A Letter from our MRA President Dear supporters of Missouri Restaurant Association: What an honor and privilege it is to serve as the Missouri Restaurant Association’s 2016 President. 2016 marks the 100-year anniversary of our founding members’ first meeting in Kansas City. Back in 1916, gentlemen from across the region banded together to start a movement that grew into the National Restaurant Association. As your President, I have two goals. First, to increase our membership numbers and our members’ involvement at the chapter level and state level. Our organization was founded on the belief that working together we can make a difference. History has proven that when the Restaurant Association backs an idea we can be very persuasive in changing public policy and opinion. Our strength comes from the dedication and passion of our members. So, I encourage all of you to attend a local chapter meeting, join a committee and get involved. For those who have been supporting our organization for many years, now is the time to appoint a passionate person from your talented team. Together, we can strengthen the MRA as we continue to support all of our industry partners.

My second goal is to enhance our association benefits and to inform our members on the benefits of joining and retaining membership in the MRA. Did you know that you can pay for your membership many times over by simply utilizing our allied partner discount programs? Restaurateurs receive free membership in the National Restaurant Association and all of the benefits that the NRA offers. Industry-based insurance programs from endorsed providers who cater specifically to the restaurant industry have significantly reduced premiums for many members over the years. Helping missouri high schooL Students Achieve their culinary pursuits The Missouri ProStart Program is inspiring a new generation of talent, which will build the Missouri restaurant industry through real world education combined with classroom curriculum relevant to today’s evolving foodservice industry. Many high school students have a newfound interest in culinary arts and are applying themselves academically in other classes in order to be a part of the two-year restaurant management and culinary arts program. Each year, ProStart teams from across the state come together to compete in the Missouri ProStart Invitational. The culinary competition highlights the creative abilities of each team through the preparation of a three course meal in sixty minutes using only two butane burners. Management teams develop a proposal for an original restaurant concept and apply critical thinking skills to challenges restaurant managers face in day-to-day operations. The performance of teams in both the culinary and management events is observed and rated by expert judges from industry and academia. Those teams taking first place honors in each category receive an invitation to compete in the National ProStart Invitational held in mid-April each year in various host cities across the country. Exciting career opportunities await the over 4,000 students from more than 80 high schools in the state who participate, making Missouri one of the largest ProStart Programs in the country. ProStart is a two-year high

school Culinary Arts and Restaurant Management program developed by the National Restaurant Association Educational Foundation and administered in Missouri by the MRAEF, a 501(c)(3) organization established to support the educational objectives of the Missouri Restaurant Association, and the Missouri Department of Elementary and Secondary Education, Division of Family Consumer Sciences and Human Services. Members and non-members of the Missouri Restaurant Association can help to inspire and motivate our state’s youth by donating to the MRA Educational Foundation’s 501(c)(3) charitable organization. Educational Foundation

Supporting the educational goals of culinary and hospitality students across missouri The Missouri Restaurant Association and its affiliated chapters embrace the importance of education in helping to prepare students for the challenging restaurant and culinary industries. In addition to scholarships offered through the MRA, several chapters offer tuition assistance to post-secondary students in their respective areas of Missouri on an annual basis.

This great opportunity can enhance students’ educational endeavors, whether new to college or returning to school to pursue a life-long dream. Members may wish to encourage students in their area to contact Missouri Restaurant Association for additional information on scholarships available.

In 2015, MRA and its affiliated chapters were able to provide more than $75,000 in financial scholarships to deserving students studying for a career in the industry. This includes matching funds made possible through the matching scholarship program established by the National Restaurant Association Educational Foundation.

