The Hollister City Council voted unanimously June 3 to allow recreational cannabis to be sold in the city, adopting a new cannabis ordinance without the word “medical.” The decision came after several council meetings and numerous town halls, where the council proceeded with caution and asked the city staff come back with revised versions of the proposal each time. While allowing recreational cannabis to be sold was the biggest change made to the ordinance at the June 3 meeting, there were also several minor changes to the existing ordinance that the council voted to approve. The new ordinance created three major changes: • an existing cannabis dispensary can apply for a delivery license within the city • no cannabis sales will be permitted between 10pm and 6am

The San Benito County Arts Council and the city Parks and Recreation Department invite fun-loving people of all ages to “Dance @
Dunne” Park every Friday evening through July. This program is free and open to all ages and abilities. The exercise and dancing begins at 5:30pm every Friday with a Zumba class, followed by a second style of dance starting at 6:15pm at the tennis courts, Dunne Park, Hollister. Anabel

Council nixes 400 block appeal TEMPERS FLARE AS CONTROVERSIAL PROJECT ADVANCES Jaqueline McCool Reporter
In a raucous three-hour debate before an overflow audience punctuated by tears, shouts and legalese, the Hollister City Council voted 3-1 on June 3 to allow a multi-purpose development plan in the
center of downtown to move forward. The council vote upheld a planning commission decision on the 400 block and rejected an unusual appeal by Mayor Ignacio Velazquez. Velazquez, sequestered outside of the council chambers throughout the debate because of a potential conflict of interest, had filed the appeal “as a
private citizen.” His lawyer presented arguments that the city had acted illegally when it approved plans for two buildings on the vacant “400 block” at San Benito and Fourth streets. The vote played out as expected, with council member Rolan Resendiz, a frequent Velazquez ally, offering the vote against upholding the planners’ decision. Council
members Marty Richman, Honor Spencer and Carol Lenoir voted to reject the appeal. Velazquez said June 4, the morning after the meeting, that he was not surprised about the outcome of the vote, but that he believed he had public support for his position. “If they were so confident in their decision, they would let it go for a [public]
vote,” Velazquez said in an interview. He said he is consulting with his lawyers before he decides what he will do next. Ninety-one SBHS seniors were recognized May 24 for earning the Seal of Biliteracy, along with those who earned Senior Scholar Awards and served as Senior Class officers. School staff provided

Before a packed house of students, families and presenters, nearly $275,000 worth of scholarships were awarded to 103 students at San Benito High School’s Senior Awards Night at a May 22 ceremony. School staff also announced its top 10 graduating students, scholarathletes, salutatorian and co-valedictorians for the Class of 2019. “Tonight validates all you have done in the last 18 years or so to support your sons and daughters,” said SBHS principal Adrian Ramirez, who helped welcome the audience members along with scholarship adviser Mary Andrade. SBHS will have co-valedictorians this year, with MIT-bound Jaron Cota and future UCLA student Frederick Keith sharing the honor. Ian Sills, who will attend Stanford in the fall, was selected as the class salutatorian. The remainder of the top 10 students from the Balers’ 2019 class are: Sara Meza (UC-Irvine, biomedical engineering with a pre-med emphasis); Erin Taylor (UC-Davis, statistics); Jennifer Rosas (UC-Berkeley, mathematics with a minor in linguistics); Grace Richards (BYU, education); Sean Slavich (UC-Berkeley, industrial engineering
and operations research); Madison Ricker (Cal Poly, San Luis Obispo, animal science); and Simone Yamaoka (University of Washington, civil engineering). The scholar athletes of the year are Senior Class President Alyssa Ito and Joseph Loredo. Ito, who will play softball for UCDavis next year, maintained a 4.22 GPA while earning 11 varsity letters in volleyball, basketball and softball. Loredo, who will attend the University of San Francisco, earned a 4.13 GPA while earning six varsity letters in cross country and track. Superintendent Shawn Tennenbaum thanked the “extreme generosity of our community” including individuals and organizations that fund scholarships for students. He also praised the students being recognized for their academic and athletic achievements, saying they “have seized the opportunities presented to you with a level of maturity far beyond your years.” “It is because of you,” he added, that SBHS “continues to thrive as a place of growth, creativity and prosperity.”
SENIOR AWARDS NIGHT San Benito seniors were honored May 22. a free pizza lunch to the entire Class of 2019. To receive the Seal of Biliteracy, students must meet all English language arts requirements for graduation with an overall grade point average of 2.0 or above and Pass the Smarter Balanced Assessments in English language arts administered in grade 11 at the proficient level or above. They must also be proficient in one or more languages in addition to English as demonstrated through one of three options: passing a foreign language Advanced
Placement examination with a score of 3 or higher or an International Baccalaureate examination with a score of 4 or higher; completing a fouryear course of study in the same foreign language, and attain an overall GPA of 3.0 or above; or passing the SAT 2 foreign language exam with a score of 600 or higher. The Senior Academic Scholar designation is for any senior who maintained a cumulative/ career GPA of 3.5 or above through the fifth grading period of their senior year.

