City manager gives update on city CITY COUNCIL TO STUDY PLAN LIMITING SINGLEFAMILY HOMES Nicholas Preciado Reporter

In the view of City Manager Bill Avera, the City of Hollister is “in good shape.” Avera reported on economic condition of the city at a recent San Benito County Chamber of Commerce lunch event billed as a “state of the city” report. Avera said he would not have characterized his report as an actual “State of the City” address, but stated that Hollister is currently doing well. “The last four to five years have been good to us,” he said. “We have challenges ahead of us of course, but where we have been, I think we are in good shape.” Recent economic development efforts like the Teknova business expansion and the grand opening of the Fairfield Inn and Suites by Marriott show that Hollister is serious about bringing business to town, he said. He added that housing growth is also healthy. “Dealing with the facts, and not public perception, is that we are seeing growth,” Avera said. “Growth for a community is good and it is modest. I do not believe it is necessarily out of control. The projects we are seeing being built have been in the planning stages for several years. They do not just pop up overnight. That is not how development works.” In the early 2000s, the Regional Water Resources Control Board enacted a building moratorium in Hollister after 15 million gallons of wastewater spilled into the San Benito River

bed. The moratorium halted housing, commercial development, and job growth in the region for over half a decade. Then a few years later, the Great Recession hit in 2008 and kept the economy stunted. Since the moratorium was lifted in 2008, Avera reported that 560 homes have been built, including 143 homes built in 2016. In 2017, 309 occupied units were constructed. Later this month, the Hollister City Council will decide on a proposed growth management program that would cap the construction of single-family residential housing to 244 units a year. Affordable housing, senior housing, secondary or accessory units, special needs housing, and rentals would all be exempt from the cap. The cap is an attempt to control local housing development in the midst of a statewide housing crisis. “We want to make sure we grow at a healthy rate,” Avera said. “I think what the state is mostly concerned about is making sure the affordable stuff is met, the higher density stuff is met. By not having that stuff count against the cap, I think we are good.” Cannabis also came up in conversation. The city recently approved allowing recreational, or adult-use, cannabis businesses to operate in town, excluding dispensaries. “What we have right now are smaller facilities just beginning operations,” Avera said. “A lot of the focus on the law enforcement side is to ensure the only way a legal cannabis operation is going to remain in operation and successful is if we cut down on what I would call the illicit sales of cannabis. That is what our focus needs to continue to be on.”

Less than an hour earlier on Feb. 25—about 4:10pm— authorities responded to a collision in which an SUV struck a motorcycle, resulting in a motorcyclist’s death, according to CHP. That accident took place at the intersection of SR 156 and San Felipe Road in Hollister. A 43-year-old Gilroy man, later identified as Michael Gonzalez, was driving a 2015 Harley Davidson motorcycle with a 29-year-old female passenger, also of Gilroy, on the back, according to police. The driver of the motorcycle was stopped at a red traffic light in the left turn of SR 156, poised to turn onto northbound San Felipe Road. A 2005 GMC Sierra, driven by a 66-yearold Hollister man, was approaching the intersection on southbound SR 156 at about 50 mph. For an unknown reason, the motorcyclist began making a left turn onto San Felipe Road while the traffic light was still red, police said. After entering the intersection, the motorcyclist began applying the vehicle’s brakes in an effort to avoid colliding with the approaching GMC, according to police. The Gilroy man was unable to avoid a collision with the SUV. As a result, the Harley Davidson driver suffered fatal injuries upon impact, and was pronounced dead at the scene, police said. His passenger suffered major injuries and was transported by air ambulance to Natividad Medical Center. Authorities do not

think alcohol or drugs were a factor in this collision. The accident is under investigation.

Single-vehicle death on Pacheco Pass

Another single-vehicle accident resulted in the driver’s death Feb. 24 on SR 152 in eastern unincorporated Santa Clara County east of Gilroy, according to the CHP. About 2:10pm, a 49-year-old Monterey woman was driving a 2014 Ford eastbound on SR 152 (Pacheco Pass), with a 49-year-old female passenger in the vehicle, police said. For an unknown reason, the driver turned the vehicle to the right, causing the Ford to leave the roadway, travel across the right shoulder and collide with a tree, police reported. The collision occurred just east of Lake Road. The driver of the vehicle suffered fatal injuries, and was pronounced dead at the scene, police said. The Santa Clara County Coroner’s Office identified the driver as Krista Evers. The passenger suffered minor injuries and was flown to San Jose Regional Medical Center. Authorities do not think alcohol or drugs were a factor in the accident, which is under investigation. On Monday, Feb. 26, CHP issued another press release urging motorists to drive with caution in response to the unusual cluster of three traffic fatalities in the area in one weekend. The release advises residents to “drive safely and courteously at all times,” obey traffic laws and slow down because “speed is a factor in most collisions.” Furthermore, officers reminded residents not to drink and drive. In 2016, more than 1,800 people were killed in California in accidents in which alcohol was a factor, according to the CHP. “While any loss of life is tragic, a loss of life resulting from something preventable is especially troubling,” the Feb. 26 press release states. “Most traffic collisions are preventable.”

