The future of this year’s Hollister Independence Rally could be decided this month as event promoter Roadshows Inc. tries to wrap up enough sponsors to submit a proposal to the city. Promoter Randy Burke said the Renobased company is still pursuing national sponsors for this year’s event— which would take place on July 6, 7 and 8—if he signs enough national sponsors. “We plan on making a proposal sometime in February,” Burke said by phone Monday. “It’s all contingent on our successful landing of several new sponsors.” Last year marked the 70th anniversary of the event that inspired the internationally-known motorcycle rally—the 1947 invasion of Hollister by the Boozefighters ➝ Motorcycle Rally, 17

The California Democratic Party on Saturday gave a pre-endorsement to San Benito County Supervisor Robert Rivas at the Region 7 Pre-Endorsement Conference. The pre-endorsement comes just three weeks after Rivas officially launched his campaign for the 30th Assembly District, which includes the cities of Morgan Hill, Gilroy, and Hollister. “I am extremely proud to have received 80 percent of the vote from local Democrats,” Rivas said. “Winning this

pre-endorsement is a sign of the support we’re receiving as we meet with voters around the district.” The California Democratic Party sets a high threshold for pre-endorsements. A candidate must receive over 70 percent support from delegates to the preendorsement conference. Democratic state Assemblywoman Anna Caballero—a state Senate candidate this year—faced criticism last week after a California-based progressive advocacy group announced her inclusion in a “Hall of Shame.” Caballero received an “F” grade in the third annual “Courage Score” report card for voting against environmental protection, criminal justice reform and gun control legislation. The report card, which can be found at www.couragescore.org/ people/anna-caballero/, claims that her votes on those issues go against the grain of regional voters in California's 30th Assembly District, which encompasses all of San Benito County, Gilroy, Morgan

Hill, Watsonville, Salinas, Soledad, Greenfield, Gonzales, and King City. District voters approved several progressive state propositions in the 2016 General Election, including Proposition 55 (taxing wealthy to fund state education), Proposition 57 (more humane parole/ juvenile bail system), Proposition 63 (expanding gun background checks), and Proposition 64 (legalizing recreational cannabis). The group contrasted those votes to Caballero’s record of voting in the Assembly against AB7 that outlaws open carry in more public spaces, AB378 that sets new pollution limits for cap-and-trade recipients, AB423 that helps protect low-income residents from eviction, AB890 that mandates all new developments undergo environmental review, and AB1578 that protects legal cannabis users from federal agents. “This grade is misleading and misrepresents the 30th Assembly District,” Caballero said in a

statement released Tuesday. The 30th District “is the agricultural engine of the state—a rural community comprised of hardworking families—mostly farmworkers and other blue collar workers. “Our needs are different from the needs of people who live in the coastal areas of the state and the grade assigned to me assumes a constituency with interests that fit urban coastal communities, not agricultural communities. In my rural district, families are concerned with the high cost of living, lack of affordable housing, childcare and preschool opportunities, and the need for good paying jobs,” she said in her statement. “In fact, I was recently honored as Legislator of the Year by the Rural County Representatives of California because my values are consistent with those of the rural communities I represent. “While it is important to discuss progressive ideas, I will continue to advocate for the interests of my district and the priorities of my

constituents, who continue to elect me by overwhelming majorities,” the Assemblywoman said. Caballero terms out of the Assembly at the end of this year, and announced in late 2017 her intent to run for the state Senate’s 12th District, currently held by Republican Anthony Cannella, who also terms out this year. “Assemblymember Caballero is part of the problem in Sacramento,” Courage Campaign Executive Director Eddie Kurtz said. “Courage Campaign will make sure her constituents know she cares more about policies favored by corporate lobbyists than about their best interests. With Washington broken and with Trump pursuing a reckless and bigoted agenda, now more than ever it is urgent that California lead the way, and people like Anna Caballero are an obstacle to that progress. Assemblymember Caballero: we’re putting you on notice.” The report card is published

