this chapter.(6) “City” means the City of Hollister.(7) “Director” means the director of public works or community development for the City of Hollister, or the director’s designee.(8) “Officer” means any person designated by the director to enforce the provisions of this chapter.(9) “Owner” means any business establishment that owns, leases, possesses, or makes a cart available to customers or the public. For purposes of this chapter, owner shall also include the owner’s agent.(10) “Premises” means the entire area owned, occupied, and/or utilized by an owner which provides carts for use by customers or other persons, including any parking lot or other property provided by or on behalf of the owner for customer parking or use. 9.30.020 Findings and purpose.(a) Abandoned carts constitute a nuisance, create potential hazards to the health and safety of the public, and interfere with pedestrian and vehicular traffic. The accumulation of abandoned carts on public and private property tends to create conditions that reduce property values, and promote blight and deterioration.(b) The intent of this chapter is to ensure that measures are taken by owners to prevent the removal of carts from business premises and to facilitate the retrieval of lost, stolen or abandoned carts in a manner that complements and supplements provisions of state law. 9.30.030. Applicability.This chapter shall apply to all owners within the City of Hollister that provide carts for customer use or the public. 9.30.040. Unauthorized removal and possession prohibited.It shall be unlawful for any person to do any of the following:(a)To remove a shopping cart from the business premises of its owner with the intent to temporarily or permanently deprive the owner of possession of the car;(b) To be in possession of a shopping cart that has been removed from the business premises of its owner with the intent to temporarily or permanently deprive the owner of possession of the cart;(c) To alter, convert, or tamper with a shopping cart, or to remove any part or portion thereof; or to remove or alter the serial number on a shopping cart; or to be in possession of any shopping cart with serial numbers removed, obliterated or altered, with the intent to temporarily or permanently deprive the owner of possession of the cart; and (d) To possess, use, leave or abandon a shopping cart at any public or private property, including public parks, sidewalks, alleys and streets, other than the business premises of the owner of the shopping cart, with the intent to temporarily or permanently deprive the owner of possession of the cart. (e) Any person who violates the provisions of this Article is subject to enforcement procedures permitted by law, including but not limited to prosecution of a misdemeanor or infraction, civil action for injunction, administrative citations and enforcement procedures, and revocation of a use permit, if applicable. 9.30.050 Cart identification and warning signs.(a) Every cart owned or provided by any owner must have a sign permanently affixed to the cart that contains all of the following information:(1) Name of cart owner.(2) The address or valid telephone number of the cart owner.(3) Notice to the public that the removal of the cart from the premises is a violation of state law.(4) Notice that carts may not be removed from the premises without the express written consent of the owner.(b) Every owner must post and maintain cart removal warning signs at all customer interior exits which meet all of the following minimum specification:(1)Contains a statement in one or more languages that unauthorized removal of a shopping cart from the business premises is a violation of state law.(2) Be conspicuously and prominently displayed on the interior walls of the building within two feet of all customer exits. 9.30.060 Measures to prevent the removal of carts from business premises.(a) Within one hundred eighty (180) days of the effective date of this chapter, owners shall implement measures to prevent the removal of carts from the business premises. Examples of these measures may include but are not limited to:(1) Increased signs directing customers not to remove the carts from the premises.(2) Employee assistance to carry purchases for the customer.(3) Providing personal carts for customers for rental or purchase.(4) Physical barriers located at doors, near loading areas orother defined perimeters that will prevent the passage of carts beyond the premises barriers. The physical barriers may also be placed on the carts themselves so that the carts cannot pass though door openings or other defined perimeters.(5) Electronic disabling devices on all carts, which are activated when they cross a barrier at the perimeter of the premises.(6) Any other reasonable containment measure that has been proven to be successful.(b) An owner must implement an effective combination of the measures described in subsection (a) in order to prevent the removal of carts from business premises. 9.30.070 Mandatory cart containment plan.If after one hundred eighty (180) days of the effective date of this chapter, five (5) or more carts in one seven (7) day period are discovered off-premises, the owner shall be issued a warning notice that the provisions of this chapter must be observed. Only one warning notice per calendar year shall be issued to an owner. After the warning notice is issued any subsequent occurrence in which five (5) or more carts in one seven (7) day period are discovered, the owner shall be required to submit a mandatory cart containment plan to the designated code enforcement officer for review and approval. The mandatory cart containment plan shall include the following elements:(a) Name of Owner. The name of the owner, the physical address where the business is conducted, name, address and phone number(s) of the onsite and off-site owner if different.(b) Inventory of Carts. A complete list of all carts maintained on or in the premises.(c) Community Outreach. A description of a community outreach process under which the owner shall cause notice to be provided to customers that the removal of carts from the premises is prohibited and is a violation of state and local law. This notice may include, but is not limited to, flyers distributed at the premises, warnings on shopping bags, signs posted in prominent places near door and parking lot exits, direct mail, announcements using intercom systems at the premises, web site or other means demonstrated to be effective to the reasonable satisfaction of the director. Any and all posting of signs shall comply with the provisions of the Hollister Municipal Code and shall be posted in multiple languages as necessary.