Petroleum industry targets assembly candidate BIG OIL FUND SENDS ATTACK MAILERS OUT ON FRACKING OPPONENT ROBERT RIVAS By Tom Gogola Pacific Sun
➝ 30th Assembly, 8
Robert Eliason
The state’s petroleum industry is spending $320,000 in the District 30 State Assembly race to defeat frontrunner Robert Rivas. The San Benito County supervisor hopes to succeed Anna Caballero, who is running for state senate this year and represents a district that stretches from Morgan Hill to King City and includes Watsonville and all of San Benito County. The San Rafael law firm Nielsen Merksamer Parrinello Gross & Leoni, which counts BP, Chevron, Exxon Mobil, Phillips and Valero Energy Corporation among its clients, created the Coalition to Restore California’s Middle Class, Opposing Robert Rivas for Assembly 2018. “We would love to have you come back to Morgan Hill,” Mayor Steve Tate exclaimed to Amgen Tour of California organizers on
the finish line stage—at Fourth Street and Monterey Road in the city’s downtown—at the conclusion of the competition’s May 16 individual time trial. “Thank you!” The 21.6-mile time trial loop started and ended in downtown Morgan Hill, which was closed to vehicle traffic for about 24 hours while TOC organizers set up—and then tore down—the course
route and installed temporary fencing and other crowd control measures. By the morning of May 16, the downtown was buzzing with the arrival of race officials, last-minute preparations by professional cycling teams and spectators trying to find the best spots to watch 116 professional cyclists start and finish the time trial. The TOC is considered one of the world’s most
prestigious pro cycling races, and is broadcast on live television to millions of viewers. Athletes such as Peter Sagan and Mark Cavendish— household names among cycling fans—competed in the seven-stage TOC as it stopped in Morgan Hill. Amid the downtown Morgan Hill “lifestyle festival” that coincided with the six-hour (including opening and closing
pageantry) time trial May 16 were a number of giant screens showing the live coverage of the day. This coverage prominently depicted repeated shots of downtown Morgan Hill and its surroundings— including El Toro mountain and stretches of rural roadways, wineries, vineyards, hillsides and waterways that are well known ➝ Agmen, 13
School board shifts gears on parcel tax MEASURE TO INCLUDE DISTRICT, CHARTER SCHOOLS Scott Forstner Reporter
In a last-minute change, Morgan Hill Unified’s Board of Trustees on May 15 surprised its own staff to include two local charter schools in the funding mix of a proposed parcel tax.
Instead of voting on the final draft of a fiveyear, $75-per-parcel tax resolution, a board majority backed a change led by Trustee David Gerard that will give a small percentage of funds generated by the tax to Voices Academy and Charter School of Morgan Hill. The parcel tax, if approved by district voters in November, would allocate money to the charter schools based on their enrollment of students

residing in Morgan Hill. Voters who reside within the MHUSD boundaries will vote on the parcel tax question on the Nov. 6 ballot. Gerard, along with Board President Tom Arnett, Vice President Mary Patterson and trustees Gino Borgioli and Teresa Murillo, responded to Voices families in attendance who earlier had pleaded with them to not exclude their school from parcel tax funding.
“There’s absolutely, in my mind, no way this board should go forward with a parcel tax that essentially splits the community,” Gerard said prior to the board’s vote. The district’s final draft, which was crafted by a special committee and consultants after months of planning that included a pair of community surveys, was exclusively for districtrun schools. It contained a clause that addressed
charter schools, promising their inclusion in future parcel taxes, but not the one headed to a Nov 6 vote. “This is for district schools. CSMH and Voices charter schools are not district schools,” said Superintendent Steve Betando, adding that all the work that had been done leading up to the final draft was based solely on district needs. ➝ Parcel Tax, 10

