draft versions of the ordinance required developers to take several new steps to get projects approved. Velazquez felt the 244 units was still too many and would only welcome single family homes to be developed. He called for staff to come up with ways that different types of housing, like townhomes, could be produced. According to state law, a city cannot make it more difficult for developers’ projects to be approved or deny a project because the city government doesn’t want the building. If a city does not comply with state affordable housing policy, the city can have state funding revoked for infrastructure and other state funded projects. Local lobbyist Victor Gomez, CEO of Pinnacle Strategies, said he agree with the mayor’s long-standing position that the city’s infrastructure had to catch

not comply with the state’s affordable housing requirements. Hollister was on the governor’s short list as being in danger of noncompliance, but according to the housing department’s letter, it narrowly missed the classification. The current draft of the ordinance did not comply with the department, so it was back to the drawing board for the City Council at its Feb. 25 meeting. The council’s direction from the meeting left many questions about the ordinance unanswered, with council members disagreeing on the fundamentals of the ordinance. The idea of drastically reducing the number of units from the proposed 240 per year was floated by Velazquez and Richman asked that the staff look into drafting a separate
inclusionary housing ordinance, which would require developers to allocate a certain percentage of projects to different housing income levels. Staff recommended that in order to not violate state law the developers could make a pitch directly to the city staff and then to council, instead of installing the previously rating system. City staff also recommended that instead of the growth management ordinance being in place until the general plan update is completed, it is put in place for five year or until the update is completed. The current ordinance would allow 244 units to be built per year, not including low-income, special needs or senior housing. This 244-unit limit had been the growth cap in Hollister when the city had previously implemented a growth management ordinance. The original and

This could spur construction like this just outside city limits. up with the city’s building, but that ultimately the first draft of the ordinance did not comply with state law. “I agree with the mayor that the state better do their part as well,” said Gomez, a former mayor. He added that a growth cap would be the most effective way to manage building in the city.
Gomez said the development community would be most the supportive of a growth cap, but is wary of anything that may seem like a growth moratorium. The city has a long history of trying to keep up with and maintain growth. Following a series of building projects, the city’s
sewer system couldn’t handle the development, resulting in an six-year moratorium on new housing that was lifted in 2008. Bryan Swanson, director of the city’s development services department, said the draft ordinance came out of mostly public pressure.

A U.S. District Court judge in Los Angeles rejected a bid by California Attorney General Xavier Becerra to block the purchase of two failing Verity Health System hospitals by Santa Clara County. The Feb. 22 ruling cleared the way for the county to close its $235 million purchase of Saint Louise Regional Hospital in Gilroy and O’Connor Hospital in San Jose, plus the DePaul Urgent Care Center in Morgan Hill this week. County officials said they expected to close the deal Feb. 28, when a courtapproved purchase agreement expired, and take ownership on March 1. “We are pleased that the district court denied the stay, which will allow the county to complete its purchase of the hospitals,” said County Counsel James Williams. “We will now be able to keep these hospitals open to ensure access to healthcare for the residents of Santa Clara County.” The federal court decision ended nearly two months of anxiety for patients, staff and community leaders, especially in southern Santa Clara County, where for more than 100,000 people Saint Louise is the only local option for many healthcare services. Becerra had appealed a bankruptcy court’s December approval of the sale to U.S. District Court, and sought a stay of the sale, pending resolution of the appeal. If successful, Becerra’s effort would have voided the county’s purchase agreement and
forced the two hospitals to close. There were no other purchase offers. “The public interest factors weigh against the stay,” U.S. District Court Judge R. Gary Klausner wrote in his six-page opinion. “A stay may result in the cancellation of the sale, which could in turn lead to a closure of both hospitals. “The bankruptcy [court] did not abuse its discretion when it found that ‘far from protecting the health and welfare, a stay would set in motion a series of events that, in all probability, would reduce the availability of healthcare services to the public,” the judge wrote in his ruling. A spokesperson for the attorney general still had conceded defeat early this week. On Feb. 25, Becerra’s press office issued a terse statement: “We are exploring our options.” The attorney general had only one option after Klausner’s ruling—to ask the 9th CIrcuit Court of Appeals to intervene before Feb. 28, a move observers considered futile and unlikely. "These two hospitals are essential to the continued health and well-being of folks in our region,” said Santa Clara County Supervisor Joe Simitian, president of the county Board of Supervisors. “Continued litigation by the attorney general is a distraction from the important work we have to do. It's time to stop arguing about who's right and start focusing on what's right, and that's taking care of the folks here in the county who need our help." Becerra had argued it

