The U.S. Environmental Protection Agency announced Dec. 13 that it has reached a settlement with Buckhorn Inc., ordering the Ohio company to study, then clean up mercury contamination at a federal Superfund site in the southeast corner of San Benito County. The initial investigation work is expected to take over two years to complete at a cost of approximately $2 million, according to the EPA. Under the Superfund law, Buckhorn will be responsible for all costs of the investigation and eventual cleanup of the New Idria Mercury Mine, which operated from 1854 to 1972. Contaminants from the mine site have been fouling San Carlos Creek and threatening the San Joaquin River watershed for decades. Congressional approval of a new five-year Farm Bill on Dec. 12 that is headed to the President’s desk this week needed strong bipartisan

support, and agreement from House Republicans to drop proposed food-stamp work requirements. President Donald Trump hinted that he would sign the farm bill this week. Congressman Jimmy Panetta, a leader of a bipartisan efforts in Congress and a member of the House Agriculture Committee played a role in the outcome.

Panetta, whose 20th District includes San Benito and Monterey counties and half of the City of Gilroy, is a member of the House Agriculture Committee, where his influence will get a boost when the new Democratic majority of the U.S. House of Representatives is sworn in next month. Panetta said in a statement that “Passage of

the 2018 Farm Bill, with strong bipartisan support, fulfills a promise to our farmers, rural communities and neighbors who need assistance putting food on the table.” “As the proud representative of the Salad Bowl of the World, I have worked to create a Farm Bill that promotes the specialty crop and organic sectors, expands opportunities for

beginning farmers, invests in agricultural research, and increases access to nutritious fresh fruits and vegetables,” he said. Hollister Police helped make the holidays brighter for scores of local children who received new donated bicycles through officers’ charity efforts. On Dec. 1, several Hollister Police Department personnel and Police Explorers attended a bicycle building event in San Jose, hosted by the nonprofit Turning Wheels for Kids. During the Dec. 1 event, more than 1,000 volunteers put together more than 2,400 new bicycles, which were in turn donated to children in Santa Clara and San Benito counties. The event resulted in more than 80 bicycles donated to kids in the Hollister area, through the

Hollister Police Department. The department reached out to teachers from Hollister schools to nominate students who they thought would benefit from a new bike this Christmas. All the children’s names were entered, and 80 names were randomly selected through a raffle to visit the Hollister Police Department on Apollo Way to retrieve their new bike. Hollister Community Services Officer Alex Oropeza, School Resource Officer Theresa Aguilera, CSO Patrick Kennedy, Lt. Dan Winn, Explorer Coordinator Officer Staci Esqueda and all the Hollister Police Explorers helped give away the bikes. Members of the Hollister Recreation Department assisted by helping fit each child with an appropriate helmet. Turning Wheels for Kids is a non-profit organization dedicated to providing new bikes to children.

Beware of season’s telephone scams POLICE SAY CALLS FROM THE IRS ARE ATTEMPT TO STEAL FROM THE UNSUSPECTING Bryce Stoepfel Reporter

You might think of them as the anti-Santa Clauses. Scammers. They're watching, waiting and given the opportunity, they'll make their holidays bright at your expense. But, with good

sense, and with some tips from police and the AARP, there's help to stop you from paying for someone else's Christmas shopping. Their most straightforward advice is to use a little common sense. "If it sounds too good to be true, it probably is," said one police official. Phone scams are common, where the scammer uses “spoofing,” or fake phone numbers to make it seem that the caller is

local. One of the most common types of phone scams is fake calls from scammers claiming to be from the IRS, threatening to arrest the victim if they don’t pay their taxes. The IRS isn't going to come to your house and arrest you for not paying taxes, said police. No government agency or legitimate business is going to request or demand payment in gift cards, they said. Since the '50s the

