The Hollister City Council unanimously approved a new three-year contract with the city’s firefighters earlier this month. The contract with the Local 3395 union provides members with a 4 percent raise for each of the first two years, and a 5 percent raise for the third contract year, which starts July 1, 2021. The five-member council unanimously approved the contract at its Aug. 6 meeting. The contract is retroactive to July 1, 2018. In addition to the annual pay raises, the new contract and memorandum of understanding also spell out other reimbursement and employment conditions for local firefighters. These include uniform and equipment allowances, overtime stipulations, CalPERS contributions, vacation, leave, health and other benefits and provisions. Starting June 30, 2021, the new contract will offer Hollister’s firefighters “longevity pay” for union members who reach specific levels of seniority. This pay starts at 3 percent of the base salary for those who have worked for Hollister Fire Department for 10 to 14 consecutive years, and goes up to 9 percent for those who have worked for the local department for 20-plus years, according to the ➝ Fire Contract, 5

Vaquero Heritage Days featured historians of the era, as well as artisans and craftspeople offering a wide range of goods manufactured with a reverence for the old ways— silversmiths, saddle makers, rawhide braiders, bootmakers, leather artisans and more. The event also included a number of demonstrations of techniques in horsemanship in the vaquero style, along with live music, food, art and informational booths.

The tomato harvest is in full swing in the Central Valley, and locally in San Benito County, and it promises to be bountiful, in more ways than one. The California Farm
Bureau reported this month that California tomato producers expect to have contracts for 11.9 million tons of the red fruit (yes, tomatoes are technically a fruit), up from 10.4 million last year. In 2016, processors—including San Benito Foods, a Neil Jones Food Company, in Hollister—skinned, chopped, processed and canned 12.5 million tons of tomatoes. One tomato farmer, Mitchell Yerxa of
Williams, Calif., told the Farm Bureau’s Ag Alert that “early cool weather was great weather for setting that fruit.” The harvest is expected to wrap up this week across the state. Producers were predicting yields of more than 52 tons of tomatoes per acre, up from 50 tons per acre a year ago. That means that machinery and employment is set to pick up, hitting an annual peak of several hundred workers,
at the tomato processing plants along Sally Street in Hollister. Six canneries last week agreet to pay a higher price, $75.50 per ton, for this year’s tomato crop, and negotiations were continued this week with another five processors, according to the Farm Bureau report. San Benito County ranks just 13th among California counties — led by Fresno County— that generate more than $1.3 billion in tomato
production. California canneries produce about 90 percent of all tomato products in the country. In Hollister, San Benito Foods is one of the small city’s biggest employers during its peak summer processing season. The higher costs for processors, while good news for farmers, could mean higher prices for canned tomato products in grocery stores next year. ➝ Tomatoes, 2

Council unanimously approves fees place in 2004, setting a base for all fees and a price index. Following the new study, the price index will be used annually to adjust fee costs. Solorio Luna said she didn’t want to wait another 14 years for the next time the fees were analyzed. “If we can do this every so often, that would be great,” said Solorio Luna. Candidate for City Council District 4, Marty Richman, commented on the fees at the meeting. He asked the council to look at how fee costs could potentially be lowered as opposed to adjusting costs to the new cost of service. He said, “I’m very concerned that public agencies, because it’s
good times, are just passing things along.” City Manager, William Avera, said fees had typically been increased using the price index annually on the first of June. The San Benito County Board of Supervisors is set to approve similar fee adjustments with a Schedule of Fees being voted on at an Aug. 21 meeting. The City of Hollister will be charging higher fees for a wide range of services following an Aug. 20 unanimous vote by the City Council. The fees applied to four departments; the city Recreation Division, Fire Department, Police Department and Development Services Department. Many classes through

