In a fatal shooting in Hollister that police say is possibly gang-related, eyewitnesses aren’t talking. Police said Ronald Molina, a 39-year-old from Hollister, died on Aug. 29 in a Monterey County trauma center from multiple gunshot wounds in an Aug. 23 attack. As of Sept. 4, Hollister police reported no arrests in what is now the city’s first homicide of 2018. On Aug. 22 at 4:24pm, officers were dispatched to the 200 block of Santa Ana Road. There were reports of shots fired, then subsequent reports that a man had been shot. The victim, later identified as Molina, had been transported to Hazel Hawkins Hospital by a private citizen, police said. The Hollister man was later flown to a trauma center in Monterey County because of the severity of his injuries.

As of Aug. 31, San Benito County officials said more than 100 county computers were back online, nearly two weeks after all were shut down to protect vital databases from a computer virus.

County Emergency Services Manager, Kevin O’Neill said in a new press release that email services for county officials may still be offline. The problems began on Aug. 18 when the San Benito County Information Technology Department took all county computers offline after identifying a virus that had permeated the system.

A press release sent by O’Neill 10 days later said the virus had been in a “phishing” email that had spread throughout county sites before it was identified by the IT Department The Aug. 28 press release said, “There is no evidence that personal data, employee information or public related material, were compromised and personnel

continue to work diligently to bring all county systems back online.” O’Neill wrote, “County email servers have been brought back online and are accessible to employees who are logged onto a clean computer that is connected to the county network. Employees are unable to access email through smartphone applications or the web at

this time, and as a result, some County employees may still not be able to access their email.” After the virus was identified on Aug. 18, county IT officials chose to take sites offline to ensure the virus did not continue to spread. “When Verity bought these hospitals from Daughters of Charity four years ago, they made promises to these communities that they would not lose access to the care they needed. Now it looks like Verity’s billionaire owner wants to go back on those commitments,” said Dave Regan, President of SEIU-UHW. In the bankruptcy filing, Verity has sought permission from the court to sell the two hospitals “free from any liens and encumbrances.” The union said this means Verity intends to “to nullify their obligations both to their union collective bargaining agreements and the conditions of sale imposed by former Attorney General Kamala Harris when Verity purchased the hospitals in 2014.” By challenging the filing, SEIU-UHW intends to ensure that all obligations are fulfilled, including keeping the hospitals open, maintaining existing services, bargaining with union workers, meeting pension obligations and maintaining current levels of employment. Verity said in an afternoon statement on Aug. 31 thatall of its hospitals will continue to operate “and provide high-quality care to patients throughout this process.”

The owners of Saint Louise Regional Hospital on Aug. 31 filed for bankruptcy protection under Chapter 11 to “reorganize and facilitate an orderly and efficient sale process.” The announcement by Verity Health System of California, Inc, a nonprofit healthcare system, that on Aug. 31 it had filed the voluntary petition for protection under Chapter 11 of the U.S. bankruptcy code in U.S. Bankruptcy Court in Los Angeles is potentially good news for Santa County County officials. Santa Clara County last month submitted an offer to buy two of Verity’s six hospitals, Saint Louise Regional Hospital in Gilroy and O’Connor Hospital in San Jose, for an undisclosed price. Verity has secured debtorin-possession financing of up to $185 million, the company announced, to keep its doors open until it is sold, likely in pieces. In addition to its two hospitals in Santa Clara County, Verity is looking to sell the two it operates in San Mateo County and its two hospitals in Los Angeles. “This additional liquidity will enable continued operations without interruption to high-quality patient care, employees and suppliers throughout the Chapter 11

process,” the company said in a statement. The union that represents 2,000 Verity workers, SEIU-United Heath Care Workers, immediately announced plans to challenge the bankruptcy proceedings filed today by the healthcare chain.

SOUTH COUNTY HOSPITAL The owner of the Saint Louise Regional Hospital in GIlroy has filed

for Chapter 11 bankruptcy protection. • Verity intends to sell all or some of its assets in Chapter 11 and is “actively seeking potential buyers.” • It has received additional liquidity of up to $185M secured to ensure financial stability throughout the reorganization process.

