Cops spread joy with holiday bike giveaway MORE THAN 90 BIKES, HELMETS DISTRIBUTED TO LOCAL STUDENTS Roseann Hernandez Cattani Editor
The Hollister police station was transformed into Santa’s grotto on Saturday as more than 90 bikes and fitted helmets were distributed to local students. This is the fourth year the local police has hosted the bike giveaway. “It started as an idea I had the first year I was chief to help kids, not just in Hollister but the whole county,” said Hollister Police Chief David Westrick. “I think that every kid should have the opportunity for a new bike at least once, no matter what.” For the last three years of the initiative, the Hollister police has teamed up with San Jose-based charity, TurningWheels for Kids, which builds and donates bikes to children in the Bay Area. Earlier this month, the organization hosted a bike building workshop where up to 2500 bikes were constructed by approximately 1000 volunteers and later distributed to 40 area nonprofits to give the bikes away to children in need. In its 13 years of operation the group has given away more than
35,000 bikes, according TurningWheels for Kids co-founder, Nancy Huff. A group of Hollister police, youth in the Explorer program and department staff and family members attended the bike building event. In addition to the bikes from TurningWheels, the local contingent collected donations from people and businesses in San Benito County. “We brought a ton of donated bicycles and helmets,” said Westrick. Central Ag Supply, Cold Storage Crossfit, Whiskey Creek, Cheap Seats, Enterprise Academy of Martial Arts and many other local private donors readily gave. “Not only did they provide a bike build team, some of the officers went to load the bikes,” said Huff. “[Chief Westrick] put a challenge out to the community and local businesses to provide in-kind donations—we have a raffle to raise money for next year to buy bikes—and they brought with them several baskets for gifts that Hollister businesses donated. That was going above and beyond and we appreciate that.” On Saturday, a line formed outside the station door at 8am, the
kids were ready and excited to collect their new bike. The police department asked teachers in Hollister schools to nominate kids who they believed would benefit from a new bike. All of the names were then entered into a drawing and randomly selected by raffle. There were an assortment of bikes to giveaway: pink ones, racing ones, cruisers, aqua blue ones with sparkly tassels dangling from the handle bars. All came with a big, red bow. Safe Kids Partners, a collaboration of various agencies involved in health, recreation and public safety, provided safety lights for each bicycle and helped fit each child with the appropriate helmet. “I do it, because I can and I have a staff that also believes we should give hope and help where we can,” said Westrick. “We don’t do it to be recognized or anything. We do it, because it’s the right thing to do. We love people, it’s why serve.” It is also just a lot of fun. “It’s always fun to see them come in with a big smile on their face,” said Carlos Rodriguez, one of three school resource officers that patrol Hollister schools.

