Q and A on cannabis with Victor Gomez PINNACLE STRATEGY PRESIDENT ON WHAT TO EXPECT AFTER JAN. 1 Staff Report

Will anyone 21 and over be able to walk into an existing dispensary on Jan. 1 and buy legal adult use cannabis?

We have received comments from patients who currently get their medicine from dispensaries or delivery services. How will their access change on Jan. 1? It shouldn’t change at all from the medical perspective. Taking a step back, I run campaigns and I’m running some up in Oregon. I’ve been spending time in Eugene and other areas. Oregon has been up and running for about six months on medical and recreational. I noticed the higher-quality cannabis seems to

I think it’s going to take some time before we see anything like that prosper and open up. Animals, for example. I know a lot of pet owners who have actually used cannabidiol (CBD) based products for their animals. Their dog may be 13-14 suffering from pain and arthritis. There are other dogs that suffer from fear. People do provide those products for their pets. Unfortunately, they can’t purchase them at the pet store.

I think that will become a trend in the future, I don’t see it necessarily happening in the next five years. But like alcohol prohibition, it took time to get it served. It takes some time for the public to feel comfortable. Will it happen in the future? I think it will, but it will take a lot of time and it’s going to take the community a while to get used to cannabis being legal, even CBD-based.

Will medical cannabis operations be able to operate if they have not applied for local licenses? No, you have to have a local permit to retain a state permit. It all starts at the local level. I follow what other cities are doing. That’s why I think to an extent it’s okay for these jurisdictions to have temporary bans to allow them to develop a policy. Now if a jurisdiction has a permanent ban and no plans to lift it anytime soon, it’s problematic. I think the state would limit their tax revenue from the cannabis industry. For example, San Benito County doesn’t have medical or recreational anything. So if the county wants to apply for grants through this new cannabis tax revenue coming into state, I don’t see the state granting San Benito anything because it doesn’t allow cannabis.

How does the Hollister City Council’s recent ban on adultuse operations impact those medical cannabis businesses who have already received local licenses to operate? Does it affect their chances of getting a state license? It will not have an effect on them getting a state license. You have a choice right now to get class M (medical) or class A (adult use), it depends on your use. If

It depends on what the local jurisdiction adopts. A good example is Hollister. If you currently are one of the two permitted dispensaries, you will not. The only way you can get cannabis at a Hollister retailer when they open up is if you have a medical card to purchase cannabis. It depends on the jurisdiction. In San Jose, they are 100 percent ready and on Jan. 1 if you’re 21 and over they’re ready to allow walk-ins. It’s a little different in Hollister and other jurisdictions that haven’t transitioned to recreational yet. They’ll still have to follow the old model of having a medical license to do that. To an extent, I hate to say it, but unless the Hollister City Council moves to allow them to do recreational sales, the Hollister permittees will be at a disadvantage while those who’ve adopted recreational will have a larger customer base.

Where on the recreational side, you’re seeing a different quality cannabis. Some argue it’s a lower quality making it to recreational side in Oregon. If anything I think if that does happen in California, it shouldn’t change anything on the medical side. If you’re a medical card holder, you’re still getting service, but there will be a significant dip. A lot of medical card holders are now looking at Jan. 1 and wondering why they need a license. There will be a dip in medical licenses that will go down quite a bit, but I’m not a believer in it’s going to go away. You still have patients between ages of 18-21 that cannot purchase recreational cannabis so they will have to keep their cards. There are people who have specific medical needs, whether they’re suffering from glaucoma, cancer, migraines, whatever it may be. A lot of folks on the medical side are used to specific products that recreational won’t provide for them.

with both San Benito County and San Juan Bautista this year to help draft policy on medical and recreational cannabis. you have a local medical license, you will only qualify for a medical state permit. But if you have both, and you can have both, you can apply for both medical and adult use at the state level. The state is going to be watching closely what local jurisdictions are doing. That’s going to be closely monitored. To the question regarding impact and this 45-day moratorium, I think the concern with maybe some of the elected officials and the concern with a small segment of community is, they’re concerned that first we’re only doing medical dispensaries. I’m not sure they’re necessarily okay with someone being able to walk into the door of these two permitted dispensaries for recreational use. The debate is on the retail side. For me, on the manufacturing, distributing, cultivation, and testing sides it’s a no-brainer for the council to move from medical and add recreational to all those license types. There's no public access to those. If you have an adult-use license, you

can only sell that product to recreational dispensaries. Right now if you have med license, you can only sell to the medical side of dispensaries. If the mayor and city council are concerned about recreational cannabis access by residents, they could keep the retailers at medical if that’s a concern. The other license types, it really makes no sense to ban them from getting recreational permits. Hollister residents can’t just walk into a cultivation, clip a couple buds and take that home. If I live in Hollister or San Benito County, I can grow six plants in my house and guess what, no one can tell me whether I can do with it or not. All you’re doing is banning recreational sales, not recreational use. You cannot ban recreational use, that’s illegal. I will say this: On the retail side, if Hollister keeps the medical only and does not allow dispensaries to do recreational, recreational users will go buy their cannabis elsewhere, which means Hollister will lose tax revenue from that. ➝ Full Interview Online

