In 2017, Shirley Higdon and her neighbor Diane Holmes realized the High Speed Rail train that had been endorsed by Californians a decade earlier might be running right through their quiet street close to U.S. 101. The two women, along with a small group of neighbors, took to Facebook and began organizing a larger coalition of Morgan Hill residents that opposed the state’s bullet train project. They called their group, “Stop HSR in its tracks—Morgan Hill.” A plan to run the High Speed Rail parallel to U.S. 101 is one of three alternatives proposed for the “San Jose to Merced project section.” The High Speed Rail

The bar has been raised at Paradise Valley Engineering Academy, where new principal Julie Page came aboard with credentials that include leading the top-scoring school in

the state while working in Cupertino. Page, who brings nearly a quarter-century of education experience as a teacher and administrator in local districts including Cupertino, Saratoga and Aptos, was out greeting families as they arrived on the LaCrosse Drive campus in southwest Morgan Hill for the Aug. 16 first day of school. Along with Paradise

Valley, it was opening day for Morgan Hill Unified School District’s 13 elementary, middle and high schools. “I live in Morgan Hill, so this is my dream come true to get this opportunity,” said Page, an Aptos transplant who fell in love with the local community after moving here several years ago. Page thinks Paradise Valley is the perfect match for her after coming from a “21st-century

technology-focused school … This engineering focus is fabulous for me.” With a strong background in Project Based Learning, Page—who is enjoying the view out to the fourth- and fifthgrade courtyard area from her principal’s office perch in the new administration building—foresees a continued integration of engineering and computer design into the existing curriculum.

Paradise Valley has 420 students, enrolled in grades K-5, and returned 17 teachers to the faculty. The domestic violence case against Morgan Hill City Councilmember Larry Carr was dismissed Aug. 20, after the alleged victim refused to answer questions under oath during a brief bench trial.

After Superior Court Judge Jacqueline Duong announced her ruling, prosecutors acknowledged they couldn’t prosecute Carr without the woman’s testimony. “We evaluate every case based solely on the evidence we can present in a courtroom,” Santa Clara County Deputy District Attorney Vishal Bathija said after the Aug. 20 trial. “Often we can and do proceed with a prosecution even when a victim

refuses to testify. Unfortunately in this case, the weight of the evidence rested in the testimony of the victim. Because the victim refused to tell the judge what happened on the night of Nov. 25, 2017 or during the 2015 incidents, we could not prove the charge beyond a reasonable doubt.” Carr, 49, waived his right to a jury trial on the charge of misdemeanor domestic battery, which the D.A.’s Office filed

against him in relation to a November 2017 incident with Barbara Ristrim, his live-in girlfriend at the time. The Aug. 20 trial was a bench or court trial, a proceeding in which the judge is tasked with weighing the evidence and testimony, and determining the defendant’s guilt or innocence. Carr pleaded not guilty to the charge at a previous hearing. The alleged battery took place at the home

Just before Carr was arrested the night of Nov. 25, Ristrim told police that Carr had broken her glasses and pulled her hair during the argument. We’re going to have a great year.” The seasoned administrator comes in the midst of a $7 million campus upgrade project that has lingered into the start of school but is expected to be

finished by the end of September. The school recently received a silver recognition from the California PBIS (Positive Behavioral Interventions and Supports) Coalition for its intervention and support systems, according to Page. “A school this size, you can have a personal connection with every child. It’s a perfect size and I’m looking forward to that,” said Page, who encouraged parents to get involved with Project Cornerstone and the Home & School Club. “I really want to welcome parents onto campus.”

Is Gilroy the county homeless capital? When I moved to Gilroy it was known as the Garlic Capital of the World. What I didn’t know is that it would become the per capita Homeless Capital of Santa Clara County. It appears we are starting the buildup of demand that requires more infrastructure and services for homeless. A reasonable response is that we should build support systems for that demand and then the system grows on its own, and it never goes away. Please know that a homeless infrastructure is already being built with low-income housing that can become section 8 housing, free transportation and more. Another factor is that our police chief has requested funds for an officer and/ or a social worker that deals only with homeless issues, but there is no funding for such an officer. This means that Gilroy is growing a homeless population and has no officers to deal with the issues created by this population. One possibility is for Gilroy to pay more taxes to accommodate more police to deal with homeless issues. Another possibility is for Gilroy to adopt the same aggressive policies and practices used by more affluent cities to reduce the likelihood a homeless person will reside here, and having a target number of homeless in mind. So what is a reasonable homeless population target? There are 7,394 homeless in Santa Clara County, 1,918,000 people in Santa Clara County and 48,821 people in Gilroy, so our fair share should be 188 homeless, instead of the 722 we currently have. This means we should limit services to accommodate to only 188 homeless using business licenses, permits and such. With