Krystal Lomanto on Dec. 1 in an email obtained by the Free Lance in a public record request. “I will resign my position. I just don’t know when I’ll do it.” Dabo sent the email to Lomanto the same day that the Free Lance reported that San Benito County District Attorney Candice Hooper would investigate possible criminal fraud or theft charges against him, once she obtained evidence from a Nov. 13 civil trial. That Superior Court trial in San Benito ended with a ruling that Dabo violated state probate laws and diverted money from a charitable trust to his own accounts, denying the Community Foundation for San Benito Country more than $640,000 in money for local charities. Dabo told the Free Lance last week that he would not seek reelection by his fellow trustees to a third consecutive year as president of the school board, but stopped short of saying he would quit the board, where he has served for 34 years. Aside from the resignation statement, most of the content of three emails sent by Dabo to Lomanto in October, November and December was hidden under thick black lines – “redacted” – by Lomanto in “the public interest.” The redactions included most of an Oct. 24 email, all of a Nov. 24 email, as well as most of the Dec. 1 email from Dabo, and all of a Dec.2 response from Lomanto. The only statements by Dabo not hidden by Lomanto’s black marker pen indicated Dabo’s concern for his reputation and that of the county Office of Education, which he said was “under attack.” “Thanks for all your support,” he wrote Lomanto.
The school superintendent responded to a Free Lance request by sending copies of 27 emails to or from Dabo over a six-week period, 18 of which were routine board communications from the board secretary. Lomanto justified her redactions of most of her exchange with Dabo before and after the civil trial as serving the public interest. There was no reference in the un-redacted text to his absences from two board meetings or his decision to not seek reelection as president. “A portion of the records have been redacted as they contain information not disclosable under Government Code…as they are not ‘public records,” she said in a letter to the Free Lance accompanying the emails. She said she was justified in redacting public records for public view “if the public interest served by not disclosing the records clearly outweighs the public interest served by disclosing the records.” The California Constitution, Article 1, Section 3, b (1) states that “The people have the right of access to information concerning the conduct of the people’s business, and, therefore, the meetings of public bodies and the writings of public officials and agencies shall be open to public scrutiny.” The school board’s attorney, Matthew P. Juhl-Darlington of conChico, CA, tends that Lomanto was “required to make” the redactions in the emails before releasing them. He also wrote that “Mr. Dabo’s privacy would be violated if certain email communications had not been redacted.” When asked to identify the specific section of state law used to to justify each redaction, Lomanto deferred to her attorney, who wrote, “To be clear, the [County Office of Education] is not required to create
a list of specific exceptions tied to each specific redaction,” citing a 2001 court decision. The California First Amendment Coalition disagrees, stating that the numerous exemptions allowed by the California Public Records Act are not mandatory, but up to the discretion of the public official or public body. Juhl-Darlington, in response to a Free Lance question, said the question of blocking content in the released emails did not come up before the full school board. “Since the [California Public Records Act request was sent to your office,” he wrote Lomanto this week, ”then you as the County Superintendent of Schools was responsible for producing responsive records per Mr. Holtzclaw’s request, and making redactions per advice from the [County Office of Education]’s legal counsel.” Dabo did not attend board meetings on Nov. 30 or Dec. 14, when Joan Campbell-Garcia was elected the new president. He also did not attend the Nov. 13 trial, saying he could not afford an attorney. The Hollister Police Department earlier this month opened its own criminal investigation, and received a binder of evidence of – canceled checks, bank statements and court documents – from District Attorney Candice Hooper showing withdrawals of money from the Matulich Charitable Trust by Dabo. The evidence, presented at the trial of Dabo’s civil lawsuit by the Community Foundation for San Benito County, had been delivered to Hooper by the Free Lance. A Superior Court judge on Nov. 13 awarded the foundation $1.74 million in damages, plus legal fees estimated at $85,000. The final court papers ordering Dabo to pay the judgment had not yet been filed this week.

Mitchell Dabo’s departure from public life is overdue
M
itchell Dabo is leaving the San Benito County Board of Education. At least he said three weeks ago that he would. The
sooner the better. He could have announced his plans to resign when he told us last week that he would not seek to be returned as board president. But he didn’t. The 34-year public servant could have told his constituents, the taxpayers and voters of San Benito County, of his plans. But he didn’t. He could have resigned five weeks ago when Superior Court Judge Marjorie L. Carter slapped him with a $1.74 million judgment and affirmed facts that he violated state probate laws by moving more than $640,000 from a charitable trust fund to his personal accounts. But he didn’t. He could have resigned from the board when the Community Foundation first filed the lawsuit, seeking the funds promised to San Benito charities by the late Tony and Barbara Matulich. Mr. Dabo knew at the time that he had been caught red-handed, and could have saved this community and his school board colleagues embarrassment. But he didn’t. For that matter, when a series of enforcement actions by the federal Financial Industry Regulatory Authority censured him on four separate occasions in 1998, 1999 and 2001, finally pulling all of his certifications for selling securities or acting as a securities broker for violating federal regulations, he could have resigned. But he didn’t. Mr. Dabo hasn’t said when he will retire. Perhaps he is waiting for the outcome of the Hollister police investigation, or the inspection of his accounts by a forensic accountant hired by the district attorney. If he is eventually charged with crimes, he might say that he wants to wait until after a verdict, or after an appeal – or after sentencing, before resigning.

