Well...2020 has definitely been an adventure! Covid-19, race relations, stock market tank / recovery, endless virtual meetings and Tiger King! What's next? No one can say this year has been boring. Even with all that, it's time to get to work and make the best of the second half of this year. Luckily there are still a lot projects that need to be built or remodeled. Now we just have to do it in a more condensed building season.

MAB events have started again! Don't miss out. Attendance has been great which adds to the networking opportunities. Thank you again to MDU for sponsoring our June event. We had a great time. Don't forget to sign up for the golf tournament on July 27th. There are limited team spots available so lock up your place today. The annual trap shoot is on August 25th and the Parade of Homes on September 26th.

The Project Hub will be a one-stop shop for attendees to speak to professionals about small projects that are on their list, and be able to get a head start on the planning process. The Project Hub will be located at The Depot in downtown Minot on Saturday, September 26th from 10AM—4PM. The Project Hub will also be a ticketing location and will have a bartender crafting cocktails on-site at The Depot, with food trucks located outside. The coronavirus pandemic has put a strain on the mental health of nearly everyone in the world. Economic uncertainty, forced solitude and worries about contracting the virus have increased stress levels in most adults. But even before the pandemic, construction workers were particularly susceptible to mental health issues and suicide. More construction workers die by suicide each day than all workplace-related fatalities combined with a rate of 43.5 suicides per 100,000 workers, second only to the mining and oil/gas extraction industry. Following a multi-year initiative to combat opioid misuse in home building, NAHB is launching a new effort focused on member mental wellbeing. Recent research suggests that industry associations have been overlooked as an agent for change, and that they have a role to play in promoting the importance of worker health and wellbeing to their member organizations. To kick off this initiative, at the recent virtual Spring Leadership Meetings, Cal Beyer, Vice President of Workforce Risk & Worker Wellbeing at construction risk management firm CSDZ, spoke to members of the Construction Liability, Risk Management, and Building Materials Committee and the Construction Safety & Health Committee, which are spearheading the initiative. During his presentation, “Focus on Workforce Wellbeing: What’s Under the Hardhat,” Beyer described some risk factors that may explain why construction workers are more prone to mental health issues and suicide. Many skilled trade workers are perfectionists, a trait important to successful work performance. But when combined with deadlines and a physically demanding work environment, it can lead to escalating stress. Construction workers are also traditionally stoic about mental and physical health issues as it may lead to missed work and missed paychecks. Long hours, the cyclical and transient nature of the work, and financial pressure can also lead to mental strain. While the health of the worker is the primary concern, mental wellbeing should be on the radar of company owners and managers. Stress can lead to illness and absenteeism and, of particular concern, presenteeism – being physically present at work but distracted and “half there.” A distracted worker is not a safe worker, to themselves and others. Beyer talked about understanding the different signs of stress – physical, psychological and behavioral. Unfortunately, many construction companies have yet to incorporate mental health, substance abuse, addiction recovery, and suicide prevention into safety, health, and wellness culture and programs. A major reason for this gap is due to stigma. Beyer concluded his remarks, however, by highlighting some of the positive steps the industry is taking to the promote workplace mental health awareness and reduce the stigma attached to mental health. Beyer and CSDZ have created resources for the construction industry to deal with stress and mental health issues, including resources for employers, a toolbox talk on self-care and suicide prevention resources. Beyer and other mental health experts advise employers to create a workplace that promotes respect and to offer specific recommendations to all workers, including:

