The $24.5 million expansion of the San Benito County Jail is nearing completion despite some weather-related delays this winter. Construction on the jail expansion—designed to prepare inmates for reentry into society rather than simply keep them incarcerated—on Flynn Road in north Hollister is about 91 percent complete, according to San Benito County Sheriff ’s Capt. Don Bradley. Originally expected to be complete in April, the project is almost two months behind schedule due to “moisture content in the air and mud on the ground throughout the unusually wet winter,” he said. The current expected completion date is June 9, Bradley said. From there, the “best guess” is the sheriff ’s office will in July gain notice to occupy the new jail building from county supervisors and the state fire marshal. Construction began in late 2017. The larger jail will require more county corrections staff. The San Benito County Board of Supervisors approved two new full-time corrections positions to staff the jail in the current county budget. The sheriff ’s office has said they need five more officers to appropriately staff the

styrene and benzene, which are neurotoxins. “While safe to use as a plate or a cup for food consumption, the produce can release these toxins when it becomes heated” as they are burned or melted down, said SBHS Food Supervisor Jim Lewis. He said the cafeteria used Styrofoam bowls for soups, salads and yogurt, and foam cups for beverages. “We are proud to say that we are now using eco-friendly paper goods for all of our food and beverage needs,” Lewis said. The new heavyweight paper goods are renewable and compostable. In a statement from the Environmental Club, co-presidents
Shelby O’Neil and Ian Sills said the club is “elated” about the ban and thanked SBHS principal Adrian Ramirez and Superintendent Shawn Tennenbaum “for their assistance in this project. Sills, who has been accepted to Stanford University, and O’Neil, who founded the nonprofit Jr. Ocean Guardians to teach schoolchildren about the importance of oceans, said the Environmental Club “recognizes the necessity of teaching students how to live sustainably.” “A major part of living a sustainable life is using sustainable materials,” the student leaders said in their announcement.
“Consequently, the Environmental Club has pursued this polystyrene ban since the beginning of the school year in order to avert the use of this harmful and environmentally detrimental material on campus.” Lewis said all bins in the cafeteria and around campus will be clearly marked and accessible to make sure students are recycling the environmentally friendly food and beverage containers. “Unlike most footprints that blow away in the wind and become unnoticed, this footprint will be sure to have a lasting impact on future students and generations at San Benito High School.”

Hollister faces special ed challenge K-8 DISTRICT CORRECTING DEFICIENCIES CITED IN NEW REPORT Scott Forstner Reporter
Less than a week on the job and new Hollister School District Superintendent Diego Ochoa is already faced with the task of bringing his district’s special education program back into compliance with state and federal guidelines. Before even officially joining the HSD staff, Ochoa was in the audience
Jan. 8 when an internal report—contracted by the district—unearthed numerous deficiencies in Hollister’s special education program. Complaints filed with the California Department of Education dating back to the 2015-16 school year included instances of staff not following mandated protocols for Individualized Education Programs (widely known as IEPs) by failing to provide instructional services and specialized academic instruction to students with special learning needs or disabilities. In one case this year, a student was removed
from class 16 times due to behavior before the district held a single IEP meeting to address the issue and find a path toward resolution. That non-action was in violation of federal regulations, according to the report’s findings. The district has since taken corrective action by providing a “more restrictive setting to address their needs,” the report concludes. In another complaint from the 2017-18 school year, the state determined that the district failed to provide a required 180 minutes of occupational therapy services to a student enrolled at one of its schools. The
district has since completed those mandatory hours. “It was an extensive and thorough report,” said Ochoa, who was still introducing himself to site principals and staff last week during his first days as HSD’s education leader while also reviewing the special education report in order to take further corrective measures. “I have been in special education my whole career. It’s really my comfort zone to be working in special education,” added Ochoa. “When I chose to interview for this position, one of the main motivators was the opportunity to work in a district
that needed assistance and focus on its special education program.” Problems in special education—among other issues he witnessed firsthand as a part-time substitute teacher in Hollister schools—is also what prompted first-term board president Stephen Kain to run for school board in November 2018. “I saw serious issues not being addressed by the school district,” said Kain, who credited interim superintendent William Barr for starting the process of fixing the special education program that ➝ Special ed, 12

