Council approves 400 block project’s parking in structure MIXED-USE BUILDING AND COMMUNITY CENTER GETS ITS PARKING Jaqueline McCool

The 400-block project on Feb. 4 won City Council approval to use parking spaces in the Briggs Parking Structure for the proposed mixed-use building and community center. The council voted 3-1 to approve an amended version of the project on Feb. 4 after directing the developer to make changes to the original plans in late 2018 and again in January. Mayor Ignacio Velazquez recused himself from the vote because he owns The Vault banquet hall on San Benito Street, adjacent to the Briggs structure and 400block site. He has consistently recused himself from any 400-block votes in the past several years because of the potential of a conflict of interest. Velazquez has been vocal in his opposition to the sale of the property to the Community Foundation of San Benito County and the Del Curto Brothers, not just because of the concept of the development but also because the city sold it for $300,000 ➝ Council, 11

Hollister police recently rescued an exotic pet parrot that was suffering from numerous complications from ongoing neglect, malnourishment, unsanitary living conditions and lack of clean water, sunlight and ventilation. The brilliant, greenheaded colorful bird named Rocky is now thriving with a new family in a much more caring, healthy home, according to authorities. Bautista”Animal control immediately responded and found the green, red, blue, yellow

and gray parrot in a dirty birdcage that had been left outdoors in cold weather. The press release lists a variety of unhealthy conditions and symptoms that Rocky was suffering from: no access to clean water; signs the animal had been fed an inappropriate diet for the species; and no sunlight or ventilation in the cage. The bird had a “severely overgrown” beak and nails, making it difficult for him to eat or perch, and he was missing several feathers. Officers learned the bird had been living in these conditions for several months, police said. Due to the concern for the parrot’s health, the officers decided to immediately seize the bird and seek immediate veterinary care. The parrot was transported to a vet’s office,

where Rocky’s beak and nails were trimmed. A veterinarian suspected Rocky’s poor feather quality was likely associated with longterm improper diet, stress and lack of socialization. After his initial examination and treatment, Rocky was transported to the Hollister Animal Shelter to be cared for while police conducted an animal neglect investigation, according to police. During the investigation, officers consulted with Mickaboo Bird Rescue, a non-profit organization that specializes in the care of neglected, abused and injured exotic parrots. On Dec. 20, city officials conducted an administrative hearing to determine if the owner should regain custody of the bird. The hearing officer determined that Rocky should not be returned to his

previous owner due to the lack of basic care and concern for his well-being. Authorities did not respond when asked if Rocky’s previous owner was charged or cited for a crime. Rocky’s health vastly improved in the weeks following his rescue, police said. While in the care of shelter staff, the bird continued to visit an avian vet for routine beak and nail trims, as well as blood tests to ensure his health continues to improve despite his previous poor diet. Furthermore, Rocky has learned to imitate the sounds of different species that pass through the animal shelter, including chickens, dogs and cats, according to authorities. He also enjoyed treats including scrambled eggs, fruit and basking in the sunlight.

After Rocky was nursed back to health and cleared his veterinary examination, authorities sought a foster home in the community. He is now living with a family who has experience with exotic birds such as Eclectus, police said. After suffering the loss of their previous bird, the family heard Rocky’s story and decided their home would be a good fit for both species. “Rocky will live out his days basking in his large cage, in the warm sunlight that he needs to thrive,” reads the press release. “His new ‘father,’ recently retired, has already dedicated much of his time to building new perches and toys for Rocky to continue to provide him with the stimulation he requires as an advanced species of bird.”

shells weren’t enough, now the tiny population of California condors in Pinnacles National Park has to worry about drones. Yes, drones. Hikers had notified park rangers late last month that they saw a man “chasing condors with a drone,” apparently trying to get photos of the endangered species. The amateur photographer

apparently was taking advantage of drastically reduced ranger patrols at the park during the 35-day federal government shutdown. Because of the delay in the reporting and reduced staffing, rangers at Pinnacles Park were unable to find the drone operator, said a park spokesperson. ➝ Condors, 4

Council looks at regulating e-cigarettes COUNCIL ASKS STAFF TO STUDY IMPACT OF MARKETING FLAVORED E-CIGARETTES TO YOUTH Jaqueline McCool Reporter