South County Relay raises $105K 24-HOUR WALKATHON HONORS THOSE STRICKEN WITH DISEASE Scott Forstner Reporter
Scott Hinrichs
Nearly 500 participants helped raise more than $105,000 as they set up camp May 19-20 at Morgan Hill Community Park for the inaugural Relay For Life of South County. The 24-hour walkathon, the biggest annual fundraiser for the American Cancer Society with localized events in cities across the country, is meant to honor those stricken with cancer and help raise money to aid research efforts in finding a cure. “It was awesome. It was a totally seamless event. Everyone came together and had a lot of fun,” said Relay co-lead Nikkie Underhill. The event—which included 467 Morgan Hill and Gilroy participants as well as 62 cancer survivors—touched home for Underhill, who was part of two Relay teams created separately in the memory of a long-time friend and her mother-in-law. “It was definitely an emotional weekend,” Underhill said. “It was really a healing event for us to come together as a family.” Relay regulars, Dancers Against Cancer, once again topped the team fundraising efforts by totaling $20,067. “They always raise a lot of money,” said Underhill of
the leading team. “It’s really incredible.” Dancers Against Cancer, captained by Nancy Bernal and Diane Berney, raises money before the event through donations from family and friends. Then, the members make up special baskets that they raffle off during the Relay to generate even more funds, according to Underhill. First-time participant Elizabeth Yoshida of Hu’s Platoon was the top individual earner for the 2018 Relay with a total raised of $6,620. Her participation was sparked after learning her father, Hubert Yoshida, was battling a rare cancer of the small intestine. The retired Marine Corps Captain and Bronze Star Medal recipient also helped the team in his honor raise nearly $9,500. “It’s a brand new team.... He’s currently in treatment so she started it for her dad,” Underhill said. “He was out there and the family was out there. They all did a great job.” Donations to the Relay can be accepted through the end of August by visiting relayforlife.org/ SouthCountyCA. After Saturday’s opening ceremonies that included speeches from councilmembers Fred Tovar of Gilroy and Caitlin Robinett Jachimowicz of Morgan Hill, the “Survivors Lap” kicked off the Relay at Community Park. There were activities throughout the day with bounce houses, face painting and live music. Keeping with a Gilroy Relay

A “Miss Relay” contest, where male participants dressed in women’s clothing and then strutted around collecting donations, was another fun event. “It was a fun time, a fun weekend,” Underhill said. Breakfast, lunch and
dinner was served to all participants in the hospitality tent as well. As the sun went down, the “Luminaries Ceremony” lit up the track for late night participants. Students in Live Oak High School’s Future Business Leaders of America decorated the luminaries that were bought on site.

COMMUNITY Sobrato HS among top schools in the state
Zoning update increases hotel height maximum
MHUSD SCHOOL RANKED BY U.S. NEWS & WORLD REPORT
NEW LODGING FACILITIES CAN BE UP TO 55 FEET TALL
Scott Forstner Reporter
Ann Sobrato High School was among the top 100 high schools in California, according to recently released U.S. News & World Report’s 2018 Best High School Rankings. The Morgan Hill Unified School District school was awarded a silver medal for its accomplishment as the 99th best in the state out of a pool of 2,100. Sobrato was also ranked 585th among 20,500 public high schools evaluated across the country by the U.S. News & World Report. “This recognition means a lot to our staff and students who work so hard every day,” Sobrato Principal Courtney Macko said. “Increasing our rank from No. 130 to No. 99 is an enormous accomplishment and illustrates the commitment of our students to achieving their academic goals with the support of an amazing staff.” Live Oak High School, which went unranked, did not crack the top 500.
In Gilroy, Dr. TJ Owens Gilroy Early College Academy earned a gold medal with rankings of 23rd in state and 172nd nationally; Gilroy High School got a silver medal with rankings of 480th in state and 2,451st nationally; and Christopher High School went unranked. San Benito High School also did not make the list. The purpose of the rankings was “to identify schools that best serve all of their students – including historically underserved populations—and assess the degree to which students are prepared for college-level coursework,” according to the report. Schools are awarded gold, silver or bronze medals based on their performance on state assessments, graduation rates and how well they prepare students for college. Sobrato, which opened in 2004, serves 1,477 ninth through 12th grade students with a 23 to 1 teacher-to-student ratio, according to the report. The student body is made up of 52 percent male and 48 percent female with 63 percent minority enrollment. The school received a “College Readiness Score” of 55.3 out
of 100 with 74 percent Advanced Placement participation rate, according to the findings. It has a 94 percent graduation rate. The top four high schools in the U.S. News & World Report state rankings were Whitney High School in Cerritos, Oxford Academy in Cypress, Stockton Collegiate International Secondary and KIPP San Jose Collegiate. “Top-ranked schools succeed in three main areas: exceeding expectations on state proficiency tests, offering challenging coursework and graduating their students,” said Anita Narayan, managing editor of Education at U.S. News. “We encourage parents to use the Best High Schools rankings and data to research which schools in their state and nationwide are ensuring students are wellequipped for the future.” The rankings, which can be viewed online at usnews.com, feature data on a number of factors, including enrollment, graduation rates, diversity, participation in free and reduced-price lunch programs and the results of state assessments, as well as Advanced Placement and International Baccalaureate test data.
Staff Report
On May 16, the Morgan Hill City Council decided to increase height restrictions for hotels along U.S. 101 to be raised to a maximum of four stories and 55 feet for the main building. The height limit for certain features like architectural design and mechanical necessities, such as for elevators may exceed 55 feet under minor exceptions. “We have identified hotel development as a key element to our future prosperity in Morgan Hill,” said Edith Ramirez, Economic Development Director for the City of Morgan Hill. “Hotels support the city by bringing needed transient occupancy tax that helps pay for street repair and public safety. Hotels are also an integral part of a tourism strategy. If we want to grow this area for tourism, we need to grow the lodging offerings. As we try to keep the community small, we need to still grow our revenue, and growing
our visitors diversifies our economy, making it more sustainable. It is not enough to say we want hotels; we need to adapt to industry standards and allowing four stories will help (get) our message out to the hotel industry that we are ready for business in Morgan Hill.” The potential changes were discussed at the April 24 Morgan Hill Planning Commision meeting. Currently, the maximum height for buildings in the Highway Commercial zone is three stories or a total of 35 feet. In the Commercial Industrial zone, non-industrial buildings can reach 30 feet and industrial buildings can be up to 50 feet high. The new Zoning Code Update will require a second public hearing in June and if adopted, will become effective early July.
Hotels push litigation to Supreme Court
The California Supreme Court will decide another matter concerning hotels in Morgan Hill. On May 30, lawyers
from the city and Attorney Asit Panwala of the Morgan Hill Hotel Coalition will present arguments to the state's highest court regarding a January 2016 lawsuit alleging that the city violated California law when it decided to not put a proposed zoning change to the city's voters. "The Morgan Hill Hotel Coalition opposed the creation of instant wealth for an out-of-town developer whom the city sought to favor by a zoning ordinance," Panwala wrote in an email. "The voters agreed and asked to exercise their power to approve or reject the ordinance when more than 2,500 people signed the petition for a referendum. The city has fought against the Constitutional right of the voters.” Panwala hopes the Supreme Court will uphold the people's “right to exercise the power of referendum to local legislation." In an opinion piece that appeared in the Times last month, Panwala suggested the city’s effort to allow for taller hotels is a backlash to the existing local hotels’ case against City Hall.
We have identified hotel development as a key element to our future prosperity in Morgan Hill.