Gov. Gavin Newsom sent shockwaves through California with his Feb. 12 State of the State address on Feb. 12 when he said “we have to get real” about the longplanned high-speed rail through California. Newsom told his statewide audience that the controversial project would “cost too much and take too long” and that he would shift focus to the Merced to Bakersfield portion of the plan. Newsom’s criticism of the rail line spawned cheers in the South Valley because many thought the project had been altered or ended all together. Two days later, the Governor issued a clarifying statement that seemed to indicate that not much had changed after all. Boris Lipkin, Northern California regional director for the rail authority, said in an interview that funds will be redirected to ensure the Merced to Bakersfield line gets completed, but added that the Gilroy stop and rail infrastructure through Morgan Hill are still in the works. Lipkin said he knew the governor planned to address the project, but didn’t realize how much the remarks would confuse Californians.
Newsom’s follow up remark came after he exchanged barbs with President Donald Trump on Twitter after Trump asked him to return the $3.5 billion in federal funds the project had received. Newsom said, “We’re going to make high-speed rail a reality for California. We have the capacity to complete the rail line between Merced and Bakersfield. We will continue our regional projects north and south. Finish Phase 1 environmental work. Connect the Central Valley to other parts of the state. For those who want to walk away, abandoning high-speed rail means we will have wasted billions of dollars with nothing but broken promises and lawsuits to show for it. I’m not interested in sending $3.5 B in federal funding—exclusively allocated for HSR—back to the White House.” Lipkin told this paper that the preliminary work being done in South County would continue, and while it was hard to know how the timeline would inevitably shift with the new plans, the lines would still happen in the previously planned areas. An email sent by Morgan Galli from the rail authority confirmed a South County meeting with the authority on March 5 will still happen as scheduled. Both Morgan Hill and Gilroy have previously held several

Morgan Hill Councilmember Rene Spring released a statement before the Governor’s clarification praising the change of plans. “While I am a big supporter of public transportation projects, this one was not it for us
in our area! Thank you, Governor!,” wrote Spring. “Many Morgan Hill residents worried about HSR’s route might now be able to take a deep breath again!” Lipkin said the authority will continue to do all of the work in Northern and Southern California to get the areas “shovel ready.” While the project has never been fully funded,
Lipkin said the authority’s 2019 project update report and 2020 business plan will address the new focus on the Bakersfield to Merced line and how the rest of the project will continue to get funding. Ultimately, Lipkin said, the rail will still extend from Sacramento to San Diego. “That’s what the
governor supports, and that’s what the voters asked the authority to do—and eventually from there extend all of the way from sacramento to San Diego,” said Lipkin. “I think what you’ve seen since the speech is the very strong desire from all parts of the state to make that a reality.”

Police: Two sex offenders arrested SUSPECTS FAILED TO UPDATE THEIR REGISTERED ADDRESS, POLICE SAY Staff report
Hollister police arrested two local sex offenders in recent weeks for lying about their registration status, according to authorities. Miguel Zarazua, 37, was
arrested on Jan. 22. Patrol officers were dispatched to a home on Knight Lane in Hollister on a report of a family argument. When officers arrived, they learned that Zarazua had been residing at the home for several months. Zarazua had previously been registering as a “transient” sex offender, and failed to update his registration address with the police department, police said in a Feb. 13 press release. Zarazua was booked at San Benito County Jail for
failing to register with the police department when he moved into the new residence. Zarazua was convicted in 2003 of rape by force or fear, according to the Megan’s Law sex offender registry website. On Feb. 7, Hollister police made a similar arrest when Julio Arevalo, 35, visited the police department to update his status as a transient sex offender, authorities said. A detective interviewed Arevalo and learned that
he failed to properly disclose his current address about 39 times in the last three years. Arevalo has been living in an apartment on Rancho Drive, but had previously failed to register that address, police said. He was arrested and booked on suspicion of failing to update his sex offender registration. Arevalo was convicted in 2004 of lewd or lascivious acts with a child and sex penetration with a foreign object of a child

