COMMUNITY ATTENDS FUNDRAISING EVENT FOR WERC WILDLIFE PROGRAMS By Debra Eskinazi Magazine and Features Editor
Twenty-five bowlers flocked to Morgan Hill Bowl Sunday, March 18 helping to raise $2,200
in funds for Wildlife Education and Rehabilitation Center’s fifth annual Bowl-A-Thon. The Morgan Hillbased nonprofit takes in injured birds of prey and other animals and nurses them back to health. Animals, like Owlivia, a Western Screech Owl, that cannot be released into the wild often become part of WERC’s resident animal team.
WERC educational coordinator Anna Pascual said the fundraiser provides needed resources for their busy spring season. “We put it on in March specifically for our spring season because that’s when we have the most animals coming in,” said Pascual. “It helps with the cost of caring for baby animals. It basically helps pay for food and medical care.” Community supporter
Emily Shem-Tov said her family became involved with WERC years ago and have become devoted regulars at its events. “Clara, my daughter, is utterly obsessed with owls and the work WERC does—she’s gotten the whole family involved,” Shem-Tov said. Shem-Tov said her daughter, who also took first place, raised $250 this year with the
Bowl-A-Thon, which she said is unique because her daughter is not an official WERC volunteer. ShemTov says she and her family are please to participate. “They need a new location, it’s just great to get the word out,” ShemTom said. Suspect has history in explosives SUSPECT DENNIS FRITSINGER ARRAIGNED ON TWO CHARGES Michael Moore Editor
A Morgan Hill man arrested last week on suspicion of making explosives in his home has a history of bomb and drug related offenses, according to police reports and news archives. The police reports state that after initially denying that he was making explosives, Dennis Fritsinger later admitted to officers who responded to his home that he intentionally detonated a mixture of chemicals in his backyard. Fritsinger, 63, was arrested by Morgan Hill Police March 13 at his home on the 17700 block of McLaughlin Court, after his neighbors heard a series of explosions outside the residence over the previous days. On March 15, Fritsinger was charged at the South
County Courthouse with one count of possession of a destructive device and one count of possession of materials with intent to make a destructive device or explosive, according to Santa Clara County Supervising Deputy District Attorney Vishal Bathija. Fritsinger’s next hearing is scheduled for 1:30pm March 23, when he is expected to enter a plea. Both charges are felonies, and his maximum sentence, if convicted, is four years, eight months in prison, according to Bathija. Fritsinger is being held at Santa Clara County Jail on $200,000 bail. According to sfgate.com, Fritsinger was convicted in 2000 of three counts of bomb possession, two counts of possessing assault rifles, three counts of possessing silencers, one count of manufacturing methamphetamine and possessing chemicals to make meth. Fritsinger was a resident of Cupertino when

