The San Benito Community Foundation announced its annual list of recipients for its “community impact” grants, an assortment of 41 nonprofits sharing more than $253,000. The grants ranged from $1,000 to $10,000, and were announced at the local foundation’s annual grant awards dinner June 12. Nearly all of the $10,000 recipients provide a range services. Senior services were among the top recipients. The Del Mar Caregivers Resource Center, Foster Grandparents Program of San Benito County and the Golden Age Nutrition Program’s Meals on Wheels each received $10,000 for nutrition services. Youth programs also received some of the top grants. The YMCA’s San Benito Summer Day Camp, the Salvation Army’s youth programming, the Veterans Park soccer fields renovation by the Hollister Tremors, and CASA’s advocacy for foster children, each received $10,000 grants.

Fugitive arrested in Mexico

FBI, MEXICAN POLICE FIND SUSPECT IN 2014 KILLING OF ARIANA ZENDEJAS By Barry Holtzclaw Managing Editor

Hollister police on Friday, July 13, announced the arrest in Mexico of a suspect in the 2014 murder of Hollister teen Ariana Zendejas.

Jose Antonio Barajas, a 24-year-old former Hollister resident, was arraigned in San Benito County Court on Monday, July 16, on charges of murder, kidnapping and assault with a deadly weapon. Police Chief David Westrick said that Barajas, U.S. citizen, was arrested by police in Guadalajara, Mexico on Thursday, July 12, on a fugitive warrant. He was deported by Mexican authorities and flown the next morning to San

Jose, where he was immediately transferred to the San Benito County jail. He was booked on charges related to the shooting death of Zendejas on Aug. 1, 2014. The victim was 19 years old. The arrest, announced in an emotional afternoon press conference at Hollister police headquarters, came two days after Hollister detectives and the FBI were able to confirm a tip local detectives received last year about

the suspect’s location in Guadalajara. A warrant for murder and kidnapping had been in the law enforcement database since 2014. “I want to thank the Hollister police for helping us with everything,” a tearful Camilla Zendejas, 13-year-old sister of the murder victim, said a the July 13 press conference. “It’s really hard to lose someone in your life that you look up to so much. Now to find out that he is

found, it helps everything, helps everyone so much, everyone in our family.” Police said the arrest occurred without incident. It was the result of a coordinated effort of Hollister police, the FBI, ICE, U.S. Marshals, Mexican federal police and Jalisco state police that included several surveillance operations, Westrick said. The suspect was flown back to the U.S. via ➝ Zendejas, 11

Statute of limitations could be Dabo issue NO DECISION ON FATE OF CHARGES FOR MISSING $640K FROM TRUST By Barry Holtzclaw Managing Editor

Eight months after a Superior Court judge ruled that San Benito County Board of Education Trustee Mitchell Dabo violated California probate laws when he transferred more

than $640,000 from a charitable trust to his person accounts, the fate of an ongoing criminal probe could hinge on how prosecutors interpret state statute of limitations laws. San Benito County District Attorney Candice Hooper continues to decline comment on any aspect of her investigation of Dabo’s actions as trustee of the Matulich Charitable Trust. Police investigators have twice sent evidence back

to Hooper, and say they have concluded their investigation. According to documents provided by Dabo himself in a civil lawsuit brought by the San Benito County Community Foundation, the draining of nearly all funds from an $800,000 trust began in 2009 and continued after the death of Barbara Matulich of Hollister in 2012. California’s statute of limitations laws—which dictate the periods when

criminal charges can be filed—vary according to the crime, say legal experts. There is no statute of limitations, for example, for murder or other offenses punishable by death or life imprisonment, or for embezzlement of public funds. For most other crimes, the statute of limitations is six years for offenses punishable by eight or more years in prison, and three years for offenses punishable by less than eight

years, after commission of the offense. That could end any prospects for prosecution of Dabo, but state law makes an exception for any crime that includes fraud, a breach of a fiduciary obligation—such as the management of a trust—or theft or embezzlement of money from an elderly or dependent adult, In these cases, the statute of limitations ➝ Dabo, 5

Opposition to Islamic center continues ENVIRONMENT REPORT DOES LITTLE TO EASE SAN MARTIN TENSIONS By Jaqueline McCool Reporter