San Benito High School has 197 Golden State Seal Merit Diploma qualifiers, up from 132 last year and 105 the year before, according to a SBHS District announcement. The award recognizes public school graduates who have demonstrated mastery of the high school curriculum in at least six subject areas, four of which are English language arts, mathematics, science and U.S. history, with the remaining two subject areas selected by the student. This year’s Democratic state convention in San Francisco offered a select group of party regulars a sneak preview of Democratic campaign themes. Included among the 3,400 delegates at the May 31-June 2 convention were local elected officials and party workers, from former city councilmember Mickie Luna to Robert Rivas, Assemblymember for District 30. “It was a very exciting time,” Rivas said. “There’s a lot of energy, and I’m optimistic that we’re going to move forward.” Old and new wounds still emerged at times at the convention, with the old guard and the new guard staked out competing claims for the party’s future, even in a state where Democrats hold an overwhelming dominance. California in 2020 will be an early voting state, meaning primary balloting begins in February 2020, ahead of the Iowa Caucus. This new position enhances California’s role in the presidential election, making it more pivotal for candidates looking to pick up delegates. That fact attracted 14 of the 23 Democratic hopefuls—including all of the frontrunners except former Vice President Joe Biden—to the convention in San Francisco. The timing of ballots in the state isn’t the only thing that has changed for the Democratic party in California. Sexual assault allegations against Eric Bauman, former chair of the state Democratic party, forced him to resign last November, and the convention tapped Los Angeles labor leader, Rusty Hicks as the new chair with a solid majority.

Rivas attended the San Francisco convention and supported Hicks in the chair election. Rivas told the Free Lance he was looking forward to “really working with [Hicks] that the California Democratic party extends beyond San Francisco and Los Angeles.” Luna also voted for Hicks to be the California party’s new chairperson. She said she had appreciated him taking the time to come to Hollister and felt he really wanted to help all California communities. Rivas said he believed that California’s new position as an early voting state made presidential candidates focus more intently on the issues that California is facing. Luna said she was impressed by
the speeches of Sen. Kamala Harris, former Rep. Beto O’Rourke and South Bend, Ind. Mayor Pete Buttigieg. She was especially taken by O’Rourke beginning his speech with two minutes of uninterrupted Spanish and said he received a warm welcome at the meeting of the Chicano Latino Caucus. Rivas didn’t endorse a candidate, but said he was impressed by Sen. Elizabeth Warren over the weekend. He told the Free Lance he was looking for a candidate who was going to take the time to address some of California’s problems and work to mend the relationship between California and the federal government that has been fractured during the Trump administration.

