BIG OIL TARGETS RIVAS PETROLEUM FIRMS FUND ATTACK MAILERS AGAINST HOLLISTER SUPE’S ASSEMBLY BID By Tom Gogola Pacific Sun
The state’s petroleum industry is spending $320,000 in the
District 30 State Assembly race to defeat fundraising frontrunner Robert Rivas. The San Benito County supervisor hopes to succeed Anna Caballero, who is running for state senate this year and represents a district that stretches from Morgan Hill to King City and includes Watsonville and all of San Benito County. The San Rafael law firm Nielsen Merksamer Parrinello
Gross & Leoni, which counts BP, Chevron, Exxon Mobil, Phillips and Valero Energy Corporation among its clients, created the Coalition to Restore California’s Middle Class, Opposing Robert Rivas for Assembly 2018. It’s the first time the industry has targeted a local official seeking higher office. Rivas was at the forefront of San Benito’s Measure J, which banned fracking in 2014
despite a $2 million push funded by large petroleum companies to defeat it. San Benito was California’s first county to enact a ban on fracking and associated oil extraction technologies, including acid well stimulation treatments and cyclic steam injection; a similar effort failed in Santa ➝Big Oil, 8

For Rep. Jimmy Panetta, whose 20th District includes some of the nation’s biggest farm producers, voting against the most recent Farm Bill was difficult but necessary. “The failure of the Farm Bill on the House floor last week was due to a flawed process and unnecessary partisanship,” said the 20th District Democrat. He placed the blame squarely on the Republican leadership of the House Agriculture Committee, of which he is a member. In addition to facing unified Democratic opposition, the Republican majority was unable to shore up support from its conservative members, and the bill presented by the Agriculture Committee failed May 18 on 198213 vote. The Farm Bill—officially called the Agriculture and Nutrition Act— comes up for a vote only once every four years, and ➝ Farm Bill, 10 Robert Eliason

Hollister works to grow local manufacturing JOB CREATION AND GROWTH ARE FOCUS OF WORKSHOP ON JUNE 7 By Bryce Stoepfel Reporter
Robert Eliason
Classics converge in Hollister Throngs of car fans celebrated American classic cars at the 16th annual Country Cruise and Car Show in Hollister May 20. The cool cars included a 1953 GMC five-window pickup painted cherry red, all ready for the Fourth of July. While car lovers from all over the region inspected, admired and fawned over the cars of their dreams and nostalgia of the past, Debra Sorensen and Steve Eggleston surveyed the engine compartment of a 1965 Corvette at the 16th annual Country Cruise and Car Show. presented by Gold Coast Rods.
As local business leaders seek to attract more employers to San Benito County, the San Benito Business Council, along with California Manufacturing Technology Consulting, are hosting a free roundtable for small and medium-sized manufacturers next month. The free event,Thursday, June 7 at San Juan Oaks Golf Course from noon to 1:30pm, aims to bring together area manufacturers and help them find what they need to grow their businesses. The California Employment Training Panel will be one of
the participants in the event. "The San Benito Business Council's goal for the roundtable is the retention, expansion, job creation and growth of existing local manufacturing businesses," said San Benito Business Council Executive Director Kristina Chavez Wyatt. While San Benito County may be known for its strong agricultural economy, 121 manufacturing businesses in San Benito County have 3,600 employees, according to the San Benito County Business Council. The council believes there is great potential to attract manufacturing and new local jobs. innovative, high performing, market-driven and cost-effective operations, according to their website. California Manufacturing Technology Consulting focuses on manufacturing. The firm is affiliated with the National Institute of Standards and Technology, which is part of the Hollings Manufacturing Extension Partnership National Network, a nationwide private/public manufacturing consulting organization. The San Benito County Business Council works to support the business community by promoting job retention and expansion— the continued growth of existing businesses— and attracting new businesses and development. The group advocates improvements to local infrastructure such as roads and housing.

