Hollister police this week revealed they have reopened their criminal investigation of MitchelI Dabo in connection with his actions as trustee for the Matulich Charitable Trust. “When there is a development, I am sure the District Attorney will advise,” he said. “For now we don’t want to jeopardize the investigation.” “The investigation was forwarded back to our investigations bureau from the District Attorney’s Office,” said Police Chief David Westrick. “I cannot comment on the details of that because I do not wish to jeopardize the integrity of the investigation.” Westrick’s investigators had closed their investigation in early January and forwarded evidence and their findings to San Benito County District Attorney Candice Hooper. The main evidence at the time was a thick binder of documents that was presented at the Superior Court trial of a lawsuit filed by the San Benito County Charitable Foundation against Dabo. The judge in that civil case in November ruled that the evidence supported the foundation’s claims that Dabo violated state probate laws when he transferred more than

A Hollister man accused of killing one of his sons and seriously injuring another in a drunken driving accident faces a long list of charges in connection with the Feb. 25 collision. The San Benito County District Attorney’s Office charged Jesus Mora, 30, of Hollister, with charges of murder, gross vehicular manslaughter without malice aforethought, child endangerment, DUI within 10 years of a previous impaired driving offense, and driving while his license was suspended for failing a blood-alcohol test in a previous incident, according to records on file at the San Benito County Courthouse. He also faces

enhancements to these charges for willfully permitting a child to suffer, causing great bodily injury and for driving with a passenger younger than 14, according to court records. These enhancements could add more years to Mora’s sentence on the listed charges, if he is convicted. The charges are related to the Feb. 25 onecar accident on McCloskey Road, just east of San Felipe Road. California Highway Patrol officers said Mora was driving westbound in a GMC Sierra with his two sons in the front seat, when he drifted off the roadway and collided into a utility pole on the side of the road. Mora’s younger son, age 6, was pronounced dead at the scene of the accident, and the other boy, age 7, was flown to a hospital with serious injuries, according to authorities. Officers suspected Mora of driving in a drunken state when

they contacted him at the scene of the collision, and arrested the driver. Court records also indicate the Feb. 25 accident that resulted in Mora’s son’s death was not the first time the adult has been accused of driving in an impaired state. Mora was also already facing a previous misdemeanor DUI charge when he crashed on McCloskey Road, according to court records. That charge— stemming from a Nov. 27, 2017 arrest—also included an enhancement for having a previous DUI within the previous 10 years. Mora’s attorney, William Pernik, could not be reached for comment. Mora remains in custody at San Benito County Jail on $1 million bail. His next hearing on both the Feb. 15 and November cases is scheduled for April 10. The court is scheduled to set a date for Mora’s preliminary hearing at that time, according to District Attorney Candice Hooper.

students or the neighborhood during the lockdown. Authorities did not release details about the suspect they were seeking, or why the reasons for the search.

City moves to allow more home building HOLLISTER AWAITS APPROVAL FROM STATE TO ALLOW 244 NEW UNITS Reporter

The Hollister City Council still awaits clearance from the State of California to ensure that a new growth management program adopted earlier this year will not conflict with rules set by the California Department of Housing and Community Development. To ensure that the city will remain in compliance with state guidelines, the council has exempted affordable housing from new limitations on new housing that were adopted in January. Those limits would restrict new single-family development to 244 units a year— an approximate 50 percent increase over current limits. The city expects to receive a final

go-ahead by late April. "We are still waiting for confirmation from the state that we will not be violating our housing element," said Hollister City Manager Bill Avera in an email Monday afternoon. In January the council voted 3-1 to approve the growth management program, with Mayor Ignacio Velazquez voting in dissent and Councilmember Karson Klauer recusing himself from the vote due to a potential conflict of interest. On Dec. 11, 2017, the cap was increased from 164 units to 244 units. “I just don’t see the need to go from 164 to nearly doubling the number we’re talking about now,” Velazquez said at during the council meeting in January. “I think the growth we’ve seen locally, the numbers are in that ballpark of 150, 140.

