CULTURAL EXCHANGE, ACTIVITIES AT LOCAL SCHOOL Scott Forstner Reporter
Staff and students at San Martin Gwinn Environmental Science Academy welcomed students and ambassadors from the Chinese Ministry of Education of Beijing, China at a Jan. 28 cultural exchange at the Morgan Hill Unified School District’s southernmost campus.
This year’s focus was environmental sciences, as students worked side by side and planted grapes using compost made by SMG students. In a cultural exchange, SMG students performed a folkloric dance and drums presentation while the visiting students also gave a musical performance. A special lunch of tamales, beans, rice and bachata was served during the visit. Also part of the festivities, representatives from
the Santa Clara Valley Water District gave a presentation on water conservation, while MHUSD’s Julia Cook worked on an engineering activity with the group. The Chinese Society of Education, under the leadership of Chinese Ministry of Education, launched the program in 2010 and has visited 36 countries. The students who visited SMG were from the Beijing No. 2 Experimental School Exchange Group.

A month after rape suspect Sharwian Bobian was released from jail, law enforcement officers are searching for him. He is accused of false imprisonment and involuntary sex with a woman who brought food and provisions to his makeshift shelter. The Santa Clara County District Attorney’s Office initially declined to pursue criminal charges because they believed the case would be difficult to prosecute. On Monday, they reversed course and filed court papers to proceed against Bobian, a 43-yearold homeless and mentally ill man who left his encampment near the San Martin Transfer waste processing facility following his Jan. 4 release and a brief psychiatric hold. As of 8pm Tuesday, Feb. 5, his whereabouts remained unknown. The Sheriff ’s Office investigated the Jan. 2 incident and detained Bobian that night after interviewing the victim and taking her to Valley Medical Center in San Jose for an hourslong rape kit examination, according to records

Becerra doubles down on hospital AG SEEKS A STAY IN DISTRICT COURT TO BLOCK SALE OF O’CONNOR AND ST. LOUISE HOSPITALS Barry Holtzclaw Managing Editor
Last week’s local jubilation over a second court victory in the battle to save Gilroy’s St. Louise Regional Hospital and O’Connor Hospital was short-lived,
as California Attorney General Xavier Becerra two days later made one final attempt to block the sale of the two hospitals to Santa Clara County. Late on Friday, Feb. 1, Becerra asked the U.S. District Court for an emergency stay of a bankruptcy court approval of the sale, which the same bankruptcy judge had affirmed in emphatic terms on Jan. 30. The final legal showdown is set for Feb. 22 in a hearing in Los Angeles, less than one week before the county’s purchase
agreement with Verity Health System expires. That means a judge could make a definitive ruling against Becerra in time to salvage the $235 million deal and keep the hospitals. The unlikely dispute between Santa Clara County, hospital patients and staff on one hand and the recently elected state attorney general on the other roiled past the boiling point in the last week of January. In one week: • The attorney general said if the sale closes
March 1, his bid—pending in U.S. District Court—to claim authority over the deal would be dead. • The county—and U.S. Bankruptcy Court—said Becerra has no legal basis for his claim. • The county said if Becerra is successful in his second attempt at a stay—the first was denied in bankruptcy court Jan. 30—the Verity Health System sale of the two hospitals would be dead. • Patients, health professionals and local politicians took that one step further, saying Becerra’s
actions would close the hospitals and actually put lives of South County residents in danger. • The attorney general told the court he didn’t believe these dire predictions. • In his filing for the stay in U.S. District Court, Becerra said he needed to stop the sale to enable his appeal to continue, but he made no mention that his effort to “preserve vital healthcare services in Santa Clara County” might have the opposite effect. ➝ Becerra, 12

Rain sends Uvas over spillway RESERVOIR REACHED BEYOND CAPACITY Michael Moore Editor
district’s website. For the winter so far, Morgan Hill has received about 13.74 inches of rain. The recent storms have had an impact on most waterways in Santa Clara County. Chesbro Reservoir, just west of Morgan Hill, was at about 93 percent of its capacity the afternoon of Feb. 4—up from about 69 percent before the Feb. 1 storms rolled in. Coyote Reservoir in Gilroy was at about 69 percent of its capacity Feb. 4, up from about 51 percent before the latest storms. Anderson Reservoir in east Morgan Hill, the water district’s largest reservoir, was about 34 percent full Monday afternoon. But water district authorities aim to keep that reservoir low during the winter months to prevent flooding upstream when the level reaches the reservoir’s

After nearly three consecutive days of rainfall drenched the South County hillsides, Uvas Reservoir began pouring over its emergency spillway Monday morning. While some property owners downstream took precaution, authorities said there was no flood risk associated with Uvas Reservoir surpassing its capacity. It was the first time this winter that the 9,688-acrefoot reservoir on Uvas Road, in western Morgan Hill, reached beyond its full capacity. As of about 4:30pm Feb. 4, Uvas Reservoir was at 102.7 percent of capacity, according to the Santa Clara Valley Water District website.