Afzal’s three daughters, Hanna, 19, Sana, 16 and Maimona, 23, defended the project during the public comments, saying the opposition was directed more toward Islamic community members than the specifics of the Cordoba Center plan. “Let’s call this opposition for what it is: bigotry,” said Maimona Afzal-Berta. The San Martin Neighborhood Alliance has been a fierce opponent of the project from the start, and members of the group protested at Wednesday’s meeting, accompanied by large printed photos of floods in San Martin., In an emailed statement on behalf of the alliance, Trina Hineser said the group is concerned about the center’s size, what they say are inaccuracies in the EIR, the proposed cemetery’s impact on groundwater and the center’s effects on development in San Martin. “We would be pleased to engage with the proposers regarding a more modest project that would meet their needs with substantially less impact,” wrote Hineser, “but regretfully cannot support this project as proposed.” Islamic community member Hambdy Abass said the South Valley Islamic Community and the neighborhood alliance have sat down on multiple occasions to discuss the project. Abass said he was confused after seeing the alliance at the meeting. “They say they’re on our side,” he said, adding that he doesn’t feel that the points the alliance has made in public reflect the concerns and sentiments the group shared with Islamic

South Valley Islamic families are beginning to see their long-awaited plans to build a mosque and community center in San Martin come together, but some vocal San Martin residents continue to oppose the project. The pros and cons of building the proposed Cordoba Center were discussed July 11 at a special meeting of the Santa Clara County Planning Commission to hear comments on a draft environmental impact report. Many of the comments reflected the continuing culture clash in this unincorporated community of 7,000 along U.S. 101 between Gilroy and Morgan Hill, rather than the specifics of the EIR. The 200-page report identified few negative impacts of the construction project. The South Valley Islamic Community, which serves Muslim families residing in South Santa Clara County, has been meeting in a converted barn in San Martin since 2001. The community purchased the land for the new worship center in 2006 and has re-submitted plans three times. In 2012, plans for a mosque and community center were unanimously approved by the county planning commission and Board of Supervisors. But when neighbors sued to block the project,

the Islamic community voluntarily withdrew, re-submitting plans for a larger facility and offering to fund an EIR. Six years later, the center is again a few months away from final county approval. The center is to be built on Monterey Road neighboring Llagas Creek, on the highest point in San Martin. The proposed project includes a mosque, a community building, recreational facilities, a cemetery and a summer camp site. The Hiram room at the Morgan Hill Community Center was at capacity on July 11, with approximately 280 people inside and more watching on monitors set up in the hallway during the special meeting. The meeting was hosted by the Santa Clara County Planning Commission and San Martin Planning Advisory Committee to mark the halfway point of the comment period on the EIR. The comment period ends July 30. Islamic community member Nashaba Afzal said at the meeting that the report, combined with the decision by the South Valley Islamic Community to withdraw its previous applications, represented an effort to be transparent. She said, “We didn’t want people thinking that we’re shoving this down their throats.” The plan remains a flashpoint for many, with residents from Gilroy and Morgan Hill joining their San Martin neighbors in the comments at the meeting. Booing or clapping occasionally drowned out speakers’ remarks, and signs both for and against the center were fervently waved in the air.

SEEKING NEW MOSQUE From left, sisters Maimona Afzal-Berta, Hanna Afzal and Sana Afzal at July 11 meeting. community members in private meetings. The alliance’s concerns regarding the cemetery’s effect on San Martin residents’ water supplies was echoed by many attendees throughout the meeting. While the EIR shows the center having minimal impact on flooding and the community’s access to groundwater, the report finds the cemetery’s effect on water quality in the area to be “potentially significant.” The report stated, “The potential effect on groundwater is not because of any specific toxicity [human remains] possess, but rather because of the potential for increasing the concentration of naturally occurring organic or inorganic substances to levels that would render the groundwater unfit for potable supplies or other uses.” Despite the alliance’s disapproval, Abass said he felt overwhelmingly optimistic coming away from

the meeting. He believed a majority of the comments made were in support of the center. Abass said the questions regarding the cemetery’s effects on groundwater are a valid public concern, but added that the Islamic center’s motivations to ensure that San Martin groundwater remains uncontaminated are just as great as the other members of the community. “We put in a lot of work to make sure the cemetery has no effect on us or our children,” said Abass. A community questionand-answer session was set for 7pm July 18 at the Advent Lutheran Church, 16870 Murphy Ave., Morgan Hill. Santa Clara County Supervisor Mike Wasserman was not at the July 11 meeting, but said in a statement that he encourages all constituents to take advantage of the comment period. “The community can also attend and comment on this

project at future hearings of the San Martin Planning Advisory Committee, the county planning commission and the Board of Supervisors,” said Wasserman. After the comment period for the draft EIR closes July 30, county planning staff will spend several weeks compiling responses to the comments. Then the project will be considered by the county planning commission and the Board of Supervisors, with further public review opportunities built into the approval processes. Abass hopes those who still have questions will submit them to the commission, come to questionand-answer sessions, or read the 200-page report. “Everything required of us, we delivered,” said Abass. “It’s time for the county to deliver as well.” Questions and comments should be sent to CordobaEIRComments@pln.sccgov.org.

