By the end of the day Jan. 7, Hollister School District’s new superintendent Diego Ochoa had already introduced himself to the community with a meet-and-greet at the district office. By the end of the day Jan. 8, Ochoa—who emerged as the sole finalist among a pool of nearly 50 candidates identified by a search firm—had his contract officially ratified by the district’s school board. The five-member board announced the hiring late last month. “President Stephen Kain is pleased to announce that Diego Ochoa is the sole finalist for the superintendent position,” the Dec. 26 release states. Board President Stephen Kain said, “In my more than 30 years of education, I have never met a more qualified person than Mr. Diego Ochoa for the job of superintendent of the Hollister School District. I give him my 100 percent support, and I am

LIFE SKILLS STUDENTS LEARN THE BUSINESS Staff report

San Benito High School’s Life Skills Department has a partnership brewing with

local business Java Express to form the Baler Strong Coffee Company. The campus-based business assists students with special needs in developing and practicing social norms, communication skills, money-handling and team building, according to staff.

The coffee business, which launched in late 2018, takes email orders from campus clients only, offering coffee, Ghirardelli hot chocolate, hot tea and iced tea, along with a selection of baked goods to teachers, staff and administrators.

Organizers plan to make the Baler Strong coffee available to the public at school sporting events and activities. Special education transition teacher Chalene Hernandez said the company is a revamped version of the Happy Cup

As the federal government shutdown entered its third week with no end in sight, local

farmers and home buyers were already feeling the pinch. If the shutdown continues, a wider range of services will be affected, say Congressional staffers. If you are getting ready to prepare your 2018 federal tax return, the Internal Revenue Service said it was prepared to process returns and refunds at the end of the month. If you are one of

approximately 39,000 federal employees in California who are not getting paid, you may still have to go to work. If you are worried about food stamps, there is only enough money to fund the program through January. The staff of Congressman Jimmy Panetta, whose 20th District includes San Benito County and parts of

Gilroy, prepared a report for the Free Lance as of Jan. 8, the date of President Trump’s televised address to the nation. Here is a summary of the shutdown impact, according to Panetta’s staff: The federal Supplemental Nutrition Assistance Program, SNAP, has enough funding to last through the month. New Year’s Day brought a welcome addition to the Palacios family in Hollister

and the first baby of the New Year to Hazel Hawkins Memorial Hospital. Herman and Mandy Palacios welcomed their son, Herman, Jr., on Jan. 1 at 6:22am. Their little bundle of joy weighed in at 8 pounds, 3.5 ounces, was 21.5 inches long and was delivered by Dr. Ralph Armstrong. The couple originally had expected a Christmas baby. The tiny celebrity is the youngest of

four siblings. He joins his 19-year old brother and his two sisters, ages 14 and 2. The staff in the hospital’s maternal child unit presented the family with a gift basket and gift certificates to celebrate the occasion. Board taps Kain as new president HSD BOARD ADDS SECOND MONTHLY MEETING Scott Forstner Reporter

Retired educator and new trustee Stephen Kain was selected as Hollister School District’s next school board president through 2019 after a split vote in his favor at the annual organization meeting Dec. 18. “It was an honor,” said Kain of being elected president. “Even though I’m a first-time board member, I’ve worked for this

school district for 30 years and dealt with all kinds of issues over those 30 years.” Kain is a former teachers’ union president and classroom instructor who finished out his education career at the district office. That pedigree allows him to understand principal reports, standardized test data, contract negotiations and new school construction among other education issues, Kain explained. “As union president, I’ve attended hundreds of board meetings,” said Kain, who was challenged by trustee Robert Bernosky for the board presidency.

“This is not something new to me. Most things that get brought up I’ve experienced before.” Kain received support from the two other firstterm trustees: Jan Grist, who nominated him, and Carla Torres-Deluna, who seconded Grist’s motion. Meanwhile, Bernosky, who was later unanimously selected as board clerk, was given a vote of support for president by trustee Elizabeth Martinez. Kain and Bernosky engaged in some backand-forth discussion, with both stating their cases for president prior to the roll

call vote that ended 3-2 in Kain’s favor. “I’ve been to more board meetings and done more negotiations over the years and know more about the Hollister School District than anybody here by far,” said Kain at the Dec. 18 meeting.

