Dozens of people gathered Oct. 5 for the official opening of River Parkway Road, otherwise known as the Nash Road Bypass. The bypass has been a highly anticipated project among city, county and San Benito High School officials. The Hollister City Council approved the plans in November 2016, citing safety concerns for students crossing the street to attend classes. Multiple city and county agencies were applauded for their cooperative efforts. San Benito County Board of Supervisors Vice Chair Jerry Muenzer hailed the project as an example of intergovernmental accomplishments. “A day like today shows how we can come together and get something done,”

The process of introducing commercial cannabis activities in unincorporated San Benito County is moving forward, if a bit slowly. But progress

is progress, and on Sept. 25 the San Benito County Board of Supervisors heard a presentation from Hdl Companies that laid out potential updates in policy along with an estimated final reading of legislation that will formally introduce commercial cannabis to the county on Nov. 20. David McPherson, a consultant for Hdl

Companies, said that on Oct. 17 changes to the plan will be submitted to the San Benito County Planning Commission. The program will continue to undergo revisions on Nov. 6, and come back for an expected final reading on Nov. 20. “We’re not reinventing the wheel,” McPherson said. “The rates provided are realistic, and

consistent with surrounding counties.” Measure C, while not setting the exact tax rate, established a range for commercial cannabis taxes. The tax per square foot for cultivators will be between $3 and $17, and gross receipt taxes on cultivators will be 2 percent to 4 percent on distributors, 2.5 percent to 4 percent on manufacturers,

and 2.5 percent to 5 percent on micro businesses. The City of Hollister currently charges $7 per square foot and has a 5 percent tax on gross receipts in manufacturing and retail. Anyone hoping for countywide dispensaries will be disappointed. Cannabis retail ➝ Cannabis, 15

PLANNING COMMISH APPOINTED TO FILL RAY FRIEND’S SEAT Jaqueline McCool Reporter

Hollister City Council members voted to fill a council seat left vacant by District 1 Councilmember Ray Friend. In a 3-1 vote, Planning Commissioner Carol Lenoir was appointed. The Oct. 1 special meeting began with candidate interviews with the council in chambers. The three candidates who had applied before the Sept. 14 deadline were all interviewed: Elizabeth Doidge, Dawn Koistinen and Lenoir. Kevin Henderson had applied for the seat, but later withdrew his application. The Hollister City Council rejected the option of scheduling a special council election next spring, following Friend’s resignation from his seat at an Aug. 7 council meeting. Friend told his colleagues and constituents he was stepping down from the council

because he is moving to Washington. By law, the city had to make its decision on an appointment before Oct. 7, 60 days after Friend’s resignation became effective. The appointment comes one month before the mayoral position and the three other council member seats will be on the Nov. 6 ballot. Friend’s resignation came too late for his open seat to be included in the November election. When the seat first became available, City Clerk Christine Black told the Free Lance that the council could have decided to keep the seat open and hold a special election for the remainder of Friend’s term, which expires in 2020. Instead, the council chose to fill the seat by appointment. Black said March 5 was the earliest possible date for a special election to fill the seat. On Aug. 20, the council voted 3-1, with Mayor Ignacio Velazquez opposed, to appoint Friend’s successor and not allow District 1 voters to choose his replacement. Velazquez also

opposed the Oct. 1 vote to appoint Lenoir. At the special meeting, Velazquez had moved to appoint Koistinen, but the motion was defeated after no one seconded it. The mayor said he had hoped to have Koistinen on the council because she has a financial background, and he believes the council needs someone who “really understands the numbers.” Velazquez told the Free Lance he thought Koistinen would bring something different to the council and that is why he ultimately could not vote in favor of Lenoir. “I wanted to make sure we had someone different representing that district that was outside of that circle,” said Velazquez. On the Planning Commission, Lenoir has worked with the city on two master plans, and she said her position as chairwoman of the Planning Commission qualified and prepared her to be on the City Council. “I’m excited to go serve,” said Lenoir. “I’ve always wanted to.”

The questions were selected after asking Hollister residents what they would like to hear from their future elected representatives. Answers were limited to 50 words. Candidate Brande Barrett did not respond to the questions before the Free Lance’s print deadline. Here’s what they had to say:

teacher shortage is the next educational crisis. To obtain a credential today costs in the neighborhood of $15,000-$20,000 on top of any money paid to get a degree. Once you finish the classwork and get a job, teachers spend their first two years trying to clear their credential. The Hollister School District has lost 99 teachers in the last two years. First order of business if I’m elected would be, why this is happening? Second would be sending our director of personnel to every teacher fair with contracts in hand.

