MIAMI LAKES, FLORIDA

Honorary Mayor For a Day

JUNE 17, 2016

Six-month abatement approved by the court in mayor’s legal fees case The Town of Miami Lakes and Mayor Michael Pizzi’s attorneys have reached an agreement over a temporary stay in his lawsuit against the town which is demanding the city pays his lawyers $2.5 million for successfully defending him during his criminal trial. According to the accord, both sides have put on hold any court proceedings relating to the lawsuit for six months, including dispositions and motions to reimburse attorneys fees, to give Miami Lakes an opportunity to pursue its own action against its insurance carrier to pay the mayor’s legal bill. The motion for an abatement was filed on May 16 in the Circuit

Court for Miami-Dade County. The temporary stay in the case would allow Miami Lakes’ attorney, Lydecker Diaz, to go after the town’s insurance company to cover the mayor’s legal bill and also recover the $460,000 as part of a settlement for Pizzi’s court costs for his reinstatement case, which started at the Florida Supreme Court and ended in the lower court. According to the abatement, which expires November 15, the mayor’s legal team who includes Ed Shohat, Ralf Rodriguez and Ben Kuehne, might assist the town in its lawsuit against the insurance company to recover the money. For a year, Miami Lakes has

been seeking an abatement to stop the mounting legal fees. According to Town Attorney Raul Gastesi, the mayor’s lawyers repeatedly rejected the town’s request for an abatement, and he questioned the timing of the stay of litigation since the mayor’s disposition was scheduled for May 23. At a Town Council meeting in May, Shohat verbally committed to the six-month abatement when Gastesi requested $100,000 in attorney fees for Pizzi’s deposition and other legal proceedings relating to his lawsuit. Pizzi was arrested in 2013 in an FBI sting and was indicted on

Town enters Par 3 Park in Public Space Challenge Town of Miami Lakes’ submission for the Par 3 Central Park has been selected as a finalist in the Miami Foundation’s 2016 Public Space Challenge. One of 56 selected finalists from a pool of more than 400 ideas, the Town seeks to transform the Par 3 Golf Course, located on the east side of the Palmetto Expressway and south of N.W. 154 Street, into Miami Lakes Par 3 Central Park. The 32-acre parcel of land is being acquired by the Town through a donation from The Graham Companies. Originally opened in 1963, the 18-hole Par 3 Course is located within prime gathering space of Don Shula’s Golf Club and Hotel Indigo. The Town’s vision is to convert the Par 3 Course into a multiuse central park. Proposed amenities and activities for people to enjoy include walking trails, fitness stations, a kids play area, as well as botanical and butterfly gardens. The availability of parks is an important quality-of-life factor, and the Town intends to continue looking for additional park and recreation opportunities for its residents.

Legal fees straw ballot proposal ignites firestorm By The Miami Lakes Staff A proposal for a non-binding straw ballot to decide if Miami Lakes residents want the Town to pay the mayor’s legal bill for his criminal case sparked a political firestorm and could have led to another court battle and more fees. The opposition for Councilmember Frank Mingo’s proposed straw ballot during the November election centered on a disdain for taxpayers footing another legal bill should Mayor Michael Pizzi file a third lawsuit against the town for conceivably violating his civil rights since he may be entitled to the money following his acquittal. Pizzi and Miami Lakes are mired in a legal dispute over his lawsuit demanding the town pay $2.5 million in attorney fees incurred from his public corrup-

tion trial, but the two sides agreed to abate the case for six months while the city pursue its insurance carrier to pay his bill. But Mingo had second thoughts about putting the town’s taxpayers in harms way of another legal battle and rescinded his legislation, though it appeared he had the support of his fellow council members at last week’s Town Council meeting. Mingo said his proposal wasn’t politically motivated against Pizzi. “I want the people of Miami Lakes to weigh in and gives us an idea where they want us to go, he said. “My intention is not political but to get the input from the people of Miami Lakes. I see he’s trying to get the money for his lawyers, and that tells me it’s all about one thing, money. Mingo said $2.5 million consti-