purpose of the new facility is rehabilitation and preparation for re-entry back into the community,” Bradley said. “So the inmates selected for this (test run) will be screened for their desire to participate in education, or job skills training in an effort to reduce recidivism and promote a successful return to a productive live without…criminality.” The new facility will contain new space for health services for inmates, classrooms and outdoor recreation yards. A challenge in the design and budgeting of the new facility has been the control room technology. The control room in the current facility is at the end of its life, with jail staff often having difficulty replacing broken parts, Bradley said.
The expanded jail will have a modern, state-of-the-art control room, but it is not compatible with the antiquated technology in the existing jail. “We have been able to design and approve installation of a temporary fix that will allow both facilities to be operated from one control room,” Bradley said. “Unfortunately, this is not a long-term fix.” The long-term solution involves the purchase of another technological upgrade, “but this will not occur until after we have occupied the new jail expansion and the existing contract is closed,” Bradley said. Planning of the jail expansion began in 2007, when the county received $15 million for the project under the state AB900 law. The county will contribute

such staffing as the facility becomes fully operational. The current jail has a staff of 26 full-time employees, according to the county’s 2017-18 budget. The sheriff ’s office is in the process of hiring three full-time corrections deputies, one of which is an existing vacant position, Bradley said. Another delay is related to an off-site vendor’s production of an “anti-climb mesh wire” that will be installed around the outdoor recreation yards in the new facility, Bradley said. The county was recently told the vendor would manufacture this material at the end of April, but this is the third time the item has been delayed.
The 25,000-squarefoot jail expansion, a podular design, is directly next door to the county’s existing facility, which is routinely filled to its full capacity of 142 inmates. A breezeway will connect the two buildings. Once the expansion is open, the county will have a total jail capacity of 214. Authorities “do not anticipate running this facility at full capacity right away” due to its prioritization of rehabilitation over incarceration, Bradley explained. A small group of inmates will be selected by county corrections staff to give the new facility a “test drive” after it is cleared to open. These inmates will be selected based on past good behavior, and on their willingness to be productive citizens. “Keep in mind that the

The COPs will utilize a “lease/leaseback” arrangement with the San Benito County Financing Corporation to gain the needed funds, explains a Feb. 5 county supervisors staff report.

Slower high-speed rail?
I
t sounds crazy, but a presidential rant on Twitter may have forced Gov. Gavin Newsom to “clarify”—actually, backtrack—his position on California’s high-speed rail. “The project, as currently planned, would cost too much and take too long,” the governor said of the state’s high-speed rail plan in his State of the State address Feb. 12. He pledged to complete a Central Valley (Merced to Bakersfield) route and take a hard look at the rest of the route. “Right now,” he said, “there simply isn’t a path to get from Sacramento to San Diego, let alone from San Francisco to LA. I wish there were.” That sent some reporters and politicians scrambling to social media to write the train’s obituary. With the latest price tag approaching $80 billion, nearly double original estimates and more than eight times the $9 billion authorized by California voters in 2008, the governor’s statement seemed to make sense—until daily newspaper headlines and local officials, even President Donald Trump, assumed that Newsom’s comments meant that the project was dead. It turns out that initial reports of the death of High-Speed Rail were greatly exaggerated. There, in fact, was more in the speech. The governor then gave a politically ambiguous “on-the-other-hand’ remark, saying that, “Abandoning high-speed rail entirely means we will have wasted billions of dollars with nothing but broken promises and lawsuits to show for it. And by the way, I am not interested in sending (back) $3.5 billion in federal funding that was allocated to this project.” The day after the State of State remarks, Trump called on California to return $3.5 billion in federal funds that had been provided for the high-speed rail system. He tweeted, “California has been forced to cancel the massive bullet train project after having spent and wasted many billions of dollars. They owe the federal government 3½ billion dollars. We want that money back now. Whole project is a ‘green’ disaster!”