A fee is not a tax that is paid by each city resident, it is only paid to fund the service used on an individual basis. The department’s fees have been regularly adjusted with a predetermined consumer price index. However, the departments recently completed a comprehensive study to analyze adjustments that needed to be made to make up the money spent to provide each service. The last study took

the recreation department will see a small fee raise, for example, a hula class that used to be $65 for Hollister residents, will now be $70 to anyone in San Benito County. The Fire Department will now charge a fee of $161 for fire extinguisher training, when before the instruction was free. Police reports and traffic collision reports used to be free through the Hollister police department, but will now cost $10. The Development Services Department deals with things like housing, building and planning in Hollister. A one time transportation permit through development services will be raised from $16 to $25 and

n the face of a tariff war that is already hurting U.S. farmers and ranchers, the American Farm Bureau Federation—despite its solid Republican roots—has gone on the offensive against the Trump Administration, offering to assist farmers and ranchers in advocacy efforts on trade during the August congressional recess. The message from the national and California Farm Bureau is simple: “The current trade uncertainty”—also known as Trump’s Tariff War—needs to end soon. The Farm Bureau points out that “foreign demand for U.S. farm goods plays a huge role in farm income.” “Thanks to trade agreements that have reduced barriers to our exports, U.S. farmers and ranchers export more (by value) than farmers in any other country,” the Farm Bureau tool kit emphasizes. “In fact, the U.S. has a trade surplus in agriculture.” President Trump’s imposition of tariffs on $79 billion of goods and services and proposed additional tariffs on $702 billion of other foreign products, instead of forcing resolution of longstanding trade imbalances, has prompted retaliatory tariffs on billions of dollars’ worth of U.S. farm products, including many here in San Benito County and the rest of the state. Fruit faces an additional 25-40 percent tariff in China and a 20 percent tariff in Mexico. Tree nuts face an additional 2540 percent tariff in China. Wine faces an additional 15 percent tariff in China. Soybeans, cotton, corn, wheat, beef, sorghum and other agricultural products face an additional 25 percent tariff in China. Cheeses face an additional 25 percent tariff in China and a 20-25 percent tariff in Mexico. Since the tariffs have gone into effect, the Farm Bureau reports that prices for some U.S. farm goods have gone down. For example, the
Farm Bureau reported that the new crop corn price in July fell 17 percent from its mid-May season high, the new crop soybean price fell 20 percent and Kansas Hard Red Winter wheat fell nearly 16 percent.
A trade war threatens an area where the U.S. until this year had a trade surplus. Fruit, nut and vegetable growers are seeing similar impacts. Almond exports in June were reported down from May, including to China (down 48 percent), Western Europe (down 18 percent) and the Middle East (down 26 percent). Milk and dairy product prices fell more than 10 percent in June. Going back to the beginning of 2018, lean hog and live cattle futures have lost 8 to 10 percent of their value “due to increased trade uncertainty,” representing “billions of dollars in farm cash receipts,” the Farm Bureau reported. Sadly, hurting agricultural exports by engaging in a trade war threatens an area where the U.S. until this year had a trade surplus. We agree with the main message of the Farm Bureau Federation’s August outreach effort, that Congress needs to act immediately to limit the damage to farm prices and farm families’ income by blocking plans for any further tariffs that would only invite more retaliation against U.S. farm exports. Answer: I grew up in the Santa Cruz area in a family that fostered a culture of serving others. Ultimately, it was my love for people combined with my passion for justice that led me to pursue a career in law enforcement. I recently celebrated my 30th year of service in law enforcement and will be soon celebrating my 30th wedding anniversary. My wife and I moved to Hollister to raise our children in this amazing, family-oriented community, and that decision has proven to be one of the best decisions we’ve ever made. Our children share a proud heritage with this community. We recently became grandparents, which has brought us tremendous joy. San Benito is a great community with so much to do. It is home to great motorcycling, a classic car community, plenty of opportunity for amateur musicians, a strong “foodie” culture and great neighbors. We are proud to call San Benito home.
What are some of the big plans you have for the sheriff's department and public safety in San Benito County over the next four years? We have so much to be proud of, but there is still a lot of work to be done. I look forward to bringing our office’s initiatives to
fruition in my third term. During my first term, our office and community was tested by layoffs and budget cuts. We persevered through those tough times. My second term was a reset, an opportunity to rebuild. We reorganized the rank structure into three divisions, providing a greater level of supervision, communication and staff development. We introduced a new records management system that shares information with our jail, our patrol teams and the Hollister Police Department. In our third term, we hope to sow some seeds for the future. The average age of the members of our agency indicates a large departure into retirement in the next three to six years. We need to hire and develop staff of all classifications to prepare for the future. This will not be easy, as the candidate pool is numerically very small compared to previous generations. But I am confident we can meet any challenge.
What are some of the biggest public safety challenges facing the sheriff's office and communities in San Benito County? Any particular types of calls or emergencies that have become increasingly common in the last four years? Law enforcement is evolving across California and the nation. Twenty years ago, our largest public safety concern was gang-related crimes. Voters and legislators in California implemented some very tough prison sentences for gang crimes and were able to address some of the circumstances that discouraged witnesses from participating in the criminal justice process. Collectively, these two dynamics resulted in a reduction of
gang crimes. Conversely, it created overcrowding in our state prisons. The current political spotlight on immigration issues may cause some immigrants a bit of reluctance to come forward as cooperative witnesses in gang crimes. Combine that with California’s commitment to reduce incarceration, and California could see an uptick in crimes committed by organized criminal enterprise.
Have Prop 47, Prop 57, AB109 and other state provisions intended to keep lowlevel offenders out of the prison system impacted public safety in San Benito County? If so, how? Some impacts of these new laws and policies have been positive, and others a bit over-reaching. Incarceration is not very effective when it comes to rehabilitating people, but it’s very effective at protecting the public from continued victimization. Understanding that most offenders return to freedom, California has placed an emphasis on rehabilitation, hoping to reduce recidivism. There have been some unintended consequences. Low-level offenders were pushed from state prisons back to county jails. Now county jails have pushed them out to make room for habitual and higher-level offenders. Lowlevel offenders no longer have the threat of incarceration as an incentive to overcome their addictions and modify their behaviors. We are relatively early in this development, so we have yet to get meaningful evaluation data. Sheriff's deputies and jail staff have recently started wearing body cameras on patrol and in the jails. Any examples of how these tools have aided the prosecution of a crime or corroborated a deputy's account of an incident?
What is the sheriff's office policy on releasing body camera footage to the public?
Society is pushing hard in two conflicting directions. There is a call for more transparency, and simultaneously a call for more privacy! This creates a no win situation for body camera footage. Conversely, we in law enforcement are anxious to clear our own reputations when our actions are scrutinized. From a safety perspective, the release of footage can have other damaging impacts like tainting potential jurors or jeopardizing the safety of witnesses. These dynamics and other factors will be considered as we evaluate whether to release footage. At this time our final policy is