AARP has fought to advance and protect the interest of older Americans, who are often the target of scammers. As online purchases soar during the Christmas shopping season, online scams increase as well. The AARP warns customers to avoid steeply discounted items meant lure shoppers into fake online sales and to always rely on popular websites with strong safety records. Seasonal job seekers

are also often the targets of scammers, and since more than 500,000 people take seasonal jobs, there are plenty of targets. Scammers will pose as potential employees, using fake websites to gather the victim’s personal information to steal their identity. The biggest red flag are jobs that offer a lot of money for very little work. If the job looks too good to be true, it probably is. In winter scammers

claiming to be from utility companies use threats of shutting off power, water or heat unless the victim pays up. Scammers will insist that the victim did not pay their bill, and through fear tactics, they can extract money or personal information. The AARP recommends that potential victims hang up immediately when they get these calls and to call their utility provider to confirm their billing status.

Three new Hollister City Council members took their oaths of office at the Dec. 10 council meeting, ushering a new wave of leadership for the city. Ignacio Velazquez was sworn in once again as mayor, while new council members Rolan Resendiz, Honor Spencer and Marty Richman took their seats in Districts 2, 3 and 4, respectively. Each outgoing council member was presented with a plaque by Velazquez and took a few moments to address supporters, family and friends. Mickie Solorio Luna, who is being succeeded by Rolan Resendiz in District 2, shared thoughts about her term on the council. “Some people have said to me, ‘Mickie, you don’t look upset at all about not being re-elected,’ and I said, ‘You know what? I have give 34 years of my life to the city, to the community, and I will continue to be an advocate,” Luna said. “It’s been a real trip, and let me tell you, I’m here to help anybody, and I don’t hold grudges against anybody.” District 4 Councilmember Jim Gillio, who will be taking Jerry Muenzer’s San Benito County Supervisor seat,had been appointed to his council seat a year and a half ago. He told the crowd at the meeting, “This quote from John F. Kennedy, I think, is particularly poignant

‘Cap and trade’ deal helps the polluters

A

controversial deal struck last year handed oil companies and other major polluters a multimillion-dollar windfall—a giveaway to industry. “It sends the wrong message at the exact time climate leaders were in Poland trying to increase global ambition to curb emissions,” said state Sen. Bob Wieckowski, a Fremont Democrat. “This decision moves us backward and reduces future revenue to curb emissions.” The 2017 deal for subsidies worth as much as $350 million rescued a cliffhanger vote in the Legislature that extended the state’s cap and trade program to 2030. Under cap and trade, industries may pay to pollute by buying allowances in a carbon-trading market. In addition, some receive free allowances from the state. The state Air Resources Board’s staff originally recommended a reduction in free allowances, as called for in the program’s design. But on Dec. 13, as the board set its plan for implementing the cap-and-trade extension, it voted to maintain a full supply of free carbon credits to some companies. That vote adopted recommendations from a later staff report. The move assures industry the maximum state assistance through 2020. The cap-andtrade extension guarantees that level of help from 2021 to 2030. At the same time, officials acknowledged that the cap-and-trade system for cutting greenhouse gases is in danger of not delivering the state’s required emissions reductions—a possibility many experts have warned about as companies have banked their pollution credits for later use. The board affirmed its view that there is no excess supply of allowances and other credits in the cap-and-trade market. But the nonpartisan Legislative Analyst’s Office, academics and market experts have concluded that companies are holding too many credits and could use them to cover future emissions rather than reduce their pollution.