After several community members voiced concerns about flavored tobacco products at past council meetings, Hollister City Council members directed city staff to put

together a report on the issue. Flavored tobacco products like popular Juul pods and e-cigarette products have been the subject of national debate, with many arguing the flavors target young people, even though sales to persons under 21 are illegal. A ban was proposed on the state level in November 2018, and neighboring cities and counties already restrict or ban the sale of flavored tobacco products. According to the staff report, Berkeley, San Francisco, Palo Alto, Oakland,

Marin County, Sausalito, Half Moon Bay, Santa Clara County, Portola Valley, Richmond, Windsor, San Mateo County, Cloverdale, Saratoga, Fairfax, San Leandro, Hayward, Contra Costa County, Los Gatos, El Cerrito, Novato and Sonoma all restrict or ban these products. Bill Avera let the council know that San Francisco’s ordinance was challenged by referendum, but was maintained through a public vote. Avera said after a meeting of Hollister’s Youth Committee that the

committee recommended the city ban all flavored tobacco products. Ultimately the council directed staff to consult with business owners and community youth in order to draft an ordinance. Avera told the council there are currently three designated “smoke shops” in Hollister and around 13 storefronts that sell flavored tobacco products. Many residents came to the meeting to speak about a potential ordinance. Sergio Amezquita, owner of Greenrush smoke shop, said an

all-out ban on flavored tobacco could hurt, if not ruin, his business. Other residents came to speak to the council wearing shirts that read, “Protect Hollister Youth.” District 3 Councilmember Honor Spencer said her work at the city’s high school has showed her what a serious issue electronic cigarettes have become. “This is a real problem and I give these kids credit for stepping up, and I think we really need to crack down on this now,” said Spencer. “It’s an epidemic.”

Hollister Police Chief David Westrick told the council that officers typically issue one to three citations a week for underage use of tobacco products. The punishment for the infraction is probation. Mayor Ignacio Velazquez hoped to pursue a mix of control and enforcement, while Spencer was a supporter of an all-out ban. The council told staff to move quickly in consulting the community and bringing a draft ordinance to the council in an effort to gain control of the issue.

Appeal frees Hollister sex offender FIDONE’S DEFENSE LAWYER GAVE SB PROSECUTORS INCRIMINATING EVIDENCE Michael Moore Reporter

Once sentenced to 23 years in prison for molesting a 19-month-old girl, Hollister resident Jonathan Fidone won an appeal of his 2012 conviction on three felonies and was released from custody last week. In a deal with local prosecutors following the appeals court’s decision, Fidone pleaded guilty to a single count of felony child abuse in relation to the original offense. A San Benito County Superior Court judge determined

Fidone, 29, had already served adequate prison time for the crime, and ordered him to register as a sex offender for the rest of his life. Fidone was released from custody Jan. 28. Fidone was ordered to register as a sex offender within five days of his release, but the county’s Megan’s Law website lists him as “In Violation.” His entry on the sex offender registry does not include a current address or any other updated information. San Benito County Sheriff ’s Capt. Eric Taylor did not respond to requests for more information about Fidone’s registry status. In a Nov. 6, 2018 opinion, the Sixth District Court of Appeal found that

Fidone’s appointed attorney in Fidone’s 2012 criminal trial, Arthur Cantu, was “prejudicially deficient” when he turned over a “highly incriminating” report from Cantu’s investigator to prosecutors with the San Benito County District Attorney’s Office. The report included a detailed description of an interview with Fidone’s cousin Jimy Reyna, a key witness to Fidone’s abuse of the child victim. The child was the daughter of a woman Fidone was dating at the time, according to court files. The couple and child were living with Reyna, who is Fidone’s cousin, and Reyna’s mother in Hollister at the time of the incident. The report from

