Rep. Jimmy Panetta wants the Bureau of Land Management to create a new protected wilderness area and reopen the once-popular Clear National Recreation Area, closed for more than a decade. Legislation introduced by the Congressman for the 20th District, which includes San Benito County and parts of Gilroy, would direct the Bureau of Land Management to protect 21,000 acres of federally managed land adjacent to Clear Creek by designating the area the Joaquin Rocks Wilderness. It would also reopen the 63,000-acre Clear Creek National Recreation Area in San Benito and Fresno counties for public outdoor recreation, including off-road vehicles and hiking. San Benito High School’s Robotics Team recently won a $5,000 grant from the National Aeronautics and Space Administration that will allow the team to pay for the cost of registering

The California Department of Justice has issued an information bulletin to all California law enforcement agencies, firearms dealers, manufacturers and vendors providing a brief summary of new state

firearms laws that took effect on Jan. 1. The information bulletin addresses new requirements relating to firearm transfers, gun violence restraining orders, multi-burst

trigger activators, vehicle storage, identifying information, concealed carry licenses, prohibited possession, mental health prohibitions, unsafe handguns and retired peace officers.

In addition, the California Department of Justice bulletin outlines recent amendments to existing firearms laws. In providing guidance on the new and amended laws, the California Department

of Justice seeks to ensure that all law enforcement agencies, firearms dealers, manufacturers, ammunition vendors and consumers properly manage their firearms and ammunition under state law.

A new elementary school at Santana Ranch will be completed in January 2021—six months later than the original estimate—after the Hollister School District Board of Education approved new design plans. The board voted 4-1 in favor of change at its last meeting of 2018, with Trustee Robert Bernosky the lone dissenter. Board President Stephen Kain and Trustees Jan Grist (who made the motion), Elizabeth Martinez (who seconded the motion) and Carla TorresDeluna all voted in favor of the new plan. “The school that we’re going to build is the first one since Ladd Lane back in the ’90s,” said Kain, who recalled surveying the Ladd Lane site with former Superintendent Tom Andrade prior to breaking ground. “He brought me out to the (Ladd Lane, Maze and Gabilan Hills) properties when there was nothing there but a piece of land and a vision for the new schools.” Otto Construction, Inc.—which has a boardapproved “design-build” agreement in place with the school district as of Dec. 18—submitted the new school design package to the Division of the State Architect on Jan. 4. That pushed the completion

I’d rather worry about new schools and be in increasing enrollment instead of a declining one.” Declining enrollment has become a reality for nearby school districts such as Gilroy and Morgan Hill Unified. But that’s not the case in Hollister. The 12-acre parcel of land, purchased by the

district for $5 million, is off Sunnyslope Road at 1454 Santana Ranch Drive, surrounded by new housing developments. “It’s a good location for a new school,” said Kain, who started as a teacher in Hollister in 1985. The district has earmarked $36 million of Measure V funds (approved by voters in November 2016) for the building cost. Hollister school leaders are counting on an additional $26 million in matching funds

from the state’s Proposition 51, as well as revenues from developer fees to cover the rest. Statewide voters approved Prop 51, the Kindergarten through Community College Public Education Facilities Bond Act, also in November 2016. The measure provides $9 billion of facility funding to California public schools. Measure V was outlined “to help fund the construction of a new 900-plus student elementary/middle school to keep class

sizes optimal and prevent overcrowding,” according to the school district’s fact sheet. An Independent Citizens Bond Oversight Committee was also included in Measure V’s ballot measure. When completed, the new site will be the ninth elementary school site in the district. The Hollister district serves about 5,500 students. The new site plans include four two-story buildings, with a pickup/ dropoff area on Santana

Ranch Drive and a fire lane dividing the academic buildings and common areas from the athletic fields and basketball courts. Kain said there will be more new schools to come in the future with the growing population in San Benito County. “It all depends on the housing development, which is booming right now,” Kain said. “A lot of the people buying these homes are families with kids.”