A months-long debate over the issue has exposed a vulnerability in the system’s design. In its early incarnation, the cap-andtrade system was not considered a main factor in reducing state emissions; rather, it was intended to backstop other programs aimed at cutting climate-warming pollution. The air board now expects the program to provide as many as half of those reductions, amplifying cap and trade’s expected benefits and putting pressure on the program to work as designed in order to meet the state’s ambitious climate goals. An oversupply could impede that. The Legislative Analyst foresees a reckoning, estimating that because of excess allowances, actual emissions could be as much as 30 percent over the statewide target by 2030. “The analytical integrity of what the staff has put forward does not meet the standard set by state law,” observed Danny Cullenward, an economist with the climate-change think tank Near Zero. While California has generally exceeded its own goals for cutting greenhouse gas emissions, lowering them further—and more steeply—will be a challenge. The deadline for reducing emissions to 1990 levels by 2020 has already been met. What lies ahead are reductions to 40 percent of 1990 levels by 2030 and 80 percent by 2050. Some of the issues dogging the board stem from the deal brokered by California’s powerful oil and gas interests, which crafted business-friendly language in the cap-andtrade extension law. Among the concessions were removing the ability of local air districts to regulate industrial emissions, and guaranteeing to industry that allowances would remain at the highest possible level. Given that difficulty, it is time for renewed focus on ensuring that the system doesn’t let polluters off the hook. The transition does not lessen all our responsibility to continue to be fire safe. Continue to maintain and or create a defensible space around your home before the 2019 peak wildfire season is upon us. CAL FIRE will continue to maintain staffing to meet any potential threat, as well as maintaining the ability to strategically move resources to areas that remain at a higher threat level. CAL FIRE will also continue to monitor weather conditions closely and still has the ability to increase staffing should weather conditions change or if there is a need to support wildfires or other emergencies in other areas of the state. The 2018 fire season has been an extremely active year, even more so than in 2017. This year we have seen the deadliest, the most destructive, the largest wildfire and most acres burned throughout the state in California’s recorded history. Statewide, CAL FIRE and firefighters from many local and state agencies responded to more than 6,228 wildfires that burned 876,124 acres. During the cooler winter months, CAL FIRE will continue to actively focus efforts on fire prevention and fuels treatment activities as guided by the state’s Strategic Fire Plan and localized fire plans. These will be done through public education, prescribed burns and various types of fuel reduction. PROTECTING NEIGHBORHOODS FROM THE THREAT OF WILDFIRES

With new wildfires threatening our local communities, PG&E is partnering with our customers in high fire-threat areas to accelerate and expand our vegetation management work. We will be examining and addressing critical vegetation across 7,100 miles of power lines. The 2018 wildfire season is already one of the worst on record — with more than 1.5 million acres burned and more than 1,000 homes lost. And it’s not over yet. With the wildfire risk increasing at an alarming pace, the 2018 wildfire activity is on track to exceed the 2017 wildfire season, which was the most destructive on record. In order to keep our neighborhoods safe, PG&E may need to trim or remove vegetation on or near properties in high firethreat areas. PG&E’s action plan includes the following steps: ■ Step 1: Our safety inspectors will be in your neighborhood to determine what vegetation may need to be trimmed or removed. ■ Step 2: If needed, we will mark trees that need to be addressed and contact you to discuss the results of the safety inspection. ■ Step 3: We will perform safety work shortly after the inspection. ■ Step 4: We will plan to begin wood debris removal within a few weeks after completion of the safety work (unless you would like to keep it).

town that grew up around it is now a ghost town with more than 100 standing buildings, though vandalism has contributed to their deterioration in recent years. Buckhorn Inc., subsidiary of Myers Industries and a reusable plastic packaging manufacturer based in Millford, Ohio, is the successor to the New Idria Mining and Chemical Company, a former owner and operator of the New Idria Mercury Mine. The mine, located 64 miles southeast of Hollister, produced more than 38 million pounds of mercury in its 118-year history. Under the agreement, Buckhorn is to investigate the extent of contamination at the abandoned mine to identify potential human health and environmental risks. The results will become the basis of a feasibility study with options for

cleaning up the site under EPA oversight. Operations at the New Idria Mercury Mine deposited between 0.5 and 2 million tons of waste rock, calcines and tailings, covering more than 40 acres at the site. EPA said it and Buckhorn have taken recent steps to minimize release of contaminants from the site, but added that in a statement that years of mercury pollution and mine drainage have contaminated San Carlos Creek and its sediments with levels of mercury toxic to aquatic organisms. During periods of heavy precipitation, floodwaters wash these contaminated sediments downstream, where they may reach the Mendota Pool and San Joaquin River, which flows into San Francisco Bay.

