UNOPPOSED MOTION FOR EXTENSION OF TIME COME NOW The Kroger Co. (“Kroger”), E&A Southeast Limited Partnership (“E&A”), and Fulton Improvements, LLC (“Fulton”), by and through their respective counsel of record, and file this their Motion for Extension of Time for them to file their response to Plaintiff’s Motion in Limine to Exclude Testimony of James Monohan (“Plaintiff’s Motion in Limine”) [Doc. No. 263], their supporting memorandum, and any evidence, and in support thereof would state unto the Court as follows, to-wit: 1.
Pursuant to this Court’s Order of August 2, 2013, the deadline for filing motions
was October 8, 2013. On October 8, 2013, Plaintiff, Kmart Corporation (“Kmart”), filed several motions to exclude testimony, see Doc. Nos. 255, 257, 262, 263. One of the motions to exclude filed by Kmart sought exclusion of a portion of James Monohan’s testimony. [See Doc. No. 263] Mr. Monohan has been engaged as an expert witness by Kroger, E&A Southeast Limited Partnership (“E&A”), and Fulton Improvements, LLC (“Fulton”). Under the Federal Rules of Civil Procedure and the Local Rules, the Movants’ response, supporting memorandum, and any supporting evidence are currently due to be filed on October 25, 2013.

In the interests of judicial economy, Kroger, E&A, and Fulton intend to file a
joint response to Plaintiff’s Motion to Exclude. Due to the demands in the schedules of counsel for Kroger, E&A, and Fulton, the number of pending motions which require a response in this action by the current deadline, and in order to facilitate the preparation and filing of a joint response as opposed to three separate ones, Movants request an extension of time in the amount of seven days, i.e. through and until November 1, 2013, for them to file their response, supporting memorandum, and any evidence to Plaintiff’s Motion in Limine. 3.
Counsel for Kmart Corporation has advised that they are agreeable to said
extension. 4.
Movants are unaware of any prejudice that would result from the granting of this
Motion. WHEREFORE, PREMISES CONSIDERED, Kroger, E&A, and Fulton request that this Court enter an Order extending their deadline to file their response, supporting memorandum, and any evidence to Plaintiff’s Motion in Limine through and until Friday, November 1, 2013.