Board adds second monthly meeting

Also at the Dec. 18 meeting, the Hollister School District Board of Education voted unanimously to add a second monthly meeting through March. The board had been meeting once a month. “We’ve been in such flux

here with [former superintendent] Lisa Andrew leaving so quickly. We have so many things that we need to do, and it’s been very difficult getting them all done in one night,” Kain said. The board will hold meetings on the second and fourth Tuesday of January, February and March, “and if we need to keep doing it, we will. If not, we will go down to once a month after that,” Kain noted. During the board discussion, Bernosky said meetings have been running too late, sometimes until 10:30pm, due to the

number of agenda items crammed into one session. Grist, who wanted to table the vote until new Superintendent Diego Ochoa joins them, said meetings could run more efficiently if public session started on time and if time limits were placed on presentations. “It’s up to the board. Staff will respond to whatever you want,” said Interim Superintendent William Barr prior to the board’s decision at the Dec. 18 meeting. “Our plate is very full right now. It’s a pretty large list. There would be late meetings” if only one was held each month.

Pinnacles is closed

All services for visitors to National Park Service sites, including Pinnacles National Park in San Benito County—its visitors’ center, interpretative programs, and restrooms— have been suspended. The Farm Service Agency, the agency facilitating trade aid payments says that if your payment already processed, you’ll get the payment. The agency can’t take new applications, however, since local FSA offices are closed. Loan applications to small businesses, farmers and non-profits could experience serious delays. Federal Housing Administration (FHA) will see significant delays in loan processing and approvals.

FHA loans stalled

The Federal Housing Administration (FHA) has stopped processing loans and mortgage approvals, putting families trying to buy a new home or refinance an FHA-insured mortgage into financial limbo. In addition, HUD’s Real Estate Assessment Center is not conducting inspections of units to ensure housing is decent, safe and sanitary. Section 8 Housing is not getting funding. Walk-in taxpayer assistance centers and all taxpayer customer service, which serves approximately 2.5 million citizens monthly, is unavailable during the shutdown.

peak, the Centers for Disease Control are not shut down, but the Food and Drug Administration— which is in the midst of a hunt in the Central Coast for sources of romaine lettuce contamination— is partially closed. Calls to the FDA communications office this week went to voicemail. The FDA cannot accept any regulatory submissions and cannot support many routine regulatory and compliance activities. This includes some medical product, animal drug, and most food-related activities. The FDA also cannot conduct routine establishment inspections, which could prevent the finding and correction of violations, especially for food safety.

Market Facilitation Program payments for farm producers that have already certified production with the Farm Service Agency will continue, but registration for the program ends on Jan. 15. Agriculture Secretary Sonny Perdue will determine if the deadline should be extended. You do not need to be finished with harvest to sign up. Farmers have until May 1, 2019, to certify production. A shutdown beyond January would cause the Food and Nutrition Service to reduce benefits by about 40 percent to almost 40 million individuals and families across the country who are dependent on SNAP. Immigration courts are closed, exacerbating the immigration case backlog in San Francisco as court cases are postponed. The Farm Service Agency in Monterey/Santa Cruz Counties is closed.

The Small Business Administration has completely halted its role in the federal contracting process, interfering with projects government-wide. The SBA has also stopped approving loan assistance and guarantee applications from commercial banks and small businesses, blocking access to federally assisted loans for many small businesses. Businesses have lost access to the Department of Homeland Security’s E-Verify program, which is intended to allow business owners to comply with federal law and determine the immigration status of employees they hire. Nearly all Securities

and Exchange Commission employees are furloughed, limiting the agency’s activities to process and approve filings. A prolonged shutdown will require companies to delay mergers, IPOs and other actions, hindering economic activity. Most services provided by the Federal Trade Commission are suspended under the shutdown, including the National Do Not Call Registry (for consumers and telemarketers), consumer complaint systems and identity theft reporting, as well as law enforcement access to FTC’s consumer complaints. In addition, the

FTC has suspended most investigations and litigation under the shutdown.

No payments to crime victims

The Department of Justice’s civil litigation efforts have stopped, and payments to crime victims have been put on hold. Training for Department of Justice employees, even for those still working despite the shutdown, is canceled. Department of Justice programs to train state and local law enforcement officers and officials have also been canceled. The Environmental Protection Agency has halted inspections at drinking water systems,

hazardous waste management and chemical facilities. More than 39,000 employees in California have not received any pay since Dec. 22, when the shutdown began. Nationwide, 380,000 federal workers are furloughed, and 420,000 employees are working without pay. Nearly one-third of all federal employees are veterans. Impacted employees with critical safety, security and emergency management missions include FBI agents, U.S. marshals, TSA employees, Coast Guard employees and Forest Service firefighters..