Mr. Dabo complained to Krystal Lomanto, superintendent of the county Office of Education, that he and the school board were “under attack.” By whom? The Matulich Charitable Trust? The Community Foundation? The Free Lance, which simply reported the details of the court case? We don’t know what Supt. Lomanto said to Mr. Dabo. We don’t know if she encouraged him or discouraged him with regard to his board status. We do know that he thanked her for her support. Or more accurately, for her public silence, since she and Mr. Dabo’s fellow trustees have chosen to say nothing to reassure the citizens of San Benito County that public trust is more important than cronyism.
Mr. Dabo should resign immediately. Give us a break. Give the county school board a chance to get back to business. We don’t know much of what he said to Ms. Lomanto, either, because she ran her black marker over most of the email content before sending the public documents to us. In doing so, she chose to define the public’s interests as her own private interests, at the expense of the public’s right to know what elected public officials are saying about their public responsibilities. Mr. Dabo should resign immediately. Give us a break. Give the county school board a chance to get back to business. Give Ms. Lomanto a chance to put down her black marker and restore transparency to the Office of Education. Give prospective candidates an opportunity to file for his vacant seat. That would be a great holiday gift and a great way to start the New Year.

During a suspicious vehicle investigation on Fairview Road two people were found to have warrants out for their arrest. Both suspects were arrested, transported and booked into county jail.
December 2, 2017 Suspect on Comienzo Drive was contacted during a traffic enforcement stop. Upon conducting a driver license and warrant check of the suspect, county communications revealed that the suspect had a confirmed misdemeanor arrest warrant and also a suspended driver license. Suspect was arrested and booked into county jail.
A relative who lives in Los Angeles reported her mother missing under suspicious circumstances. Further investigation at Monte Cristo Court revealed the missing person’s husband and a female referred to by the husband as a cousin, however, she was unknown to the daughter. Leads were developed to show there was a likelihood the missing female had been killed. A search warrant was authored and was served on December 6. The Federal Bureau of Investigation Evidence Response Team and Santa Clara County Human Remains Detection dogs and their handlers assisted. Evidence was located to suggest the female was killed. Both the husband, Sang Ji and female, Jung Choi, were considered suspects. Ji and Choi were both arrested and booked at the San Benito County jail on charges of murder. As of December 18,

December 5, 2017 Unknown suspect threw a bottle at the victim’s vehicle causing minor damage to the rear trunk lid. Reported on Enterprise Road.
Suspect was contacted for a suspected domestic dispute between him and girlfriend. Suspect appeared to be intoxicated with alcohol and being boisterous. Suspect ran rom law enforcement during initial contact but was later captured. Suspect was arrested, transported and booked to county jail.
December 8, 2017 Driver was cited for multiple vehicle code violation on Highway 25. Stolen vehicle recovered on San Felipe Road. During a traffic stop on Hawkins Street, the passenger was found to have two misdemeanor warrants for their arrest. Suspect arrested and transported to county jail. Cellphone located on Toro Drive and turned over to Sheriff’s Office. Owner of lost cell phone was located and turned over.

ernida Jones, of Morgan Hill, California, died peacefully on December 18, 2017. She lived in Morgan Hill for the past 46 years. Vernida continued her career as a hairdresser for several years before she retired.