(d) Cart Identification. Signs and cart identification requirements which conform to local and state law.(e) Loss Prevention Measures. A description of the specific measures that the owner shall implement to prevent cart removal from the premises. These measures may include, but are not limited to, electronic or other disabling devices on the carts so they cannot be removed from the premises, effective management practices, use of courtesy clerks to accompany customers and return the carts to the store, use of security personnel to prevent removal, security deposit for use of cart, or other demonstrable measures acceptable to the director that are likely to prevent cart removal from the premises. The plan must contain at least one physical containment measure.(f) Employee Training. A description of an ongoing employee training program that shall be implemented by the owner and that shall be designed to educate new and existing employees on the abandoned cart prevention plan and conditions contained therein no less frequently than annually.(g) Mandatory Cart Retrieval. A plan for retrieval of abandoned carts by the owner within twenty-four (24) hours. 9.30.080. Fees.Every owner who is required to submit a mandatory cart containment plan or an application for a modified cart containment plan pursuant to this chapter shall submit with the plan or plan modification, a fee for review of the plan or plan modification in the amount set forth in the schedule of fees established by resolution of the City Council.9.30.090 Plan approval or denial and penalties.(a) The officer may approve or deny the proposed plan and notify the owner of such decision within thirty (30) days of receipt. If approved, the cart containment plan shall be implemented by the owner no later than thirty days from the date of approval.(b) A plan may be denied based upon one or more of the following grounds:(1) Implementation of the plan violates any provision of the building, zoning, health, safety, fire, police or other provision of this code or any county, state or federal law which substantially affects public health, welfare, or safety in this chapter.(2) The plan fails to include all of the information required by this chapter.(3) The plan is insufficient or inadequate to prevent removal of carts from the premises.(4) The plan fails to address any special or unique conditions due to the geographical location of the premises as they relate to cart retention and prevention efforts.(5) Implementation of the plan violates a term or condition of a plan or other requirement of this title.(c) The owner knowingly makes a false statement of fact or omits a fact required to be revealed in an application for the plan, or in any amendment or report or other information required to be made. If the plan is rejected as incomplete or inadequate, the officer shall indicate areas of incompleteness or inadequacy, and the owner shall have an additional thirty days in which to resubmit a complete and adequate plan.(d) An owner who fails to submit a complete plan to the satisfaction of the officer, or fails to implement approved plan measures or fails to comply with the approved plan measures will be subject to enforcement of these requirements through any lawful means available to the city, including without limitation institution of the administrative remedies process pursuant to this chapter.(e)The officer’s decision to deny a plan may be appealed to the director.(f) The decision of the director to approve or deny a plan is final. 9.30.100. Plan modification.At any time after the officer’s approval of any abandoned cart plan, the owner may submit to the officer, along with the appropriate fee, a modification of the previously approved plan to address a change in circumstances, address an unanticipated physical or economic impact of the plan or modify an inadequate or ineffective plan. 9.30.110. Enforcement.This chapter shall be enforced by the Code Enforcement Division of the City of Hollister, or such other department designated by the city manager to administer this chapter. 9.30.120. Retrieval notification.The city shall notify the owner of an abandoned cart as identified on the signage information permanently affixed to the cart. The city notification shall be documented and provided either by telephone or by written notice. The notification shall require that the identified cart(s) be retrieved pursuant to the conditions for retrieval under state and local law. The City may immediately dispose of any abandoned cart that lacks an identification sign required by this Chapter. 9.30.130. Administrative costs and fines.Pursuant to Business and Professions Code section 22435.7, any owner that fails to retrieve its abandoned cart(s) after receiving the three-day notice by the city, shall pay the city’s administrative costs for retrieving the cart(s) and providing the notification to the owner. Consistent with state law, any owner who fails to retrieve abandoned carts in accordance with this chapter in excess of three times during a specified six-month period shall be subject to an additional $50.00 fine for each occurrence. An occurrence includes all carts owned by the owner found off-site in a one-day period. SECTION 2. CONSTITUTIONALITY; SEVERABILITY. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, subsection, sentence, clause and phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid. SECTION 3. EXEMPTION FROM CEQA. The City Council finds, pursuant to Title 14 of the California Code of Regulations, Section 15061(b)(3), that this ordinance is exempt from the requirements of the California Environmental Quality Act (CEQA) in that it is not a Project which has the potential for causing a significant effect on the environment. SECTION 4. EFFECTIVE DATE. This ordinance shall be in full force and effect thirty (30) days from and after the date of its adoption. SECTION 5. POSTING AND PUBLICATION. The City Clerk is directed to cause publication once in the official newspaper for publication of legal notices of the City of Hollister, of a notice setting forth the date of adoption, and the title of this ordinance within fifteen (15) days after adoption of this ordinance.