PLEASE ACCEPT OUR APOLOGY

In our June 29th and July 6th publications we printed an ad for the Hollister School District with the incorrect date for an informational meeting to allow the local community to learn about becoming a board member for the school district. It is with our deepest apologies that the Hollister Free Lance made this mistake and fully support the school district and regret any inconvenience this may have caused. At this time, no other meeting has been scheduled, but we will be sure to do our best to inform you when the meeting does occur.

Dabo hasn’t said if he will seek reelection Dabo, 1 period does not begin until the discovery of an offense—instead of when it occurred. Hollister Police Chief David Westrick said this typically begins when an investigation gets a case number, when police investigators believe there is enough evidence to warrant the start of an investigation. Case opened Dec. 12 For Mitchell Dabo, Westrick said that beginning date is Dec. 12, 2017— the date when Hollister police said their investigation officially began. This was nearly a month after documents detailing the transfer by Dabo of money from the Matulich Charitable Trust to his personal accounts had been presented at the civil trial. A 217-page binder containing the evidence gathered by John Clark of Morgan Hill, the foundation’s lawyer, and affirmed by a Superior Court judge at the Nov. 13 civil trial included trust bank statements, canceled checks, emails and court documents detailing the systematic draining of funds from the charitable trust by Dabo. Hooper said in late November 2017 that she would ask a special forensic accountant to look at the civil court evidence and investigate possible crimes by Dabo, a selfdescribed financial planner and tax preparer. Hooper sent the binder to the Hollister police investigators in December, and on Dec. 12, 2017, the police department officially

opened its investigation, Capt. Carlos Reynoso confirmed this month. The binder included copies of canceled checks from the trust signed by Dabo and evidence of electronic transfers from the trust to a Mitchell Dabo Associates bank account. The canceled checks included: numerous checks made out to “cash” and signed by Dabo, in amounts ranging from $2,700 to $21,008; three checks, totaling $490,000, to the late Jack Tyler, a friend and former business associate of Dabo; one check, for $3,000, to Barbara Matulich dated three weeks after she died in March 2012. The money in the Matulich trust had been earmarked for non-profits served by the Community Foundation for San Benito County, which received just $82,110 from the trust. The foundation said in court papers that Dabo had offered no explanation for the missing funds. In November, a week after the civil court judgment, Dabo, in his only public comment in the case, apologized in a signed online statement for what he called “a costly mistake.” He has repeatedly declined requests for interviews.

Foundation: Other victims

Foundation CEO Gary Byrne said earlier this year that several individuals had reached out to him, alleging they were victims of fraud or theft by Dabo,

Youth, senior programs are given high priority Foundation, 1

but he said none had agreed to come forward. Phil Fortino, president of the foundation board of directors, said last year he was hopeful there would be a criminal investigation, and the additional victims would come forward. “There are others who have said they had a similar experience,” he added. Reynoso said last week that no additional possible victims of Dabo had come forward, and that police had not interviewed any. He added that anyone who believes they were the victim of fraud or theft in their dealings with Mitchell Dabo should contact Hollister police. He said the case has been sent back to police by Hooper twice and each time sent back to her office. He declined to say whether or not police had recommended prosecution. San Benito County Superior Court Judge Marjorie L. Carter in November ruled in favor of the foundation in its 2016 suit against Dabo and ordered him to pay the foundation $1.74 million in damages, plus an estimated $85,000 in legal fees. Dabo had told his county school board colleagues in December that he intended to resign, but didn’t say when. There is no record of any discussion of his civil court case or handling of the charitable trust by the school board. Dabo is up for re-election to his District 4 seat. He has not said whether he will seek another term.