Big surprise: CA costs too much

A matter of trust

A

little over a year ago, we wrote an editorial in this space entitled, “Why should we care?” “Why should we care about any further investigation of the money that disappeared from the Tony and Barbara Matulich Charitable Trust?” was the question we posed. After all, we wrote, it wasn’t like the money was taken from them personally, since the farming couple who established the trust had both died. And the transfer of most of the trust’s money took place more than six years ago, shortly after the death of Barbara Matulich. “No one was really hurt, some might say—charities just didn’t get unexpected windfalls that they had not expected,” we wrote. “Money managers can’t be held responsible if some investments fail,” some people might say. Last month, we reported that District Attorney Candice Hooper had decided not to prosecute Mitchell Dabo on any criminal charges in connection with his draining of $644,000 from the Matulich Charitable Trust into accounts he controlled, despite recommendations from Hollister police for some prosecution. The trust funds were supposed to be given to the Community Foundation for San Benito County, to funnel money to local charities. Meanwhile, a Superior Court judgment of $1.74 million against Dabo, the court assigned manager of the trust, still stands unpaid, gathering interest. If Dabo had followed state laws, the Matulich Foundation funds would have been a huge boost for San Benito County nonprofits. The amount was more than 2½ times the approximately $250,000 the foundation awarded to 41 non-profits in 2018; the court judgement is more than seven times that number. Why should we care? Indeed. Think of

the lives that could have been transformed, the valuable organizations that could have been helped by the generosity of that loving San Benito farm couple. The judgment will never be paid. In the only interview Dabo gave to the Free Lance more than a year ago, he said he had no money. That’s why, he said, he didn’t contest the lawsuit brought against him by the foundation, which had sought its money when Hooper initially rejected its plea to investigate the matter in 2016. After months of silence, Hooper’s stunning conclusion last month that she couldn’t find enough evidence of criminal intent meant that Dabo would not only avoid paying any monetary damages, but he would also skate on any criminal charges in connection with the draining of the trust. Let’s be clear: Dabo admitted transferring the money out of the trust to his personal accounts. The Superior Court ruling was in large part based on documents he supplied, including one check made out to “cash” and signed by him for $21,000. Life goes on. It is nearly tax season, a busy time of year for tax preparers. Once again, San Benito citizens will put their trust in Dabo’s hands to prepare their taxes, many of them no doubt longtime friends—just as Tony and Barbara Matulich had counted him as a friend. The complete silence about Dabo’s misdeeds from all elected officials in San Benito County continues. He served the remainder of his term on the school board. He continues to run his business, half a block down the street from the foundation. Trust. It’s the glue that holds communities together. We trust our financial advisers. We trust those who manage funds. We trust elected officials. We trust law enforcement. The saga of the Dabo case represents a breach of that trust, on many fronts.

Gov. Gavin Newsom’s inaugural address was a bit too long and somewhat disjointed, but he did make some cogent points, including this one: “Even in a booming economy, there is a disquieting sense that things are not as predictable as they once were, that we must now run faster just to stay in place. Stagnant wages. Costs that keep rising–rent, utilities, visiting the doctor–the basics are increasingly out of reach. We face a gulf between the rich and everyone else, and it’s not just inequality of wealth; it’s inequality of opportunity.” While decrying economic inequality is not a new theme for California politicians, they’ve only occasionally cited high living costs as a factor. In fact, those costs are the major reason we have the nation’s highest level of poverty, as measured by the Census Bureau, and they are not confined to housing. Californians’ personal incomes, while not the nation’s highest, average above the nation as a whole. But Californians’ incomes don’t stretch as far as those in most other states. Take gasoline, a necessity of modern life. The American Automobile Association’s latest survey pegs the national average at $2.24 per gallon, with Missouri having the cheapest gas at $1.82 and California the most expensive at $3.32. That $1.06 gap between California and the average translates into about $15 billion per year in additional costs for motorists, or about $400 for driving 10,000 miles a year. Utilities, another basic, are also expensive, as Newsom mentioned. California’s electric utility rates are among the nation’s highest and have climbed steeply in recent years, thanks largely to a shift to wind and solar energy sources. The Tax Foundation annually calculates what $100 is worth, in terms of buying goods and services, state by state. Last year, a c-note was worth the most in Mississippi, at $115.74, and the least in Hawaii ($84.46), followed by New York ($86.51) and California ($87.41). Bankrate, a financial data website, recently published a “cost of living calculator” which allows the user to see how moving from one metropolitan area to another changes living costs. One example that illustrates the disparity is someone moving from the San Francisco Bay Area to Austin, Texas, another technology hub that’s a popular destination for Californians seeking more affordable lives. According to Bankrate, someone with a $75,000 annual income in the Bay Area could maintain the same standard of living for $40,816 in Austin, where overall costs are 45.6 percent less, including 74 percent less to buy the median home, or 67 percent less for apartment rent. Bankrate covers dozens of other specific costs, including food items, clothes, gasoline (31 percent less), cosmetics, medical services and even haircuts, the only expense even slightly (8 percent) higher in Austin. Those with high incomes, such as Newsom himself, can easily absorb the higher costs of California living, but the state is seeing an exodus of those who can’t and is increasingly becoming a society of haves and have-nots with a declining middle class. Moreover, many of those costs–housing, gasoline and utilities, for example–are directly attributable to political actions and inactions, which Newsom should also acknowledge as he decries their impacts. He seems inclined to offset health care, housing and other high costs with state subsidies. But that approach would ultimately require big tax increases in a state whose residents already have one of the nation’s highest tax burdens, and could encourage even more flight.