Taxpayers fund bond campaigns

A

lthough state law specifically prohibits public officials from using taxpayers’ money for political campaigning, they have been doing exactly that throughout California. Local governments hire “consultants” to poll voters on what tax and bond measures they would find acceptable, to draft those proposals accordingly and finally, to run so-called “information” campaigns to persuade voters to approve them. It’s so blatant that firms seeking lucrative contracts openly boast of their successful campaigns, eliminating any doubt that they are truly political operatives. The practice has ballooned because local prosecutors and the state attorney general’s office ignore complaints about its illegality. Indeed, local district attorneys often benefit from the higher taxes. Finally, however, we may be seeing some effort to sanitize this very stinky phenomenon which, if left unchecked, will only become more commonplace. Last month, the state Fair Political Practices Commission took a potentially significant action against the Bay Area Rapid Transit District for doing what it and other local governments have been doing. The FPPC voted unanimously to impose a $7,500 fine on BART for failing to report its spending on a bond issue as a campaign contribution. It also asked the attorney general and Bay Area district attorneys to prosecute the transit district for violating the law prohibiting the use of public funds for political campaigns. “It’s not the total (amount) of what was used; it’s the concept of misusing public funds,” FPPC chairwoman Alice Germond said at the commission’s December meeting. “We want to send a warning and not create a precedent that it’s a minor, ‘slap on the wrist’ kind of thing.”

The action stems from a proposed $3.5 billion bond issue, Measure RR, that voters in the three-county district approved two years ago by a 70 percent margin. The “information campaign” for the bond included a video, featuring Golden State Warriors player Draymond Green, that the FPPC said was acceptable, while concluding that two other videos and text messages to voters were clearly advocacy. BART paid a public relations firm, Clifford Moss LLC, $99,000 to craft its measure before the item was placed on the ballot, and the same firm then directed the supposedly independent campaign for the bond measure. The FPPC acted on a complaint from Jason Bezis, a Lafayette attorney. It’s similar to complaints that have been filed about other local bond and tax measures, including those in Los Angeles County, by taxpayer advocacy groups. After the FPPC acted, BART spokeswoman Alicia Trost told the Bay Area News Group that the campaign errors were “accidental.” “We have been and will continue to be committed to following the law,” Trost told BANG. “We accept their finding.” While state law allows agencies to publish accurate information about their proposals, they are not allowed to advocate their passage, and that’s the line that BART and other agencies have obviously and arrogantly been crossing. If they use public money for campaigns, they will, the FPPC implies, be treated like other financiers of political campaigns and be required to file reports. If they file such reports, however, they will be admitting, in effect, that they are violating the law prohibiting such spending. That’s where the prosecutors should come into the picture. They should do their duty, enforce the law and seek personal fines from the officials involved. And the Legislature could, and should, invalidate any local measure that’s passed when those officials ignore the law.

SHARES PRIORITIES Diego Ochoa will focus on education programs and educational leadership. on two of the district’s greatest areas of need, namely improving special education services and overall student learning. “My goals as superintendent will include addressing educational programs and providing strong educational leadership to the district and community,” he said. Ochoa will oversee the nearly 6,000-student district and is expected to begin his role in February, according to the board. His contract is set for three years with a $209,000 annual salary.

During the four-month superintendent search process, district staff gathered input from more than 200 community members regarding the qualities they’d like to see in the next superintendent. Those qualities include collaborative leadership, knowledge of special education, a commitment to staying in ollister and cultural competence. Ochoa said, “I chose to apply to the Hollister School District because the goals of the district align with who I am as a leader.”

I will focus on improving special education services and overall student learning.

“I wanted it to be the students taking a leadership role,” Hernandez said of the business. She also noted that it may expand to become a club and involve general education students. Orders are accepted through a Google form emailed to Baler staff members, and the company is selling 16-ounce refillable tumblers. The company plans to start with once-aweek orders but could expand. Java Express will offer seasonal flavors such as pumpkin spice and peppermint bark, in

addition to a traditional coffee flavor. The 12 Life Skills students in the Transitions program work Mondays and Wednesdays for Java, breaking down boxes and recycling, learning responsibility, developing skills and giving back to the local business that is helping support the effort. Special education instructional aide Danielle Craig, an organizer of the recent Baler Buckaroos Life Skills Rodeo on campus, was a 15-year employee of Java Express.

