Candidates for local government and school board offices can begin filing for election—or re-election— beginning Monday, July 16, and some local school candidates have already made their decisions about their next steps. A desire to complete several school construction projects within the San Benito High School District is a major reason why both Board President Steve Delay and Trustee Juan Robledo will be seeking re-election in November. “My experience on the board has been amazing,” said Robledo, who thanked SBHS district voters for approving two bond measures “that have made it possible to make SBHS a better, nicer place for our students and future students.” While Robledo is finishing out his first fouryear term on the local high school district’s governing

The City of Hollister earlier this year rejected plans for a Fourth of July motorcycle festival, but that didn’t stop hundreds of Harley riders from descending on San Benito Street on July 7 in an informal, impromptu communal gathering of leather-clad enthusiasts. The nearly 150 ‘hogs’ and their riders filled downtown, and visited the iconic Johnnie’s bar and other local restaurants (and gas stations) in homage to a more restless visitation by bikers 71 years ago. Police reported no increase in weekend incidents.

The Santa Clara Valley Water District is moving forward with plans to build a new Pacheco Pass reservoir in San Benito County, which the district

describes as a “game-changer” to ease the impact of future droughts in the Bay Area. If $485 million in state funds are approved this month, supporters they could raise the rest of the $969 million project budget from federal grants and increased water rates to build the largest reservoir constructed in the Bay Area in the past 20 years. The water district board on June 26 approved a memorandum of understanding between the Santa Clara Valley Water

District, Pacheco Pass Water District and San Benito County Water District and approved an option to buy land with the Pacheco Pass Water District for the massive dam and reservoir project, which has been in the planning stages for a decade. The board last year submitted an application to the California Water Commission for funding of the project under Proposition 1, and final hearings before the commission were held in late June. The commission’s decision

on state funding is expected by the end of July. While the Prop. 1 application is being evaluated by the water commission, the water district said it may seek federal legislative authorization for construction funding from Federal Water Infrastructure Improvements. “The Pacheco Reservoir Expansion Project is a modern solution to the age-old challenges of providing a sustainable water ➝ Reservoir, 14

Police cite dozens for illegal fireworks SIX FIRES MAY HAVE BEEN CAUSED BY FIREWORKS Staff report

of 28 citations, police said. In 2016, police wrote one citation for fireworks violations. Police also received 54 fireworks calls to the Hollister dispatch center on July 4—up from 48 calls the same day in 2017, but down from 63 in 2016. Hollister Fire Department reported six fires July 4 that were possibly fireworks-related, according to the police. Firefighters also reported a fireworks-related fire July 3. The public can report illegal fireworks to the Hollister Police Department’s non-emergency line at 831-636-4331. Residents should call 911 for any emergencies.

Hollister police and city code enforcement officers cited 34 people on suspicion of illegal fireworks violations July 4. The police department also received hundreds of reports from citizens through a smartphone application designed to alert authorities of nearby fireworks activity. The city’s illegal fireworks operation began at 5pm July 4 and concluded just after 11pm, according to Hollister police. The

focus of this year’s Independence Day operation was to deploy police and code enforcement officers to enforce fireworks violations, in order to free up firefighters to respond to fires at full strength due to the dry conditions. The city also encouraged residents to use the FOREalert smartphone application, which allows users to send GPS locations of illegal fireworks activity to authorities. Police received a total of 632 reports of fireworks through July 4 from this app, according to authorities. The city’s 2017 illegal fireworks operations resulted in the issuance

Suspect with gun arrested in standoff Michael Moore Reporter

A tense standoff in a Hollister neighborhood ended peacefully Thursday, even after a suspect brandished a handgun at sheriff ’s deputies and fired one round as he was chased through the residential area, according to the San Benito County Sheriff ’s Office. Deputies and Hollister police negotiated with the suspect, Rafael Rojas, for more than 20 minutes before arresting him with the help of Rojas’ family members, without anyone suffering significant injuries, according to authorities. The incident started about 11:30am July 5, when a sheriff ’s deputy

attempted to stop a vehicle for a traffic violation in the area of East Fourth Street in Hollister, according to a sheriff ’s press release. The deputy activated his emergency lights, but the driver, later identified as Rojas, did not stop. The deputy pursued the vehicle through Hollister at slow to moderate speeds, according to authorities. In the area of Paseo Drive, just west of Veterans Memorial Park, Rojas fired a single gunshot from his vehicle. Authorities are still investigating the direction of the shot and what, if anything, it struck. Nobody was hit or injured by the gunshot. In the area of the 1300

block of Marne Drive, Rojas stopped the car and ran on foot into the neighborhood. By this point, Hollister Police officers had arrived to assist deputies with the pursuit and arrest of Rojas. As the first deputy pursued Rojas on foot, he noticed the suspect held a handgun in his right hand, according to authorities. The deputy and officers ordered Rojas to drop the gun and surrender, but he refused. Rojas allegedly challenged the officers to shoot him. Rojas then kicked open the gate to the yard of what police later determined was a home of a relative, according to the sheriff ’s office. An armed standoff

began in the backyard of the residence. Sheriff ’s deputies and police began evacuating residents from nearby homes. The police department sent out an advisory via social media during the standoff, urging people to avoid the area. Officers engaged Rojas in verbal negotiations to disarm and give himself up, according to police. At one point during the standoff, an officer fired a “less than lethal” beanbag round at Rojas, according to Hollister Police Sgt. Don Pershall. Rojas was hit by the beanbag projectile, but did not immediately drop his weapon or surrender. Ultimately, officers and deputies used their cell

