J. Hopkins withdraws from the District 7 Gav race HIS NAME WILL STILL APPEAR ON BALLOT Scott Forstner Reporter

Robert Eliasont

Jason Hopkins, a candidate in Trustee Area 7 for the Gavilan Community College Joint District Board of Trustees, announced he is withdrawing from the race, citing “personal and health reasons.” Trustee Area 7 includes all of San Benito County outside of Hollister. Hopkins, 37, whose decision to withdraw came too late to have his name removed from the Nov. 6 ballot, said, “I’m not campaigning anymore,” but “I’d take the job” if elected. The two remaining candidates are Michael Alcorn and Irma C. Gonzalez.

In addition to station tours, the department had engines out on display, and Sparky the Fire Dog was available to meet and greet children. The department held a Pee Wee Firefighter Combat Challenge and offered a free hot dog lunch to guests. “The month of October is National Fire Prevention month,” Bedolla said. “Every year there is a different, theme. This year’s theme was, ‘Look. Listen. Learn.’”

Nearly 250 people came out to show their support and even display a little courage during the Hollister Fire Department’s Open House and its Pee Wee Firefighter Combat Challenge on Saturday, Oct. 13.

The event culminates the department’s annual Fire Prevention Week held this year Oct. 7-13. Deputy Fire Marshal Charlie Bedolla said it provided a great opportunity for the community to visit the station and interact with firefighters. “This event gives the community an opportunity to chat and ask questions, take a tour inside of the station, see what we are all about and ultimately see that we are here for them,” said Bedolla.

Mayoral candidates discuss plans for city 3 CANDIDATES DIFFER ON ISSUES FACING THE CITY IN INTERVIEWS By Jaqueline McCool Reporter

The race for mayor is crowded in Hollister, with incumbent Ignacio Velazquez up against former planning

commissioner and city councilmember Gordon Machado and five-time candidate Keith Snow. In Hollister the mayor sits on the City Council as a member at large, with council members representing four districts. Machado served as mayor when the position was a rotational appointment among council members. Velazquez owns and operates The Vault, a banquet

hall on San Benito Street in downtown Hollister. He is running for his fourth consecutive to-year term. Along with serving on the Hollister Planning Commission for eight years, Machado also served on the Hazel Hawkins hospital board for 12 years. He owns and operates a local business, Rustic Turtle Embroidery. Aside from his past runs for Hollister mayor, Snow

is a retired engineer-foreman and frequent attendee at council meetings. In interviews this month with the Free Lance, the three candidates offered sharply different views on city growth and downtown development strategies. The Free Lance asked each candidate the same questions, developed from Facebook posts where Hollister residents

indicated issues they would like to hear elected officials discuss.

Role of the mayor

Machado emphasized his Hollister roots as giving him insight into understanding the constituents he hopes to serve. He said the key to being mayor is understanding the city as a corporation. ➝ Mayor Interviews, 9

Upgrades abound at SBHS ATHLETICS, CTE AND MORE Scott Forstner Reporter

For each day there is a ribbon-cutting ceremony to signify the completion of a new construction project on the San Benito High School campus, there is a groundbreaking ceremony for the start of another. “We’re extremely grateful to our community,” said SBHS District Superintendent Shawn Tennenbaum as he went over each of the completed, ongoing and soon-to-be started campus upgrade projects from the Facilities Master Plan. “We are so grateful to have these opportunities.” One of the most recent additions to the sprawling 120-acre SBHS campus—which which rivals most other high schools and even some colleges throughout the state—was an outdoor multi-purpose/ physical education field. It was christened with a Sept. 10 ribbon-cutting. The $4.6 million Measure U-funded project is currently used by PE classes (including adaptive PE) during school hours and by a number of Haybaler sports teams after school (including softball, baseball, lacrosse, field hockey, soccer, football, cheer and band). While all SBHS students will use the field for PE, 250 to 300 student-athletes will take advantage of the state-ofthe-art complex during after-school activities. “It’s a great facility,” said Tennenbaum, who, along