Smith. “The county will ensure that O’Connor and Saint Louise hospitals continue serving our communities with the enhanced services we will offer through the hospitals as part of the county’s integrated health system.” Klausner affirmed in today’s ruling an earlier decision in Bankruptcy Court that the sale of the hospitals “is not reviewable by the attorney general.” “Losing Saint Louise Hospital simply was not an option for me and for the 100,000 Gilroy and Morgan Hill residents who would have lost their local hospital,” said Supervisor

hospitals staying at their current jobs. There is one more bump in the road for the county—a possible strike by Saint Louise and O’Connor nurses.The California Nurses Association, which represented nurses at O’Connor and Saint Louise under contracts voided by the Bankruptcy Court, has asked the state Public Employment Relations Board to intervene on the nurses’ behalf. The nurses union is a rival of the Registered Nurses Professional Association, which represents nurses at the flagship of the expanded county healthcare system, Santa Clara Valley Medical Center. The new countyemployee nurses will be covered by the RNPA contract beginning March 1. CNA members told the county Board of Supervisors last week they would strike at O’Connor and Saint Louise if the county didn’t recognize their union and begin negotiations on
a new nurses contract for the two hospitals. The CNA has asked the state Public Employee Relations Board to seek an injunction in state court next week to force the county to the bargaining table. The county said to do so would violate state law, the RNPA contract and the county’s own personnel rules. “We asked the PERB to seek an injunction to ensure the county bargains in good faith with the Saint Louise and O’Connor nurses through their chosen union, CNA,” said Andrew Prediletto, the regional CNA director. “We want to ensure nurses stay at the hospitals and to preserve the patient care protections that nurses have won over the past two decades.” Felix de la Torre, general counsel for PERB, said he will make his recommendation on the CNA request to the board by March 1, but said he could not say when or if the quasi-judicial board would make a decision.

Should Atty. General police the police?
I
n his two years on the job, California Attorney General Xavier Becerra has crafted an image as a progressive warrior, suing the Trump Administration dozens of times and delivering the Democrats’ Spanish-language rebuttal to the President’s State of the Union speech. But there’s one major area where the Democrat isn’t allied with progressives: accountability for law enforcement. There, Becerra is at odds with the push by many in his own party to better police the police. The attorney general is refusing to provide records on police misconduct that media outlets requested under a new law signed last year by Democratic former Gov. Jerry Brown. The legislator who wrote the law, also a Democrat, says the documents must be disclosed. But Becerra has sided with police who want the courts to weigh in before releasing records about officers who were involved in shootings, sexual assault or lying on the job. The union representing statewide law enforcement officers spent $226,000 to help Becerra win election last year. The prison guards union put $320,000 into a campaign that supported a bipartisan mix of politicians, including Becerra. And Becerra’s own campaign received more than $75,000 from law enforcement unions up and down the state. Numerous police unions have filed lawsuits in recent weeks to try to block their departments from releasing misconduct records under the new law, Senate Bill 1421, which took effect on Jan. 1. The officers argue that the law only applies to records created on or after Jan. 1, while the legislator who wrote the law says it applies to any records in the police departments’ possession, including those from past years. Courts have offered differing opinions, with judges in Contra Costa and Los Angeles saying the prior records must be disclosed and a Ventura County judge blocking their release.