by progressive advocacy group Courage Campaign in partnership with the Alliance of Californians for Community Empowerment Action (ACCE), another state advocacy group with a focus on worker and housing justice. The report card ranks legislators on their votes and how they represented constituents against corporations. It is endorsed by such groups as California Calls, Democracy For America, Dolores Huerta Foundation, DailyKos, and California Immigrant Policy Center. Courage Campaign plans to endorse candidates during the state primary later this year and plans to spend at least $100,000 in digital and television advertisements, mailers, and mobilization/ on-the-ground actions. “We’re taking accountability to the next level, and for the first time in our organization’s history, we will be playing in Democratic primaries using the Courage Score as our North Star,” said Kurtz.

Teachers to lead Summer Scholars Academy ➝ SBHS, 1

Gavilan hired four San Benito High School teachers to participate in 30 hours of curriculum development and another 30 hours of direct instruction to high school students in a combination of after-school and

Saturday workshops as part of a Smarter Balanced Assessment Consortium Math Boot Camp. The focus will be on 11thgrade English Language Development students, in preparation for the SBAC test in April. There will also be co-taught enrichment seminars for seniors preparing to take the Gavilan College placement exam.

In addition, Gavilan hired six San Benito High School teachers to lead a Summer Scholars Academy with an English language arts focus to participate in 30 hours of curriculum development, which is already underway, and 30 hours of direct instruction to students during the summer. The focus of the five-day,

six-hours-per-session academy will be on offering enrichment instruction and activities to ELD long-term learners and completion of the seminar will be part of a student’s ELD reclassification. Teachers will work in pairs to focus on a specialty—reading, writing, creative expressing or speaking. “It should be an immersive

experience,” said English Department Chair Carissa Alvarez. “The idea is to help the kids see that they do, in fact, have something to offer in a college setting. We want them to explore their identify and, in turn, become inspired to push their education further than high school, whether it be to attend a community college, trade school or university.”

Despite the completion of the Fairfield Inn and Suites by Marriott off Gateway Drive, the Hollister City Council voted 3-1 to include the new hotel in the Economic Development Subsidy, a program that is designed to encourage the development of additional hotels in an underserved San Benito County market. “I think it’s good and we need more hotels in town,” said Juli Vieira, CEO of the San Benito County Chamber of Commerce. “We had a baseball team come to town that was looking for 15 to 20 rooms and we just didn’t have that at the time.” The Economic Development Subsidy will provide an annual 70 percent rebate on transient occupancy tax, a tax collected on hotel rooms. The rebate will be in effect for 10 years and will be capped at $2 million. When the 10-year term of the deal is up, the city will have the option to extend the deal for another five years with a rebate of 33 percent.

The transient occupancy tax rebate will only be available for hotels that reach a three-diamond rating, which is described by AAA to meet expectations that include: distinguished, multifaceted with enhanced physical attributes, amenities and guest comforts. Today, the only hotel in Hollister that achieves a three-diamond rating is Fairfield Inn and Suites by Marriott. The city’s smaller lodges will not benefit from the incentive program. San Benito County’s loss is Gilroy’s gain for available hotel rooms. For large events such as the Hollister Independence Rally, the city’s annual downtown motorcycle event, a lack of available hotel rooms has adverse effects on other businesses in town that would benefit from the influx of visitors. “When you have an event like that, if they ride for hours to get here and can’t stay the night in town, they just might go home,” Vieira said. “That means that they are likely to spend money elsewhere, instead of here. We have a lot of weddings in Hollister and often they are staying in Gilroy.” Councilmember Karson Klauer was the lone dissenting vote and was skeptical of the

agreement at the Jan. 16 city council meeting, citing the $2 million cap along with previous agreements with contractors he believed were not beneficial to the city’s interests. “A million dollars in transient occupancy tax is a million

dollars of general fund money that can go towards police, fire, parks, and recreation,” Klauer said. While Vieira is happy to welcome the Fairfield Inn, she hopes that the city will add another hotel and an expansion

of available conference room space. “The Fairfield Inn’s conference room seats about 40 people comfortably, so I think we will need more room for larger conferences,” Vieira said in regards to Hollister’s hotel needs.