As is often the case, the President got it wrong, not unlike many California politicians. Newsom responded the next day with his own tweet: “Fake news. We’re building highspeed rail, connecting the Central Valley and beyond. This is California’s money, allocated by Congress for this project. We’re not giving it back. The train is leaving the station—better get on board! (Also, desperately searching for some wall $$??)” Newsom’s attempt at clarification has left most of the state wondering where we go from here. After the State of the State, a Newsom spokesperson Nathan Click gave assurances that his boss wanted to “refocus” and “reprioritize” funding, to enable the Central Valley plan to be completed. But he added his own on-the-other-hand comment, that “the state will continue undertaking the broader project—completing the bookend projects and finishing the environmental review for the SF to LA leg—that would allow the project to continue seeking other funding streams.” Proposition 1A in 2008 said the highspeed train would need to move at a speed of at least 200 mph and connect San Francisco to Los Angeles in 22/3 hours. Construction of the Fresno-to-Madera portion of the rail system began four years ago. The high-speed rail folks are trying to say there really has been no change of plan, saying the governor “reaffirmed our commitment to complete the environmental work statewide, to meet our ‘bookend’ investments in the Bay Area and Los Angeles and to pursue additional federal and private funding for future project expansion.” That didn’t help. These high-speed rail waters continue to be as muddy as a creek after a winter rain. A high-speed rail connection in Gilroy could be a lifesaver for the city’s downtown. It also could provide an important new commuter option for northbound workers in San Benito County. At this point, however, the “train to nowhere” label will linger as long as both the funding and the plans remain in limbo. More clarity, governor; more clarity, please.

Too often, entrenched conflicts that pit water user against water user block efforts to secure a sustainable, equitable and democratic water future in California. Striking a balance involves art and science, compassion and flexibility, and adherence to science and the law. Felicia Marcus is a public servant unknown to many Californians. But as she concludes her tenure as chair of the State Water Resources Control Board, we owe her a debt of gratitude for consistently reaching for that balance. In the face of a changing climate with more ferocious and unpredictable floods, droughts and fires, Californians need public leaders of Marcus’ caliber. Under her guidance, the state water board helped navigate California out of one of the worst droughts in our history, championed solutions to help fulfill the human right to safe water, developed laws and regulations to bring our groundwater basins into balance, and began to bring our water data systems into the 21st century. “There is no silver bullet to our water problems, only silver buckshot,” Marcus says. She understood and championed the need for a portfolio of solutions. She genuinely listened, didn’t shy away from tough decisions and maintained a fierce dedication to public safety, economic security and environmental health priorities of the state she loves. Her leadership will help her successors, E. Joaquin Esquivel and Laurel Firestone, who bring experience in community-based work to the board. At a time when one million Californians can’t drink the water out of their taps, extreme weather threatens the security of our precious water supplies, and freshwater ecosystems stand at the brink of collapse, we must identify and encourage leaders who prioritize community needs and aspirations. The water board’s work is complex. To keep California on a path toward success, the board should continue practices from Marcus’ tenure. The water board’s role is to carry out laws passed by Congress and the Legislature, oversee water rights and protect the public trust. That includes ensuring safe water and a healthy environment. Board members increasingly championed flexibility and creativity in how those laws are implemented, seeking winwin solutions when possible. But it cannot compromise its legal requirements and end goals and objectives. All of these tasks are easier said than done but are critical to mitigating and preventing the worst, whether it’s the collapse of iconic fish populations, toxic water in homes and schools, or the loss of our agricultural economy and heritage. We can govern with science and empathy, humor and grace. We can collaborate around creative solutions that make the biggest impact with the smallest cuts while keeping our eyes trained on tangible outcomes. In the Delta, that means restored habitat, clean water flows, greater certainty of supplies and resilience against droughts and more violent floods. In a New York Times interview a few years ago, Marcus said: “I see people, and the first thing they want to tell me, they want to do, is confess their water sins.” We’re lucky to have been in the same room as she listened actively to anyone about anything for as long as they needed to share. It’s not something to take for granted. Perhaps we all became water sin confessors in front of Marcus because she regularly reminded us that we all play a role in protecting our water resources. In our field, we often hear that where water flows, our lives and livelihoods thrive. Water public servants are what Californians need to keep us on a path dedicated to the public interest. In the middle of a drenching rain storm Feb. 14, a group of protestors gathered outside the Morgan Hill office of Immigration and Customs Enforcement (ICE) in hopes of shutting it down. The protest, organized by the Rapid Response Network in Santa Clara County, hosted a series of speakers at the Vineyard Court office who advocated for the abolishment of the agency and the shutdown of the field office over an incident that occurred in December 2018. At the first protest, immigration attorney Dorothy Ma described an incident where an immigrant was detained by officers with the U.S. ICE agency and was denied due process while forced to sit in a van outside the Morgan Hill field office on Vineyard Court before he was transported to a processing center in San Francisco. The protestors returned nearly two months later, this time in smaller numbers in the winter rain, with a list of demands; many marched into the field office an read the list to the