Shortly after the reservoir reached the spillway, the water district issued a statement assuring residents that there was no immediate threat of flooding. “Water is flowing over the spillway as is normal when a reservoir reaches capacity,” reads the statement on the water district’s Facebook page. “Spillways are designed to allow for controlled releases and to help regulate flows. They don’t automatically result in flooding. There are currently no flood risks along Uvas Creek associated with the spilling, nor are there any flood risks anticipated. The creek has reached its peak flows and data readings are showing the flow is decreasing.” Since Feb. 1, when the latest round of storms hit the West Coast, more than 2.5 inches of rain have fallen on Morgan Hill, according to the water

Uvas Reservoir shortly after the water level reached over the spillway, but no significant incidents. Thousand Trails RV park on Uvas Road evacuated its property as a precaution, according to various news reports.
The latest surge of rainfall mostly stopped by Tuesday morning, but temperatures continued to drop. A light dusting of snow covered the hills east of Morgan Hill early in the morning Feb. 5.
Measure B funding finally released MORGAN HILL GETS $189K CHECK FOR ROAD REPAIRS Jaqueline McCool Reporter
After a lawsuit held up Measure B funding for over two years, cities across California awaited funding for infrastructure projects.
Money from the measure has been stalled in the courts since the voters approved the special sales tax. However, the California Supreme Court eventually upheld the constitutionality of the measure by refusing to consider past rulings. Now South Valley cities will receive much-needed funding for infrastructure
repair like the repaving of roads, updating striping and other improvement projects. The Santa Clara County Valley Transportation Authority (VTA) held a ceremonial press conference Jan. 30, delivering checks to the cities receiving Measure B funds. So far the Measure B tax has already collected $360 million—a small portion of the $6.3 billion
expected to be dispersed by the VTA over the next 30 years. In this round of disbursements, Morgan Hill was given $189,552 and Gilroy was given $240,462. VTA Public Information Officer, Holly Perez, told the Times that the Jan. 30 event was the first step toward distributing measure funds.
The measure was passed in November 2016 with 72 percent of the vote and implements a halfcent countywide sales tax over 30 years. Funds collected go to city and county transit projects. Mayor Rich Constantine of Morgan Hill said the city is supposed to receive $800,000 in funds annually from Measure B.
The Jan. 30 check is an advance on that money. Constantine said because of the city’s poor pavement quality, the funds are currently planned solely for repair.“We have such a deficit in road maintenance,” said Constantine. “We plan on using every dime of Measure B money to update roads.”

One of Morgan Hill Unified School District’s education leaders is leaving the district at the end of the 2018-19 school year, according to a Jan. 27 press release. Ramon Zavala, MHUSD’s Assistant Superintendent of Educational Services for the last four years, announced Jan. 28 that he is resigning from his current position on the executive cabinet. His last day of work will be June 30. “Since I am now eligible for full retirement, I want to dedicate my time to personal matters and work on exploring new opportunities,” Zavala said.