Cantu’s investigator, David Godoy, provided significantly more detail about what Reyna said he saw the day of the crime—July 17, 2010—than the witness offered in sworn testimony during the trial, the Sixth District opinion continues. Cantu was not obligated to turn over Godoy’s report to prosecutors, and in doing so likely led the jury to find Fidone guilty of three felony counts: sexual penetration by a foreign object, forcible lewd act upon a child and aggravated assault of a child. Judge Steven Sanders subsequently sentenced Fidone to 23 years to life in prison in 2012. The appeals court in November thus ordered that conviction to be vacated, and prohibited

the prosecution’s use of Godoy’s original report as evidence against Fidone in any future re-trial. “Cantu’s deficiency… was so serious that it undermines our confidence in the outcome of the trial,” reads the Sixth District Appeals Court’s opinion. “By deficiently disclosing to the prosecution highly incriminating evidence, Cantu failed to perform competently and prejudiced his client. Defendant is entitled to a new trial.” The state attorney general’s office argued against Fidone’s appeal, but was unable to convince the Sixth District to uphold the original conviction. District Attorney Candice Hooper’s office declined to bring Fidone’s

case to trial again. In January, Fidone was transported back to San Benito County Jail from Kern Valley State Prison. He accepted the deal with prosecutors at a Jan. 28 hearing at the local courthouse. Also at that hearing, the local judge vacated Fidone’s original conviction, as directed by the Sixth District. “When the Court of Appeal ordered that the convictions be vacated, it also directed the trial court to bar the prosecution from using crucial evidence that had been presented in the original trial,” San Benito County Deputy DA Karen Forcum said Feb. 1 in a written response to questions. ➝ Appeal, 11

“Drones are illegal in the park,” he said, adding the ban holds for all national parks. The rugged trails were still being cleared of debris this week, as rangers and maintenance crews worked to restore access routes that spider through the park’s spectacular scenery. National Park Service biologists also returned to work, monitoring and

tracking the endangered bird. California condors, with an estimated Central Coast population now approaching 100, had dwindled to 20 or so in the late 1980s, perilously close to extinction. The big raptors with the 10-foot wingspans apparently have grown fond of the peaks at Pinnacles, where biologists say at least two nesting pairs make their home.

Not much is known about the condors, but nearly all are tagged, numbered and equipped with their own GPS devices and radio transmitters—not for their own navigational purposes, but for the biologists whose laptops follow the birds’ movements. Condors in captivity have been known to live 50 years, but not much is known about their life spans in the wild.

Condors are visiting the park this time of year as nesting season approaches, which makes it prime time for condor watching, said park biologists. A lead biologist estimated there are likely just six active condor nests in Central California. She reported this week sighting the first active condor nest within Pinnacles Park boundaries in several

years. The soaring, reclusive birds hatch just a single egg every two years, so sighting any active nest is good news in the campaign to save the species. The last successful nest, hatching a surviving bird, in the park boundaries was spotted four years ago. That nest, in the park’s centennial year, was the first successful nest in 100 years, according to the biologist.

Lead poisoning from birdshot shotgun shells— now banned in California—is still the biggest threat to condors, she said. The other endangered animal in the park is the Townsend big-eared bat, which lives in the unique caves in the Pinnacles. E

very year we have the opportunity to make a change in our community, but 2019 is special in that there are four new council members with a willingness to actually make change. This is the year we can make positive changes. I would like to explain my vision for a better community. My vision includes a dedication to repairing our local roads, shifting focus from residential development to retail and commercial development and laying the groundwork for providing quality facilities. Residential growth has been a very contentious issue over the last few years, and it has now become very clear that we need a new course rather than continuing down the path of just becoming a bedroom community for Silicon Valley. I want to shift our focus from aggressive residential growth to retail and commercial growth. Implementing smart growth for future residential developments will be very important to ensure that future infrastructure repair costs do not outweigh revenues being collected. Smart growth will also ensure that we only build the number of units that can be absorbed into our community without adding stress to our infrastructure. New developments will also have a mix of affordable units for our local residents. A successful future for our community will depend on more investment in retail and commercial projects, which will lead to more local jobs. Last year, we were able to allocate over $3 million for local improvements to our roads because of the savings from paying off old city debt. This year, I want to make sure we work to permanently allocate over $2 million in funding from vehicle license fees to our road funds account rather than our general fund account. By shifting funds we will have the dollars needed in our road budget to adequately maintain our roads on a yearly basis. This simple move will mean that we will