Gifted Games offer chances to excel Staff report
Robert Eliason
More than 400 students from 24 schools in San Benito and Santa Clara counties gave it their all at the 13th annual Gifted Games, which was created to allow individuals with special needs a chance to experience the thrill of athletic competition. The event, which was held May 18 at Gilroy High School, began as a way to allow 30 Life Skills students from San Benito High School to compete in Olympic-style events has become a community-wide celebration of hundreds of special needs student-athletes from around the area. Special Education teacher Tania Sauer said there were 436 athletes registered from San Benito and Santa Clara counties, ranging in age from
kindergarten through high school. Total athletes and school staff were 671. The Gifted Games alternates venues between San Benito and Gilroy high schools. It was held in Gilroy in 2017 because of storm damage to Andy Hardin Field and was held there this year and will be held there again next year as a new stadium is constructed in Hollister. “I've visited all the classes attending in Hollister and students are really looking forward to the event,” Sauer said prior to the Games. “I had the the chance to train some of the classes in the events that we will be doing. Students in the Life Skills program have been training in the events as well...I’m really looking forward to hosting the event here in 2020 so that we can include more of our Baler community.”

OPINION
Rivas for Assembly
F
ive candidates are running for California Assembly District 30, and two have emerged as serious contenders to represent the region’s half million residents. The district includes south Santa Clara County and San Benito County and is currently represented by Anna Caballero, who is running for state senate. Gilroy Councilman Peter Leroe-Muñoz, a former San Benito County deputy district attorney who works in San Jose for the tech industry’s Silicon Valley Leadership Group, is running on a public safety and economic development platform. The Harvard-educated attorney has attracted contributions from the housing development industry, which is not surprising given his past role as a leading champion of one of the worst development schemes ever hatched for Gilroy: a 721-acre, 4000-unit plan that sparked a 2016 LAFCO lawsuit against the city and prompted voters to boot Mayor Perry Woodward out of office and overwhelmingly pass an urban growth boundary. Leroe-Muñoz admits “we could have done a better job with the community” by getting information out earlier. He made the motion for the project’s approval after backroom deals had been cut by former mayors Woodward and Don Gage. Leroe-Muñoz also believes there is “no problem between the Gilroy Police Department and the Latino community,” though tensions flared after a Feb. 25 death that remains under investigation.
San Benito County Supervisor Robert Rivas, on the other hand, seems to be in close touch with his constituents. When business leaders opposed a 2014 initiative to restrict oil drilling in San Benito County, Rivas went out on a limb. He took early leadership in the anti-fracking movement, which despite $2 million in spending by Big Oil, carried 59 percent of the votes and inspired similar initiatives in other California counties. Petrol purveyors have targeted Rivas with $320,000 in independent expenditures to portray him as soft on crime. While Leroe-Muñoz doesn’t appear to mind them raising the public safety issue, he says he doesn’t support fracking or other enhanced extraction techniques because of water supply contamination concerns. Rivas has run a campaign of diversity and inclusion, while Leroe-Muñoz has aligned himself with business interests. Rivas, who has raised more than twice the funding as his leading opponent, is endorsed by political arms of the state’s teachers, nurses and public employee unions; Leroe-Muñoz sounds alarms about CalPERS’ unfunded pension liabilities. A political science college instructor, Rivas believes the vibrancy of downtowns is important and sees Morgan Hill-style revitalization and high density housing as preferable to sprawl. While both have local roots and either candidate could competently represent this region’s residents in Sacramento, Rivas is