Zavala joined the district office four years ago, replacing former educational services head Norma MartinezPalmer, who had worked for MHUSD for three years. Zavala came to Morgan Hill from the Compton Unified School District. “I have enjoyed working in this leadership position and have appreciated all that I have experienced and learned,” Zavala said. “It has been wonderful working with my teams and staff.” During his tenure, Zavala helped produce blueprints for success such as the District Master Plan for English Learners (IMAGINE), Project 2Inspire, and the new Visual and Performing Arts Strategic Plan. He was also an integral part of organizing
services to all students, including programs that perpetuate a college and career going culture, according to staff. “I am grateful that the students and schools in Morgan Hill Unified have been positively impacted by Dr. Zavala’s work since he joined our team,” Superintendent Steve Betando said. “His work in this district has always been led by a ‘students first’ focus, and we couldn’t be more grateful for his dedication to California’s youth.” The district will immediately begin a search for Zavala’s replacement, according to staff. The position is posted on the education recruiter site, edjoin. org. The salary listed is $184,976 per year with up to $3,000 in degree stipends.

February is American Heart Month, and one way to show your love to someone you care about is to learn about heart disease and the risk factors associated with it. In the United States, cardiovascular disease and stroke cause one of every three deaths, or 2,200 deaths per day. The most common type of heart disease is coronary artery disease, which can lead to a heart attack. The risk of getting heart disease is increased by your lifestyle, age and family history. According to the Centers for Disease Control and Prevention (CDC), about half of all Americans have at least one of the three risk factors for heart disease: high blood pressure, high cholesterol and/or smoking. Risk factors for heart disease that cannot be controlled are your age and family history. The signs and symptoms of a heart attack include chest pain or discomfort; upper body pain or discomfort in the arms, back, neck, jaw or upper stomach; shortness of breath; or nausea, lightheadedness or cold sweats. If you or someone you know has one of these symptoms, it could potentially be a heart attack, and emergency treatment should be sought out immediately.
The risk of getting heart disease is increased by your lifestyle, age and family history. According to the Centers for Disease Control and Prevention (CDC), about half of all Americans have at least one of the three risk factors for heart disease, high blood pressure, high cholesterol, and/or smoking. While men were once thought to be at higher risk of heart disease, this is no longer true. Ninety percent of women have one or more risk factors for developing heart disease, yet only one in five women believe that heart disease is among their greatest health threats. Heart disease and stroke account for 31.7 percent of all female deaths in California, according to the CDC. A 2010 CDC study found that on average, almost 100 women die from heart disease and stroke in California each day. You can take action to reduce heart disease by changing your lifestyle and diet, maintaining a healthy weight, and lowering your cholesterol and blood pressure. Taking steps to address your health is important as we acknoåwledge American Heart Month. Do it for yourself and your loved ones and get a health check-up. Sen. Bill Monning represents the 17th State Senate District, which includes all of San Luis Obispo and Santa Cruz counties, and portions of Monterey and Santa Clara counties.

Manhunt begins one month after release ➝ Rapist, 1
Michael Moore
that became public earlier this week along with the charging documents. Sheriff ’s deputies had expected the case to move forward in early January, however Clarissa Hamilton of the DA’s sexual assaults team reportedly called the victim the morning after the alleged rape to tell her that the office opted against pressing charges. According to the victim, prosecutors cited a legal doctrine called the Mayberry Defense, saying Bobian might have interpreted the victim’s lack of apparent resistance as consent. Prosecutors changed their minds this week and obtained the warrant to arrest Bobian. The South Carolina transplant has a two-decade criminal history that includes aggravated assault in Georgia and a host of petty crimes in Santa Clara, Santa Barbara and San Mateo counties in California. The San Martin incident rocked the small community, where neighbors shared the victim’s sense of violation and questioned why the DA allowed the suspect to walk free less than a day after officers brought him to jail. Though the victim, described in court papers as Jane Doe, maintains she was told the morning of Jan. 3 not to expect prosecution, DA spokesman Sean Webby said the case never closed— it was just under scrupulous, time-intensive review. “We've been investigating
it the entire time,” Webby said in a Feb. 1 phone call. Most reported rapes go unprosecuted. Nationwide, on average, just 13 of every 1,000 reported rapes get referred to prosecutors, according to data from the U.S. Department of Justice, and about seven of those result in felony convictions. Last year, law enforcement agencies in Santa Clara County submitted a combined 994 sexual assault cases to the district attorney’s office, which filed charges in about half of them. Of those, just 34 went to jury trial and 25 resulted in convictions. Prosecutors have the unenviable task of deciding whether a claim meets the American Bar Association’s ethical standards for criminal charges: that there’s probable cause of an offense and enough evidence to support a conviction. The victim and her husband said the DA’s reluctance to charge Bobian because an attorney might claim a mistake-of-fact defense suggests more concern for conviction rates than public safety. California law deems rape an act accomplished against a victim’s will “by means of force, violence, duress, menace or fear of immediate and unlawful bodily injury.” Lack of consent being the defining element. Though the expectation of victim resistance has been largely eliminated through legislative reforms, it’s still effectively enforced through case law.