only 188, Gilroy can provide a higher quality of care for those who are here rather than overburden our services. Our police department is overworked as it is. Police officers are working overtime and that is not enough to handle our crime and they are under-appreciated for that effort. Adding a burden to their work load only endangers our community. According to the homeless survey, 1 in 4 homeless people will spend a night in jail next year. If the homeless population is reduced by 500, that will remove 125 arrests needed to be made by our GPD and Gilroy will be a better community for it. I don’t have all of the answers, but clearly something can be done, to be more proactive with our city-wide policies. Elected officials who support expanding services should be removed from office. Some churches offer free meals and they should be responsible for the human waste created by those free meals, if it is deposited around the community. Events to feed the homeless should require a permit and that permit should require facilities. Think about it. Would you go to a Gilroy Garlic Festival if it didn’t have any toilets available? This is a health and safety issue. Like you I have supported some homeless support organizations that include the Second Harvest Food Bank. That organization supports several others that have direct contact with the elderly, disabled, meals on wheels and the homeless. I don’t like seeing anyone go hungry, but that is not the point. The point is right-sizing our efforts to match our community’s size and capacity. Gilroy should not be a dumping ground for other city's homeless.

Counties eye more passenger trains SALINAS-TO-SJ ROUTE THROUGH GILROY IS PLAN IN MONTEREY By Barry Holtzclaw Managing Editor

The 40-year dream of restoring passenger rail service—stoked by increasing population and traffic congestion—from Gilroy south to Salinas and/or Hollister has found new life in two counties. Monterey County officials this week began construction of an $81 million project to build a new train station and other railroad upgrades, which they claim could bring daily railroad service to Gilroy and the Bay Area by 2020. Meanwhile, San Benito county transportation officials this spring received a $150,000 grant for an “indepth feasibility assessment of public transit projects, including passenger rail, to help reduce congestion along Highway 25.” One problem: No

railway company has committed to, or even expressed an interest in, providing the rail service. The Capitol Corridor Joint Powers Authority, which contracts with BART to operate rail service between Sacramento and San Jose, is the latest favorite of the Transportation Agency of Monterey County for the San JoseGilroy passenger rail. Caltrain, the initial choice, told the Dispatch this week, “There has been no commitment made that Caltrain would be responsible for operating the service” from San Jose to Salinas through GIlroy. Six Caltrain trains— three northbound in the early morning commute and three southbound in the evening commute— currently connect the Bay Area to and from the Gilroy station, with stops in San Martin and Morgan Hill. Some folks may still remember the last passenger train to stop in Hollister at the Fifth Street depot, on Oct. 30, 1955. The Gilroy-to-Hollister

rail route opened in 1871. The old train station since 2007 has been the home of El Epazote Restaurant. WIth much fanfare, Monterey officials held a groundbreaking ceremony Aug. 9 at the Salinas Train Station to celebrate “the Monterey County Rail Extension–Kick Start Project” to extend passenger rail service from Santa Clara County to the City of Salinas. “The project will provide an alternative to traffic congestion, thereby reducing commuter stress and increasing productivity. The extension will provide access to jobs, health care, education and shopping, and expand transportation options for the young, elderly and disabled,” touted the Monterey agency in a press release. The event was cited as “an unprecedented collaboration of state and regional transportation agencies, along with local jurisdictions.” The proposed route would follow Union Pacific tracks that roughly parallel state Highway 129.