Fire leaves three homeless in Hollister ONE VICTIM REPORTEDLY CRITICALLY INJURED WITH BURNS FROM HOUSE FIRE Staff report
An early morning house fire Feb. 13 left three elderly Hollister residents homeless, and one in critical condition, according to authorities. About 7:05am Wednesday, Hollister police and fire departments were dispatched to a structure fire on the 900 block of Prune Street, just east of Hollister’s downtown. Hollister Police Officer Stephen Frates was the first

The American Red Cross responded to assist the fire victims, and Adult Protective Services arrived to help care for the displaced residents until family members could be notified. Authorities estimated the home is a total loss. The San Benito County Fire Investigation Team is investigating the cause of the blaze, according to police. A subsequent search of Perez and the passenger, Emily Vaca, 38, of Gilroy, revealed that Vaca was carrying a handgun concealed on her person, according to police. Hollister Police arrested three people in possession of concealed handguns in separate incidents in recent days, according to authorities. The first incident occurred about 10:16pm Feb. 8. A Hollister police
occurred about 9pm Feb. 9, when detectives were out working a “proactive enforcement detail” in Hollister, police said. Two detectives attempted to stop a vehicle in the 600 block of Central Avenue for a traffic violation. The vehicle fled at a high speed, running stop signs and driving recklessly. The officers pursued the vehicle to the 200 block of San Lorenzo Drive. The driver stopped the vehicle and all occupants were detained without incident, police said. A loaded handgun

Hollister Prep gets new Hardin lease CHARTER SITE WILL CONTINUE WHERE AT THE GRADE SCHOOL Staff report
With the addition of two more classrooms to accommodate its grade-level expansion, Navigator Schools’ Hollister Prep School was granted a new facilities use
agreement for 2019-20 by the Hollister School District’s Board of Education. The board, which ratified the deal at a Feb. 16 meeting, followed district staff ’s recommendation in approving the one-year Prop. 39 agreement. Hollister Prep is projected to enroll 540 students for the 2019-20 school year. The charter school will add eighth grade in the fall and was
granted an increase from 17 to 19 classrooms on the R.O. Hardin Elementary School campus, located at 881 Line St. in Hollister. In addition, the agreement allows HPS “exclusive access to three rooms for office and other administrative use, exclusive use of the garage for storage and shared use of a storage container, multi-purpose room, restrooms, library, outside
eating area, play fields and parking lot at the R.O. Hardin Elementary School site,” according to the staff report. Per the agreement, HPS is responsible for its own custodial services and for all costs associated with routine maintenance and child nutrition services provided by the Hollister School District. In the current 201819 year, Hollister
Prep—which opened in August 2013 at Hardin with authorization through the Hollister School District—has 480 students enrolled in kindergarten through seventh grade. Navigator Schools’ flagship charter campus is
in Gilroy and authorized through Gilroy Unified School District. It recently won an appeal through the state Department of Education to open another charter school in Watsonville for the 2019-20 school year.
The charter school will add eighth grade in 2019-20.

to monitor and proactively review IEPs for compliance.” Per the recommendations for staff, the district is recruiting a director of special education, whose only focus would be that department, as well as three clerical positions to “ensure the work of the department is completed.” The district will provide training and written procedures for staff, according to the report. “Our vacant director of special education position was posted on Jan. 25 and it closes Feb. 25, and we will be interviewing immediately afterward and identifying the successful candidate,” said Ochoa, who has set a deadline of March 1 for all necessary job postings such as school psychologist and speech and language pathologists. “I also want an extensive analysis of how many students we have in the district who need services and how we can fit those needs in with the appropriate staff.” Other recommended positions for the special education department were a Spanish translator to help with IEPs and three additional