Radios. The topography of this county makes radio communications difficult. However, in recent years, and in an ongoing effort, our radio infrastructure has been, and will continue to be upgraded. We are working toward a modern, networked radio infrastructure that truly is the lifeline for our deputies and those in need. Staffing. Attracting qualified candidates is a problem in this field, and in this area. We are in competition with surrounding agencies that have more attractive employment packages than we can offer. Training. Funding training is a problem many law enforcement agencies have. Apart from the “mandated” training, it has become increasingly difficult to send staff away for more detailed, in-depth training off-site. This “advanced-officer”
training is essential to having a more well-educated and professional agency. No agency should ever strive to meet the minimum standard.
How have mental health issues and homelessness impacted the sheriff's office and the community's safety in recent years? Have these issues grown in the last four years?
In 2011 we arrested a homeless man for the murder of another homeless man at an impromptu unauthorized encampment. In 2012 and again in 2013, in separate events, mentally ill offenders murdered their mothers and dumped their bodies here in San Benito. Mental health issues and homelessness can certainly have a nexus, but they can also be very independent topics. Some of our homeless are just down on their luck, and others are overwhelmed with mental health issues. Statistically, if they offend, both tend to be low-level offenders. As I mentioned, low-level offenders have been pushed out of

We recently had an armed robbery in Tres Pinos at the Tres Pinos Country Store. A clerk was robbed at gunpoint. The responding deputies were able to get surveillance footage in the area. One deputy recognized the man as the same person he had stopped in a vehicle the week prior. He was able to go to his bodycam footage and produce an image of the man from that stop. This image was then used to identify the man who was later arrested and confessed. On July 5, our deputies were involved in the pursuit of an armed suspect. Though this incident was resolved without anybody being hurt, it was a great test of our system to see just how well it can capture these life-changing moments. An audit
of the system showed it worked very well, and, had the incident ended tragically, the evidence would have been captured. Many of our interactions occur away from the patrol vehicle, even if they begin there. The pursuit case was a prime example of that. Our office now has the capability to capture these incidents.