Two Hollister residents accused of the murder of laundromat owner Yoon Ji in December 2017 are scheduled for a preliminary hearing Jan. 22 and 23 at the San Benito County Courthouse. Suspects Sang Ji, 49, and Jung Choi, 45, are both charged with the murder of Sang Ji’s wife on Dec. 2, 2017. Both have remained in custody at San Benito County Jail since they were arrested by sheriff ’s deputies. If the preliminary hearing proceeds as scheduled later this month, prosecutors from the San Benito County District Attorney’s Office will seek to present enough evidence of the suspects’ involvement to convince the judge to set a trial date. Sheriff ’s investigators found Yoon Ji’s remains in December 2017 off Salinas Grade Road between San Benito and Monterey counties, according to authorities. Yoon Ji and Sang Ji owned Hollister Laundromat before the woman’s death. Following the suspects’ arrest, Sang Ji initially told county law enforcement that the co-defendant is his cousin, according to a separate claim for wrongful death in civil court. The civil claim— filed by Sang Ji and Yoon Ji’s adult children—alleges that Jung Choi and Sang Ji were having an extramarital affair. Yoon Ji’s daughter and sister, who live in Los Angeles, reported the woman missing Dec. 2. The daughter told sheriff ’s authorities that she had not heard from her mother since about two weeks earlier,

which was an unusually long time to pass without contact, according to police. Just before reporting her mother missing, the daughter received a message from her father, Sang Ji, saying her mother had traveled to South Korea unexpectedly, according to authorities. The daughter then contacted family in South Korea, who said the mother was not there and they weren’t expecting her. The daughter became increasingly concerned about her missing mother and contacted the sheriff’s office report her missing, police said. Authorities acquired a search warrant and found evidence that suggested Yoon Ji had been killed. The wrongful death lawsuit filed by Sang Ji and Yoon Ji’s daughters in late December 2017 alleges that their parents’ marriage had been on the rocks in the weeks preceding their mother’s death. Sang Ji and Jung Choi conspired to remove more

than $175,000 worth of “community property assets” from a safe in the family home in Hollister, and transfer the proceeds to an associate in South Korea. The lawsuit claims the property had belonged jointly to Sang Ji and Yoon Ji, and Sang Ji did not want to divorce his wife of 23 years for fear of losing a portion of these assets. Yoon Ji allegedly died of “multiple cranio-cerebral injuries,” according to her daughters’ lawsuit. The defendants allegedly stuffed her body into a suitcase and buried her remains in a ravine on the 2300 block of Salinas Grade Road. On Feb. 20, 2018, San Benito County Superior Court Judge Harry Tobias ordered Sang Ji and Jung Choi to pay each of the two daughters $20 million in damages. The order was a default judgment issued after the defendants missed a deadline to respond to the initial wrongful death lawsuit.

Jose Antonio Barajas, who was arrested in Mexico last summer on suspicion of murdering a teenage girl in Hollister in 2014, will next appear in local court Feb. 6. The hearing is scheduled as a “pre-preliminary” hearing, according to records at the San Benito County Courthouse. The court has further scheduled a preliminary hearing for Barajas for Feb. 11. Barajas, 24, was arrested July 12, 2018 in Guadalajara, Mexico in relation to the shooting death of Ariana Zendejas. He was He was deported from Mexico and flown to San Jose, where he was immediately transferred to the San Benito County Jail, according to authorities. He has remained in custody at the local jail since his arrest. Zendejas was 19 when Barajas allegedly shot her to death. Hollister police said in 2014 that

Barajas had fired from one vehicle into another in which Zendejas was a passenger, at B and West streets the night of Aug. 1. Authorities identified Barajas as the prime suspect shortly after the shooting, then learned he had fled to Mexico. Barajas is also charged with kidnapping Vanessa Flores, who was with Barajas when he fled to Mexico, according to authorities. Flores, a friend of Zendejas, appeared alone at the U.S.-Mexico border on Feb. 7, 2015. In total, Barajas faces one charge of murder, three charges of kidnapping and one charge of shooting a firearm at an occupied motor vehicle, according to the criminal complaint filed against him in Superior Court. Each charge carries special allegations for using and firing a firearm in the commission of each crime. If convicted of all charges, Barajas faces life in prison.

