With the filing period for candidates set to close Aug. 10, voters likely will have choices in all of the races for Hollister City Council and San Benito County Board of Supervisors. As of July 31, several candidates had filed to run for mayor and City Council, with all awaiting certification by the county elections office, primarily to determine citizenship and their legal address. In San Benito County, the top four candidates from the June primaries are facing off, and all were verified as qualified prior to the primary vote. The Hollister City Council has three open four-year seats up for grabs in Districts 2, 3 and 4, plus the two-year term for mayor. In District 2, incumbent Mickie Solorio Luna and contender Rolan Resendiz have filed to run for the council seat. There are three

28, when more than 400 participants gathered for the first Hollister Wild Color Run. The run, a spectacular 5K coordinated by the City of Hollister Recreation Department, was a lively event that began and ended at Technology Parkway

and involved participants being blasted with non-toxic clouds of color along the route. Jen Rodriguez, city special events coordinator, said the the event produced a wonderful community spirit. “The most exciting part of the day was watching

all the colorful participants cross the finish line with huge smiles on their faces,” said Rodriguez. Being the first race of this magnitude in Hollister, Rodriguez said participants are already eager to make this the Wild Color Run an annual affair. “We have received

nothing but wonderful community response Participants have been emailing us about what a great time they had and can’t wait till next year.” The race culminated in an after-party where attendees and their families enjoyed food and entertainment.

A new grading system— one that calls for students to receive three separate marks per class in the categories of academics, citizenship and work habits—will be expanded for

the 2018-19 school year at San Benito High School. It likely will mean more work for teachers, but administrators are hopeful the more complex system will give parents and students a more comprehensive look at student learning. Most ninth- and 10thgrade classes will follow the new grading practices that were piloted in select freshman classes last year,

according to district Educational Services Director Elaine Klauer. Some 11th- and 12thgrade classes will also participate in the 0-4 scale, rather than the traditional F-to-A grading practice, but the focus will be on the freshman and sophomore classes in the second year of the program, according to staff. The purpose “is to provide students and parents

with a snapshot of our students’ academic and citizenship/work habit performance,” Klauer said. Academic grades are based on student proficiency and not by nonacademic factors, such as citizenship and work habits, which will be evaluated separately. “Students will receive three separate marks,” Klauer explained, one for their academic grade, a

second for their citizenship performance and a third for work habit performance. Klauer clarified that all college transcript information will be the same, because students will receive a letter grade at the end of each six-week grading period and a final semester grade in the fall and spring. Santa Clara County this week is offering to buy Saint Louise Regional Hospital in Gilroy and O’Connor Hospital in San Jose for an undisclosed sum, the Gilroy Dispatch and Morgan Hill TImes have learned. “We would be the perfect purchaser, from our perspective,” County Executive Jeff Smith said in an interview Tuesday, July 31. “So we are moving ahead” with the offer to buy the two private nonprofit hospitals in Santa Clara County, he said. “We have been doing our due diligence with the

appropriate consultants to come up with what we think will be a fair offer” to Verity Health System, the nonprofit that owns the two Santa Clara County hospitals and four others in the Bay Area and Southern California, said Smith. “We’ve been trying to keep in touch with Verity group to keep up with their timeline.” Smith said he expected the county’s letter of intent to go to Verity Health Systems by Aug. 3. The letter will include a purchase offer, plus a list of terms and conditions relating to medical services offered by the two acute care hospitals. One condition would be that “we should operate both O’Connor and Saint Louise pretty much as they are operating right now, in terms of the availability of

Police say man used brass knuckles SUSPECT AT CENTER OF HOUSE PARTY DISTURBANCE, POLICE SAY Staff report

Hollister Police arrested a young man July 21 after he allegedly assaulted multiple people with brass knuckles at a house party that grew out of control, according to authorities. About 9:40pm, officers responded to the 200 block of Sundance Drive

on a report of a fight with weapons occurring in the street outside a residence. A large party had started at the home earlier in the evening, according to police. One of the callers who reported the disturbance told authorities that someone at the party had a handgun and was involved in the fight, police said. Hollister Police Officers Miguel Masso and Miguel Martin Del Campo arrived to the scene to find about 100 teens and young adults in the street outside the house party. Witnesses directed Masso to the main suspect,