never have to experience dilapidated roads again. In the 2018 election, voters passed Measure G to widen highway 25 to four lanes and also to help repair local roads. Making Highway 25 a four-lane road will take a lot of work and many public meetings, but it will be very important to our future. Building a community that we can be proud of is important because it gives our residents quality local facilities and it also makes our community more attractive to tourism. One of the best ways to spur a local economy is through tourism. We have many places to visit, such as Pinnacles National Park, Hollister Hills and several wineries. We also can bring many more weekend visitors by building a quality sports park, which will bring families into town to compete at a local facility that has baseball, soccer, football, lacrosse and other types of fields. Hundreds of families would visit our community on weekends, staying in our hotels, eating in our restaurants and shopping in our stores. During the week our local families will have quality facilities to improve their skills. We all win with a sports park. A TEL Center project—Technology, Education, Library— is one that I believe is important to our community. This facility would be able to educate our community for high-paying jobs in technology by providing high-level courses in programming and other important computer skills. There would be classrooms for our middle school, high school and college students who have an interest in a career in technology. The TEL Center would also have gaming rooms for androoms for tutoring in all subjects. The building would also have a new and improved high-tech library for the entire community to use. The TEL Center would be the modern version of a community center that would be located in the heart of our downtown. If the entire community comes together to create partnerships, it will all happen. These projects will take time, but they will change our community for the better.

When I ran for election for mayor, I never had a chance to speak my opinion. I want to address the people about our city growth. They did not think clearly when making all these deals. All it seemed was continuously okaying these houses to be built. To them it means money, money, money. They did not consider how all this would effect our small town—which is no longer a small town. They keep saying affordable housing to make it sound appropriate. But yet, we still have so many people in our community who cannot afford to live in these homes. It’s a joke and another scam to make the city officials look good and make a dollar off of the taxpayers. The point is, Yes, I understand growth is a good thing. But not when it’s making living conditions worse. I have to agree with probably 80 percent of Hollister, that the commute gets more dreadful every day. You’re going to push people out of Hollister before you even get a chance to fill all these new homes. My point would be, “Know when to stop!” Know when to say enough is enough, and be satisfied. fFix what you already have, Fix the roads and get Hollister livable and enjoyable again. I understand things take time. But stop adding, before we finish all these other projects. Our city officials need to be more organized and stop wasting taxpayers’ money. Another thing. I’ve said it time and time again: Growth starts from within. So stop hiring outof-town companies and get our (in-home) businesses and companies involved—give them the opportunity to help grow the community they live in. We all make this city as a whole, we are all a part of it and we need each other to make it function properly. Let’s find a common ground and get things in order. I mean, a $3 million park? Is that really necessary? There’s so much more that I didn’t even touch on, the schools, the hospital. Let’s start finding solutions to all these issues, show results, start budgeting better and get this show on the road. Literally! God bless you all. Keith Snow

Block the plan for lower San Joaquin A plan for lower San Joaquin River flows misrepresents and underestimates the harm it would cause to agricultural resources in the Central Valley. Adopted last December by the state’s Water Resources Control Board, the plan would redirect 30 to 50 percent of “unimpaired flows” in three San Joaquin River tributaries—the Stanislaus, Tuolumne and Merced rivers—in the name of increasing fish populations in the rivers. The flows plan would sharply reduce the amount of water available to irrigate crops in regions served by the rivers. The flows plan would have far-reaching environmental impacts to the agricultural landscape in the Central Valley, and those impacts were insufficiently analyzed, insufficiently avoided and insufficiently mitigated in the board’s final plan. The water board brushed off warnings about the significant damage its plan would cause to agricultural resources in the Central Valley, labeling it “unavoidable.” That damage can be avoided, by following a different approach that would be better for fish and people alike. The water board failed to consider reasonable alternatives to its flows-dominated approach— including non-flow measures such as predator control, food supply and habitat projects for protected fish—and ignored overwhelming evidence that ocean conditions, predation and lack of habitat—rather than river flows—have been chief contributors to reducing fish populations. California farmland is a significant environmental resource, providing food, farm products and jobs for people throughout the state, nation and world. Before cutting water to thousands of acres of farmland for dubious benefit, the state must do more to analyze alternatives that would avoid this environmental harm. Becerra has declined invitations to meet directly with county officials, and has refused all requests for media interviews. One lawyer familiar with the case characterized Becerra’s filing late Friday on the eve of Super Bowl weekend as a “Hail Mary” pass, aimed at convincing a federal judge that only the attorney general could protect healthcare services in Santa Clara County. Becerra submitted his 29-page filing late Friday, Feb. 1, two days after a similar request for a stay was rejected by the same U.S. Bankruptcy Court judge who had approved the hospitals’ sale in late December. Becerra argued in his district court request that a stay “would promote the public interest,” and “involves important issues of state law regarding health, safety and welfare.” Without the stay, “the families and patients served by O’Connor Hospital and St. Louise Regional Hospital will suffer irreparable injury,” wrote Becerra. In the latest court filing, the attorney general made no mention of the claim by the county and Verity Health that if he is successful in his legal fight, O’Connor and St. Louise will close. He said in a Jan 31 press release that the Jan. 30 court decision “strips our office of the authority to protect patients when hospitals are transferred to public entities.” Becerra’s Feb. 1 filing repeated arguments that were soundly rejected by Bankruptcy Judge Ernest Robles in his Jan. 30 ruling.