A Fremont man who owns ranch land east of Gilroy is free after posting $200,000 bail last week on more than a dozen felony charges related to the slaughter and burial of at

least 11 cattle in a grazing dispute. Santa Clara County Sheriff ’s Office deputies arrested Marc Belluomini, 54, at his residence in Fremont on Aug. 27, and announced the arrest the next day, after Belluomini was charged with . 11 counts of animal cruelty, two counts of Illegal cattle driving, and one count of brandishing a firearm. Deputies identified Belluomini as the owner of a large parcel of land in unincorporated Santa

Clara County east of Gilroy, near the large Canada de Los Osos Ecological Preserve off Highway 152. Early in 2018, according to deputies, Belluomini entered into an agreement to allow cattle to graze on 1,500 acres of his South County land. The cattle were owned by two separate cattle owners who were both parties to the agreement. In May 2018, the relationship between the parties began to break down, and one of the cattle owners desired

to remove his cattle from Belluomini’s property, deputies said. On May 25, Belluomini confronted a cattle owner who was attempting to remove cattle from Belluomini’s land, deputies said. Belluomini brandished a rifle during the confrontation and ordered the cattle owner off the property. The cattle owner notified the Sheriff ’s Office about the incident. The sheriff ’s rural crime deputies spoke to all the parties and negotiated

what they thought was a solution, which involved removing all the cattle from Belluomini’s property. The solution was amenable to all parties at the time. However, on June 5, deputies were informed by the cattle owners that numerous cattle had been slaughtered and buried on Belluomini’s property. The Sheriff ’s Office launched a full investigation that included numerous search warrants and the unearthing of 11 cattle carcasses

from Belluomini’s property. Investigators said they were able to recover bullet fragments from some of the deceased cattle in addition to other evidence. Belluomini was booked into the Santa Clara County Main Jail and posted bail set at $200,000. “I am extremely proud of the exquisite work by our investigators in this unusual case,” said Sheriff Laurie Smith. “I truly hope justice will be served in response to the cruel killing of these animals.”

Unions still wield legislative clout

T

he 2016-18 legislative session, which ended last week, provided more proof of the symbiotic relationship between California’s labor unions and the Legislature’s Democratic majority. While they didn’t get everything they wanted from the Legislature, unions – particularly those representing state and local government workers – won far more skirmishes than they lost. The record was a testament to the central role that union leaders play in recruiting and financing Democratic candidates for the Legislature, many of them union activists themselves, and in the unparalleled clout that union lobbyists enjoy when legislation is being drafted behind closed doors. That said, Labor Day 2018 found California unions seeing a downward trend in membership that could accelerate now that the U.S. Supreme Court has decreed that workers who don’t belong to unions cannot be compelled to pay even partial dues. Even before the landmark Janus decision was issued this year, California unions were seeing membership erosion, from a peak of 18.9 percent of California’s workers in 1989 to 15.5 percent in 2017, according to the federal Bureau of Labor Statistics. Numerically, the state’s 2.5 million union members are virtually unchanged in the last decade, meaning that membership failed to grow as public and private payrolls expanded by 1.5 million workers during that period, the BLS reported earlier this year. Union members are also graying, with just 8 percent of workers aged 18 to 24 covered by union contracts, but 22 percent of those over 55, according to the prounion Labor Center at the University of California-Berkeley. Roughly half of the state’s unionized

