LETTER FROM THE PRESIDENT SHANE LIDER 2021 MAB PRESIDENT
It’s been an honor to serve Happy Fall everyone! I hope this year has been treating you well. As I am writing this letter it is the end of August and looking forward to some cooler temperatures and hopefully some much needed moisture to help with this drought we are going through.
Birdie with the Builders was another great event this year, but very HOT! We have the Guns and Roses Shootout coming up shortly, but that will be over by the time you read this. If you made it out, I hope you had a great evening out shooting, eating and networking. Also, keep an eye out for all the upcoming events we have including the Business After Hours events which are always a good time. Don’t forget we have Bags and Builders coming in October and also the Builders Bash coming later this year. Hope to see you at a few (or all) of these events!
Since this is my last letter as your 2021 MAB president, I It has been a great honor to serve as your 2021 President and would like to thank everyone for a good year, and the board I look forward to seeing what 2022 has to bring. members for all the hard work they put into the association. MORE ABOUT THE AWARDS: Builder and Associate of the Year: these awards have been around since 1980 and are based on work expended in the interest of fellow members, the Association and the community within the past year (Sept. 1, 2020 – August 31, 2021). These members are judged on: member involvement and industry promotion, civic activity, professional accomplishments, local association activity, and state and national association activities.
Recipients of the Builder & Associate of the Year Awards will be chosen by board members and the MAB staff. The award will be presented at the December 2nd Builders Banquet. Local winners go on to represent the MAB for consideration in the North Dakota Association of Builders’, Builder and Associate of the Year Awards selection in November.
BEAM Award: It stands for “Builders Engaging Associate Members,” and is meant to recognize Builder members who exemplify the motto “It’s good business to do business with a member.” Associate members nominate Builder members for this award. The MAB names a winner on the local level that advances to the state (North Dakota Association of Builders) level, and possibly to the national level with the National Association of Home Builders.
The Builder member nominees will be evaluated on loyalty, ethics, trust, communication, and consideration. The Builder who receives the most nominations will be notified and asked to submit their list of suppliers/trade contractors. MAB staff and the board of directors will make a final decision following submission of the list.
Citizen of the Year: In choosing the recipient of the MAB Citizen of the Year award, regard is given to the nominee’s significant contribution to the community, the scope of impact the individual’s contribution has had on the local area, and whether or not the nominee is an inspirational role model for the community. This citizen does not necessarily need to be a member of the Minot Association of Builders.
Dan Feist Extra Mile Award: This award was introduced in 2016. The Extra Mile Award is designed to recognize someone who has made an exceptional contribution to our organization to help MAB carry out its mission.

With housing in such high demand, it may be tempting to build and design homes the same. After all, if people are buying, what’s there to change? Architect Deryl Patterson of Housing Design Matters says now is the time to do the opposite and examine what exactly is driving the demand for housing. Patterson says it’s because of the pandemic that buyers are seeking homes that better reflect their lifestyles. Prior to the pandemic, homes were mostly used to sleep in, so buyers were more willing to settle. But now with commuting, working, schooling, shopping, dining, and more factors of life shifted by the pandemic, what homes do and offer has drastically shifted.
How much of that has changed? During lockdown, virtually none of that was possible. Homeowners quickly grew attuned to the deficiencies in their houses. From the Executive Director, SEPTEMBER 2021 Developing, preserving, and stabilizing affordable housing cannot be accomplished by one entity alone. North Dakota Housing Finance Agency (NDHFA) is proud of the everyday work our partners do and how they go above and beyond at times when people are most in need. For almost four decades, NDHFA has formed relationships with the federal government, other state agencies, local communities, the public and private sector, and for-profit and non-profit organizations in pursuit of our affordable housing mission. A celebration of partnership that NDHFA recently participated in highlighted Wells Fargo and Beyond Shelter, Inc.’s (BSI) collaboration. Over the last 22 years, they have worked on 12 developments together, creating 346 affordable homes. Most of the project were supported by programs administered by NDHFA. Wells Fargo’s total equity investment is more than $35.5 million. During the gathering held at BSI’s Homefield 3, a senior multifamily property in Fargo, a resident talked about the transition from being a country girl to now living in the city. She said, “Our state and community, they give us this opportunity to live in a convenient area where I have medical, groceries, hospitals, I have whatever I need, and I don’t have to go far….and the homes are clean, comfortable and convenient. It’s more than I ever expected.” Other partnerships bring new business models into our state. In 2018, Patterson Place Apartments were acquired by the Schuett Companies, Inc. of Golden Valley, MN. Their recently completed rehabilitation of the apartments, located in the historic McKenzie Building in downtown Bismarck, preserved 117 affordable rental homes. During construction, the residents didn’t move out of the building; instead, the units were remodeled during the day with the residents returning each night. One resident, who has lived at Patterson Place for 10 years stated that he likes how the building is more modernized and appreciates the new windows that don’t leak water inside when it rains. During a time of crisis, having good partners is critical. US Dept. of Housing and Urban Development, ND Dept. of Human Services, NDHFA, property managers, housing counselors, renters, utility companies and communities are working through the ND Rent Help program to keep renters housing stable. To date, more than 2,400 households have been assisted with 1,139 housing providers receiving more than $8 million in rental assistance.