Last week’s local jubilation over a second court victory in the battle to save Gilroy’s St. Louise Regional Hospital and O’Connor Hospital was short-lived, as California Attorney General Xavier Becerra two days later made one final attempt to block the sale of the two hospitals to Santa Clara County. Late on Friday, Feb. 1, Becerra asked the U.S. District Court for an emergency stay of a bankruptcy court approval of the sale, which the same bankruptcy judge had affirmed in emphatic terms on Jan. 30. The final legal showdown is set for Feb. 22 in a hearing in Los Angeles, less than one week before the county’s purchase agreement with Verity Health System expires. That means a judge could make a definitive ruling against Becerra in time to salvage the $235 million deal and keep the hospitals. The unlikely dispute between Santa Clara County, hospital patients and staff on one hand and the recently elected state attorney general on the other roiled past the boiling point in the last week of January. In one week: • The attorney general said if the sale closes March 1, his bid—pending in U.S. District Court—to claim authority over the deal would be dead. The county—and U.S. Bankruptcy Court—said Becerra has no legal basis

for his claim. • The county said if Becerra is successful in his second attempt at a stay—the first was denied in bankruptcy court Jan. 30—the Verity Health System sale of the two hospitals would be dead. • Patients, health professionals and local politicians took that one step further, saying Becerra’s actions would close the hospitals and actually put lives of South County residents in danger. • The attorney general told the court he didn’t believe these dire predictions. • In his filing for the stay in U.S. District Court, Becerra said he needed to stop the sale to enable his appeal to continue, but he made no mention that his effort to “preserve vital healthcare services in Santa Clara County” might have the opposite effect. • The attorney general alleged again in more certain terms Feb. 1 that the county had “refused” to guarantee the provision of essential healthcare and emergency services, or to promise acceptance of Medicare and MediCal patients. • County Executive Jeff Smith accused Becerra of making “false” and “misleading” statements, referring to well-publicized statements by the county and to the attorney general’s rejection on Jan. 22 of a signed agreement with the county assuring the provision of the healthcare services to all county residents. • The attorney general said that if he can’t enforce guarantees, “the county is free to close the hospitals or eliminate vital healthcare services in those communities.” • Smith last week called this claim “just absurd” and said the county offered to pay $235 million to buy two

Parking for 400 block endorsed by 3-1 vote ➝ Council, 1

Avera told the Free Lance that the proposal differed from the last time it was presented to the council because of the addition of loading zones on San Benito Street, a lot line adjustment and the relocation of a trash enclosure. An original proposal had included 20 parking spaces reserved for the community center, but that was taken out of the plans. District 2 Councilmember Rolan Resendiz pulled the item from the agenda for discussion. He has consistently aligned with the mayor’s view of the project, and he questioned why Del Curto Brothers was not paying to use the parking spaces. Avera said the developer’s would not be paying to use the spaces, but a maintenance cost was still to be worked out. Ultimately,