City leaders put a halt to non-medical cannabis URGENCY ORDINANCE WILL BE VALID FOR 45 DAYS Nicholas Preciado Reporter
The Hollister City Council focused on cannabis operations once again as elected officials on Monday enacted an urgency ordinance that prohibits recreational cannabis business operations within city limits for a period of time. City leaders also approved a manufacturing permit for a medical cannabis business on Industrial Drive and denied the appeal of a dispensary applicant who failed to receive a permit from the council in September.
Urgency ordinance
The city council unanimously approved an urgency ordinance that prohibits cultivation, processing, manufacturing, distribution, testing and sale of non-medical cannabis in the City of Hollister. The urgency ordinance is valid for 45 days. “Staff will be coming back to
you either with findings to continue this particular ordinance or the real goal here is to provide you with enough information for you to adopt a permanent ordinance relating to the adult use of cannabis,” City Manager Bill Avera told the council. The city council approved a medical cannabis ordinance in December 2016. Since then, the city has approved two medical dispensaries within city limits, as well as a multitude of cultivation, manufacturing and distribution businesses. Residents and local cannabis businesses turned out at the Monday night meeting to voice their opinions on the urgency ordinance. John Kolodinski of High Class Distribution and YHL, Inc. mentioned the financial impact on local cannabis operations. “If we’re restricted as a producer to only work in the medical market, that would affect our ability to generate revenue,” Kolodinski said. “We hope you consider the implications of restricting our operation.” The urgency ordinance had support from numerous
residents, including Steve Becerra. “They came to you before and said they wanted to provide medicine for people and tonight we’re seeing a different shirt,” Becerra said. “Tonight we’re seeing what it’s really about in the future: recreational marijuana.”
Cannabis comes to Industrial Drive
Medical cannabis business Euphoric Life, Inc. received a permit to operate a manufacturing facility at 807 Industrial Drive, but relinquished a cultivation permit at the same location after public outcry over the location. The business will manufacture transdermal, adhesive pain patches that utilize cannabidiol, or CBD, a cannabis compound with health benefits that doesn’t get the user high as is the case with tetrahydrocannabinol, or THC. Additionally, the location was owned and recently sold by a trust where a member of Vice Mayor Karson Klauer’s family is a beneficiary. Klauer recused himself from the item.
Residents came to speak out against the proposed location for Euphoric Life at Monday night’s meeting. “I just want to reiterate again that we still have children, we still have families and we still have been there in that facility for 25 years,” said Lisa Rovella of Rovella’s Gym. “So we’ve built our business, we’ve gone through all of the things we needed to go through to keep our business and to accommodate the healthy lifestyle. We have to fight again to remain a healthy choice in our community.” In August, the city council denied three cannabis permit applications from Layla’s Landing, who intended to operate at 817 Industrial Drive mere feet away from Euphoric Life’s location. The permit denial came after members of the public raised concern over the site’s proximity to places where youth gather, such as Crossfit San Benito and Rovella’s Gym. Euphoric Life Owner Dr. Ahmad Rafii, a doctor of chiropractic medicine for over 25 years, said he attended the August city council meeting where the initial uproar over 817 Industrial Drive occurred. After some questions
from the council, Rafii said he would be willing to defer a cultivation permit and just stick with a manufacturing permit. Pinnacle Strategy President Victor Gomez, speaking as a representative for Euphoric Life, argued in favor of allowing cannabis manufacturing facilities on Industrial Drive. “When it comes to manufacturing, the question about location is over,” Gomez said. “The city council adopted an ordinance that included Industrial Drive. The argument whether this is a good location for cannabis or not is really irrelevant, because the council already adopted and said Industrial Drive is going to be cannabis-friendly. Even with the investments that have been made, my client is willing to defer the cultivation component, but we believe that the manufacturing component is 100 percent consistent with the industrial zoning use and also the cannabis zoning use as well.” The medical cannabis business ended up receiving a manufacturing permit with a 3-1 vote. Mayor Velazquez was the sole dissenter.

Campbell-Garcia said, only so far as the board has had to keep repeating that they have no jurisdiction over what Mr. Dabo does. “Some people seem to think the superintendent can fire him or we can fire him, that is ridiculous. That’s not just the way it works,” she said. To the best of her knowledge, Campbell-Garcia said Dabo had not resigned from the board. “We focus on the business at hand,” she said.