OPINION LETTER

Let us support Islamic center

Heroes in our midst

T

his is a story of ordinary events that unexpectedly escalated into extraordinary circumstances, of dangerous situations that were resolved peacefully—events that in other communities have resulted in tragic, even deadly consequences. But not in Hollister. In the late morning on the day after the Fourth of July holiday, a San Benito County Sheriff ’s deputy attempted to stop a vehicle for a traffic violation in the area of East Fourth Street. The deputy activated his emergency lights, but the driver kept driving. The deputy pursued the vehicle through Hollister at slow to moderate speeds, when suddenly in the area of Paseo Drive, just west of Veterans Memorial Park, the driver fired a single gunshot. No one was hit or injured. Several blocks later, the driver stopped his car and fled on foot into the neighborhood. By this point, Hollister police officers had arrived to assist. The first deputy running after the man noticed he was holding a handgun in his right hand. The deputy and officers ordered him to drop the gun and surrender. Facing drawn police guns, he refused, and challenged the officers to shoot. The held their ground, guns drawn. Nearby houses were evacuated. Officers talked to the man, urging him to put the weapon down and give up. At one point during the standoff, one officer fired a “less-than-lethal” beanbag round at the man, but he did not immediately drop his weapon or surrender. Then officers and deputies used their mobile phones to establish communication between the man and a family member, and the family member was able to help officers convince the suspect to drop the gun and surrender. A Sheriff ’s Office press release later would report, with some understatement, that the deputy’s and officers’ “patience and professionalism were paramount to the safe conclusion of this case.”

One day earlier, on the morning of the Fourth of July, Hollister Police Sgt. Michael Paddy was patrolling the area of Vista Hill Park, off Locust Avenue and Hill Court, when he saw a suspicious vehicle occupied by three people who appeared to be sleeping. The vehicle was parked in a handicapped parking space near the park’s playground and displayed no handicap placard. Paddy contacted the person in the driver’s seat. The man was initially uncooperative and said he was a transient with no local address. A routine records check revealed the driver was an Oregon man wanted on suspicion of multiple charges, including rape, rape of a child and other sexual assault charges. He was immediately arrested without incident. A little less than two weeks later, on Monday, Hollister police officers were dispatched to Santa Ana Road to investigate a report of domestic violence. There was a brief high-speed car chase, a pursuit on foot, and a neighborhood search that led to a confrontation in which the suspect kicked a detective. The man was arrested with no further incident. These officers were shot at, led on dangerous cases, kicked, and probably cursed. But they did their job, with no discharge of their weapons and minimal danger to the public. And the accused are in jail. We have all read of these kinds of incidents in other cities that ended in tragedy, where police or suspects were injured or killed. The training and experience, the humanity and maturity, the judgment required of our officers in these situations— and countless others—prevented similar tragedies here. This kind of police work often goes unnoticed and unrecognized. Let’s take a moment to thank our Sheriff ’s deputies and Hollister police officers, and pray for their safety. Make no mistake: There are heroes in our midst.

To the Editor, I write in support of the Cordoba Center project initiated by the South Valley Islamic Community (SVIC) to provide a mosque for worship and related spiritual services, a cemetery, a separate community building for social and educational activities, and a caretaker’s dwelling and a maintenance building. The right to build, buy, or lease a place to assemble for worship is an indispensable part of religious freedom. Religious groups simply cannot exercise their faiths without facilities adequate for their needs. Santa Clara County released the comprehensive draft Environmental Impact Report (EIR) for the Cordoba Center project. A summary of issues raised by commenters during the draft EIR preparation included: adequate access to infrastructure, including sewer and water; increased traffic; local drainage and flooding; effects of the proposed cemetery on groundwater quality; land use compatibility; the combined effects of the proposed project and the proposed Patel RV Park (which is adjacent to the proposed Cordoba Center project site). The draft EIR report concluded that these issues would have “less than significant impact with mitigation.” I reside in Gilroy, am a member of Advent Lutheran Church in Morgan Hill, and am active in the Interfaith Community of South County (ICSC). The nearly 20 faith communities who participate in the ICSC are committed to creating compassionate communities through social, service, and educational programs. The ICSC is open to all faiths and denominations. I expect that the Cordoba Center project will receive the same consideration as proposed building plans from any other religious community. I expect the Cordoba Center project will be evaluated according to existing laws and regulations including the Religious Land Use and Institutionalized Persons Act (RLUIPA) that was passed by Congress to prevent municipalities from using zoning or land-use rules that were “unjustifiably burdensome” on a specific religion. Ed Merrell

FROM THE WEB Re: ‘Plans for $1 billion reservoir advance’ Aside from the cost to ratepayers, there are a lot of impacts from this project that the water district never brings up. The new reservoir will inundate hundreds of acres of valuable oak wood and riparian habitat and native American historic sites. The project will bring lowquality delta water into the Pajaro River system that flows into Monterey Bay. Construction impacts will be intense and last at least 6 years. They will build a quarry on site to mine materials and a cement plant to process the mined materials to build the dam. But a huge amount of materials will also need to be brought in from and disposed of offsite. San Benito and southern Santa Clara counties will be inundated with truck traffic, and any site that receives the waste materials will be overburdened. ,

