The San Benito County Board of Supervisors took steps Tuesday to begin new energy conservation measures at county buildings, including potentially constructing solar panels. County leaders listened to a presentation by ENGIE Services US, the North American branch of an international energy company, that reported on the findings of a study conducted on energy usage at county buildings and properties. The Hollister Police Department is requesting public assistance in locating a sexual assault suspect from an incident that occurred in October 2017. In late 2017, a victim checked into Hazel Hawkins Hospital and reported she was sexually assaulted in downtown Hollister. Police detectives were able to determine the date and time of the incident, and isolate pertinent footage from the event from the city’s downtown surveillance system. Police released pictures to the public on Jan. 11, 2018 with a request for assistance in identifying the suspect. After release of the photographs, two separate sources came forward with information indicating that Cory Dean Daughtery, 31 of Fresno, was the subject pictured. Detectives worked with the victim, who was able to provide enough information to obtain a warrant

Additionally, Daughtery current has a no bail warrant for a parole violation. His whereabouts are unknown, is believed to be transient, and he may have left the Hollister area. Site work begins on new athletic fields ➝ School Construction, 1

2018 graduation ceremony staying on campus

District officials announced that the June 8 graduation ceremony will be held on campus, rather than at Rabobank Stadium in Salinas, as previously expected due to construction. However, a delay in the campus construction schedule has made the area near the practice soccer fields available, according to district staff. “The state’s request for more information has briefly delayed site work in the area of campus near Hardin Field, which otherwise would have precluded holding the commencement ceremony on the nearby lawn, as it would have been a construction zone,” according to a Jan. 18 letter to school staff, students and community issued by Superintendent Shawn Tennenbaum, Principal Adrian Ramirez and Graduation Coordinator Laurie Chavez. The 2019 ceremony will be held at the new multi-use fields currently under construction on campus and the 2020 ceremony will be held in the new stadium, according to district staff.

(scheduled to open by Summer 2019); and new student union, cafeteria and central quad, scheduled for completion in December 2019, according to a Nov. 17 presentation by district staff. Along with the multi-use practice facilty, other athletic projects funded by Measure U are a new Aquatics Complex, slated for completion by May 2019; new track and field as well as softball field, scheduled to be done in summer 2019; and an athletic storage facility, according to a Nov. 17 presentation by district staff. “The commitment to build new athletic facilities on our campus is huge,” said Thatcher. “Once completed, our athletic facilities will be as good as they get for public high schools in California. We are extremely grateful to our Hollister community, Board of Trustees and administration for seeing the need, value and importance of building these new athletic facilities.”

Businesses are in middle of potential ICE squeeze

T

he stories began flying last week: Federal Immigration and Customs Enforcement (ICE) agents would raid businesses across California and deport undocumented workers. As of this newspaper’s press time, the raids had not started, but the specter remains. Heightened anxiety about federal immigration policies has already intensified at the ground level of the nation’s biggest economy earlier this month. A new state law, passed in 2016, went into effect Jan. 1. It makes it a crime for business owners and managers to cooperate with ICE in certain circumstances. Rumors of pending ICE raids prompted our outspoken Attorney General Xavier Becerra to warn California employers last week that he wouldn’t hesitate to hit businesses with fines up to $10,000 if they assisted ICE in violation of the new state Immigrant Worker Protection Act. “It’s important, given these rumors that are out there, to let people know – more specifically, employers – that if they voluntarily start giving up information about their employees or access to their employees in ways that contradict our new California laws, they subject themselves to actions by my office,” Becerra said. This followed a warning earlier this month from President Trump’s acting director of ICE, Thomas Homan, via Fox News that “California better hold on tight... If the politicians in California don’t want to protect their communities, then ICE will.” A Republican candidate for California governor, Travis Allen, said last week that employers should help federal authorities conducting immigration raids and defy the law that went into effect Jan.1. He said federal officials should consider bringing charges of their own against the attorney general. The new state law: • Requires employers to ask immigration agents for a warrant before granting access to a worksite