Cyclist struck by Toyota

The recent rash of fatalities began Feb. 19, when a Cupertino bicyclist died after a collision with a

Toyota just south of Hollister, according to police. The accident occurred about 5pm. A 2001 Toyota, driven by a 40-yearold San Lorenzo man, was traveling northbound on SR 25 just south of Cienega Road, according to a CHP press release. The 65-year-old cyclist, riding a Trek bicycle, was traveling on SR 25 in the same direction as the Toyota, when the bigger vehicle approached from behind, according to police. The Toyota collided with the bicyclist “due to the unsafe speed of ” the Toyota, police said. The collision caused the cyclist to be ejected from his bicycle before hitting the asphalt roadway, according to CHP. The Toyota stayed at the scene, where authorities pronounced the cyclist dead. The driver of the Toyota suffered a minor cut to his finger, according to police. Three passengers in the Toyota were uninjured. It “does not appear” that alcohol or drugs were a factor in this accident, according to police. The accident remains under investigation.

Fatality on Shore Road

The latest fatality reported by CHP occurred north of Hollister the afternoon of Feb. 26. About 3:12pm Feb. 26, a 52-year-old Hollister man was traveling eastbound on Shore Road west of San Felipe Road in a 1995 Chevrolet S-10, according to a press release from the CHP Hollister-Gilroy office. For an unknown reason, the driver allowed the vehicle to travel across the westbound traffic lane and onto the north shoulder of Shore Road. The vehicle collided with two trees before coming to rest, police said. As a result of the collision, the driver suffered fatal injuries, according to the CHP. Police do not think alcohol or drugs were a factor in the collision, which is under investigation. The San Benito County Sheriff ’s Office identified the driver as Steve Lawrence. At the scene, Mora referred to the two young boys in the vehicle as his children, according to CHP Officer Chris Miceli. The San Benito County Sheriff’s Office later identified the boy as Camillo Mora-Valles, of Salinas. Mora, the driver, suffered minor injuries in the accident and was transported to Hazel Hawkins Hospital in Hollister, according to police. Mora was arrested on suspicion of murder and driving while intoxicated, causing bodily injury. He was booked into the San Benito County Jail, according to police.

Bill 109, to reclassify current “nonviolent” crimes as “violent” to prevent the early release of inmates convicted of various sex and assault crimes. The initiative also aims to reform the parole system to stop early release of violent felons, expand parolee oversight, strengthen penalties for parole violations, reform theft laws, and expand DNA collection for drug, theft, domestic violence, and other crimes. It is supported by the California Police Chiefs Association, The California District Attorney’s Association, andthe Peace Officers Research Association of California. Former Gilroy Police Officer and current Hollister City Councilman Jim Gillio is another

supporter of the Reducing Crime and Keeping California Safe Act of 2018. “Over the past several years we have had Proposition 47 and Proposition 57 that have essentially, in an administrative way, decriminalized certain crimes,” Gillio said by phone Monday. “Certain violent crimes have been lowered, so you are eligible for early release. Administratively, so you are eligible for early release is what I mean by lowered.” California voters approved Proposition 57 in November 2016, which allowed parole consideration for nonviolent felons, authorized creditearning opportunities for good behavior, and changed some juvenile prosecution policies.

“The overall intent of both Prop 47 and 57 was to increase the opportunities for rehabilitation and try to minimize mass incarceration, but there were unintended consequences,” Gillio said. The Hollister councilman is currently working with Acting Chief of Police Carlos Reynoso to have a support resolution for the new initiative placed on the next city council meeting on March 5. “I will present it to the city council for their consideration,” Reynoso said. “If passed, all we are asking for is their support in getting this initiative on the ballot For more information on the Reducing Crime and Keeping California Safe Act of 2018, visit www. keepCALsafe.org.