Dabo needs to resign now

N

ews arrived this week that the new state election reform law requires moving the date of the San Benito County Board of Education elections from June to November. That’s a mixed blessing for county voters. On the plus side, the change means that prospective candidates for the four-year term have until July to decide whether to run. The new period for filing as a candidate for one of the two open board seats begins July 16, and closes Aug. 10. The new law did not affect the election dates for county school superintendent. That election will occur in June, as it has in previous years. Schools Supt. Krystal Lomanto, former San Benito High School principal, was first elected in 2014. She has filed documents indicating she intends to seek re-election. Thus far, she is the only candidate. There are two board seats open this year. The board seat for Supervisor District 3 is held by retired educator and current president of the county school board, Joan Campbell-Garcia. She has not said yet whether she will seek reelection. The county school board has a longstanding tradition of having unopposed elections. The longer filing deadline gives more time for thoughtful people to consider running for a trustee seat, and the November election ensures there will be more people voting—if there is more than one candidate. These jobs are too important to go unopposed. It’s time to break with tradition and have contested elections. The other school board seat is held by Mitchell Dabo, who has been a board member for more than 30 years. He now has until July to decide whether to seek re-election, although he has said he intends to resign from the board.

Lomanto said Dabo has not indicated when he will resign. On the downside, the new filing deadline means that Dabo could remain in limbo and drag his decision out for even more months. In December, Dabo chose not seek to be reelected to a second one-year term as president by his fellow trustees. Dabo said on Dec. 1 he would resign his school board seat, citing fallout from the civil court ruling in November that he illegally took money from a charitable trust. “I will resign my position. I just don’t know when I’ll do it.” As we have said before, Dabo should go ahead and get out of public life. The revelations in the civil suit mean have placed a cloud over the board. His continued presence raises doubts about the trustees’ judgment and their decisions, which can only be cleared by his rapid departure. The Superior Court trial in San Benito ended with a civil ruling that Dabo violated state probate laws and diverted money from a charitable trust to his own accounts, denying the Community Foundation for San Benito County more than $640,000 in money for local charities. A Superior Court judge on Nov. 13 awarded the foundation $1.74 million in damages, plus legal fees estimated at $85,000. It is shameful that Lomanto and the district trustees all have consistently denied any comment on the civil suit, or on the bank records that show that Dabo was responsible for diverting large sums of money from a charitable trust to his own accounts—or on Dabo’s status with the board. He should resign at the Feb. 8 meeting. This will give the board a chance to seek out and interview candidates for an appointed position and give the public several months to flush out more candidates for a board that is sorely in need of new faces and new ideas.

elen Lena Turturici entered into eternal rest on Sunday, January 14, 2018. During her 88 years, she touched many lives with her wise and caring ways. She was an amazing daughter, wife, sister, Mom, and Nani. She loved spending time with her family and friends around the kitchen table and on the golf course. She also enjoyed reading, puzzles, playing cards, and bowling.

Helen was born to Gus and Lena Albo in Berkeley and graduated from Berkeley High School. Following graduation, she worked as a bookkeeper. Helen met her husband Bennie and they built their life and family together in San Jose. Helen and Bennie retired to Hollister in 1998 to live and play golf on Ridgemark Golf Course. Helen is survived by her loving children David, Douglas, and Carolyn (Spain); caring son-in-law Bill; adoring granddaughter Samantha; dear sister-in-law Marie (Romero); and many cherished nieces, nephews, and cousins. She was preceded in death by her devoted husband Bennie in 2014. In lieu of flowers, donations may be made to your favorite charity or to St. Jude Children’s Hospital. A memorial mass will be held for Helen at St. Christopher Parish in San Jose on Friday, February 2, 2018 at 10:30am.

ee Farrand Silveira passed away on January 17, 2018 at 92 years of age. Born in Roseville, CA, at age 1, he moved to Gilroy with his father and mother, John and Lucy Silveira, and his brother Roy. He lived his life on the family ranch in South Santa Clara County. Lee and his loving wife Annabell (deceased in 1995) were married for 47 wonderful years, and raised two children, Kenneth and Sherrie. Lee was a dedicated husband, father, grandfather and friend.