The lone Amtrak train, the Coast Starlight linking San Diego and Vancouver, follows this route—northbound in the early evening and southbound midmornings. This is the closest passenger train to Hollister, but the San Benito Council of Governments will be studying its own possible Caltrain extension. A Tres Pinos branch line of this rail route extends east past San Juan Bautista to Hollister. The Union Pacific is the main rail freight system in the region. One Salinas city councilmember last week said that Monterey officials would also be reaching out to Union Pacific as a possible provider of the new passenger service, but the railway stopped all of its passenger trains in the U.S. in 1971. Plans to link either the Capitol Corridor, which now ends in San Jose, or Caltrain, which now ends service at Gilroy, could be in place “optimistically by 2020,” said Christina Watson of the Transportation Agency for Monterey County. Originally, the project was to extend Caltrain to Salinas, according to Monterey County officials. Then the plan changed to extending the Capitol Corridor train, which connects Sacramento with San Jose. Another project in the mix is the California High Speed Rail, which would reach from Gilroy to Merced, then to Los Angeles. Caltrain, along with many other regional rail

operators and the state, has been involved with planning efforts to establish rail service between Monterey County and the Bay Area. However, there has been no commitment from Caltrain to be responsible for operating the service. “The Transportation Authority of Monterey County has been working on this effort for many years, but the effort is still in its infancy and no operator has been identified,” Caltrain said in a statement this week in response to inquiries from the Dispatch. “Significant planning, capital improvements, actions and agreements involving many parties would be required before any service could be considered for operation. As a key part of the region’s rail network, Caltrain staff will continue to participate in these discussions.” The Council of San Benito County Governments and San Benito County Local Transportation Authority, which oversees San Benito County Express, received a $150,000 competitive SB1 transportation planning grant award from Caltrans. The funds will be dedicated to an in-depth feasibility assessment of public transit projects, including passenger rail, to help reduce congestion along Highway 25. Highway 25 is highly congested during weekday commute hours due to the large number of residents commuting to Santa Clara County. The average daily

traffic at the San Benito/ Santa Clara county line has more than doubled since the mid-1990s due to rapid population growth and commute trips, and is expected to double again by 2040. Supes favor ban on pot cultivation PROPOSED BAN WOULD AFFECT UNINCORPORATED AREAS Jaqueline McCool Reporter

California voters may have approved the legalization of cannabis, but the Board of Supervisors in Santa Clara County, the state’s sixth-most populous county, has dropped plans to extend a moratorium on growing or selling cannabis, and instead is set to vote to ban pot growth altogether. A temporary moratorium on the cultivation and sale of cannabis in unincorporated areas of the county imposed in 2017 ends Sept.12. Janice Rombeck, communication officer for Supervisor Dave Cortese, said supervisors will vote on the permanent ban Aug. 28, with a second reading on Sept. 11. It would take 30 days for the ordinance to go into effect, meaning there would be a brief period between the moratorium expiration and the permanent ban. “No one expects that gap to have an impact on illegal cultivation,” said Rombeck. Four of five supervisors would need to agree to extend the moratorium, but approval of a ban on cannabis sale and cultivation would require just three votes. After Supervisors

Cortese and Ken Yeager voted on Aug. 14 against extending the moratorium, the other supervisors decided to move forward with the ban. In response to questions about the upcoming vote, Supervisor Mike Wasserman, whose District 1 includes Gilroy and Morgan Hill, wrote in an email, “This all comes down to the health, safety and environmental concerns surrounding cannabis cultivation in unincorporated county areas. We recently had to increase funding for the Sheriff ’s Office to combat illegal grow operations, especially in the Santa Cruz Mountains.” Cortese released a public statement following his vote voicing his concern over a permanent ban. He said in an interview that he originally worried about extending the moratorium another year because he felt no progress had been made in understanding how to regulate cannabis in Santa Clara County. A memorandum given to the supervisors on Aug. 14 outlined research conducted by staff on how to regulate cannabis. Cortese says the research did not ultimately provide any pathways for regulation. He felt the staff had simply outlined a path to banning cannabis all together. Cortese believes a complete ban on pot in Santa