• Prevents employers from voluntarily sharing confidential employee information without a subpoena • Requires employers to notify their workers before a federal audit of employee records • Gives the attorney general and labor commissioner exclusive authority to enforce new provisions of state labor laws • Prohibits employers from re-verifying information on employment verification forms, unless compelled to by federal law. Employers must inform employees of potential lawful ICE raids 72 hours in advance, under the new law. The new law, combined with the Trump administration’s immigration enforcement policies and Becerra’s aggressive stance, leaves business owners and their managers unprotected on the front lines of a pitched national immigration battle. Becerra apparently is willing to let the men and women behind the counters and in other workplace settings slowly twist in the breeze, uninformed and unprotected by their state with orders to face off against the intimidating presence of armed federal ICE agents. This heavy-handed confrontational approach by both California and the federal government hurts our most vulnerable businesses and their managers, as this latest immigration enforcement spectacle plays out. Of course there is a larger context: cannabis laws, offshore drilling, solar tariffs, sanctuary cities, pesticide safeguards, student loans, abortion rights, net neutrality and immigration policies are just some of the federal-state flashpoints that seem so clearly directed at us, the biggest and most blue state. Rights of our immigrant workers must be protected, but our small business owners and managers also deserve support and guidance from state officials, instead of threats. To state and federal agencies: These battle lines should be drawn in courtrooms, not in our neighborhood businesses, or our communities will become collateral damage in the immigration wars.

ike Johnson passed away in Pueblo, Colorado on December 15, 2017 at the age of 69. He leaves his wife, Ginger Johnson, three brothers: Karl Johnson of Hollister, Craig Johnson of Spring City, TN, Doug Johnson of Trabuco Canyon, CA. He was a decorated Vietnam War veteran and received two Bronze Stars for his service to our country.

Mike was an amazing husband, father, brother and friend to us all. He will be dearly missed. A celebration of life is planned in Pueblo Colorado in April 2018.

ill Clem went to be with his Lord and Savior on January 21, 2018. He was a Foremen for a local builder in Gilroy. He was a City Building Inspector for 20 years, when he retired. He served in the Army Air corps during World War II and was a tail gunner in a B-17 with the 303rd Bomb Group, known as the Hell’s Angels. He is survived by his wife Edith Lawana Clem, his children Larry Clem of Ardmore, Glenda Nichols of Yuba City, Marilyn England of Gilroy and Bruce Clem of Hollister. He has nine grandchildren and five great grandchildren, with one due in July. Memorial Services at Ullrey Memorial Chapel, 817 Almond St, Yuba City, followed by fellowship at the Calvary Christian Center 2620 Colusa Highway, Yuba City.

elen Lena Turturici entered into eternal rest on Sunday, January 14, 2018. During her 88 years, she touched many lives with her wise and caring ways. She was an amazing daughter, wife, sister, Mom, and Nani. She loved spending time with her family and friends around the kitchen table and on the golf course. She also enjoyed reading, puzzles, playing cards, and bowling.

Helen was born to Gus and Lena Albo in Berkeley and graduated from Berkeley High School. Following graduation, she worked as a bookkeeper. Helen met her husband Bennie and they built their life and family together in San Jose. Helen and Bennie retired to Hollister in 1998 to live and play golf on Ridgemark Golf Course. Helen is survived by her loving children David, Douglas, and Carolyn (Spain); caring son-in-law Bill; adoring granddaughter Samantha; dear sisterin-law Marie (Romero); and many cherished nieces, nephews, and cousins. She was preceded in death by her devoted husband Bennie in 2014. In lieu of flowers, donations may be made to your favorite charity or to St. Jude Childrenís Hospital. A memorial mass will be held for Helen at St. Christopher Parish in San Jose on Friday, February 2 at 10:30am.