Wyatt Dennin, 20, according to police. Dennin reportedly took swings at numerous people with brass knuckles in his fist. When confronted by the officers, Dennin discarded the brass knuckles but did not comply with police commands, according to police. While he was being placed under arrest, a hostile crowd gathered around the officers. Additional police arrived for backup, and the officers were able to restore order to the scene. Police later learned the owners of the Sundance Drive home had been out

of town due to a death in the family. Their children, ages 19 and 20, texted a few friends to come over for pool party, police said. Word of the party got out through social media, and people from Monterey, Gilroy, Morgan Hill and Hollister arrived to partake in the festivities, according to police. Dennin, who was a stranger to the youngsters hosting the party, got into a fight with others at the gathering, according to authorities. Dennin allegedly hit several people, and suffered a broken

jaw when he was assaulted during the disturbance. When Masso arrived, Dennin was assaulting one of the victims, according to police. Dennin was arrested on suspicion of assault with a deadly weapon, possession of brass knuckles and obstruction of an officer, police said. The suspect was transported to Hazel Hawkins Hospital for treatment of his broken jaw, and was later transferred to San Jose Regional Hospital for emergency surgery on his face. No other victims or

suspects were identified in relation to the party and disturbance, police said. No gun was found, but a cell phone video from a partygoer showed a photo of a person with Dennin brandishing a handgun. Anyone who was at the Sundance Drive party or who knows someone at the party who has additional video of the suspect with the gun can call Hollister police at 831-636-4330. SBHS measures success in 3 ways New Grading, 1 semester grade in the fall and spring. A GPA, Grade Point Average, for each student will be tabulated based on that. The 0-4 rubric scale is applied to all assignments leading up to the final grade (A-F), Klauer added. The new grading practices at SBHS encompass four main ideas: 1) Students will be provided feedback regarding progress and learning; 2) Students will have multiple opportunities to demonstrate learning; 3) Academic and Citizenship/ Work Habits grades will be graded separately; 4) Students will receive an academic grade on a rubric scale of 0-4 and a Citizenship/Work Habit

grade (O-Outstanding, S-Satisfactory, NINeeds Improvement, U-Unsatisfactory). “Students still have a GPA and all A-F marks are academic grades,” said Klauer, explaining that the other two marks for “Citizenship” and “Work Habits” will be marked O, S, NI or U. “All NI and U marks will also receive a comment regarding how to improve in these areas since citizenship and work habits are critically important in the overall development of our students.” The district hired consultant Tom Hierck, who works with districts on essential standards, assessments and grading practices, to formulate

and implement the new grading system at SBHS. Hierck also most recently authored “Grading For Impact,” which is based on Winneconne High School in Wisconsin. He also consulted two Calif. high schools, including Fontana HS, according to Klauer. “Students will be assessed on content standards and some standards may encompass several targets, while others may encompass very few,” Klauer said. “Learning targets are derived from the standards and become the basis for assessment, instruction, and ultimately the feedback that is communicated to students and families for reporting purposes.”

Ninth- and 10th-grade teachers, who recently attended a two-day workshop on grading practices on campus this month, will not penalize students for late work, but rather provide them with opportunities to get the work done for credit, according to staff. “Research does not show that penalties (such as zeroes in the gradebook) encourage students,” Klauer said. “We do not believe in artificially inflating grades through the use of extra credit. We commit that grades are reflective of student proficiency toward learning standards.” Klauer contends that “extra credit is not needed” in the new system because

The Hollister School District is looking to engage superintendent search

services to help find a permanent replacement for former superintendent Lisa Andrew, who abruptly resigned after only two years with the district. The purpose of the July 27 request for proposal, posted on hesd.org and mailed out to prospective search firms known to the district, is to find a qualified consultant “to provide

assistance with the identification, recruitment and screening of candidates for the position of superintendent of HSD,” it states. The board will select the consultants based on capacity for community engagement; capacity for active/personalized recruitment; experience in California and with school districts with diverse

populations; experience and qualifications of personnel; as well as methodology, references and cost. Prospective companies’ last day for questions is Aug. 7, and deadline for responses is Aug. 10. Initial screening of proposals and selection of finalists will take place Aug. 15. Presentations and interviews are scheduled

for Aug. 21, and board approval of consultant Aug. 28. At a July 6 meeting, the five-member HSD board agreed to a 46-day contract at a $935-per-day rate to hire retired administrator William Barr as the district’s interim superintendent.