Mushroom grower sued for pollution OFFICIALS SAY LOCAL WATER QUALITY NOT IMPACTED Michael Moore Editor

that may contain animal urine and feces—are pictured sitting directly next to the creek in one of the exhibits, with no barrier or collection pond to prevent rain water from washing material into the creek. On one incident in January 2016, Fish and Game wardens observed stormwater running off piles of used hay bales, “flowing through an intentionally hand-dug ditch and directly into a stream, Fisher Creek,” reads the DA’s complaint. The lawsuit also alleges that employees of Monterey Mushrooms dug up sections of Fisher Creek’s banks without a permit, to remove weeds. On Feb. 7, 2017, authorities estimated the Morgan Hill site pumped more than 345,000 gallons of wastewater into Fisher Creek. Much of the wastewater pumped into the creek from Monterey Mushrooms’ site, on multiple occasions, contained toxic levels of ammonia, according to the DA’s complaint. In all the DA’s complaint alleges 66 violations of state Fish and Game codes and one violation of unfair competition laws. The lawsuit alleges Monterey Mushrooms committed the violations in order to cut operation costs. Monterey Mushrooms, one of the nation’s largest mushroom growers, operates other farms in California that fall outside the local jurisdiction. The DA included information about recent violations at these sites as well in the lawsuit, for background information. Three other Monterey Mushrooms facilities where the company has allegedly

Monterey Mushrooms’ history of allowing its farm production waste and other wastewater to flow from its Morgan Hill facility into local waterways is extensive, according to the district attorney’s civil complaint against the company. Recorded incidents of such wastewater flow from the mushroom-growing site on Hale Avenue into Fisher Creek and its tributaries date back more than 30 years and have occurred on dozens of occasions observed by enforcement authorities, the lawsuit filed Dec. 21 by the Santa Clara County DA’s Office states. Similar illegal wastewater dumping practices have been logged at other Monterey Mushrooms facilities in the Central Coast region, and authorities outside Santa Clara County are still working with the company to correct the more recent violations, according to multiple sources. The local lawsuit addresses suspected violations of state Fish and Game and Business and Professions laws from 2012 to 2017, a timeframe within the statute of limitations for the alleged crimes. Despite the nasty-sounding nature of the allegations against Monterey Mushrooms, local officials have aimed to assure the public that their drinking water is not at risk. City of Morgan Hill spokeswoman Maureen

Tobin noted that the mushroom-growing facility near Hale and Miramonte avenues is outside the city’s boundaries—about 1.5 miles north of the city limits—and Fisher Creek flows away from town to the north. “Although the alleged discharges are far to the north of the city’s groundwater supply, residents should understand that the city has and continues to test water quality in order to ensure the water delivered to Morgan Hill is safe,” Tobin said in an email statement. Morgan Hill’s public drinking water is drawn directly from the groundwater basin beneath the city. Fisher Creek flows into Coyote Creek, which flows into the San Francisco Bay. Coyote Creek is home to steelhead trout, California tiger salamanders and California red-legged frogs. The DA’s complaint alleges the environmentally harmful and unfair business practices have been deliberate and pervasive at Monterey Mushrooms, Inc.’s Morgan Hill site. DA Jeff Rosen’s lawsuit is asking the Superior Court for $67 million in damages for Monterey Mushrooms’ alleged repeated violations of the state Fish and Wildlife and Business and Professions codes. The DA’s extensive lawsuit describes in detail and includes photos of how Monterey Mushrooms has allowed, and even manipulated its property to allow, the farming operation’s harmful production waste to flow off its property into Fisher Creek in north Morgan Hill. MUSHROOMS Large producer has history of violations. diverted or pumped wastewater into creeks are in Royal Oaks, Watsonville and Arroyo Grande. The company is based in Watsonville. These facilities fall within the oversight jurisdiction of the Central Coast Regional Water Quality Control Board. That board’s assistant executive officer, Matt Keeling, said these three sites have shown “similar types of violations (that) we’re currently working with Monterey Mushrooms to resolve.” The board has not yet fined or penalized the company, but it has the authority to do so, and such enforcement may later be on the table for Monterey Mushrooms, Keeling said. The alleged violations at the Central Coast

mushroom facilities date back to 2016, according to Keeling. When asked if wastewater runoff violations are pervasive at Monterey Mushrooms, Keeling said, “It does appear to be so.” The board’s goal at the moment is to make sure these facilities are in compliance with state Fish and Game laws. In a statement in December, Monterey Mushrooms said it was “shocked” by the DA’s lawsuit. A company spokesman said the unpermitted flows of wastewater off the Morgan Hill site in 2016 and 2017 were not intentional, but were the result of torrential rain storms that occurred during the winter months. The DA’s lawsuit also

