LETTER FROM THE PRESIDENT PAT BAILEY 2019 MAB PRESIDENT
THE FUTURE IS BRIGHT Hello fellow MAB members, Happy New Year! I hope this letter finds that everyone had a great holiday and are looking forward to a successful and fulfilling 2019. This is my first letter to you as the 2019 MAB President and I can’t express how honored I am to serve as your president this next year. I look forward to my term as president and want to make it my main focus to grow the membership by 25 to 30 %. It will take all of our efforts, from the builder member, associate member, affiliate member, and the MAB Board of Directors. It is a lofty goal but if we all work together I think great things are achievable. I am excited in the direction the MAB is heading and can’t wait to see what 2019 has in store for us. From the 40 Below Council, Bags and Builders Cornhole Tournament, the Guns and Roses
Shootout, Birdie with the Builders, Builders’ Bash, and more. The turn out we have seen the past year at these events was awesome! Keep the involvement in the MAB coming! Membership and member involvement drive any successful association. That’s why I feel the future of the MAB is bright. I would also like to take a moment and thank Melissa for the last year as our President of the MAB and look forward to her continued involvement in the MAB and its future successes. I also want to express a thank the MAB membership and the Board of Directors for the continued support that you give selflessly to the MAB. STAYING CONNECTED
BUILDERS UNDER FIRE RESPONDING TO SOCIAL MEDIA ATTACKS Businesses increasingly rely on the internet and social media to attract and retain customers. Responding to online attacks is critical to maintain a strong online reputation. Even one incident can ruin a company’s reputation and cause customers to go elsewhere. Gone are the days when complaints were spread through mouth of word. Attacking a company online is easier and more effective. Anyone can post a bad Facebook review or damaging Twitter post. More sophisticated attackers can impersonate a company online, hack accounts, and reach millions of users often before a company ever notices.
PROACTIVE MEASURES
Harm posed by an attack is greater if the victim company has no detection or response plans in place. There are steps a company can take to limit the harm caused by an attack. MANAGE AND MONITOR. A company should invest in continuously monitoring its online presence. COMPLAINT PROCEDURE. A company should create clear procedures with a designated team to investigate and respond to posts containing damaging rumors or misleading information. The faster company responds to complaints, the more likely any single attack can be contained.
COMBATTING AN ATTACK
1 DO NOT ACT IMPULSIVELY OR RELTATIATE. The initial reaction to a social
media attack is to strike back. A vengeful response, without fully understanding the attack, can do more harm than good. Instead, take a deep breath, consider options and make a proper response.

2 IDENTIFY THE NATURE, SOURCE, AND EXTENT OF THE ATTACK. It is crucial (but not always easy) to identify the attackers. Anonymous posting is very common. If the attacker(s) cannot be identified, a company should at least identify the type of the attacker, who may be angry or dissatisfied. 3 EVAULATE POTENTIAL RESPONSES. A. Contact Media Platform. Contact the platform directly or utilize the provider’s reporting mechanisms. For example, Twitter and Facebook allow reporting and blocking of harmful or abusive users. If the damage can be contained using these procedures, this should be the first option. B. Contact the Known Attacker Directly. A disgruntled customer or employee may respond more positively if contacted personally. Research has found that approximately 1/3 of customers receiving a personal response to their negative review deleted the negative review and/or posted a positive review. C. Reaching Out to the Unknown Attacker. By posting a polite message asking the attacker to contact the company directly, a company may cure the underlying problem that triggered the online attack, and will show other viewers that the company is attentive to its customers. D. Issue Public Statement. The more individuals publicly expressing concern, the more appropriate a public statement becomes. The message should focus on affirmative steps taking to remedy a legitimate concern raised by an attacker. 4 LEGAL ACTION. A final option is to pursue legal action. While defamation
claims are notoriously difficult to prove, some organizations have been successful against blatant and unfair attackers.

