Township officials announced that they will appeal this decision. For many years, residents in SSP have claimed that they are not treated as equals by the rest of Berkeley. By a strange quirk of history, this area –which is between the borough of Seaside Park and Island Beach State Park – is part of Berkeley Township. By Chris Lundy BERKELEY - There’s milkweed in a butterfly garden. There’s a honeybee hive box by the pumpkin patch. Both are there to bring pollinators to the Wrangle Brook Community Garden. In addition to these, other helpers have been coming once a week.Members of the ARC have been working in the garden. They pull weeds, plant seeds, and pick ripe fruits and vegetables. Lisa spent some of her time pulling dead leaves to keep the plant healthy. “He’s bad. He’s got to get taken out. They learn techniques to see what they might like to do. They’re always looking for more job sampling options, she said. Mark Baranyay is an intern with the Master Gardener program who does outreach for the garden, going to elementary schools and getting kids interested in gardening. This transitioned to working with the ARC. The members were very excited and asked if they can come back one day a week. “They started planting herbs, like dill. They did great,” he said. “I look forward to my Wednesdays.” The ARC members asked questions, and listened carefully as Baranyay explained how to know when blackberries were perfect for picking. Then, he let them sample some of the berries that they picked. Other things they picked went to food pantries, so they also felt proud that they were helping people in“He’sneed. taught us so much,” said Tiffany. “I’ve got to say I was impressed with the strawberries.” The garden opened several years ago on an unused section of land between Lakehurst Road in Toms River and the entrance to Silver Ridge Park East. This area used to have a small beach for the branch of the river, and a basketball court. Over time, it had been abandoned. Then, volunteers turned it into a community garden. Being that close to the river, there are no artificial fertilizers and no pesticides. Some residents have their own boxes that they tend. Pounds and pounds of food are donated to food banks. There’s even a memorial garden for one of the founding members. The township cuts the grass and takes out the garbage. There are compost bins out back to recycle unused organic matter. There’s also decoy plants to keep the deer fed so they don’t try to get at the fence. They recently donated more than 30 pounds of beans and 19 pounds of garlic, garden coordinator Bonney Parker said as an example. Other crops include lemon drop squash, Swiss chard, pepper, and more. It went on to say, “the undisputed facts demonstrated by the petitioners leads this court to the conclusion that the outcome of this process was in fact predetermined…Rather than conducting a fact finding hearing, the members of the Planning Board became part of the adversarial process.”
Among evidence, the court noted that the Planning Board’s planner, Stuart Wiser, privately advised board members how to respond to concerns raised. He was not a witness, so SSP could not cross-examine him.
Additionally, the Planning Board and Township Council held joint meetings to discuss strategy. Planning Board members expressed during meetings and on their own time that they opposed de-annexation.CouncilmanJohn Bacchione, who is on the Planning Board, told members of the Italian-American Club “if South Seaside Park becomes Seaside Park, your taxes are going up.”
“We are happy with Judge Marlene LynchFord’s decision and the fact that she recognized the way Berkeley Township treated the petitioners from the outset of our action,” Whiteman said. “She found that the decision of the governing body of the Township of Berkeley, declining to approve de-annexation, was arbitrary, capricious and“Judgeunreasonable.Lynch-Ford also acknowledged the incongruity of our governing body being located six towns over the bridge and she agreed, based on her decision, that South Seaside Park residents are better served by a like-minded community that is contiguous to another town on the beach,” he said. Township Business Administrator John Camera, who is also at Planning Board meetings, testified that the SSP members were “elitist.” A Planning Board member who lives in SSP had a sign against the petitioners on his property.
SSP’s witness said that the average home in Berkeley, valued at $183,600, would see an increase of $35 a year. The township’s witness said the increase would be about $200 a year, which would increase in perpetuity. The court opined that Bayville could make up for that loss by allowing more development on the mainland, agreeing with the plaintiffs that Berkeley would recover from it in about five years. The court also said that Berkeley’s loss wouldn’t be felt as strongly because they would be spending less in services for that community. SSP’s expert also said that they would see their taxes go down by 40% if they joined Seaside Park. Long Trials Resident Don Whiteman has been organizing SSP to make the change, which is officially called a de-annexation. There were 285 signatures from that neighborhood wanting to leave, which makes up about 66% of the area’s registered voters. There are about 1,400 properties in that section of town. The Planning Board had 38 hearings on the issue from 2015 to 2019. In 2020, the Planning Board issued a resolution suggesting that the Township Council deny de-annexation. The Council agreed. Then SSP challenged the council’s vote inJudgecourt.Marlene Lynch-Ford agreed with SSP that they should be allowed to de-annex. The South Seaside Park Homeowners and Voters Association stated that the mainland is too far away for government services, if a resident has to do business with the town. If police, fire, or first aid is needed, it is most likely to come from a town on the barrier island instead. However, recently, Berkeley did open a satellite building in a former real estate office in SSP that offers governmental services and also serves as a police hub. Similarly, the town has one of its summer concerts at SSP, and based a farmers market there as well. “Our courts have considered not just the tax impact of de-annexation, but also the ability of the petitioners to have meaningful participation in religious, cultural, civic, charitable and intellectual activities of both the community from which they seek to secede as well as the community they wish to join,” Lynch-Ford said. Citing case law, the judge said that the burden of proof was put on the SSP residents to show how Berkeley’s refusal to allow them to secede was “arbitrary and capricious.” They also had to show how they were going to be hurt by staying, and that Berkeley wouldn’t be substantially hurt if they left. The court said that clear evidence of “bias, prejudice or collusion by a municipal body” means that the decision could be arbitrary and capricious.
The court found “a pattern of continuous acts and statements by members of the Township Council and the Planning Board reflecting opposition to the de-annexation.”