Vote ‘No’ on recall of Judge Persky
Rivas for Assembly
F
ive candidates are running for California Assembly District 30, and two have emerged as serious contenders to represent the region’s half million residents. The district includes south Santa Clara County and San Benito County and is currently represented by Anna Caballero, who is running for state senate. Gilroy Councilman Peter Leroe-Muñoz, a former San Benito County deputy district attorney who works in San Jose for the tech industry’s Silicon Valley Leadership Group, is running on a public safety and economic development platform. The Harvardeducated attorney has attracted contributions from the housing development industry, which is not surprising given his past role as a leading champion of one of the worst development schemes ever hatched for the South Valley: a 721-acre, 4000-unit plan that sparked a 2016 LAFCO lawsuit against the Gilroy and prompted voters to boot Gilroy Mayor Perry Woodward out of office and overwhelmingly pass an urban growth boundary. Leroe-Muñoz admits “we could have done a better job with the community” by getting information out earlier. He made the motion for the project’s approval after backroom deals had been cut by former mayors Woodward and Don Gage. San Benito County Supervisor Robert Rivas, on the other hand, seems to be in close touch with his constituents. When business leaders opposed a 2014 initiative to restrict oil drilling in San Benito County, Rivas went out on a limb. He took early leadership in the anti-fracking movement, which despite $2 million in spending by Big Oil, carried 59 percent of the votes and inspired similar laws in other California counties. Petrol purveyors have targeted Rivas with $320,000 in independent expenditures to portray him as soft on crime. While Leroe-Muñoz doesn’t appear to mind them raising the public safety issue, he says he doesn’t support fracking or other enhanced