Upgrade ‘2-year’ colleges

alifornia’s 114 community colleges are the Rodney Dangerfields of higher education, overshadowed by the state’s four-year universities and not getting much respect. That’s true even though the community colleges’ 2.1 million full- and part-time students represent more than three times the combined enrollments of the University of California and the California State University System. More importantly, low-cost, conveniently located community colleges are the primary gateway into post-high school job training and four-year degrees for those who would otherwise be stuck on the lower rungs of the socioeconomic ladder. Some big changes are coming to the system, some of them from Gov. Jerry Brown, who began his political career a half-century ago as a community college trustee in Los Angeles and will end it this year. Under his prodding, the Legislature has approved a new state-operated online community college that he says will give workers displaced by technology or other circumstances new opportunities to acquire marketable skills. “I want people to be able to open their own imaginations whether they are 15 or 50. Now (students) have a real opportunity to not only learn but to get a certificate and get skills to earn more money, advance and pursue their

dreams,” Brown told the state community college board after signing legislation for the online college. Brown and the Legislature are also overhauling how the colleges are financed, giving them more state aid but conditioning some money on how well colleges are preparing students for jobs or transfer to fouryear institutions. It’s meant to be a carrot to encourage better performances by local colleges, which previously had been given allocations based on enrollment— but it’s also something of an anomaly. The governor has stoutly resisted performance measures for K-12 schools, even for his program of directing more state aid to help poor and “English-learner” students raise their academic skills. He calls that reluctance “subsidiarity,” meaning he’s trusting local education officials to do the right thing, and has rejected pleas of education reformers for more accountability. It’s a little odd that he would reject such accountability for K-12 schools but insist on it for community colleges. Still another Brown-backed change is called “California College Promise.” Participating community colleges may provide financial incentives and guaranteed transfers to four-year colleges for community college students meeting certain criteria. The program also envisions community colleges partnering with K-12 schools to improve college preparation.

Brown, however, is not the only source of change for the community colleges. In July, the state community college board approved an agreement that allows students who have completed required lower-division work in some majors to transfer as juniors to private, nonprofit colleges and universities. While students have sought such transfers in the past, the new agreement provides a more direct pathway for admission. But perhaps the biggest change coming, albeit slowly, to the state’s community colleges is allowing some of them to offer four-year “baccalaureate” degrees in some fields. Nine community colleges awarded 135 such degrees this year under a pilot program, involving such fields as dental hygiene, mortuary science and ranch management. The state Senate has passed a bill to extend the pilot program, but it faces stiff opposition from faculty unions, and the Assembly has killed extension legislation in the past. California has a looming shortage of college-educated workers and if the gap is to be closed, community colleges must be full partners and not merely academic stepchildren. With the Hollister City Council out on vacation in July, further developments in the development of a local cannabis industry have been stalled. When council members return, they likely will hear a request from former Hollister mayor and president of Pinnacle Consulting Victor Gomez that he says will streamline the permitting process for finding building space for the city's emerging cannabis industry. Gomez said he will act on behalf of the holders of cannabis-related licenses to seek an S-type permit, which would allow multiple cannabis businesses to share space. “One of the issues for my clients is finding room for their locations,” Gomez said. “If it’s a commercial kitchen that makes edibles (and) if someone is making brownies and another is making lollipops, and you’re only using the kitchen four hours a

Elections, 1 incumbent, currently finishing a four-year term. There are three potential candidates in District 3: Raul Escareno, Kenneth Johnson and Honor Spencer. Incumbent Councilmember Karsen Klauer, elected in 2014, had not yet filed for reelection as of July 31. Marty Richman and Leila Sadeghian are the potential candidates for District 4. In the District 4 race, incumbent Jerry Muenzer is running against Jim Gillio, current Hollister City Council member for District 4. I think (the Hollister City Council) will be happy to see that.” Cannabis cultivation and manufacturing in unincorporated San Benito County took a step forward when the county’s Board of Supervisors voted unanimously to hire HDL Companies to create a plan for cannabis development and implementation. The agreement, according to the July 24 meeting agenda, cannot be for more than $10,000. HDL Companies is a consulting company for local governments that specializes in cannabis legislation. HDL Companies will also work with the county to develop a cannabis regulation program. “They wanted the tax to pass. Financial problems plague hospitals Saint Louise, 2 large mergers and acquisitions, and a consultant that specializes in operational mergers of health care systems—to develop the offer letter. Currently, the county operates one acute care hospital, Valley Medical Center, plus 10 healthcare clinics around the county. The Santa Clara County offer will be for just two of the six hospitals owned by Verity Health. Verity Health System announced in July that it was “exploring strategic options to alleviate financial and operational pressures on its six hospitals.” Whether Verity will agree to sell off two of its six properties remains to be seen, and could depend on whether there are buyers for the other four hospitals: Seton Medical Center and Seton Seaside in San Mateo County, plus St. Francis and St. Vincent medical centers in Los Angeles. “At this time, a range of