| Encouraging workers to talk to their families, friends and other trusted people in their lives about their problems | Staying hydrated on the job site | Eating well-balanced meals | Spending leisure time in nature | Setting limits on digital information intake, especially political news | Above all, employers should be open to listening to any concerns raised by workers about their stress levels or mental health issues. NAHB has also joined the Construction Industry Alliance for Suicide Prevention (CIASP) in an effort to raise awareness of the prevalence of suicide in the construction industry. The National Kitchen and Bath Association has released the results of its updated 2020 Kitchen and Bath Market Outlook, which has been modified to account for the COVID-19 pandemic’s impact on the kitchen and bath industry. The report estimates the current value of the industry at $130.8 billion. “Our initial 2020 Kitchen & Bath Market Outlook was conducted in late 2019, before the pandemic hit our members and homeowners in the U.S. and Canada,” says NKBA CEO Bill Darcy. “Kitchen and bath spending had been increasing steadily prior to the pandemic at 9% in 2018 and 4% in 2019. As such, the original report projected a strong 2020, bolstered by an especially bright Q1. While the COVID-19 crisis, unsurprisingly, led to a double-digit decline in spending across all major categories, we are already seeing signs of positive growth as shelter-in-place orders are lifted, and we’re optimistic about the industry’s long-term health.” In a study commissioned by the NKBA and conducted through John Burns Real Estate Consulting, consumers cited fewer resources, limited access to industry professionals, store and showroom closures, and a fear of outsiders entering the home as hurdles to home improvements. However, lower spending in other areas and more free time spent at home has led to a higher focus on DIY home projects. As of mid-April 2020, 81% of kitchen and bath remodeling projects had been postponed or canceled, but 70% of homeowners said they plan to reschedule those projects. Kitchen spending fell by 25%, compared with 18% for master baths. Of the projects that continued through the pandemic, only 25% made use of a designer, compared with 38% pre-COVID. MAB PARTICIPATES IN NAHB LEGISLATIVE CONFERENCE The National Association of Homebuilders made the decision to move its annual Legislative Conference to a virtual meeting format in June, instead of holding the event in Washington D.C. as scheduled. Leg Con is a time for members to meet with representatives from their state to discuss valid issues in the building industry. The North Dakota Association of Builders set up virtual meetings with Congressman Kelly Armstrong, Senator John Hoeven, and Senator Kevin Cramer. NDAB Board Members from across the state logged in to have conversations with our representatives. Shane Lider, Bruce Walker, and Erika Kelly represented the Minot Association of Builders at these virtual meetings, and enjoyed the time that was given to talk to our Congressman and Senators. The following topics were outlined by the NAHB as relevant topics, and brought up to our representatives. FROM THE EXECUTIVE DIRECTOR, MAY 2020 BISMARCK, ND – It is incredible how so much can change and remain the same, at the same time. In mid- March, NDHFA closed its doors to the public and sent 80 percent of our staff home to begin teleworking. Our IT and HR departments went into overdrive, ensuring staff had the equipment and remote access they needed. While our office and parking lot are desolate, and most businesses and interactions are now done over the phone and computer, I am proud to say that we have continued to provide excellent customer service. Less than 3 percent of our borrowers have called about forbearance protocols and fortunately, most were able to make their April mortgage payment. May and upcoming months may be harder, we don’t know yet, but the staff is up to date on federal regulations, moratoriums, and guidelines to provide accurate information to assist these individuals and families, so they understand all of their options. While processing loan applications is taking a bit longer due to extra verification measures, our reservation numbers are on par with last year and our balance sheet remains strong. While compliance monitoring for multifamily housing units has been restricted to desk reviews, no on-site visits, and extensions were granted for some federal project financing to accommodate delayed construction, other federal and state programs continue to move forward because our housing partners and developers need continuity to continue to serve the state’s most vulnerable populations. New to many of us is the amount of time we now spend in meetings to conduct normal business on top of state and federal meetings to comprehend the new guidelines, protocols and regulations. A few staff are assisting on multi-agency statewide taskforces to develop and organize resources for citizens that may be housing insecure in addition to responding to citizen and media inquiries. The pandemic has been a catalyst to eliminating silos in state government. It is all hands on deck, outside of the box thinking and leveraging of the skills and time capacity of everyone willing to take on the challenge. As I stated previously, in some areas we haven’t missed a beat. The agency recommended and received approval to increase the FirstHome™ program cost limits to $294,600 for a single-family home and set the maximum income limits at $86,000 to $119,945. In 2019, the average FirstHome loan purchased by NDHFA was just over $168,000, and the average borrower’s household income was $60,600. The allocation plans for the federal Low Income Housing Tax Credit and the National Housing Trust Fund programs have been published. NDHFA reviews the plans annually to ensure they are addressing the state’s current housing needs. The next competitive application round will be in September 2020. The agency’s Helping Housing Across North Dakota (HAND) program awarded $200,000 in grants to targeted community programs for the housing rehab needs of lower-income individuals and families. NDHFA has allocated over $6 million in earnings since the program began in 1993 to assist more than 7,500 households. Finally, on May 1st, I began my first day as the newly appointed executive director of NDHFA by the North Dakota Industrial Commission. I have been with the agency for almost 40 years and it continues to be a blessing every day. Even though our office doors will remain closed to the public and no date has been set as to when we will open, I look forward to the changes and the challenges that are on the horizon within our industry and know that whether the staff is at the office or in their homes, we are always working to ensure that every North Dakotan has a safe place to call home.