Grow your business by growing your industry connections with 40 Below and 40 Above alike! What should you expect from Table Talk? At this new event sponsored by Tollefson’s Carpetland, we’ll enjoy drinks and appetizers from 4-4:30 PM. Then we’ll split up into groups and you’ll introduce yourself to four new friends at each table. You’ll answer questions about work, life and fun stuff! After a few minutes, we’ll switch tables and you’ll meet four new people! The goal of the evening is to build relationships in a lively, low pressure environment.
CONTRACTING CONCERNS
ASSOCIATION HEALTH PLANS MOVING FORWARD NAHB has been a long-time proponent of association health plans (AHPs), which empower small businesses to pool together to purchase health insurance plans for their employees. On Oct. 12, President Trump signed an executive order with NAHB First Vice Chairman Randy Noel standing by his side directing the Department of Labor (DOL) to implement new regulations to ease restrictions on AHPs. On Jun. 19, NAHB welcomed the issuance of a final rule by DOL expanding the ability of small businesses to join together locally or across state lines through a bona fide industry, professional, or trade association to become large purchasers of health insurance. Further, the new guidelines allow sole proprietorships and independent contractors to participate in an AHP, expanding access to affordable health coverage to small employers and selfemployed individuals. All associations (new or existing) may establish a fully-insured AHP on Sept. 1, 2018. Existing associations that sponsored an AHP on or before the date the final rule was published may restructure their AHP to be self-funded on Jan 1, 2019. All other associations (new or existing) may establish a self-funded AHP on April 1, 2019.
NAHB does not offer a health insurance benefit to our members at this time. NAHB has remained engaged with Congress, DOL and the White House on the new rule from start to finish and will continue to monitor its implementation. Through the work of a member-driven task force, we are determining what our best opportunities – and those of our affiliated HBAs – may be. Why It Matters Smaller employers face significant challenges in negotiating high-quality health care at costs that they and their employees can afford. AHPs can lower costs for employers and workers by putting small businesses on an equal footing with larger employers and unions when it comes to negotiating lower insurance rates. Moreover, with the construction industry facing a severe labor shortage, allowing small residential home building firms to offer competitive health care benefits at affordable rates will help them to attract and retain talented workers.

NEGOTIATE NOW American home builders need access to reasonably priced lumber to build homes that average working families can afford. However, U.S. domestic production is not sufficient to meet demand. And the Trump administration's 20-percent tariffs on imported Canadian softwood lumber are needlessly increasing lumber prices.

increased the price of an average single-family home by several thousands of dollars. This additional cost has effectively priced out more than 1.1 million households nationwide from the housing market. What's worse, large U.S. lumber companies are unfairly profiting at the expense of American families and small businesses. Why It Matters The tariffs on Canadian softwood lumber are acting as a tax on American home builders and home buyers, making housing less affordable for American families and forcing builders to look overseas to other markets, including Sweden, Germany and Russia, in order to meet demand. That is why it is imperative that the Trump administration resumes talks with Canada to find a long-term solution to the trade dispute that will ensure American home builders and consumers have access to a reliable supply of softwood lumber at reasonable prices. Solutions America cannot meet the nation’s demand for softwood lumber, therefore, NAHB believes the following steps should be taken:
•Rescind the lumber duties and negotiate a settlement to address American home builder concerns regarding price and availability of lumber. NAHB is meeting with representatives of the Trump administration and Congress, as well as Canadian federal and provincial officials, to achieve this goal, most recently sending a letter Oct. 3 to the president asking for a return to negotiations.
•Boost domestic production by seeking higher targets for timber sales from publicly-owned lands and opening up additional federal forest lands for logging in an environmentally sustainable manner.
•Reduce U.S. lumber exports. Domestic producers are selling abroad to China and other international clients in order to increase profits. Exporting timber should be discouraged when there is a gaping need at home.
•Seek out new markets to reduce our nation’s reliance on Canadian lumber imports and make up for our domestic shortfall. NAHB met with Chilean government, trade and industry officials that focused on increasing exports of softwood lumber to America. Other potential markets include Brazil.

While the federal government shutdown doesn't have an end in sight, North Dakota's legislature went back to work in early January and there's a number of bills going forward that could be significant. One of the top priorities will be Operation Prairie Dog, a bill Republicans introduced this summer which will get infrastructure money to counties and towns outside of North Dakota's oil country. Rep. Jason Dockter, R-Bismarck, says that bill will start in the taxation committee. North Dakota lawmakers are also looking to get rid of income tax on active and retired military members Other bills that will likely be looked at early on are marijuana decriminalization and record expungement changes. Rep Shannon Roers Jones, R-Fargo, who is working on these two, said in November these bills would be a continuation on some of the justice reinvestment bills from last session.