A Superior Court judge on Nov. 13 awarded the foundation $1.74 million in damages, plus legal fees estimated at $85,000. Lomanto and the district’s trustees all have consistently denied any comment on the civil suit, or on the evidence that Dabo was responsible for diverting large sums of money from a charitable trust to his own accounts or on Dabo’s status with the board. Dabo did not attend the November or December board meetings, but did attend the January meeting. The board’s next meeting is Feb .8. Campbell-Garcia is a former teacher at San Andreas Continuation High School and has a strong interest in vocational education. The county school board is made up of five representatives, one from each of the supervisor districts. Campbell-Garcia is the representative for District 3. Dabo is the representative for District 4. The governing board is the policy-making body of the county office of education, which oversees alternative and special education and provides support to the county’s 11 different school districts.

I just don’t know when I’ll do it.” A Superior Court trial in San Benito ended with a civil ruling that Dabo violated state probate laws and diverted money from a charitable trust to his own accounts, denying the Community Foundation for San Benito Country more than $640,000 in money for local charities. Dabo initially had said only that he would not seek reelection by his fellow trustees to a third consecutive year as president of the school board, but stopped short of saying he would quit the board, where he has served for 34 years. He is currently under investigation by the San Benito County District Attorney, following a criminal investigation by the Hollister Police Department. Police had examined a binder of evidence of – canceled checks, bank statements and court documents –showing withdrawals of money from the Matulich Charitable Trust by Dabo. The evidence was presented at the trial of Dabo’s civil lawsuit by the Community Foundation for San Benito County.

State urges caution with wild mushrooms OVER 1,000 CASES OF POISONOUS INGESTION SINCE 2016 Staff Report

• 16 suffered a major health outcome, such as liver failure leading to coma and/ or a liver transplant, or kidney failure requiring dialysis. • 51 suffered a moderate health outcome, such as dehydration due to vomiting and diarrhea, or injury to the liver or kidney. • 433 were children younger than six years of age. Usually, the children ate a small amount of a mushroom growing in yards or neighborhood parks.

As seasonal rains promote the growth of wild mushrooms, California Department of Public Health Director and State Public Health Officer Dr. Karen Smith is again reminding people that eating wild mushrooms can cause serious illness and even death. “Telling the difference between wild mushrooms that are safe and those that are poisonous can be difficult for many people,” Smith said. “Wild mushrooms should not be eaten unless they have been examined by a mushroom expert and determined to be edible.” The most serious illnesses and deaths have been linked primarily to wild mushrooms known to cause liver damage, including Amanita phalloides, also known as the “death cap” and Amanita ocreata, or “destroying angel.” A bloom of

Amanita phalloides last winter resulted in 14 mushroom poisonings in California that required hospitalization. Three of these cases required a liver transplant. According to the California Poison Control System (CPCS), 1,038 cases of poisonous mushroom ingestion were reported throughout the state from November 2016 to January 15, 2018. Among those cases:

and resulted in 14 state cases of mushroom poisonings last winter. • 522 were treated at a health care facility. • 16 were admitted to an intensive care unit.

Eating poisonous mushrooms can cause abdominal pain, cramping, vomiting, diarrhea, liver damage or death. Anyone who develops symptoms after eating wild mushrooms should seek

immediate medical attention. People who develop these symptoms, or their treating health care providers, should immediately contact the California Poison Control System at (800) 222-1222.