Ochoa has now taken on. “When we sat down with the new superintendent and learned of his vast background in special education, that’s one of the reasons we hired Diego Ochoa.” Ochoa absorbed as much as he could when consultant Marilyn Shepherd gave her report on the state of the district’s special education department at the Jan. 8 school board meeting. He identified two main factors causing the noncompliance issues as staffing and procedures. “When you are looking at how to improve special education, you first go to what are the procedures and do we have the appropriate procedures in place?” Ochoa explained. “Every IEP must be handled according to (education code) requirements. We need to establish nonnegotiable procedures in that department.” By law, an IEP, which is designed to meet a student’s unique needs, must include current performance (how the disability has affected the student’s
ability to perform and progress); annual goals (short-term and benchmark); special education and related services (such as supplementary aids and services that the child needs); participation with nondisabled children; participation in state and district-wide tests (any necessary modifications to test-taking); and dates and places (when services begin, how often they will be provided, where they will be provided and how long they will last). According to multiple complaints over the past three years, addressed in the report, Hollister schools failed to follow through on students’ individualized plans. “We are aggressively trying to address the concerns as quickly as possible,” Kain said. “We are already making progress. This is not something that can be done overnight.” Kain is confident that Ochoa’s experience and leadership will bring the district back into compliance. the special education staff so they are adequately serving students and documenting the services they are providing for them. “Once we have those set, then we have to invest the time to train staff on the procedures, which could take another 90 days in order to get every related employed trained,” Ochoa said. Ochoa has already begun meeting with parents of students with special accommodations in
their IEPs to enter into new agreements to make up for missed compensatory instruction time and rebuild their trust. “We want to pace out the lost time so the students get the maximum benefit from it,” Ochoa said. “We want to bring parents into our offices and make them understand that we are ready to supply those compensatory special education services.”

terminate the county’s purchase of the hospitals, result in their closure, and would eviscerate healthcare access for some of the Santa Clara County’s neediest residents.” The hospital owners— supported by Santa Clara County and affirmed by the bankruptcy court judge—said the attorney general had no legal authority to get involved in the sale. The Feb. 15 filing, filed in Becerra’s behalf by Deputy Attorney General Alicia Berry, claimed the county had refused to provide a range of healthcare services. Further, she wrote, “State law allows the attorney general to enforce the health and safety protections within his conditions to the fullest extent provided by law.” Berry also wrote that the bankruptcy court had “abused its discretion by finding that state law did not apply to this sale transaction.” “The attorney general’s reply conveniently ignores most of the material that was submitted in opposition to his stay request,” said County Counsel James Williams in an email statement. He said the attorney general ignores the county’s assertion that a stay “would effectively kill the transaction and likely lead to the hospitals’ closure,” and that the fact that the county has committed to “comprehensive healthcare services.” “Willful ignorance doesn’t make that evidence disappear,” Williams wrote. “When the judge reviews the actual record and the law, we certainly hope he reaches the same conclusion the bankruptcy court

There will be no federal court hearing of a request by Attorney General Xavier Becerra’s motion to block the sale of O’Connor and Saint Louise hospitals by Verity Health System to Santa Clara County. U.S. District Court Judge R. Gary Klausner on Feb. 14 canceled the hearing, which had been scheduled for Feb. 22 in his courtroom in Los Angeles. “No appearances by counsel are necessary,” the judge wrote. “The court will issue a ruling after full consideration of properly submitted pleadings.” With the filing Feb. 15, of the attorney general’s final response to Verity Health System’s pleadings, Klausner’s ruling could come any time after court is back in session Feb. 19, after the Feb. 18 federal holiday. Becerra is seeking a stay of the county’s $235 million purchase of the two failing hospitals, until the District Court hears his objection to a December decision in U.S. Bankruptcy Court approving the sale. Verity submitted its objections to Becerra’s request on Monday, Feb. 11. A stay of the Bankruptcy Court approval of the sale would cause the deal to collapse, forcing the hospitals to close, according to Verity Health and the county.
The purchase agreement that had been approved by Bankruptcy Court Judge Ernest Robles expires Feb. 28. There were no other purchase offers. The case was transferred to Klausner’s courtroom on Feb. 11 by District Court Judge Dolly Gee, who had set the Feb. 22 hearing after rejecting Becerra’s request for an “emergency” review before the deal closed. Verity Health System sought Chapter 11 protection last fall in bankruptcy court. If Saint Louise Regional Hospital were to close, the 110,000 people in the communities of Gilroy, San Martin and Morgan Hill would lose their local hospital, and more than 2,000 healthcare workers at the two hospitals would be out of work. The 93-bed Saint Louise hospital is in Gilroy. The 358-bed O’Connor Hospital is in San Jose. Becerra had initially sought the stay in bankruptcy court, but Robles rejected it Jan. 30. The attorney general’s attempts to block the sale of the hospitals ignited a firestorm of protest from the hospital’s patients, staff, community leaders and Santa Clara County politicians, with rallies and a social media campaign. Becerra contends that only oversight by his office can ensure that the hospitals provide comprehensive healthcare services to Medicare, MediCal and other patients. Santa Clara County countered that it is legally required—and eager—to provide these services. In its Feb. 11 filing, Verity Health said a stay of the purchase “would