He was on the right side of a defining issue in the county he represents, while Leroe-Muñoz was on the wrong side of a watershed moment in the city where he holds elected office. Barbara after the San Rafael law firm led a $7.6 million campaign funded by large petroleum producers. Monterey and Santa Clara counties both passed antifracking laws in the wake of the San Benito win. This year, there’s a push in San Luis Obispo County to enact a similar ban. Rivas is a Hollister resident who has been on the board of supervisors since 2010. His campaign decries the ads against him as misleading, negative and personal. Among other things, the ads criticize Rivas on public safety. Rivas is running against a fellow Democrat, former prosecutor and lawyer Peter LeroeMuñoz, as well as Bill Lipe, whose campaign is funded by agricultural interests in the Greenfield, San Ardo and Salinas areas. The primary is on June 5. Rivas opponent LeroeMuñoz, a Gilroy councilman, is on the same page when it comes to the contentious extraction process. “I do not support fracking,” he says. Nielsen Merksamer attorney Steven S. Lucas is listed as the attorney of record for the political committee. He did not respond to phone calls and an email seeking comment. The Nielsen Merksamer firm was instrumental in helping defeat Santa Barbara’s Measure P, and the firm opposed the 2006 California Global Warming Solutions Act (AB 32), which aimed to reduce the state’s greenhousegas emissions. “We advise our ballot measure clients on all aspects of campaigning,” the firm’s website reads, “from initiative drafting and filing, contesting ballot language and other pre-election litigation, observing and potentially contesting the final vote, and post-election substantive challenges.” Rivas was on the campaign trail over the weekend and says he’s not surprised at the petroleum industry’s moves against him. “That is unfortunately politics in 2018,” he says. “Being in this process for the first time, this Assembly seat is a regional office and it’s certainly been a unique experience, and it’s unfortunate that the oil

PETER LEROE-MUÑOZ Gilroy councilman also opposes fracking but may benefit from oil industry’s revenge mailer. companies have chosen to play dirty politics by attacking me personally with misleading attack ads and attempts to deceive voters. The fact that I took on the oil industry to protect the community against fracking—that’s why I am the subject of these attacks.” Rivas believes that the attacks on him will only further toxify a Sacramento political climate that’s fraught with divisiveness. “The civility question—it plays to a larger concern as to why people have very little faith, have very little confidence, in elected officials and government in general,” he says, noting that the energy lobby never met with him during the Measure J push. “They viewed my position against fracking as against their interests.” According to campaign materials, numerous officials, organizations and citizens have leapt to Rivas’ defense, including State Sen. Bill Monning, the Sierra Club and civil rights icon Dolores Huerta. “Robert Rivas took a bold stand against fracking in San Benito County,” said North Bay Assemblyman Marc Levine, who represents San Rafael in Sacramento and pushed for a failed statewide fracking moratorium in 2012, “and oil companies want him to pay a price.” “Fortunately, voters will have the last say.” Rivas opponent LeroeMuñoz also addressed the petroleum industry campaign against Rivas in an interview this week. “Obviously it’s an independent expenditure, so we have no coordination with them,” he says. Citing his law enforcement
background, he says, “I can’t speak to what their thoughts or motivations are, but I think that what is important is that they are raising an issue around public safety. That’s an issue that many residents have raised with me in the district.” The petroleum industry committee paid for a recent mailer which “addressed that issue in particular around Robert and public safety and cuts that he made while he was on the board of supervisors,” says Leroe Muñoz. The Gilroy councilman has raised $80,898 in contributions, according to the contribution database on the California Secretary of State’s website, though Leroe Muñoz estimated his raise at $140,000 in a Tuesday interview. Supervisor Rivas has brought in $451,432, according to state filings. Lipe has collected $93,537 and contributed $55,000 of his own money to his campaign. Leroe Muñoz, who supported a failed 2016 effort to develop 721 acres of North Gilroy farmland into a 4,000home development, has received contributions from Gilroy development services firm Ruggeri-Jensen-Azar & Associates, Summerhill Homes CEO Joe Head, Gilroy concrete firm owner Don Alvarez, Gilroy residential developer The James Group and Peninsula developer Skip Spiering. Rivas draws much of his support from public employee unions, including teachers, nurses and municipal employees. Other contributors include state trial lawyers’ groups, Yelp CEO Jeremy Stoppelman and former Palm Inc. CEO Donna Dubinsky.