with staff, visited more than a dozen schools in the region to get as many examples as possible as to what works best for a multi-use field such as the one completed in June on the SBHS campus. “(This facility) provides our students with a safe, playable surface 24 hours (a day), seven days a week, 365 days a year.” The 177,000-squarefoot facility includes lines for regulation soccer, baseball, softball, field hockey, lacrosse and practice football fields. The massive perimeter fenced-in layout is covered by a cork infill field turf surface instead of rubber to keep on-field temperatures low and maximize safety, according to staff. There are also vertical safety nets to prevent balls from flying out onto the new bypass road running alongside the southern part of the facility. Local leaders gathered Oct. 5 to commemorate the opening of the River Parkway, a bypass around Nash Road and the SBHS campus. Nash Road will be closed from 7am to 7pm on weekdays between Monterey and West streets after an Oct. 15 “grandclosing” ceremony. The athletic facility “was designed to have multiple sports going on at once,” said construction manager Rob Zimmerman, a SBHS alumnus who was gleaming with pride as he led the Free Lance on a Sept. 28 tour of the campus. The multi-purpose field does not currently have

WORK IN PROGRESS A drone shot of some of the ongoing construction projects at San Benito High School. lighting, but the electrical capabilities are there if the district chooses to add them, Zimmerman noted. “It’s just a great way to provide state of the art facilities for staff and current students and future generations of Haybalers,” Tennenbaum added.

New Science and Robotics Building on the horizon

The same day district officials were unveiling the new field, they also announced the groundbreaking for the new Science and Robotics Building, a

36,882-square-foot facility with 12 next-generation science labs/classrooms, prep rooms, a robotics classroom and restrooms. Just getting started with the underground utilities, plans for the estimated $16.6 million project are under review by the Department of the State Architect, with a targeted completion date of fall 2019. Tennenbaum said this building helps the district tackle some “critical content area and skills” that will allow students to be better prepared for

real-world challenges and careers. “Science is all about problem-solving and inquiry and being able to synthesize information and apply it to the real world. … Robotics calls for many of those same skills,” said Tennenbaum, noting the district’s focus on establishing its Engineering and Robotics pathway for students. The Science and Robotics Building, funded with Measure U and state matching funds, is planned for the western portion of SBHS and has

Re-Elect

been tagged as the STEM (science, technology, engineering, math) campus. Tennenbaum explained that SBHS used to be all north of Nash Road but is now south as well, with the long-term facilities master plan designed to have the main hub of campus between Nash and West with the opening of the bypass road. SBHS, located at 1220 Monterey St., has more than 140 staff members that help serve just under 3,000 students. ➝ SBHS, 14

GUEST VIEW CARLY GELSINGER

Why some women support Kavanaugh for court seat

I

t seems a lot of people can’t fathom why a woman could support Brett Kavanaugh. I can, and here’s why. I come from a young generation of women who were never taught consent. In our world, we were taught that our bodies didn’t belong to ourselves. God owned them, they said, but really that meant that men owned them. Our fathers. Our pastors. Our husbands. This was the 1990s evangelical movement known as “purity culture.” A pendulum swing from the free love culture of the 1970s and the AIDS scare of the 1980s, the 1990s were all about abstinence. Purity culture taught young girls to hold responsibility for men’s lust. Our formative years were spent in shame of our bodies, in suspicion of our sexuality, and in earnest ownership over the behaviors of men. When I was 13, I went to my female youth pastor, shaken by my first aggressive catcall. She said, “welcome to the wonderful world of womanhood,” with an edge of tired sarcasm to her voice. When I was 14, I was lying on my belly reading the bible on the church floor before youth group. A youth leader told me to sit up. You don’t want the boys to picture you naked, she said.

When I was 15, I was violently assaulted on a missions trip. I was asked by my team leader, “What were you wearing?”

Women who grew up being guardians of male sexuality now expect other women to as well When I was 16, I sat in a dark movie theater with my crush. It was my first official date, and I was too consumed by fear to enjoy it. You see, we were taught that women who have sex before marriage are like a trampled rose. When I was 17, I attended a purity retreat where I signed a pledge to save myself for my future husband. I didn’t even think about what I wanted because that didn’t matter. My body wasn’t my own. When I was 18, a guy at my Christian college lectured my friend and me for stretching in the student union. He said it caused him to picture us in the positions we could maintain in bed and that we should work harder to protect his

thoughts. We acquiesced. After all, we wanted to be worthy of our future husbands. When I was 19, another girlfriend of mine went to visit a guy who was housesitting off campus. He forced himself on her. She didn’t report it because we knew that girls who had sex were expelled from school. When I was 20, I got dumped by my Christian boyfriend. “I want a pure woman,” he told me, after one of our kissing sessions. We hadn’t even had sex. When I was 21, I was engaged to another Christian man. We sought Christian counsel to prepare ourselves for marriage. Always be available to your husband, they said. If you don’t fulfill his needs, he will lust after other women. When I was 22, I began to untangle myself from purity culture. I had to relearn basic concepts of bodily autonomy and consent. So this is why it is not surprising to me that so many women defend Kavanaugh. The women who grew up being guardians of male sexuality are now approaching middle age, and many of us are still assuming that role, and expecting other women to as well. The lingering effects of purity culture run deep. We were taught to distrust women—beginning with ourselves.