What are some of your ideas for improving school safety and eliminating bullying in schools?

The issue of bullying has been around for a long time and is a very serious problem. Research shows how learning is very hard if not impossible if a student doesn’t feel safe. If elected, I would review current board policy and make sure that every school has a policy of dealing with offenders. Repeat offenders would be referred to the board for review and action taken if necessary.

The hiring and retaining of highly qualified teachers has become more and more challenging. How would you help Hollister School District address this issue?

If the school district discovered additional funds that needed to be allocated immediately, what areas would you like to see those funds go toward, and why?

This used to be referred to as “student teaching.” The district has begun working on acceptance of a program to provide an induction program for new teachers during the first few years out of school themselves. New bail law will nix monetary system BOND BUSINESS CLAIMS POOR WILL BE WORSE OFF Bryce Stoepfel Reporter

Critics of the current system contend that it's a tax on the poor since many impoverished offenders often can't afford to pay bail. Bail bonds companies step in by offering a surety bond to cover the bail, along with a 10 percent fee. The California Money Bail Reform Act was introduced by Senator Bob Hertzberg and Assemblymember Rob Bonta, both Democrats, to ensure that prisoners were not held solely because they could not afford bail. Brown had sought bail bond reform since as far back as 1979 when he called the current system a "tax on the poor." Lieutenant Governor Gavin Newsom and California Chief Justice Tani Cantil-Sakauye, who said the current system is “outdated, unsafe and unfair," echoed their support for the reform. The effort is among several criminal justice reforms championed by the Brown Administration. Brown has also signed bills and measures to downgrade drug offenses, easing punishments for juvenile offenders, and the expansion of the possibility of early release for prisoners. Now the bail bond industry is scrambling to gather more than 350,000 signatures from registered California voters to overturn Senate Bill 10. If advocates of the bail bond industry can obtain the needed signatures by the Nov. 26, 2018 deadline, voters

On Aug. 28, California Governor Jerry Brown signed one of the most sweeping bills of his administration, Senate Bill 10, the California Money Bail Reform Act, which will abolish the state's current money bail bond system. For Frank and Yesenia Rivera, owners of Eight Ball Bail Bonds in Hollister, the new law would put them out of business. “The biggest problem in California is that the legislators think we’re taking advantage of people, or that we don’t bail out people of color; that’s not true,” Frank Rivera said. “We bail out anyone within reason.” Rivera has been bailing people out of jail since 1997, when he opened Eight Ball Bail Bonds, now located at 335 San Benito Street in Hollister. The Hollister native recognized that there was a need, and for him, it was good business sense to work to get people out of jail quickly. For anyone sitting in a jail cell, quick is essential. For Rivera, if the current system of bail is overturned, many arrestees may find themselves in prison longer than they would have if they could use Eight Ball Bail Bonds. "If you get arrested on a Friday, you won't be able to

see a judge until that Monday, or longer if there's a holiday," Rivera said. If the new law goes into effect on Oct. 1, 2019, instead of paying a monetary bond, judges will decide who remains in prison based on how much danger the prisoner potentially poses to the community. Bail bond agencies are a lot like tow truck businesses. You don’t want to need their service, but you’re glad they’re there if you ever do. The Riveras think the bail bond industry is unfairly stigmatized. To them they fill a role useful both for the arrestee, but also the state. “A bail bond is a power of attorney that is worth what the bail is set at,” Rivera said. “If they don’t come back to court, we have six months to bring them back. If we don’t we owe the full amount due to the court. If the new law is put into effect, the taxpayers foot the bill.” The amount of bail is based on the crime on a county by county basis. People in jail can get out by paying, and the court ensures their return by paying back the bail when the trial is over. Felony domestic violence in San Benito County carries a $50,000 bond, and if the arrestee fails to return to court when ordered, the bail is forfeited. At that point, Rivera must either hire a bounty hunter to make the arrest, or he must make the arrest himself. Under the new law, state police are on the hook to find and arrest bail jumpers.

Until then, the Riveras will continue business as usual, but they will also need to have an eye on the future. Should the state

lock away their business and throw away the key in 2019, they will need to find another way to make a living. “I don’t know yet what we’re going to do,” Rivera said. “For 20 years, it’s helped us raise

a family and send out kids to school, and we’ve been able to stay off the road and do business here. If not, the court may have open positions and Farmers Insurance reached out to see if we wanted to work with them.”