Vehicular homicide

A Hollister man who killed one of his sons and injured another in a February 2018 drunk driving accident pleaded guilty late last year to a

list of charges, including manslaughter. Jesus Mora, 30, was sentenced to 13 years in prison at a hearing in November. On Oct. 19, he pleaded guilty to two charges of manslaughter—including a charge of gross vehicular manslaughter—as well as child endangerment and DUI causing injury in relation to the fatal Feb. 25 accident, according to records at San Benito County Courthouse. On Feb. 25, according to the California Highway Patrol, Mora was driving westbound on McCloskey Road in a GMC Sierra with his two sons in the front seat, when he drifted off the roadway and collided into a utility pole on the side of the road. Mora’s younger son, age 6, was pronounced dead at the scene of the accident, and the other boy, age 7, was flown to a hospital with serious injuries, according to authorities. Officers suspected Mora of driving in a drunken state when they contacted him at the scene of the collision, and arrested the driver. Mora has been in custody at the county jail since his February arrest.

Bomb-factory suspect still at large WEAPONS, DRUGS, BOMBMAKING LAB FOUND IN HOME NEAR HIGH SCHOOL Staff report

San Benito County Sheriff ’s deputies on Jan. 14 were still looking for a Hollister man who had

been released after a drug arrest. On Jan. 11, several days after the man was released, deputies found weapons, drugs and bomb-making materials in the man’s home near San Benito High School. Earlier this month, deputies had conducted a traffic stop on a male identified as Ansley Godoy,whom they arrested for felony possession of controlled

substances for sale. Godoy was released on bail. Deputies on Jan. 11 released a photograph of Godoy. He is wanted for weapons and narcotics violations and was thought to be in Modesto. At 7:30am Jan. 11, a search warrant was obtained and was subsequently served at Godoy’s apartment on Nash Road. Deputies said that during the search, they located two

firearms (a rifle and a pistol), ammunition, narcotics, narcotic paraphernalia and suspected explosive devices. The Monterey County Sheriff’s Office Bomb Squad was called in to assist. Once on scene, the bomb squad detonated a device in an empty parcel at Homestead Avenue and Nash Road, the Sheriff’s Office reported. The parcel and the apartment are near the San Benito High School

campus, “but a very safe distance away in regard to the explosives located,” deputies said in a press release. “There was never any type of threat to the campus and/or the students. The explosive was relatively small, designed to inflict injury to a person very close to it,” the statement read. Numerous other suspicious items were located that appeared to be explosives and/or IEDs, deputies

reported. After the bomb squad robot was able to x-ray them, they were determined to be inert. The San Benito County Sheriff’s Office expressed gratitude for its partnerships with the Hollister Police Department, Hollister Fire Department, the City of Hollister and the Monterey County Sheriff’s Office. Each of these agencies assisted in the safe handling of this event.

Police are destroying some records

agencies have harshly criticized the new law. The Los Angeles Police Protective League suit is attempting to prevent the City of Los Angeles from disclosing these internal city police records from before Jan. 1. The lawsuit obtained a court order that limits the disclosure requirements of SB1421 to only those records in existence as of Jan. 1, said Jim Ewert, general counsel of the California News Publishers Association. The order only applies to the City of Los Angeles, and the CNPA and other parties are planning to push back against the LA Superior Court interpretation. Ewert and other SB1421 proponents argue the law applies retroactively to all records in a police agency’s possession, regardless of how old they are. The CNPA, First Amendment Coalition, Los Angeles Times and other parties are preparing a motion to

file in response to the LA Superior Court’s ruling. A hearing on that motion is scheduled for Feb. 5. “Any time the Public Records Act has ever been changed—including the exemption that made these records confidential back in the 1980s—those bills never contained language that specified the change in law applied retroactively,” Ewert said. “Nevertheless, the cops understood it to apply to all records in existence on the effective date. For them to argue now that, without some explicit statement in the bill, it only applies prospectively is a little disingenuous.” He added that the language of previous changes to the Public Records Act has never indicated that the changes only apply to a certain time period. Despite the police union’s challenge in Los Angeles and other resistance to SB1421 from individual law enforcement agencies, the California