While Snow does not have political experience, he believes he had gleaned understanding of mayoral duties during his past campaigns. “You learn things as you go,” said Snow. , “I know what the job of mayor is; (it’s) “to work with the council with what’s on the agenda.” Snow emphasized the importance of the mayor’s role in the city’s public safety. “The mayor works with the city manager and the city clerk,” he added. Velazquez said the single most important duty of mayor is to have vision. His vision has been at odds with the rest of the council for his entire tenure, as he has consistently voted against development projects that come before the City Council. While he acknowledges this is mostly symbolic, he said he hopes to work with a new council to create a set plan for the city’s growth, “putting together a plan or a vision for where the city wants to go,” “The tricky part of that is getting the other City Council members to go

Velazquez had gained enough signatures to put a referendum on the ballot that would have let voters decide the fate of the block. The state’s Attorney General said the public could not vote on the issue. “You’re asking me all of my history,” Machado said when talking about the 400 block. He is familiar with the history of the project because of his work on the Downtown Association. He said the city contacted him and said, “What we want to have the downtown association do is have one person per block, a block captain.” “I was so lucky [to be] the block captain of the 400 block,” said Machado, “so I coordinated that for probably about two or three years..” He has seen The 400 block several proposals, including one that Machado and almost came to Velazquez clashed fruition until the over their ideas economic downand personal histoturn of 2008. “It’s ries with the 400 been a frustration block in downtown over the years,” Hollister. He said, “My goal is to make sure we have a council that understands the needs of the public so we can implement what I’ve been trying to implement, and that’s a smart growth plan where were focused on how many units we’re going to be building a year, making sure every unit pays for itself the first day and 20 years down the road. Making sure we’re providing the quality of life for our residents.” Velazquez hopes that if re-elected he would be able to serve with other council members who share his stance on growth and infrastructure. “It’s not complicated,” said Velazquez. “ It just has to be done.”

DUI IN FATAL ACCIDENT IN SEPTEMBER LED TO DEATH OF PICKUP’S PASSENGER

HOLLISTER PD, DEA TO HOST SEMI-ANNUAL PUBLIC EVENT IN HOLLISTER OCT. 27

Staff report

A Hollister man accused of driving under the influence during a Sept. 30 accident that left his passenger dead will appear in court on a vehicular manslaughter charge Oct. 23, according to authorities. Travis White, 30, of Hollister, is also charged with driving under the influence causing great bodily injury, according to San Benito County Assistant District Attorney

Ellen Campos. The maximum sentence for the vehicular manslaughter charge is four years in prison, and the max for the felony DUI charge is six years. About 11pm Sept. 30, White was driving a 2002 GMC Yukon northbound on Quien Sabe Ranch Road east of Hollister at a speed of about 45 mph, according to the California Highway Patrol. For an unknown reason, White turned the GMC in an unsafe manner, causing the vehicle to overturn. Investigators determined that neither White nor his right front passenger, a 20-year-old Hollister man, were wearing their seatbelts, the CHP said. Both were

ejected from the vehicle as a result of the collision. The passenger suffered fatal injuries due to the collision, according to authorities. White suffered minor injuries. When officers responded to the scene of the accident, they arrested White on suspicion of driving under the influence of drugs or alcohol. After White was treated at Hazel Hawkins Hospital for his injuries, he was booked at San Benito County Jail. White remains in custody at the county jail in lieu of $130,000 bail, Campos said. His Oct. 23 hearing at San Benito County Courthouse is scheduled as a preliminary hearing setting.