Re: ‘Letter to the editor: Support for San Martin mosque’ Well written letter and certainly compassionate. San Martin at this time has at least seven places of worship, including the current mosque. I don’t believe the good people of San Martin are opposed to a mosque here, since we In fact, already have one, and none of these facilities of worship established in San Martin are anywhere near the size of this massive Cordoba campus. There are many concerns for a resident of San Martin. We are unincorporated, and at the mercy of the county. We’ve already been polluted and violated by Morgan Hill’s sewage and the Olin Corporation’s perchlorate spill that contaminated our wells and kept us on bottled water for many years. San Martin Neighborhood Alliance and Planning and Advisory Committee have worked tirelessly and intelligently with the county to preserve a rural way of living rapidly disappearing due to greed, and to well meaning but uninformed people who don’t live here. The issues here are these: 1. Groundwater. We are all on wells, and have been violated before, so yes, we’re a little sensitive. 2. Size of the project. What started out as something reasonable and possible has now turned into a large-scale project no longer in keeping with the neighborhood. 3. Misinformation. Very good people have been lambasted in the media for expressing their outrage over having this being dumped on them. What about the neighbors? Does anybody care that people who live here, some of them having been here for generations, care about how this will affect their lives?

Staff report

Representatives of the Associated Student Body, the student government at San Benito High School, had a cumulative 3.53 grade point average during the 2017-18 school term, according to an annual report by SBHS Activities Director Catalina Lemos. Lemos, who gave the presentation June 26 to the SBHS district’s Board of Trustees, noted that there were 51 ASB student officers in the recently completed academic year; 10 were elected and the other 41 were appointed after an interview process. ASB class officers earned a 3.57 GPA, compared to the overall student body GPA of 2.72. The student government organized numerous events throughout the year, including Fall and Winter Homecoming, the ASB Convention, the Fall and Spring Bumpfest, Air Jams, rallies, BLTs (Baler Lunch Time) and other events. The student government also coordinated a benefit drive that resulted more than $23,000 for Brett Mattocks and provided community service and volunteer hours at numerous events in San Benito County, such as Kids at the Park, the San Benito County Fair's Kids’ Day, the Hazel Hawkins Hospital Auxiliary luncheon, the R.O. Hardin Reading Program and set-up and clean-up at graduation, according to the report.

Sober Grad Night celebrates Class of 2018

Nearly 400 members of San Benito High School’s 2018 graduating class attended a volunteer-run and community-supported Sober Grad Night June 8. Nearly 250 of the students stayed the night at the event, which was held in O’Donnell Gymnasium and featured food, games, bounce houses and other activities—all at no charge to students. Organizer Rick Espino called the event

“successful,” as more than $23,000 was raised to support the free event, which is open to all graduates. “We are only able to do this with great support from the community, local businesses, senior parents and the school administration,” Espino said. The graduation committee allows Sober Grad Night organizers to sell 300 premium commencement seats for $25 each, which brings in $7,500. “We also have sponsorship grants from the Monterey Peninsula Foundation, AT&T, the Community Foundation for San Benito County, Pride & Conveyance of Hollister, the Hollister Exchange Club, and more,” added Espino, a Baler girls tennis coach whose children attended SBHS. Local businesses contributed about $6,000 in monetary donations and another $2,000 to $3,000 in donated goods and services. RJR Recycling provided a dumpster, Crown Sanitation provided PortaPotties and wash stations, and Joe Tonascia provided the three light towers used to light up the outdoors, all for free. “We get the perimeter fence from JV Orta at a discount, and the high school allows us the use of the facilities at no charge,” Espino said. “The senior parents support us by buying into a special senior raffle where they donate $25 per entry. This

raffle is separate from the free raffles we do all night and will have less names to draw from.” This year’s raffle brought in $2,225, the highest amount in five years. “We rely on volunteers to make all this work,” Espino added. “Parent volunteers work all night in shifts to provide a fun and safe environment.”

SBHSD seeks substitute teachers

SBHS District is in need of certificated and classified substitutes for the 2018-2019 school year. Certificated substitutes (for teachers) require a 30-day substitute permit or a valid single subject credential. For those who hold a bachelor’s degree and are willing to take the CBEST test, the district can help them obtain their 30-day substitute permit once they have the results of the CBEST. The pay for certificated substitutes is $160 per day or $53.34 per block. The district welcomes retired teachers back as substitutes. Retired teachers earn $175 per day or $58.34 per block. Classified substitutes are also needed, especially special education instructional aides and custodians. Classified substitute pay is based on the classified salary schedule. Anyone interested should contact Dayna Dickison in Human Resources at 831-637-5831 ext. 143.