diameter, capped on both ends” was spinning on an unidentified machine. Officers also saw an “unknown substance” in a large glass beaker. Fritsinger initially told officers that the tube was a “tumbler” for polish, and that the chemicals were for refrigeration materials for his work. The court file lists Fritsinger’s profession as “self-employed.” After Fritsinger gave the officers verbal permission to search his home, police found chemicals on his kitchen island such as thermite and ammonium nitrate, the court file reads. The officers recognized these as potential bombmaking material. They also found a substance labeled “thermite ignition mix,” as well as aluminum powder, wires, electronic boards, metal pipes and a notepad with the names of chemicals listed on it. Fritsinger “then admitted to causing explosions in his backyard with
thermite in a container mixed with ammonium nitrate,” according to the MHPD report contained in the court file. MHPD officers then acquired a search warrant and the Santa Clara County Bomb Squad returned to search the property March 13. Some neighboring homes on McLaughlin Court were evacuated on March 12 after the explosions were reported, and during the March 13 search. No injuries were reported due to the explosions outside his home, according to police. Fritsinger’s home is about one block east of Monterey Road just north of downtown. The Morgan Hill Pre-School Academy and Shadow Mountain Baptist School, among other commercial properties, are nearby. Britton Middle School is about two blocks away, on the west side of Monterey Road at West Central Avenue.
Carr hearing postponed to April 18 COUNCILMAN LARRY CARR FACES HEARING FOR DOMESTIC BATTERY Michael Moore Editor
Morgan Hill City Councilman Larry Carr will next appear in court April 18 for a pre-trial conference on a domestic battery
charge, according to authorities. Carr, 49, had a hearing March 19 at South County Courthouse in Morgan Hill, but it was postponed because his attorney could not be present, according to Santa Clara County Supervising Deputy District Attorney Vishal Bathija. He is next scheduled to appear in court at 1:30pm April 18. At a hearing in February, Carr pleaded not
guilty to the misdemeanor charge of domestic battery. The charge stems from a Nov. 25, 2017 incident involving his girlfriend of 11 years, with whom he shared a home in downtown Morgan Hill at the time. Morgan Hill Police responded to the couple’s residence that evening, and arrested Carr after taking statements from him and his girlfriend. The woman had told police, during a
lengthy verbal argument, that Carr “ripped the glasses from her face and threw them to the ground, causing them to break,” and pulled her hair in the process, according to the police report of the investigation. Carr told police at the time that any contact he made with his girlfriend during the argument was accidental. He has continued to deny the allegations since his arrest.
The victim did not exhibit any injuries or indicate a complaint of pain, according to police. Carr—who is currently serving in his fifth term as a Morgan Hill councilmember—was convicted of a similar misdemeanor charge in 2015, in relation to an incident at the couple’s previous home March 23. Carr pleaded no contest to domestic battery and completed a 16-week
counseling program. The court later dismissed the charge from his record, at Carr’s formal request. Carr has also denied acting violently in that incident, and he pleaded no contest to avoid prolonged court proceedings. If Carr is convicted of the 2017 charge, the court can consider the 2015 conviction as a prior offense in his sentencing, according to authorities.

Morgan Hill prepares for major tour
Newsprint duties could hurt small newspapers
T
he printing press remains the symbol—despite the arrival of online news—of the Fourth Estate, of “Freedom of the Press.” That’s why for centuries one of the first acts of authoritarian rulers was to smash the printing presses of the opposition. In 21st Century democracies, the pressures are more subtle, but with the same potential impact—to silence independent voices: labeling all legitimate, professional media as “fake news,” for example. Now, coming on the heels of the announcement of the Trump administration’s controversial tariffs on imported steel and aluminum, the Department of Commerce this month announced the imposition of a 22 percent “anti-dumping duty” on imported Canadian newsprint, a major source of paper for many community and metro newspapers. The Commerce Department had concluded that Canadian paper manufacturers have been “dumping” newsprint into the U.S. for less than its fair value. The antidumping duties follow duties on newsprint and other uncoated paper products of 4.4 to 9 percent announced in January. Paper producers have already announced significant price increases in an attempt to absorb the duties. Additionally, newsprint manufacturers with low rates are being asked for supply and are raising prices because of higher demand. The California News Publishers Association and other industry groups are asking each member of California's Congressional delegation to oppose Commerce's imposition of the duties. David Chavern, CEO of the Newspaper Marketing Association, predicted dire consequences: “Most newspapers will not be able to absorb these increased costs and will be forced to reduce page counts, reduce days of

distribution, and/or move more information to digital platforms. “Some small-market or rural newspapers, with slim margins, will close.” Ironically, the supposed beneficiary of duties on Canadian newsprint imports— U.S. newsprint mills— will be harmed as tariffs will artificially decrease the demand for their product.”
The consequence of the newsprint ‘duties’ (another word for tariff) could be even more dire for our democracy. A consequence of the new steel and aluminum tariffs will be increases in manufacturing costs and consumer prices for cars, refrigerators and washing machines. The consequence of the newsprint “duties” (another word for tariff ) could be even more dire for our democracy. South Carolina newspaper publisher Susan Rowell warned, “We are painfully aware that some newspapers will not survive this upheaval. For those who do, it will be at the expense of a diminished news mission. Our readers, customers and community will pay the price, just so one small paper mill in Washington state can use trade laws to a very temporary advantage. Long term, we will all lose.” Although the new duties are in place, the Commerce Department and the U.S. International Trade Commission will be studying their impact this summer on newsprint customers and the newspaper industry. Let’s hope that wiser heads prevail and these new rules are reversed.