A broad coalition of media outlets have been requesting misconduct records from law enforcement agencies big and small since the new law took effect at the start of the year. Becerra refused to disclose any misconduct records regarding officers employed by the state Department of Justice. Then the free-speech non-profit, the First Amendment Coalition, sued him, arguing that his refusal has had a ripple effect, giving “a green light to other departments to disregard the new law.” Becerra said he’s waiting until courts clarify what now stand as conflicting opinions. “I’d rather make sure I do this right because there are lots of people whose privacy is at stake.” Five days later, he submitted a legal brief in an unrelated lawsuit saying he thinks the disclosure law does apply to records created before Jan. 1, but that he’s withholding them until courts resolve the question. Becerra is not the first California Attorney General to side with police on accountability issues—or to take heat for it from the left. Democratic presidential candidate and U.S. Sen. Kamala Harris, for instance, refused as attorney general to support statewide standards for police body cameras, endorsing instead the law enforcement argument that such rules should be determined at the local level, even if the result was a patchwork. She also opposed a bill to put the state Department of Justice in charge of investigating police shootings. Becerra has held a similar position on more recent versions of the bill, marking another instance in which he sided with law enforcement against efforts toward greater transparency. Progressive advocates for criminal justice reform argue that the state Department of Justice could be more objective than local prosecutors in determining if shootings are justified, because local prosecutors work so closely with police. For some commercial beekeepers, California's almond bloom ended before it officially started. Early last week, Tulare County beekeeper Steve Godlin of Visalia learned that about 100 honeybee colonies he was managing had disappeared from an almond orchard west of Visalia. Citing a shortage of bees for almond pollination, which this year requires about 2.14 million apiaries for more than 1 million bearing acres of almonds, Godlin said the bees were likely stolen Feb. 10. The next day, just a few miles from the Godlin location, Gunter Honey reported a second theft of another 96 hives. Godlin said 100 beehives would be valued at $20,000 for the bees alone and another $20,000 for the pollination services—and that to steal that many hives would require a one-ton truck and forklift. His advice to farmers? "Know your beekeepers, and if you or anybody in the public sees somebody loading bees up in an almond orchard, call the police. That's not the way it works. Bees should be going into the almonds, not out," Godlin said. Butte County Sheriff 's Deputy Rowdy Freeman, who investigates rural and agricultural crimes, said a theft of 100 or 200 hives at a time would likely be committed by someone who is a beekeeper. "They know what they are doing. They have beekeeping equipment. They know how to go in and take them and have the means to do it. It could be a beekeeper who lost a lot of hives and can't fulfill his contract. Desperation leads to theft, so they will steal the hives from someone," Freeman said, noting that other bee thefts had been reported already this year in Kern County and in Southern California, with a total of 300 hives lost. Early this month, Freeman investigated reports of a small number of bees stolen from Butte and Glenn counties. He later recovered about half of the bees, after deputies spotted some of the stolen hives loaded onto a small utility trailer parked in a driveway in Biggs. Two adults were arrested for the alleged crime and for felony possession of stolen property. The recovered bees were returned to the beekeeperowner in Glenn County. The sheriff 's department said the suspects planned to place the hives in an almond orchard in exchange for payment for pollination services. Freeman, who also became interested in beekeeping after investigating a theft in 2013 and now maintains about 50 hives of his own, said the thefts this season are likely related to a limited supply of bees. Whether or not almond growers will have enough bees remains to be seen. Mel Machado, director of member relations for the Blue Diamond Growers cooperative, said he hadn't heard "any issues related to a shortage of bees." Phippen said he expects the cost of pollination services this year will be approximately $190 per colony. Freeman offered suggestions for preventing bee theft: • Beekeepers should place bees out of sight and off the road, and mark hives, lids and frames with identifying information so that recovered bees can be traced back to the owner. • Growers paying for pollination services should verify that colonies in the orchard or field match with the contract they have with the beekeeper. • Though it is not cost-effective for every hive, beekeepers should strategically place GPS trackers in certain hives. • Beekeepers and farmers should maintain a close working relationship. • The California State Beekeepers Association offers up to $10,000 for information that leads to the arrest and conviction of persons responsible for stealing bees and/or beekeeping equipment; information may be sent to calstatebeekeepers@ agamsi.com. SUSPECTS ACCUSED OF VIOLATING COURT ORDER, OBSTRUCTION Hollister police recently arrested two local men— including one who had a loaded handgun—on suspicion of violating a restraining order and obstructing officers, according to authorities. About 10:20pm Feb. 18, officers were dispatched to a home on the 800 block of Central Avenue in Hollister on a report of violation of a restraining order, according to a press release from the police department. The suspect, Randy Casarez, Jr., 27, of Hollister, was at the residence in violation of a court order prohibiting him from being there. When police arrived, Casarez fled out the back door and into a neighboring backyard, according to police. Officers