We’ve been handling it. I think it’s a mistake to take it to a higher number and that’s why I’m going to be opposing this, unfortunately, tonight.” The new growth management ordinance has precedence. Measure U, which was passed in 2002, limited new single-family home growth to 244 units a year. The measure expired in 2012 and discussions to implement a new growth limitation were restarted in August 2017. By 2012, when Measure U expired, the 244 unit limitation was not met due to the lingering effects of the Great Recession. Starting in 2013 the rate of new home building started to rebound, and developers began to clear ground on projects that had already been approved but not started, said city officials.

Recent studies conducted by the Association of Monterey Bay Area Governments reported that the population of Hollister is expected to exceed 43,000 by 2030—a growth rate of more than 1 percent per year. “The big picture for the community is the desire for more retail and services in town, but companies

need certain levels of population, education and income levels before they build in a town. and I think we’re finally reaching that place,” Wyatt said. “We’re reaching a point of smart and moderate growth in housing.” It’s still unclear if the rate of growth is strong enough to attract a wider pool of incoming businesses. The new Hollister Farms center itself will need to attract tenants to fill the other large

retail units, nearly two dozen smaller retail units, along with six fast food restaurant plots. According to the Hawkins Companies website, a Panera Bread is expected to fill one of the restaurant spots. The resolution passed at the March 5 city council meeting approved utility and tree planting and maintenance easements on the property bordered by McCray and East Park Streets and Highway 25.

It’s unclear if the growth rate is strong enough to attract a wider pool of businesses.

an Benito County District Attorney Candice Hooper told us this week that her forensic accountant has finished his examination of bank records of the Matulich Charitable Trust, and that she has forwarded the case back to Hollister Police “for further investigation” of possible criminal charges against Mitchell Dabo. Dabo had been the appointed trustee of the trust. If this sounds familiar, you’re right. Back in November, Hooper had sent a “raw” version of the same evidence to Hollister Police for investigation. These were documents that had been provided to the court by Dabo himself, as part of the discovery process in a lawsuit brought against Dabo by the San Benito County Community Foundation. A Superior Court judge in November ruled that this evidence, plus other documents supplied by the foundation, affirmed the foundation’s claim that Dabo had violated California probate laws when he transferred more than $640,000 from a charitable trust to his personal accounts. The judge ruled that Dabo had systematically drained all of the funds from the Matulich Charitable Trust for his own purposes, depriving non-profits of money for community services, and ordered Dabo to pay the foundation $1.74 million in damages. The judgment has not yet been paid, In November, Hooper said she couldn’t make a determination of whether to pursue possible criminal charges against Dabo until police had first investigated the case. In early January, police passed the documents and possibly other evidence back to Hooper, saying they had concluded their investigation. Then the district attorney assigned a special forensic accountant to look at the bank documents, which had been assembled in a binder for the Superior Court civil trial. Two months later, the evidence, coupled with a forensic accountant’s analysis, is back in the hands of the police, who have reopened the investigation at Hooper’s request. The evidence that was revealed at the civil trial—much of it provided by Dabo and uncontested by him—was pretty clear cut: massive transfers of funds out of the

charitable trust to Dabo’s personal or business account, checks written by Dabo for his own investments and, in one instance, a $20,000 check made out to cash and signed by Dabo. These new developments are good news for anyone concerned about justice in this case. The case, by all accounts, is alive and well. The district attorney has not decided to drop an investigation, and she is asking Gilroy police to come up with some more evidence to bolster her case against Dabo—perhaps interviewing the former county school board president himself?

For Dabo, it’s been business as usual: preparing tax returns and selling insurance out of the office next to the liquor store formerly owned by his mother. In December, he did not seek reelection by fellow trustees to his position as president of the San Benito County Board of Education Board of Trustee, but retained his trustee post. He had told county school Supt. Krystal Lomanto that he would be resigning his seat on the board, without giving a date. He still sits on the board, and has given no indication whether he will actually resign. He has until the end of July to decide whether to seek reelection to his board seat. The school board continues to treat him with kid gloves, as a trusted colleague. The very meaning of “trustee”—one occupying a position of trust—comes from its first syllable. As hard as it may be to comprehend, given his admissions about the illegal transfers of charitable trust money, his fellow trustees have never asked Dabo to resign. Thankfully, law enforcement continues to take a more hard line.