If you want us to cover the parking and put the balance on the ground we can consider that.” Timeline for implementation is expected to last from March 2018 to February 2019, as the project still requires legal analysis from the county counsel’s office and final board approval at a future meeting. Resident Marty Richman asked if the solar array system could operate as an emergency energy source in the event of a natural disaster, like an earthquake. Jain said that the solar arrays would only work if the electrical grid was online. “These solar projects are neck-metered, meaning they constantly are supplying electricity when the building needs it,” Jain said. “ If it doesn’t need it, it goes to PG&E and you get a credit based on the current rate at that time.” Supervisor Jaime De La Cruz said he was ready to see a more structured plan with financing. “I’ve seen this package twice already, I want to see some substance now,” De La Cruz said. “If the board wants to go in that direction, let’s move now. about the county’s energy usage and potential conservation measures that could save taxpayers money. According to the study, San Benito County buildings generated $475,113 in electric bills in 2016. Data for other years was not presented. Currently, all county buildings and street lights have an annual energy usage of 2,385,872 kilowatts. To help conserve both energy and money, the study recommended retrofitting indoor and outdoor lights with LED bulbs, thermostat upgrades and HVAC replacements at various county buildings. Further conservation measures could include installing solar arrays, such as a 518.4 kilowatt solar array situated on the grounds of the San Benito County Jail shown during the presentation. Chairman Anthony Botelho, appointed to lead the board earlier in the meeting, asked why the panels would be arranged on the ground at some locations. Upgrades coming for a portion of Fourth Street SPRING AND SUMMER REPAVING, NEW DRAINS COULD SLOW TRAFFIC ON THOROUGHFARE Nicholas Preciado Reporter

Residents could see a smoother commute on Fourth Street next fall as the City of Hollister prepares to go out to bid for upgrades to road and water infrastructure. Before completion, expect delays and detours on one of Hollister’s busiest streets during spring and summer construction. “The project will provide much needed relief to surface flooding along the corridor,” Development Services Director Bryan Swanson

said. “Fourth Street is a unique corridor as it contains a variety of land uses while also serving as an important vehicle corridor leading in and out of the city. It will be an exciting project!” The Hollister City Council is expected to open bids for the Fourth Street Infrastructure Project at its next regular meeting on Feb. 5. City staff said it will be a sealed, competitive bidding process for Class A contractors in accordance with public bidding practices and laws. “Once the bids are opened and reviewed, the apparent lowest responsive bidder will be considered by the council which is tentatively scheduled for February 20, 2018,” City Engineer

David Rubcic said via email. The $1.8 million project is a combination of three infrastructure projects identified in the city’s capital improvement program. By combining multiple road and water upgrades into a single project, city staff expect a better economy of scale for bidding purposes that could result in a lower cost compared to if the bids went out separately. Work will be conducted on Fourth Street between Line Street and College Street. Upgrades and improvements include the following: • Repaving of Fourth Street • Installation of a storm drain line on Powell Street between Fourth and Fifth Streets

• Reconstruction of intersection at Fifth Street and College Street with new curb ramps • Installation of 12-inch water lines and fire hydrants on Fourth Street • Installation of 36-inch storm drain on Fourth Street • Installation of 24-inch storm drain pipes on College Street, with additional infrastructure to support installation • Replacement of some curbs and gutters • Replacement of corner curb ramps with ADAaccessible ramps • Removal and replacement of some sidewalk and driveways

• Landscaping with planting of approximately 30 trees “The project will also include the installation of two new inground lighted crosswalks similar to the one installed at Monterey and Fourth Street,” Rubcic said. “If funds are available, additional sidewalk will be removed and replaced.” Pending council approval and weather, the Fourth Street Infrastructure Project could begin 30 days after a contract is awarded, placing the start of the timeline around April with construction through the summer. A notice will be mailed to affected residents before work commences.