immediately responded to the neighboring home, where police obtained permission from the homeowner to search outside for Casarez. Once in the backyard, officers encountered Efren Villareal, 28, of Hollister. Villareal lives at the home, and suggested he had the right to shoot officers because they were on his property, according to police. The officers could see Casarez hiding behind Villareal, police said. Villareal refused to cooperate when asked to show his hands. After a “very short standoff,” Villareal was taken into custody. A loaded high-capacity magazine
was found on his person. Casarez was found hiding nearby and also arrested, according to police. He was booked on suspicion of disobeying a court order and resisting arrest. Villareal was booked on suspicion of threatening officers, obstruction and being in possession of a highcapacity magazine. Hollister police are on the lookout for two suspects who tried to break into the city’s animal shelter and steal dogs last week. About 3:53am Feb. 21, Hollister police officers responded to an alarm at the animal shelter at 1331 South St., according to a press release. When officers arrived, nobody was found in the area, but police found that a gate
had just been forced open and a lock had been cut. Officers obtained video footage of two men tampering with the gate and proceeding to the back area of the shelter, according to police. Investigators found evidence suggesting the burglars were attempting to break into the kennels where dangerous dogs are housed. The burglars were unsuccessful in opening the kennels and fled before police arrived, according to authorities. Both suspects wore hooded sweatshirts and hid their faces. One of
the suspects wore camouflage pants. Hollister police released photos of the Feb. 21 burglary from the shelter’s security cameras, in hope that someone from the public might recognize them. Authorities are offering a $1,000 reward for information leading to the identification and conviction of the two suspects, police said. Every time the San Benito High players open up the storage equipment container before practice starts, they see a blownup picture of the Gilroy High softball team celebrating a Central Coast Section playoff championship, with the Mustang players holding up a single finger to represent that they—and not the Haybalers—were No. 1 in the area a year ago. San Benito fell to Gilroy 4-3 in the Division I championship game. Balers coach Andrew Barragan posted the pictures just to add a little spice to the start of the season. “It’s a reminder that, ‘Hey, we have to finish this out,”” said Barragan, who is entering his fourth season as the coach. “It hurts because San Benito-Hollister softball should be the last ones standing at the end with the program we have and historical run (former coach) Scott Smith had. We’re expected to be there, and when you lose a championship game nowadays at Hollister, it’s tough to think about.” Barragan tried not to dwell on the loss too much; however, it was hard for him not to think about in this day of social media. “Every opportunity I had to think about that game, I do,” he said. “You look at the (Gilroy) Dispatch and Twitter and Facebook and Instagram, they all got their CCS championship rings and the city had a parade for them (and other teams that won a CCS title). Any time you see that, you wouldn’t be human
if you didn’t think about stuff like that.” If the Balers are to get back to the mountain top—they last won a section title in 2016—they’ll need the 1-2 pitching punch of juniors Julia Woeste and Drew Barragan to come through. Barragan said he was confident the two pitchers would do just that. Woeste has improved every season and has the potential for a MVP-type season, Barragan said. Woeste is projected to hit fourth or fifth in the lineup, and her bat packs a punch. Drew Barragan is the coach’s daughter and possesses tremendous off-speed pitches. Drew played at Monte Vista Christian in her freshman year and sat out last season before transferring into San Benito High. Drew has tremendous off-speed stuff and Woeste has greater velocity, something Barragan expects to make for a great combination. “We don’t have the best pitcher in CCS, but I can guarantee it’s going to be hard to come up with a better 1-2 punch in CCS,” Andrew said. “Julia is a smarter pitcher now, and I can also count on her and Drew to hit. Drew has pinpoint accuracy, and that is a great strength.” The Balers have three Division I signees—Dominique Monteon (North Carolina), Amber Rodriguez (Weber State) and Alyssa Ito (UC Davis)—who plan to have their best seasons yet. Rodriguez plays catcher and has a cannon for an arm that makes baserunners think twice about stealing. Monteon plays third base and possesses one of the most potent bats in the section, and Ito mans the shortstop position about as well as anyone in the CCS. Sophomore Kaiya Dickens, who had a solid freshman season, plays first base and second base and seemingly has all of the tools to one day play in college. “We threw Kaiya into the fire last year and she responded very well,” Barragan said. “She had a good year of high-caliber travel