Duplicate Bridge tournament featured in ML Senior Games

tutes 15 percent of the town’s budget and Miami Lakes may have to raise taxes and cut services to balance next year’s spending plan. “It’s sad the people of Miami Lakes would be silenced on an important issue, he said. Pizzi said Mingo’s straw ballot idea was politically motivated to try to keep him out of office, albeit he has yet to file papers to run for re-election in November. The mayor said the results would’ve been predetermined had it been placed on the ballot. “Nobody wants to pay attorney fees under any circumstances, Pizzi said. “So you know how they will vote. This is a legal issue that should be decided in the court of law. Pizzi said the abatement for his criminal case should have eased some tension but Mingo’s straw ballot brought back old wounds. “We agreed to an abatement in good faith and this item gets out on the agenda, Pizzi said. “Talk about lack of good faith. During the heated debate which lasted over 60 minutes, Mingo and Pizzi exchanged words over the legal fees and proposed straw ballot which the mayor called misleading and disingenuous. “This is part of a political strategy to make sure Michael Pizzi, who may run for office, be able to make attorney’s fees and criminal case a central issue in the campaign, Pizzi said. “It’s absolutely absurd and intellectually dishonest. Mingo took a verbal swipe at the mayor following his intellectu-

ally dishonest comment. “When I’m called intellectually dishonest, my gloves come off, Mingo said. “I have never been arrested by the FBI for talking money in a closet. So, if there’s anyone who has a cloud over him, it’s you, not me. Before Mingo pulled his proposal for a straw ballot, most of his colleagues seemed to support his idea. Councilmember Tony Lama said the straw ballot couldn’t be politically motivated since Pizzi hasn’t opened up a campaign account to run in November’s election. “This is not interfering with an election because Mr. Pizzi has not filed papers, Lama said. “This is not politically motivated, we want to make the right decision and find out where residents sit. Councilmember Ceasar Mestre, who is running for mayor, said the Town Council is under a lot of pressure to resolve the legal matter once the abatement is over. “I would like to know what they want us to do themselves because we have to make some decisions, he said. But residents who weighed in on the contentious straw ballot request didn’t embrace it. Harry Bolinger said a straw ballot would just add to the town’s legal problem. “We keep fighting the same battle for over a year and we’re getting deeper, said Bolinger, who was a police officer for 27 years. “Working in law enforcement, I have seen people acquitted and

entitled to reinstatement, back pay and attorney fees. It’s the law.â€? Maria Kramer indicated the approval of a straw ballot pales in comparison to a judge’s decision on whether Miami Lakes should pay Pizzi’s legal fees. “In the United States government, the court supersedes city, state and federal governments,â€? she said. “So no matter what the voters pass, if the courts say we have to pay the mayor’s legal fees, we are enjoined to have to the pay the mayor’s legal fees.â€? Roosevelt Bradley said he couldn’t support Mingo’s proposal because it would drag taxpayers into a politically motivated campaign. “I’m not in support for money to pay for political ads,â€? said the former Miami-Dade Transit director. Ken Harris Robins, a civil rights attorney who Town Attorney Raul Gastesi said assisted Pizzi in his reinstatement settlement against Miami Lakes, said the straw ballot would have violated the mayor’s civil rights. “He was acquitted of a crime and entitled to get paid by the city that benefited from the services by that mayor,â€? Robins said. “Don’t tamper with the ballot.â€? In other Town Council News: • Council members gave their final approval for an ordinance to amend the current budget totaling a $7,814,088 increase in the town’s spending plan from $29,799,989 to $37,614,076. Town and mayor’s attorneys arrive at six-month abatement in dispute over legal expenses (Continued from Page 1) seven counts of public corruption charges. After his acquittal in 2014, Florida Governor Rick Scott refused to reinstate him and Pizzi sued him in Florida’s top court. The Circuit Court returned him to political office and the decision was upheld by an Appeals Court. As for the town’s litigation against its insurance company, Gastesi said a hearing is scheduled for Thursday, June 9, for the company’s motion to dismiss the town’s case. Sometime before July 31, since

the insurance litigation and criminal fees cases are related, the attorneys involved in the criminal fees case are attempting to have the attorneys and parties involved in the insurance litigation case attend a mediation session. Gastesi said since the abatement was approved, the $100,000 is not needed for the town’s legal expense for the deposition and other legal motions in the mayor’s case. But the Council approved his request for $35,000 from the $100,000 for the mediation sessions.