Clara County will fail to keep communities safe. “To me that’s sticking your head in the sand,” said Cortese. Cortese said he believes there is no research to suggest a ban would help make cannabis use safer or prevent illegal growing. “It’s going to put us in a position of looking like we’re Nancy Reagan,” he added. What Cortese really wants is more direction by the supervisors for research on regulation. He says that the way things are now, moving forward with a ban would be “letting the criminals control how it’s dispensed.” To reverse a ban would require a supervisor who had previously voted in favor of it to second a motion to overturn it. A second ordinance would then have to be introduced, which Cortese said is unlikely unless there is a political shift on the board. However, he did identify District 2 Supervisor Cindy Chavez as the most likely to change her position. Chavez said there was a split among supervisors when it came to reacting to new cannabis laws: Cortese and Yeager, who do not support a ban, and Joseph Simitian and Wasserman, who favor a ban. “There really are two strong minds on the board,” said Chavez. Chavez said, “my feeling is there is no risk to getting more information and see how other communities are addressing the concerns raised.” Chavez said she couldn’t say that cannabis would never be allowed in

unincorporated Santa Clara County and made it clear a ban could be overturned. Supervisors cited a report that the Santa Clara County Sheriff’s Marijuana Eradication Team had seized 5,793 illegally grown marijuana plants in the first five months of this year. Cortese said the best way to deal with cannabis in the county would not be an all-out ban, but with regulations to prevent black market sale and cultivation of the crop.

Bathija said after the trial that prosecutors had issued subpoenas ordering multiple witnesses to testify, including Morgan Hill Police officers who responded to and investigated the November incident. However, without Ristrim’s testimony, the D.A.’s office couldn’t make the case that Carr committed the crime of domestic battery. In 2015, Carr pleaded no contest to a misdemeanor charge of domestic battery. That conviction was related to a March 2015 incident, also involving Ristrim, at the couple’s previous home in Morgan Hill. Carr completed a 16-week counseling program as his sentence for the 2015 conviction. Carr has also denied

acting violently in that incident, and said he pleaded no contest to avoid prolonged court proceedings. Outside the courtroom after the Aug. 20 trial, Carr said he and Ristrim have supported each other throughout the court proceedings related to the November 2017 incident. “From the beginning we have asked for patience and privacy for Barbara and I,” Carr said. “We’re trying to move on now and get this behind us.” Carr’s attorney, Stuart Kirchick, added that Carr is glad the case is over with so that he can continue to “serve the people of Morgan Hill.” Carr is currently in his fifth term as a Morgan Hill councilmember.

A motorcyclist died after

colliding with a tractortrailer in a Morgan Hill traffic accident during the afternoon rush hour Aug. 17, according to the California Highway Patrol. Authorities identified the motorcyclist as Vanessa Rodriguez, 30, of Sunnyvale. The accident occurred

about 2:21pm Aug. 17, when Rodriguez was driving a black Honda Rebel motorcycle at an unknown speed, southbound on U.S. 101 just north of Cochrane Road, according to the CHP. As the motorcycle approached the Cochrane Road exit, Rodriguez was

splitting traffic by traveling between the two lanes on the right side of the freeway, police said. For an unknown reason, Rodriguez lost control of the motorcycle and collided with the left side of a trailer pulled by a 2015 Freightliner big rig. The truck was traveling in the far

right southbound lane of U.S. 101. The collision caused Rodriguez and the Honda motorcycle to slide under the Freightliner’s trailer. Rodriguez and the motorcycle became entangled with the trailer’s rear axle, and were dragged for about 100 yards before the truck

came to a stop, according to authorities. Paramedics who responded to the emergency attempted to render aid to Rodriguez but were unable to revive her at the scene, police said. Authorities do not think alcohol or drugs were a factor in the collision.

On Aug. 14, two meetings were held in the Morgan Hill City Council chambers, spearheaded by the Chamber of Commerce and led by the High Speed Rail Authority. Newly appointed Northern California Regional Director Boris Lipkin presented the authority’s 2018 business plan and new alternative for a “blended track” using existing Union Pacific Railway tracks through downtown Morgan Hill, along Depot Street. The meetings also served as a forum for community members. Lipkin identified three alternatives for the section of the rail line through Morgan Hill that will be part of an 84-mile line connecting San Jose and Merced. The first option is an embankment that would run parallel to the existing rail line. The second is a viaduct, or raised platform proposal, that would sit west of U.S. 101. Union Pacific Corridor and electrify the tracks that CalTrain would be able to use along with the High Speed Rail. The newest alternative is known as the blended plan because it blends track uses. With the blended plan, the train would slow to 110 mph in the Union Pacific Corridor, although it will be capable of going upwards of 200 mph. Lipkin explained that as the alternatives continue to be explored and a partnership with Union Pacific is worked out, plans on all three routes will be presented to the High Speed Rail Authority. The group will pick one preferred route in September 2019. November 2020 will see the final Environmental Impact Report, following the public review period, which will address mitigation plans for the prospected route. Following the selection of the plan, the Right of Way Authority, part of the High Speed Rail Authority that deals with property acquisition, will identify properties in the line of the bullet train. Notices are planned to go out after the alternative is chosen, as early as 2019.