Students help raise $23k to aid teen BENEFIT DRIVE WAS EFFORT BY ENTIRE COMMUNITY Staff report

San Benito High School’s Benefit Drive, an annual effort by students to help an individual in need, raised $23,200 to help offset the medical costs for Brett Mattocks, a 13-year-old Hollister boy who had a brain tumor removed last summer. Mattocks underwent chemotherapy and radiation throughout the school year and recently was given the news that he is in remission, according to San Benito Activities Director Catalina Lemos, who coordinated the drive from November 2017 through May 2018. This year’s fundraising effort surpassed its $22,000 goal. Associated Student Body volunteers went doorto-door in many Hollister neighborhoods throughout the year, spending three hours on some Saturdays asking for donations. The student organization also

held “$2 Tuesdays” during which high school staff and students were encouraged to donate whatever they could to the cause, and they organized a “Miracle Minute” at a school rally, in which students donated as much as they could in 60 seconds as part of a class competition. During home athletic games throughout the year, students collected donations from home and visiting fans. “Their generosity is very appreciated,” Lemos said. Various San Benito County restaurants, including Running Rooster and Panda Express in Hollister and Doña Esther in San Juan Bautista, designated certain evenings when a portion of that night’s sales were donated to the cause. The student government also coordinated a spaghetti feed that raised $5,700 with help from the Hollister Veterans of Foreign Wars, which provided a location and some supplies in addition to preparing the food. Lemos credited the persistence and caring shown by students, including ASB President Mylah Smiley and

our beneficiary,” Lemos said. “All ASB officers participated and helped in raising funds for Brett and his family.” Lemos also thanked the Community Foundation for San Benito County and ASB students’ parents for their support, including Maria Spandri, Gabby Ledesma, Beth Breger, Vanessa Yniguez, Teresa Sills

and Jimmy Miguelgorry. The effort was truly a community one, Lemos, a Baler alumna, noted, saying that she wanted “to thank everyone in Hollister and beyond that donated, sent positive thoughts and/ or helped spread the word about our beneficiary.” “My students grew so much from this experience,”

Lemos added. “It is so important to learn to serve in order to be a great leader, and these students are great leaders. I am thankful to be from such a wonderful place, where we still take care of one another.” Mattocks and his family were presented with the check at the ASB Banquet on May 21.

administrator William Barr as the K-8 district’s interim superintendent. Trustee Robert Bernosky made the motion and was seconded by Trustee Elsa Rodriguez. It was then supported by Board President Patricia Moore as well trustees Peter Hernandez and Elizabeth Martinez. “He comes with a very impressive background,” said Hernandez of Barr’s resume, which includes

work with the state education department. “He has extensive experience in contract negotiations, budget crisis and finance. … He’s the guy people go to to fix school districts and put them back on track.” Barr’s first day on the job will be July 18 and he will work a total of 46 days, which do not have to be consecutive and may average two days per week. He will

not receive health benefits or any other allowances during that time, according to the contract details. The agreement can be terminated at any time by mutual consent, and Barr can resign with a 15-day advance notice. “Considering the time right where we’re at now, all that would be available would be interim (superintendents),” Martinez said. “It is very difficult to find a good,

polished person at this stage of the game, and so it would be to our benefit to start a search for someone right now.” With the interim in place, the board will now decide on a search firm to hire to find Andrew’s permanent replacement in the coming weeks. Andrew informed board members last month that she was leaving the district after two years as superintendent.

Hollister needs positive change

Local papers impact government bonds

T

hree economists have published a study that concludes that local newspapers can save taxpayers money. The May 2018 study by Pengjie Gao of Notre Dame and Chang Lee and Dermot Murphy of the University of Illinois at Chicago examined the effect of local newspaper closures on public finance for local governments, and found that following a newspaper closure, municipal borrowing costs increased by 5 to 11 basis points in the long run. The 8,000-word analysis further concluded that these results were not being driven by deteriorating local economic conditions, but from increased government inefficiencies and higher government wages, employees and taxes—all associated with the absence of a community newspaper. “Local newspapers hold their governments accountable,” they concluded. The economists cited a recent Federal Communications Commission report that said, “In many communities, we now face a shortage of local, professional, accountability reporting. This is likely to lead to the kinds of problems that are, not surprisingly, associated with a lack of accountability–more government waste, more local corruption, less effective schools and other serious community problems.” The economists cited related academic studies that show that “geographic areas with reduced local media coverage have fewer informed voters and lower voter turnouts, removing the incentives of local politicians to work hard on behalf of their constituencies.” The economists warned of a deterioration in the quality of public governance when the local government is no longer being monitored closely. A local newspaper closure, for example, could affect public borrowing costs because potential lenders have greater difficulty evaluating the

