POSITION: Senior Expert (Category 2), Business Environment Lawyer

1. Objective(s) and linkages to Reforms Ukraine has made a considerable progress in establishing better business climate – implemented reforms of regulations, laws and permits. However, economic performance is going slowly. Despite apparently sound reforms, business complains about day-to-day problems with bureaucracy and administrative barriers to investment, including inconsistent interpretations of laws and procedures in different parts of the country. This situation also leads to a conclusion on poor implementation of fairly high quality strategies and laws. The Government is conducting a series of measures to improve business climate in Ukraine, starting from holding of CMU deregulation sessions, where adopted sets of deregulation projects that improve Ukraine's Doing Business Rank. Reform Support Team (RST) at the Ministry of Economic Development and Trade of Ukraine (MEDT) being a group of Ukrainian professionals (non-civil servants) funded on a temporary basis by international donors provides targeted technical support and assists the MEDT in the implementation of reform aimed to establish better business climate in Ukraine. The main objective of a lawyer will be to provide legal support for these changes. 2. Duration and proposed timeframe Duration of assignment is until 30 June 2019. Subject to the availability of funding, the performance of the selected consultant and the specific needs of the RST, this appointment may be extended. The Consultant shall deliver services in Ukraine and for no less than working 20 days per calendar month. 3. Main Duties and Responsibilities  Legal and procedural support to the Business Environment Team  Providing expertise of existing legislation, international conventions and Doing Business best practices, development of recommendations for structuring and implementation of deregulation reform  Deregulation projects initiatives evaluation on the results of work with representatives of the business environment, preparation of recommendations with their further promotion in MEDT or/and BRDO  Providing legal analysis of current legislation and proposals preparation for its amendments in order to establish better business climate in Ukraine  Legal support to the deregulation projects in MEDT, constant close work with the MEDT representatives during projects drafting  Legal support in drafting of innovation law and by-laws  Collaboration with internal legal department of the MEDT for implementation of deregulation projects  Preparation of presentations and analysis of legal acts 4. Main anticipated deliverables  Recommendations for structuring and implementation of deregulation reform are provided to all stakeholders

Deregulation projects initiatives received from the representatives of the business environment are evaluated, recommendation for the MEDT are prepared and provided Deregulation process adjustments are aligned with the MEDT policy Legal support to the deregulation projects in MEDT, incl. drafting of innovation law and by-laws, is provided All necessary legal acts aimed to establish better business climate in Ukraine are adopted and enacted Strategic sessions and workshops on Business Environment issues are conducted Required documentation and presentations needed for Business Environment legal acts preparation are drafted

5.1 Qualifications and skills:  At least Master’s degree in law from reputable Ukrainian university  Strong analytical, communication and presentation skills  PC literacy (PowerPoint, Excel, Word; Visio and Project is an asset)  Fluency in Ukrainian and English 5.2 General professional experience: ● Preferably more than 10 years of general professional experience (minimum 5 years of working experience as a lawyer). Prior experience of work in public services reform team is a plus 5.3 Specific professional experience: ● Proven knowledge and professional experience in Ukrainian law ● Experience working with multidisciplinary teams is an asset 6. Assignment Value The estimated monthly value of this consultancy position is in the region of 800-1400 EUR. The funding source of this assignment is the EBRD Ukraine Stabilisation and Sustainable Growth Multi-Donor Account (MDA). The contributors are: Denmark, the European Union, Finland, France, Germany, Italy, Japan, the Netherlands, Poland, Sweden, Switzerland, the United Kingdom and the United States of America. 9. Selection Procedure Following the evaluation of all applications received, selected candidates will be invited to a brief written test and interview in covering both general and technical questions in both English and Ukrainian. Only short-listed candidates will be invited to a final interview.