Changing the rules to change election results

C

lay Matthews, the Green Bay Packers’ much-feared linebacker, was penalized after a hard tackle on Washington Redskins quarterback Alex Smith on Sept. 23, running afoul of new league rules aimed at protecting Smith and other QBs from injury. It was the second straight week that Matthews had been ticketed for making hard tackles on quarterbacks, and he complained loudly. The particulars of the incidents aside, they illustrate a cogent point. Changing the rules of the game can change outcomes. If linebackers can’t go after quarterbacks they way they used to, it gives the offense an advantage vis-à-vis the defense. What’s true in sports is also true in politics. Each legislative session brings a slew of bills to change political rules, with the hope of affecting who or what wins or loses. Two of this year’s political rules measures, one signed and one vetoed, underscore the syndrome. The Democrats who control the Capitol have been trying for years to alter the initiative system that allows advocates to bypass the Legislature and take their proposals directly to voters by gathering signatures of registered voters on petitions.

Why? Having achieved domination of the Capitol, they and their allies, such as unions, want to make it more difficult for competing interests, particularly anti-tax or business groups, to bypass the Legislature and place their causes on the ballot. Assembly Bill 1947 would have done exactly that by banning organizations from paying professional signature-gatherers for each name they collect. They would have had to be paid by the hour or by the day instead. The rationale for the measure was that paying by the name encourages signaturegatherers to distort the measures they are promoting, making them sound benign. But the real motive was to make qualification of initiatives, referenda and recalls more expensive, as Brown said in his veto message. Brown rejected a nearly identical bill in 2011, and he repeated his reasoning on AB 1947, saying that paying by the signature is “often the most cost-effective method for collecting the hundreds of thousands of signatures needed to qualify a ballot measure.” Brown, it should be noted, used pay-bythe-name signature gatherers to qualify two initiatives himself. The second rule-changing bill, which

Brown signed, allows Davis Unified School District to exempt teachers and other school employees from paying a parcel tax it would submit to voters for approval. The official rationale for the exemption, as Senate Bill 958’s author, Sen. Bill Dodd, a Napa Democrat, puts it: “This bill would provide an additional incentive for public educators and school staff to live in the community in which they work, despite the severe shortage of affordable housing.” The more likely reason is that exempting school employees who live in the district from paying new taxes would make them—and their unions—more likely to support the campaigns to get them approved by voters. It’s a classic slippery slope, as critics of the measure pointed out in legislative hearings. Now that Davis school employees have a tax exemption, workers for other local government agencies will certainly demand similar treatment when their employers seek tax hikes. THE OCT. 3 ACCIDENT TIED UP TRAFFIC FOR FOUR HOURS Staff report

No injuries were reported after a big rig overturned on Highway 25 in Hollister, closing the road for about four hours Oct. 3, according to authorities. About 8pm, a 64-year-old Wisconsin woman was driving a 2000 Peterbilt truck

towing a trailer northbound on Highway 25, north of Shore Road in unincorporated San Benito County, according to the California Highway Patrol. The roadway at this location is straight and flat, with the northbound and southbound lanes divided by double yellow lines and an eightfoot center median. For an unknown reason, the truck driver abruptly turned the steering wheel to the left, according to police. This caused the Peterbilt

and its trailer to overturn onto its right side. The truck and trailer came to rest partially blocking the northbound lane and fully blocking the southbound lane of Highway 25. The highway was closed from State Route 156 to Shore Road for about four hours while authorities cleaned up the accident, police said. The truck driver was uninjured, according to the CHP. While neither alcohol nor drugs are suspected to be a factor, the accident is still under investigation.

School safety and bullying Hollister School District has been working on making the school and surroundings safer for the students during school hours by directing visitor flow into the school to the office where visitors are required to sign in and obtain an identification badge. Gates and fencing have been improved as well as the alarm systems and safety planning.

School spending is extremely regulated by either the State or Federal as they are the source of most funding. However, if the “additional funds” come with no strings and it is one-time funds and if it's in the range of $100,000 or less, I'd like to see more Chromebooks available to the schools.