workers work for federal, state or local agencies, which may explain why Californians with college degrees are substantially more likely to be union members than those with high school or lesser educations. Unions leaders fear – and anti-union groups hope – that the Janus decision will not only allow thousands of nonmembers to stop paying what are called “fair share” dues, but persuade many members to drop out. It seems unlikely that public workers who are, in relative terms, well educated and well paid – such as teachers, engineers or police officers – will drop out in large numbers because they have obvious stakes in their unions’ clout. However, that may not be true of lower-paid government workers to whom union dues may represent a greater share of living expenses. This year, unions successfully pressed their friends in the Legislature to make it more difficult for workers to stop paying dues under Janus, including blocking access to workers’ contact information by anti-union groups. They also played a prominent role in the Legislature’s highly controversial decision to end money bail for criminal defendants. That decree would eliminate the jobs of thousands of private bail bond agency workers and create thousands of new civil service jobs in the court system for evaluating defendants. Looking forward, another court decision could spell trouble for the state’s public worker unions. The state Supreme Court is weighing several cases stemming out of a mild reform of public employee pension enacted by the Legislature and Gov. Jerry Brown. Warning that two-thirds of Southern California’s beaches could completely disappear and the average area burned by wildfires could nearly double by 2100, the State of California has released California’s Fourth Climate Change Assessment, which details new science on the devastating impacts of climate change and provides planning tools to support the state’s response. “In California, facts and science still matter,” said Governor Brown. “These findings are profoundly serious and will continue to guide us as we confront the apocalyptic threat of irreversible climate change.” The compilation of original climate research includes 44 technical reports and 13 summary reports on climate change impacts to help ready the state for a future punctuated by severe wildfires, more frequent and longer droughts, rising sea levels, increased flooding, coastal erosion and extreme heat events. For agriculture, the report notes that many of California’s important crops, including fruit and nut trees, are particularly vulnerable to climate change impacts like changing temperature regimes and waterinduced stress. Adaptive decision-making and technological advancement may maintain the viability of California agriculture. However, studies show that viability of the sector overall may be at the expense of agricultural jobs and the dairy sector, and this report points out that additional research is needed on potential yield changes of crops under changing climate conditions, to provide growers the crops varieties that can thrive under warmer and drier conditions, and tools they can use to identify and implement adaptation options. Sustainably managing groundwater resources remains a crucial priority. California has completed three prior Climate Change Assessments. Since the release of California’s Third Climate Change Assessment in 2012, the state has experienced several of the most extreme natural events in its recorded history, including a severe five-year drought, an unprecedented tree mortality crisis, damaging floods driven by atmospheric rivers and increasingly large and destructive wildfires. In addition, a report set for release in early September will highlight how California can better integrate climate impacts in design processes for critical infrastructure. To access California’s Fourth Climate Change Assessment, visit www.ClimateAssessment.ca.gov. The Climate Change Assessments directly inform state policies, plans, programs, and guidance to promote effective and integrated action to safeguard California from climate change. California will convene the Global Climate Action Summit in San Francisco this month. At the summit, representatives from subnational governments, businesses and civil society will showcase the surge of climate action around the world, and make the case that even more must be done. Alum looks forward to SBHS board SAHAGUN WILL JOIN FORMER TEACHER ON SBHS BOARD IN NOVEMBER Scott Forstner Reporter

As a former admissions officer at two different colleges, Miguel Sahagun Jr. knows what it takes for a high school graduate to make the leap into higher education. However, the San Benito High School alumnus also realizes how valuable a technical education can be as a successful pathway into adult life. “I believe there’s value in that,” Sahagun said. “I just want to do the best job I can for the students, the school and the community.” Now self-employed, Sahagun Jr. found he has the time to give back to his alma mater as the newest trustee on the SBHS District Board of Trustees, where he will be

starting after the November election. Sahagun Jr., whose son is a sophomore at SBHS, will not appear on the ballot, however, as he and two board incumbents, Juan Robledo and Steve Delay, went unopposed in their respective trustee area districts. Therefore, they will be appointed to those positions. Former trustee William Tiffany did not seek reelection and Sahagun was the only resident to step up. Along with Robledo and Delay, he will join trustees John Corrigan and Patty Nehme on the governing body. “I’m going to listen a lot and learn (from the veteran board members),” said Sahagun, who plans to come in with “an open mind” since he is a newcomer to the political forum. The 49-year-old father of three will have a level of familiarity on the dias as Robledo was one of his teachers during his local schooling.

Board of Trustees has selected the search firm in charge of finding its next superintendent. On a motion by Trustee Elsa Rodriguez at an Aug. 21 special meeting, seconded by Trustee Robert Bernosky, the five-member board unanimously approved the hiring of Hazard Young Attea

Associates. The approval came “with an amended motion to have Interim Supt. William Barr negotiate the lowest bid price; ensure community input is part of the process, and include board candidates running for office input,” according to the staff report. At the meeting, the

board interviewed four search firms; the other three were JGConsulting, McPherson Jacobson, LLC, and Leadership Association. Barr is filling in on an interim basis as HSD superintendent, after former education leader Lisa Andrew unexpectedly resigned from the post