On the June 5 ballot, Santa Clara County voters will be asked whether or not to recall Judge Aaron Persky, the judge who sentenced former Stanford student Brock Turner for sexual assault. I urge all voters to vote NO to the recall and here is why. Let me be clear, rape, sexual assault, domestic violence and similar offenses are wrong, illegal, and those who commit these offenses should be held accountable. The issue is whether Judge Persky acted in a way that deserves a recall. While many believe the sentence in the Turner case was too lenient, the sentence was lawful and followed the recommendation of the probation officer. The recall campaign claims that Judge Persky is an “outlier” in his sentencing and that his cases show a “pattern of bias” toward white, privileged athletes. These assertions are false. Jeff Rosen, the Santa Clara County District Attorney and Molly O’Neal, Santa Clara County Public Defender, both oppose the recall. They each confirm they never received one report, phone call or email complaining about the conduct of Judge Persky or heard any suggestion that Judge Persky ever acted with bias in any case. Had they received such a complaint, they would have taken action. The California Commission on Judicial Performance thoroughly investigated Judge Persky’s prior sentences and found no bias or misconduct. While Judge Persky presided over more than 2,000 cases, the recall campaign identified five cases they felt support a pattern of bias; that’s .25 percent or onequarter of one percent of Judge Persky’s cases. That is not a pattern! Four out of five of those cases were the result of a plea bargain between the DA and the defense. In only one case was the defendant an athlete (and he was African-American), and in only one case was the defendant white (and he was not an athlete). Finally, this recall threatens judicial Independence. Judges take an oath to follow the law and not to follow popular opinion. We do not want to politicize our judges. They are not politicians and should not give in to popular sentiment. This case has created a lot of emotion, but also a lot of misleading and inaccurate information. Get the facts at norecall2018.org and vote no on June 5. Swanee Edwards Morgan Hill
Let’s all go to the park
ROBERT RIVAS San Benito County supervisor.
As your District 1 County Supervisor, I am proud of the beautiful parks and trails in South County that are accessible to all residents, and I encourage you and your readers to explore what South County has to offer. The County, City of Morgan Hill and City of Gilroy invest in parks and trails for their economic, health, environmental and quality of life benefits. According to the Centers for Disease Control and Prevention, providing places where residents can be physically active can improve both physical and mental health. Chronic disease sufferers can greatly benefit from walking on local trails and spending time at our parks. Being outdoors can increase vitamin D levels, decrease blood sugar levels for diabetes, and reduce feelings of depression, thereby improving mental health. Parks and trails function as a hub for community members to meet for social events and recreational activities resulting in increased social cohesion, which strengthens our community. The South County United for Health Leadership Team—which I Co-Chair with Erin O’Brien, CEO of Community Solutions—is coordinating our second annual “Let’s All Go to the Park” initiative. Along with the City of Gilroy, City of Morgan Hill, Santa Clara County Parks, Santa Clara County Public Health, the South County Collaborative and the Gilroy Bicycle Pedestrian Commission, we have undertaken this initiative to promote parks and trails as destinations for physical activity and meeting other members of the community. Five free events have been planned in South County geared to all ages and fitness levels. Prizes will be provided for participation. I encourage residents to participate in these events. The first event is a hike on Saturday, May 26 at 9am at the Coyote Creek Parkway. This event will begin at the Park Visitor Center, 19245 Malaguerra Ave. in Morgan Hill, and be led by Santa Clara County Park guides who will provide information about local plants and animals. Taking steps toward better health as a community is important.
extraction techniques because of water supply contamination concerns. Rivas has run a campaign of diversity and inclusion, while Leroe-Muñoz has aligned himself with business interests. Rivas, who has raised more than twice the funding as his leading opponent, is endorsed by political arms of the state’s teachers, nurses and public employee unions; Leroe-Muñoz sounds alarms about CalPERS’ unfunded pension liabilities. A political science college instructor, Rivas believes the vibrancy of downtowns is important and sees Morgan Hill-style revitalization and high density housing as preferable to sprawl. While both have local roots and either candidate could competently represent this region’s residents in Sacramento, Rivas is more closely aligned with the sentiments of people who live in the district. He was on the right side of a defining issue in the county he represents, while Leroe-Muñoz was on the For information about “Let’s All go to the Park” wrong side of a watershed moment in the city events please visit https://spark.adobe.com/ page/QBHMd68OAVBt7/. where he holds elected office. We recommend a vote for Robert Rivas in Mike Wasserman Santa Clara County Supervisor, District 1 the June 5 primary.