FLOOD CONTROL WORK CONTINUES Flood protection contractors executed one of the largest concrete pours to date, this will form lower walls of the Broadway Pump Station on the MI-1 4th Avenue flood protection project in Minot. The walls will be between 1.5 and 4 feet thick, and measure 26 feet high. It is estimated that 410 cubic yards of concrete will be needed, the equivalent of more than 40 truckloads. “It’s nice to see that contractors are taking advantage of warmer than average weather to catch up on their scheduled timeline of work in this area.” said David Ashley, Souris River Joint Board chairman. “Once the Maple Diversion is complete, this pump station will collect the storm water runoff from 2,260 acres of Minot – almost all of north Minot. With the underground utility work being done over the next couple of years, all that new piping and consequent water runoff will be directed to the pump station and not have to go through the base of the floodwalls. This makes the floodwalls, homes and businesses even more secure.” The Broadway Pump Station, a storm water pump station at the corner of Broadway and Fourth Avenue, makes up a substantial piece of the Phase MI-1 4th Avenue floodwall project, and when finished will be able to pump 180,000 gallons of water per minute. Park Construction anticipates substantial completion of the pump station in 2019. Once completed, the Broadway Pump Station will be one of, if not the largest storm water pump station in the state. The Phase MI-1 Fourth Avenue enhanced flood protection project is a six block stretch of levees, floodwalls, a new sanitary lift station, and a major storm water pump station from just west of Broadway to the east side of Third Street NE.
ARMSTRONG SWORN IN The 435 members of the U.S. House were sworn in together by House Speaker Nancy Pelosi, who was selected by the now majority Democrats. North Dakota Republican Kelly Armstrong was in that crowd taking the oath of office. Armstrong says he's ready to take up the fight over the wall, adding that it's just as important in North Dakota as it is on the southern border.
The House's first item of business is to pass a spending bill to reopen the part of the government that shut down that has no end in sight.

THE WARD COUNTY COMPREHENSIVE PLAN Ward County is in the process of developing a Comprehensive and Transportation Plan to help prepare the County for the future. The Plan is a tool to maintain and improve quality of life for the County’s residents and to build a more resilient County. Public input is essential to understanding the issues and opportunities facing the County now and in the future. Opportunities for public input will be announced through multiple communication techniques including this website. The Ward County Comprehensive Plan will be an official document adopted by the Ward County Board of County Commissioners as a policy guide, vision, and roadmap for the future. The planning process will focus on land use, transportation, and physical infrastructure especially in the rural part of the County. However, additional topics are expected to emerge during the public input activities. The planning process will identify critical topics and develop strategies to address these topics. The Comprehensive Plan is expected to be completed by March 2019, and will be followed by updates to the County’s zoning and subdivision regulations.