Complete the ag census

T

here’s still time. To ensure an accurate representation of the agriculture industry in this country, the United States Department of Agriculture’s National Agricultural Statistics Service has extended their 2017 Census of Agriculture response deadline through spring, and the Rural Coalition/Coalición Rural is calling on all farmers and ranchers to participate. Small and minority producers need policymakers to continue to respect their value. According to the 2012 Census of Agriculture, small farms make up 88 percent of all U.S. farms. It’s data like this that demonstrate economic importance. With a new Farm Bill around the corner, this is the time to be counted. The Census of Agriculture, conducted just once every five years and sent to every farm and ranch in the country, is the only source of uniform, comprehensive, and impartial agriculture data down to the county level. Providing an overall picture of U.S. agriculture, census data are then relied on when making important decisions about farm policy, disaster relief, loan programs, research, technology development, infrastructure improvements, and more. Trade associations, extension educators, agribusinesses, even farmers and ranchers themselves have used census data in support of American agriculture. For nearly 30 years, the Outreach and Assistance to Socially Disadvantaged and Veteran Farmers and Ranchers Program has been the primary tool to help historically underserved producers gain access to USDA’s credit, commodity, conservation, and other services. In the four years of the 2008 Farm Bill, the program received $75 million in mandatory funds, about $18 million per year. According to the 2012 Census of Agriculture, during that time, the number of Hispanic and Asian-American farmers increased 21 percent, African-American farmers increased 12 percent, and Native American farmers increased 5 percent. In the 2014 Farm Bill, Congress expanded the outreach

and assistance program to include veteran farmers, making increased funding all the more necessary. However, that Farm Bill reduced mandatory funds to only $10 million annually. If everyone is counted, data from the 2017 Census of Agriculture will help make the case for restoring the additional funding needed to restore the aid program to its previous or better levels. But this is just one example of how census data have been and will be used. For farmers and ranchers, the Census of Agriculture is their voice, their opportunity to be represented in the data. There’s strength in numbers. This year’s Census of Agriculture aims to show an even more detailed account of the industry. Producers will see a new question about military veteran status, expanded questions about food marketing practices, and questions about on-farm decision-making to better capture the roles and contributions of new farmers, women farmers, and others involved in running the business. Representing thousands of diverse producers throughout the United States, the rural coalition has worked for 40 years to promote just and sustainable rural development that brings fair returns to diverse farmers and communities. It also works to protect the environment and bring safe and healthy food to consumers. Serving as an advocacy voice, the coalition was able to secure more than 30 sections of policies in the 2008 Farm Bill that provided more opportunities for small and minority producers, and developed methods and models to serve its constituencies best. What will the 2017 Census of Agriculture tell us about changes over the last five years? We will see, but now is the time to ensure an accurate representation of the industry—not just for the future of your operation but your community as well. We urge you to respond to your Census of Agriculture today. I still haven’t gotten any feedback about our lobbyist and if she’s fighting for road money. So until that happens, I will not support any new tax of any kind. Gifted Games

The Gifted Games began in 2005 as a way for San Benito Life Skills students to train for and participate in athletics in a non-competitive atmosphere. The activity then expanded to an event that invited students from Hollister Elementary School District schools to compete at the campus stadium and, in 2011, the Games invited the Gilroy Unified School District to participate. The Gifted Games, now in its 13th year, is open to all preschool through high school students in San Benito County and Gilroy Unified, and the event, with 400 students, is hosted in alternating years by San Benito and Gilroy High schools.

Baler Biscuits

Another project Sauer coordinates is Baler Biscuits, which for the past seven years has given students in the Life Skills program real-world business experience making and selling dog treats.

Gifted Cheer

Founded in the 2015-16 school year by Hilda Cascio, Gifted Cheer gives boys and girls with disabilities the opportunity to develop gross motor skills, coordinate movement and dance, and show their school spirit as a fullfledged cheer squad supported by the Baler Cheer students. Baler Buckaroos Rodeo Starting in 2016-17 by San Benito instructional aide and alumna Danielle Craig with help from Future Farmers of America and community sponsors, general education students help students with disabilities enjoy modified rodeo events including goat tail untying, single-stake stick horse races, dummy roping and boot and hat races.

Based on an idea from social media, Happy Cup

is a campus beverage and snack service run by the Special Education Department, whose students make drinks and snacks to sell to staff around campus. “This helps students learn job skills for when they graduate,” said Maura Forbush, a Baler alumnaturned Special Education teacher. She said every student shares roles such as cart pusher, beverage dispenser, pastry identifier, cash register operator and hostess/host.

Life Skills Prom

For the past seven years, the school’s Associated Student Body has helped coordinate a Prom for the Life Skills program, complete with food provided by the school’s food services department, a slide show and decorations by Circle of Friends. Raymond Andrade, a new special education instructional aide, helped start the Prom when he was a student at San Benito.