Summary of more actions taken at June 8 Town Council meeting (Continued from Page 3) budget by $679,809 (of which $666,809 represents one-time revenues from the Dunnwoody Lake Development and grant awards, and $13,000 of net transfers between funds), bringing the total budget to $38,293,855. The amendment also includes an additional $45,000 to upgrade the Wi-Fi in the town’s parks, and an additional $650,000 in money generated by the new mobility fee from Lennar Homes Corporation’s residential development at N.W. 87 Avenue and 154 Street. The modified budget funds some traffic-troubled spots at Windmill Gate Road ($50,000) and the Palmetto Expressway and N.W. 67 Avenue ($30,000), the Greenways and Trails Striping Improvements ($15,000), and the Town’s Dog Park construction additional funding ($50,000). • Lawmakers approved a resolution to adopt the mobility fee for the Dunnwoody Lakes property where Lennar Homes Corporation is planning to build a residential community at N.W. 87 Avenue and 154 Street. Lennar Homes purchased the tract from the Lowell Dunn family last year and Miami Lakes subsequently approved the corporation’s plans to build 256-singlefamily homes and 226 townhouses on the parcel. The mobility fee of $657,807 replaces the town’s old method of developers paying for a traffic

study to help improve traffic flow on the town’s roadways. The new concurrency program allows developers to pay the town a fee based on the daily trips near their development projects and Miami Lakes would use the money to improve mobility for residents. Town Manager Alex Rey said the mobility fee for Lennar Homes can help make roadway upgrades to meet traffic concurrency as required in a 2011 development agreement between the town and the Lowell Dunn family, which paved the way for opening up N.W. 87 Avenue to alleviate traffic gridlock on the west side. Traffic improvements include adding a southbound left-turn lane at N.W. 82nd Avenue and 154 Street, building an exclusive westbound and eastbound right-turn lane at N.W. 82nd Avenue and N.W. 154 Street; construction an additional eastbound through lane on N.W. 154 Street from N.W. 79th Court to N.W. 77th Court; constructing an additional southbound left-turn lane at N.W. 154 Street and 79 Avenue; and erecting an exclusive northbound right-turn lane at N.W. 138 Street and 87 Avenue. In addition, Council members approved a resolution for the final plat for Lennar Homes’ building plans. • Council members approved a resolution to oppose any entity’s efforts to opening up N.W. 170 Street at Interstate 75.

• Council members approved a a three-year agreement with the Miami Lakes United Soccer Club with an option for two (1) year extensions to use Miami Lakes Optimist and Royal Oaks parks. The new accord calls for the club to maintain a minimum of a 50 resident participation ratio in its recreational programs and a minimum of a 25 percent resident participation ratio in its travel and competitive programs, and the program should maintain a nonresident registration fee that is at a minimum 25 percent higher than the resident registration fee. • Council members approved a resolution to accept and certify of the results of the May 17 special mail-in ballot election in which residents overwhelmingly approved 10 town charter amendments. • Lawmakers approved Council member Manny Cid’s proposal for town staff to draft Declaration of Principles of Inclusion for individuals with Autism and other kids with special needs. Cid said the town should follow Coral Gables’ lead and adopt similar principles including accommodating children and adults with autism and other special needs in all aspects of town sponsored events and activities. • Lawmakers approved Cid’s proposal to direct town staff to fund the Black Olive Tree Removal program for the next fiscal year. The town would set aside $75,000 a year to underwrite the program.