The San Benito County Arts Council recently announced its 10th annual high school art exhibition, Art 110, on display to Feb. 17 at the Art Annex, 217 Fifth Street in downtown Hollister. The exhibition, which features artwork from the advanced and AP

art classes at San Benito High School, will be open during special hours from 12 to 4pm on Feb. 3, Feb. 11 and Feb. 17. The community is encouraged to join in the opening reception from 12 to 4pm on Saturday, Feb. 3 to view the artwork, meet the artists and enjoy light refreshments. This event is free and open to everyone. The San Benito County Arts Council presents Art 110 under the guidance of John Robrock and Jennifer

Registration for 201819 Full-day Kindergarten and Full-day Transitional Kindergarten classes for incoming Hollister School District students begins Feb. 5, according to a district announcement. Parents must register at their neighborhood school. Kindergarten students must be 5 years old on or before Sept. 1. Transitional Kindergarten students must be 5 years old from Sept. 2 through Jan. 31. Parents must bring a certified copy of their child’s birth certificate, written proof of immunizations as required

by California State law, which includes Hepatitis B and second Measles vaccine, and proof of address (current utility bill). Along with a proof of residency form, parents will need to present current approved proof of residency documents, including a PG&E bill, land/cell phone bill, property tax bill, current rental agreement, DMV car registration, doctor bill or credit card bill. They were the third promoter in four years to handle the event. While the budget has remained consistent over the past couple years, previous years showed large fluctuations. A city spreadsheet obtained in a 2016 records request by the Free Lance shows total activity expenses for the rally from 2013 to 2017. Total activity expenses were $150,930 for 2013-2014, $244,950 for 20142015, $193,101 for 2015-2016, and $163,969 for 2016-2017. For the 2017 Hollister Independence Rally, Roadshows Inc. entered into a $164,000, threeday contract with the City of Hollister. There is a good reason why San Benito High junior Edgar Barbosa plays on the right wing. Barbosa makes several strong runs in every game, a byproduct of his speed. Often times, the 5-foot5, 115-pound Barbosa gains separation from defenders to corral a pass before shooting or delivering the ball to a teammate. “Usually I get sent through balls and catch up to them because of my speed,” he said. “That is a strength along with my ball control.” Barbosa is one of the dozen-plus

players who have contributed to what is shaping up to be a historic season for the Haybalers, who entered Thursday’s Monterey Bay League Gabilan Division showdown against Alisal at 8-1-6 overall and 5-0-3 in league. With 18 points, the first-place Balers are two points up on Alisal, which has played one less game. San Benito defeated Alisal 3-0 in the teams’ first meeting on Jan. 9. As a first-year varsity member—Barbosa played forward on the junior varsity squad last season—Barbosa has been critical to the team’s success. “He is fast, great at dribbling the ball, not selfish at all, and he has great vision,” Balers coach Marco Orozco said. “He has scored important goals, especially during the Homestead Tournament.”

Barbosa said his finest individual moment of the season came in the Homestead Tournament, as San Benito High won the top division of the prestigious tournament for the first time in school history. Barbosa had two goals during the team’s four-match run in the tourney, including a critical goal late in the second half of one contest that proved pivotal. Barbosa has made a smooth transition on the varsity after being called up for the team’s Central Coast Section playoff run last season. “I got some time in one of the CCS games, and I got a feel for how the varsity level was going to be like,” he said. “I knew it was going to be tough because we have a lot of talent, and you have to compete everyday.” The Balers lost only a couple

of starters off a team that won the program’s first-ever playoff game, and they’ve followed that up with what statistically is their best-ever start to a season. If San Benito can overtake Alisal for the title, it would mark another first for the program—winning an A-league championship. “That would be the biggest accomplishment we’d have so far,” he said. “To win league would mean everything. No one is taking anything for granted. We’ve been focused in practice and training to beat them since they’re our main rivals.” If the Balers can repeat the best parts of their performance against Monterey last week—a 5-3 win—they’ll be a strong bet to win a section title. “We scored the first two goals, but Monterey came back and we

kind of struggled in the beginning of the second half,” Barbosa said. “But we turned it up in the end and got the win. We were telling ourselves not to go in too confident and to stay humble. When we play unselfishly, that’s when we’re at our best.” In addition to his speed, Barbosa has tremendous ball control. Barbosa credits his uncle, also named Edgar, for motivating and helping him develop the skills to play at a high level. “He advised me to play soccer,” Barbosa said. “Without him, I wouldn’t have tried out for it.” Barbosa completed the first semester with a 4.0 GPA, a testament to his seriousness in the classroom. On the field, Barbosa has achieved at a high level. “I always want to improve,” he said.