Police Chiefs Association has been a proponent of the law that expands police transparency. Morgan Hill Police Chief David Swing, who is president of the CPCA, said he “personally supports applying the new only to actions after Jan. 1, 2019, similar to the position argued by the LA Police Protective League lawsuit. “However, we as a profession and department will abide by the court’s application,” Swing said. The CPCA supported the law because it could improve public trust in police, as it allows the public to gain a glimpse of the “time and attention and resources” that investigators put into dealing with officer-involved incidents, Swing said in October. Ewert said regardless of the outcome of the Feb. 5 hearing in Los Angeles, he expects the losing party to appeal. In the weeks before the law went into effect, multiple California cities authorized police departments

to destroy stacks of old internal and investigative records sitting in storage. These cities’ officials have argued the timing of the record purges so close to the Jan. 1 implementation of SB1421 is merely coincidental, but Ewert is skeptical. In Morgan Hill, the city council on Dec. 19 adopted an update to its citywide records retention policy, setting defined schedules for when each type of public record can be destroyed. Under the city’s new policy, the Morgan Hill Police Department will retain records related to officer-involved shootings for two years before they can be destroyed. It was unclear how the city can legally destroy such records so soon, as a state law requires police departments to retain documents related to officer-involved shooting investigations for a minimum of five years. “If the officer is cleared of wrongdoing, the criminal investigation of the officer

may be destroyed after two years,” said Morgan Hill City Attorney Donald Larkin. “In any officer-involved shooting, there will be a separate administrative investigation. Files from the administrative investigation are kept for five years.” Larkin said that “because administrative investigations typically involve compelled statements that cannot be used in court, the administrative investigation is kept separately. Reports and evidence from the criminal investigation would be included in the administrative investigation, so even if the separate criminal investigation files are destroyed, the documents and evidence from those files are maintained under the administrative investigation.” Two officer-involved incidents resulting in injury or death have occurred in South County within the last year. On Feb. 25, 2018, Gilroy resident Stevie Juarez

died while he was being restrained and arrested by city police officers. On April 29, a Morgan Hill Police officer accidentally fired his service handgun during an incident response, resulting in injury to a teenage girl. Both incidents are still under investigation by the Santa Clara County District Attorney’s Office. Records related to those incidents must be retained at least until the investigation is completed, and possibly for at least five years under existing state law and city policies. Police personnel complaints and internal investigation records will be retained for five years in Morgan Hill before they can be destroyed, under the city’s policy update. MHPD case files for certain types of felonies— including murder, capital offenses and child abuse— will be held permanently, according to the Dec. 19 city staff report. that, adding that “

AG moves to block St. Louise sale SC COUNTY WARNS IF IT CAN’T BUY TWO HOSPITALS, THEY’LL CLOSE Barry Holtzclaw Managing Editor

California Attorney General Xavier Becerra wants to block the sale of O’Connor and St. Louise hospitals to Santa Clara County, putting him on a legal collision course with a U.S. bankruptcy judge and the county. If the attorney general is successful, says Santa Clara County Executive Jeff Smith, the deal for the county’s $235 million purchase of the two local hospitals from Verity Health System is dead and the hospitals will close, with no prospect of reopening under new owners. There was no indication in recent court filings that Becerra realized that his actions could put more than 2,000 hospital workers out of work and leave South County communities miles away from hospital services. “The attorney general’s actions to block the sale of Verity’s hospitals to the county is a real threat to

the health of our community, our residents and the vulnerable populations the hospitals serve,” Smith said in a Jan.10 statement. A hearing of Becerra’s request to block the sale has been set for Jan. 30 in U.S. District Court. Smith drove to Sacramento Tuesday afternoon for a meeting with the attorney general’s office, “to try to get them to remove their request for a stay,” Smith told supervisors Tuesday morning. “Time is running out,” he said. “We’re anxious to try and get resolution.” Becerra contends in court documents that any sale of hospitals owned by Verity Health must adhere to all of the strict conditions set down in December 2015 by his predecessor Kamala Harris, regardless of the consequences. Becerra and his staff have declined interview requests. “It’s absurd,” said a frustrated Smith in an interview Jan. 11. His exhilaration over the pending success of a plan to save two failing hospitals and expand health care for county residents is now clouded by a new threat from the state’s highest law enforcement official.