Fugitive arraigned on murder charge Zendejas, 1

Barry Holtzclaw

commercial airline under guard of Mexican and U.S. federal agents, Westrick said. “This young lady was absolutely innocent,” Westrick said at the press conference, which was attended by Zendejas’ mother, sister and several friends and relatives. The announcement of the arrest came six days before what would have been the victim’s 24th birthday. Westrick said investigators had identified the prime suspect shortly after the shooting, then learned that Barajas had fled to Mexico. Police said in 2014 that Barajas had fired from one vehicle into another, in which Zendejas was a passenger, at B and West streets the night of Aug. 1, 2014. “I’ve had this picture on my desk since the day that we started this investigation,” the chief said, pointing to several large photos of Zendejas to his right. “I’m a father. I’m a parent. I love this community, and we will never forget this young lady, and that’s why the Hollister Police Department has always had this case at the top of our stack.” “Hopefully, today this will start the healing process for Ariana’s family,” he said. The victim’s mother, Marisela Zendejas, spoke in Spanish of her love for her daughter and her loss. Ariana’s younger sister, Camilla Zendejas, a freshman at San Benito High

FOUR-YEAR SEARCH Hollister Police Chief David Westrick announces arrest of suspect in murder of Ariana Zendejas, whose photo is displayed at left. School, and cousin Jesus Ruiz, spoke. “We never gave up hope” that the suspect would be caught, said Ruiz. The family was notified of the arrest a couple hours before the July 13 announcement. Ariana’s father, Jose Angel Zendejas, was at work and could not leave in time to attend the press conference. The family attends Sacred Heart and St. Benedict’s Catholic Church in Hollister.

“Four years ago the life of an innocent victim was lost, we did not forget her,” said FBI Special Agent in Charge John F. Bennett in a July 13 statement. He said the arrest was “the result of tenacious and collaborative work of the FBI and our partners at the Hollister Police Department.” “This case demonstrates that no matter how long it takes, we will find criminals—wherever they may hide—and bring them

to justice,” Bennett said in the statement At the July 13 press conference, Westrick declined to comment on one key aspect of the Zendejas murder case: the role of the victim’s friend, Vanessa Flores-Ibarra, initially identified as kidnapping victim. Was she kidnapped at the time of the killing, was she held against her will for six months, and was she instrumental in locating Barajas in Mexico, leading to his arrest?

Hollister police had said they initially believed that Flores-Ibarra, who disappeared after the shooting, had been kidnapped by Barajas. On Feb. 7, 2015, Flores-Ibarra appeared alone at the U.S.Mexico border at Tijuana, prompting Hollister police at the time to say they were not sure whether she was a victim or accomplice. Flores-Ibarra told immigration authorities that she was a U.S. citizen and had been a missing person. At

the time, Westrick would not discuss what Flores-Ibarra knew about the Zendejas killing, the whereabouts of Barajas or the circumstances of her reappearance, except to say she had been with the suspect in Mexico. At the July 13 press conference in Hollister, Westrick continued to decline to comment on Flores-Ibarra, her status, or her relationship to the case, except to say that it remained under investigation.

Domestic violence suspect arrested Police on July 16 arrested a Hollister man who tried to flee from officers responding to a report of domestic violence, according to authorities. About 11:15am, Hollister Police were dispatched to the 500 block of Santa Ana Road on a report of a domestic violence incident, police said. A caller reported seeing a man in a red Jeep who was attempting to run someone over. The man was later identified as Austin Nye, 23, of Hollister. Officers responded to the area and found the

victim, police said. About 11:25am, a detective found Nye in his vehicle in Main Alley near Santa Ana Road, according to police. The detective identified himself and attempted to stop Nye, who made a u-turn and fled at a high rate of speed. The detective activated his patrol vehicle’s emergency lights and siren, chasing Nye for about 1.5 miles, before parking his vehicle in the 100 block of McCarthy Avenue and fleeing on foot into the residential neighborhood. Hollister Police officers and San

Benito County Sheriff ’s deputies set up a perimeter and began searching for Nye in residential yards, police said. Nye continued to move from backyard to backyard, jumping fences. He forcibly entered several homes and backyards in the area. Nye also kicked a detective while attempting to avoid arrest. Nye was eventually arrested in the area of Maple Street and San Juan Drive, and was booked at San Benito County Jail on suspicion of assault with a deadly weapon; resisting,

delaying and obstructing an officer; assault on a peace officer causing injury; evading while driving a vehicle and other offenses.