HAVE YOU SEEN THIS MAN? Sharwian Bobian, sitting at his former tent home, where police say he sexually assaulted a woman who had been helping him. “It just feels so disgusting and disheartening,” the victim said in a recent interview. “The criminal system let us down so horrifically.” The couple also took issue with the way prosecutors kept them in the dark on important details, telling them Bobian had no criminal history while his rap sheet includes aggravated assault and
evading police convictions in Atlanta, Georgia. The other brushes with the law were mostly petty crimes symptomatic of homelessness and mental illness, like trespassing, shopping cart theft and throwing an object at a moving car. Bobian is currently on probation for the San Mateo offenses, according to court documents.
The accuser criticized the DA’s handling of the case as indecisive and concerned more about the defendant than the crime victim. The prosecutor’s reversal follows a month of media interest in the case and outrage expressed privately in the law enforcement community, along with the victim’s willingness to share painful details in multiple
interviews about the incident with a man she tried to help out of compassion for his miserable situation. “I can’t understand how this could happen in an age of women’s rights and equality,” she said. “I’m still trying to process the rape, and all those feelings that go with it, and now I feel like I have to go into fight mode.”

County baffled by AG resistance ➝ Becerra, 1 • The attorney general alleged again in more certain terms Feb. 1 that the county had “refused” to guarantee the provision of essential healthcare and emergency services, or to promise acceptance of Medicare and MediCal patients. • County Executive Jeff Smith accused Becerra of making “false” and “misleading” statements, referring to well-publicized statements by the county and to the attorney general’s rejection on Jan. 22 of a signed agreement with the county assuring the provision of the healthcare services to all county residents. • The attorney general said that if he can’t enforce guarantees, “the county is free to close the hospitals or eliminate vital healthcare services in those communities.” • Smith last week called this claim “just absurd” and said the county offered
to pay $235 million to buy two hospitals to keep and expand vital healthcare services, not to shut them down. Becerra has declined invitations to meet directly with county officials, and has refused all requests for media interviews. One lawyer familiar with the case characterized Becerra’s filing late Friday on the eve of Super Bowl weekend as a “Hail Mary” pass, aimed at convincing a federal judge that only the attorney general could protect healthcare services in Santa Clara County. Becerra submitted his 29-page filing late Friday, Feb. 1, two days after a similar request for a stay was rejected by the same U.S. Bankruptcy Court judge who had approved the hospitals’ sale in late December. Becerra argued in his district court request that a stay “would promote the public interest,” and “involves important issues
of state law regarding health, safety and welfare.” Without the stay, “the families and patients served by O’Connor Hospital and St. Louise Regional Hospital will suffer irreparable injury,” wrote Becerra. In the latest court filing, the attorney general made no mention of the claim by the county and Verity Health that if he is successful in his legal fight, O’Connor and St. Louise will close. Becerra’s Feb. 1 filing repeated arguments that were soundly rejected by Bankruptcy Judge Ernest Robles in his Jan. 30 ruling. Robles said he was concerned about the impact on Santa Clara County residents if the two hospitals were to close. Smith said the attorney general’s actions could only be explained by a desire to exert his authority, at the expense of the health and safety of
Santa Clara County residents, especially those who live in the South County communities of Morgan Hill, Gilroy and San Martin. In his Jan. 30 ruling, Robles agreed with that assessment, saying the harm to the attorney general’s office would pale in comparison to the harm to Santa Clara County if the hospitals were to close. Robles also said that Becerra’s district court appeal was futile and that he would probably lose. Becerra said the opposite on Feb.1, telling the District court he is likely to succeed on the merits of his appeal of the bankruptcy court’s approval of the sale. Robles characterized the attorney general’s legal case as weak, with a “lack of merit.” “The attorney general still has not identified the specific statutory provision establishing his authority to review the