Perry J. Cohen Foundation hosts free one-day boating safety course in M. Lakes on June 25 Last summer, 14-year-old boys Perry Cohen and Austin Stephanos went missing at sea while fishing. Animal Services opens new Pet Adoption and Protection Center Miami-Dade County officials, including Mayor Carlos Gimenez, Commission chairman Jean Monestime and other Commissioners, hosted the grand opening on June 13 of the Animal Services Pet Adoption and Protection Center in Doral. The new facility has set a new standard for animal rescue and care by focusing on providing a comfortable, relaxed environment for homeless pets, and enhancing the customer experience. Located on almost 5 acres, the facility is the first rescue and protection center of its scale to open in MiamiDade, and surpasses the standard requirements of any shelter in the USA. “We have built the best facility to ensure every pet gets adopted, offer more low-cost spay/neuter services and enrich our life-saving

programs,” said Gimenez. Advanced medical technology and equipment complement the skilled surgeons and support staff, and an open floor plan increases efficiency and maximizes surgical flow. The expanded surgical suites and a streamlined pre-admission process enhance and support highquality, high-volume spay/neuter services. “Completion of this new center increases surgical capacity by more than 50 percent,” said Alex Muñoz, Animal Services Department director. “Accessible and affordable spay/neuter surgeries are an important component in the efforts towards no kill goals,” he added. Dog housing has been increased by more than 25 percent and cat housing is almost double in the modern mall-like layout that

was retrofitted and renovated in an existing building on the site. The entire facility is climate controlled making it the largest air-conditioned animal shelter in the country. The air conditioning system is designed to control cross contamination of disease, with six air changes per hour in the canine/feline adoption suites facilitating ventilation of fresh outside air, mitigating odors and reducing the spread of disease. Tara C. Smith, director of Miami-Dade’s Internal Services department, said, “We created an environment that is inviting to families, where they can come find their ‘furever friend,’ as well as a place of protection for our furry residents.” Full services are now available at the new location, 3599 N.W. 79 Avenue, in Doral.

Two former Optimist Club athletes receive Roland Gomez Scholarships Longtime Miami Lakes Optimist Club member and chairman of the Roland Gomez Scholarship Committee Jim Hamilton, presented $1,000 checks to two scholarship recipients recently – Barbara Goleman High senior Daniel Wong and Mater Academy senior Emily Acosta. Scholarship winners receive their checks once they are ready to go off to college. Wong played baseball for Goleman and the Miami Lakes Optimist Club, where he achieved success in the classroom and on the playing field. He said he chose to attend the University of Florida because his father went there, and he felt at home during his seven visits, “I loved the campus,” Wong said. “We watched the Gators’ football games and participated in other school activities.”

Besides athletics, Wong said the University of Florida offers him the best opportunity for his major in engineering. In high school, Wong said balancing school work and athletics were arduous at times, but he overcame the challenges of being an AP student and playing center fielder and designated hitter on a district-winning team. With a 5.25 GPA, Wong said he took a host of AP classes during his junior and senior years, including difficult research courses that earned him 40 college credits. During the summertime while still studying to prepare for the new school year, Wong played on the Optimist Club team which played in the prestigious Cal Ripken Jr, tournament in South Carolina, and the ESPN Disney Baseball Tournament in Florida. He credits Goleman assistant

coach Dario Martinez for shaping him into a good baseball player at school and at the Optimist Club, while not losing focus on his academics. Acosta, with an unweighted 3.7 GPA as a student-athlete, achieved her goals in high-school and is ready to make another impact in college. She will be attending Ave Maria University in Naples, Florida, in the fall to study biology. Acosta said the college feels best for her in achieving her goals after high school. “I felt comfortable there,” she said. At Mater Academy, she played flag football, basketball and ran cross-country and track and field. In flag football for the 2016 season, Acosta, a running back and defensive back, recorded 93 attempts for 1,016 yards, 10 touchdowns, 52 pulls and 10 interceptions), earning her The MiamiHerald’s All-Dade First Team honors. Acosta was also recognized as a state finalist for the Wendy’s High School Heisman. At the Optimist Club, she played basketball and played on the organization’s All-Star teams. Hamilton said Acosta demonstrated excellence in the classroom and athletic fields. “We are extremely proud of her for being an outstanding person in academics and athletics. In her case, not only was she exceptional at the Optimist Club but also the classroom. I’m sure she will do well in college.”