If the sale of the hospitals does close on March 1, nurses at the two hospitals
would become county employees under the county’s contract with the Registered Nurses Professional Association (RNPA). The California Nurses Association, a rival union that represents nurses in a contract with Verity Health that was voided in bankruptcy court, said its members will strike unless the county opens immediate negotiations with the CNA. The nurses told supervisors they had a right to strike because of “unfair labor practices” committed by the county in transitioning nurses into new jobs as county employees. The court filings in the Verity Health case came the same day that Becerra was in the national
spotlight, announcing that he would sue President Donald Trump to challenge the constitutionality of Trump’s decision to declare a national emergency along the U.S./Mexico border. Klausner was in the national spotlight two years ago when he presided over a trial in which jurors cleared the rock group Led Zeppelin of plagiarizing the melody for its iconic “Stairway to Heaven.” Klausner was in the news again last year, when a U.S. Circuit of Appeals in San Francisco ordered a new trial in the case, ruling that Klausner had made several errors in his instructions to the Led Zeppelin jury.

Noah Nelson and Khader Yasin represent the future of the San Benito High wrestling program. The duo recently capped tremendous freshmen seasons, as both finished third in the Pacific Coast League Gabilan Division Championships and advanced to the Central Coast Section Tournament. On the girls side, Jenna Hartman will have another shot to grab that elusive CCS title, as she placed fourth at 116 pounds in last Saturday’s CCS Championships at Independence High. The finish earned the junior a second straight berth into the CIF State Championships, the two-day event that starts on Friday at Rabobank Arena in Bakersfield. The top finishers from the boys team last Saturday included Michael Guzman, who placed fifth in the 145pound weight division; Albert Rodriguez, who took fifth at 220 pounds; and Ethan Rossi, who finished sixth at 126 pounds. For Nelson and Yasin, finishing in third place in the league championships represented a breakthrough. Before the season started, the freshmen had goals to earn a spot on the varsity squad. The fact they peaked at the perfect time—late in the season—was a testament to their focus, work ethic and talent. “I had low expectations (before the league tournament) began, but I tried my hardest to get to the top,” said Nelson, who
won his first two matches at 106 pounds in the CCS Championships before dropping his last two contests to get eliminated. Nelson started the season on the junior varsity team before earning a spot on the varsity squad late in the season. In the thirdplace match in the Gabilan Division tournament, Nelson knew it was now or never. “It was win the match and get third or not go to the CCS Tournament,” he said. “And in that moment everything hit me in that I was either going to go above how I was doing or hit rock bottom. I had to shoot high to place high—that’s my motto.” Nelson utilized his strengths in the neutral position, relying on shooting to score points. Nelson said he is committed to improve his weaknesses, including his bottom game. “I’m focused on doing yearround practices with the Razorbacks and even practicing in my garage if I have to,” he said. “I was nervous because I knew I’d be facing seniors and juniors and a lot of people older than me.” Nelson was nervous in his first varsity match; however, he won via pinfall and hasn’t looked back since. The same could be said of Yasin, who has taken a similar path to become one of the team’s best grapplers by the end of the season. Yasin, who wrestled in the 195-pound weight class this season, had a meteoric rise as he wrestled on the junior varsity team for a good chunk of the season. Yasin’s third-place showing in the Gabilan Division Championships came in just the second varsity tournament of his career. Yasin comported himself well, winning the third-place match 9-7 in overtime. In the OT period, Yasin’s opponent took a shot that Yasin was prepared for and anticipating. Yasin sprawled, stood back up and threw his opponent down for two points and the sudden-death victory.
UP AND COMER Balers freshman Noah Nelson finished third in the PCAL Gabilan Division Championships and followed that up with a 2-2 mark in the CCS Tournament in the 106-pound weigh division. “I was calm because I didn‘t want to show I was super happy,” he said. “But when I went to my corner where my coaches were, I was pretty happy. My mindset stays the same in every match and it’s to go out there and do my best.” Yasin’s strengths lies in his throws, with his favorite being the Japanese Wizard maneuver in which he turns, goes on his knees and in one motion throws his opponents over his shoulder and on their backs. Even though San Benito didn’t qualify anyone from the boys team to the state championships this season, Nelson and Yasin represent a hopeful future, two wrestlers who if they continue to improve have
legitimate state aspirations. This year’s top senior class of Guzman and Rodriguez have passed the proverbial torch, as they wrapped up solid careers in a Balers’ singlet. Guzman won his first three matches at CCS before dropping a 5-1 decision to eventual 145-pound champion John Fox of Gilroy, which turned out to be Fox’s toughest match of the tournament. Guzman then lost a 9-5 decision to put him in the fifth-place match, which he won via pinfall at the 4 minute, 4 second mark. Like his fellow senior, Rodriguez’s route to a fifth-place finish involved winning his first three matches, losing the next two—including the first to the
eventual league champion at 220 pound—and then capturing the match for fifth. Rossi has the potential to finish in the top three of the CCS Championships next year if he puts in the time in the off-season. A year after taking sixth at 106 pounds, Rossi equaled that finish, this time at 126 pounds.The junior displayed mental toughness and the ability to wrestle strong in the clutch, as he lost his second match to put him in the consolation round early. That’s when Rossi got to work, winning four consecutive matches—three of which came by razor-thin scores of 4-3, 3-2 and 3-1—before he dropped his last two matches to finish in sixth place.