sale,” Robles said in the order. Smith said in an interview on Jan. 31 that the stated goals of quality health care for all are share by Santa Clara County and the attorney general. “We’re on the same team, with the same goals,” he said. “It’s as if someone on the same team is trying to shoot me in the back.” “We’re going to continue to work as if it’s a done deal. We’re anticipating a clean sale order on the first of March,” he said. In an interview, Richard Adcock, chief executive officer of Verity Health System—whose filing for Chapter 11 bankruptcy protection last fall opened the door to the county’s purchase offer—praised the Jan. 30 ruling by the bankruptcy court. “We are happy and proud” of the sale of two of its six hospitals to Santa Clara County and the pending sale—headed
for approval next week— of the other four hospitals to KPC Group, a private, Southern California firm, he said. Adcock said Verity is working on a transition plan with Santa Clara County to provide IT and other support in the weeks after the sale is closed March 4. The Verity Health System facilities in Santa Clara County beginning March 4 will be owned by Santa Clara County and will be operated as community hospitals with local control by the physicians at the hospitals and by local administrators, if the judge rules in the county’s favor later this month. The sale also includes De Paul Medical Center in Morgan Hill. Smith said he expects the county to hire more than 2,000 hospital staff and contract with approximately 700 physicians now affiliated with the two Verity Health hospitals.

Oakwood solid as ever
Robert Eliason
TEMPO SETTER Oakwood High junior point guard Justin Bautista calls out a play during the Hawks’ 57-54 win over King City on Jan. 29, their first win over the Mustangs in three tries this season. The victory put Oakwood in the driver’s seat to win the PCAL Santa Lucia Division championship.
HAWKS AIM TO FLY HIGH IN PURSUIT OF LEAGUE TITLE emanuel lee Sports Editor
Robert Eliason
Playing perhaps its most lackluster half of the season, the Oakwood High boys basketball team went into the halftime break trailing by 10 points to the same King City team that it had already lost to twice earlier in the season by a combined margin of five points. “We couldn’t let this team beat us a third time,” said Andrej Velijkovic, Oakwood’s outstanding junior shooting guard. “We had to win.” And that’s exactly what the Hawks did, roaring back for a thrilling 57-54 Pacific Coast League Santa Lucia Division victory on Tuesday. Velijkovic had a team-high 19 points, Nikola Djalovic had 16 and Aaron Fripo finished with 11 as Oakwood took a big step toward winning a division championship. With the win, Oakwood improved to 5-1 in division play, ahead of second-place Watsonville and Gonzales, both with 3-2 marks. A dominating 19-5 third-quarter run propelled the Hawks to an impressive comeback victory, making one wonder what magic words were said in the locker room at halftime. “We can’t print it,” Oakwood coach Kort Jensen said with a grin. “I don’t know if I can say,” Velijkovic said with a smile. “That is a secret that will stay behind closed doors.” There was no doubt the coaches lit a fire under the players’ proverbial butts at halftime, and to the players’ credit, they responded. Oakwood turned a 15-point deficit into a four-point lead entering the fourth quarter, an advantage it never relinquished. A gritty King City team actually opened the third quarter on a mini 5-0 run to build the largest lead of the game, 39-24, with 6 minutes, 10 seconds remaining in the third. At that point, it looked as if Oakwood was going to get run out of its own gym. Then something clicked. Fripo, a 6-foot-2 sophomore, hit on consecutive
shots, a floater in the lane followed by a layup. Fripo displayed great basketball instincts, producing key rebounds, steals and being at the right place at the right time. Djalovic, a 6-9 senior center, hit a baby hook shot from in close before Fripo connected on a 3-pointer to cut the Hawks’ deficit to six, 39-33, with 3:13 left in the third. Then it was Velijkovic’s time to shine. He nailed back-to-back 3-pointers—the second of which came after he produced a steal— and Djalovic closed the quarter with consecutive baskets to complete an impressive 19-0 run to give Oakwood a 43-39 lead entering the final quarter. Velijkovic scored eight of his 19 points in the fourth, displaying all of his ability and skills in the process. Working well off the ball to get free of a