options is being considered, including the potential sale of some or all of the locations, among other possible transactions,” Verity Health said in a July 9 statement. “The top priority of Verity's board and management team is to establish a longterm, sustainable path forward for our hospitals, which are of critical importance to the communities they serve,” said Rich Adcock, CEO of Verity Health. “Pursuant to Verity's strategic plan, we are exploring a number of options to deleverage our balance sheet and address challenges our hospitals face after a decade of deferred maintenance, poor payor contracts, and increasing costs. That's all, folks. It's a wrap for the 40th annual Gilroy Garlic Festival. After the last pepper steak had been served, the final beer poured, and as folks lingered in traffic driving home, all that remained, save for a Monday full of teardown work for volunteers, were memories and garlicky breath. Volunteering is the lifeblood of the Garlic Festival and on Sunday several notable Gilroyans joined nearly 4,000 volunteers working at jobs like pouring beers and serving as festival guides. “It's been great; the crowd is really happy,” Gilroy Councilman Dan Harney said as a band played on the main stage behind him. “My daughter, Frances Harney, won third place in the Junior Cook Off.” A short walk away from the main stage, the Gavilan College football team, with head coach John Lango, sold cups of wine margaritas for $5 to support the football team. “We sold over 1,500 yesterday, and we're hoping to sell 1,000 today and break some records,” Lango said. Over at the wine garden, wine lovers kept cool under

the shade of tents and tree limbs. A gentle cool mist of cooling water from little overhead sprinklers helped to stave off the heat. One Morgan Hill resident far too young for wine, 18-monthold Fiona Azzarello, was held up in the mist by her mom Kelly Azzarello to keep cool. “We didn't hit any traffic; we took Watsonville Road and Santa Teresa,” said Kelly Azzarello. “The wine is the best part for me, but the kids love the kid's area. My son found a bubble machine that made him very happy, and Fiona loves the food.” It's likely that most at the wine garden didn't realize that the smiling, tall gentleman in a tiedyed shirt was Gilroy Police Chief Scot Smithee. Smithee was there selling wine tickets, $9 for a glass or for three samples. “The Garlic Festival is a beautiful event because we have over 100,000 people come from all over, which helps us to show off what we do," Smithee said. “All the people around town who volunteer to make this happen is fantastic." Gilroy was well-represented in the volunteer ranks. Before Don Smith started receiving photo assignments from some of the premier publications in the world, he cut his teeth shooting local sports events for the Hollister Free Lance. “I shot every high school or Little League game, and I didn’t care what was thrown my way,” said Smith, a longtime Hollister resident who recently wrapped up a 27-year career as the San Jose Sharks team photographer. “It was my craft.” Smith has treated his craft like a lifelong project. Along with being gifted with some serious talent, Smith’s indefatigable work ethic and passion are the main reasons why he’s shot for Sports Illustrated, Outdoor Photographer Magazine, Time, Newsweek, US News and World Report, the New York Times, USA Today, and ESPN The Magazine, just to name a few. The 62-year-old Smith credits his passion and zeal for all things photography as key to capturing a shot that makes people’s jaws drop. “It really comes down to hard work,” said Smith, who runs a highly successful landscaping photography business. “I can teach you everything you need to know about the camera, lighting, the composition— all of those things. But what I can’t do is take my passion and put it inside of you. To do well at anything, you have to have a passion that drives you every single day. For whatever reason in the 40 years I’ve been doing this, that passion has never left me. In fact, it probably burns as much as it does today than when I first