At one point, the Idria mine was the largest operating mercury mine in the country. “The legacy of abandoned mines threatens public health and natural resources in California,” said EPA Pacific Southwest regional administrator Mike Stoker in a statement. “After the feasibility study is complete, EPA will select a final remedy and work toward the ultimate cleanup, protecting important waterways from mercury and other pollutants.” The New Idria Mercury Mine was named in honor of the world's second-largest quicksilver mine in Idrija, Slovenia. Stanford gives Sills early acceptance

he described the variety of influences in his life— moving from high-tech San Jose to big ag Hollister—and also took great pride in identifying as “biracial.” Sills is the son to a first-generation Mexican mother and a Caucasian father, something he said epitomizes the “bicultural” Hollister community. “Moving from Silicon Valley to a small ag town and being biracial, it really helped me in my life,” said Sills, a third-degree black belt who competed as a hurdler on the Baler track team. “I’d really like to thank my high school for being such a great catalyst for my development. It’s through opportunities and great people I’ve met in high school that I was really able to accomplish this.”

San Benito High School senior Ian Sills recently huddled with his parents and three younger siblings in front of his computer screen so they could all share in his once-in-a-lifetime moment. The 17-year-old was about to click the mouse to find out if he had been accepted to his top college choice. Early acceptance into Stanford University had been a dream of Sills since he was 10 years old, so he described the build-up to finding out his future as “strange and surreal.” Sills logged into his

online application account with his family looking over his shoulder, and immediately saw the response he wanted. “The first word was ‘Congratulations,’” he said. “It was really a surreal moment.” It was an early Christmas present for Sills, who submitted his application to Stanford prior to the Nov. 1 cutoff for “early action” consideration. “It definitely feels like the weight of the world lifted off my shoulders,” said Sills, vice president of his high school’s Associated Student Body who is ranked third in his class with a 4.5 cumulative GPA. Along with filling out the common application for private schools, Sills authored a personal statement essay. In that,

San Benito still on FDA’s lettuce list SANTA BARBARA FARM RECALLS ITS RED LEAF LETTUCE AND CAULIFLOWER Barry Holtzclaw Managing Editor

The U.S. Food and Drug Administration announced Dec. 13 that it had identified “a positive sample result for the outbreak strain in the sediment of a local irrigation reservoir used by a single farm owned and operated by Adam Bros. Farms in Santa Barbara County.” Federal and state investigators on Dec. 17 narrowed their nationwide search for

the source of romaine lettuce contamination from six to just three California counties—San Benito, Monterey and Santa Barbara counties. Monterey County, the nation’s largest lettuce producer, and San Benito County were still on the list as the search continued into its fourth week because federal officials still contended that “the outbreak cannot be explained by a single farm, grower, harvester or distributor.” Also on Dec. 17, Adam Bros. Farming of Santa Maria announced it was recalling red leaf lettuce, green leaf lettuce and cauliflower

harvested at its farm in late November “out of an abundance of caution.” The farm said none of these products have tested positive for E. coli so far, and no illnesses have been reported. The FDA said it will be sending investigators back to this farm for further sampling. “It’s important to note that although this is an important piece of information, the finding on this farm doesn’t explain all illnesses and our traceback investigation will continue as we narrow down what commonalities this farm may have with other farms that are part of our investigation,” the

agency said in a statement. “While the analysis of the strain found in the people who got ill and the sediment in one of this farm’s water sources is a genetic match, our traceback work suggests that additional romaine lettuce shipped from other farms could also likely be implicated in the outbreak.” “Therefore, the water from the reservoir on this single farm doesn’t fully explain what the common source of the contamination. We are continuing to investigate what commonalities there could be from multiple farms in the region that could explain

this finding in the water, and potentially the ultimate source of the outbreak.” In a statement, the Food and Drug Administration said, “Traceback information from five restaurants in four different states so far has implicated 11 different distributors, 9 different growers and 8 different farms as potential sources of the contaminated lettuce.” The agency, which is coordinating the probe in California with the Centers for Disease Control and the California departments of public health and food and agriculture, said its probe is continuing.