The pair charged in Yoon Ji’s death are her husband, Sang Ji and Jung Choi, a woman who Sang Ji initially referred to county law enforcement as a cousin. Both have been in custody at the San Benito County Jail since Dec. 2 and were arraigned on murder charges at San Benito County Superior Court on Thursday, Dec.21. Each of the suspects spoke through a Korean interpreter and was given a bail of $2 million plus $10,000. Sang Ji, who operates Hollister Laundromat in the city, was assigned a public defender after Sang Ji said the laundromat has been closed since his arrest and he has no money for an attorney. Choi, who presiding Superior Court Judge Steven Sanders said, “had means,” was given time to consult an attorney. Choi, through the interpreter, said her brother from South Korea was supposed to consult with a attorney at the consulate Wednesday, but she had not heard from him. Sanders scheduled a brief continuance for both suspects on Dec. 28 at 9 a.m. Outside the courtroom, Gregory Michael Laforge, the public defender assigned to Sang Ji, said he had not yet introduced himself to his client and had nothing to add. Holding up a thick

file, he said, “I don’t have anything to say right now, I need to review the discovery.” At the courthouse, Taylor said they are confident the right suspects are in custody. “We are confident we have the two people who are responsible,” he said. Yoon Ji was reported missing on Dec. 2 by Ji’s daughter and her sister who live in Los Angeles. The daughter told the San Benito County Sheriff ’s Office that she had not heard from their mother since Nov. 27. She told investigators this was odd because they had daily communication with her up until that time.

On Dec. 1, she received a message from her father, Sang Ji, stating her mother had gone to South Korea unexpectedly. The daughter contacted family in South Korea who said her mother was not there, and had not contacted them to go there. The female and her sister were concerned so she drove to Hollister from Los Angeles to confront the father. The daughter arrived in Hollister and contacted her father at the family home, police said. The father was in the company of a female identified as Jung Choi. Sang said Jung was a cousin, but she was unknown to the daughter. The daughter became increasingly concerned for her mother after her conversation with Sang and Jung. She contacted

Serious flu season expected this winter COUNTY PUBLIC HEALTH STILL OFFERING VACCINES Staff Report

Get ready for a particularly nasty flu season, warns San Benito County public health officials. And that means, get a flu shot. “It’s never too late to get a flu shot,” said Dr. Gail Newel, health officer for San Benito County.“It’s impossible to get the flu from the flu shot. Everyone six months of age and older, including pregnant women, should get the flu shot at the beginning of every flu season.” Flu activity reaches its highest levels between December and February, and can continue through May. However, flu activity has not yet peaked in the United States. Public health officials in the southern hemisphere have warned that this year’s flu season could be particularly severe. Flu activity south of the equator offers a good indication of coming flu activity in the northern hemisphere. Getting the flu shot is still the best way to protect oneself against

the different flu strains that circulate in the community. In addition to one’s health care provider and pharmacies, the flu vaccine is available locally at the public health services office at 439 Fourth Street in Hollister. The vaccine is available on Mondays, Wednesdays, Thursdays and Fridays from 8:30am to 4pm. No appointments are necessary. The flu vaccine is offered while supplies last. In addition to getting the flu vaccine, public health officials advise people to take the following precautions: • Cover coughs and sneezes with a tissue • If you don’t have a tissue, cough or sneeze into your elbow • Avoid touching your eyes, nose or mouth • Wash your hands often and thoroughly with soap and warm water or an alcohol-based hand sanitizer • Stay home when you or family members are sick, and stay home until you have been symptom-free for 24 hours.