Some SSP residents have said they have felt marooned by the township, receiving less services. They feel that they have more in common with Seaside Park and might be better off there. Tax Impact Although the hearings discussed recreation, transportation, and a number of other issues, the main point on everyone’s mind is money. It was once declared that SSP makes up about 10% of Berkeley’s taxes, despite being only 1% of their population. If the taxes stop coming from SSP, and everything else remains the same, Berkeley would have to raise taxes on the rest of the town to make up for the loss. The sides disagree on what the impact would be.
“It defies logic and common sense that the plaintiffs be obligated to traverse six or seven municipalities in order to integrate into the community, social and civic affairs of Berkeley Township,” she wrote.
There had also been arguments during the hearings about whether the Planning Board and professionals were truly neutral. The town pays the attorneys and engineers that work with the Planning Board, and the council approves their payments. So, would that mean they are working for the town, and are therefore biased toward the town? SSP’s attorney, Joseph Michelini, questioned the motives of the professionals’ providing testimony.Thecourt also decided that even being geographically distant from most of Berkeley is in itself a reason to leave. A SSP resident might have to drive through six towns to get to Town Hall. Berkeley has two other non-contiguous portions: part of Pelican Island, the land you touch down on first after you drive over the bridge to Seaside; and Manitou Park, which is north of South Toms River.

The Covered Bridge To politicize the baby formula shortage feels more like a knee jerk reaction without proper comprehension. So let’s try and clear up the apparent confusion on who’s to blame for the shortage. With the midterms around the corner, there seems to be more interest in whether President Biden will run again or not. Many think the President has done enough to satisfy I’m a news junkie and two headlines from (the weekend of July 30) struck me as showing the difference between this administration and the last one. Let’s start with the current administration. Biden announced that top Al Qaeda leader Ayman al-Zawahiri, one of the plotters behind the attacks on Sept. 11, was killed by U.S. forces. “Justice has been delivered. And this terrorist leader is no more,” Biden announced. U.S. intelligence had built a model of his safehouse and used a Hellfire missile that does not explode, but rather kills by nature of it being a 100-pound weapon fired at a person. Before impact, blades extend from the sides of the weapon. It was fired from a drone. All of this was done to minimize civilian and allied casualties. This same weekend, Trump hosted the Saudi government’s LIV golf tournament at his course in Bedminster, right here in New Jersey. The Saudi government had an important role in planning Sept. 11, and they continue with terrorism to this day. But Trump welcomed them with open arms because they have money. If there’s any discussion about which president is tougher on terrorism, one needs to look no further than what happened in one weekend. One president kills terrorist leaders. The other one embraces them.

The permissions were set to expire November 30, 2022 but will now be extended by two additional years to support the food and beverage industry, patrons, and local communities by facilitating opportunities to serve customers outdoors. “My Administration worked in collaboration with the Legislature to support the restaurant industry and their customers by expanding outdoor dining during the COVID-19 pandemic. The Governor authorized municipalities to enable the expansion of outdoor dining during the COVID-19 pandemic to protect residents while supporting food and beverage establishments. Many business owners have continued to offer outdoor dining since beginning to offer outdoor seating during the summer of 2020. This legislation will authorize continued use of fixtures such as tents, canopies, umbrellas, tables, and chairs for outdoor dining until November 30, 2024, extending a law that was signed by the Governor in February of 2021. This represents another part of the Governor’s ongoing support for small businesses, which includes the additional $50 million investment in the FY2023 budget for the Main Street Recovery Fund that has assisted many restaurants and other small businesses.