below the most recent appraised value of the property. A 2015 appraisal had valued the land at downtown Hollister’s busiest corner at $390,000. In September 2016, an updated appraisal placed the property’s market value at $690,000. The property was sold to the developers and the foundation in June 2017 for $390,000. The current project is made up of two phases: The first is the philanthropic center, which will serve as office space for various non-profits in San Benito County, including BenitoLink, a non-profit news website funded in part by the foundation. The second phase includes ground-floor

commercial space with second-floor apartments. In October the city’s Planning Commission approved site and architectural application for the philanthropic center and mixed-use space on the 400-block site. When it came to the developments’ use of the parking structure, the council had asked city staff to address a number of concerns with the structure being used for the apartments and community center. How apartment tenants will access the structure remains up for debate: City Manager Bill Avera told the Free Lance that he hopes the structure will be open 24 hours a day to avoid conflicts with keys and automated gates.

the woman’s 19-monthold daughter were living with Reyna on Versailles Drive. Fidone arrived home that day with the baby, but the girl’s mother was not with them. Reyna was at home with his own children, according to a highly graphic description of Reyna’s statements and testimony in the Sixth District’s Nov. 6 opinion. At one point, Fidone carried the baby into the home’s garage, which had

been converted into a living space where the couple and baby lived, and closed the door behind him, according to the court file. A few minutes later, Reyna knocked on the garage door, but Fidone did not respond. Reyna then went outside to a window to attempt to see inside the garage. From outside the window, he saw the child on the bed, being moved in a suspicious, potentially harmful manner but could not see Fidone. He could hear the child screaming, and saw

an adult hand—presumably Fidone’s—reach up to cover the girl’s mouth. Reyna then went back around to the door, which was locked, and opened it with a screwdriver, reads the appeals court’s account of the trial. He saw Fidone standing in the corner of the room, wearing a shirt with his pant around his ankles. He was holding a towel in front of him to cover himself up. The unclothed child was still on the bed when Reyna entered the room. Reyna also saw pornographic

magazines open in the room, and a pornographic movie playing on the television. Fidone told Reyna at this point that he was “changing the baby,” reads the appeals court document. Fidone denied harming the child. Evidence at the 2012 trial included reports and testimony from medical experts who examined the child after the reported abuse, in addition to testimony from Godoy, Reyna, police investigators and forensic science

technicians. Prosecutors presented DNA evidence that allegedly connected Fidone to the reported abuse. The jury deliberated for three hours before returning the guilty verdict. Cantu appealed the verdict on Fidone’s behalf shortly thereafter on the grounds of juror misconduct. However, the judge denied that appeal. Fidone then sought habeus corpus relief with the appeals court, leading to the recent decision. His attorney in the appeals proceedings is

David D. Martin, who did not return a phone call. Cantu also did not return a phone call requesting comment. The appeals court opinion said Cantu’s decision to turn over Godoy’s report “violated Cantu’s duty of loyalty to his client.” “Cantu’s decision to list Reyna as a defense witness and to disclose Godoy’s report to the prosecution was not a reasonable strategic decision; it was plain incompetence,” the Sixth District opinion states.

ORDINANCE NO. 61 AN ORDINANCE OF THE BOARD OF DIRECTORS OF THE SAN BENITO COUNTY WATER DISTRICT ESTABLISHING SAN FELIPE DISTRIBUTION SYSTEM WATER CHARGES FOR AGRICULTURAL, NON-AGRICULTURAL AND WHOLESALE WATER WHEREAS, on November 8, 1977, the voters of San Benito County passed Proposition B, which authorized the levy of charges sufficient to repay the United States for the District’s share of the cost of construction and cost of operation and maintenance of the Federal Facilities portion of the San Felipe Division of the Central Valley Project; and WHEREAS, Proposition B also authorized a levy of charges sufficient to repay the costs of construction and cost of operation and maintenance of the District’s Distribution Facilities; and WHEREAS, the Board of Directors has determined charges which together with other revenue sources, are sufficient to repay the United States for the construction and operation and maintenance of the Federal Facilities or for the cost of operation and maintenance and repayment of the District’s Distribution Facilities; and WHEREAS, the District mailed notices to all parcels upon which the charge is to be imposed (*excepting wholesale rate customers) setting forth the information required in Section 6 of Article XIII D of the California Constitution (Proposition 218) and notifying the owners thereof of a public hearing on January 30, 2019, to consider the charge (*Wholesale charges are not subject to Article XIII D of the California Constitution); and WHEREAS, the District also published a Notice of Public Hearing for January 30, 2019, at 5 p.m. to consider the adoption of an ordinance setting all San Felipe rates and charges; and WHEREAS, after 45 days from the date said Proposition 218 notice was mailed, and pursuant to said Notice of Public Hearing, the Board conducted a public hearing on January 30, 2019, to determine whether or not the charge should be levied in Zone 6, and to consider the amount of any such charge; and WHEREAS, excepting the wholesale rate to which the protest procedure is not applicable, less than a majority of the owners or lessees of parcels upon which the charge is proposed for imposition filed protests. BE IT ORDAINED by the Board of Directors of the San Benito County Water District as follows: 1.Rates and Charges: In order to meet said costs, the rates for water delivered through the pressurized San Felipe Distribution System shall be established as follows:

Regulatory Overuse Charge - Water used over the allocation(s) will be billed at the applicable agricultural or non-agricultural rate along with the regulatory overuse charge. The regulatory charge is to encourage conservation and discourage overuse, and is the current spot market rate, with a maximum of $2000.00 per acre foot. The regulatory charge is applied to blue valve water use which exceeds the parcel or account allocation. 2.

Findings:

The Board of Directors hereby finds and determines that: a) Revenues derived from the charge imposed herein do not exceed the funds required to pay for operation and maintenance costs associated with the delivery of San Felipe water and the power costs for pumping, transmission and distribution of San Felipe water to the District’s customers, and shall not be used for any other purpose; b)

The amount of the charge does not exceed the proportional cost of the service attributable to the parcel;

c)

The service for which the charge is imposed (see 1. above) is actually used by or is immediately available to the owner in question;

d)

The charge is not imposed for general governmental services.

e)

The wholesale charge does not exceed the reasonable costs to the District of providing the product and services to the retailer.

3.

Effective Date: The above rates and charges shall be effective upon the commencement of each water year as set forth in Paragraph #1 above.

4.

Repeal of Prior Ordinances: All Ordinance and parts of Ordinances inconsistent herewith are hereby repealed.

5. Severability Clause: In the event that any portion or provision of this Ordinance shall be determined by a court of law or other tribunal to be invalid or unconstitutional, such findings of invalidity or unconstitutionality shall not affect the validity of the remaining provisions of this Ordinance, which shall remain in full force and effect. 6. Publication: This Ordinance shall take effect immediately. Within 15 days after its passage, this Ordinance shall be published once in a newspaper of general circulation in the County of San Benito, State of California, together with the names of the members of the Board of Directors voting for and against same. Man arrested downtown with loaded gun SUSPECT WAS CARRYING FIREARM AND HIGH-CAPACITY MAGAZINE, POLICE SAY Staff Report

Hollister police arrested a local man who was carrying a loaded firearm and a high-capacity magazine in the city’s downtown, according to authorities. About 10:46pm Jan. 26, a Hollister police officer was on patrol when

another officer advised him that several people had been involved in a physical altercation, according to a press release. The altercation had been reported in front of the Hollister House Bar and Grill, 500 San Benito St. As the officer arrived, he saw three men running from the area, according to authorities. He followed them in order to determine if they were involved in the fight. The officer caught up to the suspects in the area of the 600 block of San Benito Street and detained them.

As the officer was questioning the three men, he recognized one of them as a suspect who was recently arrested for possession of a firearm, police said. As the investigation continued, the officer learned one of the men had a handgun loaded with a high-capacity magazine concealed on his person. The gun did not display a serial number. The officer arrested the man, Cesar Gomez, 20, of Hollister, police said. Gomez was transported to San Benito County Jail and booked on suspicion of carrying a loaded