Gifted Soccer

The newest inclusion effort on campus is Gifted Soccer, which senior varsity soccer player and peer teacher Mariana Magana created to give students with disabilities the opportunity to play a competitive game in the main campus quad—complete with a cheering section of students on their lunch break.

The Gifted Games began in 2005 for San Benito High School Life Skills students.

The Peer Helper program, formed in 2011, is a class in which general education

students attend Life Skills classes to serve as extra support for teachers and students. The helpers—there can be two or three in every severely disabled classroom—may be assigned to a particular student or a group of students to provide support on academic, functional and social tasks. Class of 2013 alumna Ellie Burley was a peer helper for two years and is now a special education teacher at her alma mater.

I want to thank the staff and Doctors at Hazel Hawkins Hospital for the excellent care I received when I had emergency surgery on Sunday, November 27, 2017. Upon entering the Emergency department, throughout surgery and returning home three days later, I had excellent professional care. AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HOLLISTER ADDING SECTION 5.21.090 REAUTHORIZATION OF STATE FRANCHISE HOLDER PEG FEES TO HOLLISTER MUNICIPAL CODE 5.21 STATE VIDEO SERVICE FRANCHISES WHEREAS, Section 5870(n) of the Public Utilities Code, which was enacted as part of the Digital Infrastructure and Video Competition Act of 2006, authorized the City of Hollister to adopt an ordinance establishing a fee on statefranchised video and cable service providers to support public, educational, and governmental access channel facilities (“PEG”); and WHEREAS, on November 30, 2009 the City of Hollister adopted Ordinance 1054 to establish such a fee and Ordinance 1054 was codified as Hollister Municipal Code Chapter 5.21 State Video Service Franchises; and WHEREAS, Section 5870(n) of the Public Utilities Code states that such an ordinance shall expire, and may be reauthorized, upon the expiration of the state franchise; and WHEREAS, the City’s state-issued franchises were given a term of 10 years, which expired. It has renewed its stateissued franchise with the CPUC and has given the City an immediate deadline to reauthorize its ordinance; and WHEREAS, the City of Hollister desires to ensure that there is no gap in the payment of PEG fees due to the future expiration of any existing or future video and cable franchise certificate franchise(s) held by any state franchise holder operating within the City of Hollister; and WHEREAS, the City depends upon the PEG Fee for capital costs relating to PEG Channel facilities, which are essential to providing City residents with important civic programming including emergency alerts and community and government news, therefore an Urgency Ordinance is necessary for the immediate preservation of the public peace, health and safety; and WHEREAS, this Ordinance is exempt from environmental review pursuant toSection 15061(b)(3) of the State Guidelines implementing the California Environmental Quality Act of 1970, as amended. NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Hollister does hereby ordain as follows: SECTION 1. Chapter 5.21.090 is hereby added to the Hollister Municipal Code as follows: 5.21.090 Reauthorization of State Franchise Holder PEG Fees i. The fee on state franchise holders to support public, educational, and governmental channel facilities in Hollister City Code Chapter 5.21 is reauthorized and shall remain unchanged and in full effect as to all state franchise holders. ii. The PEG support fee in Hollister City Code Sections 5.21.070 shall automatically be reauthorized upon the expiration of any existing or future franchise certificate(s) held by any state franchise holder operating within the City of Hollister. iii. This chapter shall automatically be reauthorized upon the expiration of any existing or future franchise certificate franchise(s) held by any state franchise holder operating within the City of Hollister. This chapter shall so renew upon the future expiration of any franchise certificate(s) until such time that the City Council takes formal affirmative action to cease the renewals. SECTION 2. Any provision of the Hollister Municipal Code or appendices thereto inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, is hereby repealed or modified to that extent necessary to effect the provisions of this Ordinance. SECTION 3. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional. SECTION 4. This Ordinance shall become effective immediately upon its adoption and shall remain effective until the effective date of any superseding ordinance. After a 5-1 demolition of a solid Serra team in the Central Coast Section Division I playoff quarterfinals, the San Benito High boys soccer team seemed primed to go the distance. It wasn’t meant to be. The No. 2 seed Haybalers saw their season end in a 2-0 loss to No. 3 St. Francis Tuesday in a semifinal at Valley Christian-San Jose. “Honestly, I don’t know what happened,” Haybalers coach Marco Orozco said. “We’ve been playing good, but today was not our game. I think some of our players were not in it, especially on the back (end). We made some