quality of public projects and the government officials in charge of these projects. Their study also provided evidence that alternative sources of media, such as the internet, are not acting as sufficient substitutes for these local newspapers. “Online sources do not act as a perfect substitute for local newspapers,” the economists wrote. “Our evidence suggests that newspaper closures lead to increased government inefficiencies, [and] local news media have an important and uncompromised external governance role. … Local newspapers continue to play a crucial role in informing local residents.” They warned that communities without a local newspaper have a “local information vacuum” that cannot be easily filled by other media. “Non-traditional media outlets, which are primarily online, have not sufficiently filled the investigative journalism gap that has resulted from newspaper closures. Instead, these non-traditional outlets have primarily been in the business of content dissemination rather than the production of new information.” They referred to a warning from Terry Francke, a leading expert on government transparency, about what can happen “to communities without their own oldfashioned diligent news coverage by veteran newspaper reporters, or at least smart reporters led by veteran newspaper editors.” In case we needed more evidence of the importance of our task at the Free Lance, these economists provide some valuable data. It’s no secret that many communities our size have no local newspaper—many haven’t for years—and the communities suffer. Fortunately, our community support is strong, ensuring that our “watchdog” role— which these days is more important than ever—will continue.

Dear Editor, I have lived in Hollister for over seven years. Since I’ve been here, I have tried my best to give my input into the city and county as far as how to better help our community. I have talked a lot about saving money, budgeting better, stop signing contracts that cost us more in the long run, public safety, the roads, the water treatment plant, the garbage contract … the list goes on. So many changes need to be made. In the time I have been here, we are still struggling with the same things. The only change so far is more homes, which means more people, more traffic, fewer jobs, crowded schools. I am not the only one who sees this; I have seen several, more than it should be, concerned citizens about these topics. I, myself, am a very concerned citizen. So when will we know the truth? When will the city and county be honest with the community? Do they really know what they are doing? This has to stop. We need a better system, and the public officials need to start taking some accountability. As taxpayers, we deserve some honest answers. What kind of direction are the public officials taking the city of Hollister in? Why don’t we use local companies more instead of always hiring out-of-town, even out-of-state consultants and companies to do our work? That not only costs us more, but our local companies lose out as well. We are supposed to be helping our local businesses. We have the tools, we have the workers and we have the time and the money. Let’s direct it better and start using what we have, utilize the great companies Hollister has to offer. We need to work together and harder to make a positive change between our city officials, our businesses and our citizens. Let’s get on the same page.

body, Delay has been on the Board of Trustees since first winning election in 2006. “I started out in that district as a teacher so I’ve always had a soft spot for it,” said Delay, who later got involved with facilities and construction in 1986. “We’re doing so much with the bonds I would like to continue to see that plan come to an end and continue to be part of it.” The third expiring trustee seat is occupied by Bill Tiffany, who let his board colleagues know that he was not going to seek another four-year term. “I would like the opportunity to continue working with our staff to complete the construction that started right after I first got on the board,” Robledo said. “Besides construction, I feel that my 38 years of teaching at SBHS has given me a background that will allow me to continue to help provide direction for our school.” The SBHS district will conduct its first trustee area/by district elections in November after converting from an at-large format. The new setup allows only candidates living within a designated trustee area to run for that office. Police move quickly to arrest teens for theft Staff report

Using a store manager’s description to pull over a suspicious vehicle, Hollister police officers made a late-night arrest of two teenaged suspects in possession of thousands of dollars of over-thecounter pharmaceuticals from Safeway stores in Hollister, Prunedale and Half Moon Bay. On the night of July 5, 2018, Hollister police said they received a report that a theft had just occurred at the Safeway at 591 Tres Pinos Road. The reporting party provided a description of the two suspects, a vehicle description and the last direction of travel. While responding to the call, Officer Masso located a vehicle matching the given description leaving the area occupied

by two individuals matching the description of the suspects. Officer Masso made a traffic stop on the vehicle on Hillcrest Road and contacted two suspects, Melique Carter, 19, and Annalisia Kapisi,18, from Vallejo. The officer reported he found several boxes of overthe-counter medications and other items in the vehicle. Information obtained during the investigation suggests that the two may have traveled from city to city to commit similar thefts. The recovered stolen property was not only from the theft at the Hollister store. Subsequent investigation revealed items were stolen from the store in Prunedale and Half Moon Bay. The total amount of stolen pharmaceuticals recovered was in excess

of $3,300.00. Both Carter and Kapisi are on probation from San Mateo County for prior convictions. Carter and Kapisi were both arrested without incident and booked on the charges of grand theft and conspiracy to commit a crime. “The Hollister Police Department would like to thank the business employee who called to report the crime in progress and providing accurate and timely information,” said Capt. There are few suitable spots in California for new water storage, and fewer still that substantially help threatened fish species. We’re fortunate to have one of those spots in our backyard.”

The expanded reservoir would be filled with storm runoff from the surrounding watershed, and would also be used to store water imported through the Sacramento-San Joaquin Delta. The project would include a new earthen dam and spillway. Other features are new pipelines, tunnels and a pump station to connect the new reservoir to the Pacheco Conduit, an existing pipeline near Highway 152 that conveys water from San Luis Reservoir to Santa Clara and San Benito counties. Key project partners include the Pacheco Pass and San Benito County water districts and eight wildlife refuges in the San Joaquin River Hydrologic Region. Support letters from 46 California state legislators, organizations, resource conservation districts, water agencies and individuals were included in the application. Jerry J. Smith, Ph.D., a fisheries biologist with experience studying Pacheco Creek since 1972 wrote the district, “The additional storage in the enlarged reservoir would potentially allow for increased releases from the reservoir into Pacheco Creek for rearing, including expanding releases to drought years when the existing reservoir would have insufficient storage to provide adequate releases for rearing steelhead.” Josué García, CEO of the Santa Clara and San Benito Counties Building and Construction Trades Council, wrote, “This investment in our future will create both short- and long-term jobs as