Main Street Players presents play reading of East Light and Jack Madigan on June 18 Main Street Players will present a staged reading of the play East Light and Jack Madigan by Robert Anderson, staged by Robert Coppel, on Saturday, June 18, at 8 p.m., 6766 Main Street, Miami Lakes. Tickets are $10 and may be purchased at the door or online at www.mainstreetplayers. com. It is February 1995 and Jack Madigan is excited about the fact that his girlfriend, Laurie, will soon be moving in with him but a monkey wrench is thrown into his plan when he gets an unexpected visit from his dad, Bill. It seems as if his chain-smoking, alcoholic father has come to Florida from the Northeast to find “his harmony” away from his loving, but overly concerned wife. Both Jack and Laurie do their best to greet the elder Madigan with open arms, but Laurie makes

it clear to Jack that she will not be moving into his place until his dad is out. She makes a valiant effort in reaching out to him as they share a love for literature, but Bill is a tough man to crack and he leaves Laurie keeping her distance, which could impact her relationship with Jack. Ryan Boda plays Jack Madigan, Amy Brienes plays Laurie, and Joel Kolker plays Bill Madigan. Stage directions will be read by Cindy Castillo.

Pace High graduates first four-year EMT Academy program students By Rene D. Basulto Special to The Miami Laker Seventeen Pace High School seniors established a new tradition by graduating as the first four-year class of Pace’s Academy for Health Sciences in conjunction with Barry University’s EMT Academy program. The 17 seniors, known as “Class 001,” received their graduation certificates in a ceremony held at the Barry University campus on May 25 with their families, teachers, and Academy underclassmen in attendance. The EMT Academy puts students on a path towards earning their EMT certification and preparing for work in the medical field. As part of the academy, the 17 graduates were Barry

University students as well, complete with Barry IDs and instructors from Barry University in their senior year. Their “Class 001” moniker comes from Kevin LaGrange, lead teacher for the Academy for Health Sciences and a Pace Class of 1996 alumnus, who was inspired by military special forces programs when naming them. The seniors were the first set of graduates to be a part of the Academy of Health Sciences for all of their four years at Pace. “To see their growth and development, they embodied what I believed the academy could be,” said LaGrange. “You see them becoming these professionals. They can respond to an emergency. They can walk into your house and

perform to a high standard.” While LaGrange was their teacher for the first three years of the academy, he took on a mentorship and liaison role for their senior year as Barry University instructors taught the class. Jorge Nunez, a Barry EMS instructor and Lieutenant with Miami-Dade Fire Rescue, was the EMT class’ main teacher, followed by Cliff Rickets, a Captain with Miramar Fire-Rescue and Pace Class of 1999 alumnus, and several other Barry instructors in the EMT and medical field. The majority of the graduates will be moving into the medical field, with some pursuing nursing, paramedic, and medical degrees in hopes of becoming doctors or physician assistants.

SEVENTEEN SENIORS from Monsignor Edward Pace High School graduated from the school’s Academy for Health Sciences EMT Academy program done in conjunction with Barry University at a ceremony held on the Barry campus on May 25.

Dade Christian’s track/field star Milton Ingraham wins discus state championship By David L. Snelling The Miami Laker staff Dade Christian track and field athlete Milton Ingraham won the state championship last month in the discus with a 157-10 score in the final competition and finished sixth in the shot put, but the accomplishments didn’t make him too happy. “I wasn’t too happy,” he said. “I thanked God for wining it for my family. To me, it was just a win.” Ingraham, a sophomore, won the state title in the discus as a middle school student at DCS. He also plays basketball for the Crusaders, a power forward who averaged 6 points and 7 rebounds a game this past season. Running track and field was Ingraham’s ancestry calling. His mother was a track and field athlete who won a state title and threw discus at the University of Florida. He also had other relatives who threw discus. Doreen Mercer, Dade Christian’s track and field coach said Ingraham is very committed to discus. He also made The Miami Herald’s All-Dade First Team in track and field. “He has the talent to compete in Division 1A in college, Mercer said. “His passion is basketball but getting into college, his strength is track and field. Mercer said Ingraham’s mother is the immediate coach for him. “I’m just the driving force,” she said.