mistakes, and they got us.” Indeed, both of St. Francis’ goals came off of defensive miscues, with the first coming on a lack of a communication and the second on several failed clear attempts. Balers goalkeeper Manny Luna had no chance at either of them. “Things that were practiced, the players didn’t put into play today,” Orozco said. “We’ve put what we’ve practiced in other games, but today, not so much.” Despite the loss, the Balers have plenty to be proud of. A year after winning a CCS playoff game for the first time in program history, San Benito went a round farther in finishing 11-4-8 overall and 6-2-4— good for a tie for second place—in the ultra competitive MBL Gabilan Division. One could say this San Benito team established itself as the greatest in program history. But against a disciplined St. Francis squad, the Balers had to be at their best—and they

weren’t. They never got into a consistent rhythm, resulting in just a couple of legitimate scoring chances. Their best chances to score came off the foot of Edgar Barbosa, who had a laser for a shot go slightly wide in the 13th minute and a nicely executed chip shot go wide left in the 54th. And other than a couple of goal-stopping saves from Luna, San Benito had few highlights. Manny Ceja had an outstanding postseason, scoring six of the team’s eight goals. Orozco said he was proud of the players and what they gave this season. He pointed to the leadership of Abraham Arevalo and Jerry Torres, the tenacity of Jose Agredano and the breakthrough of Erik Servin. “I could put Erik at right back, right wing or left wing, and he would respond,” Orozco said. “I can go on and on about our players because they were all terrific.” Even though the Balers

will graduate four senior starters, they’ll return a strong nucleus next season to potentially make another deep playoff run. Orozco is looking for players like midfielder Pedro Laguna—who is one of the more physical players on the team—to take his game to the next level.

“He needs to be a little more disciplined, but other than that, he has what it takes to get the team to another level,” Orozco said. “I think the players who are returning will work hard to improve and come back stronger next year. We’ll try to improve again.”

Gallardo shines in CCS Finals emanuel lee Sports Editor

Despite going in unseeded in the Central Coast Section Wrestling Championships, Richardo Gallardo reached the finals in the 182-pound weight class. The San Benito High senior finished as the runner-up after a sterling run to the title match, where he fell to stalwart Matthew Martinez of Alvarez, 17-2 via technical fall. Gallardo entered the tournament thinking he could win a match or two, but he did so much more, finishing 4-1. “I went into the tournament wanting to make the second day, and next thing you know I’m in the finals,” he said. “I didn’ expect anythigng too crazy. I was thinking I’d get fourth place and maybe if everything worked out right third place.”

By not setting his expectations too high, Gallardo wrestled freely and produced the best performance of his ascending career. His 6-3 win over Aptos’ Keegan Dutton-Jones in the semifinals was particularly noteworthy since Gallardo had been knocked out of the tournament a year earlier by the same opponent. When Gallardo approached Haybalers coach Steven Salcedo after the match, Salcedo gave him a bear hug, and lifted him up in the air. “I was like, ‘Oh, coach must be really exctied,’” Gallardo said. “I was pretty fired up, too. That was an intense match.” Salcedo was proud of his team’s performance, which included strong sixth place or higher finishes from Bryce Mattson, Matt Ramon, Michael

Guzman, Ethan Rossi and Nathan Morioka. “It’s a little bittersweet,” Salcedo said. “We ended up taking fourth place, which is great, but we could have won a few more matches, and if things had gone a little bit differently, we could have finished high as second place. Overall, I’m encouraged. We got a lot out of our kids. We competed really well, and the kids who all placed weren’t even seeded. We had a couple of disappointments, but we’ll take that into consideration as we get ready for next year.” Gallardo’s strategy of not taking any shots and staying on his feet against Dutton-Jones worked to perfection. After sizing up his opponent, Gallardo scored four quick points in the third period to give him an advantage he

That’s when you knew we were ready to play.” While there were plenty of tears afterward, the Anzar players knew they had accomplished something special. Hansen, who had never played a sport until arriving at Anzar, will miss the camaraderie and all of the hard practices the team went through to improve. “I’m going to miss having to run those liners in practice,” she said. “It’s weird to say, but it’s those hard times when we pushed together that really brought us together as a team. That’s the reason why we’re crying tonight—because we were a family and team.”