supply for our expanding population and businesses,” district staff said in a report. “This project will reduce the frequency and severity of water shortages, provide flood protection for disadvantaged communities, as well as protect and grow the native steelhead population.” The proposed state funding would come from Prop. 1, which was approved by nearly three-quarters of San Benito and Santa Clara county voters in 2014. The funding would come from the $2.7 billion Water Storage Investment Program, part of California’s Water Quality, Supply and Infrastructure Improvement Act of 2014, a $7.5 billion bond passed by voters. The project would establish a new dam and expanded reservoir on the North Fork of Pacheco Creek that could hold 141,000 acre-feet of water, a substantial increase from the 6,000-acre-foot capacity of the existing reservoir. Constructed in 1939 and used for groundwater recharge, the reservoir is located about 13 miles southwest of San Luis Reservoir, off Highway 152. The district describes project’s potential benefits as “vast,” including the following: • Increase suitable habitat in Pacheco Creek for the federally threatened South Central California Coast steelhead • Develop water supplies for the environmental needs of wildlife refuges to support habitat management in the delta watershed

Together, these changes will create consistent economic growth for the entire Silicon Valley.” The land is currently owned by the tiny Pacheco Pass Water District and is submerged under a small lake used by farmers that is known as Pacheco Reservoir. The Santa Clara Valley Water District agreed to pay the Pacheco Pass Water District $200,000 for the land under a 15-year option. The Santa Clara district would then construct the new $969 million reservoir on, or slightly upstream from, the existing reservoir in the rugged ranch lands about half a mile north of Highway 152 near Casa de Fruta. The larger district would

guarantee the Pacheco district a similar amount of water as it is getting now. “The reliability of our water supply system is really key,” said Norma Camacho, CEO of the Santa Clara Valley Water District. “When you are dealing with climate change and recurring droughts, we are going to need an emergency water supply. It allows for more resiliency. It’s an insurance policy.” The Santa Clara Valley Water District is a government agency based in San Jose that provides water and flood protection to 1.9 million people from Palo Alto to Gilroy. The existing reservoir was built on the North Fork of Pacheco Creek in 1939 behind a 100-foot earthen

dam now badly in need of costly repairs. There are eight bids in the running to replace it with a new reservoir that would hold more than 23 times as much water. The water district has yet to identify where the other $484 million needed to build the new reservoir would come from. The district could try to tap federal sources, but raising local water bills is considered the most likely way to raise the money. Weaver wants hike participants to be prepared to handle any situation a hiker and dog may encounter, such as an unleashed dog in the park or other potential hazards. “I try and let them discuss, emphasizing staying calm, since panicking and yelling just escalates the situation,” she said. “I give tips and share stories of my experiences.” The majority of Weaver’s organized hikes occur in the evening when it’s not too hot. “Our trails close to hikers at sunset for their safety,” Weaver said. “On these hikes, visitors can experience the park at night with a park ranger and not worry about getting lost.” She’s earned quite a

following in the last decade. “I am moving parks to Coyote Lake’s Harvey Bear Ranch in October, and I already have dog owners asking me to please continue my hikes there,” she said. Weaver acknowledges that Mt. Madonna, located at the top of Hecker Pass off CA 152, is a bit out of the way for people. “It does amaze me how far people will travel to attend a hike.” Depending on other events scheduled at the park, Weaver tries to schedule these summer hikes at least once a month. The next hike is scheduled for Saturday, Aug. 25. Weaver loves sharing the park with the visitors, but best part of it all is sharing information and getting to meet wonderful people and dogs.

Taking your dog for a walk can be an adventure. Just ask Blake Weaver, senior ranger with Santa Clara County parks who has been hosting special dog hikes at Mt. Madonna County Park since 2005. “Dogs are such a big part of many of our lives,” said Weaver. “I am lucky enough to work for Santa Clara County Parks at a park that allows dogs to hike the trails on leash.” More than 15 people and their furry companions showed up at dusk on Saturday, July 7 to take a mountain hike through Mt. Madonna trails with Weaver and her standard poodle Yeti. Not only is getting out for a hike good for hikers and their pets, but these groups hikes add an element of socialization, said Weaver, who lives in Hollister. “I frequently have puppies join the group for this reason,” she said. Weaver cautioned, however that with such privilege comes the responsibility to ensure the dogs leave a small footprint by minimizing the disruption to other people, other dogs and wildlife and

The Hollister American 11-yearold All Star Little League team knew it was facing a stiff test in last Saturday’s District 9 championship game against Ferrasci. After all, Hollister needed a minor miracle—it scored four runs in the bottom of the sixth inning for a 7-6 win—to beat Ferrasci when the teams played in the winners’ bracket semifinal. “We all talked about mentally trying not to let them score (and get ahead) of us like they did last time,” said Nathan Alves, who is one of the team’s four main pitchers. “The last time we played them, we thought we were going to lose (as the team entered the final half inning).” As such, Hollister needed no reminder how close it was to being sent to the bottom bracket. It competed like a team that didn’t want to play on Sunday, which it would’ve had to do in a winnertake-all contest had it lost Saturday’s contest. From the get-go, Hollister displayed its superiority in a 15-3 win that ended in the fourth inning due to the mercy rule. American advances to the Section 5 Tournament in Santa Cruz on Saturday. “We were on it today,” manager Richard Alves said. “The boys were in it from the get-go, and we came out hitting.” Did they ever. After going scoreless in the first inning, Hollister racked up six runs in the second before piling on nine more in the third to bury Ferrasci. The Hollister roster includes Nathan Alves, David Arzate, Westin Aviles, Angelo Bonomi, Gavyn