The emotion-laden notes of “Taps” fill the air as Joe Ostenson plays his bugle outside the mausoleum. country at more than 1,200 memorial sites like this one, people are gathered as one nation to remember, honor and teach,” began Juli A. Vieira, president of the San Benito County Chamber of Commerce. Called Wreaths across America, the memorial service takes place every year on December 16. County to hire lobbyist, Rivas catches fire KIM STONE PREVIOUSLY WORKED WITH SUPERVISOR’S BROTHER Nicholas Preciado Reporter
San Benito County policymakers last week approved the hiring of a lobbyist to work on the county’s behalf at the state capitol to the tune of $120,000 over the next fiscal year. But some have balked at the $10,000 a month in retainer fees that will go to the Sacramento-based lobby firm, Stone Advocacy, and raised the spectre of a potential conflict-of-interest on the part of one of the county supervisors, Robert Rivas, whose brother once worked with the lobby firm’s principal and founder, Kim Stone. “Knowing someone does not create a conflict of interest,” Rivas said, who referred to Stone as an acquaintance. “I’ve held myself to the highest standards of the board of supervisors. I’ve been as transparent as I can be. Unfortunately, this is an attempt by political opponents to discredit me.” Stone worked with Supervisor
Rivas’ brother, Rick, when she was president of the Civil Justice Association of California, a Sacramento-based nonprofit group that lobbies against policy that would make it easier to bring lawsuits against business. The board of directors includes major companies such as JPMorgan Chase, The Dow Chemical Company, ExxonMobil Corporation, Wells Fargo Bank and Kaiser Permanente. Stone left the lobby firm in December 2016 and Rick Rivas now works at Equality California as the San Francisco program manager. The Board of Supervisors decided to hire Stone Advocacy after a search that started earlier this year. The county placed an ad in a Sacramento news publication, Capitol Weekly, seeking letters of interest and proposals from California lobbying firms. The county received a total of seven proposals over the last five months and brought three before the supervisors at the December 12 meeting: Dimare, Brown, Hicks & Kessler LLC,
Hurst Brooks Espinosa LLC and Stone Advocacy. Each firm requested a monthly retainer, with Stone Advocacy and Dimare, Brown, Hicks & Kessler asking for $10,000. Hurst Brooks Espinosa was the lowest bid at $3,000. “It’s 2017; it’s time for our county to get professional representation in Sacramento,” Supervisor Rivas said at the meeting. Rivas, who was part of an ad hoc committee to find representation for the county alongside Chairman Jaime De La Cruz, nominated Stone Advocacy. Part of the lobbyist’s mandate is to advocate on important county issues like roads and transportation. “When we were tasked with finding a county advocate, I looked for three things,” Rivas said by phone Monday. “I wanted the best to represent San Benito County, I wanted a firm with bandwidth to focus on our county and we need a proven advocate who knows how to deliver results.” A motion passed 3-2, with De La Cruz and Supervisor Mark Medina dissenting.
Since the vote, Rivas’ brother’s connection to Stone has raised eyebrows. Rivas said it is just dirty politics at work. Rivas is considering a run for the district 30 seat in the state assembly next year, currently held by Anna Caballero, who cannot run for reelection because of term limits. Rivas has yet to make an official announcement. Furthermore, the Rivas brothers and Stone worked for Caballero during a previous campaign in 2006. “I was employed as Anna Caballero’s field director,” Rivas said. “I didn’t know Kim then. My brother was campaign manager. This whole idea that we’ve worked together, it’s false. I’ve never been on the same payroll as Kim Stone.” While Rivas acknowledged that his brother worked with Stone in the past, they haven’t worked together in over a year and a half. County staff is currently in negotiations with Stone Advocacy to hammer out a one-year agreement. The contract does not
require additional board action, as Chief Administrative Officer Ray Espinosa is authorized to execute the agreement per board direction on December 12. Stone Advocacy’s scope of service is expected to be outlined in the contract currently under negotiation. “I’m happy we’ve directed staff to begin negotiations,” Rivas said. “I’m not part of those. We directed staff to negotiate. I’m optimistic and hopeful staff can negotiate a good price to obtain her services. I think this is a step in the right direction for our county and the board of supervisors.” According to county officials, Stone Advocacy will meet with a wide range of local community stakeholders in the coming weeks to help supervisors formulate a comprehensive legislative and advocacy agenda for the upcoming legislative session in Sacramento. “The bottom line is Kim Stone is the very best,” Rivas said. “She had references from Anna Caballero and State Senator Anthony Cannella.”

This ordinance explicitly prohibits cannabis business activities in the unincorporated area of San Benito County, as follows: • Expressly prohibit any and all medicinal and non-medicinal cannabis business activities (defined in state law as “commercial cannabis activities”), including, but not limited to, cultivation, delivery, dispensary or mobile dispensary, distribution, manufacture, microbusiness, nursery, processing, propagation, retail sale, storage, and testing laboratory. • Further define conditions creating a public nuisance. • Incorporate nuisance abatement enforcement procedures and administrative processes for violations of the Cannabis Businesses Ordinance as provided for by the San Benito County Code. • Provide a process for commencing the administrative process and imposing administrative penalties. During her sophomore year, Berenice Martinez remembers all of the people who had only negative things to say to her. “There were some people at school trying to put me down,” the San Benito High senior guard said. “They told me I couldn’t do this or do that, but I overcame that. I told myself I could do this and prove I’m capable of playing basketball well and moving forward.” And that’s exactly what Martinez has done. Martinez has proved the haters wrong with a breakout season for the Haybalers, who entered the Del Mar Tournament Wednesday with a 6-3 record. Martinez is one of the Baler’ top scorers and 3-point shooters, and she’s improved in every facet of the game from last season. “I think overall I’m doing better with moving the ball and finding the open girl,” she said. “I feel like my shooting is better than what it was last year, and as a result I’m shooting a lot more this season.” That took some adjusting, however. Martinez has always had a passfirst mentality, but she’s learned that sometimes the best shot for the team is when she’s taking it. Plus, Balers coach Mitch Burley has encouraged Martinez to take open shots. Even though Martinez can light it up from the outside, she’s also adept at getting to the basket ➝ Martinez, page 20