Pace president Reverend Paul Vuturo and principal Ana Garcia presented seniors with baccalaureate medals during the mass, and the event was capped off with a charming guitar and vocal performance of the senior class song “Stole the Show” by the Pace Choir’s senior members as their classmates clapped along. After a few trips back to campus throughout the week to prepare, the Class of 2016 seniors closed out their high school careers at Pace’s 53rd Annual Commencement Exercise on May 27 at the Miami-Dade County Auditorium. Senior Cristina Castillo gave the farewell address, reminiscing about the things they learned and the legacy they left behind, such as being the first class to transfer completely over to an iPad curriculum as freshmen. Castillo mentioned in her address that her class raised $90,000 across all four years for Pace’s sister schools in Haiti. In her address to the seniors, Garcia wished the graduates well, expressed that she expects great things from them, and announced that the Class of 2016 received $7.4 million in academic scholarships and $2.2 million in athletic scholarships.

Spanish Lake Elementary students win First Place in annual H.O.P.E. contest Spanish Lake Elementary fifth grade teachers, Sharon Wallen and Jennifer Meneses, were elated as their students swept first place in the Elementary School Class Division in the H.O.P.E. (Help Overcome Pet Euthanasia) Contest sponsored by the Humane Society, Miami-Dade Animal Services Department and endorsed by Miami-Dade Public Schools. Although there are many components to the contest, it is geared to benefit animals by making others aware of animal services provided, responsibility of pet ownership, the cruelty that is done to animals, and innovative ways the shelters may produce needed income for services. The students’ projects focused upon answering provoking questions related to pet care and ways the students could actually support a better life for animals in an innovative way. After “surfing” the web for background information and ideas, the students discussed their

findings with their instructors. The students then arranged a conference with Jacqueline AriasGonzalez, SLE principal, in order to discuss final project design and for approval. The students formulated a wish list for pet needs in order to facilitate the student run drive for food, toys, towels, donations, etc. They designed their own flyers for advertisement in the form of original word searches, color pages, and class donation tracking. They wore custom t-shirts and hats. Through their painstaking and conscientious efforts, the students were amazed with the knowledge gained and the success of their drive. For their sterling efforts and first place win, the students received a field trip to visit the Miami Humane Society and a yellow bag filled with goodies including a Target gift card, Marlin game tickets, a Humane Society bracelet, dog shampoo, sunglasses, and more.

SPANISH LAKE ELEMENTARY students are pictured holding certificates for their first place win in the HOPE contest.

Mater Lakes Academy’s Sabrina Gonzalez wins a Miami Herald Silver Knight Three Mater Lakes Academy students were nominated for The Miami Herald’s Silver Knight Awards that were held on Wednesday, May 18 at the James L. Knight Center. One of the nominees, Sabrina Gonzalez, won the Silver Knight in the Vocational Technical category for MiamiDade. Gonzalez is part of the Early Childhood Education program at Mater Lakes Academy, and grew very fond of a particular student and their family while he was part of “Cub Academy” (the on-site pre-school that is part of the early childhood curriculum). This student, who is autistic, was leaving the pre-school to attend another school for students with special needs, unfortunately the school was costing the parents several thousands and they were expecting twins. Knowing the struggles the parents were going through, Gonzalez decided to start a nonprofit, Heroes Miami, Inc., in August 2014, for families that have children with autism to assist them financially to cover some of the expenses they cannot afford. Through her non-profit, she has raised over $7,000 and has held several fundraising events.

SABRINA GONZALEZ Gonzalez is not only graduating with Summa Cum Laude honors in June, but with her Associates in Arts from MiamiDade College as part of the Dual Enrollment program and with the CDA certification as part of the Early Childhood Education program. She has done all this while being the 2016 Class President and involved in several organizations on campus including the Key Club and the National Honor Society. She will be attending the University of Florida in Fall 2016