Monterey County Supervisor and former Watsonville Mayor Luis Alejo announced Monday he has decided not to run for the state Senate’s District 12 seat. Instead, Alejo has decided to focus on the pressing needs facing Monterey County. “Over the last year, I have really grown into my new job as a county supervisor representing the City of Salinas,” Alejo said Monday. “Even though I have worked in other levels of government, this is the best job I have ever had and where I know I can continue to effectively solve problems and serve my constituents.” Alejo opened an exploratory committee in September 2017 to evaluate whether or not to run for State Senate in District 12, which is expected to be an

open race as current State Senator Anthony Cannella terms out. After his first year of initiatives and accomplishments as a new county supervisor, Alejo was elected Jan. 9 to serve as the new chair of the Monterey County Board of Supervisors. He was also elected to serve as president of the Latino Caucus of California Counties last November. Scholarships are awarded each year to students who are pursuing a medical or medically-oriented career. The total amount awarded to each recipient will be at the discretion of the Scholarship Committee. Auxiliary members put in thousands of hours throughout the year running a thrift shop, the

hospital gift shop, and organizing their annual holiday bazaar in order to fund scholarships and purchase equipment for Hazel Hawkins Memorial Hospital and its skilled nursing facilities. To be eligible to apply for a scholarship individuals must: • Be a high school graduate (or equivalent)

At the Firebaugh Westside Tournament, Ramon was involved in two nailbiting matches. The first came in the semifinals, where he lost 3-2 in the ultimate tiebreaker. In the next match, Ramon won in sudden death, 4-2, to propel himself to the thirdplace match. In the semifinals, Ramon went through three, 2-minute regulation periods and three overtime periods before his opponent was rewarded with an escape in the ultimate tiebreaker. “If he escapes he wins, and if I held him down for 30 seconds, I would’ve won,” Ramon said. “It could’ve gone either way. It was a tough match, but you live and learn.” Feeling down but far from demoralized, Ramon felt what it was like to be on the other side of a close match, as he edged Clovis East’s Brevin Leibee, 4-2, for

At 5-foot-5, Matt Ramon has always had a height disadvantage in his athletic career. The San Benito High senior grew up playing baseball and soccer before eventually taking up football and wrestling in his freshman year. Whatever sport Ramon played, he thrived, especially in football and wrestling. Burly and tough, Ramon has used his compact frame to his advantage. Nowhere is that more apparent than on the mat, as Ramon has set himself up for a strong wrestling season. Ramon, who entered the week at No. 5 in the Central Coast Section 170-pound weight division rankings, is coming off solid third-place showings in the Firebaugh Westside and Overfelt tournaments. “I’ve been motivated to prove people wrong and show them there is a lot more than what they see in me,” he said. Ramon has wrestled up a weight class for most of the season, but he’ll get to settle in now at his preferred division. Balers coach Steven Salcedo likes Ramon for plenty of reasons. “Over the years, he has been one of the most coachable kids I have ever worked with,” Salcedo said in an email to the Free Lance. “He has used what he has learned to

out-hustle and outwork his opponents. Part of the game plan I coach is to wear your opponent out and beat them in the end, and that’s what he does. He has a simple game plan, but it works. He gets out of the bottom easily and can ride on top well. His main problem has been taking people down, but that should change now that he isn’t wrestling guys 10 to 12 pounds heavier than him.” Ramon feels he’s an improved wrestler from a year ago, having refined his technical skills and overall mental toughness. “I feel faster and conditioning-wise I feel a lot better,” he said.

Ramon only started wrestling in his freshman year, and has refined his skills each passing year. a sudden victory. Ramon earned the victory by scoring off a headlock in the first overtime period. “It was pretty exciting because at that point I didn’t feel like wrestling,” Ramon said. “I was already tired from the previous match.” In the Central Coast Section Championships last season, Ramon was one win away from competing in the third-place match and a berth to the CIF State Championships. However, he lost in overtime, a heartbreaking defeat that nevertheless served a purpose as it helped him to prepare for this season.

“That was a tough loss,” he said. “I wasn’t wrestling smart, but all of those losses make me learn what not to do going forward.” Ramon has learned valuable lessons from Salcedo; namely, to constantly use his entire body—not just his arms—during a match. In the Firebaugh Westside Tournament, Ramon could barely feel his arms at one point because he wasn’t utilizing his legs in his matches. Unlike most of the topranked wrestlers in the section, Ramon didn’t start his career on the mat until high school. “I’ve come a long way from not knowing

anything about wrestling when I started,” he said. Early on, Ramon knew wrestling was going to be the ultimate physical and mental challenge.