rs. Yukie (Hayashi) Dwan, born on May 14, 1931 in Fukushima, Japan, passed away at age 87 on December 13, 2018 at her home in Gilroy. Yukie was the loving wife of Francis Dwan. Yukie is survived by her husband; daughters, Nancy Dwan and Susan Payne; brother, Yukiharu Hayashi; and sister, Takako Hara. Yukie was a loving, devoted wife and mother whose warm heart, cheerful smile and positive spirit filled her home and charmed those who knew her. Yukie enjoyed sewing, sumi-e, and singing, and took pride in caring for her husband and children. A memorial service will take place at 1:00pm on Saturday, March 2, at the Morgan Hill Buddhist Community Center.

heresa A. Ashworth (95), passed away peacefully on February 5, 2019, at Salinas Valley Memorial Hospital with family by her side. Theresa was born in Fresno, CA to Joseph and Virgina (DiDeo) Fiatarone. She was the second eldest of four children - Maria, James and Jean.
August 1950, Theresa married the love of her life David C. Ashworth in Fresno, CA. Later that same year they moved to Salinas, CA, where they bought their forever home. While her husband drove for the Greyhound Bus Department, Theresa spent some time as a local beautician, but after a couple of years she changed professions and began working as a Lab Technician at John Ingles/United Foods. Theresa and David were happily married for 20 years, until his death in 1970. In 1952 she and her husband gave birth to their only child, David (Davey). Shortly after his birth, they became active members of Madonna del Sasso Church and Parrish. In 1977, Davey married Jeri (Cohn) and in 1984 they adopted their only daughter, Allison. Theresa retired from United Foods in 1988 and spent the next few years caring for Allison after school in Morgan Hill. Theresa’s family was her greatest treasure. Theresa was lucky to spend the last four years with her three wonderful great-grandchildren; Braxten, Landen and Karsen, whom she loved dearly! Theresa is preceded in death by her husband David, siblings Maria Graybill, James Fiatarone, and Jean DeFendis, as well as her son Dave Ashworth. Theresa is survived by her granddaughter, Allison (Josh) Messina and family of Hollister, Daughter in-law Jeri of Salinas, 9 Nieces and Nephews, as well as plenty of greatNieces and great-Nephews: the Graybill family of Santa Barbara, the Fiatarone family of Pinole, and the DeFendis family of Fresno, and her loving friends and family. Theresa will be reunited once again with her husband and son, at the Queen of Heaven Cemetery. She will be missed by all that had the privilege of meeting, knowing, and loving her.