The approximately 600 workers at Christopher Garlic’s production facility in Gilroy in July received a raise that’s part of an aggressive plan to increase wages in the nation’s biggest garlic producer. The increased wages benefit not only the workers but also the company, said Ken Christopher, Christopher’s executive vice president. Christopher Ranch increased the minimum wages for its workers from $11 per hour to $13 an hour in January 2017, and increased the company minimum again in July 2018, to $15 per hour. “We now offer one of the highest minimum wages in the nation, and unlike many other agribusinesses, we’re at full employment and even have a waitlist,” Christopher said. Christopher Ranch was stung by a Netflix documentary in January that alleged that it benefited

from imported garlic harvested by Chinese prison labor. The company has vehemently denied the allegations that it uses any imported Chinese garlic in its products, and believes its wage increase should go a long way to counteract any negative publicity from the documentary. Field workers are provided by the federal H2A Temporary Agricultural Program. Unlike many other farms, Ken Christopher claims that Christopher Ranch has had no trouble attracting farm workers. “They work at piece rates, and they are incredibly efficient,” Christopher said. “They make above our corporate minimum wage.” Gilroy may be the “Garlic Capital of the World,” but only 300 acres out of Christopher Ranch’s 5,500 acres in production in California are in Gilroy. “Fresh garlic costs between 50 cents to $1 per pound to harvest, with the variance depending on different fields yields and whether it was harvested organically or not,” Christopher said. “From there, depending on the end

robust harvests to date, over 100 million pounds. This bumper crop was due in part to increased water and labor availability. Christopher Ranch will only sell American garlic, foregoing imports from Argentina and Spain.

“We have absolutely not, never, used Chinese garlic, past, present or future,” Christopher said. “We take pride in our integrity. We’re not a faceless company. We’re a 62-year family farm that has had success.”

Donating money and product to the Garlic Festival has been a longterm effort by Christopher Ranch and the Christopher family. It’s also a show of gratitude for the support that Gilroy has shown Christopher Ranch.

The county’s Agricultural Department ommission was unable to release its annual Crop Report of the previous year by the Aug. 31 deadline. Agricultural Commissioner, Karen Overstreet told the Freelance that the report was near completion prior to the shutdown, but now it may be a few weeks before the report is completed. O’Neill’s press release said, “For all remaining functions, departments have implemented “pen and paper” techniques to continue fulfilling responsibilities.”

County administrator Ray Espinosa said in a statement to the Free Lance a week after the shut down, “I just want to assure the community that the county is still functioning and work is being done. We are working diligently to get everything back online as fast as possible, and we appreciate the community’s patience.” The county is now working toward stronger anti-virus measures. O’Neill’s Aug. 28 press release said, “ if you need assistance, please visit the office during business hours, call, fax, or use the postal service to submit documents to county offices. Phone numbers and addresses for county departments can be found by visiting cosb.us/ county-departments/”.

“They bring a lot of court knowledge and are smart hitters,” Burley said. “They see spots and put the ball in spots they need to go.” The Balers also have outside hitters Amanda Navarro and Nicole Miller, a sophomore who recorded a team-high 17 kills in the season-opener against Woodside on Aug. 28. There’s going to be plenty of Miller time for the Balers in the present and future, as the sophomore can flat-out hit it. “Nicole has a heavy swing, is very strong and willing to learn,” Burley said. Ito said Miller reminded her of Lauren Sabbatini, last year’s Gabilan Division MVP who is now playing at Fresno State. San Benito looks to be strong at the setter and defensive specialist positions. Sophomore Jaya Waller, Maya Villegas and Maya Garcia all have the ability to run the offense, while Ito, Francesca Giannotta and senior Kiana Heredia—who will be one of the team’s liberos this season—fortify a solid defensive specialist corps. Juniors Isabella Rivas and Lilie Sutton provide depth on the right side and the defensive specialist spots. In Rivas, the Balers have a left-hander to play the right side, which according to Ito is no small thing to overlook. “It’s a lot more natural position to have a lefty on the right side,” Ito said. “Not only on