Churchill, Dominic Esparza, Evan Lopez, Daniel Martinez, Angel Montiel, Jack Penney, Trenton Roach, Jacob Sanchez and Alfredo Verduzco, Jr. Martinez and Churchill each went 3 for 3, and Roach went 2 for 2. Arzate, Esparza and Martinez drove in three runs apiece, and Sanchez had two RBIs. Alves started and went three innings, allowing three runs while striking out five and walking none. Arzate tossed an inning of scoreless relief to seal the victory. Hollister ran the table in the District 9 Tournament; however, the team knows the competition will be a lot stiffer in sectionals. “This is the situation we like to be in, where we play tougher competition,” said Richard Alves, who followed with a hilarious comment that most other coaches can relate with in regards to potential distractions. “Hopefully, the kids can stay with it and not worry about (the popular video game) Fortnite so much. So many kids love that game it’s crazy. We’ve got to keep them disciplined where they can only stay up until 10 p.m. playing that game.” Alves was pleased with the players’ focus, as they were on point in all phases of the game from the start. “The dugout was alive, and that is always a good sign,” he said. “Even if we made a mistake, they weren’t getting down on themselves. They had a positive attitude, and that helped them to win.” Hollister learned from its first game with Ferrasci, in which it trailed 6-2 entering the bottom of the sixth inning. Having been badly outplayed until that point, the American players hit another gear, displaying a steely resolve belying their age. Alves led off the frame with a walk and advanced to third base on a Montiel single. Roach followed with a run-scoring double, and Martinez and Esparza succeeded Roach with run-scoring

When we started getting hits, that pumped the team up to do better.” Said Richard Alves: “We played a lot better this time than the first time against them. We were in it to win it. The first time we were down in our at-bats, but this time after going down in the first, we did what we needed to do.” When Nathan Alves was asked about the possibility of

winning the district tournament again after he was part of the 10-year-old squad that won it last year, he hinted that bigger things were in store for the upcoming sectionals. “We have no younger kids; everyone is 11 years old and is really good,” he said. “We’ve won district before, and it’s always a good feeling.” Richard Alves said every player on the roster played on a Majors team, which is a huge advantage because some teams have to select players from a Minors squad. Hollister Little League has a deep reservoir of talent, with over 500 kids in its organization. “We’ve got experienced and talented players, which is good and bad because sometimes confidence can be your enemy,” he

said. “All of our kids played on Majors team, which is a huge advantage. Overall as a team, in some cases we’ve beaten ourselves, whether it’s making the incorrect or bad throw. But this group is great and they’re getting better with each week.” In the team’s 4-1 win over Soledad in a winners’ bracket quarterfinal, Alves and Churchill combined to shut down the Soledad lineup, and Esparza launched a solo home run in the fifth inning. American has received solid pitching from Alves, Churchill, Martinez and Roach. “The kids are throwing well,” Richard Alves said. “We have a lot of fastball pitchers; we don’t throw a lot of off-speed pitches. We’re more about throwing fastballs with placement.”

She leaves behind her children, Peggy Sakamoto, Susie Tanaka, Lillian Tominaga, Akio Jim Teramoto (SGM Retired), Lee and Joanne Bishop; eight grandchildren, seventeen greatgrandchildren and one great-great-grandchild. Services were held at Willow Glen Funeral Home. Burial at Gavilan Hills Cemetery in Gilroy.