The FDA reported that on-site investigations of farms and lettuce cooling facilities in the Central Coast collected samples of romaine lettuce, soil, water, and scat (animal droppings), and found no evidence of the E.coli strain. Results of water testing being conducted by CDC are pending. The FDA announced last week that both the United States and Canada are seeing increasing numbers of people confirmed with infections from the outbreak strain of E. coli O157:H7. Neither country has reported any confirmed deaths.

SC County is only bid for St. Louise

Santa Clara County emerged this month as the sole bidder for O’Connor and Saint Louise hospitals, clearing the way for the county to buy the two private hospitals for $235 million, County Executive Jeff Smith disclosed Monday. “We are really excited, and we’re ready to go,” Smith told the Gilroy Dispatch Monday. “There is nothing that can derail it.” Smith said the county, anticipating this month’s news, had been laying the groundwork for its expanded healthcare system for weeks and now will be on a fast track, which Smith hopes will ensure a smooth transition to a three-hospital system in less than three months. Once the deal closes, the 129-year-old O’Connor Hospital in San Jose and the 29-year-old Saint Louise Regional Hospital in Gilroy will join the 142-year-old Valley Medical Center in a significantly expanded publicly owned and managed healthcare system. The new three-hospital system will increase the number of hospital beds by nearly 80 percent, increase medical staff by 70 percent and boost total employees by nearly 40 percent, according to the county. Smith said the county has already created more than 2,000 new positions, ready to be filled initially by existing O’Connor and Saint Louise employees, who will be hired as “provisional employees in permanent positions.” He expects the deal to close in late February.

Smith said patients at the two Verity-owned hospitals will see few immediate changes with the new ownership. “Patients will see the same nurses, the same staff doctors—they won’t see much, if any, change at all,” he said. He said the hospitals will accept the same health insurance carriers. The county executive said he expects a federal bankruptcy judge to finalize the county purchase on Dec.19, and the escrow period to close by the end of February. The county offered to buy the hospitals in late July, after Verity Health announced it was seeking suitors and one month before Verity filed for Chapter 11 bankruptcy protection. In October, Santa Clara County’s offer of $235

million was identified as a “stalking horse bid” in a highly anticipated bidding race that never got out of the starting gate. A Dec. 5 deadline passed with no competing bids for the two Santa Clara County hospitals, eliminating the need for an auction this month in U.S. Bankruptcy Court in Los Angeles. Verity and its hospitals in August filed voluntary petitions for protection under Chapter 11 of the U.S. Bankruptcy Code, for the stated purpose of facilitating a courtsupervised sale of some or all of the hospitals. Saint Louise Regional Hospital is located on the north side of Gilroy, and O’Connor Hospital is in San Jose, located less than two miles from Valley Medical Center.

Verity Health owns the two Santa Clara County hospitals, plus two in San Mateo County and two in Los Angeles. The company had posted no information or released any statement as of Dec. 10 about the sale of the two hospitals to Santa Clara County. The O’Connor and Saint Louise employees will retain their jobs, but Smith said all union contracts with Verity Health will be voided, with the new employees represented by the current collective bargaining agreements already in place in Santa Clara County. The bankruptcy court will be deciding how much, if any, payment Saint Louise and O’Connor employees will receive in a payout of their pensions. Smith said the employees will