must be more than 400 feet away from any offparcel residence if the business is located on a parcel that is 10 acres or less. Any cannabis business proposed for a plot of 10 acres or less must go through a hearing. Each cannabis business must adhere to its classification permit, so cultivation businesses must engage only in cultivation. Cultivation business permits may not be issued in residential buildings,and the permits will lay out specific business practices. Applicants may appeal these provisions with a written request to the county administrative officer. If the application is denied, the applicant may submit a written appeal to the clerk of the Board of Supervisors, which will be reviewed by the county supervisors. San Benito County commercial cannabis permits are limited to indoor or mixed-light

commercial cultivation (greenhouses). Other permit types will include manufacturing, micro businesses and testing labs. All permit holders need to get a cannabis business permit from the county and a valid California seller’s permit. The San Benito County Administrative Office will oversee the Cannabis Business Regulatory Program. Their duties include creating application forms, conducting inspections, approving or denying applications, issuing, inspecting or revoking permits. The County Administrative Office will also communicate with the public about the number of permits accepted on the county’s website. The proposed plan lays out various reasons why an application may be denied, including non-payment of fees, non-compliance with regulations regarding health, safety and morals, or if the applicant does not

business—whether a dispensary, retail delivery (cannabis delivery for personal use), or retail as part of a micro business (a cannabis operation that involves cultivation, manufacturing and retail)— will remain prohibited. The county’s cannabis industry will remain cultivation (growing), manufacturing (edibles), distribution or laboratory testing. On July 1, the state mandated that all cannabis sold legally must undergo testing for purity and potency. Cannabis business applicants will also need to adhere to restrictions regarding location. All cannabis businesses must be more than 300 feet away from property boundary lines and 1,000 feet from any school, school bus stop, school evacuation site, church, park childcare center or youth-oriented facility. Long-awaited bypass now a reality Nash Road, 1

Vanessa Gonzalez a representative for State Assemblymember Anna Caballero, both presented certificates of recognition to Botehlo. Mayor Ignacio Velazquez said the project was an example of agencies and government officials overcoming differences. “There’s a lot of talk about how the city (and) the county or the different agencies don’t work together,” said Velazquez. “But that’s not true.” School and county officials had originally hoped the road could close to weekday traffic in August, providing a bypass around the school to divert traffic from the center of the sprawling campus. However, the opening was pushed to sometime in October. Nash Road is expected to close for the first time on Oct. 15 from 7am till 7pm. Superintendent Sean Tennebaum said the project was a “historic moment,” and would greatly benefit the roughly 12,000 people who cross the road everyday. “This project is going to ensure generations and decades of San Benito High School students have a safe journey to and from class,” said Tennenbaum. “The power of collaboration is today.”

Jerry Muenzer hailed the project as an example of intergovernmental accomplishments. “A day like today shows how we can come together and get something done,” said Muenzer. Board of Supervisor chair Anthony Botehlo shared a similar sentiment. “We were able to get three agencies together and come up with a solution,” said Botehlo. “And what a solution it is.” Four construction projects were happening simultaneously through and around Nash Road. The timing of the road’s closure is dependent on the completion of a bypass road, which is intertwined with the various projects. The projects included in the plans are a park, a crosstown pipeline, the bypass road and the Nash Road closure. The bypass being created to divert traffic is also the first stage of a new county park. Following the opening of River Parkway, the new county park also opened. Julia Pearson gets out of bed every morning wondering if she woke up too late. On the drive to school, Pearson goes through her backpack, frantically making sure she hasn’t forgotten anything. Perhaps she forgot to pack a lunch? Or if she brought her lunch, maybe she didn’t pack enough food? And if she brought enough food, did she remember to pack enough water? These type of thoughts are constant, and at times, almost debilitating. The San Benito High senior sought help recently and got it, but the battle rages on daily. Pearson suffers from anxiety disorder, and she was remarkably candid in a conversation with the Free Lance. “It’s ironic because I don’t like my teachers knowing too much about me and here I am talking to the Free Lance about my anxiety,” said Pearson, the No. 1 singles player for the San Benito High girls tennis team since the start of the 2017 season. “But I know other people

have it (anxiety disorder) and younger middle school kids have it, so maybe if one of them reads this and thinks, ‘Oh, a No. 1 varsity athlete has serious anxiety?’ Maybe they’ll realize there isn’t something terribly wrong with me. And maybe they’ll get help for it, and it’ll benefit their life.” Mental illnesses have long been misunderstood and stigmatized, and awareness and education of the issue have finally come to the forefront in this country in the last couple of years. Still, there is a long way to go. According to research done through USA Today, roughly 44 million Americans experienced some form of mental illness in 2015 (the latest numbers available at the time of the report). People from all walks of life suffer from a wide range of mental illnesses. Pearson, who has been seeing a therapist for four or five months, didn’t have to reveal anything about her anxiety disorder yet did so in lengthy detail. She simply wants people to be educated on the issue and hopefully give hope to those who are afflicted with it and other mental illnesses. That is why she was candid and forthright as she talked with a reporter, to help others who are battling mental illness. “If even one person has a better life because they’re reading this, then I’ll be happy,” she said. “I’m tired of the stigma about mental health, and I wish

everyone talked more about it so there wouldn’t be so many (messed) up people. We need to talk about it because when we don’t we’ll continue to have so many anxious and suicidal teenagers. I interact with them on a daily basis. … There aren’t nearly enough counselors at this school to help them all.”