Police asked to look further in Dabo case ➝ Dabo, 1

Police bust suspected ‘hash oil’ lab downtown NO ARRESTS REPORTED Staff report

Law enforcement authorities uncovered an illegal marijuana extraction lab in a decrepit, unsafe building in downtown Hollister, according to police. No arrests have been reported in relation to the raid of the property and seizure of a variety of marijuana by-products, and the police investigation is ongoing. About 10:10am March

20, deputies from the San Benito County Sheriff ’s Office arrived at a commercial building on the 800 block of San Benito Street to conduct a civil eviction, according to a press release. There were no people inside the unsecured building when deputies entered, but two dogs were found and later released to Hollister Animal Control, according to police. Deputies did find inside the building a variety of materials associated with the illegal extraction of

Tetrahydrocannabinol (THC) from marijuana, in plain view and on the front porch, authorities said. Upon seeing these materials, the sheriff ’s office called the United Narcotics Enforcement Team (UNET) to assist. UNET obtained a search warrant to further investigate the presence of a suspected, clandestine butane hash oil (BHO) laboratory inside the building, according to authorities. As a result of the search warrant, law enforcement seized about 24

pounds of marijuana, about 82 grams of finished THC product, several used butane canisters, a case of unused butane canisters, THC extraction tubes, filters, a vacuum pump, glass dishes and a 50-pound tank of medicalgrade nitrous oxide with balloons, according to the press release. Also found at the property were indicia to a local motorcycle gang, and “support material” for a known outlaw motorcycle gang, according to police. City of Hollister code

enforcement responded to the scene and found the conditions of the building to be unsafe, and they “red-tagged” the location to prohibit entry or occupation of the premises, authorities said. This incident marked the second marijuanarelated search warrant at the same address. The first unrelated investigation of the property in 2016 involved the manufacture of THC-laced flavored “syrup,” police said. The sheriff ’s office, UNET and Hollister

San Benito honors Guatemalan student SENIOR ROLANDO PABLO LORENZO CAME TO U.S. ON HIS OWN Staff report

San Benito High School senior Rolando Pablo Lorenzo was named as one of four area finalists for the “Every Student Succeeding” award program presented by the Association of California School Administrators. Lorenzo came to the United States on his own from Guatemala at age 14 to live with his uncle while seeking a brighter educational future, according to San Benito High School District’s announcement of the achievement. A group of administrators from local school districts recently notified the Lorenzo of his finalist status. Lorenzo and one student each from Monterey, Salinas and Santa Cruz are up for the award. North County Joint Union School District Superintendent/Principal Jenny Bernosky said students nominated for the award “may have had challenges in their life; things they’ve had to overcome by working really hard.” They “might have had a language issue or struggled academically, but really persevered above and beyond to be an outstanding student.” San Benito Principal Adrian Ramirez addressed the classroom about the details of the award, and then announced Lorenzo’s name, drawing a standing ovation for the senior. In the nomination form for the award, Lorenzo is called “an

outstanding example of perseverance and hard work.” His 3.69 grade point average could make it appear like academics has always come easy to him, the form noted, “but he has had struggles throughout his high school career and before,” having arrived in San Benito County from Guatemala on his own at age 14. Not knowing a word of English, he was placed in an English Language Development class offered by the high school’s Migrant Program’s evening summer school program prior to starting ninth grade. To overcome that language barrier, he sought the help of teachers and attended a tutorial to finish his first year of high school with a 3.5 GPA. While working part time to help his uncle with expenses, Lorenzo has carried a full academic load (taking seven classes some semesters) in addition to attending evening summer school classes. He has applied to various California State Universities and is looking forward to attending college with the goal of becoming a lawyer. The San Benito Migrant Education Program staff has provided guidance to Lorenzo throughout high school, including sponsoring his trip to the annual three-day Northern California College Tour during his junior year, which familiarized him with college requirements and the admissions process. He later was hired as a tutor to help other students in the Migrant Program’s Work Experience Program.