Staff report

Local and federal law enforcement authorities are teaming up to help remove unneeded controlled substances from the community by sponsoring a prescription drug “takeback” in Hollister Oct. 27. From 10am to 2pm Oct. 27, residents can bring their unused prescription drugs to Target, 1790 Airline Highway, where Hollister Police and Drug Enforcement Administration officers will safely dispose of the medications.

bleachers. The targeted completion date for that job is June 2019. The aquatics complex, which is targeted for a spring 2019 opening, will include a 50-meter by 25-yard competition pool, an eightlane by 25-yard learn-toswim pool, a large pool deck, bleacher, equipment room and storage area. The all-turf softball field facility will also have double-wide batting cages and bullpen, new scoreboard, netted backstop and storage area. “We are promoting lifelong physical fitness as well as joint-use projects,” Tennenbaum said. “The aquatics center will provide the only two outdoor pool facilities in the county.”

Career training another top priority

Students at SBHS have already been able to utilize many other campus upgrades, none more

impactful than the multifaceted Career Technical Education Classroom Building, which allows for students to work hands-on in the fields of automotive, metal shop, wood shop, mechanics and ag mechanics. “We have 17 different CTE pathways from culinary arts to auto shop. We’re really proud of that,” Tennenbaum said. Other completed projects over the last two years alone include the new weight room and wrestling room, outdoor tennis courts and parking lot, main special education facility, campus-wide HVAC installation, skylight at Mattson Gym and communication, technology and electrical infrastructure upgrades. On the horizon for SBHS are projects that include an Associated Student Body and Student Union Building and a multi-purpose room, kitchen and cafeteria.

The synthetic allweather track and field stadium will have locker room and restroom buildings with an extended parking lot, entry structure, sports lighting and

FINDINGS: A.Resolution of Intention to Form CFD 2018-1: On August 7, 2018, the Board of Supervisors of the County of San Benito (the “Board”) adopted a resolution entitled “Resolution of Intention to Establish Community Facilities District” (the “Resolution of Intention”), and has conducted proceedings (the “Proceedings”) to establish “County of San Benito Community Facilities District No. 2018-1 (Residential Services)” (the “CFD”) pursuant to the Mello-Roos Community Facilities Act, Chapter 2.5 of Part 1 of Division 2 of Title 5, commencing with Section 53311, of the California Government Code (the “Act”) to levy a special tax (the “Special Tax”) to finance certain public services (the “Services) as provided in the Act. B. Public Hearing: Pursuant to notice as specified in the Act, and as part of the Proceedings, the Board has held a public hearing under the Act relative to the determination to proceed with the formation of the CFD and the rate and method of apportionment of the Special Tax to be levied within the CFD to finance the Services, and at such hearing all persons desiring to be heard on all matters pertaining to the formation of the CFD and the levy of the Special Tax were heard, substantial evidence was presented and considered by this Board and a full and fair hearing was held. C. D. Special Election: On September 25, 2018 a special election was held among the landowners within the CFD at which such landowners approved the levy of the Special Tax by the two-thirds vote required by the Act, which approval has been confirmed by resolution of this Board. SECTION 2: Based on the foregoing, the Board hereby authorizes and levies the Special Tax on all of the parcels within the CFD pursuant to the Act, at the rate and in accordance with the rate and method of apportionment of Special Tax (“Rate and Method of Apportionment”) on file with the Clerk of the Board and as approved in the Resolution of Formation. By this reference, both the Resolution of Intention and the Resolution of Formation are incorporated herein. The Special Tax is hereby levied commencing in fiscal year 2018/19 and in each fiscal year thereafter to pay for the Services for the CFD, as contemplated by the Resolution of Formation and the Proceedings and all costs of administering the CFD. In addition, the provisions of Section 53356.1 of the Act shall apply to delinquent Special Tax payments. The County Treasurer is hereby authorized and directed to provide all necessary information to the auditor/tax collector of the County of San Benito in order to effect proper billing and collection of the Special Tax, so that the Special Tax shall be included on the secured property tax roll of the County of San Benito for fiscal year 2018/19 and for each fiscal year thereafter until no longer required to pay for the Services or until otherwise terminated by the County. SECTION 7. If for any reason any portion of this ordinance is found to be invalid, or if the Special Tax is found inapplicable to any particular parcel within the CFD, by a court of competent jurisdiction, the balance of this ordinance and the application of the Special Tax to the remaining parcels within the CFD shall not be affected. READY TO BLOCK Camille Finley, a former San Benito High standout, is enjoying another fine season playing middle blocker for Gavilan College. The Rams entered the week ranked No. 2 in the state and are loaded with a talented and deep roster featuring several local players.