JIMMY PANETTA 20th District Congressman, shown here during last winterís floods, is on the House Agriculture Committee.
Panetta says GOP bill hurts farmers Farm Bill, 1 includes both food stamps and important farm price supports. The legislation expires Sept .1. In an interview this week, Panetta told the Free Lance he remains hopeful a new Farn Bill is approved. He added, “I don’t see much happening in the next week or two.” He said that for him, the necessary first step is for Democrats and Republicans to meet in committee to iron out differences. A last-minute addition by Republicans—without a hearing or opportunity
for input from the minority party members— to expand work requirements for food stamp recipients guaranteed united Democratic opposition. “Although historically bipartisan, the Agriculture Committee became partisan when the majority decided to put forward and hastily pass an underfunded Farm Bill, and insist on unproven and untested changes to the bill’s Supplemental Nutrition Assistance Program (SNAP),” Panetta said. He said the GOP bill also lacked adequate funds
for critical programs for specialty crops, organics and beginning famers. “I voted against the bill because I believe that it was based on politics rather than the procedure of holding hearings to gather supportive evidence in a bipartisan manner, which is normally found in the Agriculture Committee and necessary for such a major piece of legislation like the Farm Bill,” said Panetta. “Our farmers and those facing hunger in our communities deserve better and depend on Congress to
do better together,” he said. “There are 74,000 people in my district that depend on the SNAP program.” “I am ready to work with my colleagues on both sides of the aisle to produce a Farm Bill that supports our farmers, grows our agriculture industry, and tackles hunger across our country.” Committee chair Mike Conaway of Texas, said, “Though a disappointing vote, the House will continue its efforts to deliver a farm bill to the president’s desk on time.” Ranking committee
Democrat Rep. Collin Peterson of Minnesota said Democratic members of the committee consider the nutrition title of the GOP bill to be “an affront.” The Republican bill would impose work requirements on food stamp beneficiaries up to age 59, except for children, the disabled and people caring for young children. It will also make qualifying for food stamps harder by restricting categorical eligibility programs under which people qualify for food stamps by participating in other
government assistance programs. Peterson said he agrees that “people should work,” but disagrees with a provision that would take “savings” from fewer people participating and use it for a work training program because it would amount to spending “a huge amount of money on this bureaucracy.” Peterson said spending under the 2014 farm bill is now $130 billion less than projected, and said he believes agriculture “deserves” some of that money back to improve the farm program.

Hollister School District’s Accelerated Achievement Academy, Cerra Vista Elementary, Gabilan Hills Elementary and Rancho San Justo Middle School were all named to the 2017-2018 Educational Results Partnership Honor Roll for high achievement and student success. The program, sponsored by the Campaign for Business and Education Excellence, is part of a national effort to identify higher-performing schools and districts that are improving student outcomes, according to the announcement. “Our teachers and administrators are committed to reaching higher levels of academic achievement and continuously improving our practices,” said Superintendent Lisa Andrew. “We are pleased to see our hard work and dedication translating to positive outcomes for all our students.” The 2017-2018 Honor Roll is developed by Educational Results Partnership, a nonprofit
organization that applies data science to help improve student outcomes and career readiness. “Educational success must be data-informed,” said Greg Jones, ERP and CBEE board chairman. “These Honor Roll schools and districts are improving student achievement and we have the data to prove it.” ERP maintains the nation’s largest database on student achievement and utilizes this data to identify higher-performing schools and districts. Schools that receive the ERP Honor Roll distinction have demonstrated consistent high levels of student academic achievement, improvement in achievement levels over time and a reduction in achievement gaps among student populations, according to the release. “These bright spot schools and districts are implementing programs and practices that are improving educational equity and accelerating student success. ,” said James Lanich, Ph.D., ERP president and CEO. “We need to shine a spotlight on their work and encourage others to replicate it.” For more information on the ERP Honor Roll, visit edresults.org.

BALL PLAYERS San Benito High’s Zach Livingston and Josh Cutler have embodied the selfless team dynamic that has characterized the Haybalers this season. Cutler, a catcher, and Livingston, a center fielder, are part of a team that played Valley Christian in the CCS semifinals Tuesday. PREP BASEBALL