Rivas’ ballot measure role stirred oil’s ire 30th Assembly, 1 2018. It’s the first time the industry has targeted a local official seeking higher office. Rivas was at the forefront of San Benito’s Measure J, which banned fracking in 2014 despite a $2 million push funded by large petroleum companies to defeat it. San Benito was California’s first county to enact a ban on fracking and associated oil extraction technologies, including acid well stimulation treatments and cyclic steam injection; a similar effort failed in Santa Barbara after the San Rafael law firm led a $7.6 million campaign funded by large petroleum producers. Monterey and Santa Clara counties both passed anti-fracking laws in the wake of the San Benito win. This year, there’s a push in San Luis Obispo County to enact a similar ban. Rivas is a Hollister resident who has been on the board of supervisors since 2010. His campaign decries the ads against him as misleading, negative and personal. Among other things, the ads criticize Rivas on public safety. Rivas is running against a fellow Democrat, former prosecutor and lawyer Peter LeroeMuñoz, as well as Bill Lipe, whose campaign is funded by agricultural interests in the Greenfield, San Ardo and Salinas areas. The primary is on June 5. Rivas opponent Leroe-Muñoz, a Gilroy councilman, is on the same page when it comes to the contentious extraction process. “I do not support fracking,” he says. Nielsen Merksamer attorney Steven S. Lucas is listed as the attorney of record for the political committee. He did not respond to phone calls and an email seeking comment. The Nielsen Merksamer firm was instrumental in helping defeat Santa Barbara’s Measure P, and the firm opposed the 2006 California Global Warming Solutions Act (AB 32), which aimed to reduce
the state’s greenhousegas emissions. “We advise our ballot measure clients on all aspects of campaigning,” the firm’s website reads, “from initiative drafting and filing, contesting ballot language and other pre-election litigation, observing and potentially contesting the final vote, and post-election substantive challenges.” Rivas was on the campaign trail over the weekend and says he’s not surprised at the petroleum industry’s moves against him. “That is unfortunately politics in 2018,” he says. “Being in this process for the first time, this Assembly seat is a regional office and it’s certainly been a unique experience, and it’s unfortunate that the oil companies have chosen to play dirty politics by attacking me personally with misleading attack ads and attempts to deceive voters. The fact that I took on the oil industry to protect the community against fracking—that’s why I am the subject of these attacks.” Rivas believes that the attacks on him will only further toxify a Sacramento political climate that’s fraught with divisiveness. “The civility question—it plays to a larger concern as to why people have very little faith, have very little confidence, in elected officials and government in general,” he says, noting that the energy lobby never met with him during the Measure J push. “They viewed my position against fracking as against their interests.” According to campaign materials, numerous officials, organizations and citizens have leapt to Rivas’ defense, including State Sen. Bill Monning, the Sierra Club and civil rights icon Dolores Huerta. “Robert Rivas took a bold stand against fracking in San Benito County,” said North Bay Assemblyman Marc Levine, who represents San Rafael in Sacramento and pushed for a failed statewide fracking moratorium in 2012, “and oil companies want him to pay a price.”
“Fortunately, voters will have the last say.” Rivas opponent Leroe-Muñoz also addressed the petroleum industry campaign against Rivas in an interview this week. “Obviously it’s an independent expenditure, so we have no coordination with them,” he says. Citing his law enforcement background, he says, “I can’t speak to what their thoughts or motivations are, but I think that what is important is that they are raising an issue around public safety. That’s an issue that many residents have raised with me in the district.” The petroleum industry committee paid for a recent mailer which “addressed that issue in particular around Robert and public safety and cuts that he made while he was on the board of supervisors,” says Leroe Muñoz. The Gilroy councilman has raised $80,898 in contributions, according to the contribution database on the California Secretary of State’s website, though Leroe Muñoz estimated his raise at $140,000 in a Tuesday interview. Supervisor Rivas has brought in $451,432, according to state filings. Lipe has collected $93,537 and contributed $55,000 of his own money to his campaign. Leroe Muñoz, who supported a failed 2016 effort to develop 721 acres of North Gilroy farmland into a 4,000home development, has received contributions from Gilroy development services firm Ruggeri-Jensen-Azar & Associates, Summerhill Homes CEO Joe Head, Gilroy concrete firm owner Don Alvarez, Gilroy residential developer The James Group and Peninsula developer Skip Spiering. Rivas draws much of his support from public employee unions, including teachers, nurses and municipal employees. Other contributors include state trial lawyers’ groups, Yelp CEO Jeremy Stoppelman and former Palm Inc. CEO Donna Dubinsky.

Board backs tax funds for charter Parcel Tax, 1
He said the plan might have taken a different path if it included the charter schools. The May 15 surprise was not the first time the board has gone against the district staff ’s recommendation when it comes to charter schools. In December 2017, the board supported CSMH’s Proposition 51 application for state rehabilitation funds against the district’s wishes.
Charter support considered crucial
Gerard said he had met with Voices representatives and believed they wholeheartedly were sincere in wanting to work cooperatively with the district to help pass the parcel tax measure. He also claimed to have met with seven trustees from other area school boards who all told him that the parcel tax would not pass if the district did not include some funding for charter schools. “We need more money for education in California.
MorganHillAd10x13.indd 1
Let us work together,” Gerard said. Arnett and Patterson initially said it seemed too late in the process to include charter schools in the parcel tax, although they were in favor of doing so in future measures. However, when Gerard made a motion to include the charters that was seconded by Murillo, they approved it. “I wish we could rewind the clock to go back and include the charter schools of Morgan Hill in (earlier) discussions,” said Arnett, who admitted to being “a bit frustrated” by the predicament. “Given the fact that conversations are just coming up now, my recommendation would be to move forward with the parcel tax as it is now....(and) amend other tax revenue measures (to include charters).” Patterson suggested they start planning right away for another parcel tax in 2020 with charter schools involved from the very beginning. Even Borgioli, who was on board with including
charters in the 2018 version, believed the district’s resolution was set to pass despite the extended dialogue amongst Voices supporters. “I believe there are four trustees who are willing to go forward with this parcel tax even after all this dialogue (to include charters),” said Borgioli, who tried to call the vote for the existing resolution. “For me, I’ve heard enough. There’s no going back. There’s only moving forward.” The hour-plus debate on the parcel tax began with impassioned speeches from more than a half dozen parents of students at Voices, which is a county-authorized charter school in Morgan Hill, and continued with back-and-forth from trustees on both sides and district staff wanting to move forward as planned. “I feel very excluded from this tax. My child won’t benefit from it,” said Victor Rodriguez, a Voices supporter. “I just feel excluded like we’re forgotten. Everyone here is
really sad that we weren’t included.”
Changes will cost extra money
Following the board’s vote May 15 to change directions right away, district staff explained they would have to discuss the change of parcel tax plans with legal advisors before another parcel tax resolution could be drawn up for the board to vote on. They also want to meet with the charter school leaders to iron out details as far as administrative regulations of allocating the funds and recouping a portion of money already spent by the district and ongoing costs for the parcel tax from the charters if they want to receive their annual share. If successful, the property tax is estimated to generate $1.5 million annually for five years. Gerard convinced the board that around 9 percent of money that comes in should go to the charter schools based on their enrollment of Morgan Hill students.
The four key areas where the tax funds will be used, described on the resolution, are: • Core academic programs that focus on skills like science, technology, engineering and math; • Ability to attract and retain quality teachers and staff; • Programs to help children with special needs; and • Programs focused on the arts. Patrick Walsh, a regional director with the California Charter Schools Association who addressed the MHUSD board May 15, said the charters would use their cut of the funds for the same reasons. CSMH Executive Director Paige Cisewski did not comment during the meeting but sat with Walsh during the proceedings. Jim Carrillo, the district’s director of technology who headed up the parcel tax committee and led the presentation,
said the parcel tax polling and consultant advice they received accounted for “programs specific to our district.” He noted that other districts did not include charter schools in their initial parcel tax measures, but added them to later measures once they were established. “We will be going for a larger parcel tax in the future and for a longer time (than five years) so we could include the charter schools in that,” Carrillo said. Betando said he met with Voices families the week prior and, through those discussions, suggested to the parcel tax committee to include the passage, “Even though charter schools are not included in this parcel tax, the Board of Education will reevaluate whether or not to consider including charter schools in the future.” The next board meeting is scheduled for June 5.