No quitting

“(In one of my first practices), I was hearing the coaches say, ‘No water breaks,’” he said. “When I heard that, I was like, ‘Oh no.’ I didn’t think I could make it through that season, but I did. It was a tough and great, new experience. My dad always told me not to quit, so that kind of helped me to finish what I started.” To his credit, Ramon has improved every season

despite having to juggle football as well. In his offseason, Ramon was dedicated to improving himself in both sports. A starting fullback on the football squad, Ramon routinely collided with bigger players. Yet most of the time he gained yardage after first contact, barreling into defenders with tremendous force. Now in the twilight of his prep wrestling career, Ramon plans on his best CCS finish yet. A year ago, he finished sixth in the championships. “My goal this year is to hopefully make it to state,” he said. “I’ll have to be in the top three at CCS, and I’m confident I can do that.”

Section 17.12.050 “Special purpose land use and permit requirements for open space, park and public facility” is hereby amended to include the following text as follows: a. The following text shall be included preceding Table 17.12-3 “Open Space, Park and Public Facilities/Institutional Zone Districts Land Use and Permit Requirements” to read: “Commercial Uses on Open Space, Park and Public Facilities/Institutional Districts. Commercial leases for use of portions or segments of open space or a park or underutilized buildings or areas in the PF district may be allowed with City Council approval. The intent is to enhance the recreation experience in the open space and park districts where practical and feasible and in the public facility/institutional district to provide opportunity for private businesses to utilize underutilized buildings or areas with enhanced cultural and educational programs, business incubators, shared workspaces, or event centers where desirable or feasible. Furthermore, commercial uses may be desirable in certain circumstances to provide revenues to offset maintenance costs of the balance of a park or municipal property. Each proposed lease shall be carefully studied and judged on the merits of the location of the property, and the type of property on a case by case basis. A. Prior to release of a request for proposal for use of a building or property, the City Council shall adopt a resolution pursuant to Section 3.06.060 of the Hollister Municipal Code that the building or segment of property is not necessary for municipal purposes during the term of the lease or any extension authorized by the City Council. B. Prior to submitting a lease for City Council approval, a request for proposal shall be issued articulating the scope and purpose of the commercial use in context of the property type and surrounding uses. C. Commercial leases at park or open space lands may include commercial concessions, equipment rentals, specialty training or other similar uses that are compatible and incidental and complementary to the primary purpose of the park or open space area. D. Commercial leases of buildings or areas in the public facility/institutional zoning district shall be compatible with surrounding land uses and to the extent feasible enhance programing or services in the community and if possible, nearby uses. E. Approval of a lease shall require a Conditional Use Permit. a. A recommendation from the Parks and Recreation Commission shall be required as part of the Conditional Use Permit application for a lease within any municipal park or open space. b. After receipt of the Planning Commission recommendation, a public hearing on the Conditional Use Permit and lease plan shall be scheduled before the City Council. After the hearing, the Council may approve the Conditional Use Permit and Lease, may disapprove the permit or lease, or may adopt the plan and lease with changes, provided that any changes to the plan that were not considered by the Commission shall be referred to the Commission for its recommendation. Failure of the Commission to report within forty-five (45) days after the referral, or any longer period set by the Council, shall be deemed a recommendation for the approval of the changes.” Section 2. Severability. Should any provision, section, paragraph, sentence, or word of this ordinance be rendered or declared invalid by any final court action in a court of competent jurisdiction or by reason of any preemptive legislation, the remaining provisions, sections, paragraphs, sentences, or words of this ordinance as hereby adopted shall remain in full force and effect. Section 3. Effective Date. This ordinance shall take effect and be in force thirty (30) days from and after its final passage. Section 4. Publication. Within fifteen (15) days after passage, the City Clerk shall cause this ordinance to be published one time in the Free Lance, a newspaper of general circulation. The work to be performed includes, but is not necessarily limited to: the installation of a new 12” waterline and new 36” storm drain line on Fourth Street, a new 24” storm drain line on College Street, and a new 24”storm drain line on Powell Street in accordance with the plans and specifications.