F

lorence Conley Kline was born February 17, 1920 at Glasgow, Montana. She was the first child of Paul Harry Conley and Minnie Josephine (Hanson) Conley, both from North Dakota. Her mother was of Norwegian descent and her father was of Irish and Norwegian descent. Her father and grandfather were pioneer railroad engineers in the northwest. An Irish great-great grandfather, Luke Conley, built Mr. Rochester’s stone mill at a site that later became Rochester, New York. Florence was a longtime employee of Wheeler Hospital in Gilroy, California. She was one of the first women to complete two years of study at North Idaho Junior College (now North Idaho College), and won archery awards in northern Idaho in the late 1930s. During World War Two (prior to the existence of the CIA) she served in the United States Department of State’s top-secret cryptology section as a Code Clerk. She was the widow of Joseph Nathaniel Kline II of Washington, DC. She is survived by four children Joseph (Donna) Kline, Linda Kline, Stephen Kline and Paul (Martha) Kline and many grandchildren and great-grandchildren. She is also survived by a sister Pauline (Conley) Wilson and half-siblings Donald Conley, James Conley, Joan Conley (Gary) Gaspard and Colleen Conley (Barry) Wright. She was a loving grandmother to five grandchildren; Deborah Hernandez, Ruth Lane, Dina Bengivengo, Rachel Jones, and Robert Jones; ten great-grandchildren and six great-great grandchildren. Top accomplishments include paying debts Year End Goals, 1 for six school sites for parks and after school hours. That was pretty big. It’s going to be important going forward as some [agreements] had expired and some were set to expire. It’s another opportunity, another success story at least from getting the negotiation agreement together between agencies. For the most part, we’re working a lot better with the school districts and I think our relationship with county is getting a bit better. There’s still work to do, but that was a good one where you have two agencies working together to benefit the public. Another approved earlier in the year was the implementation of the pavement condition index. We’ll be able to actually know which roads we should be working on going forward as we identify funding. I think we set aside a little over $3 million for road projects coming up soon. Other things we’ve started but haven’t finished are the Parks Master Plan and the General Plan Update. Another is quarterly business outreach breakfast meetings. I think that has helped because now people have a forum to go to on a normal basis. If they have success stories or issues that need to be addressed, they know those meetings will be coming up. Other big things to happen this year, I think paying off the side fund debt, starting the process of lowering the sewer rates, and opening the West Hills Water Treatment Plant were other big things that happened this year. Councilman Ray Friend I think helping supporting the city in paying off the unsecured loans saved the city millions, also doing that and keep with our budget.

Councilman Chris Martorana Bringing on an assistant city manager who I believe will become our new city manager in the not too distant future. Michaele has an incredible background and I think she’ll bring something special to the city. Also surviving the upheaval we’ve had, it’s been a tough year for us. We got through it, the council pulled together reasonably well and we worked well together. A lot of contentiousness was expected with the two new members who came on this year, but we worked well and I’m proud I worked well with John and Dan. I think finally developing what I think is a realistic plan

San Benito County Board of Supervisors Board Chairman Jaime De La Cruz Approving the creation of the New San Benito County homeless shelter that will provide services like meals, counseling and education. Approved a new impact fee that will provide funding for future library capital projects and adjusted all other impact fees to new housing developments. The new jail expansion project. Joined the Monterey Bay Regional Power joint powers authority for the sole purpose of creating renewable and alternative energy projects from sources of solar, wind or hydroelectric with the end result of providing lower cost energy to Monterey, San Benito and Santa Cruz County customers. Finally reaching an

agreement with Duke Energy (Solar Farm) that will generate over $10 million to San Benito County for the next 20 years. Supported CHISPA in the creation of a 13-unit affordable single-family homes and 41-unit apartment for low-income families project. Supervisor Anthony Botelho I am happy this is a plural question, as San Benito County was able to accomplish several items of public need and good. Moving forward with the jail expansion was very important to utilize a state grant to cover much of the construction costs which is absolutely vital, as our county’s growth warrants additional capacity. This has been a project in the planning stage for a long time and it is good to see it move to construction. The jail project is a $21 million project in which the state is covering $15 million. The same can be said with the recently opened HOME Resource Center. I am excited about the homeless shelter, as this is the first step in addressing the issue in San Benito County. Our intention is not to “enable” continued homelessness of the individuals that we all see in our streets, but to provide a place that will be a temporary shelter, address their personal issues, assist in transitional housing and ultimately lead them to a path of employment and off the streets. By no means will this be successful for all homeless folks, but I do believe it will help a good number in the future. The county and our many partners have a lot of work to do to build the complete program. Personally, working on the updated schedule for impact fees was very important. Councilman Jim Gillio From a council perspective I’m happy to see council and staff have committed to paying off lingering debt in the side funds. I try to give other people credit and they did outstanding job. I was also excited to see staff brought the council a balanced budget and we were able to set aside 25 percent of the budget for a rainy day fund. We also committed $3.5 million for road repairs for 2017-2018. As a council we were able to add two police officers and a parks person and still have a balanced budget. Public safety is a priority for me. I met with Police Chief David Westrick early on and the council was able to add an additional two officers. Now with a person working in cannabis, there’s another police position. Our police department is very understaffed and working their