Schools acquire faster internet connections GRANT MONEY UPGRADES INTERNET SPEEDS IN COUNTY SCHOOLS Staff report

March for their lives Students, parent and teachers participated in a local “March For Our Lives” demonstration March 24 in Morgan Hill, as they joined millions of Americans in similar marches in cities across the U.S. to call for stricter gun laws and to honor the victims of gun violence. The marches grew out of plans developed by the student survivors of the Feb. 14 mass shooting in Parkland, Florida.

Schools throughout San Benito County have improved internet capabilites thanks to funds received through the Broadband Infrastructure Improvement Grant. In the 2015-2016 school year, the state budgeted $50 million for network infrastructure improvement for schools and districts, which were selected through an application process reviewed by the K-12 High Speed Network, in consultation with the State Department of Education and State Board of Education. Some of the major highlights of local projects from this one-time funding include: a 10 GB redundant circuit installed at SBCOE which allows for districts with higher data demands to receive one GB connections while lower demand districts receive 100 MB connections. For the SBCOE this is 10 times

the speed previously available and for some districts this has resulted in internet speeds up to 1,000 times faster. Also negotiated as part of the BIIG, is a next generation firewall that can handle a 10 GB passthrough as well as filter out illegitimate traffic and intrusions. Prior to these improvements, some school sites struggled to test one classroom at a time. Now an entire school can test simultaneously while all other required technology systems will continue to operate as intended. Trenches for fiber optic cables, the erection of microwave towers, electrical and low-voltage systems, as well as various hardware installations, are some of the ongoing and completed tasks. “The BIIG grant has made a tremendous impact on Tres Pinos School in becoming technology literate. We have moved from internet that never was reliable to internet that is never down or interrupted,” said Bronson Mendes-LoBue, the superintendent and principal at Tres Pinos Union Elementary. “We have been able to incorporate a student information system which allows teachers and office personnel immediate

access to a wide scope of student information from demographics to discipline and grades.” The total cost of county projects falls between $1 million and $1.5 million, with all covered by the BIIG. Included in that, specific site costs range from approximately $350,000 at Jefferson Elementary School District to $55,000 for Southside School District.

Parents encouraged to participate in LCAP Survey

San Benito High School District officials are urging families to participate in a Local Control and Accountability Program survey, which is available in both English and Spanish. “Each year, the District asks for your feedback regarding SBHS’s practices and programs,” said Elaine Klauer, Director of Educational Services. “Your feedback will assist the District as it updates the actions and services we implement to ensure academic success and school safety for all students.” The survey, which can be found on the San Benito High School and District websites, will be open until April 13.

LOCAL SCENE Schools and safety The San Benito County Office of Education and the Hollister Police Department hosted a safety workshop at the San Benito High School library on Monday, March 26. School districts from throughout the county were on hand for the 90-minute workshop, led by County Schools Supt. Krystal Lomanto and Hollister Police Department school resource officers Carlos Rodriguez and Staci Esqueda. Lomanto offered a handout that discussed “The Big 5” actions that require an emergency response, including shelter in place; drop, cover and hold on; secure campus; evacuation; and lockdown/barricade. Lomanto said the more that school staff think and talk about safety measures, “the more prepared they will be.” She added that “The more you practice and collaborate, the more prepared you will be if there is a serious incident, like an earthquake or an active shooter.”