What is the National Certificate of Achievement and what are the requirements? The National Certificate of Achievement is given to students who are enrolled in the ProStart program and demonstrate excellence through academics and industry experience. To receive the certificate, a student must: • Complete both Year 1 and Year 2 of the approved ProStart program curriculum and pass the year-end assessment for each year. • Complete 400 hours of mentored internship at a restaurant or hotel. 150 hours may be accepted from participating in “alternative” hospitality-related jobs or activities. • Complete at least 50 of the 72 core competencies. Why is it easy to achieve? • Students may earn up to 150 hours of credit towards the 400-internship hour requirement by participating in “alternative” hospitality-related jobs or activities. These alternative hospitality related jobs may be paid or unpaid (due to the nature of the task). • The 400 hours of work experience must be completed within three years after taking the Year One examination. • Example: 10 hours/week over two summers and 150 flex hours equals 400 hours. And working over breaks or during the school year helps students achieve more hours even faster! What are the benefits for students? College Credit - Our National Passport showcases colleges and universities that have signed articulation agreements with the NRA Educational Foundation. In addition, our state may have additional locally signed agreements. These agreements allow students to receive college credit in entry-level hospitality courses. Scholarships - Students can apply for a $2,000 Scholarship from the NRAEF. Students who have earned the National Certificate of Achievement are better qualified to receive the scholarship. Advanced Work Placement - Students develop transferable skills and become more marketable. They will have enough work experience to show potential employers that they are management material on the fast track. Pursuing the National Certificate of Achievement helps motivate students to identify college and career goals. Throughout the 400 hours of work experience students rotate through the operation seeing a variety of career opportunities and paths.

The Missouri Restaurant Association represents the interests of the restaurant industry before the Missouri legislature with a continual presence at the Capitol in Jefferson City. Recognizing that many elected officials lack even an elementary understanding of the harmful impact various taxes, fees, and regulations can have on small businesses, jobs, and the Missouri economy, MRA works diligently to educate legislators and monitor legislation on your behalf.

There is strength in numbers. We need your voice at the Capitol.

MRA Political Action Committee

Washington DC Public Affairs Conference

MRA’s Political Action Committee raises funds to facilitate the election of a slate of pro-business legislators. Prior to making a contribution to the campaign of any candidate, the MRA PAC determines that the candidate is favorably disposed to legislation deemed important to the restaurant industry. Once legislators are elected, MRA monitors voting records to determine the extent to which any given legislator is standing with us.

In the spring of each year, a delegation of restaurateurs representing MRA and the restaurant industry in Missouri, attends the National Restaurant Association Public Affairs Conference. While in Washington, the delegation meets face-to-face with Missouri’s members of Congress to discuss issues of concern to the industry.

Over the years, MRA PAC has awarded thousands of dollars to pro-business candidates on both sides of the aisle. The funding has come from PAC donations by MRA members in amounts ranging from $25 to $500. It speaks to the fundamental essence of MRA: if everyone pitches in a little, the burden on any one member need not be onerous.

Legislative Day

MRA Legislative Updates and Calls to Action During the legislative session, MRA emails legislative updates and calls to action to members detailing bills and issues that are of importance to the restaurant industry in Missouri. It is our goal to keep our members abreast of possible legislation that could impact their business. Be sure to watch your inbox for this important information.

The MRA hosts an annual event in Jefferson City designed to bring together restaurant operators throughout Missouri to call on senators and representatives. Held early in the year’s legislative session, Legislative Day highlights MRA’s legislative initiatives and priorities for the year. The Legislative Day event begins at 9:00 a.m. with a breakfast meeting where members are briefed on the issues and educated on the most effective techniques for engaging with legislators. MRA staff members are available to schedule appointments with your senators and representatives if you desire. Taste of Missouri Legislative Day concludes with the Taste of Missouri, a food-focused event that is marked on the calendar of every Missouri senator and representative. As the legislators enjoy fare from Missouri restaurants in the Capitol Rotunda, members have additional opportunities to engage on the issues, and legislators leave with a remembrance of the excellence of the restaurants in our state.