obert J. “Bob” Lindeleaf (77) died peacefully on Friday, July 6, 2018 at his home. Bob was born and raised in Gilroy, CA. He graduated from Gilroy High School and married his high school sweetheart, Louise DeFrancesco. As partners in life, Bob and Louise enjoyed a successful life of farming. Over the years, Bob recounted that the success of the farming operations was a result of mutual respect, love, dedication and contributions of the Javier Lopez and Juan Acevedo families. Upon retirement from farming, the Lindeleaf’s moved to Snelling, CA and then to Fresno, CA to be near their daughter Toni. Bob is preceded in death by his loving wife of 57 years, Louise P. Lindeleaf. He is survived by his two daughters and son in law, Toni Lindeleaf, Robin and Don Watenpaugh. Bob and Louise shared a passion for hunting and road trip adventures. He enjoyed a second career as a cowboy helping local ranchers with gathering and branding cattle. His parents, Howard and Bertha Lindeleaf, In-Laws Mario and Pauline DeFrancesco Sr. and brotherin-law Alfred DeFrancesco preceded Bob in death. Bob leaves behind his brothers, Jerry and Don Lindeleaf, brother-in-law Mario DeFrancesco Jr., sisters-in-law, Judy Lindeleaf, Diane Lindeleaf, Carolyn DeFrancesco, Dolores DeFrancesco and many nieces and nephews. 942 HOL - Public Notice COUNTY COUNSEL’S SUMMARY OF PROPOSED COUNCIL OF SAN BENITO COUNTY GOVERNMENTS ORDINANCE NO. 2018 01 THE “ROADS, TRANSPORTATION SAFETY AND INVESTMENT PLAN TRANSACTIONS AND USE TAX ORDINANCE”, IMPOSING A RETAIL TRANSACTIONS AND USE TAX TO BE ADMINISTERED BY THE CALIFORNIA DEPARTMENT OF TAX AND FEE ADMINISTRATION, AND ADOPTING A TRANSPORTATION EXPENDITURE PLAN, THE “SAN BENITO COUNTY TRANSPORTATION SAFETY AND INVESTMENT PLAN” The Council of San Benito County Governments (COG) will consider, at its regularly scheduled meeting of July 19, 2018 at 3:00 p.m., adopting an ordinance entitled “AN ORDINANCE OF THE COUNCIL OF SAN BENITO COUNTY GOVERNMENTS, THE “ROADS, TRANSPORTATION SAFETY AND INVESTMENT PLAN TRANSACTIONS AND USE TAX ORDINANCE”, IMPOSING A RETAIL TRANSACTIONS AND USE TAX TO BE ADMINISTERED BY THE CALIFORNIA DEPARTMENT OF TAX AND FEE ADMINISTRATION, AND ADOPTING A TRANSPORTATION EXPENDITURE PLAN, THE “SAN BENITO COUNTY TRANSPORTATION SAFETY AND INVESTMENT PLAN”. Pursuant to the authority of the June 21, 2018 order of the COG Board of Directors and Government Code section 25124, the ordinance is of such a length and content that a complete copy of the ordinance would not be practical to publish in the official newspaper. Accordingly, a summary has been prepared as follows. A copy of the proposed ordinance is on file with the Clerk of the Council of San Benito County Governments and is available for inspection during normal business hours at the Council of Governments Offices, 330 Tres Pinos Road, C 7, Hollister, California. The ordinance, if adopted, will be applicable in the incorporated and unincorporated territory of San Benito County, and will provide for: A. the adoption of a transportation expenditure plan that has been approved by all affected jurisdictions, referred to as the “San Benito County Transportation Safety and Investment Plan”, to: 1. repair potholes; 2. improve and maintain local roads; 3. widen Highway 25 to relieve traffic congestion and improve safety; 4. improve pedestrian and bicycle safety; 5. provide mobility, bus, and paratransit services for seniors, people with disabilities, and youth; and 6. qualify for state and federal matching funds; B. the imposition of a retail transactions and use tax of one percent (1%) over a period of thirty (30) years; C. the authority to issue bonds secured by such taxes; D. the authority to receive short-term or long-term loans secured by such taxes; E. the COG’s authority to administer tax proceeds; and F. the establishment of a citizens’ oversight committee, with the requirement to conduct annual independent audits. Since Measure ___ is for a specific use and not a general tax, a 2/3 majority vote of the electors voting on the measure is required for passage. Measure __ is not similar to a gas tax that is shared throughout the State of California. It is a local retail transactions and use (sales) tax whereby all revenues plus interest generated shall be distributed as required by the Transportation Safety and Investment Plan (Exhibit B), only for road, transportation and transit projects, only in San Benito County. More specifically, the ordinance, if adopted, will include the following Sections: - SECTION 1 (Title) shall be known as the Council of San Benito County Governments “Roads, Transportation Safety and Investment Plan Transactions and Use Tax Ordinance.” - SECTION 2 (Summary) provides a summary of the ordinance, as set forth above. - SECTION 3 (Administration Of Plan) will provide that the COG shall impose the Roads, Transportation Safety and Investment Plan Transactions and Use Tax, enter into an agreement with the Department of Tax and Fee Administration to collect the funds, and that it shall allocate the tax revenues and administer the Transportation Safety and Investment Plan, consistently with Chapter 5 (commencing with Section 180200) of Division 19 of the California Public Utilities Code, and with Part 1.6 (commencing with Section 7251) of Division 2 of the California Revenue and Taxation Code. - SECTION 4 (Administrative Costs) will provide for annual administrative costs to administer the Ordinance and Transportation Safety and Investment Plan, not to exceed one percent (1%) of the Measure ___ revenue generated in that year, excluding the California Department of Tax and Fee Administration’s administrative costs, and that the COG shall expend only that amount of the funds generated for staff support, audits, annual reports and other administrative expenses and contract services that are necessary and reasonable to carry out its responsibilities pursuant to Division 2 of the Revenue and Taxation Code. - SECTION 5 (Definitions) will define certain terms used throughout the ordinance. - SECTION 6 (Purpose) sets forth the purposes of the ordinance and directs that provisions of the ordinance be interpreted in order to accomplish those purposes: - SECTION 7 (Identification Of Tax And Statement Of Facts On How Tax Revenue Can Be Spent) will require that the revenue from the Roads, Transportation Safety and Investment Plan Transactions and Use Tax will be spent only to implement specific projects and programs specifically set forth in the Transportation Safety and Investment Plan, summarized as follows: A. Widen Highway 25: Relieve Traffic and Improve Safety: revenues shall fund an