enter the California Public Employees’ Retirement System as new employees, regardless of seniority. He said the union contracts and pensions have to be different, because federal and state labor and pension laws differ between public and private employees. Smith said the county is talking with employees and unions, adding, “We will be speaking with the doctors, and tenants of the buildings” at the hospital campuses. The first-year costs in connection with the hospital purchase will be expensive, perhaps exceeding the purchase price of the two hospitals, Smith estimated. However, he said these expenses will be defrayed by income from

the two hospitals. The county will sell “lease revenue bonds” to finance the purchase, a mechanism already authorized by the Board of Supervisors. Smith described this as a kind of mortgage, for which payments would be about $15 million per year. Smith is optimistic about the financial health of the two hospitals, because Medicare reimbursement formulas provide more money for medical bills at publicly owned hospitals than for private hospitals. “Now that the future is more stable, we know there is never going to be a cloud over these hospitals, and there is going to be a stable owner,” said Smith. “Then we can build the system back up and provide more services.”

NOTICE IS HEREBY GIVEN that on December 12, 2018, the San Benito County Board of Supervisors adopted Ordinance 974, regulating Cannabis Business zoning by amending Sections 25.07.005, 25.17.023, 25.17.044 and 25.17.063 of the San Benito County Code.

NOTICE IS HEREBY GIVEN that on December 12, 2018, the San Benito County Board of Supervisors adopted Ordinance 976, regulating Cannabis Businesses by amending Chapter 7.02 of the San Benito County Code.

Applicant/Proponent: San Benito County. Location: San Benito County (county-wide), unincorporated area. Environmental Review. Exempt, including but not limited to, California Business and Professions Code section 26055, subd. (h) and State CEQA Guidelines section 15308. The ordinance allows certain commercial cannabis activity within the unincorporated area of the County subject to a valid State License and valid Cannabis Business Permit issued by the County to qualified cannabis businesses. Amended Chapter 7.02 categorizes commercial cannabis activities into six (6) permit types and requires each person or entity to obtain a separate Cannabis Business Permit for each fixed location in which the commercial cannabis activity is to occur and for each type of commercial cannabis activity noted below prior to commencing operations. The six Cannabis Business Permit types are as follows: Cultivation (indoor or mixed-light only, including nurseries), Distribution, Laboratory Testing, Manufacturing (Volatile and Non-Volatile), Microbusiness (Non-Retail), and Retail (Out-of-County delivery only). In addition, amended Ch. 7.02 prohibits all of the following: any outdoor cultivation of cannabis, microbusinesses with a retail component, and retail (storefront and on-storefront). However, State-Licensed out-of-county delivery services holding a valid authorization from the jurisdiction of origin would be allowed to deliver cannabis within the unincorporated area of the County so long as they obtain a valid Cannabis Business Permit from the County. Amended Chapter 7.02 sets forth the application, evaluation, issuance, and denial/non-renewal/ suspension/revocation processes for both Cannabis Business Permits and Cannabis Employee Work Permits. Finally, amended Chapter 7.02 sets for an appeal procedure for decisions regarding the issuance and/or conditions of the permit. Under amended Chapter 7.02, Cannabis Business Permit application availability may vary depending on whether the commercial cannabis activity is prohibited or limited, e.g., cultivation is limited to fifty (50). All Cannabis Business Permits shall be issued upon payment of fees in full and shall be valid for twelve months from the date of issuance, unless suspended or revoked. Amended Ch. 7.02 deems each and every violation of its provisions unlawful and a public nuisance.

