A Seller’s Guide to Real Estate Short Sales We are seeing more and more of these situations in the current, depreciating real estate market. If you bought or refinanced a home in 2004, 2005 or 2006 and got 80% financing or higher you are probably “upside down”. If you have to sell now; and don’t have the financial resources to bring money to closing to cover the “short” pay off, you are a likely candidate for a “short sale”. If you can no longer afford your monthly mortgage payments because of a change in your financial situation…and are delinquent for 2-3 months or more…you have probably already been contacted by a representative from the lender’s “loss management” or “work-out” departments. Pre-Foreclosure activities may have already commenced. The lender may have filed for a judgment to foreclose on your mortgage and a Lis Pendens may have already been recorded. Depending on the length of time involved and your willingness to communicate with and/or work out alternative arrangements with the lender…there may already be a foreclosure date set. This is not a hopeless situation! It is possible to sell your house, get out from under the payments, avoid Foreclosure and possibly salvage your credit! Are you a candidate for a Short Sale? Is the current market value of your property; less selling costs, more than what you owe on it?Do you have enough assets to cover the shortfall? Can you afford to bring money to closing? If you answered NO to thesequestions,you may be an ideal candidate for a short sale. What is the Process to successfully sell your property in a “Short Sale?” Sign a listing agreement with your Realtor. An above market commission is suggested because you

want to give cooperating Realtors an incentive to show and sell your property instead of the many others available. Also, the lender will want to try and negotiate the commission down when a “short” offer is submitted. This gives your realtor a little leeway to work with the lender. There is also MUCH more paperwork involved in a short sale scenario. The Listing agreement, short sale addendum, and Seller’s property disclosure will state that “Any contract resulting in a “short sale” is subject to third party lender approval.” Sign a Letter of Authorization with your Realtor to allow them to speak to and negotiate with the lender on your behalf. This letter needs to include the loan number, address of the property, the date, and your contact information. The letter must be signed by all of the parties to the loan. Disclosures. On the Seller’s Property Disclosure where it asks “is there any existing or threatened legal action affecting the property?” make sure that you check yes if there is a Lis Pendens or other pre-foreclosure activities in process. . If it is likely the only way the property can be sold is with a “short sale”, make sure you sign a short sale listing addendum. Get a “short sale” package from the lender’s loss mitigation department. Your realtor can help you with this. Expect them to ask for financial information from you, including pulling a credit report and requesting bank statements. They will also want pay stubs, a hardship letter, financial statements and 2 years income tax returns.Under no circumstances can you walk away from the closing table with money. General Notes 1. You will have much more leverage with the lender when you have a signed offer in hand. Price your property aggressively.

“short sale” deal than they stand to if they don’t do the deal…they will PROBABLY do the deal. The lenders usually use 80% of today’s market value as their bottom line number. 3. The lender will probably negotiate their short sale terms in this order. Their goal is to protect the principal first and the yield second. (A) Pre-payment penalty the first and easiest thing to negotiate off. (B) Late charges and penalties – the next easiest things to get off. 4. Strive for a quick closing before months’ end. Lenders hate to carry over to the next month!

The preceding are general guidelines designed to help facilitate a short sale. However; just like Real Estate in general, short sales will all be different and have their own unique characteristics. Many factors will come into play including: the lender’s corporate policy on short sales, your status with mortgage payments, your overall financial condition, the strength of the contract presented, market conditions, and personalities. Negotiating skills are still very much in play here. Contact a knowledgeable Realtor for a much more detailed analysis of your own situation. Monthly Real Estate Market Commentary By Peter Zalewski of Condo Vultures

“Calling The Bottom Of The Real Estate Market”. On July 9th Condo Vultures sent out a market update with a headline that read. “Calling the bottom of the real estate market”. In short it went on to say: This July not only marks the start of the third quarter of the year but an increasing debate amongst industry watchers about when the bottom of the real estate market will be reached. In Florida where residential sales peaked in November 2005, the real estate market has struggled ever since with a combination of weak demand and plummeting prices for 33 months and counting. Optimists yearning for a recovery point to the fact that a typical real estate cycle lasts between seven to 10 years, meaning the chances of a gradual improvement in Florida could be near.

Given the conflicting ideas, calling the bottom of the market with any accuracy in the overbuilt markets of Florida is unlikely to occur until months after prices have already leveled off. Condo Vultures went on to say that residential lending needs to be restored and at least one small bank in Florida needs to be severely reprimanded by the federal regulators before we have a clear sign that the bottom was in. Within days of this analysis the feds seized IndyMac bank, after that it was First National Bank of Nevada and First Heritage of California. Additional banks since then have been closed by the fed’s. While they are not in Florida it shows the correction process is quickly moving forward. Some of the banks in our area (Palm Beach County) have started to close on their short sales faster than they have been. Possibly these banks have gotten the message and they are beginning to realize that they must unload their troubled loans a little quicker.

Pessimists respond that this real estate cycle in Florida is not like others given the widespread speculation that occurred unchecked between 2003 and 2006, and ultimately produced the excess inventory that now plagues the market.

Some industry watchers predict the recovery to begin in earnest when well-qualified buyers are once again able to purchase residential properties using traditional financing with moderate underwriting requirements.

The black tarps that you see in those countries, and increasingly here in South Florida are not tarps at all. They are "green" solar collectors. Solar water heaters and solar pool heaters are the most common form of solar energy systems used here in the USA. With our abundant supply of sunshine, South Florida is an ideal location for a solar water heater as well as a solar pool heater. A mechanically minded homeowner can install these systems by him/herself, or with the many installation companies available, these money saving systems can be installed with minimal disruption to our busy lifestyles.

They both work in a similar way. Basically a large thin black panel gets heat from the sunshine and our overly warm weather. Slowly water is pumped into the system into the panels from the tank (or pool), and the temperature of the water rises. Because of our warm weather, the systems here are simpler and less expensive to build and operate than those in colder climates. The average cost of heating a pool can run as high as about $1500 if you use electricity directly, or about $500-$600 using either an electric heating pump or natural gas/propane. The system should reduce that amount to zero dollars per year, though there still may be instances when electric or fossil fuels might have to be used. Solar pool heaters have an average installation cost of $2000-4000, and pay for themselves in as little as 2-4 years. Inside your home right now, the average family of 4 is using close to 70 gallons of hot water a day. That should be costing you about $400 per year. Installing a solar water system can save you close to $200-300

per year, knocking that bill down to a mere $100. Though the cost runs from $3000-6000 for installation, there are tax credits available. You can even finance this system in your home mortgage or solar installation companies can finance it for you. The savings on electricity will be far more than the financing costs. A solar water heater and pool heater (two separate systems) are also generally maintenance free and by using Mr. Sunshine, your contribution to the nice people at Florida Power and Light will be dramatically reduced.