The foundation president, Gary Byrne, told the council that he had been told by Velazquez that he wanted to use the abandoned lot as a beer garden for the Vault, a banquet hall owned by the mayor next to the development site. In an interview with the Free Lance, Velazquez disputed Byrne’s account. “This is how they keep trying to misrepresent things,” said Velazquez. “I’ve said this time and again: This should be a community plaza.” Byrne told the council that he believed Velazquez intended to sue the city to get the project canceled, and vowed to continue to fight back to get the projects on the property that the foundation and De Curto Brothers developers purchased from the city in 2017. “The mayor is going to sue the city of Hollister,” Byrne told the council. “And the Del Curto Brothers and the Community Foundation are going to pay the bill—but we don’t care because we’re committed to downtown.” At an April 11 special meeting of the city Planning Commission, the commission had approved a tentative map for Del Curto brothers condominiums, the vacation of
Briggs Alley that separates the site for the Community Foundation and the Del Curto project and a density housing bonus, which would allow four extra units be built for low-income and very lowincome rates. The mayor’s lawyers arguments at the June 3 appeal hearing centered on the city’s decision to allow more housing units. Velazquez’s lawyer, Edward Schexnayder, of Schute, Mihaly and Weinberger, told the council that the Community Foundation and the Del Curto development mixed-use space were split up into two projects when advantageous to the planning staff, then later combined to one project. Schexnayder said that his law firm sent a letter on Velazquez’s behalf to the planning commission, pointing out the switch, which resulted in the language in the density housing bonus being changed to reflect a single project. Planning Manager, Abraham Prado, confirmed that the application language was changed sometime between the March and April planning commission meetings, after the staff had received the letter from Velazquez’s lawyers. Prado argued that the Community Foundation offices and Del Curto mixed-use building have always been referred to as phase one and phase two of the project.

Build this block right
T
he City of Hollister should go back to the drawing board on the 400 block. The proposed deal has way too many problems and is too polarizing because it wasn’t handled the right way. An appraisal was hidden from the public, allowing the land to be sold too cheaply, at the expense of schools, fire districts and public agencies that benefit from a sale. Not are they being cheated by the artificially low sales price, but a nonprofit-owned parcel will be exempt from paying property taxes on a prime piece of downtown real estate. Then the City Council prohibited the public from voting on the development, despite a petition qualifying the question for the ballot. It should have let voters speak. Voters chose Rolan Resendiz over incumbent Mickie Solorio Luna, who was instrumental in squashing the election—a clear sign that citizens were tired of insiderism. The city should have sat up and taken notice, but it continued on its divisive course rather than listen to the public. The Community Foundation of San Benito County, instead of serving the people who need its help, has been spending too much time and money on politics, influence building, development and media. It poured cash that it raised into Benitolink, which shamelessly reported on council activities and the 400 block without disclosing that it will benefit from having cushy quarters there. That’s a conflict of interest. The foundation should refocus on its core mission and look for less strategic land than the most important corner in town. The 400-block location is better suited to a public use that will generate more foot traffic, taxes and economic activity than offices for a small nonprofit. The city should talk to revitalization consultants to find out what uses kickstart a downtown, and talk to the community to find out what it wants. A plaza? A marketplace

Then Hollister should invite innovative architects, public space planners and developers from near and far to submit proposals. There should be a competitive process—not a backroom deal. Perhaps Hollister is ready for some exciting architecture or a destination draw. Communities such as Mountain View and Escondido have gone from backwaters to regional magnets by building arts centers in their downtowns. Hollister can do better than a handful of run-of-the-mill apartments or condos, and some vanilla office and retail space. Let’s dare to do something better and make a difference. Whatever is built will be here for a long time and set the tone for the future. Create a crown jewel for downtown’s next century. It’s time to go big or go home. It’s time to lead, not settle.

San Juan Bautista City Councilmember Dan DeVries was arrested on suspicion of domestic violence in May, but the district attorney has not charged him with a crime, according to authorities. The evening of May 24, San Benito County Sheriff's deputies responded to a residence on the 400 block of Fifth Street in San Juan Bautista. The deputies responded to a 911 call from a victim who accused DeVries of spousal abuse, according to Sheriff's Capt. Eric Taylor. Deputies arrested DeVries, 54, on suspicion of domestic violence, Taylor said.

A recent gang member compliance check by local law enforcement authorities resulted in two arrests and the discovery that three residents are in violation of their post-release sentencing terms, according to police. On May 22, the Hollister Police Department, San Benito County Probation Department and the California Department of Corrections and Rehabilitation conducted
probation gang compliance checks at the homes of 18 known gang members in the city limits of Hollister, reads a press release from the Hollister Police Department. During the operation, Rudolfo Miramon, 31, was arrested for a felony warrant and resisting arrest, police said. Miramon was on felony probation at the time of the May 22 sweep. Also arrested May 22 was Mario Sanchez, 36, on suspicion of violating his post-release community supervision gang terms, according to police. Somegang members the officers checked
in on were not home May 22, and are now wanted for violation of their gang terms, reads the press release. These suspects are Ruben Jacquez, 30; Abel Pasillas, 21, who is on high-risk felony probation; and Jacob DeLaRosa, 32, also on felony probation, police said. Although these gang members were not home, officers searched their homes May 22. During the searches, police discovered gang indicia and other evidence of recent crimes in their homes, according to authorities. They are wanted by county probation officers.