Many of you are busy during our summer months and we hope you continue to practice safe distancing and CDC recommendations. According to the National Association of Home Builders (NAHB), people who work in construction are significantly more likely to become addicted to opioids, like prescription painkillers, than other workers in the general population and are six times more likely to die as a result of overdose. During these uncertain times, mental health and wellbeing has been challenged more than ever and we encourage each of you to check in on your employees. NDAB and NAHB have both changed how we hold meetings and have gone virtual. While it isn’t the same as meeting our colleagues in person, it does still give us an opportunity to conduct business and connect with each other. NDAB held our summer Board of Directors meeting virtually in early June and hosted guests from NAHB along with members from around the state. Interested in learning more about what we do at the state level? You are always welcome to join in our meeting or ask us for our meeting minutes. We always welcome new members to help us conduct business and shape the future! NAHB changed their summer legislative meetings to be held virtually as well. With that, NDAB members were able to connect with our national delegation virtually as well. Thank you to the Builder participants for maintaining social distancing at the homes, providing personal protection equipment, and monitoring visitor numbers and presence. Measures like these ensured safety and are the driving force behind the event’s success. Planning for the Fall Parade of Homes is underway. Members interviewed all willing city and county candidates appearing on the June 9 North Dakota ballot. We congratulate and look forward to working with all election winners. Details for interviewing North Dakota legislative candidates are developing. Meetings with Minnesota candidates will likely be in July or early August. The Cass County Career Workforce Academy remains a top priority and fundraising and promotional efforts continue. The cities have been generous, and we continue working closely with HBA of F-M members, the North Dakota State College of Science and Cass County commissioners to secure funding. All five local mayors have proclaimed June to be Homeownership Month in their respective cities and we engaged a fun social media campaign to promote it through the entire month. The 2020 Golf Outings will be July 14 and Aug. 11. Our members work hard and the Golf Outing is one way we help members interact and network without talking shop. The Muddy Boots Picnic will be July 29. HBA of F-M are Cass County Electric Cooperative are collaborating to make this member celebration a landmark. WATERS OF THE UNITED STATES The Clean Water Act (CWA) makes it unlawful for a person to add pollutants or dredge or fill material into a “water of the United States” (WOTUS) without a permit. Since 1972, determining which water bodies are waters of the United States has been the subject of federal agency regulations, guidance and numerous cases both at the U.S. Supreme Court and at the lower federal courts.

Navigable Waters Protection Rule Effective June 22, 2020, the "Navigable Waters Protection Rule" (NWPR) is the federal definition of WOTUS in every state except Colorado. The NWPR provides many benefits to builders and developers. For example, it exempts ephemeral features that form only in response to rainfall, eliminates ambiguous tests to determine jurisdiction, and removes many isolated features from federal jurisdiction. As a result, builders and developers should require fewer federal wetland permits and have greater ability to determine their permitting needs for themselves. EPA Repeals Controversial 2015 Rule On Sept. 12, 2019, the EPA rescinded the controversial 2015 WOTUS rule that went so far as to regulate man-made ditches and isolated ponds on private property. The 2015 rule was subject to several legal challenges that halted its implementation nationwide. Prior to EPA’s repeal announcement, the Obama-era rule was in effect in 22 states and the District of Columbia, and the previous regulations issued in 1986 were in effect in the remaining 28 states.

Why It Matters When home builders need to add fill material into a water of the United States, they must first get a permit from the Corps. Obtaining permits is costly and time consuming. For example, one study found that it costs on average $270,000 and takes 788 days to obtain an individual CWA fill permit. As the EPA and Corps expanded the definition of "waters of the United States," builders needed to obtain additional or more onerous permits, spending more time and resources to avoid wet features — this has been made all the more difficult because existing regulations do not clearly define which features to avoid.

NATIONAL NEWS NEW HOME SALES JUMP IN MAY AS HOUSING CONTINUES TO REBOUND In another sign that the housing market is rebounding from the COVID-19 pandemic, sales of newly built, single-family homes rose 16.6% to a seasonally adjusted annual rate of 676,000 units in May, according to newly released data from HUD and the U.S. Census Bureau. However, the April data was downwardly revised to a 580,000 pace, likely marking the low point of sales for the current recession. The April pace was 25% lower than the peak, pre-recession rate set in January. Sales were likely supported by price incentive use in April, with NAHB data indicating that two out of 10 builders used such business strategies. However, the use of price incentives eased in May, as median new home prices increased to $317,900, a gain of almost 2%, year-overyear. A new home sale occurs when a sales contract is signed or a deposit is accepted.

The home can be in any stage of the 
construction process: not yet started, under construction or completed. Regionally, new home sales were up in all four regions: 6.8% in the Northeast, 9.5% in the Midwest, 0.3% in the South, and 1.4% in the West. The gains for new home sales are consistent with the NAHB forecast that housing will lead any economic recovery.

NAHB ANNOUNCES NEW CHAIRMAN OF THE BOARD At the conclusion of NAHB's recent Spring Leadership Meetings, Chairman Dean Mon informed the Board of Directors he would be unable to complete the remainder of his term due to personal reasons and was resigning his chairmanship. Mon will continue to be an active member of the Federation, providing guidance to both NAHB leadership and members going forward. His leadership this year during the COVID-19 pandemic helped position the housing industry as an essential business that allowed NAHB members to continue working. Effective immediately, NAHB First Vice Chairman Chuck Fowke, a custom home builder from Tampa, Fla., will take on the duties of chairman. His chairmanship will continue through the 2022 International Builders’ Show, Feb. 8-10 in Orlando. Immediate Past Chairman Greg Ugalde will continue his duties as past chair during this same time period. Jerry Konter, of Savannah, Ga., will remain Second Vice Chair and Alicia Huey, of Birmingham, Ala., Third Vice Chair until the next senior officer election takes place at the 2021 Builders’ Show in Orlando on Feb. 11, 2021.