picked up the camera. I want to continually get better at what I’m doing.” At an age when most people are slowing down, Smith is in fifth gear, with no letup in sight. In the spring, Smith went through a brutal stretch in which he didn’t take a day off for three consecutive months. Smith spent that period shooting Sharks games and literally traveling the world for his photo landscaping business. Smith teaches 18 landscapebased workshops per year in locations throughout the world. When Smith is not holding a workshop, he’s on a plane scouting out destinations for the locations of his future workshops (past workshop locations include New Zealand, Namibia and Patagonia, just to name a few). A bunch of his work has been displayed in calendars, greeting cards and worldwide in the Getty Museums of Art. Although landscape photography is Smith’s current and future business, he will always have a soft spot in his heart for sports. After all, in addition to being the Sharks team photographer, Smith spent 20-plus years shooting NFL and MLB games. “I grew up a sports nut because my dad was a sports nut,” Smith said. “I played baseball, but the sport I really wanted to excel at was skiing.” Smith had a goal to make the U.S. Winter Olympics team, but chronic knee issues helped derail those plans. After working for a year as a ski race coach at Dodge Ridge, Smith returned to San Jose State to earn his journalism degree. That’s when a conversation with his parents and his academic advisor, Joe Swann, led him to a life-altering decision. “He (Swann) called me into his office one day and told me you either become a writer or a photographer,” Smith said.

The third of seven children, Molly grew up mostly in Sunnyvale, where she attended Peterson High School from 1973-1977. She then studied Business at San Jose State University, where she met her future husband, Donald (Don) Edgar. She worked in Silicon Valley while she and Don established themselves in Morgan Hill, where they lived for their 36 years of marriage. They have two sons, Matthew and Joseph. Molly was very active in Morgan Hill public schools, first as a parent volunteer and then in the office at Martin Murphy Middle School and as secretary to the principal at Sobrato High School, where she was much loved and appreciated. She was also very dedicated to her disabled younger brother, Brendan. She was a member of St. Catherine’s Church and offered her beautiful voice in the choir. Her faith gave her great comfort at the end of her life. Molly was preceded in death by her mother Emily Francis O’Hare (1932-1970) and father Eugene O’Hare (1931-2017). She is survived by her beloved husband Don, sons Matt (Kaya) and Joey, granddaughter Arya (mother Felicia Ortiz), stepmother Carol O’Hare, siblings Kathleen Hallam (Jim), John O’Hare (Sharon), Brendan O’Hare, Eileen Skinner (Johnnie), Martin O’Hare (Cindy VanSickle), Tim O’Hare (Amy Tennant), and stepbrother Chandako Bhikkhu, as well as numerous other family members. Molly was widely and much loved and will be dearly missed. Gifts in Molly’s memory may be made to the Lustgarten Foundation for Pancreatic Cancer Research, St Catherine’s Church Memorial Building Fund, or Elwyn California. A memorial service will be held on August 9, 2018, 11:00am at St Catherine’s Church, Morgan Hill, with a reception following at the Morgan Hill Cellars.

He was in the Military Intelligence Service that received the Congressional Gold Medal of Honor. Private services were held on July 20, 2018 at Oak Hill Memorial Park, with Taps and a New Orleans style of send-off.