Late in the second set of last Friday’s match, Kevin Kramer sat quietly on a chair and stared ahead. The Gavilan College women’s volleyball coach was rather comfortable, with the Rams in total control of the match. Gavilan’s three-game sweep of Ohlone of Fremont— game scores were 25-20, 25-18, 25-12—represented an accurate picture of the team’s season in that it has made short work of the majority of its opponents this season. The win improved Gavilan’s record to 20-1 overall and 5-0 in Coast Conference play. Out of its 20 victories, 14 have come in three game sweeps. Now that’s what you call domination. “Sometimes we get better competition in practice than in games,” said sophomore middle Camille Finley, a former San Benito High standout. “That’s what makes being on this team fun. It’s been a great experience playing with a fun group of girls.” It helps that the Rams are loaded in talent and depth, going at least two deep at every single position. Often times when

coaches say starting spots are open for competition during the season, they simply are looking to keep their starters from getting complacent. However, when Kramer says players are battling for starting roles in practice, he has the luxury of meaning it because the next player in line is good enough to start for most other teams. “The nice thing about having a bunch of good players is you can go to somebody else to get the job done if someone is struggling or if you’re dealing with injuries,” Kramer said. If the Rams can stay healthy, they’ll have an excellent chance to go down as the greatest team in program history. Two years after advancing to the California Community College State Final Eight Championships, Gavilan is poised to do it again this season with arguably its greatest assembly of talent ever. “The girls have been working extremely hard on that (chemistry) and you can see it they’re here to win, compete and move on,” Kramer said. “Those three things kind of trump everything else right now.” Translation: The Rams mean business. Against a solid Ohlone team that came into the match undefeated in conference action, the Rams were clearly on another level. The Renegades kept things close in the first set before Gavilan steamrolled the home side in the final two games. In Game 2, Gavilan displayed

its impressive skill set and determination. With the game tied at 6-6, Charlotte Cannizzaro, a 6-foot-1 freshman outside hitter, went up for an attack on the left side. However, the set was a bit off and Cannizzaro had to adjust in mid-air as the ball sailed over her head. No matter. Cannizzaro did her best Gumby impression and reached back at full extension and somehow getting enough on the ball while hitting it from

her sideline to the Ohlone sideline, a crosscourt shot that defied description. Midway through the game, the Rams were involved in a long rally, which Teresa Ochoa punctuated with a kill. Finley had two blocks during the point and Mikeila Banda produced an incredible dig to set up Ochoa’s winning attack. Finley was a force at the net, recording four solo blocks in the final two games. Kieley Hoskins (San Benito) has been a difference-maker at setter, running the offense with precision. Black got a taste of the varsity when she basically moonlighted as a junior varsity and varsity player toward the end of last season. Black would play a JV match before joining the varsity and watching the squad from the bench. “Watching the players’ spirits and their attitudes kind of helped in terms of setting the tone for this season,” she said. “At the beginning of the season it was kind of scary being on the varsity even though I was not new to the sport. Varsity players are set to a higher standard, so it took a week (into the regular season) for me to get comfortable and for the girls to bond really quickly. They made things easier for me to get adjusted.” Black has made a connection with Balers setter Maya Garcia after practicing together for hundreds of hours since the summer started. “Before each set, we make sure to talk it up and communicate to make sure we’re on the same page,” Black said. “Whenever different plays come

Roxanne Black has come a long way since her youth playing soccer days. A junior middle blocker on the San Benito High girls volleyball team, Black went through a period of her life in which she felt uncoordinated—like most tall teens who experience growth spurts—with many unglamorous moments happening on the sports field. “I remember tripping over myself while playing soccer,” said Black, who grew up playing soccer and softball before taking up volleyball. “I’ve developed quite a lot since I started playing volleyball. I used to play at Rancho San Justo and remember being super slow and going the wrong way and stuff like that. Now I’ve improved to the point where I know where to go before the ball is set. I can read where the play is going.” Indeed, Black has been a strong presence at the net

this season for a San Benito team that entered the week at 8-2 in the Pacific Coast League’s Gabilan Division, tied for second place with Carmel. Black hits the ball with authority and provides a strong block, two key factors in the Balers’ success. Black said her best match came on Sept. 6 against St. Francis of Mountain View, which is a perennial Northern California powerhouse. Even though the Balers lost in three games, Black felt excited to play against premier competition. “I remember playing really well and getting a lot of good quick side outs and quick hits,” she said. “I felt I played really well.” Before the season started, Black made it a goal to maximize her talent by giving her best effort in practices and matches. “I wanted to see an improvement in each practice,” she said. “Let’s say I’m going to work on blocking, hitting or tipping. The goal is to have a goal within each area each day. I feel like I’m doing well mechanically hitting on threes and ones and blocking.” In volleyball terminology, a three means hitting a quick set about halfway between