After an 0-12 league record last year prompted a demotion to the Monterey Bay League’s Pacific Division this season, the San Benito High boys volleyball team plans on earning a promotion back up to the upper Gabilan for the 2019 season. To guarantee that, the Haybalers must win this year’s Pacific Division championship. They’re off to a great start, having won their first three league matches entering Tuesday’s match against Alvarez. “As long as we continue doing what we’re doing, I see no reason why we can’t go back to the Gabilan,” Balers coach David Ventura said. San Benito’s program is seemingly on the upswing, as its junior varsity squad is also flourishing. The varsity side features two sophomores and a freshman, signaling there is talent at each grade level. That means the team has an excellent chance of going on a sustained run of success. Key players include senior libero Chris Gonzalez, junior setter Brennan Ventura, senior opposite Saul Martinez, senior outside hitter Dominic Garcia, freshman

outside hitter Alec Garcia, and middle blockers Eduardo Villanueva and Connor Champion. Two reserves—Greg Gonzalez and Chad Champion—also play key roles. Martinez and Villanueva are two of the league leaders in hitting percentage, and Ventura has the ability to not only make great sets but block and play tough defense around the net whenever opponents are trying to do back passes. The Balers have something really unique going on, as half of their 12-player roster are brothers. They include Chris and Greg Gonzalez, Alec and Dominic Garcia, and Connor and Chad Champion. Having three sets of siblings on the team makes for great competition, especially in practice. “When the brothers are teamed up against each other in drills or scrimmages, it’s pretty fun to watch,” Villanueva said. “They go after it pretty hard, and they really want to win at whatever they’re doing.” Villanueva, a 6-foot-2, 205pound senior, has made dramatic improvement since taking up the sport during his junior year. That’s right—Villanueva is only in his second year of playing volleyball, but he’s learning fast. “Eduardo made the biggest improvement out of anyone over last summer,” Ventura said. “His hitting has gotten pretty dominant. When we’re in rhythm and get the ball to our middles— and even more when we get it to Eduardo—it’s almost always a point. Our last tournament, his hitting percentage was .333, which is fantastic.” It’s no coincidence Villanueva

San Benito is off to a 3-0 start in MBL Pacific play. has become a force on the court. In between playing for the water polo team in the fall, Villanueva worked on his volleyball game in open gyms. Villanueva said the key to the team’s success has been its ability to shake off tough times with a stronger mental approach. “We’re better at staying positive,” he said. “Last year it was hard to stay positive because we had so many losses. But we’ve learned from our mistakes and grown from them.” Off the court, Villanueva has flourished as well. Villanueva carries a 4.1 GPA and earned an Eagle Scout award—the highest achievement or rank attainable in the Boy Scouts of America. To earn

the Eagle Scout honor, Villanueva completed a project in which he built an informational board for the local Elks Lodge. Villanueva, who has been accepted to Cal PolySan Luis Obispo, plans on majoring in biology and going to medical school to become a doctor. His dad has a doctorate degree and is a plant breeder, while Villanueva’s sister, Sophia, a sophomore at San Benito, actually was the driving force for Villanueva to start playing volleyball. “I got interested in the sport after watching my sister play club (for Rush),” he said. The Balers know they’ll need to clean up their play to win the Pacific Division title. In a

thrilling five-set win over Gilroy on March 22, San Benito finished with 64 kills to go along with a whopping 74 errors. “We had over 20 serving errors, let the ball hit the ground too much and made a lot of mistakes,” Ventura said. “But we persevered and won. If we can cut down on the errors, we’ll be a tough team to beat.” The school has set up a pair of alumni games on April 6 at 6 p.m. It’s a fundraiser for both the boys and girls volleyball programs, with the women’s match starting at 6 and the men at 7:30. have lofty goals outside of golf—Hoefling plans on being a sports data analyst and Wells in the realm of aerospace engineering and physics—but before that happens, they would love nothing more than to play golf in college. Hoefling will attend Chico State and will explore his options there, while Hoefling said, “There is a strong possibility I will play golf in college.” Whatever happens this season, the two have thoroughly enjoyed their time together in high school. “We’ve got a similar drive to play a lot and always wanting to get better,” Wells said. “The competition is always fun and super friendly.” Hoefling and Wells have worked tirelessly honing their games at San Juan Oaks. Wells credits Balers coach Reggie Synegal and San Juan Oaks Director of Golf Manny Freitas for helping him with the technical aspects of his swing and overall game. Hoefling actually lives 5 minutes away from San Juan Oaks, and his dad took him to the course when he was 8 or 9 years old. “But I didn’t take things seriously until high school,” Hoefling said. After gradual improvement from his freshman to sophomore year, Hoefling’s game started to take off as a junior and now as a senior. Wells is also at the top of his game, a byproduct of hitting balls for hours at a time five to six times a week. For Hoefling and Wells, hard work has paid off, and their scores reflect it.