Jacob Burley and Matt Campo grew up playing a lot of 1-on1 basketball against each other, developing a close bond in the process. Now the San Benito High juniors are key cogs for a Haybalers team that is looking to rebound from a tough threeyear stretch. The Balers entered Thursday’s game against Milpitas with a 2-9 record, and yet Burley and Campo have been consistent contributors throughout the season.
Burley, a 6-foot-1, 170-pound point guard, and Campo, a 6-2, 190-pound power forward, are similar in that they’re willing to compete for every possession and do all of the little things that might not show up on the stat sheet but plays a key role in a team’s success. San Benito High coach Anthony Butler has been pleased with the two first-year varsity players. “Matt Campo is a guy who has really stepped up so far this year on the defensive side as well as being aggressive offensively,” Butler said. “Jacob Burley has been someone who has impressed us early. His work ethic and basketball IQ is something that is great to see. These guys work hard on the court, but more importantly
they are great students in the classroom.” Burley, who is the son of longtime San Benito High girls basketball coach Mitch Burley, started the season at shooting guard only to make the switch to point guard a couple of games into the season. “I knew that was my spot and how I could help the team most,” he said. In the team’s season-opening 68-63 win over Christopher, Burley finished with 14 points, scoring some critical baskets in the fourth quarter and overtime periods. “In the close games, I love handling the pressure and trying to make the big shots,” he said. Burley is also adept at shooting from 3-point range and getting to
the basket off dribble penetration. Campo has played solid interior defense while also being strong on the boards. He had 12 points in a 56-46 loss to Wilcox on Dec. 12, starting the game off strong with a couple of putbacks. Campo earns every point he scores, as they usually come through pure grit and effort. Against Wilcox, Campo converted some steals into layups while also slicing through the Wilcox defense for some close-range baskets. “I play scrappy and try to outhustle the players on the other team,” Campo said. “All I want to do is help my team in any way I can. Mentally, it’s about grinding and playing hard all the time.” Burley and Campo also grew up ➝ Balers, page 20

The Orchard Valley Toros U15 FC girls soccer team ranked No. 1 in the state and No. 5 nationally in their division this past season, finishing 18-1-4. The Toros won their final two matches in the NorCal NPL Showcase in Davis, while also taking home the National Premier League 1 West championship. OV will play in the prestigious NPL Champions League in the spring. Haybalers senior Martinez shows she’s got game about basketball until C.C. turned her on it,” Burley said. “She has really grown in her basketball acumen over the last couple of years. Typically she is very quiet, but on the court she is extremely loud. Her hustle and toughness make her fun to watch. The other day she dove over an opposing player to create a jump ball without touching the player. I asked the team if they saw ‘Ninja Berenice’ make that play.” Vasquez, who is now playing at Gavilan College, always offers helpful advice and tips to Martinez, who is more than willing to listen and learn. “C.C. will always come to me and tell me what kind of drills they’re doing at Gavilan,” Martinez said. “She’ll show me certain things that she thinks will help me, like drills to help me handle the ball better. I end up trying those things on my own. C.C. is a good role model, is positive and
always gives 100 percent. She’s just amazing and helps motivate me to keep going.” Martinez said as an eighth grader she had no clue what basketball was about. While it took some time for her to learn the rules of the game and the fundamentals, she had a deep desire to improve in a sport she was quickly falling in love with. “I would go to the park with my cousins and just play as much as I could,” said Martinez, who also credited her uncle, Miguel Vasquez, for teaching her the basics of the game. “ Despite her lack of experience, Martinez was named a co-captain on the Balers’ freshmen team three years ago. “I didn’t see that coming, but I used it as an opportunity and saw it as a positive thing,” she said. Martinez loves the makeup of this year’s team, noting the superior talent