Benito’s goal once again is to win a CCS championship, having last won it all in the 2016 season. ball, so she’s that much better this year.” Gianna Perez and Seryna Esparza are two freshmen infielders who Barragan said has plenty of powerful bats. “The hit the (crap) out of the ball,” he said. Anther pair of freshmen, Giana Felice and Angelic Diaz, will contend for starting spots in the outfield. The freshmen class—in all likelihood two will start and possibly more—are a big reason why Barragan said this is the most talented team he’s had in his four years as coach. Diaz and Felice bring tremendous speed to the team, which excites Barragan. In Barragan’s first season as the coach, the team had 72 stolen bases. Last year, that number dropped to the 20s.
“Felice and Diaz remind me of (Chloe) Cortez and (Brittnee) Rossi,” Barragan said, referring to the two former San Benito High standouts who were a threat to steal a base any time they got on. “And they can hit.” Other key returnees include a pair of utility players in senior Ariel Mendez and sophomore Aniesa Osorio. Mendez, like most or all of her teammates, plays for a high-level travel ball program. “Ariel is a great gap to gap hitter with a great arm in the outfield,” Barragan said. “She can hit it to any part of the park, and just as important she’ll get some clutch hits for us for sure.” Osorio plays second base and is one of those sparkplug players who has a diverse skill set
and can come through in a variety of ways. “I can put Aniesa at any position except pitcher, catcher and first base,” Barragan said. “She’s got good speed, good hands and can lay it down (a bunt) when we need her to.” In finishing 17-14 last year, the Balers suffered double-digit losses for the first time in nearly two decades. Barragan doesn’t expect that to happen again this season. Whereas last year’s team didn’t have much depth, the 2019 squad has superior depth. “If I had to take the top 12 or 14 players, they can battle each other the whole time in practice,” Barragan said. “One through 14 is solid.”

From there he was one of 15 players selected to represent the NorCal region at the USA Baseball Training Complex, and then was one of a small group of players selected to attend a special National Team selection workout in attempts to make the 15U National Team this summer. “I knew he was good, but he’s really good (after seeing Pace for a sustained period of time),” Aviles said. The Balers kicked off the season with a 2-1 win over Alisal last Saturday, with newcomer Aiden Shaw hitting a home run and Guttierez, Salazar and Pace combining on a two-hitter. Jeremy Ashford had a team-high two hits in a strong seasonopener. Some of the key returnees in the lineup include catcher Jacob Burley, shortstop Brady Miguel and catcher/outfielder Marcus Aranda. Miguel will hit leadoff and is a potent base-stealing threat, while Aranda has
added another dimension to his game. “Marcus became a more complete hitter in the offseason,” Aviles said. “He looks good physically and he can flat-out swing it. He’ll produce some runs for us.” Campo figures to drive in some runs as well. When Campo is not on the mound, he’ll be in the outfield. Campo has been reliable and consistent, a type of player every coach appreciates. In the off-season, Campo focused on packing some extra muscle to his frame, and he said he gained 10 pounds and is now up to 195 pounds. “I’ve noticed a difference, mostly on the mound,” he said. “On the mound my velo(city) is up 2 to 3 mph from last year. I can feel added strength in my legs, and my endurance and stamina are a lot better.” Campo has been playing baseball since age 5 and started pitching when he was 7. He’s always had a solid role model in his dad, Dave, who “has always been the one to show me the way, especially from the mental side of the game.” Dave constructively critiques his son’s performances, harping on the mental aspect of the sport like being perceptive and looking at hitters’ tendencies and what their swing path is like. Dave also taught Matt the value of hard work. “When it comes to work ethic with baseball, it’s not just taking reps, but it’s about quality and doing it over and over again,” Matt said. “And when you do something, do it with a sense of urgency and have a purpose with what you’re doing. Think about what you’re doing and if something is wrong, step out for a second, think about it and correct it and keep going. That is what my dad has taught me, and it’s been great advice.”