The San Benito High girls volleyball team has won three consecutive league championships, including the last two in outright fashion. This season, the Haybalers’ quest for a four-peat will be as tough as ever. For one, the Gabilan Division got even tougher with the additions of Carmel and Santa Catalina, two perennial Central Coast Section playoff participants. Two, the Balers graduated four starters who were instrumental to the program for the last four years. Having said all that, San Benito still might have the requisite talent, work ethic and determination to make a legitimate run at a fourth straight league title. “We do think it’s very realistic (that we can contend for another title),” said Alyssa Ito, a returning senior defensive specialist who recently accepted a scholarship offer to play softball at UC Davis. “It’s weird kind of losing all that senior leadership from last year, but we’ve got younger girls who are ready to step in and make a difference.” It’s not as if the Balers are lacking for talent; in fact, they have a nice blend of returning players along with an influx of newcomers who have shown they’re ready to make an immediate impact. In senior Elizabeth Fleming and junior Roxanne Black, San Benito has a formidable presence in the middle capable of stuffing the opposition’s attack. “Elizabeth is probably one of

the best middles in the league, and her and Roxanne put up a great block,” Balers coach Emily Burley said. “They can also swing it, which is great.” The team has some strong offensive firepower in returners Carissa Garcia on the right side and Elliana Gaitan, who both had standout moments a season ago. Garcia and Gaitan won’t overpower the opposition; rather, they play smart and look for ways to get the ball down.

Heredia finished with 14 digs, Waller had nine and Gaitan eight. Fleming had seven blocks, while Black and Rivas had five blocks each. Burley said the team learned a lot from its four-set loss to Woodside, which should go a long way in the team’s quest to win a fourth consecutive league title.

“We can only take care of the things we can control, and if we’re trying to do too much that doesn’t help anybody,” she said. “We have a lot of returners and the four people who graduated— yes they were four big spots— but there is no doubt in my mind these girls can hold their own. I know last year we relied on a few players more, but we don’t want that to be the case this year. We want everyone to be a standout.” Ito has been on the varsity since her freshman year, and hopes her final year of playing competitive volleyball is a great one. A threesport standout, Ito was equally parts excited and relieved that she doesn’t have to worry about applying to colleges anymore by

committing to UC Davis. A solid and heady player who possesses excellent footwork and game instincts, Ito has plenty of game and intangibles to make an impact at the Division I level. Interestingly enough, Ito got on UC Davis’ radar after the coaches came to a tournament to look at another player on Ito’s club softball team a couple of years ago. “I was super excited (they offered a day before school started),” she said. “I kind of assumed if it (earning an athletic scholarship) was going to happen, it was going to be in softball because I’m pretty small for those other sports (I play in basketball and volleyball).”

“Having that depth allows people not to feel that pressure to carry the weight,” Kramer said. “That allows everyone to let it all hang out and go after it.” In Finley, Clonts, Tukuaoga and Lexi Chavarria, the Rams have an imposing front line presence. Finley, Clonts and Tukuaoga are all 6-foot-1, and Chavarria is 5-10. “Those four are pretty formidable and make it tough for everyone to play against everyday,” Kramer said. “They just beat the heck out of each other in practice blocking each other. If anything sets us apart, it’ll be their ability in the middle for us. Across the board, we’re one of the biggest teams in Northern California, if not the state.”

Strong everywhere

Dizon and Viray were two of the go-to outside hitters in 2017, but Dizon has transitioned to the right side and defensive specialist and “will be a huge factor.” Viray looks stronger than ever, and along with Cannizzaro and Ochoa give the Rams some powerful hitters who will be unstoppable at times. “Charlotte is a potential D1 outside hitter,” Kramer said. “And Teresa honestly at this point might be the most explosive outside hitter we’ve ever had in this gym. She can take a bad set and put it away. She’s explosive and athletic, and if she’s not one of the top hitters in NorCal this season, I’d be surprised.” The Rams are also deep at the setter position, with returners Gilroy