Page 19 off dribble penetration. She had a season-high 15 points in a game earlier this season, mostly coming off a variety of drives and open outside jumpers. At 5-foot-3, Martinez knows the importance of positioning and using screens to shake her defender. “It’s harder for someone like me to shoot over a lot of girls, so I have to work hard with and without the ball to get open,” she said. “I have to find a way to get around them or create space for myself so they don’t have a chance to block my shot.” Martinez only started playing organized basketball in the eighth grade, but thanks to her cousin, former Balers standout C.C. Vasquez, Martinez has made meteoric strides in her game. Burley said he has been thoroughly impressed with Martinez’s play. “She knew very little

level and chemistry compared to last year’s squad. In particular, freshman sensation Kaiya Dickens has made quite an impression, playing a game few freshmen in the entire
Central Coast Section can rival. Dickens’ impact has helped the Balers in every facet of the game. “I feel like this year we’re communicating better, working harder in practice
and giving each other more helpful instructions in practice and in the games,” she said. “We’re more vocal with each other, and that makes it more easier to know where everyone is on the court.”

“They never let me win in anything, so that helped me a lot. I was always around them and they helped give me a love for sports. My sister played travel softball, and I went to almost all of her tournaments every weekend. During the winter basketball season, I was in the gym all day.” Mitch, of course, is the most decorated athlete of the family, having played basketball at Santa Clara University. The younger Burley has done a nice job of following in his siblings’ footsteps while also forging his own identity. Burley prides himself on hustling and never giving up, as does Campo, who credits the San Benito coaching staff for putting him
in a position to succeed. Campo is an excellent help defender, always active on the glass and willing to set strong screens. Burley and Campo can’t wait for the league season to start. They know it’s going to be a tough road, but they don’t plan on laying down anytime soon. “I’m really looking forward to league and seeing where we’re at,” Burley said. “I love playing the games where the atmosphere is high intensity.” Said Campo: “Our goal is to not only win more games, but we want to bring excitement and the crowd back to our home games. We want to have people talking and being excited again.”

playing baseball against each other as members on different teams. They’ve always shared a love for competition, and they know how to play well together on the court. Burley grew up in the gym and on various athletic fields—literally. With two older brothers (Kevin and Matt) and one older sister (Ellie), Burley watched his siblings’ games while also practicing at the same time. Kevin graduated from San Benito High in 2008, Matt in 2011 and Ellie in 2013. Burley said growing up with three older siblings helped him develop at a faster pace. “They were all good siblings, and they were never easy on me,” Burley said.