After every round, San Benito High seniors Nick Wells and Andrew Hoefling compare scores while reviewing their rounds. The friends push each other to improve daily, whether it’s in the matches or during practice. Wells and Hoefling are the top two players in the Haybalers’ lineup, and both of them have goals of having a top-tier finish in the Monterey Bay League tournament in hopes of qualifying for the Central Coast Section tournament. Through last week, Wells’ best round consisted of an 83 over 18 holes and 37 over 9 holes, while Hoefling has a personal-best 84 over 18 and 39 over 9 holes. Wells was the team’s No. 3 player and Hoefling the No. 4/5 player in the lineup a season ago. Both players work at San Juan Oaks, the place where they also hone their game. “I’ve improved a lot over the past year,” Hoefling said. “From the end of last golf season to the beginning of this season, I was working out to improve my game.” Wells acknowledged he and Hoefling have a responsibility as the top players on the team to set a good example in practice and help the less experienced players with their respective games. “During practice we try to help the new freshmen who will have the future spots in our program,” Wells said.

The San Benito team also includes Dawson Biersdorff, Brian Plemmons, Brady Figone-Gallagher, Brandin Mulcahy, Christian Puccinelli and Austin Wilson. Hoefling and Wells have different strengths on the course. Wells is potent off the tee—“He can drive it a mile,” Hoefling said— while Hoefling has an excellent short game that allows him to score well. “My chip shots around the green and my putting is what I do best,” Hoefling said. “I’ve got at least 20 pounds on Nick, but he hits the ball crazy far. But I like to say I can get the ball closer to the hole most of the time.” Friendly and tough competition drives both players, and Wells loves playing a team like Palma, which has upwards of five players capable of shooting a sub-40 round in the same match. “You learn a lot playing with those kind of people,” Wells said. “Playing with them makes me better and puts pressure on me to feel the need to put more work in.” Wells was utterly delighted when he got to meet golf greats Rory McIlroy and Phil Mickelson in the AT&T Pebble Bach Pro-Am in February. Wells, who was carrying mini scoreboard signs for the players on the penultimate day of the tournament, had a short interaction with a future PGA Tour Hall of Fame player in Mickelson and a player who has the potential to win 10 or more majors in McIlroy. “I got to meet with them and talk a little bit,” Wells said. “I couldn’t believe it—it was so surreal.” Hoefling and Wells both

upe Rocha Yamamoto passed away suddenly and unexpectedly on March 21, 2018. Lupe was a Gilroy girl her whole life! She was a beautiful, loving and caring person who lived her life devoted to her family and God. She was a very giving person who would give you her last nickel if you needed it. As long as she had her family, she was fulfilled. She took great pride in her children (Vanessa, Elliott, Janet and James), but her greatest joy was her grandson, Ethan. She so loved her mother (Catalina Rocha), brother {Henry Rocha, Jr (Suzann)} and sisters (Rosemary Rocha Zurlo (Richard), Bertie Rocha Cooke (Glen), Sylvia Rocha Bell (Rod)} and always let them know, in one way or another, with a ‘little something’. She leaves behind her niece and many nephews and great nephews. She joins her heavenly family, her father (Henry Rocha, Sr), sister (Anna Rocha Taylor) and grandparents. She will be greatly missed by her family and many, many extended family and friends. April 4, 2018 – viewing - 2:00pm to 9:00pm and a Vigil service at 6:30pm at Habing Family Funeral Home. April 5, 2018 – Mass 10am at St Mary’s Church. Lupe loved to wear clothing that had beautiful colors, so please feel free to do the same.