According to San Benito County Jail staff, DeVries was booked at the jail just before 10pm May 24, and released on $50,000 bail just before midnight the same evening. San Benito County District Attorney Candice Hooper said in a May 31 email to the Free Lance that her office has not received a report of the sheriff 's allegations against DeVries, and thus has not charged him with a crime. DeVries could not be reached for comment.

Taylor declined to release details of DeVries' relationship with the alleged victim, or state if the victim suffered injuries as a result of the May 24 disturbance. Taylor did say that the elements included in the penal code DeVries is suspected of violating “were present and confirmed through evidence.” He gave no further details. California Penal Code 273.5 states that the victim of such a crime is the offender's spouse, former spouse, cohabitant, former cohabitant, fiancée, in a dating relationship with the offender or is a parent of the offender's child. The law also states that an offender of that code has “willfully (inflicted) corporal injury resulting in a traumatic condition upon a victim.”

to approve recreational cannabis use. At an April 22 council meeting, City Manager Bill Avera told the council that the city was currently “breaking even”on cannabis revenues. Maria Mendez, cannabis affairs manager for the city, previously estimated that with recreational and medical sales, the city could collect $5.5 million annually in fees, but with just medical sales the projected revenue would be $1.375 million. There are two storefront dispensaries set to open in Hollister, which
is currently the maximum allowed. Mayor Ignacio Velazquez, who had been critical of the ordinance in the past and said he wanted to move forward cautiously, thanked the staff and business owners who had given input over the past months. “Thank you for taking the time, giving us tours, making sure we’re following the rules,” said Velazquez. “I know this isn’t going to be perfect, but I think we’re getting close to doing a really good job.”

As the new coach of the Gavilan College softball team, Bobby Reggiani knows he faces an uphill climb to turn the Rams into a winner on the field. The Rams’ last winning season came in 2014, but since then the team has averaged just below nine victories per season. It’s a task Reggiani said he’s up for. “I want to get it to the point where the girls around the area say, ‘Yeah, I want to play softball at Gavilan,’” said Reggiani, who was hired as the new Gavilan coach three weeks ago. “A lot of times they (high school players who plan to play community college softball) don’t want to stay in town. So they’ll go to San Jose City or another junior college. It’s going to be a challenge,
but I’m up to it and just want to see these girls succeed and have them eventually get to the point where they say, ‘Hey, I want to play at Gav.’” If numbers are any indication, the Rams are on their way to stamping themselves as a major factor in the community college landscape. Reggiani said he already has nine recruits committed to play for the program next season— he’s also working on a couple more—while also having several returning sophomores in the fold. Increased numbers play a critical role in that it creates a dynamic, thriving and competitive atmosphere. “The last two years we’ve had the bare minimum number of girls (to field a program), and it’s hard to get them motivated sometimes if there is no one to push them,” he said. “The more girls in the program, the more energy you’ll see. I’ve already had a meeting with the returners and they’re already excited about seeing some new girls coming in and the team we can have.” Some of the top players projected to return next season include Noel Chavarria, Brooke
Siaz and Liezl Clark. All three players prepped locally and are an embodiment of the Gavilan program in that the majority of the roster features homegrown, local players. Chavarria, a centerfielder from San Benito High, had a terrific freshman season, especially defensively. “She was one of the top defensive center fielders in the league this past year,” Reggiani said. “She saved a lot of runs for us covering a lot of range in that outfield.” Clark, who is from Gilroy and can play multiple positions in the infield including catcher, was a second team all-conference player in 2019 and hit .325 in Coast Conference South Division play while leading the team in home runs. Siaz, who is from Prunedale and prepped at North Salinas High, earned Coast Conference First Team honors this past season as a utility player. Reggiani hopes he’ll be able to move Siaz to the infield next season, which would make the Rams a more formidable team. Chavarria is stoked that Reggiani has taken over the reins of the program. “Bobby puts his heart and soul into it and I know that will
translate into an amazing season and great things for this program,” she said. Chavarria likens Reggiani as a coach who knows how to be patient and reflect on certain things rather than voice comments in the heat of the moment that can sometimes prove detrimental. “He kind of sits back, internalizes things and watches what is going on and gives us feedback afterward,” Chavarria said. “(For example) he’ll look at what an opposing pitcher is doing and watch their sequence, and then when we go up to bat he’ll tell us to lay off the rise ball or make sure to get our hands up high in the box. He helps the players know what adjustments to make.” Chavarria played three sports in her freshman season: indoor volleyball, beach and softball. The latter two she did in the same season with her older sister Lex, who recently signed a letter of intent to play volleyball at Peru State University in Nebraska. It was a dream come true for the sisters, who played together at San Benito High but never in three sports in the same school year like they did at Gavilan. “It was awesome playing with
my sister,” she said. “It was a bonding experience and we were together 24/7. It was definitely an experience I’ll never forget, and those memories will keep me going whenever I practice or play.” The Gavilan beach volleyball program advanced to the state championships for the first time in program history, and the Chavarria sisters were the lone pairs squad to win a point in the team’s final match of the season at the No. 3 position. “It was crazy because we had been playing No. 4 all season and moved up to three for the state tournament,” Noel said. The community college sports scene can be transient at times, where the only constant is chaos and unexpected change. Often times, it means the players need to learn how to deal with adversity. Chavarria did just that in the softball season. “Last season wasn’t exactly what we planned, but we kept it together in the middle of the season when some of the girls wanted to give up and call it quits,” she said. “Overcoming all this adversity was a learning experience and will really help us as players going forward.”