The Right of Way Parcel Acquisition Plan states, “Once properties are identified as necessary for the project, the Authority issues the Notice of Decision to Appraise on parcels which are to be acquired.” It was the viaduct option that had first alarmed Hidgon, Holmes and their neighbors. They had originally envisioned the rail running up the middle of U.S. 101 or along Highway 5. While the blended plan appeased Hidgon, Holmes has remained skeptical. While she thought the blended route would be the least impactful to Morgan Hill neighborhoods, she’d wondered how the blended route is feasible. “It doesn’t make sense all the way around,” said Holmes. The High Speed Rail in California dates back to Gov. Jerry Brown’s first time in office, in the 1980s. M

yrtle Irene Tenney Mousley of North Bend, Oregon, passed away peacefully in her home on Thursday, August 9, 2018 at the age of ninety-four. Irene was born November 15, 1923 in Virden, New Mexico to Nathan Cram Tenney and Myrtle Payne Tenney. She grew up in Virden, the eleventh of eleven children in the family.

Irene graduated from Virden High School. She attended New Mexico State Teachers College in Silver City, New Mexico. She was also a student at Los Angeles City College and LDS Business College in Salt Lake City, Utah. After serving a proselyting mission for The Church of Jesus Christ of Latter-day Saints. Irene married Woodrow Vernon Mousley in the Salt Lake Temple on April 7, 1952. Irene and Woody moved to Morgan Hill, California where they raised their six children: David, LeeAnn (Lani), Michelle (Shellie), Lori, Chris, and April. Irene worked as a very busy homemaker and mother. Woody taught school, ultimately becoming a professor at San Jose State University. After thirty-five years in Morgan Hill, Irene and Woody moved to Kansas City, Kansas and then to North Bend, Oregon. Irene’s husband, Woodrow, passed away on August 14, 2002. Since that time, Irene has lived in a home next door to her daughters, Lori and April. Irene was an avid reader and a gifted writer. With her husband, she wrote and published three biographies. Irene also edited and published another biography, a selection of poems written by her son, David, and following Woody’s death, wrote a descriptive history of Woody’s violin making, with pictures, entitled For Remembering. Irene was a journal keeper, with over twenty-five handwritten diaries and numerous typed entries. Until recent months she continued to write, organize, and compile her journal entries. She loved to correspond with family and friends through telephone calls, letters, and emails. She went to great efforts to locate and communicate with friends from her past. Irene loved classical music and opera. She attended opera performances over the years in many cities, including Los Angeles, New York City, London, and Milan, Italy. Irene was an active member of The Church of Jesus Christ of Latter-day Saints. In her twenties, she served as a full-time missionary in the Central States Mission. She served in leadership and as a teacher in the Primary, Young Women, and Relief Society organizations. At the age of eighty she was called to serve as the Relief Society President. Irene was preceded in death by her husband, Woodrow, her parents, David Woodrow Mousley (son), Shellie Weed (daughter), brothers: Walter Tenney, Nathan Tenney, Carl Tenney, Lynn Tenney, Clifton Tenney, Samuel Tenny, and sisters: Louise Robinson, Anna Turley, Pearl Archuletta, and Helen Webb. Irene was the last living of her siblings. She is survived by four children: Lani (Richard) Moore, Lori K (Steven) Tersigni, Chris (Holly) Mousley, and April Mousley. She is also survived by seventeen grandchildren and twenty-one great-grandchildren. Irene will be buried alongside her husband in the Salt Lake City Cemetery.