Even though the Hawks will graduate a huge senior class, Cisneros said the cupboard isn’t bare next season. Standout juniors Rachel Cardini, Monse Valenzuela and Sammy Vanderford will return, and there should be a player or two from the junior varsity team who will make an impact. Cisneros said he was encouraged by the junior varsity team’s progress under coach Jaime Hall. “She was able to work with the seven girls this year and help them develop, so it’s not like we’ll be starting brand new next season,” Cisneros said. Hansen credits Cisneros for molding the players and bringing the girls together to form a cohesiveness that all successful teams need. “He knows how to work with us and how to deal with us,” she said. “He’s really helped us understand the game better.” Seyffert said she’ll miss Hansen’s intensity and love for the game. “I’ll always remember her

Skylar Seyffert had just started responding to a question from a reporter when one of her teammates came up to her to say a couple of poignant words. The two embraced in a hug as tears welled in their eyes. That picture captured the essence of the Anzar High girls basketball team’s season, one that concluded with a 38-24 loss to host Castilleja of Palo Alto last Thursday in the second round of the Central Coast Section Division V playoffs. “I’ll remember how far we’ve come since we were freshmen, and how far we’ve come even from last year,” said Seyffert, who scored 5 points against Castilleja and is one of nine seniors on the team. “We were all kind of beginners coming in, with many of us not having played before. But we all came in, committed ourselves and pushed each other. We got good instruction from our coach (Mark Cisneros), who was always there for us.” The Hawks had their best season in recent memory, finishing 16-10 and earning the program’s first playoff win in five years. While it may have been a bittersweet end to the season, the players knew they had gone as far as they could. The team’s three standout seniors—Destiny

Hansen, Fatima Gomez and Seyffert—left an indelible impression on the program. In fact, all nine of the seniors did. “It’s going to be hard to swallow not seeing the nine seniors back in the gym next year,” Cisneros said. “I think they left an impression on the underclassmen that if you work hard, they can go as far as they want to go. The girls got a taste of CCS last year, so they came into this year hungry. They played amazing together, backed each other up and were very supportive of each other. We’ve been yelling family (as our team motto) quite a bit, and that’s what this team was.” Gomez scored a teamhigh 8 points against Castilleja, which simply had too much athleticism and superior shooting in defeating Anzar. The Hawks kept it close for half a quarter before the Gators started to gradually pull away midway through the first quarter. They led 9-4 entering the second quarter before extending their lead to 24-11 at halftime. Anzar displayed resiliency, cutting its deficit to 8 points early in the fourth, but it would get no closer. Cisneros has helped instill in his team confidence and direction. Having just completed his third season as coach, the team has made dramatic improvement since it won only four games in his first season at the helm. Both Hansen and Seyffert said the team’s 38-29 win over Gonzales on Dec. 4 was the highlight of their season because of how