Environmental study, design and construction of the Highway 25 4-Lane Expressway Project, building a new 4-lane highway between Hollister and Santa Clara County. Local funds will be used to match with State (Local Partnership Program and State Transportation Improvement Program) and Federal funds as well as local Traffic Impact Mitigation Fees. The COG and its local jurisdictions will work closely with the California Department of Transportation and the California Transportation Commission to maximize the State contributions to project development and funding the project. In addition, local developers will be required to pay their “fair share” for project impacts of new housing and retail development on the highway, which is identified as 40% of the total cost. B. Local Street and Road Repair, Maintenance and Rehabilitation, and Improvements: Improve Safety & Traffic Flow: Funding will be provided to the local jurisdictions, based on a formula of 47.5% to San Benito County, 47.5% to the City of Hollister, and 5% to the City of San Juan Bautista. Funds will be distributed annually by COG and local jurisdictions will implement based on their adopted Pavement Management Plans. Local funds will be used to match with state gas tax funds already provided to the local jurisdictions. C. Other Categories: Funding will be provided for the following: 1. Mobility, bus, and paratransit services for seniors, people with disabilities, and youth as described in the Regional Transportation Plan for the community. 2. Projects that Enhance Pedestrian and Bicycle Safety, including implementation of Safe Routes to School projects and projects identified in the Countywide Bicycle, Pedestrian Master Plan, and Regional Transportation Plan. 3. Projects that enhance safety and improve traffic flow on local roadways, including operational improvements, traffic calming, and “complete streets” measures. 4. Administration (capped at one percent (1%)) 5. Future Planning & Contingency - SECTION 8 (Election) will provide that the San Benito County Board of Supervisors be requested to call an election for voter approval of the measure at the November 6, 2018 election, with the sample ballot to include the full proposition as set forth in the ordinance, and the voter information handbook to include the Transportation Safety and Investment Plan, with approval of the measure and imposition of the Roads, Transportation Safety and Investment Plan Transactions and Use Tax, to require the vote of a two-thirds (2/3) majority of the electors voting on the measure at that election. - SECTION 9 (Annual Report) will provide for the preparation of an annual report setting forth (a) the amount of funds collected and expended pursuant to this Ordinance and (b) the status of any projects authorized to be funded in the Investment Plan. - SECTION 10 (Citizens’ Oversight Committee: The Measure __ Transportation Safety And Investment Plan Oversight Committee) will provide that prior to expenditure of any funds collected, COG’s Board of Directors shall establish and convene a citizens’ oversight committee, with members who shall be residents of the City of Hollister, the City of San Juan Bautista, and the unincorporated areas of San Benito County, who are neither elected officials of any government, nor employees from any agency or organization that either oversees or benefits from the proceeds of the tax revenues, to be appointed by the COG’s Board of Directors to fairly represent the geographical, social, cultural and economic diversity of the County to ensure maximum benefit for road and transportation users, and that the oversight committee shall be responsible for the following: A. Independent Audits: The oversight committee shall have full access to COG’s independent auditor and review the annual audits, have the authority to request and review the specific financial information, and provide input on the audit to assure the funds are being expended in accordance with the Transportation Safety and Investment Plan; B. Plan Changes: The oversight committee shall review and make recommendations on any proposed changes to the Transportation Safety and Investment Plan, prior to COG’s consideration, subject to 2/3 vote of the voting oversight committee members; C. Project Delivery and Priorities: The oversight committee shall review and comment on the project delivery schedules and make recommendations to the COG on any proposals for changing project delivery priorities; and D. Annual and Final Reports: The oversight committee shall prepare annual reports regarding the administration of the program, to be presented to the COG’s Board of Directors and posted to the COG’s website. - SECTION 11 (Amendments To The Transportation Safety And Investment Plan) will provide that COG may annually review and propose amendments to the Transportation Safety and Investment Plan to provide for the use of additional Federal, State and local funds, to account for unexpected revenues, or to take into consideration unforeseen circumstances, only for projects that are included in the adopted 2040 San Benito County Regional Transportation Plan at the time the amendment is proposed and/or by the priorities established in the Transportation Safety and Investment Plan, and only in accordance with the following process set forth in Section 180207 of the Public Utilities Code: (1) COG shall recite findings of necessity to initiate amendments; (2) COG shall provide notice and a copy of the proposed amendments to the County Board of Supervisors and the City Councils of the Cities of Hollister and San Juan Bautista; and (3) the proposed amendments shall become effective 45 days after notice is given. - SECTION 12 (Pavement Management Program Requirements) will provide that each jurisdiction shall adopt a pavement management program, that they shall rely on their pavement management programs to identify priority projects for construction during the time the Roads, Transportation Safety and Investment Plan Transactions and Use Tax is in effect, and shall submit regular reports on the conditions of their streets and roads, to ensure timely repairs and to keep the public informed. This section also will provide that, if deemed necessary by COG, a pavement management program adopted by the COG will be eligible to be funded prior to distribution of funds to the cities or county. - SECTION 13 (Impact Fee Requirements) will provide that each jurisdiction shall maintain participation in the Regional Traffic Impact Mitigation Fee program and shall impose the adopted fees on new development as applicable, to ensure new development pays for its impacts