942 HOL - Public Notice COUNTY COUNSEL’S SUMMARY OF ORDINANCE NO. 2018 01 ADOPTED ON JULY 19, 2018BY THE COUNCIL OF SAN BENITO COUNTY GOVERNMENTS THE “ROADS, TRANSPORTATION SAFETY AND INVESTMENT PLAN TRANSACTIONS AND USE TAX ORDINANCE”, IMPOSING A RETAIL TRANSACTIONS AND USE TAX TO BE ADMINISTERED BY THE CALIFORNIA DEPARTMENT OF TAX AND FEE ADMINISTRATION, AND ADOPTING A TRANSPORTATION EXPENDITURE PLAN, THE “SAN BENITO COUNTY TRANSPORTATION SAFETY AND INVESTMENT PLAN” The Council of San Benito County Governments (COG) adopted Ordinance No. 2018 01, entitled “AN ORDINANCE OF THE COUNCIL OF SAN BENITO COUNTY GOVERNMENTS, THE “ROADS, TRANSPORTATION SAFETY AND INVESTMENT PLAN TRANSACTIONS AND USE TAX ORDINANCE”, IMPOSING A RETAIL TRANSACTIONS AND USE TAX TO BE ADMINISTERED BY THE CALIFORNIA DEPARTMENT OF TAX AND FEE ADMINISTRATION, AND ADOPTING A TRANSPORTATION EXPENDITURE PLAN, THE “SAN BENITO COUNTY TRANSPORTATION SAFETY AND INVESTMENT PLAN” at its regularly scheduled meeting of July 19, 2018 at 3:00 p.m., by the following vote: Ayes: Director(s): Chair De La Cruz, Boch, Botelho, Gillio Noes: Director(s): Absent: Director(s): Velazquez Abstaining: Director(s): A complete, certified copy of Ordinance No. 2018-01 is on file in the Office of the Clerk of the Council of San Benito County Governments, located at 330 Tres Pinos Road, C 7, Hollister, California, and shall be available for public inspection and review during normal business hours at that location. Pursuant to the authority of the June 21, 2018 order of the COG Board of Directors and Government Code section 25124, Ordinance No. 2018-01 is of such a length and content that a complete copy of Ordinance No. 2018-01 would not be practical to publish in the official newspaper. Accordingly, a summary has been prepared as follows. SUMMARY OF ORDINANCE NO. 2018 01 Ordinance No. 2018 01 will be applicable in the incorporated and unincorporated territory of San Benito County, and provides for: A. the adoption of a transportation expenditure plan that has been approved by all affected jurisdictions, referred to as the “San Benito County Transportation Safety and Investment Plan”, to: 1. repair potholes; 2. improve and maintain local roads; 3. widen Highway 25 to relieve traffic congestion and improve safety; 4. improve pedestrian and bicycle safety; 5. provide mobility, bus, and paratransit services for seniors, people with disabilities, and youth; and 6. qualify for state and federal matching funds; B. the imposition of a retail transactions and use tax of one percent (1%) over a period of thirty (30) years; C. the authority to issue bonds secured by such taxes; D. the authority to receive short-term or long-term loans secured by such taxes; E. the COG’s authority to administer tax proceeds; and F. the establishment of a citizens’ oversight committee, with the requirement to conduct annual independent audits. Since Measure ___ is for a specific use and not a general tax, a 2/3 majority vote of the electors voting on the measure is required for passage. Measure __ is not similar to a gas tax that is shared throughout the State of California. It is a local retail transactions and use (sales) tax whereby all revenues plus interest generated shall be distributed as required by the Transportation Safety and Investment Plan (Exhibit B), only for road, transportation and transit projects, only in San Benito County. More specifically, Ordinance No. 2018 01 includes the following Sections: - SECTION 1 (Title) shall be known as the Council of San Benito County Governments “Roads, Transportation Safety and Investment Plan Transactions and Use Tax Ordinance.” - SECTION 2 (Summary) provides a summary of Ordinance No. 2018-01, as set forth above. - SECTION 3 (Administration Of Plan) provides that the COG shall impose the Roads, Transportation Safety and Investment Plan Transactions and Use Tax, enter into an agreement with the Department of Tax and Fee Administration to collect the funds, and that it shall allocate the tax revenues and administer the Transportation Safety and Investment Plan, consistently with Chapter 5 (commencing with Section 180200) of Division 19 of the California Public Utilities Code, and with Part 1.6 (commencing with Section 7251) of Division 2 of the California Revenue and Taxation Code. - SECTION 4 (Administrative Costs) provides for annual administrative costs to administer Ordinance No. 2018-01 and the Transportation Safety and Investment Plan, not to exceed one percent (1%) of the Measure ___ revenue generated in that year, excluding the California Department of Tax and Fee Administration’s administrative costs, and that the COG shall expend only that amount of the funds generated for staff support, audits, annual reports and other administrative expenses and contract services that are necessary and reasonable to carry out its responsibilities pursuant to Division 2 of the Revenue and Taxation Code. - SECTION 5 (Definitions) defines certain terms used throughout Ordinance No. 2018 01. - SECTION 6 (Purpose) sets forth the purposes of Ordinance No. 2018-01 and directs that provisions of Ordinance No. 2018-01 be interpreted in order to accomplish those purposes: - SECTION 7 (Identification Of Tax And Statement Of Facts On How Tax Revenue Can Be Spent) requires that the revenue from the Roads, Transportation Safety and Investment Plan Transactions and