AN URGENCY ORDINANCE OF THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN BENITO, READOPTING ARTICLES I AND II OF CHAPTER 7.05 OF THE SAN BENITO COUNTY CODE ENTITLED “STATE VIDEO SERVICE FRANCHISES” RELATING TO STATEFRANCHISES FOR CABLE COMMUNICATIONS; AND REAUTHORIZING A FEE TO SUPPORT PUBLIC, EDUCATION, AND GOVERNMENTAL (“PEG”) CHANNEL FACILITIES WITHIN THE UNINCORPORATED AREA OF SAN BENITO COUNTY WHEREAS, Section 5870, subdivision (n) of the Public Utilities Code, which was enacted as part of the Digital Infrastructure and Video Competition Act of 2006 (“DIVCA”), authorized the County of San Benito (“County”) to adopt an ordinance establishing a fee on state-franchised video service providers to support public, educational, and governmental access channel facilities; and WHEREAS, Section 5870, subdivision (n) of the Public Utilities Code provides that local ordinance establishing the Public, Education, and Governmental (“PEG”) fee shall expire expiration of an applicable State franchise, however, such an ordinance may be reauthorized; and WHEREAS, the County of San Benito (“County”) adopted Ordinance No. 849 on January 12, 2010, wherein the County created Article II of Chapter 7.05 of the San Benito County Code entitled “State Video Service Franchises” (sections 7.05.027 – 7.05.034) in which Section 7.05.033, subdivision (B) (entitled “PEG Support”) imposed PEG fees on cable providers within the County’s jurisdiction; and WHEREAS, California Video Franchise Certificate Franchise No. 0007 granted to Charter Communications, which includes the County of San Benito would have expired on January 2, 2018. In addition, any other state-issued Video Franchise Certificate Franchises within the County which expire in coming years will each trigger the need for renewal of Ordinance No. 849. This Ordinance is intended to establish an evergreen renewal of Ordinance No. 849 until such time that the Board of Supervisors takes action to cease such reauthorizations; and WHEREAS, Charter Communications state franchise renewal with the County became effective on or about January 2, 2018; and WHEREAS, the County intends to readopt Articles I and II of Chapter 7.05 of the San Benito County Code (sections 7.05.001 – 7.05.034) of the San Benito County Code to reauthorize the collection of PEG fees; and WHEREAS, given the short time frame within which legislation must become effective to protect the County’s PEG fee, the County finds that an urgency ordinance is necessary for the immediate protection of the public health, safety and welfare in order to assure the continuation of the County’s PEG fee; and WHEREAS, Government Code Sections 25131 and 25123 expressly authorize the Board of Supervisors to adopt an urgency ordinance for the immediate preservation of the public peace, health or safety; and WHEREAS, this ordinance will authorize/reauthorize the County’s ability to charge a fee to cable providers within the County’s jurisdiction to support public, educational and government channel facilities; and, WHEREAS, the County reserves the argument of whether or not Ordinance 849 has in fact expired, or whether it was automatically renewed by the extension of the cable franchise. NOW, THEREFORE, THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN BENITO ORDAINS AS FOLLOWS: SECTION 1. The foregoing recitals are true and correct and incorporated herein as though set forth in full. SECTION 2. FINDINGS. The Board of Supervisors makes the findings set forth in Exhibit “A”“Findings” which is attached hereto and incorporated herein by this reference. SECTION 3. READOPTION. Articles I and II of Chapter 7.05 of the San Benito County Code (sections 7.05.001 – 7.05.034 are hereby readopted in their entirety without any changes. SECTION 4. REAUTHORIZATION. (A) In readopting Articles I and II of Chapter 7.05 of the San Benito County Code (sections 7.05.001 – 7.05.034), the County intends to, to the extent required by California Public Utilities Code section 5870, subdivision (n), and hereby does reauthorize the fee on state-franchised video service providers to support public, educational, and governmental (“PEG”) channel facilities adopted by the Board of Supervisors on January 12, 2010 in Ordinance No. 849. The fee shall remain unchanged and in full effect as to all state-franchised video service providers. (B) Commencing from, and after, the effective date of this Ordinance, the County’s PEG fee in Ordinance No. 849 shall automatically be reauthorized upon the expiration of any existing or future Video Franchise Certificate Franchise(s) held by any state-franchised video service provider operating within the County. The Ordinance shall so renew upon the future expiration of Video Franchise Certificate Franchise(s) until such time that the Board of Supervisors takes formal affirmative action to cease the renewals (which action may be taken at any time and without notice, except as required by the Ralph M. Brown Act, California Government Code Section 54950 et seq.). SECTION 5. SEVERABILITY. If any section, subsection, sentence, clause, portion, or phrase of this Ordinance is for any reason held illegal, invalid, or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions hereof. The board hereby declares that it would have passed this chapter and each section, subsection, sentence, clause, portion, or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared illegal, invalid or unconstitutional. SECTION 6. The Board of Supervisors hereby finds that this Ordinance is not subject to review under the California Environmental Quality Act (CEQA) because it can be seen with certainty that there is no possibility the Ordinance may have a significant effect of the environment pursuant to CEQA Guidelines section 15061, subdivision (b)(3) and is therefore exempt. The County Administrative Officer, or his designee, is hereby directed to prepare and file a Notice of Exemption. (See, CEQA Guidelines sections 15061, subd. (d) and 15062.) SECTION 7. EFFECTIVE DATE AND CODIFICATION. San Benito County Code sections 7.05.001 – 7.05.034 shall remain codified without changes. The Board of Supervisors declares this Ordinance is necessary as an urgency ordinance measure for preserving the public health, safety and welfare. This ordinance shall take effective immediately upon its passage and shall expire 45 days thereafter unless extended pursuant to law. (Notwithstanding longer dates set forth in the ordinance above, this ordinance shall expire in 45 days unless lawfully extended by the board of Supervisors.) Prior to the expiration of fifteen (15) days from the adoption thereof shall be published at least one time in a newspaper of general circulation in San Benito County, with the names of the Supervisors voting for or against the same. odney Roman Alnas, age 47, passed away in his lifelong hometown of San Juan Bautista on February 20, 2018. He was born on December 8, 1970, attended school and spent most of his life in San Benito County. He worked as a carpenter and mechanic and loved to spend time with family and friends. Rodney was preceded to heaven by his mother, Roberta Alnas. He is survived by his father, Raymond Alnas, brothers Raymond, Rikki, Russell, Rion, Reinny, Ruben, his beloved nieces and nephews, Randy, Raeann, Carley, Rachel, Krystal, Rikki, Mia, Russell, Khalessi, Kaine, aunts, uncles, and many other family and friends. aymond Domingo Trevino, 79, a longtime resident of Gilroy and Hollister, passed away on February 16, 2018 at the Veteran’s Home of California in Yountville.