on the regional transportation system. - SECTION 14 (Tax Sharing Agreements) will provide that each jurisdiction shall enter into tax sharing agreements with COG that will include enforcement procedures, designed to reassure the public that tax revenues are spent in accordance with the ballot language. - SECTION 15 (Establishment Of Bonding Authority) will provide authority to issue bonds to finance capital outlay expenditures as may be provided for in the Transportation Safety and Investment Plan, payable from the proceeds of the Roads, Transportation Safety and Investment Plan Transactions and Use Tax. - SECTION 16 (Maintenance Of Effort) will provide that additional funds provided to each jurisdiction by Measure ___ are intended to supplement other existing funds, revenues and other resources being used for street and highway purposes, including but not limited to federal and state funding, the collection of traffic impact mitigation fees, other local impact fees, and dedications of property, and that each jurisdiction shall maintain their existing commitment of local transportation-related funds for transportation purposes. - SECTION 17 (Creation Of Special Fund) will provide that all tax revenue, plus interest, will be deposited in a special fund for Measure ___ projects, to be administered by COG pursuant to the ordinance and to the provisions of Division 19 (commencing with Section 180000) of the California Public Utilities Code, and Part 1.6 (commencing with Section 7251) of Division 2 of the California Revenue and Taxation Code, with any interest generated to be treated as Measure ___ Revenue for the purpose of using the interest for Measure ___ projects. - SECTION 18 (Contract With State) will provide that COG shall contract with the California Department of Tax and Fee Administration to perform all functions incident to the administration and operation of this Roads, Transportation Safety and Investment Plan Transactions and Use Tax Ordinance. - SECTION 19 (Transactions Tax Rate) will provide that a tax will be imposed upon all retailers in the incorporated and unincorporated territory of the County of San Benito at the rate of one percent (1%) of the gross receipts of any retailer from the sale of all tangible personal property sold at retail. - SECTION 20 (Place Of Sale) will provide guidelines for determining the place of sale for all retail sales. - SECTION 21 (Use Tax Rate) will provide that an excise tax will be imposed on the storage, use or other consumption in the County of San Benito of tangible personal property purchased from any retailer for storage, use or other consumption in said territory at the rate of one percent (1%) of the sales price of the property. - SECTION 22 (Adoption Of Provisions Of State Law), SECTION 23 (Limitations On Adoption Of State Law And Collection Of Use Taxes) and SECTION 25 (Exemptions And Exclusions) will incorporate the provisions of Part 1 (commencing with Section 6001) of Division 2 of the Revenue and Taxation Code, with certain exceptions, exemptions, exclusions and limitations set forth in those sections. - SECTION 24 (Permit Not Required) will provide that if a seller’s permit has been issued to a retailer under Section 6067 of the Revenue and Taxation Code, an additional transactor’s permit shall not be required. - SECTION 26 (Amendments To The Ordinance) will provide that amendments to provisions of state law that are incorporated by reference into the ordinance shall automatically become a part of the ordinance, except that no such amendment shall affect the rate of tax imposed, and that other amendments to the ordinance shall require a two-thirds (2/3) vote of the total membership of COG, plus the subsequent approval of a twothirds (2/3) majority of the electors voting on such change submitted for a vote at a special election called for that purpose by the Board of Supervisors. - SECTION 27 (Enjoining Collection Forbidden) will provide that no injunction or writ of mandate or other legal or equitable process shall prevent or enjoin the collection under the ordinance, or Division 19 (commencing with Section 180000) of the California Public Utilities Code, and Part 1.6 (commencing with Section 7251) of Division 2 of the Revenue and Taxation Code, of any tax or any amount of tax required to be collected. - SECTION 28 (Severability) will provide that if any provision, subsection, sentence, clause or phrase of the ordinance or application to any person or circumstance is held invalid or unconstitutional, the remainder of the ordinance will remain in full force and effect. - SECTION 29 (Effective Date) will provide that the ordinance will take effect immediately. - SECTION 30 (Termination Date) will provide that the ordinance shall expire 30 years from the operative date. - SECTION 31 (Captions) will provide that the titles and headings shall not effect the construction or interpretation of the ordinance. - SECTION 32 (Publication) will provide for publication of a summary of the ordinance, with the names of the COG members voting for and against it, within 15 days after its passage. - Exhibit A to the ordinance, if adopted, will provide for a ballot measure, to read as follows: Measure Shall the voters authorize a San Benito County Roads and Transportation Safety and Investment Plan to: repair potholes and maintain roads; widen Highway 25 to relieve traffic congestion and make it safer; improve pedestrian, bicycle, and transit options; and, qualify for state and federal matching funds by enacting a one cent sales tax, raising approximately $16,000,000 annually over 30 years, with annual audits, independent oversight, all funds spent locally, and a detailed expenditure plan? -Exhibit B to the ordinance is COG’s adopted Transportation Safety and Investment Plan, which describes a process conducted by COG to identify transportation needs and projects in the region, sets forth goals and objectives for projects, includes a tiered structure for project funding, and identifies the estimated amount of local tax dollars generated by the measure that will be used on the project Tiers. Tier I is the Highway 25 4-lane widening. Tier II includes projects to maintain local roads, repair potholes, and improve traffic flow. Tier III includes other projects including bicycle and pedestrian, transit/mobility, and administration. The Plan also includes administrative provisions and taxpayer safeguards addressing the following: audit requirements, an independent citizen’s oversight committee, the allocation criteria and community benefits to be considered by COG when allocating funds, CEQA compliance, and amendments.