I think it’s time for another update about the Amgen Tour of California (ToC). I’ve been fortunate enough to be one of many involved in the planning of what happens in Morgan Hill before and during the ToC. There are many, many moving parts to an event as big and prestigious as this one, and there is an army of people locally making sure it’s done right. On May 16 it will all be done right. A lot goes into the planning for this huge event locally, like logistics, traffic control, parking, support events, feeding crowds and more. But the priority has always been about how to reduce the impacts to the residents. Considering the magnitude of the event, the number of people directly affected and all the hubbub appears to have been minimized greatly—but if you’re one of those affected it’s a big deal. That is not lost on the planning groups, and to this day the effort to minimize impacts is still underway. Groups are working with the schools that might be impacted and the downtown businesses will be getting briefed on what to expect. The restaurants are already discussing how to handle the crowds on race day. A plan of street closures and how to move around those areas should be available to everyone in the next few weeks. The street closures are being strategically planned to allow for the best traffic movement the night before and the morning of the event. Logistics is another issue. Where do you put news crews that will broadcast the race to almost 200 countries? Where do you stage about 125 racers and support teams with cars and bikes and all their stuff? How do you make sure they’re all fed? That is all being worked on right now too. It’s a big deal. I believe there will be more than 1,000 people involved with the event, from the organizer’s staff to the news crews and riders. This whole circus will arrive the evening before our race, after breaking down from the event’s stop near Monterey, to set up for our stage of the race and then break it down and do it all over again when done here and set up in Stockton that night. It’s going to be an amazing 24 hours of excitement. There’ll be a “Lifestyle Festival” during the race, which will be a big bicycling related market, maybe with some food booths to entertain the spectators. We have some involvement in setting up local booths at that festival but most of the work has been focused on establishing activities leading up to race day. A schedule of activities has been finalized that includes time in our schools to educate and build excitement in our school aged children. I’ll provide more details in the near future but trust me, this will be BIG! Supreme Court hears appeal of CA statute PREGNANCY CENTERS BATTLE TO OVERTURN CA LAW, CITING FIRST AMENDMENT By Barry Holtzclaw
The U.S. Supreme Court justices Tuesday heard arguments in its first abortionrelated case under President Trump, and “pregnancy centers” in South County were center stage. In a story that led nearly every major national news report March 20, lawyers for the National Institute of Family and Life Advocates pleaded their case that a 2015 California law violates the First Amendment free-speech rights of their affiliates, which include Informed Choices of Gilroy and the Hollister Pregnancy Center. The highly anticipated case is being watched closely by more than 300 of these anti-abortion counseling centers in California, which

for more than two years have been required to provide positive information about abortions. The centers, which were created to convince expectant mothers not to have abortions, stress adoption alternatives and offer free pregnancy tests. Christine Vatuone, executive director of Informed Choices, was in Washington, DC Tuesday, and was not available for comment. Brigette Blair, director of the Hollister Pregnancy Center, declined to comment. Informed Choices has moved back and forth between Morgan Hill and Gilroy for three decades, and most recently relocated to Gilroy, at 66 1st St. The Hollister center is at 483 5th St. There are more than a dozen similar centers in Santa Clara County, including Life Advocates Inc. Gilroy, 1335 1st St. Some are affiliated directly with the Roman Catholic Diocese of San Jose, others are
supported by evangelical Christian groups. The question before the Supreme Court justices on Tuesday was whether a California law’s requirement that these faith-based “crisis pregnancy centers” provide their patients with specific kinds of information – including, for some, the availability of low-cost or free abortions – violates their free-speech rights under the First Amendment. “After roughly an hour of oral argument, the law appeared to be in some jeopardy, not only among the court’s more conservative justices but also perhaps at least with Justice Elena Kagan, one of the more liberal justices,” reported Amy Howe, of SCOTUSBLOG after Tuesday’s hearing in Washington, D.C. The organizations had been unsuccessful at blocking the California law—The California Reproductive Freedom, Accountability, Comprehensive Care, and Transparency Act (FACT)— at the federal district court level, and the state was upheld by a 3-0 vote of the Ninth Circuit Court of Appeals last fall. The federal appeals