Smith cites unions’ influence Smith said the attorney general doesn’t understand California law and has succumbed to pressure from politically powerful labor unions. If the purchase agreement with Verity Health fails because of delays caused by Becerra’s effort, and the hospitals close, “It would be a disaster,” said the county executive who holds both medical and legal degrees. Blocking the county purchase would mean “the hospitals will close, and nobody is going to buy them. They will be sold to some developer, torn down and turned into condos,” Smith said. Things had looked brighter on Christmas Eve, when Robles ruled that “the attorney general's objections to the sale motion are overruled, and the debtors are authorized to sell the hospitals free and clear of the conditions.” Less than a week later, four unions representing nurses and other healthcare workers joined Becerra in seeking the Jan. 30 hearing in Los Angeles to appeal the late December order.

Becerra supported the unions’ claim that the new owner of the hospital, Santa Clara County, was required to honor all of the 2015 conditions, which included the unions’ labor contracts with Verity and the retention of Verity-funded employee pensions. Employees lose pensions Under the sale agreement reached in early December between Verity Health and Santa Clara County, all employees of Saint Louise Regional Hospital in Gilroy and O’Connor Hospital in San Jose would be rehired by the county under existing public employee contracts, but they would lose their seniority. They also would lose their Verity pensions, whose funds would be swallowed up by the banks and lenders who are Verity Health’s major creditors, as part of the Chapter 11 reorganization. Smith said that some of the approximately 2,000 employees at the two hospitals have already quit because of the uncertain future. “We have been having employment fairs, inviting the employes to apply,” he

said. “We expected to give them an informal employment offer on Feb. 9.” He said more than 1,200 current hospital employees had applied to keep their jobs as of Jan. 11. Last year ended with more than 200 documents filed in connection with the sale of two of Verity Health’s six hospitals to Santa Clara County. There are no other pending sale offers for Verity’s other hospitals, two in San Mateo County and two in Los Angeles, and their fate is uncertain. Some of the documents were from creditors, including UMB Bank, US Bank, MOB Financing, even Kaiser Foundation hospitals. Others were from the unions—Service Employees International UnionUnited Healthcare Workers-West, Licensed Vocational Nurses Association, California Nurses Association and Engineers and Scientists of California, IFPTE Local 20—as well as the main physicians’ group, California Physicians’ Service dba Blue Shield of California, and heath insurer Health Net of California. Becerra had first

objected in October to the county plan to purchase the O’Connor and Saint Louise “free and clear of the [2015] conditions,” and to bidding procedures for the pending bankruptcy auction. County seeking resolution Santa Clara County said in response in a filing in November that “its status as a government entity made it impossible to comply with certain conditions without violating its obligations under California law and the California Constitution.” “We’ve been trying to communicate with the attorney general’s office extensively since Dec. 19,” said Smith. The attorney general filed a statement on Dec. 14 that he would not object to the sale. Five days later he appeared to have changed his mind and on Dec. 21 filed objections to the sale, returning to this contention that it violated the 2015 conditions placed on any potential buyers of the Verity hospitals. Becerra “is asking us to assume responsibilities we can’t legally assume,” said Smith.

Plans begin to reopen Clear Creek ➝ Panetta, 1

preserve California’s public lands for future generations," said Panetta. "Preserving the Joaquin Rocks Wilderness will bolster our conservation efforts and reaffirm our commitment to protecting our pristine environment on the Central Coast. At the same time, reopening the Clear Creek National Recreation Area will promote recreation and tourism in our district." Once considered a premier off-road vehicle recreation site, Clear Creek was temporarily closed in 2008 to the public following an Environmental Protection Agency analysis about potential risk created by naturally occurring asbestos. The proposed bill instructs the Bureau of Land Management to develop a rigorous plan to minimize the risk from asbestos exposure and educate visitors about the naturally occurring asbestos. The bureau also would be required to find ways to reduce the impact of offroad vehicles to protect the area’s habitat. The Clear Creek Management Area actually encompasses approximately 75,000 acres, of which 63,000 acres are public lands managed by the Bureau of Land Management Central Coast Field Office. Topography is rugged, with elevations ranging from 1,830 feet at Pine Canyon to 5,241 feet on San Benito Mountain. Recreational opportunities include hunting, camping, hobby gem and