She knows where I’m going to be at and I know where she is going to set the ball.” For Black, volleyball is more than just a sport—it’s a place where she can go to get away from life’s daily grinds, a stress buster and overall mood enhancer. “Volleyball is always a good experience,” she said. “If I’m mad, I can go to practice and take it out on the ball. It’s my go-to place and from the moment I

started playing the sport, I immediately connected with it.” Volleyball has also helped Black give her best in everything off the court, including academics. “School in general has been a challenge, and volleyball has taught me to push through life and especially school,” she said. “I’ve kind of had average grades, but when I started volleyball, it made me think a lot more on how to push through and to focus on one

thing at a time.” Black’s older brother, Baxter, is a former San Benito High athlete who is now playing baseball at Hartnell College. Growing up, Roxanne and Baxter went to San Juan School to play catch and throw the baseball around, and Roxanne pointed to those moments as key in her overall athletic development and mindset. “He pushed me to be a better athlete and better person,” she said.

develop into a tour de force. “She’s gotten so much better since high school it’s insane,” Weiby said. “The great thing about playing here is if you put the work in, you’re going to

improve. I’ve improved a lot and noticed the difference in my attacking because I’m a lot more aggressive and able to put balls down more.” Injuries are the biggest concern for the team right now. Players’ joints take a

pounding as they constantly jump up and down on the hardwood, so Kramer said the biggest goal currently is to have everyone healthy and up and running within the next week. Gavilan’s only loss of the season came in a Sept. 26

match against Cabrillo, the premier program in Northern California that has not lost to a North team since 2009. The last team to beat Cabrillo? None other than Gavilan. Kramer said the loss to Cabrillo served a useful purpose.

“I don’t know if there ever is a good loss, but it was a good moment for us to take something out of that,” he said. “Cabrillo played a great match and it opened our eyes to remind us we better come to work everyday and get better.”

It’s a good thing the Rams have intense and competitive practices because they’re not likely to receive much of it the rest of the way in conference play. “We just have to remember anything can happen,” Finley said.

You will be bidding on a lien, not on the property itself. Placing the highest bid at a trustee auction does not automatically entitle you to free and clear ownership of the property. You should also be aware that the lien being auctioned off may be a junior lien. If you are the highest bidder at the auction, you are or may be responsible for paying off all liens senior to the lien being auctioned off, before you can receive clear title to the property. You are encouraged to investigate the existence, priority, and size of outstanding liens that may exist on this property by contacting the county recorder’s office or a title insurance company, either of which may charge you a fee for this information. If you consult either of these resources, you should be aware that the same lender may hold more than one mortgage or deed of trust on the property. NOTICE TO PROPERTY OWNER: The sale date shown on this notice of sale may be postponed one or more times by the mortgagee, beneficiary, trustee, or a court, pursuant to Section 2924g of the California Civil Code. The law requires that information about trustee sale postponements be made available to you and to the public, as a courtesy to those not present at the sale. If you wish to learn whether your sale date has been postponed, and, if applicable, the rescheduled time and date for the sale of this property, you may call 800-280-2832 for information regarding the trustee’s sale or visit this Internet Web site http://www. qualityloan.com, using the file number assigned to this foreclosure by the Trustee: CA-18-830178-BF. Information about postponements that are very short in duration or that occur close in time to the scheduled sale may not immediately be reflected in the telephone information or on the Internet Web site. The best way to verify postponement information is to attend the scheduled sale. The undersigned Trustee disclaims any liability for any incorrectness of the property address or other common designation, if any, shown herein. If no street address or other common designation is shown, directions to the location of the property may be obtained by sending a written request to the beneficiary within 10 days of the date of first publication of this Notice of Sale. If the sale is set aside for any reason, including if the Trustee is unable to convey title, the Purchaser at the sale shall be entitled only to a return of the monies paid to the Trustee. This shall be the Purchaser’s sole and exclusive remedy. The purchaser shall have no further recourse against the Trustor, the Trustee, the Beneficiary, the Beneficiary’s Agent, or the Beneficiary’s Attorney. If you have previously been discharged through bankruptcy, you may have been released of personal liability for this loan in which case this letter is intended to exercise the note holders right’s against the real property only.