Homeless people and those with mental/behavioral illness are “self-medicating” with drugs and alcohol at a very high rate. The most recent census indicates there are
approximately 527 homeless in the county, down 124 people from last year. Although this is a positive trend, the percentage of homeless who fail to cooperatively participate in available resources is sharply increasing. Of the 527, it is estimated more than 200 are not responding to services that are offered. This is a dynamic seen statewide.

High Speed Rail to set plan in 2019 MH RESIDENTS WILL BE NOTIFIED ABOUT PROPERTY AFTER PLAN SELECTION Reporter
In 2017, Shirley Higdon and her neighbor Diane Holmes realized the High Speed Rail train that had been endorsed by Californians a decade earlier might be running right through their quiet street close to U.S. 101. The two women, along with a small group of neighbors, took to Facebook and began organizing a larger coalition of Morgan Hill residents that opposed the state’s bullet train project. They called their group, “Stop HSR in

its tracks—Morgan Hill.” A plan to run the High Speed Rail parallel to U.S. 101 is one of three alternatives proposed for the “San Jose to Merced project section.” The High Speed Rail Authority told Morgan Hill residents last week that it plans to select a final route for this section of the project and begin identifying property to acquire for right-of-way in Morgan Hill late next year. California Regional Director Boris Lipkin identified three alternatives for the section of the rail line through Morgan Hill that will be part of an 84-mile line connecting San Jose and Merced. Lipkin explained that as the alternatives continue to be explored and a partnership with Union Pacific is worked out, plans for all three routes

oanne Peixoto Lynch, 63, of Watsonville, passed away on Sunday, August 5, 2018 at Stanford Hospital after a 103 day hospitalization fighting a battle against myelofibrosis. She passed in the company of loved ones with her beloved husband, children and her newest grandchild by her side.
Joanne was born to Francis “Pex” and Sadie Peixoto on April 15, 1955. She went to Morello High School and graduated in 1973. She married Chris Lynch on July 17, 1987 and together they raised their children in Watsonville. Joanne dedicated nearly 30 years of her life to working for her brother at Dick Peixoto Company, which has since evolved into Lakeside Organic Gardens. Joanne loved traveling, learning about family history and living on the property her parents began building together in 1957. Nothing made her happier than her three grandchildren. CDR Leonard Delbert (“Del”) Byler, age 99, resident of Hollister, CA. Born March 5, 1919 in Garden City, Kansas to Leonard Ray Byler and Ruth Weaver Byler. Peacefully entered into rest on Saturday 8/18/18, surrounded by his loving family.
Del proudly served the United States Navy as a Top Gun nightfighter pilot in World War II and the Korean War, flying Hellcats, Banshees, and Bearcats off of the U.S.S. Enterprise, Saratoga, Oriskany, and Essex straight-deck carriers. After 21 years of exemplary active service and Reserves, he retired as a Lieutenant Commander. After the military, his primary career was as a successful Estate Planner selling Life, Health, and Disability insurance. Del was preceded in death by the love of his life, Jeanne (in 2005), after celebrating 60 wonderful years of marriage. Del is survived by six children: Diana Hudkins (Jack), Jan Templeton, Jeff (Martina), Kevin (Karen), Jon (Suzan), Debbie Sowle; eleven grandchildren: Stephanie, Matthew, Michael, Debra, Joseph, Amanda, Morgan, Jordan, Hayley, Bryce, Allison; and sixteen great-grandchildren. He is also survived by his beloved sister, Dorothy Smith. Del enjoyed family, golfing, travelling, playing bridge, and gardening (especially fragrant roses). A Celebration of Life service, with military honors, will be held on Saturday 9/22/18 at 11:00am, at Christ Fellowship Church, 2066 San Benito Street, Hollister, CA 95023.