MORGAN HILL TIMES
Tour places MH on world stage Agmen, 1
The TOC time trial also reinforced Morgan Hill’s image as a den of cycling enthusiasm—an image that was established long ago as Specialized grew into an international industry behemoth. “There’s a lot of bike enthusiasts in Morgan Hill, which was evident by the amount of people here enjoying the event,” said Mayor Pro Tem Rich Constantine. “We’ve gotten a lot of positive feedback.” Constantine noted that the city has received a handful of complaints from residents who live along the May 16 time trial route and were unable to pass freely in and out of their neighborhoods. He also offered thanks to the City of San Jose Sports Authority for partnering with Morgan Hill to host the May 16 time trial. Some downtown businesses on Monterey Road took advantage of the TOC time trial to attract customers, promoting their outdoor dining areas as prime race watching areas for spectators. Rosy Bergin, owner of Rosy’s At The Beach restaurant near the corner of Monterey Road and Third Street, rented a section of bleacher seats, which she placed in the dining area just outside her front door, facing the final stretch of the time trial course. The restaurant developed a “bleacher menu” containing items that outdoor diners could eat from their laps while they watched the cyclists. Local tourism proponents also expected hotels to rake in the sales for the May 16 time trial, which featured cyclists from all over the world. All 85 rooms at the Holiday Inn Express on Condit Road were booked the

to commuters, residents and visitors. Spectators lined the fenced-off closing and opening stretches of the time trial route on Monterey Road as individual cyclists embarked from and—typically less than 45 minutes later—made their approach to the downtown. All five of the city’s council members participated in the time trial’s opening and closing ceremonies. A children’s choir from St. Catherine school sang the national anthem. Before the event, city officials and local business organizations anticipated a windfall of both immediate sales at local establishments related to the May 16 event, and a long-term impact from worldwide exposure the race brought to Morgan Hill. Chamber of Commerce Executive Director John Horner said businesses are still trying to gauge the economic impact of the May 16 time trial. “Our local bike oriented companies were over the moon,” Horner said, referring to Morgan Hill-based Specialized Bicycle Components and new downtown shop Bike Therapy. “They did a lot of the work to help put the logistics together. For visibility, it’s great to have positive news about Morgan Hill. From an advertising and marketing (perspective), it was clearly a win. Some (business owners) say sales were great, some say it was just another Wednesday.” Chamber officials added that the “Bike Week” events in Morgan Hill preceding the May 16 time trial were also popular, and they will encourage a repeat next year even if the TOC does not return to town.
THE WINNERS The top three finishers in the May 16 TOC time trial were Tejay van Garderen, Patrick Bevin and Tao Geoghegan Hart. night before the time trial, according to owner Ashis Roy. Those rooms were going for $150-plus per night. On stage at the end of the time trial, after American cyclist Tejay van Garderen was declared the stage winner, Tate said on stage that it was the city’s “wonderful economic development person,” Edith Ramirez, and
her fellow city staff that made the high-profile event such a breeze for TOC organizers. Van Garderen—who also took the “yellow jersey” May 16 identifying him as overall TOC leader at the end of the time trial—counted a giant bottle of local Guglielmo wine among his prize winnings. In January, Amgen selected Morgan Hill
as the “host city” for the Stage 4 time trial. The city council agreed to host the event, in partnership with the City of San Jose, and ponied up $40,000 to assist with traffic control and road closures during the May 16 stage. The seven-stage TOC started May 13 in Long Beach and concluded May 19 in Sacramento. Egan Bernal of Colombia was