Currently, NDHFA is seeking input from our partners on the 2021 Annual Action Plan and HOME Distribution Statement and the Annual HUD Report (CAPER). The agency is also accepting applications for development assistance through state and federal programs we administer. Receiving good insight strengthens funding plans and ensures a more robust vision for future financial allocations. EPA DECLARES PRE-2015 WOTUS RULE NOW IN EFFECT Source: nahbnow.com on September 3, 2021
Following the U.S. District Court for the District of Arizona’s ruling on Monday to remand and vacate the Navigable Waters Protection Rule (NWPR), which defines the “waters of the U.S. (WOTUS),” the U.S. Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers (Corps) released a joint statement on EPA’s website today stating “the agencies have halted implementation of the Navigable Waters Protection Rule and are interpreting ‘waters of the United States’ consistent with the pre-2015 regulatory regime until further notice.” This unilateral decision by the agencies, without public input, means that landowners must immediately follow the federal definition of WOTUS that existed prior to both the Trump and Obama administration’s WOTUS rules. While the agencies reiterated their commitment to change the regulatory definition of WOTUS under the Clean Water Act (CWA) announced in June, that effort is expected to take more than a year to complete. As previously reported, NAHB Senior Officers, members and HBA staff testified at a series of hearings throughout August to voice their support for retaining the NWPR and thereby avoid having the agencies revert back to asserting federal control over non-navigable and isolated wetlands, ephemeral streams, and roadside drainage ditches.
Using the “significant nexus test” to determine federal jurisdiction over non-navigable, isolated wetlands, roadside drainage ditches, and ephemeral features; Asserting federal jurisdiction over adjacent wetlands by including isolated non-adjacent wetlands that lack any surface water connection to a traditional navigable water; Allowing federal regulators to aggregate all isolated features across the entire watershed as “similar situated” to assert federal jurisdiction over the entire group; and Establishing federal jurisdiction over roadside ditches based intermittent or even ephemeral flow.
The regulated community faces significant regulatory uncertainty in light of the agencies’ decision, as sections of the pre-2015 rules have been found unlawful by the courts, and the guidance documents provided by the agencies have been superseded by more current guidance. NAHB is exploring all options to limit this federal overreach, as well as the challenges this reversion to the old rules will create. We will continue to keep members updated on further developments and provide additional guidance once it becomes available.