In addition to whipping Seaside, the Balers lost to Alvarez 66-63 in the Palma Tournament and are 1-1 against Christopher this season, losing to the Cougars in the teams’ first game before exacting payback in the Bob Hagen Tournament, a 53-47 win on Dec. 8. The race for the championship promises to come down to the regular-season finale, and the Balers must be at their best if they expect to win the championship. They seemingly have what it takes to do just that, combining strong shooting, tough defense and a commitment to play hard on every possession. Yeager has liked what he’s seen from his teammates. “Matt has really been big for us this year because he’s all over the boards and is scoring on the offensive end, which helps us a lot,” Yeager said. “He was a really big factor in helping us win against Christopher by scoring under the rim.” Yeager also played a vital role against Christopher, nailing four 3-pointers in the fourth quarter to give the Balers the lead for good. Yeager has done well moving off the ball as he has received solid screens from his teammates to get open looks at the basket. “My role on this team

All three players possess a strong basketball acumen, something that will be key especially in the league season when mistakes must be minimized. Burley is the team’s best player at getting to the basket off dribble penetration, and Campo knows how to create space and find an open spot on the floor to get good looks at the basket. Both players have solid mid-range games, one of the dying arts in basketball today. San Benito went 13 for 35 from 3-point range (37 percent) against Seaside, a solid percentage and something it is capable of sustaining for the rest of the season. Of course, teams can also die by the 3-point shot, so the Balers must be wary of relying on that shot when it’s not falling. In the rare moments when the starting five is not getting the job done or simply needs a breather, Butler has plenty of players on the bench who can come in and pick up the slack, or in intense games, give the starters a breather. Marcus Aranda provided toughness in the paint against Seaside, while Chris Jurevich and Daniel Miskin connected on 3-pointers as the Balers finished with 11 3-pointers. He’s gone to Las Vegas, Seattle and Arizona to race (in addition to local tracks in Sonoma and Sacramento).” So does Jordan ever feel the need for speed? You bet. Yeager said he’ll most likely take a crack at race car driving in the future. “I always said to my dad that I wanted to get a racing license,” Yeager

said. “But he wanted me to focus on school and baseball mostly, and worry about racing when I’m done with school. That’s a good plan because there are still many things I want to accomplish.” Mark and Yeager’s uncle, Paul DeHaro, are the CEO and president, respectively, of West Coast Architectural Sheet Metal, a highly successful architectural sheet metal company based in San Jose. Yeager plans on working for the company in the future, with the possibility of taking over the reins

from his dad and uncle if he shows the same desire and skills in the business as he does on the court or on the mound. In the off-season, Yeager spent a lot of time on baseball, however, he also made sure to stay sharp basketball-wise by going to Burley’s house, which has a nice half-court setup in the backyard. After playing two games this week—the first against Gunderson and the second against North Monterey County—the Balers don’t have another game until Jan. 4 against Salinas.

Amended Chapter 7.02 categorizes commercial cannabis activities into six (6) permit types and requires each person or entity to obtain a separate Cannabis Business Permit for each fixed location in which the commercial cannabis activity is to occur and for each type of commercial cannabis activity noted below prior to commencing operations. The six Cannabis Business Permit types are as follows: Cultivation (indoor or mixed-light only, including nurseries), Distribution, Laboratory Testing, Manufacturing (Volatile and Non-Volatile), Microbusiness (Non-Retail), and Retail (Out-of-County delivery only). In addition, amended Ch. 7.02 prohibits all of the following: any outdoor cultivation of cannabis, microbusinesses with a retail component, and retail (storefront and on-storefront). However, State-Licensed out-of-county delivery services holding a valid authorization from the jurisdiction of origin would be allowed to deliver cannabis within the unincorporated area of the County so long as they obtain a valid Cannabis Business Permit from the County. Amended Chapter 7.02 sets forth the application, evaluation, issuance, and denial/non-renewal/ suspension/revocation processes for both Cannabis Business Permits and Cannabis Employee Work Permits. Finally, amended Chapter 7.02 sets for an appeal procedure for decisions regarding the issuance and/or conditions of the permit. Under amended Chapter 7.02, Cannabis Business Permit application availability may vary depending on whether the commercial cannabis activity is prohibited or limited, e.g., cultivation is limited to fifty (50). All Cannabis Business Permits shall be issued upon payment of fees in full and shall be valid for twelve months from the date of issuance, unless suspended or revoked.