Special to the Times
Morgan Hill resident Kayla Womach, a ninth grader at Valley Christian High School, (second from left in photo) was part of a four-person team to win the President’s Business Challenge, a Business & Entrepreneurship Initiative at the San Jose private school. Her team won money totaling $1,000 for the team. The winning team was announced at the annual BEI Banquet, which was held May 5 at Valley Christian High School. Through the BEI, students not only learn core business concepts through school-day courses, but are also given the chance to apply what they learn through numerous business programs, according to the school.

NOTICE TO POTENTIAL BIDDERS: If you are considering bidding on this property lien, you should understand that there are risks involved in bidding at a trustee auction. You will be bidding on a lien, not on the property itself. Placing the highest bid at a trustee auction does not automatically entitle you to free and clear ownership of the property. You should also be aware that the lien being auctioned off may be a junior lien. If you are the highest bidder at the auction, you are or may be responsible for paying off all liens senior to the lien being auctioned off, before you can receive clear title to the property. If no street address or other common designation is shown, directions to the location of the property may be obtained by sending a written request to the beneficiary within 10 days of the date of first publication of this Notice of Sale. AERIAL SHOW Kaitlyn Lyle, a Sobrato High sophomore, recently made the Junior Olympics competing at Level 10 in gymnastics. It was the fourth consecutive year that Lyle made the Junior Olympics at Level 10, which is just one stage below the Elite level where many mimic professional manuevers. GYMNASTICS
Sheer, utter brilliance SOBRATO HIGH SOPHOMORE DOWNRIGHT SPECTACULAR emanuel lee Sports Editor
Gymnast Kaitlyn Lyle practices 24 hours a week—no, that’s not a typo—in a sport that punishes the body. Yet somehow the Sobrato High sophomore manages to balance academics and a crazy sports schedule and excel at a high level in both. Lyle is coming off another solid performance in the Junior Nationals, the fourth consecutive year in which she’s competed in the event at Level 10, which is just one level below the Elite stage.
“The fact that she’s made it out of our region one—which is the toughest of eight regions in the country—is really impressive,” said Krystal Van Buuren, who is the co-coach of Airborne Gymnastics in Santa Clara, where Lyle trains. “Kaitlyn is one of the most genuine, hard-working kids I’ve ever had the pleasure of coaching, and she’s also a super great leader within the program, which is nice to see.” The 16-year-old Lyle loves competing with the best of the best, meaning she had a terrific time at the Junior Nationals, which took place in Cincinnati two weeks ago. To qualify for the Junior Nationals, Lyle had to get through the state stage—where she placed first in the bars, beam and floor to take third overall— before competing in the regional round.
Lyle placed first on the bars and finished fifth overall in the tougher regional round before taking 10th on the bars at the Junior Nationals. “Seeing everyone competing at the highest level was super cool,” Lyle said. “It was the best of the best. I always try to go out there, have fun, get a personalbest score and ultimately place. I placed in the top 10 on the bars and got one of my better scores of the season on the vault, which was great.” Lyle said she had perhaps her best performance of the season in the state championships, where she scored a 9.75 on the beam, 9.65 on the bars and 9.65 on the floor. After the state championships and Junior Nationals, Lyle had a feeling of peace and contentment, knowing she had put the work in and
did all that she could to score at an optimum level. “The feeling was kind of surreal,” she said. “It’s super rewarding and makes you realize all of the hard work does pay off and is worth it.” One of the great moments in Lyle’s gymnastics career occurred at the California Grand Invitational in January, when she scored a 9.6 on the vault doing a variation of the Yurchenko vault. “It’s a style of vault when Kaitlyn was younger, she flipped that vault into a pike or tuck position,” Van Buuren said. “But now that she is a little bigger, she’s doing a layout full twist, which is hard to do when you’re not super powerful. Kaitlyn is pretty tiny, so the power events have taken a little longer for her to develop, although she’s
definitely gotten there. Because she is so petite, she had to essentially grow to gain that power to be able to do that vault.” When Lyle completed the Yurchenko vault for the first time in competition at the Grand Invitational, both Lyle and Van Buuren had tears of joy as they embraced. “It was such a great moment,” Van Buuren said. “Because every event you start at a 10, but when you don’t have the difficulty level (and certain required elements), you don’t start off on a 10. So she started off on a 10 in this event, and the last time she was able to attain this was when she was at Level 7. For her to be able to attain this year at Level 10 is awesome.” Lyle also scored a 9.875 on the beam—“She’s always kind of ➝ Lyle, page 22

Signing the championship banners
Robert Eliason
On Monday, Sobrato High School had its first-ever championship banner ceremony event dedicated to all of the teams that won league championships in the calendar school year. Members of the Bulldogs girls cross country (pictured right) squad penned their signatures that eventually will go on the back of the championship banner that will hang in the gymnasium. Other Sobrato High sports teams that won league championships in the 2017-2018 school year included the football team, girls basketball team, wrestling and the swimming and diving team, which recently concluded its season. All of the Sobrato teams competed in the tough Blossom Valley Athletic League.