pesky defender, Velijkovic drove to the basket with authority in the second half. It was a 180-degree turnaround from the first half, in which Velijkovic got picked four times and committed six turnovers. The fact that Velijkovic responded to the adversity showed a mental toughness that will serve him well going forward. “I don’t know why (I didn’t play well in the first half ),” he said. “It could be mental, and that guy played tough on me, but I want to thank coach and all of my teammates who gave me really big support. They kept giving me the ball in the third quarter even when I missed a lot of shots in the first and second quarters. I just stayed focused, played my game and the shots started going in.” Jensen, who is in his 10th season as the Oakwood coach, gave his team some extra rest last weekend as the high school season can be grueling at times. The Hawks simply couldn’t get off the ground in the first half against King City, which to its credit hit several running shots in and around the lane—shots that are difficult to block—exacerbating Oakwood’s lack of rhythm on both ends of the court. “Our boys came our really flat,” Jensen said. “The effort wasn’t good. The execution on offense wasn’t sharp and the timing was off. It’s like an orchestra and if everyone comes in on the wrong note, it doesn’t sound good. We talked about that at halftime: timing, effort, physical play, stepping up, and playing more like a
OUT OF MY WAY Andrej Velijkovic, Oakwood’s outstanding 6-foot junior guard, scored a team-high 19 points in a critical 57-54 win over King City on Jan. 29. The victory put the Hawks in a great position to win a league title. real high school team and not like a small division high school.” Jensen probably made an impassioned speech to his players at halftime, knowing the team was not playing to its potential. That is why Jensen took four of the five starters of the court—Justin Gonzaga was the only starter who stayed in the game—for a brief time in the second quarter. Gonzaga brings a ton of intangibles, something that every team needs. “When I pulled four of the five starters, I left him in because I liked his body language,” Jensen said. “He was up, he was proud, he was fighting. Then we started running plays specifically for him and our second unit in that minute and a half got us a two-point advantage.” When the four starters got reinserted into the game, things didn’t go much better. “It was all across the board (in terms of the players not executing),” Jensen said. “We were lacking with our decision-making, and we weren’t getting the ball to the right person at the
right time. We started pressing and tried to do things we’re not capable of doing.” However, Gonzaga was strong throughout the contest. The 5-10 guard/forward is the Draymond Green of the Hawks, being a glue player and tough offensively, defensively and on the boards. Gonzaga made plays at crucial moments and does things that don’t show up on the stat sheet— just like Green. Things like switching and helping on defense, setting screens and boxing out well. “In the second half our big man was in foul trouble, and Justin Gonzaga came off his man to double on the ball and still was able to recover and get his man,” Jensen said. “That is a lot to ask, particularly for a high school player who is still learning the game, but he did it brilliantly. They could never get Nikola (to foul out), although they tried. That’s because Justin kept coming and digging at the ball. He would either get the steal, recover or get his man. He was the player of the game in my mind; he was awesome.”
That would also be one way to describe Velijkovic ‘s play in the second half, as he showed determination and persevered through a rough first half. “Andrej is a really good player,” Jensen said. “He’s averaging about 22 points a game for us, and he recently set a school record (for single-game point performance) with 39. He’s hit nine 3-pointers in a game for us, and is just dynamite.” This was a long time coming for Oakwood, which lost a 79-78, four-overtime thriller to King City in the Watsonville Tournament on Dec. 13, then blew an early 18-5 lead in a loss in the teams’ first league contest on Jan. 11. It looked for a while the third time wasn’t going to be the charm for the Hawks until they hit another gear early in the third quarter. King City would’ve built up a bigger lead in the first half had it not been for Justin Bautista, a 5-11 junior point guard. Even though Bautista didn’t play a great first half, his average half is still better than a lot of other guards’ level of play.