It’s often said there are two certainties in life: death and taxes. When it comes to the local high school sports world, it’s virtually guaranteed San Benito High will roll out a solid baseball team. So it is for the Haybalers, whose degree of success encompasses a multitude of factors, including league championships, advancing in the Central Coast Section playoffs and players taking up roster spots for college programs, and, in some cases, playing professionally (see Daniel Barone, Connor Menez and Darin Gillies). The only thing missing from the Balers’ resume is a CCS title. If the Balers are to win it all this season, they’ll need great pitching, solid hitting, tough defense and excel in the fundamentals. Over the years, the Balers have developed a solid reputation for doing those things well. “We’re swinging the bats really well and the pitching has been good,” Balers coach Billy Aviles said. “I like where we’re at on the mound and think we’ll score some runs. We definitely have more of a balanced offense than we had last year.” San Benito returns a solid set of arms, including seniors Jordan Yeager, Matt Campo, Moises Salazar and Kaleb Guttierez. Yeager is a returning allGabilan Division First Team player and possesses a fastball, curve, slider, and change-up. Fellow senior Campo utilizes a sharp curveball to get hitters offbalance, Salazar has a lot of potential and Guttierez uses a variety of off-speed pitches to record outs.
“Right now we’re looking at Kaleb to be our closer,” Aviles said. “He did a good job for us last year.” Said Campo: “I think Kaleb has a chance for another really good season. I’m really excited about the team and our pitching should be good. We have a lot of talent.” In addition to the seniors, expect freshman Jackson Pace to make a huge impact throughout the season. The 6-foot3, 185-pound Pace possesses quality stuff, including a mid-80 mph fastball, curve and a slider with tremendous movement. Pace comes in with top-notch credentials, having played two years for the Northern California National Team Identification Series (NTIS).

aurel Ruth (McDill) Gephart entered the Kingdom of Heaven on December 06, 2018 after a courageous battle with colon cancer. Born in Chicago IL on January 24,1945, to Lois (Tatter) and Samuel Rutherford McDill, a Baptist minister. Laurel spent her childhood in the Chicago area. The family moved to Watsonville, California in 1961 where Laurel graduated from Watsonville High School in 1963. In April 1964, Laurel married Bruce D. Gephart of Dolton, IL. They settled in Illinois and raised two children. In 1975 the family moved to Morgan Hill, California. Laurel received a Bachelor’s degree from San Jose State University and later a Masters in Education from Santa Clara University.

rs. Yukie (Hayashi) Dwan, born on May 14, 1931 in Fukushima, Japan, passed away at age 87 on December 13, 2018 at her home in Gilroy. Yukie was the loving wife of Francis Dwan. Yukie is survived by her husband; daughters, Nancy Dwan and Susan Payne; brother, Yukiharu Hayashi; and sister, Takako Hara. Yukie was a loving, devoted wife and mother whose warm heart, cheerful smile and positive spirit filled her home and charmed those who knew her. Yukie enjoyed sewing, sumi-e, and singing, and took pride in caring for her husband and children. A memorial service will take place at 1:00pm on Saturday, March 2, at the Morgan Hill Buddhist Community Center.