On paper, this year’s Gavilan College women’s volleyball team could be the best one yet since coach Kevin Kramer took over the program 12 years ago. Considering the Rams are the two-time Coast Conference South Division champions and a perennial NorCal playoff participant, that says volumes. “Sometimes you think it’s one of those (special) years,” Kramer said. That’s because the Rams return eight players off last year’s team and have an influx of newcomers who are ready to make an immediate impact. Gavilan was 4-0—having not dropped a set in the process—entering Wednesday’s matches against Sierra and Fresno City College. “Needless to say, it was a good recruiting year,” Kramer said. “Typically you’re going to get one to two kids who go in a different direction, but this year everything lined up and we even got a couple of (talented) ladies who were not on our radar and kind of fell to us. This might be one of the top recruiting classes we’ve ever had.” The incoming freshmen class includes setter Kieley Hoskins (San Benito), outside hitter Charlotte Cannizzaro (Venice), defensive specialist Noel Chavarria (San Benito), outside hitter Teresa Ochoa (North

Salinas), defensive specialist Zoe Harada (Santa Teresa), setter Melissa Zanotto (Central Catholic) and middle/opposite Florence Tukuaoga (South San Francisco). Returning players who either started or played significant games last season include setter Greysen Gilroy (Monte Vista Christian), libero Mikeila Banda (Notre Dame-Salinas), middle Camille Finley (San Benito), middle Evelyn Clonts (Gilroy), outside hitter/opposite Katelyn “Juice” Viray (Christopher), opposite/middle Lexi Chavarria (San Benito), opposite Katia Dizon (Anzar), setter/opposite Sarah Weiby (Gilroy) and defensive specialist Adrianne Orahood (Sherwood). “One of the keys to having a good year is having a lot of returners, and we are lucky to have nine sophomores,” Kramer said. “Winning conference last year, the ladies got a taste of what it takes to win it, so our sophomores will be key for us if we are to win it again.” With talent and depth at every position, Gavilan’s practices are intense and no one’s position is set in stone. “We’ve never had competition like this in the gym before on a daily basis,” Kramer said. “I told them on any given day a starting position is earned or lost. It comes down to the attention to detail and competing at the level you’re supposed to be at that could walk you into the starting lineup.” Having an ultra-deep roster also provides a boost mentally.

no one finishing in double-digits. Hoskins had 20 assists and two service aces and looks to be spoton at setter. Kramer will always deflect credit to the Gavilan administration and staff when it comes to talking about the success of the program, but the reality is few coaches can build a winning product and consistently transfer players who excel on and off the court to four-year schools at the rate in which the Gavilan program—under Kramer for the last 12 years—has done. It all starts with recruiting, and some coaches are excellent at it and some are not. Fortunately for Gavilan, Kramer’s recruiting acumen is second to none.

FRANK GUS CROSBY JR. February 16, 1930 - August 26, 2018 Resident of Morgan Hill, CA

F

rank Crosby, a long time resident of Morgan Hill, CA passed away peacefully in his home on August 26, 2018, after a long battle with cancer.

Frank was born in El Paso, Texas on February 16, 1930. He moved to Bakersfield CA in 1945 where he later met Ruth Scheuer, his loving wife of 67 years. Frank worked his way through Cal Berkeley and earned a degree in Life Science. He went on to earn a Master’s Degree in Physics at University of Michigan. He taught science, mostly Chemistry and Physics for 35 years at Live Oak High School in Morgan Hill. Frank also taught a year in Scotland in the FullbrightHayes exchange program and was a loyal member of the Santa Clara Valley Science and Engineering fair from 1960-2006. He truly enjoyed his students and never took a sick day in 35 years of teaching. Frank retired from teaching in 1990 and spent many days traveling the western United States with his wife Ruth. Above all, he loved his family, friends, enjoyed camping, fishing, football, reading and chocolate malts. He was an avid Democrat, with a strong sense of justice and donated time to his community. His gentle strength was an inspiration to all his family. He will be deeply missed by many, especially his loving wife Ruth, two daughters; Nancy (Mark), Sue (Ron), daughterin-law Josie and son-in-law Frank (Teresa). Eight Grandchildren; Carla (Danny), Dane, Marina (David), Adrienne (Fred), Skye, Christine, Laurel (Zach), Stephen (Connie) and two step grandchildren; George and Georgina. Twelve great grandchildren; Melissa, Dane M., Daniel, Ciri, Ava, Alora, Madilynn, Brooklyn, Jase, Vera, Myla, Hagan and beloved extended family. Frank was proceeded in death by his daughter Annie and his son David. A private memorial service will be held in the future to honor Frank’s life.