H

Ray was born on April 24, 1938 in Bakersfield to Ramon Trevino and Margaret Contreras Trevino. He attended East Bakersfield High School before joining the US Army. After his service, he began a thirty-year career in the jewelry business, working in Sacramento, Stockton and San Jose, before opening his own businesses in Gilroy, Trevino Jewelers and Ray’s Jewel Box. After retiring from the jewelry business, he enjoyed cooking with his Gourmet Alley friends and catering special events. He also worked as a cook and enjoyed mentoring at the James Boys Ranch in Morgan Hill. In later years, Ray lost his sight, but that did not stop him from living life to its fullest. He loved music, dancing, singing, fishing, and playing golf and poker. Ray was the first blind golfer to play in the National Veterans Golden Age Games competing against sighted players for several years beginning in 2007 and winning gold one year. He and his beloved guide dog Thorn moved to the Veterans Home in 2010. Ray returned to the Golden Age Games in 2012, traveling to St Louis where he took gold in bowling and shuffleboard, and silver in horseshoes and golf, the highest medal count ever for a visually impaired athlete. Ray is survived by siblings Maria Garza, Linda Trevino and Victor (Norma) Trevino of Bakersfield, and Robert Trevino of Glendora; son Michael (Lori) Trevino of Kensington; daughters Ramona Trevino and Cecilia (Mark) Andrade of Hollister; grandchildren Vanessa (Everett) Yniguez, Kristine Padilla, and Raymond Andrade of Hollister; Carly Andrade of Davis; and Liliana and Carina Trevino of Kensington; and great grandchildren Ali and Isaiah Yniguez, and Jayla and Jocelyn Jones. He is preceded in death by his parents, his wife Ann, and siblings Margaret Gutierrez, Paul Trevino and Vivian Ortiz. Memorial services will be held on Sunday, March 11, 2018 at 2pm at the VFW Hall, 74 West 6th Street, Gilroy, and on Saturday, March 17, 2018 at 1pm at Mission Family Mortuary, 531 California Avenue, Bakersfield, followed by burial at Union Cemetery in Bakersfield. orace Wesley Fabing passed away peacefully in the company of his family on Sunday February 18, 2018 at the age of 92. Horace was born on December 6, 1925 to Oscar and Emma Fabing in Gilroy, CA.

Horace was a fourth-generation Californian. While his service in the Merchant Marine and US Navy took him to destinations along the west coast and throughout the Pacific, Gilroy was the center of his orbit. As a boy, Horace grew up watching the freight trains go through Gilroy and San Jose, and he knew their schedule and isms just as well as his own. He believed his love of trains began when his father told him that if he would wave to the train crew (at the time, to Horace, a tough bunch of guys) that they would wave back. His father would speed up or slow down their car to “chase” the trains, so Horace could wave, and most often, the crew would wave back. Horace graduated from Gilroy High School and the U.S. Merchant Marine Academy. He married his wife, Nan Fabing on October 5, 1951 and together they built their home in Gilroy and raised their two children, Cindee Ann and Frank Wesley. Horace worked at Pacific Gas and Electric Company’s Moss Landing Power Plant for 36 years. After his retirement in 1986, his hobbies took on new life. He would travel with his speeder car and those of his friends to ride railroads around California and as far as Colorado, or ride his 7-1/2 inch gauge trains at the Portola Valley and Alpine RR. He built a garden railroad in his backyard that was for many years included as one of the stops on the Bay Area Garden Railway Society’s annual tour. Horace enjoyed traveling the country and even in his 91st year, went on a road trip to visit his granddaughter in Seattle. An author, historian, and preservationist, Horace was a story-teller with a depth to his memory that could rival any stack of encyclopedias. He gave back to his community by volunteering at the Gilroy Museum. He wrote several articles on local railroad history for The Western Railroader and authored Steinbeck Country Narrow Gauge, a book which tells the story of Claus Spreckels and the Pajaro Valley Consolidated Railroad and how the narrow gauge railway helped shape the central coast communities. Horace was an endlessly patient, kind, and ever-present fixture in our lives. He will be missed by his wife of sixty-six years, Nan, his children, Cindee Sorensen (Gary) and Frank Fabing (Dennis), and his two grandchildren, Scott Sorensen (Yvette) and Emily Sorensen. Our family would like to thank Aida Davis for being an unwavering caregiver and good friend to Horace. Horace was preceded in death by his sister, Orvalee Seadler, and brother, Robert Fabing. Celebration of life will be held at the family home on April 28, 2018 from 11:00am to 3:00pm. Memorials in Horace’s name may be made to the Gilroy Historical Society, P.O.