Use Tax will be spent only to implement specific projects and programs specifically set forth in the Transportation Safety and Investment Plan, summarized as follows: A. Widen Highway 25: Relieve Traffic and Improve Safety: revenues shall fund an Environmental study, design and construction of the Highway 25 4-Lane Expressway Project, building a new 4-lane highway between Hollister and Santa Clara County. Local funds will be used to match with State (Local Partnership Program and State Transportation Improvement Program) and Federal funds as well as local Traffic Impact Mitigation Fees. The COG and its local jurisdictions will work closely with the California Department of Transportation and the California Transportation Commission to maximize the State contributions to project development and funding the project. In addition, local developers will be required to pay their “fair share” for project impacts of new housing and retail development on the highway, which is identified as 40% of the total cost. B. Local Street and Road Repair, Maintenance and Rehabilitation, and Improvements: Improve Safety & Traffic Flow: Funding will be provided to the local jurisdictions, based on a formula of 47.5% to San Benito County, 47.5% to the City of Hollister, and 5% to the City of San Juan Bautista. Funds will be distributed annually by COG and local jurisdictions will implement based on their adopted Pavement Management Plans. Local funds will be used to match with state gas tax funds already provided to the local jurisdictions. C. Other Categories: Funding will be provided for the following: 1. Mobility, bus, and paratransit services for seniors, people with disabilities, and youth as described in the Regional Transportation Plan for the community. 2. Projects that Enhance Pedestrian and Bicycle Safety, including implementation of Safe Routes to School projects and projects identified in the Countywide Bicycle, Pedestrian Master Plan, and Regional Transportation Plan. 3. Projects that enhance safety and improve traffic flow on local roadways, including operational improvements, traffic calming, and “complete streets” measures. 4. Administration (capped at one percent (1%)) 5. Future Planning & Contingency - SECTION 8 (Election) provides that the San Benito County Board of Supervisors be requested to call an election for voter approval of the measure at the November 6, 2018 election, with the sample ballot to include the full proposition as set forth in Ordinance No. 2018-01, and the voter information handbook to include the Transportation Safety and Investment Plan, with approval of the measure and imposition of the Roads, Transportation Safety and Investment Plan Transactions and Use Tax, to require the vote of a two-thirds (2/3) majority of the electors voting on the measure at that election. - SECTION 9 (Annual Report) provides for the preparation of an annual report setting forth (a) the amount of funds collected and expended pursuant to Ordinance No. 2018 01 and (b) the status of any projects authorized to be funded in the Investment Plan. - SECTION 10 (Citizens’ Oversight Committee: The Measure __ Transportation Safety And Investment Plan Oversight Committee) provides that prior to expenditure of any funds collected, COG’s Board of Directors shall establish and convene a citizens’ oversight committee, with members who shall be residents of the City of Hollister, the City of San Juan Bautista, and the unincorporated areas of San Benito County, who are neither elected officials of any government, nor employees from any agency or organization that either oversees or benefits from the proceeds of the tax revenues, to be appointed by the COG’s Board of Directors to fairly represent the geographical, social, cultural and economic diversity of the County to ensure maximum benefit for road and transportation users, and that the oversight committee shall be responsible for the following: A. Independent Audits: The oversight committee shall have full access to COG’s independent auditor and review the annual audits, have the authority to request and review the specific financial information, and provide input on the audit to assure the funds are being expended in accordance with the Transportation Safety and Investment Plan; B. Plan Changes: The oversight committee shall review and make recommendations on any proposed changes to the Transportation Safety and Investment Plan, prior to COG’s consideration, subject to 2/3 vote of the voting oversight committee members; C. Project Delivery and Priorities: The oversight committee shall review and comment on the project delivery schedules and make recommendations to the COG on any proposals for changing project delivery priorities; and D. Annual and Final Reports: The oversight committee shall prepare annual reports regarding the administration of the program, to be presented to the COG’s Board of Directors and posted to the COG’s website. - SECTION 11 (Amendments To The Transportation Safety And Investment Plan) provides that COG may annually review and propose amendments to the Transportation Safety and Investment Plan to provide for the use of additional Federal, State and local funds, to account for unexpected revenues, or to take into consideration unforeseen circumstances, only for projects that are included in the adopted 2040 San Benito County Regional Transportation Plan