When Jason White started playing lacrosse for the first time in his freshman year, he made it a goal to land an athletic scholarship. White, a San Benito High senior, has made that goal a reality after making a verbal commitment to play lacrosse at Notre Dame de Namur University (NDNU) in Belmont. The 5-foot-11, 205pound White said he will sign his letter of intent in mid-April. When NDNU offered White a scholarship in early January, he was floored. “I couldn’t believe it at first,” he said. “It was unbelievable—just unbelievable.

It’s been my goal since my freshmen year, and a big dream of mine to reach this point. Just really thankful.” White and NDNU assistant coach Jon Black maintained contact throughout the recruiting process, which went into full swing once White took part in NDNU’s Prospect Day on Jan. 7, an event where recruits got to tour the campus, meet the team and go through drills. What helped White was the fact that he has played every position for San Benito High, including goalie last season. “Coach John said he liked the fact that I play multiple positions, and how I communicated on the field,” White said.

White loved the fact that his parents and friends will be able to watch him play, as Belmont is only a 50-minute drive from Hollister during off-peak traffic hours. “It’s really close to home, next to San Francisco and I’ve got friends close by,” he said. “NDNU made a very strong scholarship offer, and I really love it there. My parents are really proud of me because they’ve seen me come a long way from day one playing lacrosse. They’ve been supporting me since the very beginning.” White credited his former club coach, Mario Enea, for helping him

develop into a bona-fide college prospect. White spent the summer of 2016 with Enea, the head coach at the University of Oklahoma who founded BraveHeart Lacrosse, the club program White has been a member of for the last three years. White diligently spent two months that summer working with Enea, including a weeklong camp that proved to be vital to his development and somewhat of a game-changer. “I look back at that week and started to realize I could play this game at the next level if I kept working hard,” White said. ➝ White, page 21

White prepped for the season by practicing with BraveHeart, which held competitive box lacrosse pick-up games every Wednesday. “The pickup games

are very competitive,” White said. “You’ve got many of the top players in the area playing there, and we take it seriously.” San Benito High lacrosse coach Don Jones said it’s been a pleasure coaching White since the program’s inception three years ago. “He is a great student of the game, a great competitor and a quick learner,” Jones said.

Enea drilled White in the finer technical aspects of the game while also instilling in White a discipline and focus that is evident every time he takes the field. “Coach Mario was a really good influence,” White said. “I did a lot of 7 on 7 shooting (camps/ tournaments) and drills, just doing things over and over.” When White first picked up lacrosse equipment the summer before his freshman year, he had no idea how much he could improve in a relatively short amount of time. “It was weird at first because I could barely cradle and barely shoot,” he said. “Just putting in time with my teammates and coaches helped me get dialed in.” White decided to play football last season, earning some playing time at defensive end and on special teams. “I loved being with coach (Bryan) Smith and coach Cam (offensive line coach Chris Cameron),” he said. “It was a great group of guys, and football got me really conditioned for lacrosse.” Practice for the spring sports teams started Monday, and White enters his final year of high school lacrosse at peace, knowing a college career awaits. However, White and his San Benito High teammates have unfinished business in that they’re eager to compete for a Mission Trail Athletic

The customer must comply with State and Federal laws governing the separation of dual water systems or a threat of cross connection to the drinking water system by installation of a back flow protective device to protect the public water supply from the danger of cross connections. All existing non-residential customers must install a backflow protective device approved by the Tres Pinos Water District no later than two months after this ordinance takes effect or service will be discontinued until said device is installed. All future customers must install a backflow protective device approved by the Water District before service is granted.