court at that time determined that the disclosure provision does not “encourage, suggest or imply” that a woman should pursue an abortion. Rather, it is “closely drawn to achieve California’s interest in safeguarding public health and fully informing Californians of the existence of publicly funded medical services.”
Arguments
Arguing on behalf of the pregnancy centers, Howe reported that attorney Michael Farris quickly ran into questions from
several of the court’s more liberal justices that boiled down to what Justice Stephen Breyer dubbed “what is sauce for the goose is sauce for the gander”: If a state that opposes abortion can require a doctor who performs abortions to tell a pregnant woman about the possibility of adoption, why can’t a state that supports abortion rights require a doctor to tell a pregnant woman about the availability of free or low-cost abortions? Justice Sonia Sotomayor appeared to agree.

OPENS WEDS, 3/28 AT 7PM:
If you decide to talk about pregnancy, she asked Farris, why shouldn’t you be required to tell people that you are not a doctor? Farris and Jeffrey Wall, the deputy U.S. solicitor general who argued on behalf of the federal government, tried to distinguish between the two kinds of disclosures, stressing that requirements to inform pregnant women about alternatives to abortion only come into play when medical procedures are being provided, and that the unlicensed clinics are not providing such procedures.

LOCAL SCENE From 1
The Flying Lady restaurant Learn about Morgan Hill landmark, the Flying Lady restaurant, at a 10 to 11:30am April 7 presentation at Hiram Morgan Hill House, 17860 Monterey Road. Built on a grand scale by Irv Perch and named for his wife, Jan, the Flying Lady Restaurant was open from 1971 to 1994. In fact, there were two Flying Lady restaurants: the first was a small restaurant with seating for about 200 people, which opened in 1971. Not satisfied with the small quarters, Perch built the Flying Lady II, which in 1981 was one of the largest restaurants in the world with seating for nearly 2,000. The Flying Lady was also one of the most unusual restaurants in the world, with seven full-sized antique aircraft hanging from the ceiling and more than 100 scale model aircraft “flying” over the heads of the diners on a moving track. But why would anyone build a huge restaurant out in the rural foothills of Santa Clara County? What made the Flying Lady a success and what happened to it? Presenter Julie Perch Belanger, daughter of Irv and Jan Parch, will discuss some of these questions, and share treasured family photographs and movies. You will learn the fascinating story of the Flying Lady, how Julie met her husband, Pat Belanger, there and how they were married at the restaurant (in an airplane, of course).

Staff report
An off-duty Gilroy Police officer was arrested last week in Hollister on suspicion of driving under the influence of alcohol. Geoffrey Guerin, a veteran sergeant with Gilroy Police Department, was arrested by Hollister Police about 12:39am March 15, a spokesman for the Hollister Police Department confirmed. Guerin was arrested after an officer made a traffic stop on the vehicle
he was driving on the Highway 25 bypass near San Felipe Road, according to Hollister Police Sgt. Don Pershall. Gilroy City Admini-strator Gabriel A. Gonzalez sent out a press release about the arrest, but did not list any details of the alleged DUI. “Details and circumstances of the incident are currently under investigation by the Internal Affairs unit of the Gilroy Police Department,” reads the press release. “As in all cases, persons charged with a crime are presumed innocent until proven guilty,” the press release continues. The City of Gilroy also declined to release the suspect’s name. “Owing to protections
afforded public safety employees under California state law, specific details of the arrest, including the name of the off-duty officer, will not be released at this time,” reads the March 16 press release. Guerin has worked for Gilroy Police Department since at least the 1990s, according to Gilroy Dispatch news archives. He has been assigned to the city’s gang enforcement unit and the Gilroy-Morgan Hill SWAT Team. In 2010, Guerin was recognized by Gilroy police and the Gilroy Fire Department for saving the life of a 2-monthold infant when he responded to a medical emergency in the city of Gilroy.