butts off to do what they can to hire people and get up to speed. This will help our community in terms of public safety. We’ve been working with many commercial developers, a lot of opportunities are coming soon. It will help keep folks in the city and in town as well. We have some exciting stuff coming in. The term smart growth, when I started here I heard it a lot, but wondered what it meant. Over the last two months both council and staff took a huge step in the right direction. I’m hopeful the council will come together to implement a reasonable growth management plan. This month the council agreed to bring back growth management plan in ordinance form in January. I’m glad that’s happening. I’m personally proud to have participated in many economic development conversations on behalf of the city with companies looking to relocate to our area as well as local companies looking to expand.

Councilwoman Mickie Luna To have been able to hold District 2 meetings for our residents as a continual engagement is a big accomplishment. We applied to Caltrans for the Active Transportation Plan grant and were approved, due to the communication and documentation of our district meetings with the constituents who participated in dialogue about the west side of the city and improvements needed. Also due to these meetings, we were able to apply for CDBG funds on Dec. 1 to build a river park trail between Bridge Road and the new Apricot Park. The community engagement helped us document the need for the park improvements in west Hollister. The City was also able to apply for funding to prepare a plan for improved bicycle/pedestrian access on Buena Vista Road. This was a hot topic at one of our District 2 community meetings.

County leaders proud of homeless shelter Year End Goals, 12

homeless center/shelter we have made a choice as a community to take care of the weakest among us, and as a result, we can be an example for others. This project was only possible because of the strong collaboration between county and city government. In 2017 we also continued to make progress on building a new public library/learning center in San Benito County. While our current county library continues to provide important services to our residents, it is time to prioritize the construction of a new County library and community center. We have modernized several other things in our community – court house, voting, jail, roads, waste disposal, mental and physical health – yet we have a library that hasn’t been updated in decades. We should build a place of learning and discussion that will be a model for the rest of the State. A place where our entire community can come to experience the beauty of learning. After years of collaboration, in 2017, San Benito High School, the City of Hollister and San Benito County approved a contract agreement to close Nash Road and develop a plan for a new by-pass. This is important for two reasons. First, it is a great example of what we can accomplish when we all work together to alleviate traffic congestion during peak high school hours. Second, and most importantly, it provides for the safety of our youth who attend San Benito High School. For far too long we had a dangerous situation where students were crossing a busy street multiple times a day as they went from class to class. Now we will soon have a bypass that keeps the automobile traffic separate from the pedestrian

Supervisor Mark Medina Perhaps my biggest accomplishment for 2017 is to have successfully navigated (thanks to my family community and employers) my first year as an elected public servant for the people of San Benito County. Having never held an elected position, I’m honored to represent the residents of San Benito County and serve for the greater good. I feel that I have taken extra steps to actively reach out, engage and actively listen to residents and the business community, acting as a liaison to get questions answered, help mediate issues and leverage opportunities at hand. Building consensus with fellow board members and working closely with staff, we were able repair the levees in District 1 and adopt a five-year Comprehensive Economic Development Strategy. Against staff ’s recommendation, I also held residential developers accountable to their development agreement to ensure safety, improve infrastructure and accountability.

Supervisor Robert Rivas As 2017 comes to a close, I think it’s important to remember our successes not only as motivation by showing us what we are capable of accomplishing, but also, it is important to look back at our success and figure out where we can improve going forward. In 2017 San Benito County took a huge step toward becoming a more inclusive and welcoming county when we approved the opening of a new LGBTQ center. With the help of our behavioral health department, San Benito County has ensured that the LGBTQ members of our community will have the support they need to achieve their goals. Looking forward to 2018, we need to continue to work with our Superintendent of Schools and other school administrators to develop a comprehensive plan that addresses bullying and provides the needed support to every member of our community. As we have demonstrated this year, if we work together and talk about the issues and problems our LGBTQ community faces in San Benito County, than together we become a force against discrimination and homophobia. In the same vein as the LGBTQ Center, I am also extremely pleased that our community—County/City partnership—has decided to construct a state of the art homeless center/shelter to support the less fortunate in our community. Mahatma Gandhi once said, “A nation’s greatness is measured by how it treats its weakest members.” I believe that the word “nation” can easily be substituted for the word “community” because our nation as a whole is the product of the aggregate of all of the communities within it. By approving the construction of this new

addressed added costs for the library and public safety infrastructure. Road Impacts had been significantly increased prior to this point. Also, working out the details for the Nash Road bypass with the San Benito High School District and City of Hollister is so important to the high school campus for safety of the students and for the county to acquire land that is much needed for a future river parkway and trail system. The bypass road will be constructed next year and for the county, much work is ahead for the future park area. It is very satisfying to work and make agreements that are far reaching and impactful into the long term future.