Three arrested for gun, drugs

Police arrested three men—two from Hollister and one from Gilroy—after finding a loaded handgun and drugs in their vehicle, according to authorities. About 12:25am July 10, Hollister Police Officer Evan Umstead was on patrol when he was dispatched to a call of a vehicle driving up

and down the street causing a disturbance, reads a July 12 press release. Umstead responded to the area of Ladd Lane and Tres Pinos Road, where he located a car matching the description. The car was occupied by three men. The officer contacted Brandon Olivera, 18, of Hollister, David Werolin, 22, of Hollister, and Kelon Jacobs, 22, of Gilroy. During Umstead’s investigation, he found evidence of possible drug possession. As Umstead continued his investigation, he also found

a loaded handgun and 100 rounds of ammunition, police said. Werolin was booked on suspicion of being a driver allowing a passenger to carry a loaded firearm in a vehicle and possession of a controlled substance, police said. Jacobs was booked on suspicion of possession of a controlled substance. Olivera was booked for allegedly carrying a loaded firearm, carrying a firearm/not being the owner of the firearm and possession of a controlled substance.

ACE PERFORMER Hollister American Majors All Star pitcher Noah Dewey, seen here in the team’s first game against Hollister National in the District 9 Tournament, tossed a complete-game on 84 pitches in a 4-2 win in the championship game on July 8.

relied on great pitching, sound defense, timely hitting and a healthy dose of extra-base hits en route to winning the championship. Most of the kids who were on last year’s 11-year-old team that won district aged up to form the 12s squad, and they played better than ever. “They’re better kids than ball players, and they’re great ball players,” Pieracci said. “We’ve had the same kids since they were 9 year sold, and they lost in the championship to National as 9- and 10-year-olds and won it as 11- and 12-year-olds. Just a great group of kids. They’re unselfish, move the line and do their jobs.” Pieracci pointed to the team’s 6-2 win over Aptos in a Section 5 Tournament elimination game Sunday as proof. “My four subs won the game for us,” he said. With the game tied at 2-2, Lopez and Cruz got on base before Corlis moved them over. Justin Pieracci, the manager’s son, followed with a two-run double to put American ahead for good. Pieracci raved about shortstop Chavez, who can do it all. “He’s probably the best shortstop in Northern California,” Mike Pieracci said. “He is just phenomenal and a coach’s dream. I told him before the season started that it takes 13 guys like him to make it to Williamsport (site of the Little League World Series). His work ethic and ability is phenomenal, and he’s a great pitcher and hitter as well.” In addition to Dewey and Chavez, American received excellent pitching from frontline starters Pasillas and Santos. Centerfielder Ruiz also produced plenty of terrific plays defensively. “Adrian was robbing hitters of base hits left and right,” Pieracci said. National also received

The Hollister American and National 11/12-year-old All Star teams proved to be the best in the District 9 Tournament. Ultimately, American won the winner-take-all game, 4-2, and advanced to the Section 5 Tournament, where it was involved in an elimination game against Gilroy Monday evening (the result was not available when this edition went to press). “I had my ace (Noah Dewey) in the hole, our best guy on the mound, and he did what he was supposed to do,” American manager Mike Pieracci said, referring to Dewey’s 84-pitch complete-game in leading the team to the two-run victory over National in the winner-take-all contest on July 8. “Noah throws the ball hard and has a great curveball.” Said National manager Matt Lewis: “Noah Dewey pitched a great game in the championship and unfortunately our bats weren’t working that day. He kept us off-balanced and there was nothing really we could do about it.” The American roster includes Jacob Antopia, Breyon Chavez, Jonathan Corlis, Jacob Cruz, Dewey, Agustin Gomez, Alex Hernandez, Celso Lopez, Andrew Pasillas, Justin Pieracci, Adrian Ruiz, Diego Santos and Zach Watt. The National roster includes Arnulfo Abonce, Jacob Chapa, Jesus Diaz Jr., Austin Hutchison, William Lewis, Jaden Mingus, Reagan Rivera, Ezra Robinson, Gabriel Torres, Daymien Valencia, Chase Waller, Brayden Watkins