If that sounds familiar, it should. The residents still think Bayville is too far away to do business. However, their children would still go to Central Regional in Bayville because Seaside Park also sends their kids there.
The junior Whiteman told The Berkeley Times this year that the major reason it didn’t go through back then was because of a change in leadership in the borough of Seaside Park. The mayor and council had agreed to take SSP under their wing. But after an election, the new mayor and council put it to a vote among the residents of Seaside Park, where it was narrowly defeated. The original attempt lasted from 1974 to 1982.
The modern movement has grown from similar factors, exacerbated by issues like the revaluation of the town years ago that made some shore properties pay more in taxes.

Just because the court decided that SSP can leave, it doesn’t mean that it’s automatic. “The governing body authorized our attorneys to immediately file an appeal to the decision. We strongly believe the trial court applied the incorrect standard of review under the statute,” Business Administrator John Camera said. “Additionally, the Judge decided that the remaining taxpayers of Berkeley Township have some kind of obligation to subsidize the petitioners attempt to lower their own taxes.”
Berkeley’s attorney in the 1970s, Thomas Muccifori, contended that if SSP left, it would mean a $19 million loss in ratables that would impact the township’s ability to borrow money. The township’s feasibility study said that it would raise taxes by 23 cents per $100 of assessed valuation and increase sewer rates by $10 a year. The attorney also argued that it would impact the racial make-up of the town, since a largely white area would be leaving a racially mixed township. Also, he argued the decision was made by the year-round residents without say from summer residents.Inthe1970s, SSP had been represented by attorney William Miller, who had also represented West Point Island to successfully secede from Dover Township (now Toms River). West Point Island and Westmount Shores both left Dover Township and joined Lavallette. In that article, he told the NYT “The secession will mean a large loss of ratables at first, but Berkeley Township has so much room for development that we think it can make up for this loss in the not-too-distant future.” He said it would cut costs for Berkeley for the amount of services.
The same arguments were made by Superior Court Judge Marlene Lynch-Ford when she decided that Berkeley should let SSP de-annex, or secede, in 2022. The 1970s secession was led by Don Whiteman, the father of the Don Whiteman that is leading the charge today. The elder Whiteman said “We want local representation, we want a voice in government, and we want our kids to stop riding two hours each day to school. To Berkeley Township, we are secondclass citizens here.”
The appeal process will likely take more than a year, Whiteman said. If the court still agrees with de-annexation, then SSP residents will have to vote on it. If they agree to leave, they still can’t if the Township Council won’t let them. Even if the Township Council allows them to leave, SSP will have to make a petition to join Seaside Park. Officials there have remained silent on the issue in the press. South Seaside Park would receive more care and Seaside Park’s taxes would go down if they joined, Whiteman said. This current struggle started in 2014 with a petition but another attempt to leave had started with Whiteman’s father and Judy Appleby in 1974.

By Chris Lundy BEACHWOOD – What came in as a shed fire turned out to be a house fire, but fortunately no one was injured, officials said. The call came in a little after 2:30 p.m., Beachwood Fire Chief Roger Hull said. Initially, the caller believed it was on the 200 block of Pennant Avenue, but it was actually the 200 block of Windward Avenue. An enclosed porch backed up into the living area of the home. The fire was fully involved when first responders arrived.
Pine Beach, Manitou Park and Pinewald Pioneer fire companies also responded to the blaze and Bayville Fire Company covered Beachwood during the incident. Beachwood EMS also responded. By Chris Lundy TOMS RIVER – High School East Principal Patrick Thomas was appointed by the Board of Education to be a new assistant superintendent, but it was not a unanimous choice. Superintendent Michael Citta said that Thomas has been in the district about 27 years, of which he’s been a principal for about 11-12. Although the assistant superintendents all collaborate on everything that goes on in the district, they each have a specialty. This position is for grades 6-12. “When I was looking to fill the needs of a secondary (meaning grades 6-12) assistant superintendent, I wanted someone with practical building experience” and to hire from within, Citta said. “We interviewed a litany of people.”

In case you’re worried, I want to assure you, that almost everyone in this current outbreak is alive and well. I doubt you will know anyone who gets sick with it, it’s very rare! 7. What is the USA monkeypox case count? Answer: It is unclear. The CDC has a website you can visit to see the live case counts in the USA. But the exact count for monkeypox is unclear. The number they post there includes both monkeypox cases and orthopoxvirus cases, combined. The latter includes smallpox, vaccinia virus, and cowpox. So the monkeypox case count just by itself is opaque.
4. What are the symptoms? Answer: Fever is always part of the syndrome, along with headache, muscle aches, and other flu-like symptoms. Lesions and ulcers occur as well. If you develop these issues, call your doctor, and limit contact with others.