NAHB urges the agencies to reconsider this decision in light of previous problems with the pre-2015 WOTUS rule, including:

HBA of F-M has taken action to correct that by initiating economic impact study. For months, HBA of F-M members and multiple cities have been submitting data that the National Association of Home Builders Economics Group will evaluate and measure how homebuilding impacts our own metro area. Chief Economist and Senior Vice President for Economics and Housing Policy Dr. Robert Dietz will present the findings in Fargo on Oct. 5. There will be a press conference in the morning and a VIP social with Dr. Dietz later in the day. The Impact and Honors Dinner will be held that evening during which Dr. Dietz will formally announce his findings and HBA will honor some it most committed and enthusiastic members. Building Industry Connect: HBA has launched Business Industry Connect: an ongoing series of social events providing HBA of FM members a platform to meet and interact with the government officials and administrators who shape housing policy. It is an opportunity to learn leaders' visions for housing in our community and for members to introduce the Association and its goals. No presentations, no agendas and no parliamentary procedures. Just the chance for officials and members to learn about each other. Major policy changes happening in Horace: City government has been very active in Horace and considering strategies for helping the city adjust as it goes and adapt to what has already changed. HBA of F-M leaders have been on the forefront as a partner to the city and an ambassador for the homebuilding industry. WHY BUILDERS SHOULD DO BUSINESS WITH NAHB MEMBERS One of the benefits of NAHB membership is the ability to easily network and do business with other members in the industry. The NAHB BEAM (Builders Engaging Associate Members) Award is given by NAHB’s Associate Members Committee to one builder (or one local entity) who best exemplifies the motto, “It’s good business to do business with a member.” This award encourages builders to use the goods and services offered by Associates. The Kochmann Brothers, a company owned by Bob and Paul Kochmann and Darrick Guthmiller, are home builders from Fargo, N.D., and members of the Home Builders Association of Fargo-Moorhead (HBAFM). NAHB members constitute 95% of their business vendors — a key factor, along with their dedication to the industry and community, in their acknowledgement as the 2020 NAHB BEAM Award winners. “We are a small business and depend greatly on our trade contractors and associate members to succeed,” said Bob Kochmann. “We view them as part of our company because, in the end, it is a team effort to keep our industry strong.” Bob, Paul and Derrick have all been extremely active in the HBAFM throughout the years. Bob and Paul have been members for more than 35 years and recognize the value of a network of building industry partners. Darrick is the 2020 HBA president and served in that position in 2013. All three are also past Builders of the Year. “The Kochmann Brothers are the epitome of integrity. They look at all trade partners as partners,” said Terry Lipp, builder salesman for Ferguson Bath, Kitchen & Lighting Showroom and business vendor of the Kochmann Brothers. “Sometimes things don’t go smoothly or between trades. They’re the type of people who look for a solution through joint efforts. If they have an issue, we always work together to get it fixed for the client, because we all recognize the client is most important.” The Kochmann Brothers are also well-known for recruiting new members to the HBAFM, because they believe in keeping the industry strong by working with other members. “They feel strongly that it’s important to support trade contractors and suppliers who have similar goals and believe in the betterment of our industry through supporting the Association,” said Bryce Johnson, HBAFM executive officer. “They sit down with all their non-member vendors, explain the benefits of membership and share all they’ve done over the years. They embody what membership is all about: members doing business with members.” Fellow nominees for last year’s BEAM Award have also shown the value of collaborating with NAHB members to help grow and strengthen the industry: Tim Ruth — a builder member from Iowa City, Iowa, and a member of the Greater Iowa City Home Builders Association (GICHBA) — helped to create and oversee the ACE (Architectural Construction and Engineering) program with Joe Greathouse, an educator at Kirkwood Community College. The ACE Program — which spans seven counties, two HBAs, one community college, and 32 K-12 school districts — systematically tackles the labor shortage and provides education to students. “Tim eats, breathes, and lives the mantra of not only getting people into the industry, but utilizing the relationships and connections of those already involved in the HBA,” said Greathouse. “His passion for it is contagious, and often spurs others about how they can get involved, too.” Joe Atalla is a home builder from Meridian, Idaho, and a member of the Building Contractors Association of Southwestern Idaho (BCASWI). Atalla is highly involved with the NAHB Federation and is a lifetime SPIKE. When working with vendors who aren’t members, he doesn’t fail to share the value of membership and encourages them to join. “I know so many people who are members because of Joe,” said Ken Rock, a business vendor and Associate member. “The amount of members Joe has recruited speaks to his level of trust and affinity with him.” Lynne Herrick and her husband selected Dan Mitchell — a home builder from Knoxville, Tenn., and a member of the Home Builders Association of Greater Knoxville (HBAGK) — to build their home after seeing him present at a Log & Timber Home Show. “During the construction of our home, it didn’t take us long to figure out that every single subcontractor that was part of Dan’s team were all members of the Home Builders Association,” she recalled. “Not only were they members, but they also were fine in their craft. By the time construction was completed, it didn’t take long before Dan was recruiting me to join the HBAGK myself as an Associate to represent my business with Aflac and the Home Builders Association of Tennessee (HBAT) health insurance,” she added. “Soon, I was networking with different business owners as an Associate and attending different events.” The MAB Homefront || 25 || Fall 2021