Grit and perseverance

Even though Pearson has bouts with anxiety on the court, she has persevered to become a solid No. 1 player for a Balers team playing in the Pacific Coast League’s Mission Division. Entering the week, Pearson had a record of 7-2 overall and 5-1 in league play. Not bad for someone who didn’t get to play in the off-season because of a shoulder injury. “I didn’t get to practice at all in the off-season,” she said. “I’m not quite at the top of my game, but I’m getting there.” Pearson possesses a solid allaround game, but her greatest strength might be her competitiveness. When asked about her only loss in league play—to the No. 1 player from St. Francis of Watsonville on Oct. 2—Pearson was already looking forward to the rematch. “That loss burned,” she said. “But it only strengthened my resolve to beat her the next time we play. I’ve always been pretty competitive. I credit that to growing up with an older sibling who I always had to keep

up with. He was always good with academics and I was always good with sports stuff.” Pearson said her best match came in the season-opener against Soquel, a match she took in a third set super tiebreaker. Pearson rallied after dropping the first set, 6-0. “I had only been hitting for a month prior to that because of the injury,” she said. “I didn’t find my rhythm until I was down 5-0. Then I beat her 7-5 in the second set and 10-4 I think in the tiebreaker. It was really exhilarating for me. Once it got to 5-0, that is when I really focused in and had a goal that I really needed to snap out of it and play some good tennis.” During one changeover in the match, Pearson went to the back of the court and started muttering some choice words at herself “for a solid two minutes.” Most of the time, however, Pearson has a motto she repeats throughout a match. “I tell myself I’m going to win this next point and the point after that, and I say that over and over again,” she said. “The focus one needs in tennis is hard to achieve and maintain, especially in high-stress situations. But I’ve learned to recognize when I need to be positive and pick up my game.” Pearson has maintained a solid 3.3 GPA in the midst of anxiety disorder, which she first noticed in middle school.

However, it wasn’t until recently that Pearson realized that she wasn’t supposed to be anxious all the time and hold everything in. The biweekly meetings with her therapist have been a fruitful one. “Mostly she is working to help me manage my anxiety better with coping methods,” Pearson said. “Every time we see each other, she asks me how many anxiety attacks I’ve had in the last two weeks and I tell her seven or 12, it just depends.” When Pearson has an anxiety attack, her breathing gets faster, her heart rate spikes, her chest gets tight and she starts to shake. Her anxiety attacks occur over anything, from giving a presentation in class or something as simple as not having a working/extra pencil handy. The attacks also happen on the court; however, at least when Pearson is playing tennis, the amount of movement required in the sport allows her to run amid the attack and let it eventually pass. With tennis being an individual sport, Pearson faces her demons every time she steps on the court for competition. However, the sport has also been a refuge and oasis for her, giving her a place to go in the midst of daily struggles. Life will never be quote-unquote normal for Pearson, but she is determined to march on and make the best of her situation.

He was a loving father and grandfather and will be greatly missed by many. He is preceded in death by his wife Julia, sons Francisco, David, and Bengie, daughter Dianna, and grandson Daniel. He is survived by his children Michael (Debbie) Chavez, Patsy (Zeke) Robles, Beverly (Jesse) Casas, and Jess (Diana) Chavez. He was a member the Gilroy Rotary Club.

Page is survived by her husband, Pete, her two daughters, Hope (Matt) Gawlick and Peri (Kevin) McDonald, and three grandchildren, Megan Gawlick and Ewan and Darby McDonald. She is also survived by her brothers, Mark (Cynthia) Fancher and Patrick (Jacqueline) Fancher and her sister Leslie (Ken) Rodman, along with nieces, nephews, aunts, uncles and many cousins. She was preceded in death by her parents, Bud (1992) and Fern (2013), and her sister Katie (2011). Burial will be private at the Odd Fellows Cemetery in Hollister, CA, with an Open House/ Celebration of Life on Sunday, October 21, at Posada de San Juan, 310 4th Street, San Juan Bautista from 11:00am to 2:00pm.