includes a history of Monterey Mushrooms’ violations at the Morgan Hill site going back to 1985. That year, regulators required the company to install an upgraded evaporation pond to the property in order to lawfully deal with production waste. The company asked for an extension on its deadline to install the pond due to the high cost of the project, but ultimately did not complete the evaporation pond until 2001, the DA’s lawsuit reads. “During the 16 years (from 1985 to 2001), defendants remained in full production and unlawfully discharged their wastewater into (an) unlined percolation pond,” the DA’s complaint says.

Gilroy Rodeo attempting to return

While the rain may be coming down in Gilroy, rodeo organizer Erik Martin, who staged the return of the Gilroy Rodeo in 2018, already has his eyes on August for the next event. Martin is seeking a special use permit from Santa Clara County, which would allow the rodeo to operate for years to come. But it won't be easy, and what, according to Martin, should have been completed in 30 days has extended nearly three months due to ongoing wrangling with county officials. Martin is hopeful he’ll get some good news Jan.11 at a meeting with Santa Clara County Planning Department. “I think the good thing is that once you have [the special use permit], you have it for good,” Martin said. “Once we get that, we intend to have the rodeo every year.” The special use permit

isn't cheap, with a price tag reaching $100,000. Since Martin is already paying $40,000 to $60,000 in permit fees, the additional cost is worth the price. Once this hurdle is cleared, Martin can focus on expanding the rodeo from two to four days, possibly from Aug. 14-18. “We could start on Wednesday with local roping and barrel racing; we’ll focus on local participation on those days,” Martin said. “Maybe we can add some gymkhana stuff for the kids. It was a jampacked weekend, so we could spread it out.” Due to permit issues prior to the 2018 Gilroy Rodeo, Martin had little time to advertise. Compounding that challenge was a snafu with the online ticket agency. Despite the challenges, the Gilroy Rodeo drew 8,000 attendees. Even with strong ticket sales, Martin estimated in August that the Gilroy Rodeo lost $20,000. “It needs to be viable. We have the property, but at the same time we don’t want to feed it every year,” Martin said regarding the financial future of the Gilroy Rodeo. “We had a great time, but it depends

Manny Luna defines versatility. The San Benito High goalkeeper was pressed into field duty in the team’s showdown against Watsonville on Tuesday—the score of the match was not available before the completion of this article—a direct result of Luna’s playmaking ability and the fact the Haybalers have suffered some key injuries in the midfield early in the season. “He doesn’t like the idea (of playing midfield), but he will do it on occasion such as Tuesday because I want my best players and lineup out on the field against the best team,” Balers coach Greg Dolan said. “Manny is very composed on the ball, makes the right decision and is a leader on the field. He’s my best goalkeeper and he might be my best midfielder, too. His preference is in goal, but he’s so damn good on the outside, too.” Luna said he and his teammates have a deep and profound respect for Dolan, which prompted Luna to accede to his coach’s wishes. “When Greg asked me to make the switch, I said I’ll do it because I trust he knows what he’s doing,” Luna said. “But going into that game will be really tricky. Switching from goalkeeper to midfield for anyone would be a tough challenge, not only because you have to get in the game more because

you’re pulling the strings as a midfielder, but from a fitness level. As a goalie, you don’t run much, but now I’ll be going up and down the field, which is a lot different.” Before Luna made his mark as a goalkeeper two years ago, he played midfielder. However, after Luna underwent surgery in the summer before his junior year, he decided to play goalkeeper full time and only play out in the field in certain situations. The Balers, who began the week at 5-1-3, have picked off right where they left off from last year’s historic season in which they won a Central Coast Section playoff game for the first time in program history. Luna credits the smooth transition to Dolan, who knows most of the players on the team since he’s also the coach of the Hollister Strikers, the local club program. “Playing for three coaches in my four years here is a little difficult, but this coach is different because he’s like family to us,” Luna said. “Being able to play for him as the Hollister coach is what a lot of players wished for. We couldn’t be happier.” Luna said the players love Dolan because of his generosity and the attention and care for which he shows his players on a constant basis. Not only does Dolan want the players to fulfill their potential on the field, he goes to great lengths to make sure they’re taking care of business off the field as well. It’s more important for Dolan that the players excel in school, do the right things and stay out of trouble. To that end, Dolan literally opens up his home for the players so they can bond and have deep relationships. “Last Saturday (Dec. 29) he invited all of us over to his house to watch a (Premier League)