firearm, carrying a loaded firearm while being a gang member, carrying a loaded firearm for which he was not the owner, altering the serial numbers on a firearm and possession of a high-capacity magazine. In his third start of the season, Jorge Molina Ruiz showed why he’s one of the best offensive talents on the San Benito High boys soccer team. Playing against North Monterey County on Jan. 18, Ruiz had three legitimate scoring opportunities in the first half alone, barely missing on all three. That was the theme of the day for the Haybalers, who had to settle for a 1-1 tie despite dominating the possession. San Benito earned its first point in Pacific Coast League Gabilan Division play after dropping its first two matches to Soledad and Alisal. Unfortunately for the Balers, after the NMC match they went on to lose their next four matches in league play, all by one goal. They entered the week with a mark of 0-6-1 in Gabilan Division play, with five of those six defeats coming by one goal. Whatever happens, Ruiz looks like a player to watch out for the remainder of the season and next year. The junior midfielder displayed some nifty footwork against NMC, which allowed him to create space for himself, key since at 5-foot-4 Ruiz can be pushed off the ball by bigger defenders. However, Ruiz was a big reason why the Balers held the run of play, as he dribbled by defenders with ease. Ruiz was actually benched in the first game he started, but has come on strong lately. “I was really nervous in the first game I started, so I just

tried to keep working,” Ruiz said. “Coach (Greg Dolan) liked how I played in the midfield, so he put me there and I’ve been trying to make plays ever since.” Ruiz possesses a laser shot of a left leg, agility and the ability to create enough daylight in traffic to unleash a shot from anywhere around 30 yards and in. Nervous at the start of the match, Ruiz settled down nicely. “Once I got that first shot everything changed,” he said. San Benito went up 1-0 on North Monterey County when Jose Agredano made one of the finer passes you’ll ever see at the high school level, threading a ball from just inside the right sideline near the midfield line all the way to a streaking Edgar Barbosa Rosales, who banged home a shot in the 48th minute. Just a minute or two later, Agredano produced another terrific pass to Juan Orozco, whose header went wide right by a foot or two. It was one of several near-misses for a San Benito team that had its way with the visitors. Unfortunately for the Balers, they failed to clear a ball in front of their goal, allowing NMC to get the equalizer in the 57th minute. Instead of picking up three points for a win, San Benito had to settle for one point for the draw. The one or two key mental errors have been costly for the Balers this season. “It’s a little tough but from the last two games (against Soledad and Alisal), we’ve improved a lot,” Balers defender Abel Rivera said. “This game by far we had more shots and more chances. We also moved the ball a lot more. The thing we can improve on maybe is movement off the ball to check in and want and get the ball. We also need to talk to each other more. necessary. On the NMC goal, Casaca and his teammates didn’t communicate well enough to clear the ball out. Erik Servin and Erwin Gomez Puerta also were two of the more active players, with Servin making a sensational pass to Agredano midway through the first half that almost led to a goal. It’s only a matter of time before Ruiz finds the back of the net. He created some great

AROLD FRANCIS COSTA, passed away Friday, January 18, 2019 after a short illness. Husband of 60 years to the late Jean Costa (2012). Son of the late Manuel & Ann Costa (Azores). Father of Pamela Costa of Rohnert Park, CA, Steven Costa (Teresa) and Randy Costa (Ann) all of Gilroy and the late six-week old infant daughter, Shelley. Grandfather of Kyle Costa of Gilroy, Kendall Costa of San Francisco, Thomas & Kevin Costa both of Gilroy and Friend to many including Edna & Gene Yow and Pat Filice. Preceded in death by his siblings, Larry & Ernie Costa, Violet Davidson and Elaine Wanderer. Also survived by nieces and nephews. A native of San Jose, CA.

Born and raised in San Jose. Graduated from Lincoln High School. Married in 1952. Lived his entire life in San Jose until 6 months ago moving to Gilroy. Worked for P.G. & E. for 42 years as a gas serviceman. Upon retirement, Harold started his second career working with his two sons, Steve & Randy at Headstart Nursery, Gilroy as a delivery man, errand runner, cheerleader, promoter, and official greeter for 22 years. Harold was an active member of PGE Retirement Serviceman club, Gilroy Tire Morning Club, Napa Auto Parts Club, Carl’s Junior Lunch Club and the Sandy’s Café Morning Club. He enjoyed most sports, the Giants, Car Racing and Hot Rodding. He was happiest being around friends and family especially supporting his children and grandchildren at any and all school or sporting events. In lieu of flowers, family would appreciate donations to ALS in support of his late wife Jean.