Ordinance No. 965 AN ORDINANCE OF THE SAN BENITO COUNTY BOARD OF SUPERVISORS APPROVING A FIRST AMENDED DEVELOPMENT AGREEMENT WITH PANOCHE VALLEY SOLAR, LLC REGARDING THE PANOCHE VALLEY SOLAR FARM PROJECT The Board of Supervisors of the County of San Benito ordains as follows: SECTION I. PANOCHE VALLEY SOLAR FARM PROJECT FIRST AMENDED DEVELOPMENT AGREEMENT San Benito County (the “County”) and Panoche Valley Solar, LLC (“PVS”), the developer of the Panoche Valley Solar Farm Project, which is being constructed on parcels identified by the San Benito County Assessor’s Parcel Numbers described in and/or shown on the attached Exhibit A, which is incorporated herein by reference, have negotiated an amendment to the Development Agreement between the County and Solargen Energy, Inc. (predecessor in interest to PVS), adopted November 10, 2010 (Ordinance No. 862). The amended Development Agreement is titled the First Amended Development Agreement (“FADA”), which is attached hereto and incorporated herein by reference as Exhibit B. The FADA is hereby approved. Development of the Panoche Valley Solar Farm Project shall be governed by the terms of the FADA. The Resource Management Agency Director is authorized to execute the FADA on behalf of the County. To the extent any conflict may exist between the provisions reflected in County Code, Title 19, Chapter 19.11 and the provisions reflected in the FADA, the Board hereby ordains that, for purposes of the Panoche Valley Solar Farm Project, the provisions in the FADA shall prevail and hereby amends Chapter 19.11 accordingly. SECTION II. FINDINGS In support of this ordinance approving the FADA, the San Benito County Board of Supervisors hereby makes the following findings and determinations, as set forth in Exhibit C, which is incorporated herein by reference, as recommended by the Planning Commission in Planning Commission Resolution No. _________ and based on the evidence set forth in Exhibit C and on the entire administrative record, including all written and oral testimony received. SECTION III.
SEVERABILITY
If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. The Board of Supervisors declares that it would have enacted this ordinance and each section, subsection, sentence, clause, or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared invalid. SECTION IV. CAPTIONS The titles and headings to the sections hereunder are not part of this ordinance and shall have no effect upon the construction or interpretation of any part hereof. SECTION V. CODIFICATION, EFFECTIVE DATE, AND PUBLICATION This ordinance shall not be codified. This ordinance shall take effect thirty (30) days after its adoption, and before expiration of ten (10) days after passage of this ordinance, it shall be published once with the names of the members of the Board of Supervisors voting for and against the ordinance in a newspaper of general circulation in the County of San Benito, State of California. The effective date of the FADA shall be the effective date of this ordinance, so long as the FADA has been signed by PVS and Resource Management Agency Director, pursuant to section 19.11.008(D) of the County Code. If both parties have not signed the agreement as of the effective date of this ordinance, the effective date of the FADA shall be the date the FADA has been executed by both parties. The City of San Juan Bautista Water System has high levels of nitrate DO NOT GIVE THE WATER TO INFANTS UNDER 6 MONTHS OLD OR PREGNANT WOMEN OR USE IT TO MAKE INFANT FORMULA Water sample results received from 11/1/2017 to 11/30/2017 showed nitrate levels ranging from 8.44 to 13 milligrams per liter. This is above the nitrate standard, or maximum contaminant level (MCL), of 10 milligrams per liter. Nitrate in drinking water is a serious health concern for infants less than six months old. What should I do? • DO NOT GIVE THE WATER TO INFANTS. Infants below the age of six months who drink water containing nitrate in excess of the MCL may quickly become seriously ill and, if untreated, may die because high nitrate levels can interfere with the capacity of the infant’s blood to carry oxygen. Symptoms include shortness of breath and blueness of the skin. Symptoms in infants can develop rapidly, with health deteriorating over a period of days. If symptoms occur, seek medical attention immediately. • PREGNANT WOMEN SHOULD NOT CONSUME THE WATER. High nitrate levels may also affect the oxygencarrying ability of the blood of pregnant women.• Water, juice, and formula for children under six months of age should not be prepared with tap water. Contractor shall possess a Type “A” license prior to award of Contract or other license qualifying the bidder to bid as a prime Contractor, prior to award of Contract as approved by City. In accordance with the provisions of California Labor Code Sections 1770, 1773, 1773.1, 1773.6 and 1773.7 as amended, the Director of the Department of Industrial Relations has determined the general prevailing rate of per diem wages in accordance with the standards set forth in Section 1773 for the locali-ty in which the Work is to be performed. A copy of said wage rates is on file at the office of the City. It shall be mandatory for any Contractor to whom a Contract is awarded to pay not less than the applicable prevailing wage rate to all workers employed for the execution of the Contract and employ apprentices pursuant to Section 1777.5 of the California Labor Code. The general prevailing rate of wages, as determined by the Secretary of Labor are included herein-after as a part of the Contract Documents; provided, that if there is any difference between the State or Federal wage rates for any given craft or mechanic needed to execute the work, it shall be mandatory up-on the Contractor and any subcontractor to pay the higher of the two rates. Any classification omitted herein shall be paid not less than the minimum basic rate per hour plus employer payments as set forth in the collective bargaining agreement then applicable to the class or clas-sification of workmen or mechanics employed as defined in Section 1773.1 of the Labor Code of the State of California. Attention is directed to the provisions of Sections 1777.5 and 1777.6 of the Labor Code of the State of California concerning employment of apprentices by the Contractor or any subcontractor under him. There is no DBE project goal established for this project. At this time, the City will meet the DBE goal on federally assisted projects through race neutral measures. The City supports the use of race neu-tral measures to facilitate participation by DBEs and other small businesses, and encourages prime con-tractors to subcontract portions of their work that they might otherwise perform with their own forces. The City of Hollister reserves the right to reject any or all Proposals and to waive any informality in Proposals received.