SERIOUS RUNNER Live Oak High senior Kaylah Grant, seen here before the start of the 1600-meter final in last year’s CCS Championships, has goals to make it to state in the 1600 and 3200 events. Grant placed third in the 3200 at CCS last year to earn a berth to the CIF State Meet.

Live Oak set for PRs ACORNS LOOK FORWARD TO ESTABLISHING NEW RECORDS emanuel lee Sports Editor
When Brenden White unleashed a personal-record (PR) shot put throw of 46 feet, 2 inches in the first meet of the season, he was mildly surprised. But White doesn’t plan on stopping there; in fact, he has a goal of throwing 50 feet by the end of the season. If the Live Oak High senior hits that mark, he’ll be a strong contender to finish on the podium at the Central Coast Section Championships in May. White is one of several athletes who have the potential to make the CCS Semifinals and possibly beyond. Other impact
athletes on the boys side include Brandon Miner (high jump and hurdles), Greg Sperry (400 meter run), Kolton McCrossen, Cole Davis and Christian Guary. The latter two are part of Live Oak’s 4x100 relay team. “The 4x100 boys and girls relay teams are definitely hitting times to make the CCS Semis,” Acorns coach Alberto said. On the girls side, senior Kaylah Grant returns in her quest to make a return trip to the CIF State Championships in the 3200 meter run. Grant placed third last year in the CCS Finals to punch her ticket to state, and a fourth-place finish in the 1600 meant she was close to competing in two events at state. Grant, who is just starting to build her mileage up after recovering from a hip injury, can’t wait to return to competition, especially the prestigious Stanford Invitational on March 30 and 31. Grant wants to go sub
5 minutes in the 1600 by the end of the season, and continue building up her mileage so she can peak for the league and section championships. “I’m getting in some good interval training now that I’m all healed up,” Grant said. “I definitely want to go faster, race smarter and be able to have a stronger kick at the end of races.” Grant is excited to see young talent on the team, including Karlie Lema, who has impressed with fast times in several events, most notably the 100 yard dash. Freshman Audrey Reed (800, 1600), Tessa Seda (400), Sarah Jacob (100, relays) and Adina Simonsen (high jump and relays) are expected to be impact performers throughout the season. Seda and Sperry have been dominant in their best events in league meets, with Sperry winning five of seven 400-meter during last year’s Blossom Valley League season, and Seda
running dominant times compared to the rest of the BVAL in the 400 as well. White expressed confidence that he can establish additional PRs in the shot put and discus going forward. “My goal is to get all my marks way up,” he said. “Through some extra weight training and practice, I’m looking to increase my discus to the 140, 150 feet range. In practice, I always try to work on technique instead of power so I can refine it and get better. Hopefully, I’ll be able to transfer power into it and ultimately that will get me farther marks. We’ve got a pretty good throwing coach (Suarez), and he’s always got a watchful eye when we’re throwing. He’ll let us know if we’re throwing too high, if we’re messing up somewhere in the middle of a throw and what we can change for the next throw.” The Acorns have a nice blend of talented athletes from all grade levels, which should make
for a solid season. “Tessa is very exciting to watch, and Sarah has been very strong in the 100 since her freshman year,” Suarez said. “Adina is a very strong sprinter and athletic, and Karlie is tall, fast and amazing. She runs as fast as some of our top boys.” Lema broke four frosh-soph school records—in the 100 meters, 100 hurdles, 300 hurdles and long jump—with the 100 also being a varsity record in the team’s first dual meet of the season. After a standout season on the soccer team—where Lema was an unstoppable force at striker—Lema has impressed on the track. Last Saturday, the Acorns spent time at two different events: the Garlic Classic at Christopher High and the St. Francis Invitational, which White and Miner qualified for, and White said the rainy conditions made it tough to set a new PR.