North Dakota Housing Finance Agency (NDHFA) is wrapping up a recordbreaking year. The state agency, known primarily for the affordable financing it offers through its FirstHome™ program, set a production record in 2018 by purchasing 1,798 loans with a total value of more than $300 million. “If the increased activity is indicative of more young families, both those new to North Dakota and life-long residents, pursuing homeownership, that’s good for all of North Dakota because homeowners are typically more invested in their community than renters,” said Jolene Kline, NDHFA executive director.
NDHFA’s loan production was 134 percent higher in 2018 than the previous year. Activity peaked in May when NDHFA received 246 reservations for $41.5 million in financing. The agency’s staff attributes some of the increased demand to the interest rates it was able to offer this past year. “A favorable market for the mortgage-revenue bonds that fund our FirstHome program allowed NDHFA to offer financing for most of the year at a rate that was lower than what was available in the conventional marketplace,” said Dave Flohr, NDHFA homeownership division director. “The one-half of one percent or more rate difference results in significant savings on monthly payments.” This past year, two-thirds of FirstHome program users also utilized the down payment and closing cost assistance NDHFA offers. “The assistance allows first -time buyers to enter the market sooner or to retain their savings for household expenses they didn’t have as renters like purchasing a lawn mower or snow blower,” said Flohr. The purchase price of single-family homes financed through NDHFA’s FirstHome program cannot exceed $271,164 to $303,882, depending on household size and the county in which the property is located. The average FirstHome loan purchased in 2018 was just under $166,000. The program is available to state residents earning up to $98,900 who have not owned a home in the last three years. The average FirstHome borrower’s household income in 2018 was $58,600. In addition to the FirstHome loans NDHFA purchased, the agency’s production total for the year includes its HomeAccesss loans, a program for special needs households who may have previously owned a home, and North Dakota Roots, a program that assists moderate-income buyers who may have previously owned a home and first-time buyers whose income exceeds the FirstHome program limits. In an average year, NDHFA purchases 1,200 loans. Private-sector lenders originate loans on the agency’s behalf in communities statewide and sell them to NDHFA when the loans close. Currently 47 financial institutions across the state are partnered with the agency to offer its financing. The greatest overall program use is in Cass and Burleigh/Morton counties. NDHFA is a self-supporting state agency dedicated to making housing affordable for all North Dakotans. The Industrial Commission of North Dakota, consisting of Governor Doug Burgum as chairman, Agriculture Commissioner Doug Goehring and Attorney General Wayne Stenehjem, oversees the agency. January 3rd is the first official day of the 66th Legislative Assembly. The ND Legislature is made up of two chambers. Two representatives and one senator are elected from each district. The House of Representatives has 94 members and the Senate has a total of 47. North Dakota is unique in that the legislature meets bi-annually in odd numbered years and are restricted to being able to meet a total of 80 days once gaveled in which means this session will end by April 26, 2019. I would first like to thank those who attended the Annual Meeting and Awards Banquet in Williston on November 29th. It’s always a welcome opportunity when we can host state-wide members along with local association members. Congratulations to all the award winners of their achievements this past year. Members who stand out and are revered by their peers, motivate us to all do what we can to support our industry and the state association. That same night, the 2019 North Dakota Association of Builders Board of Directors were installed along with myself in the role of President of which I am truly humbled. I want to thank Dan Lindquist for his support and know I have big shoes to fill following his presidency.
I’ll make a quick mention of the International Builders Show in Las Vegas which is February 18 – 21. We will again co-host the State Reception with other Area 10 state associations on Tuesday, February 19 at the Westgate. I urge all of you attending to stop in and say hello. This is a great way to build relationships with those in our area caucus.

Department of Homeland Security • E-Verify, the Internet-based system that allows businesses to determine the eligibility of their employees to work in the U.S., is unavailable due to the government shutdown. While E-Verify is unavailable, employers will not be able to access their E-Verify accounts. Small Business Administration • The SBA will not initiate new loan guarantees during the shutdown. Department of the Interior • Businesses who seek permits from the Fish and Wildlife Service could be affected. New permits or applications currently under review will not be processed during the government shutdown, which will increase costs and delays.
Internal Revenue Service • Some lenders require home borrowers to file IRS form 4506 -T to verify the mortgage applicant’s income and Social Security number. With the IRS shut down, this could result in major delays in some mortgage application approvals. • Taxpayer services will be suspended, meaning taxpayers will not be able to phone the IRS for advice and no refunds will be issued during an extended shutdown. Economic Data • Future reports on items like housing starts and new home sales could be postponed.

FEMA RESUMES FUNDING OF FLOOD INSURANCE PROGRAM DURING GOVERNMENT SHUTDOWN After the partial government shutdown threatened the funding of the National Flood Insurance Program (NFIP), FEMA announced tonight that NFIP insurers “may resume the sale, renewal, and monetary endorsements for flood insurance policies” effective since the program’s funding was renewed by Congress on Dec. 21. NAHB worked diligently to resolve the funding issue after FEMA abruptly announced on Wednesday that NFIP insurers and insurance agents could not sell or renew flood insurance policies backed by the program because of a lack of government funding due to the shutdown. This is an important victory for NAHB members after lawmakers agreed last week to extend NFIP funding through May 31, 2019. Congress requires all properties within the 100-year floodplain that are purchased with a federally backed mortgage to carry flood insurance. So it is essential that authorization for the program does not lapse. NAHB continues to work with Congress to achieve a long-term reauthorization of the NFIP that will keep the program fiscally sound and let builders provide safe and affordable housing.