The applicants have also offered to enter into a Development Agreement with the County of San Benito. The Development Agreement will vest the Applicant's rights to conduct hemp related activities, including but not limited to cultivation, testing and distribution and derivative manufacturing and oil extraction and other hemp processing activities in accordance with County Code. The Development Agreement also addresses specific Community Benefits for San Benito County. The Planning Commission will decide on the merits of the Use Permit for the reuse of the existing facility, and then make a recommendation to the Board of Supervisors who will take final action on the Development Agreement at a future duly noticed Board of Supervisors' Meeting, potentially in July 2019. FIRE CHIEF The following Sections 2.10 will be added into Title 2, Administration and Personnel: 2.10.010 - Creation 2.10.020 - Fire Chief - Appointment 2.10.030 - Same Powers and Duties 2.10.040 - Powers and Duties of Fire Chief as a City Department Head 2.10.050 - Functions 2.10.060 - Authority to inspect 2.10.010 Creation The office of the Fire Chief is hereby established. The Fire Chief shall be appointed by the City Manager and he or she shall exercise the powers and duties as provided in this chapter and in other Ordinances in the city. 2.10.020 - Fire Chief Appointment The Fire Chief who shall be appointed by the City Manager, with the consent of the City Council of the City of Hollister. 2.10.030 - Same Powers and Duties In all cases where the duty is not expressly charged to any other department or office, it shall be the duty of the Fire Chief or to protect life and property by preventing and eliminating fire hazards and by controlling and extinguishing fires, providing emergency medical services and those other services needed to protect the lives and property of the community. It shall be the duty of the Fire Chief or to manage the functions of the department of fire. 2.10.40- Powers and Duties of Fire Chief as a City Department Head The heads of the various departments established by this chapter shall have the following general powers, duties and responsibilities: (a)To organize the department into divisions in such a manner as to efficiently perform the functional responsibilities allocated. For this purpose, the department head may create such sections and subunits within such division as deemed necessary. (b)To make recommendations regarding recruiting, disciplining and discharging of departmental personnel in accordance with the personnel rules and regulations of the city. (c)To transfer or relocate
personnel from one division to another in accordance with the personnel rules and regulations of the city. (d)To keep correct attendance records on each employee for payroll purposes, and to submit such other information as required for the proper maintenance of individual personnel records, including leaves of absence, job efficiency, personal conduct and workers compensation claims and injuries. (e)To administer the departmental budget and permit no purchase requisitions to be issued or other expense incurred, unless an appropriation therefore has been duly authorized. (f)To attend meetings of the council when required. (g)To attend meetings of their respective boards and commissions. To carry on an active public relations program for their respective services. (h)To promulgate and administer internal rules and regulations for the proper conduct of personnel and the efficient handling of the department's duties and functions. (i)To discharge such other duties as may be assigned by the City Manager or required by the ordinances, resolutions or official orders of the city council. 2.10.050 Functions The department of fire shall perform the following functions: (a)Fire protection and emergency response. Responsibilities and duties: 1.Contracts. Enforce the general laws and ordinances of the city, county and state. 2.Fire extinguishment. Extinguish all fires and protect persons, property and the environment from fire or related emergencies. 