mineral collecting, mountain biking, horseback riding, hiking, backpacking and sightseeing. Hobby gem and mineral collectors are drawn to the Clear Creek area, one of the most highly mineralized areas in California, by the presence of over 150 semi-precious minerals and gemstones. Among these are serpentine, jadeite, cinnabar, tremolite, topazite, neptunite and the extremely rare California state gem, benitoite. There are two developed campgrounds in Clear Creek, Oak Flat and Jade Mill, both with picnic tables, shade structures, fire rings and pit toilets. The county considers the Clear Creek area, at the county’s southeastern border, important as a tourism destination. The long and winding road to reopen the Clear Creek Management Area in southern San Benito County, closed in 2008, has taken much longer than retired Congressman Farr could have anticipated when he first introduced a bill in 2012 to reopen it. Clear Creek was closed by the Bureau of Land Management after an International Research Foundation study found a minimal health risk to off-highway vehicle users from naturally occurring asbestos in the Serpentine Area. Even if Panetta’s bill were to be approved today, it would most likely be another two years before the area would be opened again to the public. If the Clear Creek

office, a Hazards Education Program must be created within two years after the bill’s enactment. In total, there are approximately 6,170 acres of overlap between Joaquin Rocks and the Clear Creek area. So the Clear Creek Recreation Area is 75,000 acres with 6,170 acres overlapping with the Joaquin Rocks Wilderness (approximately 68,830 acres) and Joaquin rocks is 21,000 acres with 6,170 acres overlapping with the Clear Creek Rec Area (approximately 14,830 acres). The latest attendance

records, taken from the March 2013 Clear Creek Management Area Proposed Resource Management Plan and Final Environmental Impact Statement, are from back in 2006, when there were 43,000 visits to Clear Creek. Estimates are that the number of visits will most likely triple as word of the recreation opportunities in Clear Creek spread once it is open. A conservative guess would be over 90,000 visits annually. Located next to Clear Creek is Joaquin Rocks, sandstone outcroppings

that rise over 4,000 feet from the valley floor. Considered the centerpiece of this remote area, the three scenic monoliths are the eroded remnants of an ancient Vaqueros Sandstone formation. Due to the cool climate created by the rocks elevation, the formation is home to a diverse array of flora and fauna and several species of wildlife. In addition to falcons, hawks and owls, the cliffs provide a potential nesting habitat for the California condor which was reintroduced in the nearby Gavilan Range.

Even when the San Benito High girls soccer team lost its first three matches and four of its first five, coach Becky Bonner didn’t worry. After all, she was sacrificing shortterm victories for long-term goals. “At the beginning of the season, I told the girls—and it’s not a very popular philosophy—that the main goal was if they wanted to win league, we had to have them healthy,” she said. “And essentially what was happening in preseason (non-league play) was if anybody even mentioned being hurt, I benched them. And I didn’t bench them for any reason other than realistically if you want to win league, you can’t come into it with everybody injured or everybody hurt. “So in the preseason I looked at for us to have the best chance at league meant the girls had to be healthy and that meant that every sub that went into the game would be able to play and make a difference. It was really important to me that if something hurt, they rested. Like I said it’s not a very popular or normal strategy for a coach to use, but I’m more about keeping the kids healthy and making sure they have the ability to play long term.” Bonner’s philosophy has paid off as the Haybalers got off to a terrific start in Pacific Coast League Gabilan Division play with wins over Gilroy and Christopher,

the latter critical since the Cougars are the defending champions and returned basically their entire team. Arlette Fausto and Mayvene Molina scored for San Benito, which overcame a 1-0 halftime deficit to post an impressive victory. Molina also scored the team’s third goal on a nice rebound shot in the 26th minute against Gilroy. But it was her goal against Christopher that proved vital and set the tone in what could be a preview of the two teams that end up competing for the league championship. “(The team) picked up their rhythm and looked great as they dominated the second half,” Bonner said. “They looked good. They were passing and moving off the ball, and it was beautiful to watch.” With 12 seniors on the roster, the Balers have a deep and experienced roster that communicates well despite not being overly vocal on the field. “That is something we’ve had to work on all season,” Bonner said. “At the end of every game, we ask the girls what they need to work on and it seems like talking (more) comes up almost every time. So that is just something that realistically will have to be developed as the season goes along.” One thing is for certain: the Balers have no shortage of impact players. In the 5-0 win over Gilroy on Jan. 10, Carli Lowi scored three goals, and Molina and Alex Mendoza had one goal each. Gilroy didn’t have any answers for Lowi, who utilized her speed to consistently blow by defenders on the left flank and come in on the Gilroy goalkeeper under little duress. Lowi didn’t waste any time asserting her dominance in the contest, dribbling the ball for 50 yards on one sequence just two minutes in. Moments later, she made

Lowi also juked defenders with her deft footwork and ability to make a cut on a moment’s notice. “Carli is probably one of the fastest girls in the league, so realistically if that kid takes the space she’s going to beat most people,” Bonner said. “One thing that is really nice about Carli is she can take a shot and doesn’t have to be close to the goal. She has a rocket for a foot so she can shoot from 20, 30 yards out.” Mendoza, a dynamic midfielder, controlled the flow of play whenever the ball was on her foot against Gilroy. Dribbling and passing with precision, Mendoza possesses a number of strong attributes.