Laurel worked in elementary education in the Morgan Hill, CA school district. She loved shaping young minds and being in the classroom. Laurel taught at El Toro Elementary until she retired in 2013 after almost 30 years in the classroom. Laurel attended Morgan Hill Presbyterian Church for four decades. Laurel was fortunate to have had many opportunities to travel the world on church-related mission and family vacations. Laurel lived in Morgan Hill CA from 1975 to 2017. In 2017, she moved to Williamsport, TN to be closer to her son Stephen and his family. A celebration of her life will be held at Morgan Hill Presbyterian Church 16970 de Witt Ave., Morgan Hill, CA 95037 on Sunday, March 17th, 2019 at 12:00 PM. A reception will be held in the church fellowship hall following the celebration. Laurel is survived by her son Stephen (Nola) Gephart of Franklin, TN and their four children, Garrett, Brett, Trent, and Nola K. Ordinance 582, as previously amended from time to time, and as codified as Title 19 (Land Use And Environmental Regulations), Chapter 19.01 (Agricultural Provisions), Article II (Agricultural Preserves) of the San Benito County Code, is hereby amended to add additional uses deemed to be compatible uses within agricultural preserves as set forth in Section 19.01.023(B). Section 19.01.023(B) of Chapter 19.01 of Title 19 of the San Benito County Code is amended to read as follows: 19.01.023 COMPATIBLE USES. (B) Categories of compatible uses. The following uses are deemed compatible. The following compatible uses shall not be used in calculating the minimum acreage requirements of an agricultural preserve. (1) The use and conservation of natural resources, which include: (a) The mining and processing of minerals, petroleum products, rock, sand, gravel and clay. Processing is compatible only if it involves only the use of on-site required materials, except for water. Processing includes, without limitation, crushing, washing and screening; (b) Forestry and production of wood products; (c) Dams, reservoirs, water facilities; (d) Fire prevention facilities; and (e) Flood control works. (2) Outdoor recreation only if the recreation is incidental, and not detrimental to the agricultural use. Recreational use is the use of land by the public, with or without charge, for any of the following: walking, hiking, picnicking, camping, swimming, boating, fishing, hunting, parks or other outdoor games or sports for which facilities are provided for public participation; (3) Signs appurtenant to any authorized use; (4) Signs of property for sale; (5) Communication facilities or public utility facilities; (6) Home occupations; (7) Event centers; (8) Wineries; (9) Small solar projects for the operation of a farm or ranch; (10) Vegetable processing plants; (11) Meat processing plants; (12) Airplane runway strips for landowner's noncommercial use; (13) Any use which was approved by the Board and which existed at the time is included in a preserve; (14) Any use required to be permitted by the Act; and (15) Any other similar compatible use as determined by the Board upon a finding that the proposed use is incidental and not detrimental to agricultural use. Section 2. The remainder of section 19.01.023 of Chapter 19.01 of Title 19 of the San Benito County Code shall remain in full force and effect.Section 3. General ProvisionsA. The Sunnyslope
County Water District (SSCWD) Board of Directors determines that each fact referenced in this section to be true and correct. A. Authority. This ordinance is enacted pursuant to Sections 20200 through 20207 of the California Water Code and Section 6066 of the Government Code. B. Adoption of this ordinance is not a project as defined by the California Environmental Quality Act per Article 20, Section 15378(b)(5) of the CEQA Guidelines as it is not a Project and is an organizational or administrative activity of a government agency that will not result in direct or indirect physical changes in the environment. C. The Board of Directors (Board) last amended the compensation of the Board from $75 per day of service to $100 per day of service on June 12, 1997. D. More than twenty one years has elapsed since the most recent amendment to Board member compensation. E. The Water Code confers upon the Board the discretion to increase Board member compensation by five percent for each calendar year since the previous compensation adjustment. F. Reimbursement for expenses of Board members is subject to Sections 53232.2 and 53232.3 of the Government Code. NOW THEREFORE be it ordained as follows:
Section 1. The foregoing findings are adopted by the Board of Directors as though set forth fully herein. Section 2. Purpose of Ordinance. This Ordinance, in conformance with the California Water Code, amends and increases the compensation of the Board of Directors not exceeding a total of $950 in any calendar month. Section 3. Policy Amended. SSCWD Policy 7020 is amended to read in full as follows: 7020: Board Compensation 7020.1 Members of the Board of Directors shall receive compensation1, a Director's Fee, for each day's attendance at meetings of the Board, Committees, and other duties rendered as a Director by request of the Board. The compensation amounts are as follows: A. $200 for each day's service attending Board Meetings. B. $150 for each day's service attending Committee Meetings and other duties rendered by request of the Board. C. $100 per month for weekly check signing duties. D. Monthly compensation shall not exceed $950 per month. E. Compensation will be paid monthly based on an approved Expense Report, submitted on a monthly basis, and should include a detailed listing the meetings attended in that month. F. Any business related expenses incurred in the performance of his/her duties for items or services appropriately related to District business and for expenses while traveling on approved District business should also be included on the monthly Expense Report submitted. See policy 8150 Expense Reimbursement for more detail. Section 4. Severability. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be unconstitutional or invalid, or superseded by some other provision of law, such provisions shall be severed from and shall not affect the validity of the remaining provisions of this ordinance. The Board hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause, or phrase thereof irrespective of the fact that any other part thereof be unconstitutional or invalid, or superseded by some other provision of law.