Most of us have played for him the last four or five years, and he’s always been there for us. Being with him this long, we consider him as family.” San Benito High plays in arguably the toughest boys soccer league in the CCS, the Pacific Coast League’s Gabilan Division. Even with perennial section heavyweights Watsonville, Alvarez and Alisal in the division, the Balers envision winning the league championship. If that comes to fruition, it would be the first A-league title in program history. “We’re confident we can take

league,” Luna said. “Even though we lost a lot of good players from last year’s team, we still have a lot of talent here.” Luna had an impressive performance in a 1-0 loss to Monterey on Dec. 17, blocking a penalty shot and making several other spectacular saves. Luna actually didn’t start the match, as he said Dolan wanted to give him a rest day. However, unforeseen circumstances led to Luna being inserted into the game around the 15-minute mark. Luna feels his overall skill set has improved since last season. “I feel like I’ve gotten smarter on the field,” he said. “I’m anticipating well and if a player rushes in, I can easily play the ball with

my feet and have the confidence to play it and control it.” Even though Luna makes all the plays, it’s his willingness to be vociferous that Dolan most appreciates. “He’s a very passionate player,” Dolan said. “He takes everything so personally, whether it’s a loss or missing a tackle. It breaks his heart when things don’t go the team’s way. There are others on the team who speak up, but he’s the one who can get loud and in the face of players, and the team needs that. He directs the traffic and lets you know if you’ve done something wrong, but in a good way. He’s making sure everyone is doing their duty. He’s the loudest person in the park when he’s in goal and even louder in the midfield.”

Doug was born in April 1944 in San Francisco, CA to Rose Puls and Howard Nelsen. Doug was an accomplished mechanic and carpenter. He and his predeceased wife, Karen settled in Gilroy, CA where they had a thriving llama farm. Doug was preceded in death by his father, Howard, his mother, Rose, his wife, Karen, and step-son, Jeffrey Steiner. He is survived by his sister, Virginia Frank, his son Todd, step-daughters, Lisa and Lesli Steiner, step-son, David Steiner, grandchildren Nicole and Derek, great-grandchild, Jayden, and his niece, Rose Roth, and nephews, Vince and Tony Frank. Doug was much loved and will be missed by his family and friends. A Celebration of Doug’s Life will be held on Saturday, January 19, 2019 at One o’clock at Habing Family Funeral Home, 129 Fourth Street, Gilroy.

Since 1960, the Department has approved, planned and constructed an integrated system of water storage and transportation and power generation facilities called the State Water Resources Development System, more commonly known as the State Water Project. Pursuant to applicable statutes and other authorities, the Department is authorized to perform various duties and functions related to the State Water Project. Among its powers, the Department is authorized to enter into contracts for the sale, delivery, or use of water, generated through the State Water Project, to water agencies in the State. Twenty-nine (29) public water agencies (“Contractors”) currently have contracts (“Water Supply Contracts”) with the Department for delivery of water from the State Water Project. The Contractors receive water service in exchange for paying all costs that are associated with constructing, operating, and maintaining State Water

Project facilities and that are attributable to water supply. The Water Supply Contracts are required to be substantially uniform with respect to their basic terms and conditions for all 29 Contractors. The Water Supply Contracts originally included 75-year terms with ending dates that ranged from November 4, 2035 to August 31, 2042, depending on when each specific Water Supply Contract was executed. Article 4 of the Water Supply Contracts provides that the Contractors, by written notice to the Department at least six (6) months prior to the end of the term of the particular Water Supply Contract in question (as specified in Article 2), may elect to receive continued service under the Water Supply Contracts under certain conditions. In accordance with Article 4, the Department initiated a process to amend the Water Supply Contracts in order to maintain the financial integrity of the State Water Project. On December 11, 2018, the Department’s Director approved the “Amendments for Continued Service and the Terms and Conditions Thereof,” referred to herein as the Contract Extension Amendments. The Contract Extension Amendments extend the terms of the Water Supply Contracts to 2085, and amend other financial provisions in the Contracts to ensure that the State Water Project is properly managed and financed. A model form of the Contract Extension Amendments is attached to the Department’s validation complaint as Exhibit A. The Department brought this validation action to confirm the legality and validity of the Contract Extension Amendments and the proceedings related thereto.