“Alex is amazing; she’s like the spine of our team,” Bonner said. “She holds everyone together in the center, and she’s really good at knowing when to distribute the ball and move off the ball. Before the Christopher game, we made her the captain because she really is someone who is a leader on and off the field.” Mendoza and Stephanie Castillo displayed solid teamwork against Gilroy, as the two had a couple of nice give-andgo sequences that put the Balers into an advantageous position on the field. Jada Taylor was her usual self in the first half, able to keep the possession for the team while moving well with and without the ball. Taylor was always around the ball,

a testament to her instincts and a motor that stays in fifth gear. Laine Lowi has also come on strong this season, as the center midfielder plays well off the ball and sees the field well. Sophie Munoz was another player who had an excellent game against Gilroy, creating space on the outside on the left side, something she’s been doing all season. Lupita Gonzalez also was active, helping to move the ball and keeping the flow of play going. What will it take for the Balers to keep their strong play going? “As long as they collectively play together, push forward and remember to play for one another—that it’s not just for yourself—they’ll keep this momentum going,” Bonner said.

ane Kathryn Reed-Goularte was born on August 29, 1953 in San Jose, California. After a nearly 5 year battle with cancer, she passed away peacefully in her home surrounded by family and friends on December 25th, 2018.

Jane is survived by her husband of 41 years, Anthony Goularte, her daughter Taylor Morgan, her son in law Kyle Morgan, her granddaughter Elle Morgan and her mother Dorothy Reed. She also leaves behind brothers Mike Reed (Debbie) and William Nolan, sisters Nancy Whalen (Jim) and Kimberly Clayton (Darrell) as well as brother and sisters in law, Renee Goularte (Stephen Rose), Janice Sanders (Mike), and Harry Goularte. She will be greatly missed by her 8 nieces, 9 nephews and many great nieces and nephews, to all of whom she gave a great deal of love and devotion. Jane was born at O’Conner Hospital in San Jose, California on Saturday, August 29, 1953. She attended school first in Santa Clara, California. When the Reed family moved to Morgan Hill in 1962, she continued primary school at Machado School, followed by Burnett Middle School, and finally Live Oak High School. Jane graduated from Live Oak High School in 1971 and married her high school sweetheart Anthony Goularte on July 30, 1977. Jane attended San Jose State University and earned a Bachelor of Arts degree as well as her teaching credential. Jane worked and volunteered in Morgan Hill throughout her life. She spent time volunteering at church with her mother Dorothy teaching Bible Study, as a caregiver in the MOPS nursery, distributing food for the Reach-Out program at St. Catherine’s Church, and at the local Food Drive and Toys For Tots effort every holiday season. She was a Girl Scout leader for her nieces and daughter Taylor, and home schooled Taylor for many years. She supported several other charities and causes locally, nationally, and worldwide. Jane was a loving wife and mother and a devoted servant to all. While at home, she loved to garden and entertain. She and Anthony were endlessly generous in sharing their beautiful home and yard with family and friends. She also loved to travel and see new places with Anthony. Jane had a great love for children and young people. She was a caregiver for many nieces and nephews over the years, always willing to find the time to help out and give love and energy to her family. Each day with Jane was a blessing and she lived a beautiful life with dignity and grace, always walking God’s path.

artha Moses passed away January 3, 2019 after a brief period of declining health. She was 96. Martha and Sid Moses moved to Hollister in 1958. Except for 10 years spent in L.A., Hollister remained their home base for the rest of their lives, although were frequently away, traveling around the world. Martha was a homemaker, an ESL teacher, and passionate gardener, but also a Girl Scout leader and community volunteer. She played in the Hollister Presbyterian Church Bell Choir and was very active as a volunteer at both the library and the hospital. She was a life member of the Friends of the Library and received an award (along with Sid) as Volunteers of the Year. In 2015 Martha was awarded the Heart for Hazel by the Hazel Hawkins Hospital Foundation. Mrs. Moses was preceded in death by Sid, her husband of 58 years. She is survived by daughter Caroline Moses Camley & her husband Robert of Colorado Springs, CO, son Dale A. Moses & his wife Kim of Kernersville, NC, and several grandchildren.