Profit and Loss Statement Prior to the Wage Mandate

Protecting the restaurant industry from the unintended consequences of minimum wage mandates requires efficient and consistent communication with our elected officials. As demonstrated in Missouri in recent months, proponents of increasing the minimum wage are attempting to enact mandates at the city level. In the spring of 2015, separate measures were introduced in the cities of St. Louis and Kansas City for the purpose of enacting citywide mandates. Few outside the industry recognize the small profit margins generated by restaurants. Average pre-tax profit margins within the industry are roughly 4% of gross sales, and less in many sectors. Restaurants are also extremely labor intensive and, therefore, earn very low profit margins per employee. Currently, Missouri’s minimum wage is $7.65 per hour. The minimum cash wage paid to employees who receive tips is 50% of the prevailing minimum, or $3.825. If tips are insufficient to raise the tipped wage to the level of the minimum wage, the employer is required to make up the difference. To demonstrate the effect wage increases have on restaurants, consider Exhibit 1 – a typical profit and loss statement (“P&L”) of a modern casual dining restaurant prior to the wage mandate. The source of the information is the National Restaurant Association’s Restaurant Operations Report 2013 – 2014 (“report”) compiled by the certified public accounting firm Deloitte & Touche, LLP. Amounts indicated are median values for the 138 restaurants analyzed in the category, “FullService Restaurants – average check per person under $15.” The staffing level (19.3 full-time equivalent employees including management) and the ratio of non-tipped to tipped employees are within industry norms.

It is interesting and telling, that 30.6% of the 138 restaurants in this category that were analyzed in the report were operating at a loss. However, let’s begin the analysis with a typical P&L for the remainder of the group that was operating profitably in 2014. Note that this typical restaurant earns a pre-tax profit of $30,000, or 3% of total sales. The wage mandate, introduced in the City of St. Louis in May, proposes to increase the minimum wage according to the following schedule:

Moving forward to 2016, when the minimum wage would rise to $10.00 and the tipped wage to $5.00, we can recast the restaurant’s P&L using a few very realistic assumptions to demonstrate the drastic impact of the wage mandate. Refer to Exhibit 2 – a projected P&L for the same restaurant in 2016.

The following assumptions were used to calculate the changes used in Exhibit 2. 1. The restaurant will increase menu prices by an average of 3%. The average menu price growth over the past ten years has been 2.9%. The last time average menu prices increased by as much as 5%, according to the Bureau of Labor Statistics, was 1982. Some claim price increases are the simple offset to raising the minimum wage. However, the demand for restaurant meals has proven to be extremely sensitive to price increases.

It is readily apparent that a rise in the minimum wage to $10, which increases total labor costs by $72,000, will create a real hardship. Whereas before, a profit of $30,000 was achieved, the restaurant can now be reasonably expected to suffer a net loss of $28,700. The analysis can be completed by including the realistic assumption that all other costs will increase by the Federal Reserve’s 2% targeted inflation rate each year. Consider Exhibit 3, where the following expense categories were increased by 2% each year.

2. The cost of food purchased for resale will increase by 5.5%. This equals the percentage change in average wholesale food prices in the past year according to the Producer Price Index – All Foods. Some commodities registered much stronger growth than the average, such as beef (19.1%), eggs (17.8%), cheese (13.9%) and unprocessed fish (19.9%).

3. All expenses other than food and labor will remain unchanged. Of course, this is not realistic. The Federal Reserve Bank’s stated target rate of inflation is 2% per year. However, it is useful to look at the effect of just the wage increase combined with realistic expectations of increases in menu prices and cost of food purchased for resale.

It can be seen, the restaurant will struggle to comply with the wage increases contained in the mandate which cause total labor costs to increase by nearly $210,000 by the end of 2020. The restaurant that once achieved a modest profit of $30,000 now is projected to lose $147,100 in 2020. A business cannot, and will not continue at this level of financial loss. The restaurant’s ownership will be forced to make some difficult decisions.

Among the options likely to be considered include the adoption of operating models that are less labor intensive and require fewer employee hours, relocating to a municipality or state outside the city limits, or closing the restaurant. Clearly something must be done and in relatively short order. As demonstrated, even the first increase in the wage mandate to $10 will cause the restaurant to operate at a loss in the absence of significant changes.

If the goal is to assist the working poor, there are better ways to accomplish that end without creating the collateral damage of job loss and increased costs to Missouri businesses resulting from a minimum wage increase. The federal Earned Income Tax Credit, created in 1975, has proven to be an effective means of assisting the working poor while creating an

A Bit of History The restaurant trade association movement traces its roots to Missouri. The forerunner of the restaurant movement was the Kansas City Business Men’s Association, when in 1916, local operators banded together to resist encroachment on their business. In 1919, these individuals gathered other restaurateurs from around the nation to form the National Restaurant Association. The NRA was headquartered in Kansas City until 1926, when the office was moved to Chicago. In 1935, a charter was granted to the Missouri Restaurant Association.