and Stephan Yuste. American went 5-1 in the District 9 Tournament, with the most pivotal game— besides the winner-take-all title matchup, of course—being the winners’ bracket quarterfinal in which it edged National 7-6. That forced National to the bottom bracket, where it had to win a couple of games to earn a rematch with American. One of those was a 15-0 rout of Hartnell, which vaulted National into the championship round. Since American was the tourney’s lone undefeated team, it needed to be beaten twice to lose the championship. National won the first game 7-2 before American prevailed in the winner-take-all contest. In three games between the squads, National scored 15 runs and American 13, a reflection of just how evenly matched the teams were. “(In eight games) we ended up scoring 85 runs and only gave up 17,” Lewis said. “(The first game against American) there were five plays that if any one of them went differently, it’s a whole different ballgame. They made less errors than us and hit the crap out of the ball like they usually do.” In the winner-take-all game, things were scoreless entering the third inning before American took control. Antopia, the No. 9 hitter, fouled off several pitches before hitting a solo home run to score the first run of the contest. “He turned on a fastball and got it out after having two strikes on him,” Pieracci said. Four batters later, cleanup hitter Watts hit a two-run homer to give American a 3-0 lead it would never relinquish. American entered the contest having hit just two home runs in the tournament, with Dewey and Santos being the others. Instead of the long ball, American

standout performances, starting with a powerful three-man starting rotation in pitchers Mingus, Robinson and Abonce. “Arnuflo was our flamethrower, and Jaden throws almost as hard,” Lewis said. “Ezra was more crafty and had more pitches (in his arsenal).” The National manager also noted that Hutchison and Lewis also pitched well. National received strong offensive output from several players, including Watkins, Rivera, Mingus and Robinson. Watkins and Diaz Jr. muscled up to hit two home runs each in district play, and

Mingus, Abonce and Robinson all hit one homer apiece. Valencia also produced in clutch situations, coming through when the team either needed him to get on base, produce a hit or move a runner over. Even though National fell just short, it played superbly and had a strong tourney run. “Playing Hollister American three times and going through it, I hate it at the time,” Lewis said. “My blood pressure goes through the roof. But looking back now, it should be Hollister and Hollister in the championship—that’s the way it should be.”

If you are the highest bidder at the auction, you are or may be responsible for paying off all liens senior to the lien being auctioned off, before you can receive clear title to the property. You are encouraged to investigate the existence, priority, and size of outstanding liens that may exist on this property by contacting the county recorder’s office or a title insurance company, either of which may charge you a fee for this information. If you consult either of these resources, you should be aware that the same lender may hold more than one mortgage or deed of trust on the property. NOTICE TO PROPERTY OWNER: The sale date shown on this notice of sale may be postponed one or more times by the mortgagee, beneficiary, trustee, or a court, pursuant to Section 2924g of the California Civil Code. The law requires that information about trustee sale postponements be made available to you and to the public, as a courtesy to those not present at the sale. NOTICE OF PETITION TO ADMINISTER ESTATE OF Deloris Boone Balochie NO. PR-18-00033 FILED: 7-13-2018. To all heirs, beneficiaries, creditors, contingent creditors, and persons who may otherwise be interested in the will or estate, or both, of: Deloris Boone Balochie. A PETITION FOR PROBATE has been filed by: Eric D. Balochie in the Superior Court of California, County of San Benito. The PETITION FOR PROBATE requests that: Eric D. Balochie be appointed as personal representative to administer the estate of the decedent. The PETITION requests the decedent’s will and codicils, if any, be admitted to probate. The will and any codicils are available for examination in the file kept by the court. The PETITION requests authority to administer the estate under the Independent Administration of Estates Act. (This authority will allow the personal representative to take many actions without obtaining court approval. Before taking certain very important actions, however, the personal representative will be required to give notice to interested persons unless they have waived notice or consented to the proposed action.) The independent administration authority will be granted unless an interested person files an objection to the petition and shows good cause why the court should not grant the authority. A HEARING on the petition will be held in this court as follows: Date: 08-16-2018 Time: 1:30 p.m. Dept: 1, Superior Court of California County of San Benito, 450 Fourth Street, Hollister, California, 95023. IF YOU OBJECT to the granting of the petition, you should appear at the hearing and state your objections or file written objections with the court before the hearing. Your appearance may be in person or by your attorney. IF YOU ARE A CREDITOR or a contingent creditor of the decedent, you must file your claim with the court and mail a copy to the personal representative appointed by the court within the later of either (1) four months from the date of first issuance of letters to a general personal representative, as defined in section 58(b) of the California Probate Code, or (2) 60 days from the date of mailing or personal delivery to you of a notice under section 9052 of the California Probate Code. Other California statutes and legal authority may affect your rights as a creditor. You may want to consult with an attorney knowledgeable in California law. YOU MAY EXAMINE the file kept by the court. If you are a person interested in the estate, you may file with the court a Request for Special Notice (form DE-154) of the filing of an inventory and appraisal of estate assets or of any petition or account as provided in Probate Code section 1250. A Request for Special Notice form is available from the court clerk. Attorney for Petitioner: Robert A. Froehlich, 96 N. Third Street, Suite 500, San Jose, CA 95112, 408.293.0463.