was I needed to be louder and take on a leadership role. I need to be vocal and take charge in situations.” Livingston feels the same way in manning the outfield, knowing he had to get more vocal to keep communication between the outfielders constant. Livingston has no problems diving for the ball; growing up, he used to practice diving for balls with his dad, David. “I always had green stains on my shirt coming home,” Livingston said.
Fond memories
Cutler and Livingston are childhood friends, and their parents were friends long before the San Benito High seniors were born. Growing up, the families went on yearly camping trips to Collins Lake—it’s a man-made lake north of Sacramento in the foothills of the Sierra Nevada—and their best memories revolve around the time in the great outdoors. Livingston said the families plan on going camping again before he and Cutler leave for college, Livingston to Liberty University in Virginia and Cutler to Chico State. Neither Cutler nor Livingston have plans to play in college, making their final games in a high school uniform an emotional one. Whatever happens, Livingston and Cutler have thoroughly enjoyed the dynamics on this year’s team. Coach Billy Aviles praised the players for being selfless and coachable. Livingston said in his three years on the varsity squad, the 2018 team has the most chemistry. “It’s really exciting to play

Before Zach Livingston went up to bat with the bases loaded and two out in the bottom of the ninth inning, he had already built up a mental scouting report on the Palma pitcher. San Benito High was facing its rival for the second and final time this season in the regular-season finale May 10, and Livingston had a chance to come through. The center fielder delivered, driving a ball to deep left field for a walk-off hit. Before coming to the plate, Livingston had a conversation with assistant coach Angelo Loomis, something that happens in the normal course of a game. “He’ll always give me a scenario and ask what I think a guy will throw in a certain count,” Livingston said. “He’s always keeping us thinking in the dugout, and that is one of the reasons why we’re more prepared at the plate. … (the Palma pitcher) had good velocity, but his ball looked really flat watching from the dugout. I figured I would get a couple of chances to get fastballs early in the count.” And that’s exactly what happened, as Livingston drove a pitch that was middle in and smacked it to left field. Moments earlier, Livingston’s
best friend, catcher Josh Cutler, had led off the inning with a double. The player who pinch ran for Cutler scored the tying run in what would be a 4-3 San Benito victory. It was the season highlight for both Cutler and Livingston, who would love nothing more than to help the program to its first-ever Central Coast Section playoff championship. The No. 2 seed Balers (23-5) play No. 3 Valley Christian (27-3-1) in a CCS Open Division playoff semifinal on Tuesday at San Jose Municipal Stadium. San Benito won a 3-2, eightinning thriller over Santa Cruz last Saturday in the opening round when Marcus Aranda singled home Isaiah Bueno for the winning run. One of the team’s assistant coaches, David Marquez, coached several players on the team in Hollister Little League and Babe Ruth. “He’s been with us every step of the way, and it would be really great if we could win it with the coaches we have on this team,” Livingston said. “They’re all pretty special coaches.” As the catcher, Cutler knows he plays a vital role on the team. Communication with the pitchers and infielders is key, especially in crucial late-inning situations where the team that executes all of the fundamental plays—hitting the cut-off man or being in proper position defensively, for example—often plays a huge role in determining the game. “Catchers see everything and they have the ability to take control in most situations,” Cutler said. “That was the biggest thing coming up to the varsity,
DEPENDABLE Balers catcher Josh Cutler has provided a steady presence behind the plate, including communication with his pitchers. on this team,” Livingston said. “It’s definitely the most cohesive team because there aren’t really any cliques. No one plays for themselves.” After the Balers beat St. Francis of Watsonville 3-0 April 18, Livingston said one of the St. Francis coaches—who knows some of the San Benito players— touched upon the Balers’ team dynamics. “One of their coaches said out of all of the great Hollister teams, this might be the least talented, but the best team Hollister has ever had because of the team dynamic,” Livingston said.
“Obviously, we all get along, and I don’t think there could be a better team to make this CCS title run for how hard everyone has worked.” Against a tough Santa Cruz squad last Saturday, the Balers had all they could handle. However, San Benito responded in a close, white-knuckle affair, with Bueno leading off the bottom of the eigth inning with a triple. A couple of walks resulted in the bases being loaded for Aranda, who singled home the winning run. Ryan Jameson and Ryan Platero combined to limit Santa Cruz to two runs.

POWERFUL Former Balers standout Jacob Tonascia set the single-season CSUMB record
for home runs this season, with 18. The senior played catcher and first base.