Kaitlyn Lyle driven to succeed in punishing sport Page 21
this doesn’t leave Lyle much time—if any—to do simple things like hang out with friends. Lyle’s body, like every competitive gymnast, takes brutal punishment. All of the things a gymnast is required to do produces plenty of wear and tear on the body, and Lyle isn’t immune to the hazards of the sport. “A lot of my body is hurting all the time,” she said. “By the end of the season, we get a week off to help revive you. The coaches are really great in taking care of us and modifying our workouts when needed.” There was a time when Lyle competed at the Elite level; however, when one goes down that route, they often have to get homeschooled because the time and travel demands make it ultra difficult to go the traditional school route. “She practices 24 hours a week, and the elites typically go 32 hours a week,” Van Buuren said. “She came to the realization she really wanted to focus on school and do well at Sobrato. She didn’t want to leave school.” Lyle has earned straight A’s since her freshman year, and plans on taking three or more Advanced Placement classes for her junior year. Making Lyle’s accomplishments all the more impressive is the fact she has scoliosis, which is a sideways curvature of the spine. She also has an extra bone in her back and injured her back last year. “I’m still trying to recover from it,” she said. “I have to go see a chiropractor and was doing physical therapy for a
while. My bones are compressed, and it looks like they’re wearing down.” Whenever things get tough, Lyle thinks about her teammates and the bigger picture to keep persevering. “My mindset is to think about my goals and my teammates, who are always there to support me,” she said. “They all know we go through this together, and having a support system like this is very important. My teammates help me get through the toughest moments.” Lyle plans on earning a Division I scholarship, and achieve at a high level in college. At that point, Lyle feels she’ll be ready to call it a career gymnastics-wise. “After four years of doing college gymnastics, I feel my body will need a break,” she said. It takes incredible agility, athleticism, strength and discipline to compete as a Level 10 gymnast, and Lyle possesses all of those characteristics. One look at her performances—which are accessible on YouTube— and one can’t help but be impressed by her sheer skill and balance in all the disciplines, especially the beam and bars. “My friends are impressed whenever they see the videos of me on the bars,” Lyle said, when asked if she received looks of awe from her friends upon them seeing her in action for the first time. “Whenever I show them videos on the bars when I release the bar and catch it again, they think it’s the most amazing thing ever.” The road to a college

been the beam queen,” Van Buuren said—at the Spirit of the Flame Invitational in Febrary, which established an Airborne Gymnastics program record at Level 10. Lyle also owns the program record for the highest score on the bars (9.825), which she set at the Pikes Peak Invitational in February. Lyle has three of the top 100 scores nationally, one on the bars (9.825) and three on the beam (9.75, 9.8, 9875). “My favorite event is probably the beam because I’ve always felt confident on it,” Lyle said. “I’m pretty brave when it comes to the beam. A lot of girls are restricted because they’re so nervous and fearful, but for me, that’s never been the case.” Lyle started doing gymnastics at age 7, inspired by seeing her older sister, Kiara, doing flips and cartwheels around the house. Kiara eventually chose diving over gymnastics, and she’s currently diving for Cal PolySan Luis Obispo. Kaitlyn’s schedule makes one wonder how she gets through a day, let alone a year. Lyle practices six days a week for 4 ½ to 5 hours a day. A typical day consists of Lyle waking up at 7 a.m., attending school and immediately heading off to practice, which usually ends around 8:30 p.m. Lyle gets home at 9:15 or later, upon which she starts her homework in the hope she is in bed by 12:45 a.m. Lyle only takes a week off after the Junior Nationals and a couple of other days off here and there throughout the season. As you can imagine,
HIGH FLYER Kaitlyn Lyle performs earlier this season in what has been a stellar year. gymnastics scholarship is filled with obstacles and adversity. However, Lyle seemingly has all of the physical tools and mental mindset necessary to get there. The sacrifices she
makes are huge; however, Lyle knows there are some things in life worth fighting for in a big way—and gymnastics is one of them. “Ultimately, if I want my goal to come true, you
have to sacrifice hours and time with friends in order to make my dream become a reality,” she said. “Making a college gymnastics team is the most important thing for me.”