3.Rescue. Provide emergency rescue services to remove the public from entrapments and associated harm. 4.Emergency medical services. Provide emergency response to protect the public due to medical related emergencies. 5.Other emergency response activities. Respond to other emergencies, such as hazards material incidents, earthquakes, etc., to protect the public, property and environment. 6.Enforce laws. Enforce all laws and ordinances relating to the prevention and extinguishing of fires. 7.Investigation. Investigate and report to the department of police in all cases where there is reason to believe that any fire or other emergency is the result of a crime or that a crime is committed in connection therewith. 8.Maintain equipment. Maintain an efficiently and operable condition of the firefighting equipment and fire prevention systems and facilities assigned to the department of fire. Fire prevention. Administer and enforce all ordinances and codes pertaining to: 1.Inspection of buildings. Inspect building for fire safety and maintenance of means of egress. 2.Fire prevention. Make frequent inspections of all property within the city, for the maintenance of fire protection and elimination of fire hazards on land, in buildings, structures and other property, including those under construction. Review and inspect the installation and maintenance of automatic, manual and other private fire alarm systems and fire extinguishing equipment. 3.Abatement. Cause the abatement or removal of fire hazardous buildings, litter, junk, uncultivated weeds and shrubs and other hazardous conditions. 4.Hazardous materials. Regulate the use, handling and storage of hazardous materials and waste in the city. Investigate unauthorized releases of hazardous materials. (c)Training. This shall be under the supervision of the Fire Chief who shall promote the proficiency of the departments members by the administration of training, study and physical conditioning programs.(d)Volunteer/ Reserve personnel. They shall be under the supervision ofthe Fire Chief. These personnel shall be subject to the rules and regulations of the fire department insofar as they are in conformance with the provisions of the ordinances and rules and regulations
adopted by the council. The following shall be the responsibility and duty of the Fire Chief.(1)Recruiting. Recruit such volunteers and reserve personnel as may reasonably be required to augment regular department of fire personnel.(2)Training. Develop such courses of training so as to develop the efficiency and abilities of the reserve firefighters so that they are of assistance to the department of fire in the event of emergency.(e)Records. It shall be the responsibility and duty of the Fire Chief to keep standard records of inspections, fires, fire losses and all other activities of the department and submit quarterly reports thereof to the City Manager.(f)Divisions and command staff.(1) Field operations. ugene Lewis (Gino) Conrotto, the son of Enrico and Carolina Conrotto and the younger brother of Richard Conrotto, was born in Gilroy 90 years ago. He passed away in Modesto.
He was preceded in death by his wife, Jeanne L. Conrotto, and their son, Duane L. Conrotto. He leaves his second wife, Katherine Conrotto, his granddaughters, Tjiska Elaine and Kimberly Clare, and his daughter-in-law Karen Conrotto. Conrotto earned a degree in anthropology from Stanford University after which he began a 17-year journalism career. He was editor of Desert Magazine (where he received a California State Fair Gold Medal in Journalism) and the Palm Desert Post. He was a former president of the Palm Desert Chamber of Commerce. After moving to Sonora in 1967, he earned a Master’s Degree in English at Stanislaus State University. He taught at Oakdale High School from 1972 to 1992. He was chairman of the English Department there, and introduced Advanced Placement and GATE to the school. He is the author of numerous magazine articles and books, including, Miwok Means People.