In that time, Mission College underwent a coaching shakeup, as an entirely new staff came on board. With all of the coaches who had recruited him no longer at Mission, Tonascia felt it was best for him to move on as well. Tonascia landed at Allan Hancock College in Santa Maria—he has family members who live there—and had a solid 2016 season. More important, Tonascia’s one year in which he was sidelined re-invigorated his love for the game. “Having that year off showed me how much I missed that team camaraderie and being with my best friends everyday,” he said. “Mentally, the surgery affected me the most. I had taken the game for granted. On some days at Mission, I didn’t want to be at practice. That is what I missed the most. … When I was at Allan Hancock, I had a different level of appreciation being with my teammates everyday. ” With five former San Benito High players on the roster, some of the players playfully refer to the program as the Cal State Monterey Bay Haybalers. The last time CSUMB had a season like this, it was in 2013, when the Otters finished with 39 wins. That squad was led by a trio of former Balers standouts in Mark Hurley, Ronnie Fhurong and Brian Haggett. “That was the last time Monterey Bay was a No. 1 seed,” Tonascia said. “The Hollister guys are doing it again.” Tonascia hopes his history of elbow problems
Submitted
Jacob Tonascia had never hit more than five home runs in a season at any of the previous places he played at—San Benito High, Mission College and Allan Hancock College—until this season. The Cal State University Monterey Bay senior catcher/first baseman is having a career season, and not a moment too soon. Tonascia was one of the key players for an Otters team that recently concluded one of the great seasons in program history. CSUMB finished with a program single season, record-tying 39 wins en route to a NCAA Division West Regional appearance. Hitting anywhere in the Nos. 3, 4 and 5 spots in the lineup throughout the season, Tonascia has posted some incredible numbers, most notably the 18 home runs that broke the single-season CSUMB record along with teammate Hayden Duer. The 6-foot-3, 230pound Tonascia said several factors have gone into his power surge. “It’s a blend between preparing myself a little better and joining San Benito Strength in Tres Pinos in the past off-season,” he said. “I got a lot stronger and developed a better mindset as far as to how to attack the game.” Baseball is the ultimate game of adjustments—if you’re not making them, it’s going to be hard to last in the
sport. Tonascia, who earned All-West First Team Region honors, has found a way to adjust in how opponents have been pitching him. “Throughout college I’ve been seeing ways pitchers have been getting me out, and I’ve been able to adapt,” he said. “I’d say 75 percent of my home runs have been to right field, right-center, because pitchers have been throwing me away, and I’ve finally been able to attack that pitch. Ultimately, I had to start hitting like a big guy and start putting the ball in the air more.” Tonascia credits Otters coach Walt White for letting him loose. In comparison, Tonascia said in his previous stops in community college, the emphasis was more on hitting behind runners and putting the ball in play. “Coach White pushed me to hit the ball in the air more,” he said. “I started to make mechanical changes and got myself mentally ready to attack the baseball. I started leveraging counts to where I knew the pitchers had to throw me something that was hittable.” Tonascia also pointed out that pitchers couldn’t really pitch around him because the CSUMB lineup is pretty balanced. It’s been a long road to Monterey for Tonascia, as he played at Mission College in Santa Clara upon graduating from San Benito High in 2013. After playing the 2014 season, Tonascia had to grayshirt his sophomore season after undergoing Tommy John surgery on his right elbow.
ROUND-TRIPPER Jacob Tonascia rounds the bases for one of the 18 home runs he hit this season to establish a new CSUMB single-season record along with teammate Hayden Duer. won’t be a preventing factor from getting selected in the Major League Baseball Draft in June. In addition to the Tommy John surgery, Tonascia has had two arthroscopic surgeries
on that same right elbow. One thing is for certain: the determined Tonascia fits the mold of today’s MLB slugger: physically strong, and an all or nothing swing that produces a
round-tripper or a strikeout for the most part. Through last week, Tonascia had 16 home runs, a .330 average, 62 RBIs and a .641 slugging percentage with 66 strikeouts.