at the time the amendment is proposed and/or by the priorities established in the Transportation Safety and Investment Plan, and only in accordance with the following process set forth in Section 180207 of the Public Utilities Code: (1) COG shall recite findings of necessity to initiate amendments; (2) COG shall provide notice and a copy of the proposed amendments to the County Board of Supervisors and the City Councils of the Cities of Hollister and San Juan Bautista; and (3) the proposed amendments shall become effective 45 days after notice is given. - SECTION 12 (Pavement Management Program Requirements) provides that each jurisdiction shall adopt a pavement management program, that they shall rely on their pavement management programs to identify priority projects for construction during the time the Roads, Transportation Safety and Investment Plan Transactions and Use Tax is in effect, and shall submit regular reports on the conditions of their streets and roads, to ensure timely repairs and to keep the public informed. This section also provides that, if deemed necessary by COG, a pavement management program adopted by the COG will be eligible to be funded prior to distribution of funds to the cities or county. - SECTION 13 (Impact Fee Requirements) provides that each jurisdiction shall maintain participation in the Regional Traffic Impact Mitigation Fee program and shall impose the adopted fees on new development as applicable, to ensure new development pays for its impacts on the regional transportation system. - SECTION 14 (Tax Sharing Agreements) provides that each jurisdiction shall enter into tax sharing agreements with COG that will include enforcement procedures, designed to reassure the public that tax revenues are spent in accordance with the ballot language. - SECTION 15 (Establishment Of Bonding Authority) provides authority to issue bonds to finance capital outlay expenditures as may be provided for in the Transportation Safety and Investment Plan, payable from the proceeds of the Roads, Transportation Safety and Investment Plan Transactions and Use Tax. - SECTION 16 (Maintenance Of Effort) provides that additional funds provided to each jurisdiction by Measure ___ are intended to supplement other existing funds, revenues and other resources being used for street and highway purposes, including but not limited to federal and state funding, the collection of traffic impact mitigation fees, other local impact fees, and dedications of property, and that each jurisdiction shall maintain their existing commitment of local transportation-related funds for transportation purposes. - SECTION 17 (Creation Of Special Fund) provides that all tax revenue, plus interest, will be deposited in a special fund for Measure ___ projects, to be administered by COG pursuant to Ordinance No. 2018-01 and to the provisions of Division 19 (commencing with Section 180000) of the California Public Utilities Code, and Part 1.6 (commencing with Section 7251) of Division 2 of the California Revenue and Taxation Code, with any interest generated to be treated as Measure ___ Revenue for the purpose of using the interest for Measure ___ projects. - SECTION 18 (Contract With State) provides that COG shall contract with the California Department of Tax and Fee Administration to perform all functions incident to the administration and operation of this Roads, Transportation Safety and Investment Plan Transactions and Use Tax Ordinance. - SECTION 19 (Transactions Tax Rate) provides that a tax will be imposed upon all retailers in the incorporated and unincorporated territory of the County of San Benito at the rate of one percent (1%) of the gross receipts of any retailer from the sale of all tangible personal property sold at retail. - SECTION 20 (Place Of Sale) provides guidelines for determining the place of sale for all retail sales. - SECTION 21 (Use Tax Rate) provides that an excise tax will be imposed on the storage, use or other consumption in the County of San Benito of tangible personal property purchased from any retailer for storage, use or other consumption in said territory at the rate of one percent (1%) of the sales price of the property. - SECTION 22 (Adoption Of Provisions Of State Law), SECTION 23 (Limitations On Adoption Of State Law And Collection Of Use Taxes) and SECTION 25 (Exemptions And Exclusions) incorporate the provisions of Part 1 (commencing with Section 6001) of Division 2 of the Revenue and Taxation Code, with certain exceptions, exemptions, exclusions and limitations set forth in those sections. - SECTION 24 (Permit Not Required) provides that if a seller’s permit has been issued to a retailer under Section 6067 of the Revenue and Taxation Code, an additional transactor’s permit shall not be required. - SECTION 26 (Amendments To The Ordinance) provides that amendments to provisions of state law that are incorporated by reference into Ordinance No. 2018-01 shall automatically become a part of Ordinance No. 2018-01, except that no such amendment shall affect the rate of tax imposed, and that other amendments to Ordinance No. 2018-01 shall require a two-thirds (2/3) vote of the total membership of COG, plus the subsequent approval of a two-thirds (2/3) majority of the electors voting on such change submitted for a vote at a special election called for that purpose by the Board of Supervisors. -