Ricardo Gallardo only started wrestling in the eighth grade, but he’s made the most of his time on and off the mat. The San Benito High senior entered the week at No. 10 in the Central Coast Section rankings in the 170-pound weight class. Gallardo will continue to move up the rankings if he produces more results

like he did at the Morningstar Invitational at Los Banos High on Dec. 16. Gallardo took third place in the event, going 4-1 in the process. One of Gallardo’s highlights came in the quarterfinals, when he recorded a second-period pin. “I was facing a guy from Clovis, and he stood up, but I was able to bring him back down with a shot and take him down,” he said. Even though Gallardo went 18-14 last season and finished third in the Monterey Bay League Championships, he viewed it as a

transition year to adjust to the varisty level. “I was trying to get situated in moving up to the varsity,” he said. “Last year I didn’t do so hot. I was afraid at times of making mistakes. This year I’m going all out and being aggressive, and it’s paying off.” Indeed, Gallardo has already avenged losses to wrestlers from Bellarmine and College Park from a season ago, a telltale marker of how much he’s improved from his junior season. Gallardo stays humble, and didn’t take making

the team for granted. “My goals before the season started was to make the team first and then go out and win as many matches as possible,” he said. “I don’t want to have any regrets because last year I had a lot of regrets.” Gallardo plans on getting in tip-top condition so he can wear out his opponents and go for shots when they’re exhausted. Gallardo has made it a point of emphasis to work on his shots, focusing on driving through them. Gallardo has improved his

technical skills by watching videos and honing in on certain drills in practice time and again. “The coaches walk me through the moves, and it’s mostly the little things that I need to work on,” he said. Gallardo started wrestling in the eighth grade, in part to get healthy, lose weight and for selfdefense. However, it took some prodding from his friends to get Gallardo to try out for the sport. Once Gallardo did, he’s never looked back. In the offseason, Gallardo wrestled

in five total tournaments, from Greco Roman to freestyle. Gallardo wanted to enter more tournaments, but he had to work. Gallardo has learned to be content with little, appreciating the simple things in life people often take for granted. The Balers are scheduled to compete in the Apple Cider Tournament at Watsonville High on Jan. 6. The girls team has an all-day competition in the Lady Trojan Invitational at Alisal High School on Friday.

On Dec. 22 and 23, the San Benito High baseball and softball programs hosted a clinic to raise money for their respective teams and Robert Fabing, who is a longtime baseball coach and official. Fabing, who underwent surgery for brain cancer in May 2016, has affected countless lives through his sheer love for sports and the kids who grow up in Hollister. Many of them—24 former Baler baseball standouts, in fact—were in attendance serving as instructors or to show support for Fabing. The event was led by the high school and former Balers standout Darin Gillies, who did a great job of gathering former players and showing love for Fabing, whose cancer is in remission. A half-dozen former Baler softball players also led drills.

At its regular meeting of December 21, 2017 the City of Hollister Planning Commission during a duly noted public hearing approved a resolution recommending to the City Council approval of the zoning amendments pertaining to on-site notification of proposed projects in the City of Hollister and allowing with an APR minor vehicle repair land use facilities in the DMU Zoning District. The City of Hollister Planning Commission recommended the approval of drive-thru facilities in the DMU with an APR during a previous duly noted public hearing. CEQA: Categorical Exemption.

The project proposes a planned unit development (PUD), pursuant to Hollister Municipal Code Section 16.16.030 with a land use designation of Medium Density Residential (MDR) (8-12 dwelling units per acre) on 4.82 acres (APN 052-300-001). The remainder of the site (3.25 acres) (APN 052-080-001) would remain designated as West Gateway (WG) (20 – 35 dwelling units per acre). The project is located at 1001 Fourth Street, between 4th Street to the north, Jan Ave., to the south, and west of Westside Blvd., further identified as San Benito County Assessor’s Parcel Numbers 052-080-001and 052300-001. 2. McCray Street Vacation – City of Hollister – The City of Hollister is seeking to vacate a 10 ft. Tree Planting and Maintenance Easement and a 10 ft. Public Utility Easement along the public right-of-way of McCray Street and East Park Street for future development by a private developer.