the situation,” he said. “I need to keep in mind the team is relying on me to either score or get the ball in. Being as short as I am, I have to be a lot smarter when I go up for an attack. There is no way I’m going to hit the ball straight down on a taller blocker, so I have to tip it or hit the ball off their hands at a certain angle.” Nguyen first started playing volleyball at 5, and his development was aided by being a part of a volleyball playing family. Nguyen is the youngest of four siblings, and Nguyen’s oldest brother, Joseph, 22, plays club intramural volleyball at UC Davis. Nguyen would love nothing more than to attend UC Davis and play alongside the same club intramural team with his brother.
Pursuing dream
“My dream has to do with the (academic) prestige (of UC Davis) and following in my brother’s footsteps,” he said. “He’s a great player, and our family is very competitive. Our family in general doesn’t take to losing well. We take sports very seriously, and that’s what made me want to be better than all of them. Being the youngest, I was always behind them, and that pushed me to always improve.” Nguyen credits his dad for creating a Vietnamese scout troop team that all of the children played on growing up. “It’s a co-ed team and a little bit different than the normal, traditional scout troop,” Nguyen said. “We would play in
FRIDAY CROSSWORD
Submitted
Alex Nguyen spent his first 3 ½ years of high school at the Gilroy Early College Academy (GECA), the early college high school located in Gilroy. Even though Nguyen—a Morgan Hill resident—said he enjoyed his time at GECA, he had a burning desire to play organized volleyball (GECA doesn’t have sports teams). For Nguyen’s last semester of high school, he decided to transfer to Sobrato High to play the game he loves and be reunited with his childhood friends in the process. In most cases, transferring into a school mid-year would be a difficult transition. However, since Nguyen had an established community— the volleyball team—integrating into a new school was seamless at times. “Having a team made it a lot easier to connect with certain people,” said Nguyen, who plays outside hitter. “You have a family you can talk to and support each other with the same passion for playing volleyball. Plus, I had a couple of friends who I already knew that I could lean on in my first few days here.” Sobrato entered the week at 0-2; however, Nguyen feels it’s only a matter of time before the
team finds it rhythm. “Right now we’re in the midst of finding out where we need to improve on and where our true strengths are,” he said. “One of our middles had to sit a few weeks due to a sprained ankle, and our other outside (hitter) couldn’t play (in the team’s second match). Once we get everyone healthy and to the starting line, we’ll be a force to be reckoned with for sure.” Daniel Clifton, the firstyear Sobrato High coach, is excited about the team’s potential as well, pointing to Nguyen along with several other impact players, including freshman setter Justin Hoang, senior middle Alex Catale, senior opposite Anthony Tran, senior middle Jordan Soto, senior outside hitter David Villareal and defensive specialists Jett Asuncion and Eric Huynh. If the Bulldogs end up having the season like they did in 2017—they finished 9-3 and in second place in the Blossom Valley League’s Mount Hamilton Division—there is a good chance Nguyen will play a vital role. Even though the 5-foot7, 135-pound Nguyen routinely goes up against taller blockers, he finds a way to score a point or make the correct play. It also helps Nguyen has a nice vertical leap, allowing him to at least partially offset the height disadvantage when he goes up against some of the particularly taller players in the 6-5, 6-6 range. “As an outside, I need to make a play no matter
ON THE ATTACK Sobrato outside hitter Alex Nguyen is one of several players who play a key role for a Bulldogs team that looks to earn a return trip to the CCS playoffs. outdoor volleyball tournaments throughout the Bay Area, and I also have a lot of experience playing in open gyms.” That is why despite never playing for a travel ball club team, Nguyen
looks to be one of Sobrato’s stalwarts this season. One thing is for certain: Nguyen is ecstatic to be playing volleyball at Sobrato. On Nguyen’s first day of classes in early January, he got a kick out of
some of the reactions from people he hadn’t seen in a long time. “Well, I was 4-3 in middle school, so it was a huge difference for people to see me back then and what I am now,” he said.
